		<official-title>To require States receiving funds under the Elementary
		  and Secondary Education Act of 1965 to establish policies with respect to the
		  auditing of charter schools.</official-title>

		<section id="H7328DDF47F9A49D78D23724D500804C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Charter
			 School Good Governance and Transparency Act</quote>.</text>
		</section><section id="H11D96DFFCC9D413A8A75A4DD98D683EC"><enum>2.</enum><header>Charter school
			 audits</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, each State educational agency
			 receiving funds under the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6301 et seq.) shall—</text>
			<paragraph id="H9916DC97F420445F86AA9D36007C3BBF"><enum>(1)</enum><text display-inline="yes-display-inline">disseminate to each charter school in the
			 State receiving funds under such Act (20 U.S.C. 6301 et seq.) a list of
			 licensed, independent auditors that perform governmental audits;</text>
			</paragraph><paragraph id="H18705033EA3D4FF99025BC857C6C36A1"><enum>(2)</enum><text>develop and
			 implement a policy requiring each such charter school to—</text>
				<subparagraph commented="no" id="H01BD3B8A24A54868A4A890B4325E6A52"><enum>(A)</enum><text>maintain its
			 financial records in accordance with generally accepted accounting principles,
			 and applicable State and Federal requirements;</text>
				</subparagraph><subparagraph commented="no" id="HB3B380D46F294E77A2CCE2CE630C4693"><enum>(B)</enum><text display-inline="yes-display-inline">be subject to an annual audit by a
			 licensed, independent auditor the results of which are public and filed
			 with—</text>
					<clause id="HA3920981742D42EE932F298631A0FF42"><enum>(i)</enum><text>the
			 authorized public chartering agency that authorized or approved the school;
			 and</text>
					</clause><clause id="HE983CB924CE14D77A1E0E804F18EA99B"><enum>(ii)</enum><text>the
			 office within the State educational agency that oversees education finance;
			 and</text>
					</clause></subparagraph><subparagraph id="HFC4CCF237DE1409F83B048BF99533BBB"><enum>(C)</enum><text display-inline="yes-display-inline">adopt policies and implement practices
			 to—</text>
					<clause id="H3659FAE5C72B4DD6A3702D9730F2B03B"><enum>(i)</enum><text>address all audit
			 findings; and</text>
					</clause><clause id="H1B95941E15294A53AC07222A49E257C3"><enum>(ii)</enum><text>report to the
			 authorized public chartering agency that authorized or approved the school the
			 actions taken by the school to address the audit findings;</text>
					</clause></subparagraph></paragraph><paragraph id="H137BF8E9627F4BBCB2719D4CAFC300A9"><enum>(3)</enum><text display-inline="yes-display-inline">develop and implement a policy requiring
			 each authorized public chartering agency that authorizes or approves schools
			 described in
			 <internal-xref idref="H9916DC97F420445F86AA9D36007C3BBF" legis-path="2.(1)">paragraph (1)</internal-xref> to report to the State
			 educational agency—</text>
				<subparagraph id="H50CBA096B53B49BB81F5B0354725A45F"><enum>(A)</enum><text>instances of
			 significant audit findings for each such school; and</text>
				</subparagraph><subparagraph id="HD1A1C1146CE545DDBE967A3CF408F54A"><enum>(B)</enum><text>the corresponding
			 actions reported by each such school to address such findings; and</text>
				</subparagraph></paragraph><paragraph id="HAE972832F3C04A57891EF7B17B4E0F87"><enum>(4)</enum><text display-inline="yes-display-inline">not later than 9 months after an audit is
			 completed pursuant to
			 <internal-xref idref="HB3B380D46F294E77A2CCE2CE630C4693" legis-path="2.(2)(B)">paragraph (2)(B)</internal-xref>, and annually
			 thereafter, prepare and submit to the Secretary of Education an overall summary
			 analysis of the audit results received under such paragraph.</text>
			</paragraph></section><section id="H3C268701281644FB86507D4965C82E9C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="HC86406325C3C4845934C0231AED3D86B"><enum>(1)</enum><text>the term
			 <quote>authorized public chartering agency</quote> has the meaning given the
			 term in section 5210 of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 7721i);</text>
			</paragraph><paragraph id="H8BB5846B732F455D913616302E5DF486"><enum>(2)</enum><text>the term
			 <quote>charter school</quote> has the meaning given the term in section 5210 of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7721i), except
			 that meaning shall be applied by substituting <quote>except as otherwise
			 provided pursuant to section 2, or other State or Federal law</quote> for
			 <quote>unless such requirements are specifically waived for the purpose of this
			 program</quote>; and</text>
			</paragraph><paragraph id="H17474301B1CD4B93B3242FE52301458E"><enum>(3)</enum><text>the term
			 <quote>State educational agency</quote> has the meaning given such term in
			 section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7801).</text>
