<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend part A of title XI of the Social Security Act to provide for a 1-year extension of the authorizations for the Work Incentives Planning and Assistance program and the Protection and Advocacy for Beneficiaries of Social Security program.</official-title>

<section id="H61E81E65374B4686ABB60C4E373E19F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>WIPA and PABSS Extension Act of 2010</short-title></quote>.</text> </section> 
<section id="H297BA34FC5DA409793CF33F172CDCF65"><enum>2.</enum><header>Extension of authorizations for the Work Incentives Planning and Assistance program and the Protection and Advocacy for Beneficiaries of Social Security program</header> 
<subsection id="HCDD91A7AA16244E09532F2D56015B7BA"><enum>(a)</enum><header>Work incentives planning and assistance</header><text display-inline="yes-display-inline">Section 1149(d) of the Social Security Act (42 U.S.C. 1320b–20(d)) is amended by striking <quote>2010</quote> and inserting <quote>2011</quote>.</text> </subsection> 
<subsection id="H0BD61EB49C2A4A26B9083BEC68A02AEA"><enum>(b)</enum><header>Protection and advocacy for beneficiaries of social security</header><text>Section 1150(h) of such Act (42 U.S.C. 1320b–21(h)) is amended by striking <quote>2010</quote> and inserting <quote>2011</quote>.</text> </subsection></section> 
<section display-inline="no-display-inline" id="HE0D9295D54AB47D6B9C7DDF9125BFB34" section-type="subsequent-section"><enum>3.</enum><header>Conforming changes to the Work Incentives Planning and Assistance program</header> 
<subsection id="H635DA9C0BC11481FAFD78998971E4E1B"><enum>(a)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Section 1149 of the Social Security Act (as amended by section 2(a)) is further amended by redesignating subsections (c) and (d) as subsections (d) and (e), respectively, and by inserting after subsection (b) the following new subsection:</text>

<subsection id="H53479FBBAC744E588EF80922F4E90755"><enum>(c)</enum><header>Annual report</header><text display-inline="yes-display-inline">Each entity awarded a grant, cooperative agreement, or contract under this section shall submit an annual report to the Commissioner on the benefits planning and assistance provided to individuals under such grant, agreement, or contract.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H8E3A14B374E14C4EAB7C2105692E60E6"><enum>(b)</enum><header>One-Year carryover</header> 
<paragraph id="H087A868D0F4446AFAC793673BC13FBD2"><enum>(1)</enum><header>In general</header><text>Section 1149(b)(4) of such Act (42 U.S.C. 1320b–20(b)(4)) is amended—</text> 
<subparagraph id="H1C3D9628F352412FAEC5FD0DFA98BAE3"><enum>(A)</enum><text>by striking <quote>(4) <header-in-text level="paragraph" style="OLC">Allocation of costs</header-in-text>.—The costs</quote> and inserting the following:</text>

<subparagraph id="H08487A0A958E4F20B0441132EA14E164"><enum>(A)</enum><header>Allocation of costs</header><text display-inline="yes-display-inline">The costs</text> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph> 
<subparagraph id="H3FCAF6E1B1784A85BB13464CCB49B9C3"><enum>(B)</enum><text>by adding at the end the following:</text>

<subparagraph id="H7A0A8162A8FC4454B482F798BB4F8F6F"><enum>(B)</enum><header>Carryover</header><text display-inline="yes-display-inline">An amount not in excess of 10 percent of the total amount obligated through a grant, cooperative agreement, or contract awarded under this section for a fiscal year to a State or a private agency or organization shall remain available for obligation to such State or private agency or organization until the end of the succeeding fiscal year. Any such amount remaining available for obligation during such succeeding fiscal year shall be available for providing benefits planning and assistance only for individuals who are within the caseload of the recipient of the grant, agreement, or contract as of immediately before the beginning of such fiscal year.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph> 
<paragraph id="HC98573E741524E4DA0ADDE6ED42571C0"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply with respect to amounts allotted under section 1149 of the Social Security Act for payment for a fiscal year after fiscal year 2010.</text> </paragraph></subsection></section>
