		<official-title>To amend title XIX of the Social Security Act to remove
		  the exclusion from medical assistance under the Medicaid Program of items and
		  services for patients in an institution for mental diseases.</official-title>

		<section id="HD61A61E5B4A544999FF7BAF1FC9871F0" section-type="section-one"><enum>1.</enum><header>Removal of Medicaid exclusion
			 from medical assistance of items and services furnished to patients in an
			 institution for mental diseases</header>
			<subsection id="HF8BC9EF10D454B64AD00708CB03D4DA6"><enum>(a)</enum><header>In
			 general</header><text>The first sentence of section 1905(a) of the Social
			 Security Act (42 U.S.C. 1396d(a)) is amended, in the matter following paragraph
			 (28)—</text>
				<paragraph id="H34A4652165EE4998ACD6D4015B00D141"><enum>(1)</enum><text>by striking
			 <quote>such term does not include—</quote> and <quote>(A) any</quote> and
			 inserting <quote>such term does not include any</quote>;</text>
				</paragraph><paragraph id="H160338AA0F91451ABC6053D26D3C5ECD"><enum>(2)</enum><text>by striking
			 <quote>; or</quote> and inserting a period; and</text>
				</paragraph><paragraph id="H5169FE2CB60A4CCF91D9E14290DE0066"><enum>(3)</enum><text>by striking
			 subparagraph (B).</text>
				</paragraph></subsection><subsection id="H1F88C87E77E54FF28041DF22F98013C2"><enum>(b)</enum><header>Conforming
			 amendments To permit medical assistance for IMD patients under 65 years of
			 age</header><text>The following provisions of such Act are each amended by
			 striking <quote>65 years of age or older</quote> each place it appears:</text>
				<paragraph id="HF962F9DBE92444679D71473F6157281E"><enum>(1)</enum><text>Paragraphs (20)
			 and (21) of section 1902(a) (42 U.S.C. 1396b(a)).</text>
				</paragraph><paragraph id="H1979FBDF07414A1BBE12A19143B7311D"><enum>(2)</enum><text>Section
			 1905(a)(14) (42 U.S.C. 1396d(a)(14)).</text>
				</paragraph><paragraph id="H19CCF5E606DD4246B5BD2D168EA91830"><enum>(3)</enum><text>Section
			 1919(d)(7)(B)(i)(I) (42 U.S.C. 1396r(d)(7)(B)(i)(I)).</text>
				</paragraph></subsection><subsection id="H35737871CEA043FE869C6CF80264355"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 October 1, 2009, and shall apply to items and services furnished on or after
			 such date.</text>
