		<official-title>To provide for additional district court judges for
		  certain judicial districts, and to provide for the cross-designation of special
		  assistant United States attorneys to prosecute certain border-related offenses,
		  and for other purposes.</official-title>

		<section id="HB95403D8BEC1421290CE6A21ECAF862D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ensuring Justice Along the Southwest
			 Border Act of 2010</short-title></quote>.</text>
		</section><section id="H5155DD1EDA08427AB7A5AC77390CEAFA"><enum>2.</enum><header>Additional
			 Judgeships for certain judicial districts</header>
			<subsection id="HB65F57B35A194E5F9744B869F4DB3D40"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The President shall
			 appoint, by and with the advice and consent of the Senate—</text>
				<paragraph id="H7029CC32FC6042498DD0FC9E93D65E44"><enum>(1)</enum><text>1
			 additional district judge for the district of Arizona;</text>
				</paragraph><paragraph id="HB3AC55821F054ECCA5D027D38E33E0F8"><enum>(2)</enum><text>4
			 additional district judges for the eastern district of California;</text>
				</paragraph><paragraph id="H67379A7B060541E9AE28A3B4DBE1B65F"><enum>(3)</enum><text>4
			 additional district judges for the central district of California;</text>
				</paragraph><paragraph id="H33BECA180159418D9298591B415923E8"><enum>(4)</enum><text>4
			 additional district judges for the northern district of California;</text>
				</paragraph><paragraph id="H584FC6C355174D6CBF358BA97590F92A"><enum>(5)</enum><text>1
			 additional district judge for the district of New Mexico;</text>
				</paragraph><paragraph id="H64CF4BB58F6C4D139C5A217CADA92B59"><enum>(6)</enum><text>2
			 additional district judges for the southern district of Texas;</text>
				</paragraph><paragraph id="H0C49B0A350AE49A186270D1111F7F399"><enum>(7)</enum><text>1
			 additional district judge for the eastern district of Texas; and</text>
				</paragraph><paragraph id="HE34CAAE72FB14FA283F05EE9933BFD49"><enum>(8)</enum><text>4
			 additional district judges for the western district of Texas.</text>
				</paragraph></subsection><subsection id="H01D80292889747978DC0523E6C1A9022"><enum>(b)</enum><header>Existing
			 Judgeships</header><text display-inline="yes-display-inline">The existing
			 judgeships for the district of Arizona, the eastern district of Texas, and the
			 district of New Mexico authorized by section 312(c) of the 21st Century
			 Department of Justice Appropriations Authorization Act (Public Law 107–273, 116
			 Stat. 1758), as of the effective date of this Act, shall be authorized under
			 section 133 of title 28, United States Code, and the incumbents in those
			 offices shall hold the office under section 133 of title 28, United States
			 Code, as amended by this Act.</text>
			</subsection><subsection id="H2EA37AB8545F409CA52CF17870BE1653"><enum>(c)</enum><header>Temporary
			 Judgeship</header>
				<paragraph id="HCAB734313CD947558FBD49DE5FD5481F"><enum>(1)</enum><text>The President
			 shall appoint, by and with the advice and consent of the Senate—</text>
					<subparagraph id="H811B39A167404EF0A2989CB0F64EF709"><enum>(A)</enum><text>1 additional judge
			 for the district of Arizona;</text>
					</subparagraph><subparagraph id="H029A39E770C44B8081AD7C8F5A93AE5F"><enum>(B)</enum><text>1 additional judge
			 for the eastern district of California;</text>
					</subparagraph><subparagraph id="H4E7CAF1530FA49CC9B708C213278DBCA"><enum>(C)</enum><text>1 additional judge
			 for the central district of California; and</text>
					</subparagraph><subparagraph id="HAB848A151D9D47F2BDCC887222BFD715"><enum>(D)</enum><text>1 additional judge
			 for the northern district of California.</text>
					</subparagraph></paragraph><paragraph id="H745D3FD64DE3495F93E9C28023DA354C"><enum>(2)</enum><text>The first vacancy
			 in the office of district judge in each judicial district to which a judge is
			 appointed under paragraph (1), occurring 10 years or more after the date of
			 enactment of this Act, shall not be filled.</text>
				</paragraph></subsection><subsection commented="no" id="HF382A08C9E944DABB0946161E766485C"><enum>(d)</enum><header>Tables</header><text display-inline="yes-display-inline">In order that the table contained in
			 section 133(a) of title 28, United States Code, will, with respect to each
			 judicial district, reflect the changes in the total number of permanent
			 district judgeships authorized as a result of subsections (a) and (b) of this
			 section, such table is amended—</text>
				<paragraph commented="no" id="HE8146A70B19B420298FA1D1803070EFD"><enum>(1)</enum><text>by striking the
			 item relating to Arizona and inserting the following:</text>

				</paragraph></subsection><subsection id="H165163F65EED45F6BBFFD253F4E1EE7C"><enum>(e)</enum><header>Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section, including such sums as may be necessary to provide appropriate space
			 and facilities for the judicial positions created by this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H0C1FCFCF87F54A7EA5FC4D04552C6BC1" section-type="subsequent-section"><enum>3.</enum><header>Special assistant
			 United States attorneys' program</header>
			<subsection commented="no" id="HFDD260FDD8BF454EB636020F0758AA4F"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General shall allocate any amounts
			 appropriated pursuant to the authorization under subsection (c) for the hiring
			 and training of special assistant United States attorneys.</text>
			</subsection><subsection commented="no" id="HA26A7BEE74A04F14B871C7199014CFBC"><enum>(b)</enum><header>Use of
			 funds</header><text>The funds allocated under subsection (a) shall be used
			 to—</text>
				<paragraph commented="no" id="H9A4B5A7CD8634687BB38B0A2B4378C4D"><enum>(1)</enum><text>train local
			 prosecutors in techniques used to prosecute border-related offenses
			 cases;</text>
				</paragraph><paragraph commented="no" id="HC716836CBF0742518FA012BCE266D07C"><enum>(2)</enum><text>train local
			 prosecutors in Federal and State laws relating to border-related
			 offenses;</text>
				</paragraph><paragraph commented="no" id="H7DE040EEB6374D2FB4B5B3087CD3155C"><enum>(3)</enum><text>cross-designate
			 local prosecutors as special assistant United States attorneys; and</text>
				</paragraph><paragraph commented="no" id="H041E938690A14FD7983F028983798FD2"><enum>(4)</enum><text>hire additional
			 local prosecutors who—</text>
					<subparagraph commented="no" id="H738C0F2191934923ABA3269992F5D06A"><enum>(A)</enum><text>with the approval
			 of the United States attorney, shall be cross-designated to prosecute both
			 Federal and State border-related offenses cases; and</text>
					</subparagraph><subparagraph commented="no" id="HD95846B09F0146C5A24885729BC7BB76"><enum>(B)</enum><text>shall be assigned
			 a caseload, whether in State court or Federal court, that gives the highest
			 priority to cases in which—</text>
						<clause commented="no" id="H751987EDF71B4DE482EFD440148ACE53"><enum>(i)</enum><text>charges of
			 border-related offenses are submitted by law enforcement for consideration;
			 and</text>
						</clause><clause commented="no" id="H927A991409DE4A3EBB858FB7399F238F"><enum>(ii)</enum><text>the defendant has
			 been previously convicted of a border-related offense.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HB029D4EECCEB43C9B2CFB5F1F89D2051"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as may be necessary to carry out the provisions of this section.</text>
			</subsection><subsection id="HEE4FC2BC8E2443C9B65415E563EB8FC7"><enum>(d)</enum><header>Definition</header><text>In
			 this section, the term <term>border-related offense</term> means any of the
			 following:</text>
				<paragraph id="H5EECBAADDC4D4C5FAB8B49C1A79E545B"><enum>(1)</enum><text display-inline="yes-display-inline">Any offense under section 274(a), 274C(e),
			 275, 276, 277, or 278 of the Immigration and Nationality Act (8 U.S.C. 1324(a),
			 1324c(e), 1325, 1326, 1327, 1328).</text>
				</paragraph><paragraph id="H0877028ECFB949FDBCE931775644E71C"><enum>(2)</enum><text>Any offense under
			 section 545 or 546 of title 18, United States Code, if the relevant merchandise
			 is a controlled substance.</text>
				</paragraph><paragraph id="HB8516FAE805A4245BCB06BAFBB96CE0E"><enum>(3)</enum><text>Any offense under
			 section 1010, 1012, or 1013 of the Controlled Substances Act (21 U.S.C. 960,
			 962, 963).</text>
				</paragraph><paragraph id="H118039F3C18F489E861F6E2D014EF1AD"><enum>(4)</enum><text>Any offense under
			 chapter 69 of title 18, United States Code.</text>
				</paragraph><paragraph id="H5438189DC1744EA2AE24D21E42896180"><enum>(5)</enum><text>Any offense under
			 section 2424 of title 18, United States Code.</text>
