<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend the Water Resources Development Act of 2000 to extend and modify the program allowing the Secretary of the Army to accept and expend funds contributed by non-Federal public entities to expedite the evaluation of permits, and for other purposes.</official-title>

<section id="HBDC1B36AE28842B8BEA6F033C8EC5801" section-type="section-one"><enum>1.</enum><header>Funding to process permits</header><text display-inline="no-display-inline">Section 214 of the Water Resources Development Act of 2000 (33 U.S.C. 2201 note; 114 Stat. 2594; 117 Stat. 1836; 119 Stat. 2169; 120 Stat. 318; 120 Stat. 3197; 121 Stat. 1067; 123 Stat. 3478) is amended—</text> 
<paragraph id="HEE30B350B1D64E8DA2C27DB3CCA67A09"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> 
<quoted-block style="OLC" id="HCFD09DA439FE47AAA6C7BCAC64FD98F8" display-inline="no-display-inline"> 
<subsection id="H4F589EAABB094DC485C97D40AF39C75F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, after public notice, may accept and expend funds contributed by a non-Federal public entity to expedite the evaluation of a permit of that entity related to a project or activity for a public purpose under the jurisdiction of the Department of the Army.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H313DEBECB8E74A2789BE4B55B7B37303"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (e);</text></paragraph> 
<paragraph id="H1474E3F85165475FA06483149252496C"><enum>(3)</enum><text>by striking subsection (b) and inserting the following:</text>

<subsection id="H8787AF6692DF4EAE8B6EAD73401A4F12"><enum>(b)</enum><header>Effect on permitting</header> 
<paragraph id="H9E15F4B0D9B940CD872DDBB62DCFBC08"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary shall ensure that the use of funds accepted under subsection (a) will not impact impartial decisionmaking with respect to permits, either substantively or procedurally.</text></paragraph> 
<paragraph id="H0C4986E727A744A4939ACB90D7AA8666"><enum>(2)</enum><header>Impartial decisionmaking</header><text>In carrying out this section, the Secretary shall ensure that the evaluation of permits carried out using funds accepted under this section shall—</text> 
<subparagraph id="HB536D425CD7D4FD3B26F74D57FE2FD57"><enum>(A)</enum><text>be reviewed by—</text> 
<clause id="H2F655622561E4DA5A0F2FAD96517FDD7"><enum>(i)</enum><text>the District Commander, or the Commander’s designee, of the Corps District in which the project or activity is located; or</text></clause> 
<clause id="HB4059DE1DCD949A0A54380A1F4A02775"><enum>(ii)</enum><text>the Commander of the Corps Division in which the District is located if the evaluation of the permit is initially conducted by the District Commander; and</text></clause></subparagraph> 
<subparagraph id="H663801E7EB45407B96C279B91AE48036"><enum>(B)</enum><text>utilize the same procedures for decisions that would otherwise be required for the evaluation of permits for similar projects or activities not carried out using funds authorized under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H3F89DCD938654DBCA328D4A47FB7D181"><enum>(c)</enum><header>Limitation on use of funds</header><text>None of the funds accepted under this section shall be used to carry out a review of the evaluation of permits required under subsection (b)(2)(A).</text></subsection> 
<subsection id="H91BC3005B3B9440AABBB6BDC4D4E37F9"><enum>(d)</enum><header>Public availability</header><text>The Secretary shall ensure that all final permit decisions carried out using funds authorized under this section are made available to the public, including on the Internet.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9C1BDA421EE447CA9E33085BC7D3F47F"><enum>(4)</enum><text>in subsection (e) (as redesignated) by striking <quote>2010</quote> and inserting <quote>2016</quote>.</text></paragraph></section> 
<section id="H8D8874F1E3124D079D81627DEFA17E29"><enum>2.</enum><header>Compliance with Statutory Pay-As-You-Go Act of 2010</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section>
