		<official-title>To amend the Federal Water Pollution Control Act to
		  authorize the Administrator of the Environmental Protection Agency to make
		  additional capitalization grants to the water pollution control revolving funds
		  of States that adopt smart growth principles.</official-title>

		<section id="HE6275CBCA3C94DB98A94A0D62C267645" section-type="section-one"><enum>1.</enum><header>Smart growth
			 allotments</header><text display-inline="no-display-inline">Section 604 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1384) is amended by adding at
			 the end the following:</text>

				<subsection id="HE7EE65D2545E40298F9737EBFF83B507"><enum>(d)</enum><header>Smart growth
				allotments</header>
					<paragraph id="H028FA7EEE6634659AE00393DC76F61B6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In addition to making
				capitalization grants under section 601(a) for a fiscal year, the Administrator
				shall make available funds for distribution among eligible States under a
				formula to be determined by the Administrator.</text>
					</paragraph><paragraph id="H27F947D15A154A44ADAB4E7801507172"><enum>(2)</enum><header>Use of
				funds</header><text>Funds distributed to a State under paragraph (1) shall be
				available to the State for the purposes described in section 601(a) and shall
				be subject to the same terms and conditions as apply to capitalization grants
				made under that section.</text>
					</paragraph><paragraph id="H912323BCB73E48179D8E2767B9B603CF"><enum>(3)</enum><header>Eligible
				States</header><text>In this subsection, the term <quote>eligible State</quote>
				means a State that has adopted smart growth principles, as determined by the
				Administrator.</text>
					</paragraph><paragraph id="HD261C54E2E634DBD9E2A1E4B22E34BB4"><enum>(4)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated for fiscal
				year 2011, and each fiscal year thereafter, to carry out this subsection a sum
				equal to 5 percent of the amount made available for capitalization grants under
				section 601(a) for the fiscal
				year.</text>
