		<official-title>To amend the conservation provisions of the Food Security
		  Act of 1985 to promote the conservation and improvement of the soil, water, and
		  wildlife resources of lands containing muck soils, and for other
		  purposes.</official-title>

		<section id="HF96837B06C054E6885519930DDF395A3" section-type="section-one"><enum>1.</enum><header>Muck soils
			 conservation</header><text display-inline="no-display-inline">Title XII of the
			 Food Security Act of 1985 is amended by inserting after section 1240R (16
			 U.S.C. 3839bb–5) the following new section:</text>

				<section id="H756993F61AD547D2BB1F1815B90D6C75"><enum>1240S.</enum><header>Conservation
				of land containing muck soils</header>
					<subsection id="H90252A04FAE14954BBD125F8E51C86D6"><enum>(a)</enum><header>Establishment of
				program</header><text display-inline="yes-display-inline">The Secretary of
				Agriculture shall carry out a conservation program under which the Secretary
				makes payments to assist owners and operators of eligible land specified in
				subsection (b) to conserve and improve the soil, water, and wildlife resources
				of such land.</text>
					</subsection><subsection id="H27E5ECD6B8FB49F581C2464D67FC6D5D"><enum>(b)</enum><header>Eligible
				land</header><text display-inline="yes-display-inline">To be eligible for
				inclusion in the program established under this section, the land must—</text>
						<paragraph id="H8F0613B335EC41D08288497CE2EEC9A5"><enum>(1)</enum><text display-inline="yes-display-inline">be comprised of soil that qualifies as
				muck, as determined by the Secretary;</text>
						</paragraph><paragraph id="HA2BFDA69B9914231886CECFD30A2F83E"><enum>(2)</enum><text>be used for
				production of an agricultural crop;</text>
						</paragraph><paragraph id="H8C71557ABBA9400EB6F5789E84527F88"><enum>(3)</enum><text>have a spring
				cover crop planted in conjunction with the primary agricultural crop referred
				to in paragraph (2);</text>
						</paragraph><paragraph id="H39FDA676CE5B46A5AE7807A80157A7D5"><enum>(4)</enum><text>have a winter crop
				planted; and</text>
						</paragraph><paragraph id="HD8AE141E2D694472AD57CAD848593BDA"><enum>(5)</enum><text>have ditch banks
				seeded with grass that is maintained on a year-round basis.</text>
						</paragraph></subsection><subsection id="HFC3C984FA3AA43D18CBDACDB465A2199"><enum>(c)</enum><header>Payment
				amounts</header><text display-inline="yes-display-inline">The Secretary may
				provide payments of not less than $300, but not more than $500, per acre per
				year under the program.</text>
					</subsection><subsection id="HCBEA5F74390C48AB8602FA0F7E2B0D76"><enum>(d)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated to the
				Secretary to carry out the program $50,000,000 for each of fiscal years 2011
				and
				2012.</text>
