		<section id="HFE257604289042F08F31DB179E98B1E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Shipping Act of
			 2010</short-title></quote>.</text>
		</section><section id="H8251CD8B9D0B4FA4B20FF0A12D1A1770"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of title 46, United
			 States Code.</text>
		</section><section id="HD7C1A51E8DE34A349EB6E9F161888E5C" section-type="subsequent-section"><enum>3.</enum><header>Office of Dispute
			 Resolution and Customer Advocate</header>
			<subsection id="HEFD6DDBA862348FDAE3956A2A7D4E28E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 is amended
			 by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H306F5A8BFAE0493097176A0C42F67FA9" style="USC">
					<section id="H84FD9983AC8E433093664509C737CAB8"><enum>308.</enum><header>Office of
				Dispute Resolution and Customer Advocate</header>
						<subsection id="HEF84231D07474581A1722B9B0133AA96"><enum>(a)</enum><header>In
				general</header><paragraph commented="no" display-inline="yes-display-inline" id="H52F52594923D41D497DA51CDD6B37B68"><enum>(1)</enum><text>The Commission shall
				maintain an Office of Dispute Resolution and Customer Advocate that
				shall—</text>
								<subparagraph id="H6186459D307547DCAEEAF85CC6D7BAC4" indent="up1"><enum>(A)</enum><text>mediate disputes between persons
				subject to the Commission’s jurisdiction;</text>
								</subparagraph><subparagraph id="H64192B7FD28D4CAAB6900DF5A68C51C0" indent="up1"><enum>(B)</enum><text>facilitate communication among persons
				subject to the Commission’s jurisdiction and their customers; and</text>
								</subparagraph><subparagraph id="HB3B7CDB7CC15433392D05511AA92F433" indent="up1"><enum>(C)</enum><text>carry out other duties and powers
				prescribed by the Commission.</text>
								</subparagraph></paragraph><paragraph id="H22315D45D53D41E18AC8C5BCAF74101A" indent="up1"><enum>(2)</enum><text>The confidentiality and neutrality
				provisions of the subchapter IV of chapter 5, United States Code, shall apply
				to those mediation and facilitation services.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H675DC74B5B274FAEB5D4632BA9010E62"><enum>(b)</enum><header>Ombudsman</header><text>The
				Chairman may designate an employee of the Commission to serve as an ombudsman
				of the Commission in matters of Commission interest, including matters related
				to ocean transportation, mergers and acquisitions, or any other matter
				designated by the
				Commission.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H30F6DA2D9E3D4C409EC3881D88024FC8"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis at the beginning of such chapter is
			 amended by adding at the end the following new item:</text>

			</subsection></section><section id="H1962FBC15B8A468DA9317B4FC3500527"><enum>4.</enum><header>Ocean Shipping
			 Advisory Committee</header>
			<subsection id="HB0F3BF1A0CD04B859D9A5764B82A1103"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 is further
			 amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HCAFA89AA11A44972B6C30974950B5B7A" style="USC">
					<section id="H222ECBB7592747A2BDB9C42B75B6A9E7"><enum>309.</enum><header>Ocean Shipping
				Advisory Committee</header>
						<subsection id="H66BD6004FD2A47F18C9ECBF42966D76A"><enum>(a)</enum><header>In
				general</header><text>The Commission shall establish an Ocean Shipping Advisory
				Committee. The Committee—</text>
							<paragraph id="H20480E6C62CB4EBD9DC3421FC6715201"><enum>(1)</enum><text>may review
				proposed ocean shipping regulations and policies of the Commission and make
				recommendations to the Commission that the Committee considers
				appropriate;</text>
							</paragraph><paragraph id="H145B3879B7E744928552FF7B1C20FF52"><enum>(2)</enum><text display-inline="yes-display-inline">may advise, consult with, report to, and,
				upon approval by at least all but one of the members then serving on the
				Committee, make recommendations to the Commission on matters relating to ocean
				shipping transportation by persons subject to this subtitle;</text>
							</paragraph><paragraph id="H804AAF7EDACA4AA184EB79E457FCA407"><enum>(3)</enum><text>may make available
				to Congress recommendations that the Committee makes to the Commission;</text>
							</paragraph><paragraph id="H40895D2735274F56A7249E97D91A118E"><enum>(4)</enum><text>shall meet at the
				call of—</text>
								<subparagraph id="HFC596C67558445EF86A8549B14D3DD03"><enum>(A)</enum><text>the Chairman of
				the Commission, in consultation with the other Commissioners, who shall call
				such a meeting at least once during each calendar year; or</text>
								</subparagraph><subparagraph id="H02433E71ABE94F54BA56E7BE19C8CB96"><enum>(B)</enum><text>a majority of the
				Committee; and</text>
								</subparagraph></paragraph><paragraph id="HB484C86C6F77425D99767DD348B03457"><enum>(5)</enum><text>shall not
				intervene in or seek to influence formal or informal adjudicatory or dispute
				resolution proceedings before the Commission.</text>
							</paragraph></subsection><subsection id="H45E32ED7889D4CD29ABE15D0FD03EEA7"><enum>(b)</enum><header>Membership</header>
							<paragraph display-inline="no-display-inline" id="H44F23CE5063E46BF98956ADA167233FE"><enum>(1)</enum><header>In
				general</header><text>The Committee shall consist of 18 members appointed by
				the Commission in accordance with this subsection, each of whom has at least 5
				years practical experience in their respective ocean shipping operations. The
				term of each member shall be 5 years. Before filling a position on the
				Committee, the Commission shall publish a notice in the Federal Register
				soliciting nominations for membership on the Committee.</text>
							</paragraph><paragraph id="HA82B7D06077942498FF350425BFC6A06"><enum>(2)</enum><header>Representatives</header><text>The
				membership of the Committee shall include—</text>
								<subparagraph id="H766EDE6782F240689A4551E3C1A35B82"><enum>(A)</enum><text>6 representatives
				of ocean common carriers with representation to include those serving the east,
				west, gulf and Great Lakes coasts of the United States;</text>
								</subparagraph><subparagraph id="H6EF8AD962EB34F44B97CF6224C8A8125"><enum>(B)</enum><text>3 representatives
				of nonvessel-operating common carriers;</text>
								</subparagraph><subparagraph id="HE8E7DC366C484076A81DA340E8C7CD76"><enum>(C)</enum><text>3 representatives
				of ocean freight forwarders;</text>
								</subparagraph><subparagraph id="HC7130FC2C39847FB844A3B80842352E1"><enum>(D)</enum><text>3 representatives
				of shippers that import goods into the United States, at least one of which
				must represent small shippers; and</text>
								</subparagraph><subparagraph id="HD8FD336F999B4A398167A18F13DFE18B"><enum>(E)</enum><text>3 representatives
				of shippers that export goods from the United States, at least one of which
				must represent small shippers.</text>
								</subparagraph></paragraph></subsection><subsection id="H8138BE6CB61D46DF9A633E1FAC19503F"><enum>(c)</enum><header>Chairman and
				Vice Chairman</header>
							<paragraph display-inline="no-display-inline" id="H2DA151533F654C88A6D3339B0A9393AC"><enum>(1)</enum><header>In
				general</header><text>The Committee shall elect one of its members as the
				Chairman and one of its members as the Vice Chairman. The Vice Chairman shall
				act as Chairman in the absence or incapacity of the Chairman, or in the event
				of a vacancy in the office of the Chairman.</text>
							</paragraph><paragraph id="H70F91DE9DC9E4B5AA59C296F31639FEF"><enum>(2)</enum><header>Designation of
				observer</header><text>The Chairman of the Commission shall designate a
				representative to participate as an observer with the Committee. The individual
				so designated shall act as the executive secretary of the Committee and shall
				perform the duties set forth in section 10(c) of the Federal Advisory Committee
				Act (5 U.S.C. App.).</text>
							</paragraph></subsection><subsection id="H27FF6E7AFE0648F0826A890B26879DE0"><enum>(d)</enum><header>Consideration of
				information, advice, and recommendations</header><text display-inline="yes-display-inline">The Commission shall consider the
				information, advice, and recommendations of the Committee in formulating policy
				regarding matters affecting ocean commerce.</text>
						</subsection><subsection id="HA66EC6A6B45D4829908CA1E089E5DA35"><enum>(e)</enum><header>Compensation and
				expenses</header>
							<paragraph display-inline="no-display-inline" id="H3E2010C68B5B425786B38581F395A797"><enum>(1)</enum><header>In
				general</header><text>A member of the Committee, when attending meetings of the
				Committee or when otherwise engaged in the business of the Committee, may
				receive—</text>
								<subparagraph id="HAF84CB39C602415E8EDC4579725C3BD2"><enum>(A)</enum><text>compensation at a
				rate fixed by the Chairman of the Commission, not exceeding the daily
				equivalent of the then current rate of basic pay in effect for Level 18 of the
				General Schedule under section 5332 of title 5, including for travel time;
				and</text>
								</subparagraph><subparagraph id="H334954FBD366478C843A4B0516E83E41"><enum>(B)</enum><text>travel or
				transportation expenses under section 5703 of title 5.</text>
								</subparagraph></paragraph><paragraph id="H277AD891BDA540898B9A1627BC51B561"><enum>(2)</enum><header>Not an officer
				or employee</header><text>A member of the Committee shall not be considered to
				be an officer or employee of the United States for any purpose based on their
				receipt of any payment under this subsection.</text>
							</paragraph></subsection><subsection id="H7005B92423B14C7DBEAD3DE852BFCD95"><enum>(f)</enum><header>Termination</header>
							<paragraph display-inline="no-display-inline" id="HB600A662D8F74FF986958AC2B2ADCF0B"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any provision of the Federal Advisory
				Committee Act (5 U.S.C. App.), the Committee terminates on September 30,
				2015.</text>
							</paragraph><paragraph id="H53E0F59DB7D24D5A9839B9CB47B9B621"><enum>(2)</enum><header>Recommendation
				regarding</header><text>Two years before the termination date under paragraph
				(1), the Committee shall submit to Congress its recommendation regarding
				whether the Committee should be renewed and continued beyond the termination
				date.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF03AD806006746C78367A29C6CED6679"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis at the beginning of such chapter is
			 amended by adding at the end the following new item:</text>

			</subsection></section><section id="H8BC1492D331D4453991DBEA24A1A1FE8"><enum>5.</enum><header>Purposes of
			 regulation of ocean shipping</header><text display-inline="no-display-inline">Section 40101(3) is amended to read as follows:</text>
			<quoted-block id="H789D58398FBF4AF38FB25D5D8AC34E3D" style="OLC">
				<paragraph id="H65385B1855DA458C82452B8DE8EB4BF3"><enum>(3)</enum><text>to allow, to the
				maximum extent possible, competition and the demand for services to determine
				fair and efficient market rates and charges for transportation by common
				carriers;
				and</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC337621687F343569EA258EDA7B9E29E"><enum>6.</enum><header>Amendments to
			 definitions for part</header>
			<subsection id="H59247F46059543D688A29EC3BA27EA75"><enum>(a)</enum><header>In
			 general</header><text>Section 40102 is amended—</text>
				<paragraph id="HA8DE432B7CE14A14A0B19CA203E2983A"><enum>(1)</enum><text>by striking
			 paragraph (7);</text>
				</paragraph><paragraph id="H2824B48100A34CAE93D2243C929DF757"><enum>(2)</enum><text>by redesignating
			 paragraphs (5) and (6) as paragraphs (6) and (7), respectively;</text>
				</paragraph><paragraph id="HDBAB5B80B52740EC871C135FF6ED4073"><enum>(3)</enum><text>by redesignating
			 paragraphs (10) through (22) as paragraphs (12) through (24),
			 respectively;</text>
				</paragraph><paragraph id="H99F37439E16942528FF784CD16FD81F5"><enum>(4)</enum><text>by redesignating
			 paragraphs (23) through (25) as paragraphs (26) through (28),

				rationalization</header><text>The term <quote>capacity rationalization</quote>
				means a concerted reduction, stabilization, withholding, or other limitation in
				any manner by ocean common carriers on the size or number of vessels or
				available space offered collectively or individually to shippers in any trade
				or
				service.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H60563A1BC36A4B2687A1B450E3400ED7"><enum>(6)</enum><text>by striking
			 <quote>ocean</quote> in paragraph (8);</text>
				</paragraph><paragraph id="H38DB7324679F4618B20C5F757F3B3E31"><enum>(7)</enum><text>by inserting after
			 paragraph (9) the following:</text>
					<quoted-block id="HCB2EB241C9CD4155A157180D0E41A3EF" style="OLC">
						<paragraph id="HC0241D451AAC4F719A229B8E0D9D4E1D"><enum>(10)</enum><header>Efficiency and
				service-enhancing agreement</header><text>The term <quote>efficiency and
				service-enhancing agreement</quote> means an agreement between ocean common
				carriers that—</text>
							<subparagraph id="HC1336CAC65A7429F99CFBC73F2788452"><enum>(A)</enum><text>is likely to
				produce cognizable efficiencies and improves the service and reliability that
				would be offered individually by each of its members in the absence of such
				agreement, while maintaining adequate competition in a trade or service;
				and</text>
							</subparagraph><subparagraph id="H16048FE472BD42A6A8853CE66730E746"><enum>(B)</enum><text>gives members of
				the agreement the right to withdraw from the agreement without financial or
				other penalty.</text>
							</subparagraph></paragraph><paragraph id="H2004814023FE4435A52CC81881F6C2A9"><enum>(11)</enum><header>Equipment
				provider</header><text>The term <quote>equipment provider</quote> means a
				person in the United States that rents or leases marine cargo containers, or
				chassis for marine cargo containers, to shippers or common carriers for use in
				or related to transportation by water of cargo between the United States and a
				foreign
				country.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H24C0A4DAC682428B9B179BF09E6FA83C"><enum>(8)</enum><text>by amending
			 paragraph (22), as so redesignated, to read as follows:</text>
					<quoted-block id="HCE645A7EE6A74553955BD42DE95245EE" style="OLC">
						<paragraph id="H11E286ACC89E4D2897F903F9E4D15D13"><enum>(22)</enum><header>Service
				contract</header><text>The term <quote>service contract</quote> means a written
				contract, other than a bill of lading or receipt, between one or more shippers
				and a common carrier, in which—</text>
							<subparagraph id="HF5597C1B53874F16B7127900E53EF439"><enum>(A)</enum><text>the shipper or
				shippers commit to providing a certain volume or portion of cargo over a fixed
				time period; and</text>
							</subparagraph><subparagraph id="H6F7D7BBB97D94C3FBF879C926ABC3182"><enum>(B)</enum><text>the common carrier
				commits to a certain rate or rate schedule and a defined service level that
				includes assured space and other service
				features.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB5DF49C6585942BAAAB548909C8AC389"><enum>(9)</enum><text>by inserting after
			 paragraph (24), as so redesignated, the following:</text>
					<quoted-block id="H068507668F1F42CB94609276957CEC31" style="OLC">
						<paragraph id="HEA9264F596E845449BAFA1A5033A28A7"><enum>(25)</enum><header>Surcharge</header><text>The
				term <quote>surcharge</quote> means an amount charged by a common carrier
				related directly to a particular expense or cost incurred by the common carrier
				that is not included in the basic freight
				rate.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2BADD07F91684D999C2F8F31252F6E3A"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 431A(b)(1) of the Tariff Act of 1930 (19 U.S.C.
			 Sec. 1431a(b)(1)) is amended by striking <quote>section 40102(16)</quote> and
			 inserting <quote>section 40102(18)</quote>.</text>
			</subsection></section><section id="HCAEB59EF53FA4FC6A75324B44EA4AFB8"><enum>7.</enum><header>Administrative
			 exemptions</header><text display-inline="no-display-inline">Section 40103(a) is
			 amended by striking <quote>agreements</quote> and all that follows through
			 <quote>from any requirement</quote> and inserting <quote>agreements subject to
			 this part or any specified activity of persons subject to this part from any
			 requirement</quote>.</text>
		</section><section id="H5D4E2F89A08B4C5FA89EEFAC0E680208"><enum>8.</enum><header>Treatment of
			 certain commission orders as investigative orders</header><text display-inline="no-display-inline">Section 40104(b) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="HEB9DFE1027E0416B9AF0F1A9D732872C" style="OLC">
				<subsection id="H827F6D7691E44FAE960B6A437DF19796"><enum>(b)</enum><header>Treatment of
				certain Commission orders as investigative orders</header><text display-inline="yes-display-inline">A Commission order requiring a report,
				account, record, rate, charge, or memorandum pursuant to subsection (a)
				constitutes an investigative order to specific individuals or entities rather
				than a collection of information from a category or class of individuals or
				entities.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0421562E76E74A2280EB1B8C7A18955B"><enum>9.</enum><header>Application of
			 laws regulating ocean shipping</header><text display-inline="no-display-inline">Section 40301 is amended as follows:</text>
			<paragraph id="H1F2AD2D5EFFF41C196AFC3CB4A8C5024"><enum>(1)</enum><text>By amending
			 subsection (a) to read as follows:</text>
				<quoted-block id="H8FF6435DDD4844E6AFA80EAAAB4A5570" style="OLC">
					<subsection id="HF559351F9E814494A639AA2C0221CF3F"><enum>(a)</enum><header>Ocean common
				carrier agreements</header><text>This part applies to an efficiency and
				service-enhancing agreement between or among ocean common carriers to—</text>
						<paragraph id="HF75FA2CEAB4B40FF9A085BB57BD9486C"><enum>(1)</enum><text>share vessels or
				space on voyages between ports;</text>
						</paragraph><paragraph id="H0164F97F1E3845799C8FAA39C8DA0866"><enum>(2)</enum><text>discuss the number
				and character of voyages between those ports; and</text>
						</paragraph><paragraph id="HB3F017D9363A467BAF9275C6131BD690"><enum>(3)</enum><text>engage in an
				exclusive, preferential, or cooperative working arrangement between themselves
				or with a marine terminal
				operator.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HE6740F7B269443F7B6ABD936213804CC"><enum>(2)</enum><text>In subsection (c)
			 by inserting before the period the following: <quote>that does not result in a
			 change of control of an ocean common carrier</quote>.</text>
			</paragraph></section><section id="HA9F98CD42B6442CAB91C63D8F3B7AD9F"><enum>10.</enum><header>Restrictions on
			 ocean common carrier agreements</header>
			<subsection id="H58FD2115478E4474AB0AF704FEE7D1A5"><enum>(a)</enum><header>In
			 general</header><text>Section 40303 is amended as follows:</text>
				<paragraph id="HC0B578D70F3C4A59A22ED04A7DB4D418"><enum>(1)</enum><text>By striking so
			 much as precedes subsection (d) and inserting the following:</text>
					<quoted-block id="H0D8A03F5B10A4DDDAF324A6F6C9A378B" style="OLC">
						<subsection id="HF3705A6A01664014A19380F9BEFAF018"><enum>(a)</enum><header>Ocean common
				carrier agreements</header><text>An agreement between or among ocean common
				carriers may not—</text>
							<paragraph id="HE432EF39905C4608BB6BC49B63813582"><enum>(1)</enum><text>allow members of
				the agreement to discuss, fix, or negotiate any kind of rate or charge with
				another member of the agreement;</text>
							</paragraph><paragraph id="H6D05120754AE45FBA58FBB76AADB6A02"><enum>(2)</enum><text>allow members of
				the agreement to discuss or agree on capacity rationalization;</text>
							</paragraph><paragraph id="H36437E5A696E45EA99B30191475A5EBE"><enum>(3)</enum><text>allow members of
				the agreement to establish a joint service, or pool or divide cargo traffic,
				earnings, revenues, or losses;</text>
							</paragraph><paragraph id="H46D595C98915464B96AB1CF8436D3C6D"><enum>(4)</enum><text>allow all members
				of the agreement to allocate customers or markets;</text>

								</subparagraph><subparagraph id="H25EE8CE763AF4ED3BD719197CBD7BEA7"><enum>(C)</enum><text>the resolution of
				the complaints, if appropriate.</text>
								</subparagraph></paragraph><paragraph id="HB442C3AD638E49BBB4F4FE0540EC9AB6"><enum>(2)</enum><header>Limitation on
				identification of complainant</header><text>The annual report may identify a
				complainant that submitted an informal complaint only upon the written consent
				of the complainant.</text>
							</paragraph></subsection><subsection id="HCBFF2AF41DDB49CB9DFDFEC81D9B61E6"><enum>(c)</enum><header>Reliability
				indicators</header>

				general</header><text>Not later than one year after enactment of the Ocean
				Shipping Act of 2010, the Commission shall prescribe regulations to establish a
				binding arbitration process to resolve complaints subject to the jurisdiction
				of the Commission and within the scope of disputes to which the process applies
				under subsection (b).</text>
						</subsection><subsection id="HCEB45E8F7CF5465E8EEFCE5E86F7A773"><enum>(b)</enum><header>Covered
				disputes</header><text>The binding arbitration process—</text>
							<paragraph id="H69B98C7CCA3543C7B26FFAE85BDBB0F9"><enum>(1)</enum><text>shall apply to
				disputes involving service contracts, common carrier practices, and common
				carrier service expectations that are subject to the jurisdiction of the
				Commission;</text>
							</paragraph><paragraph id="H92EADF2ED669449F932C5A06CB83E035"><enum>(2)</enum><text>shall not apply to
				disputes to obtain the grant, denial, stay, or revocation of any license,
				authorization, or exemption;</text>
							</paragraph><paragraph id="HE0B313A17C9D4DB18247DC308C5AF97E"><enum>(3)</enum><text>shall not apply to
				disputes solely between 2 or more ocean common carriers; and</text>
							</paragraph><paragraph id="HE14CA96B893A438EA0DD206C2E92412A"><enum>(4)</enum><text>shall be agreed
				upon by the parties to dispute.</text>
							</paragraph></subsection><subsection id="H698A4C93FC9045B6960DED727B38322B"><enum>(c)</enum><header>Arbitration
				procedures</header>
							<paragraph id="H344DDD6CA2BE4945A1F3920DC876FF6C"><enum>(1)</enum><header>In
				general</header><text>The Commission—</text>
								<subparagraph id="H4280055343CC4BE69A7D6E71ADFDD15D"><enum>(A)</enum><text>may make the
				binding arbitration process available only to the relevant parties—</text>
									<clause id="H1A7A53D4A8E04E0F8ED808E782699AF2"><enum>(i)</enum><text>after the filing
				of a formal complaint; or</text>
									</clause><clause id="HFB0DC346F6CD4A24B4604470DE924071"><enum>(ii)</enum><text>on petition by a
				party at the conclusion of any informal dispute resolution process provided by
				the Commission for a complaint subject to this section;</text>
									</clause></subparagraph><subparagraph id="H6438561CB61F49E687C508597B761F9F"><enum>(B)</enum><text>shall determine
				whether to pursue a proceeding under the binding arbitration process no later
				than 30 days after the filing of a petition or formal complaint; and</text>
								</subparagraph><subparagraph id="H16D8458B605042E0AB1950CD1DD71616"><enum>(C)</enum><text>may make the
				binding arbitration proceeding and decision confidential following a request of
				the parties submitted at the time of filing the petition or formal
				complaint.</text>
								</subparagraph></paragraph><paragraph id="H804D3A96C6DC4BB998DE6B8C52411004"><enum>(2)</enum><header>Prohibition on
				separate review</header><text>The Commission may not separately review a
				complaint or dispute related to a rate, practice, or common carrier service
				that is the subject of a binding arbitration initiated under this subsection
				involving the same parties.</text>
							</paragraph><paragraph id="HF76AE8C68D9A42968FA49BB8E2E860E9"><enum>(3)</enum><header>Consideration of
				published service expectations</header><text>In resolving disputes involving
				common carrier service expectations, the arbitrator shall consider service
				expectations as published under section 40501(h) of this title.</text>
							</paragraph></subsection><subsection id="HEE61D4506ED84230ACE74FB1A9B8034F"><enum>(d)</enum><header>Arbitration
				decisions</header><text>Any decision reached in an arbitration proceeding under
				this section shall—</text>
							<paragraph id="H8D995873A7294F1D8BD1BB6C37A90520"><enum>(1)</enum><text>be consistent with
				this part;</text>
							</paragraph><paragraph id="H297D74AB61034C57BC14891B11217976"><enum>(2)</enum><text>be in writing and
				contain findings of fact and conclusions;</text>
							</paragraph><paragraph id="H84C716F0408B4EB5B66A91CB0A8CAF22"><enum>(3)</enum><text>have no
				precedential effect in any other or subsequent arbitration proceeding under
				this section; and</text>
							</paragraph><paragraph id="H7642597B36864B479E180A0A7D3836F9"><enum>(4)</enum><text>be binding upon
				the parties.</text>
							</paragraph></subsection><subsection id="H611F6FD0156E42E39AB1E81CFBCC87D8"><enum>(e)</enum><header>Timelines</header>
							<paragraph id="H0D3EF7BC1744425E9C389EA001CF28D5"><enum>(1)</enum><header>In
				general</header><text>In an arbitration proceeding under this section—</text>
								<subparagraph id="H8728FA1E540D47D683B705A69D27F5E2"><enum>(A)</enum><text display-inline="yes-display-inline">the arbitrator shall be selected within 14
				days after the Commission’s decision to initiate arbitration;</text>
								</subparagraph><subparagraph id="HBA169732430A419CB9D582F34231DBD3"><enum>(B)</enum><text>the evidentiary
				phase of the arbitration shall be completed within 90 days after the date of
				initiation of the arbitration proceeding, unless a party requests an extension
				and the arbitrator grants it; and</text>
								</subparagraph><subparagraph id="HE1332308E1ED46D089A31C70F1265D67"><enum>(C)</enum><text>the arbitrator
				shall issue a decision within 30 days after the close of the evidentiary
				record.</text>
								</subparagraph></paragraph><paragraph id="HCACEF232E2B64630B0ADE2A32D5E03A4"><enum>(2)</enum><header>Extension of
				deadlines</header><text>The Commission may extend any of the deadlines in this
				subsection.</text>
							</paragraph></subsection><subsection id="HA53B42608AD04042885FE664C86E8C64"><enum>(f)</enum><header>Arbitrators</header><text>Arbitration
				under this section shall be conducted by an arbitrator selected from a roster,
				maintained by the Commission, of Commission staff or persons in the private
				sector with transportation, economic regulation, professional or business
				experience, including agriculture. If the parties cannot mutually agree on an
				arbitrator, the parties shall select an arbitrator from the roster by
				alternately striking names from the roster until only 1 name remains. The
				parties shall share the costs of the arbitration equally. With respect to
				arbitration involving a controlled carrier, the arbitrator may not be
				controlled by or in any way affiliated with a government that owns or controls
				the carrier.</text>
						</subsection><subsection id="H149EF89744FE4AB09206A3730E263BD7"><enum>(g)</enum><header>Relief</header>
							<paragraph id="H3466EB62E12A4380B68C26DBD2554D21"><enum>(1)</enum><header>Limitation</header><text>A
				decision under this section may award the payment of damages, but the value of
				the award may not exceed $250,000 per year and the award may not cover a total
				time period of more than 2 years.</text>
							</paragraph><paragraph id="HD19610BBC4694C8E8380D30D64B38447"><enum>(2)</enum><header>Review</header><text>The
				Commission shall periodically review the amount in paragraph (1) and adjust it
				as necessary to reflect inflation.</text>
							</paragraph></subsection><subsection id="H1BC892182F57471EAC8C2D372BED1B75"><enum>(h)</enum><header>Commission
				review</header><text>If a party to an arbitration proceeding under this section
				appeals an arbitrator’s decision to the Commission, the Commission may review
				the decision under this section to determine if—</text>
							<paragraph id="HB11BFBD868F744BBA47CC482F16E6335"><enum>(1)</enum><text>the decision is
				consistent with this part as applied by the Commission; or</text>
							</paragraph><paragraph id="H4BE6EA46BAF0468A961BB229275C2437"><enum>(2)</enum><text>if the award
				limitation in subsection (g) is complied
				with.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAC2E584067F542F2BF9B788E5D9145A2"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis at the beginning of such chapter is

				that may have the effect of unreasonably and substantially lessening
				competition in a trade;</text>
						</paragraph><paragraph id="H20ABBA9E89464DF7ACDA947756000088"><enum>(17)</enum><text>discriminate
				against a shipper on the basis of nationality or association with another
				common carrier;</text>
						</paragraph><paragraph id="H2754D3BF3E474A17980BBE3EEA0D4856"><enum>(18)</enum><text>refuse to deliver
				or release a shipment, if such refusal is based on debts, claims, or amounts
				owed that are unrelated to a debt, claim, or amount owed by that shipper;
				or</text>
						</paragraph><paragraph id="H46B59B70578B47D5BCEFF7DF556F044A"><enum>(19)</enum><text>impose a
				surcharge that is unreasonable or does not comply with the requirements of this
				part.</text>

			</paragraph></section><section id="H2E34296BCF1D4290B4559A6821DB3D90"><enum>30.</enum><header>Ocean
			 transportation practices study</header>
			<subsection id="H073013E3FEEB48D2870DEAD4B07F8FE7"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Within 180 days after the date of enactment
			 of this Act, the Federal Maritime Commission shall initiate a study of ocean
			 transportation practices, including delay of cargo, surcharges, penalties,
			 demurrage, accessorial charges, and availability of containers for exports from
			 the United States. In conducting the study, the Commission shall provide public
			 notice and opportunity for comment and conduct one or more public
			 hearings.</text>
			</subsection><subsection id="H0961097CD07E4F1F8311FAB1FD4567E5"><enum>(b)</enum><header>Report to
			 Congress</header><text>Within 180 days after completion of the study, the
			 Commission shall provide a report on its findings to the Committee on Commerce,
			 Science, and Transportation of the Senate and the Committee on Transportation
			 and Infrastructure of the House of Representatives.</text>
