		<section id="H7D63655B0D604BD2BCB8DF86F9A516A8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Technology Deployment and Early-Stage Business Investment
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H0555DBC3976F4C99A8AB51D38D10F345"><enum>2.</enum><header>Technology
			 deployment and early-stage business investment grant program</header>
			<subsection id="HE7CF1038C10A40C7BF7E6C372CA47813"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
			 enactment of this Act, the Secretary of Commerce shall establish a technology
			 deployment and early-stage business investment grant program (in this section
			 referred to as the <quote>program</quote>) to support the development of
			 early-stage businesses in targeted industries.</text>
			</subsection><subsection id="HC934F77BC85142239A3EFD8F18A8BAB7"><enum>(b)</enum><header>Grant
			 authority</header>
				<paragraph id="HF3B4151A1044473FA40F0190F0F1F9D5"><enum>(1)</enum><header>In
			 general</header><text>In carrying out the program, the Secretary is authorized
			 to make grants to covered business accelerators.</text>
				</paragraph><paragraph id="HF87B68802C8C49F6947A29A572E455EB"><enum>(2)</enum><header>Grant
			 amounts</header>
					<subparagraph id="H64840CC4935C459C9213AB52816989D6"><enum>(A)</enum><header>Non-Federal
			 capital limitation</header><text display-inline="yes-display-inline">A grant
			 made to a covered business accelerator under the program may not be in an
			 amount that exceeds the amount of the accelerator’s capital that—</text>
						<clause id="HD3E1459C897044B8856CDC1204544B68"><enum>(i)</enum><text>is
			 not from a Federal source; and</text>
						</clause><clause id="HC41121F4A2CD40298576D16F6720867D"><enum>(ii)</enum><text>is
			 available for investment and business assistance services on or before the date
			 on which a grant is drawn upon.</text>
						</clause></subparagraph><subparagraph id="HC34B48BD9C3B437193D12990761BB66E"><enum>(B)</enum><header>Aggregate amount
			 limitation</header><text display-inline="yes-display-inline">The aggregate
			 amount of all grants made to a covered business accelerator under the program
			 may not exceed $5,000,000.</text>
					</subparagraph></paragraph></subsection><subsection id="HB54BBF63BA0F4096A93C7EA69B73EE6E"><enum>(c)</enum><header>Grant award
			 process</header><text display-inline="yes-display-inline">In making a grant
			 under the program, the Secretary shall commit a grant amount to a covered
			 business accelerator and the amount of each such commitment shall remain
			 available to be drawn upon by the accelerator during the 5-year period
			 beginning on the date on which each such commitment is first drawn upon.</text>
			</subsection><subsection id="HA3B53A7988EE4B729EC31208435A69C9"><enum>(d)</enum><header>Use of
			 grant</header>
				<paragraph id="H84CC959551904887B88B08C6DD4AFF4A"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A grant made under
			 the program may be used by a covered business accelerator for the
			 following:</text>
					<subparagraph id="HE9C5FFAF69FB4FDAAB224FB258F0DDCB"><enum>(A)</enum><text>Making an
			 investment in an early-stage business in a targeted industry.</text>
					</subparagraph><subparagraph id="HB12887CEC2B949A480A1C7262A015F05"><enum>(B)</enum><text>Providing
			 training, counseling, and other assistance to an early-stage business in a
			 targeted industry to support the development of the business.</text>
					</subparagraph><subparagraph id="HC91E060C37244C4FB3F6AB48F3E63179"><enum>(C)</enum><text display-inline="yes-display-inline">Making investments in and providing support
			 to an early-stage business in a targeted industry to assist the business with
			 proof of concept activities that accelerate the deployment and
			 commercialization of technology.</text>
					</subparagraph><subparagraph id="H546771F165B74108AD4D67A1BB5E044F"><enum>(D)</enum><text>Providing
			 purchased services to an early-stage business in a targeted industry.</text>
					</subparagraph><subparagraph id="H2BC9C987781048A6BF3F33B89786BFFB"><enum>(E)</enum><text>Conducting due
			 diligence activities.</text>
					</subparagraph><subparagraph id="HE1A736FAFA2C4F419A0026488055181F"><enum>(F)</enum><text>Meeting
			 operational expenses.</text>
					</subparagraph></paragraph><paragraph id="HA09169A53E5C499CAF2C77BAAD2E670A"><enum>(2)</enum><header>Limitations</header>
					<subparagraph id="HEEA4DDE4100F48E8835226B5672687F8"><enum>(A)</enum><header>Proof of concept
			 activities</header><text display-inline="yes-display-inline">Not more than 40
			 percent of the amount of a grant made to a covered business accelerator under
			 the program may be used by the accelerator to provide assistance for proof of
			 concept activities.</text>
					</subparagraph><subparagraph id="HC25E03AF54BD4D789EF119C67292A337"><enum>(B)</enum><header>Purchased
			 services</header><text display-inline="yes-display-inline">Not more than 20
			 percent of the amount of a grant made to a covered business accelerator under
			 the program may be used by the accelerator to provide purchased services to an
			 early-stage business in a targeted industry.</text>
					</subparagraph><subparagraph id="H7BE8A7A5B0D9406BADA001F739EDEB4C"><enum>(C)</enum><header>Due diligence
			 activities</header><text display-inline="yes-display-inline">Not more than 10
			 percent of the amount of a grant made to a covered business accelerator under
			 the program may be used by the accelerator to conduct due diligence
			 activities.</text>
					</subparagraph><subparagraph id="HE9B3ED0C65F445B786A153FC98247D50"><enum>(D)</enum><header>Operational
			 expenses</header><text display-inline="yes-display-inline">Not more than 20
			 percent of the amount of a grant made to a covered business accelerator under
			 the program may be used by the accelerator to meet operational expenses.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HEF4F57C3CE5C4199B08B4A431F9A2CDE"><enum>(3)</enum><header>Designation of
			 grant uses</header><text>In the application of a covered business accelerator
			 for a grant under the program, the accelerator shall notify the Secretary of
			 the percentage of the grant amount that will be used for each of the activities
			 described in subparagraphs (A) through (F) of paragraph (1) and provide a
			 detailed description of the activities to be undertaken.</text>
				</paragraph></subsection><subsection id="H5567021A11B74854901098BD996CFC11"><enum>(e)</enum><header>Grant
			 conditions</header>
				<paragraph id="H1FF381B72D5F485CBADAD8DA71E72D0F"><enum>(1)</enum><header>Fund
			 Manager</header><text display-inline="yes-display-inline">As a condition of
			 receiving a grant under the program, a covered business accelerator shall
			 designate an individual as the fund manager for the grant amount and that
			 individual shall administer and be responsible to the Secretary for information
			 with respect to the grant amounts received.</text>
				</paragraph><paragraph id="H92563674A2DB4B6588B60356C646C3B8"><enum>(2)</enum><header>Investment
			 review</header><text display-inline="yes-display-inline">As a condition of
			 receiving a grant under the program, a covered business accelerator shall
			 establish an investment evaluation process that involves not fewer than 5
			 individuals (3 of whom may not be employed by or related to the accelerator or
			 an affiliate of the accelerator) who shall—</text>
					<subparagraph id="HC1796690550745C5B46AA80BC595B446"><enum>(A)</enum><text>review proposals
			 for and advise the accelerator on the use of grant funds;</text>
					</subparagraph><subparagraph id="H9046C894963D49C284CEF53C53F3F997"><enum>(B)</enum><text>provide letters of
			 support and reference to the Secretary with respect to proposals for the use of
			 grant funds by the accelerator; and</text>
					</subparagraph><subparagraph id="HA538F17DA1C4456591FF517013CFEF5B"><enum>(C)</enum><text>submit periodic
			 reports to the Secretary on the results of activities carried out with grant
			 funds.</text>
					</subparagraph></paragraph><paragraph id="H75357474E82D4A179990E82A3A6F79EA"><enum>(3)</enum><header>Collaborator</header><text display-inline="yes-display-inline">As a condition of receiving a grant under
			 the program, a covered business accelerator shall assign to each early-stage
			 business in a targeted industry that is assisted with grant amounts a
			 collaborator that shall be an individual or organization not otherwise employed
			 by or related to the accelerator or an affiliate of the accelerator and that
			 shall assist the accelerator in providing support to the business.</text>
				</paragraph></subsection><subsection id="H21AF945F16784FDAB3533DA8E92E639E"><enum>(f)</enum><header>Federal share of
			 activities</header><text>The Federal share of the cost of an activity carried
			 out by a covered business accelerator with the assistance of a grant under the
			 program shall not exceed 75 percent.</text>
			</subsection><subsection id="H64A4888900974AD081472DA07C85FAD9"><enum>(g)</enum><header>Monitoring and
			 evaluation</header>
				<paragraph id="H13C5EBB80930477BAE8C1D2A64C86DF2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 assess the effectiveness of covered business accelerators that receive a grant
			 under the program.</text>
				</paragraph><paragraph id="H94911F9E61B14E3AA0B4EE47DB612F9F"><enum>(2)</enum><header>Data from
			 accelerators</header><text>Not later than one year after the date of receiving
			 a grant under the program, a covered business accelerator shall provide to the
			 Secretary information on the activities of the accelerator and the businesses
			 assisted under the grant, including—</text>
					<subparagraph id="H8AC2006756EA4767A3F670FD71DD177E"><enum>(A)</enum><text>the number of
			 technologies that the businesses have moved from proof of concept activities to
			 commercialization;</text>
					</subparagraph><subparagraph id="HDD35BCACF2DA43099EF542A3C392F571"><enum>(B)</enum><text>the number of jobs
			 created by the businesses;</text>
					</subparagraph><subparagraph id="H74C0BFA5893946E89B2958BDC5E5BE7C"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of taxes paid by the businesses
			 and the employees of the businesses;</text>
					</subparagraph><subparagraph id="HD7F967DD012243DFA8A2827B0C0DD1F0"><enum>(D)</enum><text>the amount of
			 private investment the businesses have received; and</text>
					</subparagraph><subparagraph id="H973F450D9EAB4213AF9B86198009E613"><enum>(E)</enum><text>other data that,
			 as determined by the Secretary, may be used to measure the value of assistance
			 under the program.</text>
					</subparagraph></paragraph></subsection><subsection id="H473E12D611F14E5396DA0AEA794A4987"><enum>(h)</enum><header>Authorization of
			 appropriations</header>
				<paragraph id="HABD208A31D2442FAABC2256DCFFB57FD"><enum>(1)</enum><header>In
			 general</header><text>There is authorized to be appropriated to carry out the
			 program—</text>
					<subparagraph id="H6400BED870BF4454BFAC83DE46B3C0F8"><enum>(A)</enum><text>$250,000,000 for
			 the first full fiscal year beginning after the date of enactment of this Act;
			 and</text>
					</subparagraph><subparagraph id="H868B584889734BB59D7C43990012B1B7"><enum>(B)</enum><text>such sums as may
			 be necessary for subsequent fiscal years.</text>
					</subparagraph></paragraph><paragraph id="HC19E8AA03C4C4750A06EAA1A6AA6B70D"><enum>(2)</enum><header>Prohibition on
			 earmarks</header><text>None of the funds appropriated for the program may be
			 used for a congressional earmark as defined in clause 9(e) of rule XXI of the
			 Rules of the House of Representatives.</text>
				</paragraph></subsection><subsection id="HC29F36023A7244838512790658E3A092"><enum>(i)</enum><header>Definitions</header><text>In
			 this Act, the following definitions apply:</text>
				<paragraph id="H5DBED734BE664F9BB6B9290E6558EBB5"><enum>(1)</enum><header>Covered business
			 accelerator</header><text display-inline="yes-display-inline">The term
			 <term>covered business accelerator</term> means a public or private
			 not-for-profit organization, including an academic institution, that—</text>
					<subparagraph id="H3FCD6513405D44908EC8284A1F3060FC"><enum>(A)</enum><text display-inline="yes-display-inline">operates a program providing assistance to
			 early-stage businesses in targeted industries to support the development of
			 those businesses, including assistance with proof of concept activities to
			 accelerate the deployment and commercialization of technology;</text>
					</subparagraph><subparagraph id="H591A3C591D944F849096E7394BFA4392"><enum>(B)</enum><text display-inline="yes-display-inline">has a physical location and on-site
			 management for the program described under subparagraph (A); and</text>
					</subparagraph><subparagraph id="H299F6EE25DE9455294E928157EAC9A2F"><enum>(C)</enum><text>has procedures for
			 selecting businesses for and graduating businesses from the program described
			 under subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="HADCB2B5724F14F9687E97E221FD92C65"><enum>(2)</enum><header>Due diligence
			 activities</header><text display-inline="yes-display-inline">The term <term>due
			 diligence activities</term> means activities undertaken to analyze and assess
			 the desirability, value, and potential of an opportunity to provide assistance
			 to an early-stage business in a targeted industry, including activities to
			 analyze and assess the technology deployment and market potential of the
			 business.</text>
				</paragraph><paragraph id="H1DFAD3DD62FC47B3A7652D73FB3770CA"><enum>(3)</enum><header>Early-stage
			 business in a targeted industry</header><text display-inline="yes-display-inline">The term <term>early-stage business in a
			 targeted industry</term> means a small business concern that—</text>
					<subparagraph id="HFBD57ED241584F57AD16B5AFAD9E808F"><enum>(A)</enum><text>is domiciled in a
			 State;</text>
					</subparagraph><subparagraph id="H298BE1536F40453E8F6A611367B28F22"><enum>(B)</enum><text display-inline="yes-display-inline">has not generated gross annual revenues
			 exceeding $5,000,000 in any of the previous 3 years; and</text>
					</subparagraph><subparagraph id="H8AC4EA52B7AC47BDBB0E1DD61670577A"><enum>(C)</enum><text>is engaged
			 primarily in researching, developing, manufacturing, producing, or bringing to
			 market goods or services with respect to any of the following business
			 sectors:</text>
						<clause id="HF4D583B4F3C14CB087911BDF62FF4863"><enum>(i)</enum><text>Agricultural
			 technology.</text>
						</clause><clause id="H1BA6C50409BC4D2FBF9FE001CFA3D409"><enum>(ii)</enum><text>Energy
			 technology.</text>
						</clause><clause id="HBBB79E04536A4AA3BCA85E45A45C81C8"><enum>(iii)</enum><text>Environmental
			 technology.</text>
						</clause><clause id="HABCDE7B280CD4FD481679ABADD2A43C6"><enum>(iv)</enum><text>Life science
			 technology.</text>
						</clause><clause id="H68EE9AA9EAD44E219BD0E3D862F1A3B9"><enum>(v)</enum><text>Biotechnology.</text>
						</clause><clause id="HF907BAE8213F45C7B466D87BE636B0AE"><enum>(vi)</enum><text>Information
			 technology.</text>
						</clause><clause id="H730A4708D83149E2A311A6B2ACCAD7DF"><enum>(vii)</enum><text>Digital
			 media.</text>
						</clause><clause id="HF1F8040281574A0399D65E372DDDE635"><enum>(viii)</enum><text>Clean
			 technology.</text>
						</clause><clause id="HC0A6B595190E4353B6A148002AB2CDD1"><enum>(ix)</enum><text>Defense
			 technology.</text>
						</clause><clause id="H95F29273133545EE9ECE695A54835885"><enum>(x)</enum><text>Photonics
			 technology.</text>
						</clause><clause id="H08C4918AF3CE4892A1CCFD9CA7D5F458"><enum>(xi)</enum><text>Electronic
			 technology.</text>
						</clause><clause id="H15D848D17D9E4D18891EA88CE2ED461C"><enum>(xii)</enum><text>Semiconductor
			 technology.</text>
						</clause><clause id="HA2221C46E6764A90964DDA4804AF7A9C"><enum>(xiii)</enum><text>Material
			 science technology.</text>
						</clause><clause id="H02158093B6C74718BECE3B7C92F625F5"><enum>(xiv)</enum><text>Aerospace.</text>
						</clause><clause id="H95D49CB7DD924CC2A8DB16AC8619B497"><enum>(xv)</enum><text>Communications.</text>
						</clause><clause id="HC8C88FDB0551450ABD8F5CC289D61B96"><enum>(xvi)</enum><text>Transportation.</text>
						</clause></subparagraph></paragraph><paragraph id="HE2DFE1D3971B4FDFBD552E454324FFB6"><enum>(4)</enum><header>Operational
			 expenses</header><text>The term <term>operational expenses</term> means the
			 costs of operating a covered business accelerator, including overhead and
			 management expenses.</text>
				</paragraph><paragraph id="HD9323661EFFD40399FD382E1BA98D40F"><enum>(5)</enum><header>Proof of concept
			 activities</header><text>The term <term>proof of concept activities</term>
			 means activities carried out to validate and confirm the commercial viability
			 of a technology, including the generation of data, prototypes, and pilot trials
			 with respect to the technology.</text>
				</paragraph><paragraph id="HDD6741A25A5E4648B0E9C3294A3AAB76"><enum>(6)</enum><header>Purchased
			 services</header><text display-inline="yes-display-inline">The term
			 <term>purchased services</term> means any training, counseling, or other
			 assistance provided to an early-stage business in a targeted industry that is
			 provided by a covered business accelerator through an agreement with another
			 entity, and not by the accelerator directly.</text>
				</paragraph><paragraph id="HEFBE82A0242B4E049E095A10CE32895C"><enum>(7)</enum><header>Secretary</header><text display-inline="yes-display-inline">The terms <term>Secretary</term> and
			 <term>Secretary of Commerce</term> mean the Secretary of Commerce acting
			 through the Assistant Secretary of Commerce for Economic Development.</text>
				</paragraph><paragraph id="H51F30DB9B81F4077B1B8D932B6EAD131"><enum>(8)</enum><header>Small business
			 concern</header><text>The term <term>small business concern</term> has the
			 meaning given that term in section 3 of the Small Business Act (15 U.S.C.
			 632).</text>
