<official-title>To provide for further additional emergency unemployment compensation.</official-title>

<section id="H371BB60AE1174D3C95876EDAF7668529" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Unemployment Compensation Extension Act of 2010</short-title></quote>.</text></section> 
<section id="H839D74C23BF24A9EAF6B5D61B8F0EC54"><enum>2.</enum><header>Fifth-tier benefits</header> 
<subsection id="H22394CF03D62428B85F021E7639414F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4002 of the Supplemental Appropriations Act, 2008 (26 U.S.C. 3304 note) is amended—</text> 
<paragraph id="H62DEF30379AE4142B7E1672041313F2C"><enum>(1)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></paragraph> 
<paragraph id="HE9859DDCD95C4FDFBD9F9E40C9BAFC73"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text> 
<quoted-block style="OLC" id="H524C05FAD45649DF8329085BC75AD3B9" display-inline="no-display-inline"> 
<subsection id="H5F66E32E53EA4F29825AC94D6BCF1F5B"><enum>(f)</enum><header>Fifth-Tier emergency unemployment compensation</header> 
<paragraph id="H446177070CFA4BFA9243CB521B264540"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If, at the time that the amount added to an individual’s account under subsection (e)(1) (fourth-tier emergency unemployment compensation) is exhausted or at any time thereafter, such individual’s State is in an extended benefit period (as determined under paragraph (2)), such account shall be further augmented by an amount (hereinafter <quote>fifth-tier emergency unemployment compensation</quote>) equal to the lesser of—</text> 
<subparagraph id="H7DA0440F937E41EFAE78F907B3E09A40"><enum>(A)</enum><text>80 percent of the total amount of regular compensation (including dependents’ allowances) payable to the individual during the individual’s benefit year under the State law; or</text></subparagraph> 
<subparagraph id="H2DEC26291A2B4688A1C7353CDC75FBEE"><enum>(B)</enum><text>20 times the individual’s average weekly benefit amount (as determined under subsection (b)(2)) for the benefit year.</text></subparagraph></paragraph> 
<paragraph id="HA5F19B5D845841CC96180BFF324A38B4" display-inline="no-display-inline"> <enum>(2)</enum> <header>Extended benefit period</header> <text>For purposes of paragraph (1), a State shall be considered to be in an extended benefit period, as of any given time, if—</text> 
<subparagraph id="HA8C635D5AA914A259B580D0D4C77287B"> <enum>(A)</enum> <text>such a period would then be in effect for such State under such Act if section 203(d) of such Act—</text> 
<clause id="HE2F5E46C738F4A2EAAB1945AD4EDBE7B"> <enum>(i)</enum> <text>were applied by substituting <quote>7</quote> for <quote>5</quote> each place it appears; and</text> </clause> 
<clause id="HFFD2894CD9BE47EEAF6BF49ADBCD5FFF"> <enum>(ii)</enum> <text>did not include the requirement under paragraph (1)(A) thereof; or</text> </clause> </subparagraph> 
<subparagraph id="HD1BABEDA76014D16B868C2C3536FFEE3"> <enum>(B)</enum> <text>such a period would then be in effect for such State under such Act if—</text> 
<clause id="H7F3C75E0266744A3971BF9A192EFA2C5"> <enum>(i)</enum> <text>section 203(f) of such Act were applied to such State (regardless of whether the State by law had provided for such application); and</text> </clause> 
<clause id="H6819752D3101436A80229644E58D0EE0"> <enum>(ii)</enum> <text>such section 203(f)—</text> 
<subclause id="H017ECEE65AFD4E23ADC94C7F3FD2A2C4"> <enum>(I)</enum> <text>were applied by substituting <quote>10</quote> for <quote>6.5</quote> in paragraph (1)(A)(i) thereof; and</text> </subclause> 
<subclause id="HB2F5776513ED49BDB76FAD86D97D052B"> <enum>(II)</enum> <text>did not include the requirement under paragraph (1)(A)(ii) thereof.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H6EAD833396D54C37B81932DED730D07F"><enum>(3)</enum><header>Limitation</header><text>The account of an individual may be augmented not more than once under this subsection.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4CDF85CE29C64A4EB84919A31373A192"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HCC5B055152234E69B3E9F526F335D620"><enum>(1)</enum><header>Coordination with extended compensation</header><text display-inline="yes-display-inline">Section 4002(g) of such Act (as so designated by subsection (a)(1)) is amended by striking <quote>subsection (c), (d), or (e) (by reason of the amendments made by sections 2, 3, and 4 of the Worker, Homeownership, and Business Assistance Act of 2009),</quote> and inserting <quote>subsection (c), (d), (e), or (f),</quote>.</text></paragraph> 
<paragraph id="H1B49EC3A414B415D9D7FEEBAD8166873"><enum>(2)</enum><header>Transfer of funds</header><text>Section 4004(e)(1) of such Act is amended—</text> 
<subparagraph id="H041A7BD2051B4E72B29F9E75D0D057F0"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> after the semicolon; and</text></subparagraph> 
<subparagraph id="H4069469ACC474596A09D27D9B68EFEA6"><enum>(B)</enum><text>by adding after subparagraph (F) the following:</text> 
<quoted-block style="traditional" id="H8A8359EBAEB74ADE9DC7AC30A9A3E48F" display-inline="no-display-inline"> 
<subparagraph id="H3ACF6AB4AF6E4C639D73914F08DCFAE4" indent="up1"><enum>(G)</enum><text>the amendments made by section 2(a) of the <short-title>Emergency Unemployment Compensation Extension Act of 2010</short-title>; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H54A6985629E441C1838F186FF3D5CECC"><enum>(3)</enum><header>Non-augmentation rule</header><text>Section 4007(b)(2) of such Act is amended—</text> 
<subparagraph id="H4BE78523B9684372A54CEA9E517676C4"><enum>(A)</enum><text>by striking <quote>subsections (c), (d), and (e) of section 4002</quote> and inserting <quote>subsections (c), (d), (e), and (f)</quote>; and</text></subparagraph> 
<subparagraph id="H7C6996787122434B8257C15754A48F5D"><enum>(B)</enum><text>by striking <quote>such subsection (c), (d), or (e) (as the case may be)</quote> and inserting <quote>such subsection (c), (d), (e), or (f)</quote>. </text></subparagraph></paragraph></subsection></section> 
<section id="H9AA0AC781BCD42FBBF3190E5F3B1D213"><enum>3.</enum><header>Effective date</header> 
<subsection id="H5C39531BBAF14767A94768F077EC01FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by section 2 shall apply as if included in the enactment of the Supplemental Appropriations Act, 2008, subject to subsection (b).</text></subsection> 
<subsection id="H64A2BC63EB514374BD762C2A5F4C4981"><enum>(b)</enum><header>Additional benefits</header><text display-inline="yes-display-inline">In applying the amendments made by section 2, any additional emergency unemployment compensation made payable by such amendments (which would not otherwise have been payable if such amendments had not been enacted) shall be payable only with respect to any week of unemployment beginning on or after the date of the enactment of this Act.</text> </subsection></section>
