<section id="HF999C804A4D04072BC32FDEB675BBC0F" section-type="undesignated-section" display-inline="yes-display-inline"><text display-inline="yes-display-inline"> <pagebreak/>That the following sums are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2010, and for other purposes, namely:</text> </section> 
<title id="H6400995531F84C3A9DD496E6943886C5"><enum>I</enum><appropriations-major id="H40E420DE4A1F44E5B3F1DFFBC5AE0C8E"><header>Department of homeland security</header></appropriations-major><appropriations-intermediate id="HCB94D92FA2B8400CB81E75EE44EAD188"><header>U.S. customs and border protection</header></appropriations-intermediate><appropriations-small id="H4D1ABD91E87E46A8A54299AEF7898EFB"><header>Salaries and expenses</header><text display-inline="no-display-inline">For an additional amount for <quote>Salaries and Expenses</quote>, $253,900,000, to remain available until September 30, 2011, of which $39,000,000 shall be for costs to maintain U.S. Customs and Border Protection Officer staffing on the Southwest Border of the United States, $29,000,000 shall be for hiring additional U.S. Customs and Border Protection Officers for deployment at ports of entry on the Southwest Border of the United States, $175,900,000 shall be for hiring additional Border Patrol agents for deployment to the Southwest Border of the United States, and $10,000,000 shall be to support integrity and background investigation programs.</text></appropriations-small><appropriations-small id="H2AC43F156A54498FB06D505A586A3C2C"><header>Border security fencing, infrastructure, and technology</header><text display-inline="no-display-inline">For an additional amount for <quote>Border Security Fencing, Infrastructure, and Technology</quote>, $14,000,000, to remain available until September 30, 2011, for costs of designing, building, and deploying tactical communications for support of enforcement activities on the Southwest Border of the United States.</text></appropriations-small><appropriations-small id="HC588B2723A0748ECA241960BA24929E9"><header>Air and marine interdiction, operations, maintenance, and procurement</header><text display-inline="no-display-inline">For an additional amount for <quote>Air and Marine Interdiction, Operations, Maintenance, and Procurement</quote>, $32,000,000, to remain available until September 30, 2012, for costs of acquisition and deployment of unmanned aircraft systems.</text></appropriations-small><appropriations-small id="H6BCBDF889A8D4D5D89EFD79AA858DDA5"><header>Construction and facilities management</header><text display-inline="no-display-inline">For an additional amount for <quote>Construction and Facilities Management</quote>, $6,000,000, to remain available until September 30, 2011, for costs to construct up to 2 forward operating bases for use by the Border Patrol to carry out enforcement activities on the Southwest Border of the United States.</text></appropriations-small><appropriations-intermediate id="H314373F4ECD44AC58CF969C8AC3222C4"><header>U.S. immigration and customs enforcement</header></appropriations-intermediate><appropriations-small id="H7AF30993D4104F2E91DC5BD8512912BC"><header>Salaries and expenses</header><text display-inline="no-display-inline">For an additional amount for <quote>Salaries and Expenses</quote>, $80,000,000, to remain available until September 30, 2011, of which $30,000,000 shall be for law enforcement activities targeted at reducing the threat of violence along the Southwest Border of the United States, and $50,000,000 shall be for hiring of additional agents, investigators, intelligence analysts, and support personnel.</text></appropriations-small><appropriations-intermediate id="HA0C90E459A544641B0ABC9349FEB7D96"><header>Federal law enforcement training center</header></appropriations-intermediate><appropriations-small id="H4321C3F7B9114FBDB251E9294D7E450A"><header>Salaries and expenses</header><text display-inline="no-display-inline">For an additional amount for <quote>Salaries and Expenses</quote>, $8,100,000, to remain available until September 30, 2011, for costs to provide basic training for new U.S. Customs and Border Protection Officers, Border Patrol agents, and U.S. Immigration and Customs Enforcement personnel.</text></appropriations-small><appropriations-major id="HDAD86AED83864B86BB9706974DB2DFA0"><header>General provisions</header></appropriations-major><appropriations-small id="HC0863358A8D744249913DCAD5895CB3E"><header>(rescissions)</header></appropriations-small> 
<section id="H97DD8BE4A6514342AD43FBEAC755393D"><enum>101.</enum><text display-inline="yes-display-inline">From unobligated balances made available to U.S. Customs and Border Protection <quote>Border Security Fencing, Infrastructure, and Technology</quote>, $100,000,000 are rescinded: <italic>Provided</italic>, That section 401 shall not apply to the amount in this section.</text></section></title>

<title id="H6BEEE0A0ED8E488992CE55B6AA9ACA86"><enum>IV</enum><appropriations-major id="H55F1B9A1CA864344B8474FAD6DBACFAE"><header>general provisions</header></appropriations-major> 
<section id="H5C3E776A66EC4CD7822A926AFA3CF615"><enum>401.</enum><text display-inline="yes-display-inline">Each amount appropriated or otherwise made available under this Act is designated as an emergency requirement and necessary to meet emergency needs pursuant to sections 403(a) and 423(b) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010.</text></section> 
<section id="H2B1315A21D0C46B9B3F9ADE17E734E6E"><enum>402.</enum> 
<subsection id="H903B9696634D45C09DEB26BBD6AFEB77" display-inline="yes-display-inline"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or any other provision of law, during the period beginning on the date of the enactment of this Act and ending on September 30, 2014, the filing fee and fraud prevention and detection fee required to be submitted with an application for admission as a nonimmigrant under section 101(a)(15)(L) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(L)) shall be increased by $2,250 for applicants that employ 50 or more employees in the United States if more than 50 percent of the applicant's employees are nonimmigrants admitted pursuant to section 101(a)(15)(H)(i)(b) of such Act or section 101(a)(15)(L) of such Act.</text></subsection> 
<subsection id="H9967FC1F90D34FFBB6C419819850C3AD"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act or any other provision of law, during the period beginning on the date of the enactment of this Act and ending on September 30, 2014, the filing fee and fraud prevention and detection fee required to be submitted with an application for admission as a nonimmigrant under section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(H)(i)(b)) shall be increased by $2,000 for applicants that employ 50 or more employees in the United States if more than 50 percent of the applicant's employees are such nonimmigrants or nonimmigrants described in section 101(a)(15)(L) of such Act.</text></subsection> 
<subsection id="HD695AA28488E4E3A9647AA0DD1A256B2"><enum>(c)</enum><text display-inline="yes-display-inline">During the period beginning on the date of the enactment of this Act and ending on September 30, 2014, all amounts collected pursuant to the fee increases authorized under this section shall be deposited in the General Fund of the Treasury.</text></subsection></section></title>
