		  to clarify the application of EHR payment incentives in cases of multi-campus

		<section id="H8E56D76780374C59963EEE90FDC1A9B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Electronic Health Record Incentives for Multi-Campus
			 Hospitals Act of 2010</short-title></quote>.</text>
		</section><section id="H48A710562F9045C2BEFC61B0CDCF0A43"><enum>2.</enum><header>Clarification of
			 incentives for multi-campus hospitals for adoption and meaningful use of
			 certified electronic health records</header>
			<subsection id="HBEA976E93ABF4DAA815FD4D16F1DFC85"><enum>(a)</enum><header>Special rule for
			 applying Medicare EHR incentive payments to remote inpatient locations of a
			 hospital</header><text display-inline="yes-display-inline">Section 1886(n) of
			 the Social Security Act (42 U.S.C. 1395ww(n)) is amended—</text>
				<paragraph id="HBACC947A528F4805A235FF1CA20CDCD5"><enum>(1)</enum><text>in paragraph (2),
			 by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H724876B76B0245AAB6991886DD5624F5" style="OLC">
						<subparagraph id="H941B68530F5D4F5B9E824F1ADA66750E"><enum>(H)</enum><header>Special rule for
				remote inpatient locations of a hospital</header>
							<clause id="HCC72BC320DAC421FB4B0E1F5D6954D14"><enum>(i)</enum><header>In
				general</header><text>In the case of an eligible hospital that consists of a
				qualified main provider and one or more qualified remote inpatient locations,
				the hospital may elect (in such form and manner as specified by the Secretary)
				for all applicable payment years to—</text>
								<subclause id="H928986C640D24C15B32C1A9CF06428EC"><enum>(I)</enum><text>substitute the
				base amount alternative described in clause (ii) for the base amount described
				in subparagraph (A)(i)(I); or</text>
								</subclause><subclause id="HF95A9930260349C8AA682870EFDDE485"><enum>(II)</enum><text>substitute the
				discharge related amount alternative described in clause (iii) for the
				discharge related amount described in subparagraph (A)(i)(II).</text>
								</subclause><continuation-text continuation-text-level="clause">The election
				described in the previous sentence, with respect to an eligible hospital, shall
				be made once for such hospital and shall apply to such hospital for all
				applicable payment years.</continuation-text></clause><clause id="H5997036052984689AD07159F75A03A19"><enum>(ii)</enum><header>Base amount
				alternative</header><text>The base amount alternative described in this clause
				with respect to an eligible hospital is the product of—</text>
								<subclause id="HA1DB5CDD46BB48CEB140FEFCAE984B15"><enum>(I)</enum><text>the base amount
				specified in subparagraph (B); and</text>
								</subclause><subclause id="H817366C11D94417C915CE8054B3F8DC9"><enum>(II)</enum><text>the total number
				of all qualified component facilities of the hospital.</text>
								</subclause><continuation-text continuation-text-level="clause">An election
				to substitute the base amount alternative described in this clause shall not
				affect the computation of the discharge related amount specified in
				subparagraph (C) for the eligible hospital.</continuation-text></clause><clause id="H0D097471A75048B3B41129DD972D1634"><enum>(iii)</enum><header>Discharge
				related amount alternative</header><text display-inline="yes-display-inline">The discharge related amount alternative
				described in this clause with respect to an eligible hospital for a 12-month
				period is determined as follows:</text>
								<subclause id="HF6F8D9F7122040548E7ACC8FA0174F42"><enum>(I)</enum><text>First, compute the
				amount under subparagraph (C) as if the phrase <quote>estimated based upon
				total discharges for the eligible hospital (regardless of any source of
				payment) for the period divided by the total number of all component facilities
				of the hospital</quote> were substituted for the phrase <quote>estimated based
				upon total discharges for the eligible hospital (regardless of any source of
				payment) for the period</quote>.</text>
								</subclause><subclause id="H2E50545ADAD3475EAB594249078047CC"><enum>(II)</enum><text>Then multiply the
				amount computed under subclause (I) by the total number of all qualified
				component facilities of such hospital.</text>
								</subclause></clause><clause id="H7659C99F075546C2B81FCF3DE772A8CD"><enum>(iv)</enum><header>Definitions</header><text>For
				purposes of this subsection:</text>
								<subclause id="H753AE3F7C601424DB64898EC76B11789"><enum>(I)</enum><header>Applicable
				payment year</header><text>The term <term>applicable payment year</term> means
				the first payment year for which a hospital makes an election described in
				clause (i) and each subsequent payment year applicable to such hospital.</text>
								</subclause><subclause id="H7824BCA27F3144D694355360382DD118"><enum>(II)</enum><header>Component
				facility; qualified component facility</header><text display-inline="yes-display-inline">The term <term>component facility</term>
				means, with respect to an eligible hospital, the main provider or any remote
				inpatient location of such hospital. The term <term>qualified component
				facility</term> means, with respect to a main provider, a qualified main
				provider and, with respect to a remote inpatient location, a qualified remote
				inpatient location.</text>
								</subclause><subclause id="H2EDDF732555F485DB95B4E5E803B0746"><enum>(III)</enum><header>Main provider;
				qualified main provider</header><text display-inline="yes-display-inline">The
				term <term>main provider</term>, with respect to an eligible hospital, has the
				meaning given such term in section 413.65(a)(2) of title 42, Code of Federal
				Regulations. The term <term>qualified main provider</term> means a main
				provider that is a meaningful EHR user for the reporting period
				involved.</text>
								</subclause><subclause id="H0F0584A93177403DB8B596C530E3D8BC"><enum>(IV)</enum><header>Remote
				inpatient location; qualified remote inpatient location</header><text display-inline="yes-display-inline">The term <term>remote inpatient
				location</term> means, with respect to an eligible hospital, a remote location
				of a hospital, as defined in and applied under section 413.65 of title 42, Code
				of Federal Regulations, that provides inpatient hospital services that are paid
				for under subsection (d). The term <term>qualified remote inpatient
				location</term> means, with respect to an eligible hospital, a location for
				which the eligible hospital has submitted to the Secretary, for the reporting
				period involved, an attestation (in such form and manner as specified by the
				Secretary) that certifies that the location is a remote inpatient location and
				a meaningful EHR user for such period.</text>
								</subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HBBBE958FA7D24A6A884EC62DF754E9D5"><enum>(2)</enum><text>in paragraph
			 (4)(A)—</text>
					<subparagraph id="HD83419D0D0534582927DB5E9BD41033A"><enum>(A)</enum><text>at the end of
			 clause (ii), by striking <quote>and</quote>;</text>
					</subparagraph><subparagraph id="HEFC099E23F8041D1B8DD0ED07CC85374"><enum>(B)</enum><text>at the end of
			 clause (iii), by striking the period and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="HEA6E3147EFAF431A89F9D7C399193AB1"><enum>(C)</enum><text>by adding at the
			 end the following new clauses:</text>
						<quoted-block display-inline="no-display-inline" id="H6AB12824E7C64755A55AFE8C5749966A" style="OLC">
							<clause id="H9F13C11009FC4B7ABD3556902AFEAB65"><enum>(iv)</enum><text display-inline="yes-display-inline">the methodology and standards for
				determining a remote inpatient location, a qualified remote inpatient location,
				a component facility, a qualified component facility, a main provider, and a
				qualified main provider, as such terms are defined in paragraph (2)(H)(iv), and
				which such locations, facilities, and providers are qualified remote inpatient
				locations, qualified component facilities, and qualified main providers, as
				such terms are defined in such paragraph; and</text>
							</clause><clause id="H316128C7944446E48D9C4153E5CE9A4D"><enum>(v)</enum><text display-inline="yes-display-inline">the methodology and standards for the
				election described in paragraph
				(2)(H).</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HDBA3A3DED2134528A831DC22B99F5428"><enum>(b)</enum><header>Implementation
			 and administration</header>
				<paragraph id="H514034338C274BEE8F38AA2C85891818"><enum>(1)</enum><header>Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Health and Human Services may implement by program instruction
			 or otherwise this section.</text>
				</paragraph><paragraph id="H23AC7E2E6C674A6FA17CF6DFAD4495EB"><enum>(2)</enum><header>Administration</header><text display-inline="yes-display-inline">Chapter 35 of title 44, United States Code,
			 shall not apply to the collection of information to carry out the amendments
			 made by this section.</text>
				</paragraph></subsection><subsection commented="no" id="HB6DC5B17FF8B4F359C91CB6CDA3B4955"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply as if included in the enactment of the American
			 Recovery and Reinvestment Act of 2009 (Public Law 111–5).</text>
			</subsection></section><section commented="no" id="HB3236E2B579A4ED88BF0F0CD01663CA9"><enum>3.</enum><header>Clarification for
			 Medicaid EHR payment incentives</header>
			<subsection commented="no" id="H7D7D11DD14F14B68B737FF241D6B4A7B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1903(t)(5) of
			 the Social Security Act (42 U.S.C. 1396b(t)(5)) is amended—</text>
				<paragraph commented="no" id="H6F43001DAB794A13BD284B0C509FFA28"><enum>(1)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H3E954C8D632749AE984C594743292E7D" style="OLC">
						<subparagraph commented="no" id="HDF800D3007AF4A96A90F75AE483B08E5" indent="up2"><enum>(E)</enum><text display-inline="yes-display-inline">For purposes of determining the applicable
				amounts specified in subparagraph (A) of section 1886(n)(2), as applied by the
				first sentence of subparagraph (B)—</text>
							<clause commented="no" id="H07E57D36CEE04EC1B42537DACF52925C"><enum>(i)</enum><text display-inline="yes-display-inline">the provisions of subparagraph (H) of such
				section shall apply to a Medicaid provider described in paragraph (2)(B)
				consisting of a qualified main provider and one or more qualified remote
				inpatient locations (as such terms are defined in clause (iv) of such
				subparagraph (H)) in the same manner and to the same extent that such
				subparagraph applies to an eligible hospital described in clause (i) of such
				subparagraph, except that—</text>
								<subclause commented="no" id="HF085DDFF931D41F8AB283A880CD7A5C1"><enum>(I)</enum><text display-inline="yes-display-inline">in applying the second sentence of clause
				(iv)(IV) of such subparagraph, with respect to a Medicaid provider described in
				paragraph (2)(B), in lieu of certifying that a remote inpatient location is a
				meaningful EHR user, the Medicaid provider shall certify that the remote
				inpatient location is described in paragraph (2)(B) and is in compliance with
				paragraph (6)(C) of this subsection for the year of payment involved;
				and</text>
								</subclause><subclause commented="no" id="H6B66C162C8304D0D8DD1FCB8AC9DDBF9"><enum>(II)</enum><text display-inline="yes-display-inline">the first sentence of clause (iv)(IV) of
				such subparagraph shall be applied in the case of a Medicaid provider described
				in paragraph (2)(B)(i) without regard to the requirement that inpatient
				hospital services provided are paid for under section 1886(d); and</text>
								</subclause></clause><clause commented="no" id="HC2558F52BBB344F08CDADFC694D41ADE"><enum>(ii)</enum><text>an election made under subparagraph
				(H) of such section by an eligible hospital described in clause (i) of such
				subparagraph that is a Medicaid provider described in paragraph (2)(B), shall
				apply.</text>
							</clause><continuation-text continuation-text-level="subparagraph">The
				Secretary may make appropriate adjustments to the overall hospital EHR amount
				under subparagraph (B), with respect to a Medicaid provider described in
				paragraph (2)(B), to take into account the provisions of this
				subparagraph.</continuation-text></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H6800D0928E21406DBEC9065EF5ADE9B9"><enum>(2)</enum><text>in the first
			 sentence of subparagraph (B), by inserting <quote>and subject to subparagraph
			 (E)</quote> after <quote>For purposes of this paragraph</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H7764104532A745F89F7A02993C73DE85"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply as if
			 included in the enactment of the American Recovery and Reinvestment Act of 2009
			 (Public Law 111–5).</text>
