		<official-title>To amend title 18, United States Code, to provide for
		  deferred sentencing and the possibility of dismissal for drug offenders, and
		  for other purposes.</official-title>

		<section id="HF3E500ACDE0349DD9D89A4BD0CE16FCA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal First Offender Improvement Act
			 of 2010</short-title></quote>.</text>
		</section><section id="H08E56882CB054443B4CC872D60A9F8D1" section-type="subsequent-section"><enum>2.</enum><header>Deferred sentencing
			 with the possibility of dismissal for drug offenders</header>
			<subsection id="HF3E5D2D72C614DAC8A9B4CA3CA6D3000"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3607(a) of
			 title 18, United States Code, is amended—</text>
				<paragraph id="H38679380614C43639CB2DA876359533E"><enum>(1)</enum><text>by striking
			 <quote>found guilty of an offense under section 404 of the Controlled
			 Substances Act (21 U.S.C. 844)</quote> and inserting <quote>is found guilty of
			 an offense under section 401, 404, or 406 of the Controlled Substances Act (21
			 U.S.C. 841, 844, 846), and</quote>;</text>
				</paragraph><paragraph id="HDE4181C423ED433FA165F17022394737"><enum>(2)</enum><text>by striking
			 paragraphs (1) and (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H443B624BA44244DBA644B87E562A9DDC" style="USC">
						<paragraph id="HA2BB39CE0145414BBB9C019AA401E4C2"><enum>(1)</enum><text>that person did
				not use violence or credible threats of violence or possess a firearm or other
				dangerous weapon (or induce another participant to do so) in connection with
				the offense;</text>
						</paragraph><paragraph id="HEAD2846D51AC4FAC9C90E76549DF38B7"><enum>(2)</enum><text>the offense did
				not result in death or serious bodily injury to any person;</text>
						</paragraph><paragraph id="HE0EEC62147D848799D02E79B2EAD08B0"><enum>(3)</enum><text>that person was
				not an organizer, leader, manager, or supervisor of others in the offense, as
				determined under the sentencing guidelines and was not engaged in a continuing
				criminal enterprise, as defined in section 408 of the Controlled Substances
				Act;</text>
						</paragraph><paragraph id="HE833782187564876A846FF53ABE1FF4F"><enum>(4)</enum><text display-inline="yes-display-inline">that person has not previously been the
				subject of a disposition under this subsection; and</text>
						</paragraph><paragraph id="H19D8501483E740C8BB6E353C495E28CC"><enum>(5)</enum><text display-inline="yes-display-inline">that person has not been previously
				convicted of a crime of violence or other offense punishable by a term of
				imprisonment for more than one year;</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8522F861AEDE47C4B29D405FEED3667D"><enum>(3)</enum><text>by striking
			 <quote>one year</quote> and inserting <quote>2 years</quote>.</text>
				</paragraph></subsection><subsection id="HDE6A4BDF95404BB88007B0DB0CF50596"><enum>(b)</enum><header>Expungement</header><text>Section
			 3607(c) of title 18, United States Code, is amended—</text>
				<paragraph id="H0F1616F6CC454F9B919B7B3D6F2B0C2B"><enum>(1)</enum><text>by striking
			 <quote>found guilty of an offense under section 404 of the Controlled
			 Substances Act (21 U.S.C. 844)</quote> and inserting <quote>found guilty of an
			 offense under section 401, 404, or 406 of the Controlled Substances Act (21
			 U.S.C. 841, 844, 846)</quote>; and</text>
				</paragraph><paragraph id="HD5FE978ACA864589982E8DC8C495A4C6"><enum>(2)</enum><text>by striking
			 <quote>, and the person was less than twenty-one years old at the time of the
			 offense</quote>.</text>
				</paragraph></subsection><subsection id="H70B34AB2D1B7402EB0901AC7901DC04F"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HDF79A5D1D80D41E2B5B2E1B5E4230179"><enum>(1)</enum><text>The heading for
			 section 3607 of title 18, United States Code, is amended by striking
			 <quote><header-in-text level="section" style="OLC">drug
			 possessors</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">drug offenders</header-in-text></quote>.</text>
				</paragraph><paragraph id="H5D4C0A3DC94544A19A7C4F59DCF3E66E"><enum>(2)</enum><text>The item relating
			 to section 3607 in the table of sections at the beginning of subchapter A of
			 chapter 229 of title 18, United States Code, is amended by striking <quote>drug
			 possessors</quote> and inserting <quote>drug offenders</quote>.</text>
