		<official-title>To provide for a land exchange with the City of
		  Bountiful, Utah, involving National Forest System land in the Wasatch-Cache
		  National Forest and to further land ownership consolidation in that national
		  forest, and for other purposes.</official-title>

		<section id="H1D4C37A3575E424D80BA90D29DD8CC14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bountiful City Land Consolidation
			 Act</short-title></quote>.</text>
		</section><section id="HA728031C3CB84325A415BFBBB8E9988"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1CAE2D86778B4EFAA7CA84B0EB00ABA8"><enum>(1)</enum><header>City</header><text>The
			 term <quote>City</quote> means the City of Bountiful, Utah.</text>
			</paragraph><paragraph id="HC0F0421465F147ABB062831FF99ED6DE"><enum>(2)</enum><header>Federal
			 land</header><text>The term <quote>Federal land</quote> means the land under
			 the jurisdiction of the Secretary identified on the map as <quote>Shooting
			 Range Special Use Permit Area</quote>.</text>
			</paragraph><paragraph id="H62A86DAB02884D7FA1C2DAB212143467"><enum>(3)</enum><header>Map</header><text>The
			 term <quote>map</quote> means the map entitled <quote>Bountiful City Land
			 Consolidation Act</quote> and dated October 15, 2007.</text>
			</paragraph><paragraph id="H34932EB365D646C5007067429F67A5F2"><enum>(4)</enum><header>Non-federal
			 land</header><text>The term <quote>non-Federal land</quote> means the 3 parcels
			 of City land comprising a total of approximately 1,680 acres, as generally
			 depicted on the map.</text>
			</paragraph><paragraph id="H601A680C841C44F89104DFCBBA001BDA"><enum>(5)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
			</paragraph></section><section id="H2DA0B6F80DD3455F8869BE96B847B2AE"><enum>3.</enum><header>Land exchange,
			 Wasatch-Cache National Forest, Utah</header>
			<subsection id="HEC7945F804DC4A5D9FD2F0F61643E8CA"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Subject to
			 subsections (c) through (g), if the City of Bountiful, Utah, conveys to the
			 Secretary of Agriculture all right, title, and interest of the City in and to
			 the non-Federal land, the Secretary shall convey to the City all right, title,
			 and interest of the United States in and to the Federal land.</text>
			</subsection><subsection id="HFB5A79257C36495DB9FD3046D298D001"><enum>(b)</enum><header>Availability of
			 Map</header><text>The map shall be on file and available for public inspection
			 in the appropriate offices of the Forest Service.</text>
			</subsection><subsection id="H4C2A8476B0B94A1AA4466C20D93FAAB0"><enum>(c)</enum><header>Valuation and
			 Equalization</header>
				<paragraph id="H9B58731E94CF43CB0094A92EACF039E6"><enum>(1)</enum><header>Valuation</header><text>The
			 value of the Federal land and the non-Federal land to be conveyed under
			 subsection (a)—</text>
					<subparagraph id="H8CD74385C23441B7B4A5697E49356FAA"><enum>(A)</enum><text>shall be equal, as
			 determined by appraisals carried out in accordance with section 206 of the
			 Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716); or</text>
					</subparagraph><subparagraph id="HA87AB290316A4B9B91203FD1A17263DB"><enum>(B)</enum><text>if not equal,
			 shall be equalized in accordance with paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="HFB1122B129184EF796A306897EF73852"><enum>(2)</enum><header>Equalization</header><text>If
			 the value of the Federal land and the non-Federal land to be conveyed in a land
			 exchange under this section is not equal, the value may be equalized by—</text>
					<subparagraph id="H9347B6CC16F5428EB1185B2DDFADD62"><enum>(A)</enum><text>making a cash
			 equalization payment to the Secretary or to the City, as appropriate; or</text>
					</subparagraph><subparagraph id="H66C0CCB6E6344D9B9FC7EF458CF50358"><enum>(B)</enum><text>reducing the
			 acreage of the Federal land or the non-Federal land to be exchanged, as
			 appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="H4FEB592180E940FD826402C1CB1DEA7F"><enum>(d)</enum><header>Applicable
			 Law</header><text>Section 206 of the Federal Land Policy and Management Act of
			 1976 (43 U.S.C. 1716) shall apply to the land exchange authorized under
			 subsection (a), except that the Secretary may accept a cash equalization
			 payment in excess of 25 percent of the value of the Federal land.</text>
			</subsection><subsection id="H280A8695BB91414D9189FFDEB9C345F3"><enum>(e)</enum><header>Conditions</header>
				<paragraph id="H72D61F1271EC412DBDD70556ACAAA600"><enum>(1)</enum><header>Liability</header>
					<subparagraph id="HF71D2022E3D74CDFB1FB3EB8C00A32C"><enum>(A)</enum><header>In
			 general</header><text>As a condition of the exchange under subsection (a), the
			 Secretary shall—</text>
						<clause id="H8381921BD68E4853A6525DADAE4972E9"><enum>(i)</enum><text>require that the
			 City—</text>
							<subclause id="H9ADF283732AB42D685ADE930D7FF7080"><enum>(I)</enum><text>assume all
			 liability for the shooting range located on the Federal land, including the
			 past, present, and future condition of the Federal land; and</text>
							</subclause><subclause id="HFEE07F7FA4D643D5B9ECDEEA073C23BA"><enum>(II)</enum><text>hold the United
			 States harmless for any liability for the condition of the Federal land;
			 and</text>
							</subclause></clause><clause id="H1FC5D75BBDFF4F84B451257F00671927"><enum>(ii)</enum><text>comply with the
			 hazardous substances disclosure requirements of section 120(h) of the
			 Comprehensive Environmental Response, Compensation, and Liability Act of 1980
			 (42 U.S.C. 9620(h)).</text>
						</clause></subparagraph><subparagraph id="H11BB38D96B7E49E9B76FEE0923DA22D6"><enum>(B)</enum><header>Limitation</header><text>Clauses
			 (ii) and (iii) of section 120(h)(3)(A) of the Comprehensive Environmental
			 Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9620(h)(3)(A))
			 shall not apply to the conveyance of Federal land under subsection (a).</text>
					</subparagraph></paragraph><paragraph id="H218EB12194DC44F7A57F8988AD76EDCE"><enum>(2)</enum><header>Additional terms
			 and conditions</header><text>The land exchange under subsection (a) shall be
			 subject to—</text>
					<subparagraph id="H0094D3FF623441EB95C9944F3C005630"><enum>(A)</enum><text>valid existing
			 rights; and</text>
					</subparagraph><subparagraph id="HCEE1FF780FF648F5AC5600433ECA0060"><enum>(B)</enum><text>such additional
			 terms and conditions as the Secretary may require.</text>
					</subparagraph></paragraph></subsection><subsection id="H79FCC78779F5433AA853E1C869605DC"><enum>(f)</enum><header>Management of
			 Acquired Land</header><text>The non-Federal land acquired by the Secretary
			 under subsection (a) shall be—</text>
				<paragraph id="HB6FAC2A95FFC448C8F6B4900DCB6B1DB"><enum>(1)</enum><text>added to, and
			 administered as part of, the Wasatch-Cache National Forest; and</text>
				</paragraph><paragraph id="H148D9E24B7AF41D99B8F47D7C653F75D"><enum>(2)</enum><text>managed by the
			 Secretary in accordance with—</text>
					<subparagraph id="H44768B620CAC4FED937660A0287C54CD"><enum>(A)</enum><text>the Act of March
			 1, 1911 (commonly known as the Weeks Law; 16 U.S.C. 480 et seq.); and</text>
					</subparagraph><subparagraph id="HBEAB015831584EA59167252FA7AA94CE"><enum>(B)</enum><text>any laws
			 (including regulations) applicable to the National Forest System.</text>
					</subparagraph></paragraph></subsection><subsection id="H17F3DF2F126340F38C88A7AE1D535B78"><enum>(g)</enum><header>Easements;
			 Rights-of-Way</header>
				<paragraph id="H4780039F3C624B5B903834FEE42D3728"><enum>(1)</enum><header>Bonneville
			 shoreline trail easement</header><text>In carrying out the land exchange under
			 subsection (a), the Secretary shall ensure that an easement not less than 60
			 feet in width is reserved for the Bonneville Shoreline Trail.</text>
				</paragraph><paragraph id="HF83F77A26A6B492F9E8100E6FB36EFB2"><enum>(2)</enum><header>Other
			 rights-of-way</header><text>The Secretary and the City may reserve any other
			 rights-of-way for utilities, roads, and trails that—</text>
					<subparagraph id="H12357E4013374193BA58D6CDD0D44C27"><enum>(A)</enum><text>are mutually
			 agreed to by the Secretary and the City; and</text>
					</subparagraph><subparagraph id="HA48919341AE54FE4BC576100D5B671FA"><enum>(B)</enum><text>the Secretary and
			 the City consider to be in the public interest.</text>
					</subparagraph></paragraph></subsection><subsection id="H4C379EBBDF6343E6B75CAB89DF9E9B69"><enum>(h)</enum><header>Disposal of
			 Remaining Federal Land</header>
				<paragraph id="H0FB72C214CB04692A2A71F61E381195C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may, by sale or exchange, dispose of all,
			 or a portion of, the parcel of National Forest System land comprising
			 approximately 220 acres, as generally depicted on the map that remains after
			 the conveyance of the Federal land authorized under subsection (a), if the
			 Secretary determines, in accordance with paragraph (2), that the land or
			 portion of the land is in excess of the needs of the National Forest
			 System.</text>
				</paragraph><paragraph id="HCEB68686C68F4FF6A510EF39C77FA9A"><enum>(2)</enum><header>Requirements</header><text>A
			 determination under paragraph (1) shall be made—</text>
					<subparagraph id="HDC2BBFEE928D426800A1DE56436E9C87"><enum>(A)</enum><text>pursuant to an
			 amendment of the land and resource management plan for the Wasatch-Cache
			 National Forest; and</text>
					</subparagraph><subparagraph id="H9470B8079CB041FBB0B23230E5088F24"><enum>(B)</enum><text>after carrying out
			 a public process consistent with the National Environmental Policy Act of 1969
			 (42 U.S.C. 4321 et seq.).</text>
					</subparagraph></paragraph><paragraph id="H134A8D305FAB4D5C9418AE54CFA360DD"><enum>(3)</enum><header>Consideration</header><text>As
			 consideration for any conveyance of Federal land under paragraph (1), the
			 Secretary shall require payment of an amount equal to not less than the fair
			 market value of the conveyed National Forest System land.</text>
				</paragraph><paragraph id="HCFA00661B067413ABDE4003C1CD46E00"><enum>(4)</enum><header>Relation to
			 other laws</header><text>Any conveyance of Federal land under paragraph (1) by
			 exchange shall be subject to section 206 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1716).</text>
				</paragraph><paragraph id="H087F12275F384C948E6200E3E5FDE0DC"><enum>(5)</enum><header>Disposition of
			 proceeds</header><text>Any amounts received by the Secretary as consideration
			 under subsection (c) or paragraph (3) shall be—</text>
					<subparagraph id="HD542C5BEBB1A4D33AE66EAA3AB24B5D4"><enum>(A)</enum><text>deposited in the
			 fund established under Public Law 90–171 (commonly known as the Sisk Act; 16
			 U.S.C. 484a); and</text>
					</subparagraph><subparagraph id="HBF52E7212BF040E4819C235067B04E08"><enum>(B)</enum><text>available to the
			 Secretary, without further appropriation and until expended, for the
			 acquisition of land or interests in land to be included in the Wasatch-Cache
			 National Forest.</text>
					</subparagraph></paragraph><paragraph id="H57323FD68D4B467CA34D6FAC4EC20192"><enum>(6)</enum><header>Additional terms
			 and conditions</header><text>Any conveyance of Federal land under paragraph (1)
			 shall be subject to—</text>
					<subparagraph id="HEE7CD7BC39364D5AB45E42A30001C01C"><enum>(A)</enum><text>valid existing
			 rights; and</text>
					</subparagraph><subparagraph id="HB4AFB45C996B4783A056945BEC76001F"><enum>(B)</enum><text>such additional
			 terms and conditions as the Secretary may require.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
