		<official-title>To amend the Foreign Assistance Act of 1961 to prohibit
		  the United States Agency for International Development from procuring
		  manufactured articles to provide disaster relief assistance or emergency relief
		  assistance in a foreign country unless the articles are manufactured in such
		  foreign country or in certain circumstances in the United States or third
		  countries.</official-title>

		<section id="H8DFCF402BE2D40819982074336611E59" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Manufacturing Disaster Relief Act of
			 2010</short-title></quote>.</text>
		</section><section id="HD8F03D77DEAD4A299C18A8D435EAEDD6"><enum>2.</enum><header>Clarification of
			 certain Buy American requirements to disaster relief assistance and emergency
			 relief assistance under the Foreign Assistance Act of 1961</header>
			<subsection id="HC27CF3E3A8C94BD1901B5E5EC4FB9086"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 604 of the
			 Foreign Assistance Act of 1961 (22 U.S.C. 2354) is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H360A3D8A8845434B80905661A863556A" style="OLC">
					<subsection id="H636B9EDBF1C54B7E904BFBE70A4A2AC8"><enum>(h)</enum><header>Clarification of
				certain Buy American requirements</header>
						<paragraph id="H3F93AAFCBE6F433D83BD1ABAAAD23F8F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				paragraph (2), the Administrator may not procure a manufactured article to
				provide disaster relief assistance or emergency relief assistance in a foreign
				country unless the article is manufactured in such foreign country.</text>
						</paragraph><paragraph id="HFC1C5354877C4AB89CE4C3284678C5A1"><enum>(2)</enum><header>Exceptions</header>
							<subparagraph id="H2217E818B5AC4E44947D3AF9635011C7"><enum>(A)</enum><header>For
				U.S.-manufactured articles</header><text display-inline="yes-display-inline">If
				the Administrator determines that satisfactory quality and sufficient quantity
				of the article described in paragraph (1) cannot be procured as and when
				needed, the Administrator may procure an article manufactured in the United
				States to provide disaster relief assistance or emergency relief assistance in
				such foreign country.</text>
							</subparagraph><subparagraph id="H68B4EBD57AD5495C85760185890FE747"><enum>(B)</enum><header>For other
				manufactured articles</header><text>If the Administrator determines that
				satisfactory quality and sufficient quantity of the article described in
				paragraph (A) cannot be procured as and when needed, the Administrator may
				procure an article manufactured in any other country to provide disaster relief
				assistance or emergency relief assistance in such foreign country.</text>
							</subparagraph></paragraph><paragraph id="HDE8AEC94D56B4792A61F625D053A6F77"><enum>(3)</enum><header>Consistency with
				international agreements</header><text display-inline="yes-display-inline">No
				provision of this subsection shall apply to the extent the Administrator, in
				consultation with the United States Trade Representative, determines that it is
				inconsistent with United States obligations under an international
				agreement.</text>
						</paragraph><paragraph id="H285295146BA34444A9421B0DE038D33B"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection—</text>
							<subparagraph id="H65018F43269440EDA0C7FFA445D0FE04"><enum>(A)</enum><text>the term
				<term>Administrator</term> means the Administrator of the United States Agency
				for International Development;</text>
							</subparagraph><subparagraph id="H884CE5B0E96B44069FCF25148EEF3DB3"><enum>(B)</enum><text>the term
				<term>disaster relief assistance</term> means assistance under chapter 9 of
				part I of this Act;</text>
							</subparagraph><subparagraph id="H9D2AFBB82DB745D4BA6306EF5967C63B"><enum>(C)</enum><text>the term
				<term>emergency relief assistance</term> means assistance under part I of this
				Act to address an urgent situation in which a population is in imminent danger
				of increased malnutrition and mortality as a result of food shortages;
				and</text>
							</subparagraph><subparagraph id="H86D53901DAC34D5D9E5DD9180AD491DF"><enum>(D)</enum><text display-inline="yes-display-inline">the term <term>manufactured</term> means,
				with respect to a country, the article has been manufactured in such country
				substantially all from articles, materials, or supplies mined, produced, or
				manufactured, as the case may be, in such
				country.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H932815FED8774767ABEB908BD8DFA48E"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section takes effect 90 days
			 after the date of the enactment of this Act and applies to any contract entered
			 into on or after that date for the procurement of articles to which such
			 amendment applies.</text>
