		<section id="H4C06BEFDE6EF4541AE0B8595B8FFF389" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Corporate Liability and Emergency
			 Accident Notification Act</short-title></quote> or <quote><short-title>CLEAN Act</short-title></quote>.</text>
		</section><section id="H7B62360385434F1D9E2132CE40980ADD"><enum>2.</enum><header>Notification of
			 incidents</header>
			<subsection id="H52CBD3012A434C868AF6D6E0A36C77D7"><enum>(a)</enum><header>Telephonic
			 notice of certain incidents</header>
				<paragraph id="HAD8E81C4B39C47C08CF535291716E172"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">Chapter 601</external-xref> of title 49,
			 United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H931E333ACDEB4641B478C07F6072DB2B" style="USC">
						<section id="HE4FEFF153C504AABA8143A5B3FEFFC89"><enum>60138.</enum><header>Telephonic
				notice of certain incidents</header>
							<subsection id="H2DFA5C8ADB7D4574A59079D77F1BAD67"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">An owner or operator
				of a pipeline facility shall provide immediate telephonic notice of—</text>
								<paragraph id="H35F72FD6C25845138310295BF44D9252"><enum>(1)</enum><text>a release of
				hazardous liquid or another substance regulated under part 195 of title 49,
				Code of Federal Regulations, resulting in an event for which notice is required
				under section 195.50 of such title; and</text>
								</paragraph><paragraph id="H556DF9DAA9B44B1DB8B03977A87CA00F"><enum>(2)</enum><text display-inline="yes-display-inline">a release of gas resulting in an incident,
				as defined in section 191.3 of such title.</text>
								</paragraph></subsection><subsection id="H86F34136D45B4D4CB581E69B7058B781"><enum>(b)</enum><header>Immediate
				telephonic notice defined</header><text display-inline="yes-display-inline">In
				subsection (a), the term <term>immediate telephonic notice</term> means
				telephonic notice, as described in section 191.5 of such title, to the
				Secretary and the National Response Center at the earliest practicable moment
				following discovery of a release of gas or hazardous liquid and not later than
				one hour following the time of such discovery.</text>
							</subsection><subsection id="HD78C54D794064AE78677D1EA50996589"><enum>(c)</enum><header>References</header><text>Any
				reference to a regulation in this section means the regulation as in effect on
				the date of enactment of this
				section.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0726D235FB334111B6D48388D7F6DEB6"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>

				incidents.</toc-entry>
						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF85D6307413A44E49E2B0B17848CE981"><enum>(b)</enum><header>Guidance</header><text>Not
			 later than 60 days after the date of enactment of this Act, the Secretary shall
			 issue guidance to clarify the meaning of the term <quote>discovery</quote> as
			 used in <external-xref legal-doc="usc" parsable-cite="usc/49/60138">section
			 60138(b)</external-xref> of title 49, United States Code, as added by
			 subsection (a) of this section.</text>
			</subsection></section><section id="HB6539B1318484CC0A9FC46A2204803AA"><enum>3.</enum><header>Transparency of
			 accidents and incidents</header><text display-inline="no-display-inline">Not
			 later than December 31, 2010, the Secretary of Transportation shall maintain on
			 the Department of Transportation’s Internet Web site a database of all
			 reportable incidents involving gas or hazardous liquid pipelines and allow the
			 public to search the database for incidents by owner or operator of a pipeline
			 facility.</text>
		</section><section id="H52339562760646909EBC84975C1B2715"><enum>4.</enum><header>Civil
			 penalties</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/60122">Section
			 60122(a)(1)</external-xref> of title 49, United States Code, is amended—</text>
			<paragraph id="H7A028C969CCF4ABC941E3B25F4543882"><enum>(1)</enum><text>in the first
			 sentence—</text>
				<subparagraph id="H0DA88433A813408093609CE89899B5DA"><enum>(A)</enum><text>by inserting
			 <quote>, or has obstructed or prevented the Secretary from carrying out an
			 inspection or investigation under this chapter,</quote> after <quote>under this
			 chapter</quote>; and</text>
				</subparagraph><subparagraph id="H23096FC072814F26BCBDD05BDD68A316"><enum>(B)</enum><text>by striking
			 <quote>$100,000</quote> and inserting <quote>$250,000</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H6985BA4EDE864E08A07D6AA14058BB6A"><enum>(2)</enum><text display-inline="yes-display-inline">in the last sentence by striking
			 <quote>$1,000,000</quote> and inserting <quote>$2,500,000</quote>.</text>
			</paragraph></section><section id="H7C6D31C89B814DB2BDA17D1125ADE18D"><enum>5.</enum><header>Compliance with
			 Statutory Pay-As-You-Go Act of 2010</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the House Budget Committee, provided
			 that such statement has been submitted prior to the vote on passage.</text>
