		  1965 to modify certain provisions concerning charter schools.</official-title>

		<section id="HE2ACD90253994B9CAC8F2E807FAB69F7" section-type="section-one"><enum>1.</enum><header>Charter school
			 programs</header>
			<subsection id="H1B6FD6FADCA14A448C7FFFAF1C18E332"><enum>(a)</enum><header>Reservation for
			 dissemination</header><text display-inline="yes-display-inline">Section
			 5204(f)(1) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7221c(f)(1)) is amended by striking <quote>may reserve</quote> and inserting
			 <quote>shall reserve</quote>.</text>
			</subsection><subsection id="HA86675476FAD48629DCD84588585DE31"><enum>(b)</enum><header>Dissemination</header><text>Section
			 5204(f)(6) of such Act (20 U.S.C. 7221c(f)(6)) is amended to read as
			 follows:</text>

					<paragraph id="H861B01068E454F009572CEFDCE2C0E37"><enum>(6)</enum><header>Dissemination</header>
						<subparagraph id="H9EDB1F281F0F4E35AA5D70D9F08D524E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">A local educational
				agency, a successful charter school, or a successful charter school in
				partnership with such a local educational agency may apply for funds reserved
				under paragraph (1) to carry out the activities described in subparagraph
				(B).</text>
						</subparagraph><subparagraph id="HD72FF30F878B4B47AF34AC4389760D73"><enum>(B)</enum><header>Activities</header><text display-inline="yes-display-inline">A recipient of funds under subparagraph (A)
				shall use the funds to assist schools in adapting the program of a successful
				charter school (or certain aspects of the successful charter school's program),
				or to disseminate information about a successful charter school, through such
				activities as—</text>
							<clause id="HD926E25ED05F429CA06F0EA95007E724"><enum>(i)</enum><text>assisting
				individuals with the planning and start-up of one or more new public schools,
				including charter schools, that are independent of the successful charter
				school and the successful charter school's developers, and that agree to be
				held to at least as high a level of accountability as the successful charter
				school;</text>
							</clause><clause commented="no" id="H2D6F88275BBE4A828DBF353E5511565D"><enum>(ii)</enum><text>developing
				partnerships with public schools, including charter schools, designed to
				improve student academic achievement in each of the schools participating in
				the partnership;</text>
							</clause><clause id="HB23FC5ED62B7485DA34BAEF3076D4670"><enum>(iii)</enum><text>developing
				curriculum materials, assessments, and other materials that promote increased
				student achievement and are based on successful practices within the successful
				charter school; and</text>
							</clause><clause id="HFCA7CDD1F74C4DA1BEB36107F884090F"><enum>(iv)</enum><text>conducting
				evaluations and developing materials that document the successful practices of
				the successful charter school and that are designed to improve student
				performance in other schools.</text>
							</clause></subparagraph><subparagraph id="H129B4615A96843A9B4282D93428CCE1B"><enum>(C)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this paragraph:</text>
							<clause id="HD7C4EC67D3EC4B87988EC8D064792C4D"><enum>(i)</enum><header>Local
				educational agency</header><text>The term <term>local educational agency</term>
				does not include a charter school that constitutes a local educational agency
				under State law.</text>
							</clause><clause id="HA85DBCE3724C492B8FC53A736A3996CE"><enum>(ii)</enum><header>Successful
				charter school</header><text display-inline="yes-display-inline">The term
				<term>successful charter school</term> means a charter school that has been in
				operation for at least 3 consecutive years and satisfies other criteria
				determined by the
				Secretary.</text>
