		<official-title>To amend the Outer Continental Shelf Lands Act and the
		  Gulf of Mexico Energy Security Act of 2006 to increase the percentage of
		  revenues from new offshore leases that will be shared with coastal States to 50
		  percent.</official-title>

		<section id="H946C0FDAF46A4FA59EE82379F036C675" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Offshore Lease Fairness
			 Act</short-title></quote>.</text>
		</section><section id="HE71C6899BD184CC9AFA58427B934141D"><enum>2.</enum><header>Increased revenue
			 sharing with States for leases within 3 miles of the coast line</header>
			<subsection display-inline="no-display-inline" id="H66DEBC7255FB4912A71D6971AAAC6141"><enum>(a)</enum><header>Leases for
			 activities authorized in OCS Lands Act</header><text>Section 8(g)(2) of the
			 Outer Continental Shelf Lands Act (43 U.S.C. 1337(g)(2)) is amended by
			 inserting after <quote>27 percent of those revenues,</quote> the following:
			 <quote>or, for leases entered into after the date of enactment of the Offshore
			 Lease Fairness Act, 50 percent of those revenues,</quote></text>
			</subsection><subsection id="H76A563D2266642A7B4730CFA2B42B1CA"><enum>(b)</enum><header>Leases for
			 energy-Related activities</header><text display-inline="yes-display-inline">Section 8(p)(2)(B) of the Outer Continental
			 Shelf Lands Act (43 U.S.C. 1337(p)(2)(B)) is amended by inserting after
			 <quote>27 percent of the revenues received by the Federal Government as a
			 result of payments under this section</quote> the following: <quote>, or, for
			 any lease, easement, or right-of-way granted after the date of enactment of the
			 Offshore Lease Fairness Act, 50 percent of those revenues,</quote>.</text>
			</subsection></section><section id="H114ECBDCD92A40F495B8A01CE9414C5F"><enum>3.</enum><header>Increased revenue
			 sharing with States for leases beyond 3 miles of the coast line</header>
			<subsection id="H9E908E583D064A53842CFAF83BFCDDB6"><enum>(a)</enum><header>Definition of
			 new outer Continental Shelf revenues</header><text display-inline="yes-display-inline">Section 102 of the Gulf of Mexico Energy
			 Security Act of 2006 (Public Law 109–432; 43 U.S.C. 1331 note) is
			 amended—</text>
				<paragraph display-inline="no-display-inline" id="HDE01C920CAA2475EB72EA4F460BFF399"><enum>(1)</enum><text>by redesignating
			 paragraphs (9) through (11) as paragraphs (10) through (12),
			 respectively;</text>
				</paragraph><paragraph id="H4CF7E0E53BC84583823C87576C9789E8"><enum>(2)</enum><text>by inserting after
			 paragraph (8) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HD97FB31F657E4E67B5278DBFEF886DC1" style="OLC">
						<paragraph id="HC78AB8C3F5A44826B29EBFCBFA37DCD8"><enum>(9)</enum><header>New outer
				Continental Shelf revenues</header>
							<subparagraph id="H5831BE39AF7A424680FB9703916DBA03"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term <term>new
				outer Continental Shelf revenues</term> means all rentals, royalties, bonus
				bids, and other sums received by the United States from leases entered into
				after the period described in paragraph (10)(A)(i) for areas on the outer
				Continental Shelf (as defined in section 2(a) of the Outer Continental Shelf
				Lands Act (43 U.S.C. 1331(a)).</text>
							</subparagraph><subparagraph id="H6A934500324F411696F0AE4DD97F2CA9"><enum>(B)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>new outer Continental Shelf
				revenues</term> does not include revenues and other amounts described in
				paragraph (10)(B).</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6B4AD054953A48EAB5BCF2D9F202C850"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (A) of paragraph (10) (as
			 redesignated by paragraph (1) of this subsection)—</text>
					<subparagraph display-inline="no-display-inline" id="HCDF27A96C860411D89B1A3286E3AA236"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>due and payable to the United States</quote> and all that
			 follows through <quote>on or after the date of enactment of this Act</quote>
			 and inserting <quote>received by the United States from leases entered into in
			 the period beginning on December 20, 2006, and ending on the date of enactment
			 of the Offshore Lease Fairness Act</quote>; and</text>
					</subparagraph><subparagraph id="H55B2658EE24943C49CF0DEFEBD6F48C1"><enum>(B)</enum><text>in clause (ii), by
			 striking <quote>on or after the date of enactment of this Act</quote> and
			 inserting <quote>in the period described in clause (i)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H65F3F8755B504CBBB6820F67FD11604F"><enum>(b)</enum><header>Disposition of
			 new outer Continental Shelf revenues</header><text display-inline="yes-display-inline">The Gulf of Mexico Energy Security Act of
			 2006 (Public Law 109–432; 43 U.S.C. 1331 note) is amended by adding at the end
			 the following new sections:</text>
				<quoted-block display-inline="no-display-inline" id="H59E5AFFDEEB7496796EDF48C9E6EF700" style="OLC">
					<section display-inline="no-display-inline" id="H5627A554341A4515A61320394A25D602" section-type="subsequent-section"><enum>106.</enum><header>Disposition of new
				outer Continental Shelf revenues</header>
						<subsection id="H62E158D3A4FE46B0A2010D5B35AC1306"><enum>(a)</enum><header>Disposition of
				revenues</header><text display-inline="yes-display-inline">Notwithstanding
				section 9 of the Outer Continental Shelf Lands Act (43 U.S.C. 1338) and subject
				to the other provisions of this section, for fiscal year 2010 and each fiscal
				year thereafter—</text>
							<paragraph id="HE8EB0943BF9B4146A9ABAE11CF1AF727"><enum>(1)</enum><text>50 percent of new
				outer Continental Shelf revenues shall be deposited in the general fund of the
				Treasury; and</text>
							</paragraph><paragraph id="H7FF0FA70002E4834AF98CA7326EC74D8"><enum>(2)</enum><text>50 percent of new
				outer Continental Shelf revenues shall be deposited in a special account in the
				Treasury, and the Secretary of the Treasury shall disburse such amount to
				coastal States under subsection (b).</text>
							</paragraph></subsection><subsection id="H1338936BDEBF4CFB8808DCFB7D8443DD"><enum>(b)</enum><header>Allocation among
				coastal States</header><text>The amount made available under subsection (a)(2)
				shall be allocated to coastal States using rules substantially similar to the
				rules in paragraphs (1) and (2) of section 105(b), except that—</text>
							<paragraph id="H1629713788B74CE588CC4FC25F64D0E9"><enum>(1)</enum><text>references in such
				paragraphs to Gulf producing States shall be treated as references to coastal
				States; and</text>
							</paragraph><paragraph id="H40523DEA15C44D0C86B95BA01C3E7CA4"><enum>(2)</enum><text display-inline="yes-display-inline">new outer Continental Shelf revenues from
				leases in the Gulf of Mexico, the Atlantic Ocean, the Pacific Ocean, and the
				Arctic Ocean may only be allocated to States that are in, or that border on,
				the Gulf of Mexico, the Atlantic Ocean, the Pacific Ocean, and the Arctic
				Ocean, respectively.</text>
							</paragraph></subsection></section><section id="H91EDEDA5E5DA4EC9971B527F761D5DBB"><enum>107.</enum><header>Timing and
				administration of disposition of revenues</header>
						<subsection display-inline="no-display-inline" id="H792B94D241E94E1389B9258B6DC7B3BF"><enum>(a)</enum><header>Timing</header><text display-inline="yes-display-inline">Amounts required to be deposited under
				sections 105(a)(2) and 106(a)(2) for a fiscal year shall be made available in
				accordance with those sections for the subsequent fiscal year.</text>
						</subsection><subsection id="H1925AB9CCCFD4BDD8534BF73EE8B43D9"><enum>(b)</enum><header>Administration</header><text>Amounts
				made available under sections 105(a)(2) and 106(a)(2) shall—</text>
							<paragraph id="H7EBD1256C41F4079910F5C84A1937E77"><enum>(1)</enum><text>be made available,
				without further appropriation, in accordance with this section;</text>
							</paragraph><paragraph id="HD55B1DD30FF34262A122399C295804B4"><enum>(2)</enum><text>remain available
				until expended; and</text>
							</paragraph><paragraph id="H96E7DA3F051148F498CC3D604FD7516E"><enum>(3)</enum><text>be in addition to
				any amounts appropriated under—</text>
								<subparagraph id="HD3C22A7C651A429C86B2AF704B2CFEAB"><enum>(A)</enum><text>the Outer
				Continental Shelf Lands Act (43 U.S.C. 1331 et seq.);</text>
								</subparagraph><subparagraph id="H261BDD722148404EBA0C28AA9577CDA7"><enum>(B)</enum><text>the Land and Water
				Conservation Fund Act of 1965 (16 U.S.C. 4601–4 et seq.); or</text>
								</subparagraph><subparagraph id="HD73B685186574E2E8132F6DBCC8AAA90"><enum>(C)</enum><text>any other
				provision of
				law.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD670DBF90D044392B13516CAEB8E70BC"><enum>(c)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 105 of the
			 Gulf of Mexico Energy Security Act of 2006 (Public Law 109–432; 43 U.S.C. 1331
			 note) is amended—</text>
				<paragraph id="H35EBD9E6AAD24DDC992CAF7F6DF24C9B"><enum>(1)</enum><text>by striking
			 subsections (c) and (e); and</text>
				</paragraph><paragraph id="H380178D2C9E543DDAFB67151972F4DB0"><enum>(2)</enum><text>by redesignating
			 subsections (d) and (f) as subsections (c) and (d), respectively.</text>
