		<official-title>To amend part A of title IV of the Social Security Act to
		  exclude child care from the determination of the 5-year limit on assistance
		  under the temporary assistance to needy families program, and for other
		  purposes.</official-title>

		<section id="HBC0D60103AB84E12A8E6E92F99667D99" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Children First Act of
			 2010</short-title></quote>.</text>
		</section><section id="H0D9DFEF4C1104A389342DEE02CAD6001"><enum>2.</enum><header>Exclusion of
			 child care from the definition of TANF assistance</header><text display-inline="no-display-inline">Section 408(a)(7) of the Social Security Act
			 (42 U.S.C. 608(a)(7)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H6E9EEFB879E64FFAA3911D1490E6E1FC" style="OLC">
				<subparagraph id="H2D469D6161EA48A4A4DED4CD0AD9764E"><enum>(H)</enum><header>Limitation on
				meaning of <quote>assistance</quote> for families receiving child
				care</header><text>For purposes of subparagraph (A), any funds provided under
				this part that are used to provide child care for a family during a month under
				the State program funded under this part shall not be considered assistance
				under the
				program.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H5A82D12482F840EF9B01139FF40998AE"><enum>3.</enum><header>Increase in
			 funding for child care</header><text display-inline="no-display-inline">Section
			 418(a)(3) of the Social Security Act (42 U.S.C. 618(a)(3)) is amended—</text>
			<paragraph id="HFF7C2B2E145F4CE385EB56633F5E5B3A"><enum>(1)</enum><text>by striking the
			 period at the end of subparagraph (G) and inserting a semicolon; and</text>
			</paragraph><paragraph id="H15BB2A1831374BC5812FDB121685055D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD6094281E9864CE087F7BE151E7D5E36" style="OLC">
					<subparagraph id="HBF445DABE356450189A793FB0C39CCE5"><enum>(H)</enum><text>$3,717,000,000 for
				fiscal year 2011;</text>
					</subparagraph><subparagraph id="HCC6ACA6E6B7D46348AF53511B10B9C3B"><enum>(I)</enum><text>$3,773,000,000 for
				fiscal year 2012;</text>
					</subparagraph><subparagraph id="H857F4014CE924C6F9679382F51B3D9A9"><enum>(J)</enum><text>$3,841,000,000 for
				fiscal year 2013;</text>
					</subparagraph><subparagraph id="HF7DF4FCF543946F7BF9285C1E7FDC62C"><enum>(K)</enum><text>$3,917,000,000 for
				fiscal year 2014; and</text>
					</subparagraph><subparagraph id="H5F0219F062CB46D99439CA30957C4994"><enum>(L)</enum><text>$3,996,000,000 for
				fiscal year
				2015.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE3D0E965BA6941688ABAAC48968F0951"><enum>4.</enum><header>Applicability of
			 State or local health and safety standards to other TANF child care
			 spending</header><text display-inline="no-display-inline">Section 402(a) of the
			 Social Security Act (42 U.S.C. 602(a)) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H769DB784959A44439E947C66C9A11F6A" style="OLC">
				<paragraph id="H5E3990A59EBC47198FBCB12C553B4176"><enum>(8)</enum><header>Certification of
				procedures to ensure that child care providers comply with applicable State or
				local health and safety standards</header><text>A certification by the chief
				executive officer of the State that procedures are in effect to ensure that any
				child care provider in the State that provides services funded through
				expenditures under this part or with qualified State expenditures complies with
				all applicable State or local health and safety requirements as described in
				section 658E(c)(2)(F) of the Child Care and Development Block Grant Act of
				1990.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H18D117DF01D54341B4AF51A6460CF663"><enum>5.</enum><header>Availability of
			 child care for parents required to work</header><text display-inline="no-display-inline">Section 407(e)(2) of the Social Security Act
			 (42 U.S.C. 607(e)(2)) is amended—</text>
			<paragraph id="HF9E5B94E6EC04B3BA76610FC9AAF06A2"><enum>(1)</enum><text>by inserting
			 <quote>or other individual with custody</quote> after <quote>parent</quote>;
			 and</text>
			</paragraph><paragraph id="HAEC7B1D59DDB42E8837D9FB4BC4A8029"><enum>(2)</enum><text>by striking
			 <quote>6</quote> and inserting <quote>13</quote>.</text>
			</paragraph></section><section id="H01BA08C028E44D19891A3E0970444FCC"><enum>6.</enum><header>Application of
			 Child Care and Development Block Grant Act of 1990 reporting rules to TANF
			 funds expended for child care</header>
			<subsection id="H674774E9D2A54D10B7DFBADB69232804"><enum>(a)</enum><header>In
			 general</header><text>Section 411(a) of the Social Security Act (42 U.S.C.
			 611(a)) is amended—</text>
				<paragraph id="H1915AFB0145D4EB7818464C9E4F9C748"><enum>(1)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text>
				</paragraph><paragraph id="HFA89D01D87DC43698B6E7A839E3B7AF0"><enum>(2)</enum><text>by inserting after
			 paragraph (6), the following:</text>
					<quoted-block display-inline="no-display-inline" id="HBF6B84A1A6BE47E7981ED3B6877744B7" style="OLC">
						<paragraph id="HCB7E24EFF2F648F5B2D612B554E6B4CD"><enum>(7)</enum><header>Application of
				child care and development block grant Act of 1990 reporting rules to funds
				expended for child care</header><text>Any funds provided under this part that
				are expended for child care, whether or not transferred to the Child Care and
				Development Block Grant Act of 1990, shall be subject to the individual and
				case data reporting requirements imposed under that Act and need not be
				included in the report required by paragraph (1) for a fiscal
				quarter.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC7D58C4919F74C5FA28C2A5608EAAFFF"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section
			 411(a)(1)(A)(ix) of such Act (42 U.S.C. 611(a)(1)(A)(ix)) is amended by
			 striking <quote>supplemental nutrition assistance program benefits, or
			 subsidized child care, and if the latter 2,</quote> and inserting <quote>or
			 supplemental nutrition assistance program benefits, and if the
			 latter,</quote>.</text>
			</subsection></section><section id="H07E03A8F18F54F3C84EFA2B2F98DEE94"><enum>7.</enum><header>Effective
			 date</header>
			<subsection id="H33225E66909548FD9DEFDFB545CCCC57"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsections (b) and (c), the amendments made
			 by this Act shall take effect on October 1, 2010, and shall apply to payments
			 under part A of title IV of the Social Security Act for calendar quarters
			 beginning on or after such date, without regard to whether regulations to
			 implement the amendments are promulgated by such date.</text>
			</subsection><subsection id="H1F06EE825EA348F28383A0624B4C11DB"><enum>(b)</enum><header>Application of
			 reporting rules</header><text>The amendments made by section 6 shall take
			 effect on October 1, 2011.</text>
			</subsection><subsection id="HEDD3B3DD800A483E91CBC5E3AB530F30"><enum>(c)</enum><header>Delay permitted
			 if State legislation required</header><text>In the case of a State plan under
			 section 402(a) of the Social Security Act which the Secretary of Health and
			 Human Services determines requires State legislation (other than legislation
			 appropriating funds) in order for the plan to meet the additional requirements
			 imposed by the amendments made by this Act, the State plan shall not be
			 regarded as failing to comply with the requirements of such section 402(a)
			 solely on the basis of the failure of the plan to meet such additional
			 requirements before the 1st day of the 1st calendar quarter beginning after the
			 close of the 1st regular session of the State legislature that begins after the
			 date of the enactment of this Act. For purposes of the previous sentence, in
			 the case of a State that has a 2-year legislative session, each year of such
			 session shall be deemed to be a separate regular session of the State
			 legislature.</text>
