		<official-title>To grant the Postmaster General the authority to
		  implement up to 12 non-mail delivery days each fiscal year for the United
		  States Postal Service.</official-title>

		<section id="H8F0A19CB67F54135AD3645B7530D6FDD" section-type="section-one"><enum>1.</enum><header>Implementation of
			 discretionary non-mail delivery days</header>
			<subsection id="H971350FFE16B427CA69256B45D0D9B80"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 404 of title
			 39, United States Code, is amended by inserting after subsection (e) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D395C46139B42A38AA6F0CAA81793A1" style="USC">
					<subsection id="HC1ED1D61C1034B52B6B02899F98FAEBE"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H135ECE5F950B407B8467C992CBFFE9B7"><enum>(1)</enum><text display-inline="yes-display-inline">The Postmaster General may declare up to 12
				non-mail delivery days in a fiscal year. Not later than 6 months before the
				beginning of such year, the Postmaster General shall submit to the Board of
				Governors a report listing the date on which each non-mail delivery day will
				occur, consistent with the requirements of this subsection.</text>
						</paragraph><paragraph id="HC6C2D011F0CB46318A8B28C94721AD08" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A
				declaration under paragraph (1) shall not be effective unless it is made in
				compliance with the following:</text>
							<subparagraph id="HF07AFE54033E4372880074DB15EE6D54"><enum>(A)</enum><text display-inline="yes-display-inline">A
				non-mail delivery day under this subsection shall occur on a date that falls on
				a day that—</text>
								<clause id="H972C22988B234B7797D6433E2073DE97"><enum>(i)</enum><text display-inline="yes-display-inline">is other than a Sunday; and</text>
								</clause><clause id="H7DAFC004049C4F9DA0DC5BF51D79FFFC"><enum>(ii)</enum><text display-inline="yes-display-inline">is not a legal public holiday listed in
				section 6103(a) of title 5 or any other day declared to be a holiday by Federal
				statute or Executive order.</text>
								</clause></subparagraph></paragraph><paragraph id="H56CC7AD3F73947CEA6FC6A0F3996551B" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any day which is declared under this
				subsection to be a non-mail delivery day shall—</text>
							<subparagraph id="H7F6E94879DB9443DBE97094B62E75227"><enum>(A)</enum><text display-inline="yes-display-inline">for purposes of mail delivery and such
				other postal operations as the Postal Service may by regulation prescribe, be
				treated as if it were a Sunday; except that</text>
							</subparagraph><subparagraph id="H3921DF33E6234BD58843D13F1D9686B0"><enum>(B)</enum><text display-inline="yes-display-inline">an
				employee of the Postal Service, other than one who is prevented from working on
				a non-mail delivery day by reason of this subsection, shall be entitled to the
				same pay and benefits for that day as if this subsection had not been
				enacted.</text>
							</subparagraph></paragraph><paragraph id="H65D468584B2345D2B393BD0B050C978F" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9D5A4BD9CB5945268CC1FB728507CB8F"><enum>(A)</enum><text display-inline="yes-display-inline">The 6-day mail delivery requirement shall
				not apply with respect to a week in which occurs a non-mail delivery day under
				this subsection.</text>
							</subparagraph><subparagraph id="H31D07759C30F4F36A3EFBBCDB5D9FF3A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The authority to declare a non-mail
				delivery day under this subsection shall be considered to be within the right
				of the Postal Service to determine the methods, means, and personnel by which
				postal operations are to be conducted.</text>
							</subparagraph></paragraph><paragraph id="H08B0A59F41114D649DA2456533D9F297" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Postal Service may prescribe any
				regulations necessary to carry out this
				subsection.</text>
