			<section display-inline="no-display-inline" id="H7AFBFEE7F19B4A089A944BB05266ED17"><enum>201.</enum><header>Definitions</header>
				<subsection id="HB377C8F6D28845C08A3E1B1ED8891A97"><enum>(a)</enum><header>Definitions</header><text>In
			 this title, the following definitions apply:</text>
					<paragraph id="H5AC53D510F5447299C83F211B95FD43B"><enum>(1)</enum><header>Advanced
			 qualification program</header><text>The term <quote>advanced qualification
			 program</quote> means the program established by the Federal Aviation
			 Administration in Advisory Circular 120–54A, dated June 23, 2006, including any
			 subsequent revisions thereto.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD32853FBB0514889858BBD97D48286CC"><enum>(2)</enum><header>Air
			 carrier</header><text>The term <quote>air carrier</quote> has the meaning given
			 that term in section 40102 of title 49, United States Code.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="H6E24A415E79E40FA843075C149D7E2AA"><enum>(3)</enum><header>Aviation safety
			 action program</header><text>The term <quote>aviation safety action
			 program</quote> means the program established by the Federal Aviation
			 Administration in Advisory Circular 120–66B, dated November 15, 2002, including
			 any subsequent revisions thereto.</text>
					</paragraph><paragraph id="H1A1665D48D72433DA9D7FD39BFEEF7A2"><enum>(4)</enum><header>Flight
			 crewmember</header><text>The term “flight crewmember” has the meaning given the
			 term <quote>flightcrew member</quote> in part 1 of title 14, Code of Federal
			 Regulations.</text>
					</paragraph><paragraph id="H436C09D762564C97A0C03A7CD48C104E"><enum>(5)</enum><header>Flight
			 operational quality assurance program</header><text>The term <quote>flight
			 operational quality assurance program</quote> means the program established by
			 the Federal Aviation Administration in Advisory Circular 120–82, dated April
			 12, 2004, including any subsequent revisions thereto.</text>
					</paragraph><paragraph id="HCE89ACBBBA9B47F49B88A1CD822BD06A"><enum>(6)</enum><header>Line operations
			 safety audit</header><text>The term <quote>line operations safety audit</quote>
			 means the procedure referenced by the Federal Aviation Administration in
			 Advisory Circular 120–90, dated April 27, 2006, including any subsequent
			 revisions thereto.</text>
					</paragraph><paragraph id="H912B4FAB9F6B456190E19FE31B9FB25B"><enum>(7)</enum><header>Part 121 air
			 carrier</header><text>The term <quote>part 121 air carrier</quote> means an air
			 carrier that holds a certificate issued under part 121 of title 14, Code of
			 Federal Regulations.</text>
					</paragraph><paragraph id="H2F14555C857D442FA179C2CFC1E7CBF7"><enum>(8)</enum><header>Part 135 air
			 carrier</header><text>The term <quote>part 135 air carrier</quote> means an air
			 carrier that holds a certificate issued under part 135 of title 14, Code of
			 Federal Regulations.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H4CF18FAE9ACB4B90A4374F68298776D7" section-type="subsequent-section"><enum>202.</enum><header>Secretary of
			 Transportation responses to safety recommendations</header>
				<subsection id="H5C6D956CDC9E465A8EA9A16D96B9EE29"><enum>(a)</enum><header>In
			 general</header><text>The first sentence of section 1135(a) is amended by
			 inserting <quote>to the Board</quote> after <quote>shall give</quote>.</text>
				</subsection><subsection id="H44C7D358DF9A45EA9D357F21563DCFBF"><enum>(b)</enum><header>Air carrier
			 safety recommendations</header><text>Section 1135 is amended—</text>
					<paragraph id="H8E3CF6BE438E4321AEBB836558CA2FCD"><enum>(1)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>
					</paragraph><paragraph id="H59E1507326394098A85DB86990E7B765"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following:</text>

							<subsection id="HCBC5F290AFFC4B438A34477262D04270"><enum>(d)</enum><header>Annual report on
				air carrier safety recommendations</header>
								<paragraph id="HD51E3B2425C143719A1C517A5037BD84"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall submit to Congress and the Board, on
				an annual basis, a report on the recommendations made by the Board to the
				Secretary regarding air carrier operations conducted under part 121 of title
				14, Code of Federal Regulations.</text>
								</paragraph><paragraph id="H9E39ED8793B0449C8E8BBDEE035EB630"><enum>(2)</enum><header>Recommendations
				to be covered</header><text>The report shall cover—</text>
									<subparagraph id="H704FF1F0D16144B998DF899261B101B8"><enum>(A)</enum><text>any recommendation
				for which the Secretary has developed, or intends to develop, procedures to
				adopt the recommendation or part of the recommendation, but has yet to complete
				the procedures; and</text>
									</subparagraph><subparagraph id="H8590816089D345D781F61544EE64E8BE"><enum>(B)</enum><text>any recommendation
				for which the Secretary, in the preceding year, has issued a response under
				subsection (a)(2) or (a)(3) refusing to carry out all or part of the procedures
				to adopt the recommendation.</text>
									</subparagraph></paragraph><paragraph id="H3329C5CFF2A2455CA411C949638CF253"><enum>(3)</enum><header>Contents</header>
									<subparagraph id="H3AE7D224A12B47189428CB613EDFD793"><enum>(A)</enum><header>Plans to adopt
				recommendations</header><text>For each recommendation of the Board described in
				paragraph (2)(A), the report shall contain—</text>
										<clause id="H8785BF4D425A4070898B967B362BD65D"><enum>(i)</enum><text>a
				description of the recommendation;</text>
										</clause><clause id="HDDDC3A0525FF447D9CB43F650879EB4A"><enum>(ii)</enum><text>a
				description of the procedures planned for adopting the recommendation or part
				of the recommendation;</text>
										</clause><clause id="HD3A7E71ACBCD4F5E87A7C5AE7A9BA1AB"><enum>(iii)</enum><text>the proposed
				date for completing the procedures; and</text>
										</clause><clause id="H566AC40F37CE4F23B25AC3EA4A179CD4"><enum>(iv)</enum><text>if the Secretary
				has not met a deadline contained in a proposed timeline developed in connection
				with the recommendation under subsection (b), an explanation for not meeting
				the deadline.</text>
										</clause></subparagraph><subparagraph id="HC5AF6CBCE76A44B8B4C72E5E00A908A8"><enum>(B)</enum><header>Refusals to
				adopt recommendations</header><text display-inline="yes-display-inline">For
				each recommendation of the Board described in paragraph (2)(B), the report
				shall contain—</text>
										<clause id="H6D913E06D254426698D196B96289450C"><enum>(i)</enum><text>a
				description of the recommendation; and</text>
										</clause><clause id="H68333F8C679D4EAC88A8E789C77F2441"><enum>(ii)</enum><text>a
				description of the reasons for the refusal to carry out all or part of the
				procedures to adopt the
				recommendation.</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="HBC70B9B881134F1780586DFDC114FDC7" section-type="subsequent-section"><enum>203.</enum><header>FAA pilot records
			 database</header>
				<subsection id="H1A163BE52B6D415B896B2599459698FE"><enum>(a)</enum><header>Records of
			 employment of pilot applicants</header><text display-inline="yes-display-inline">Section 44703(h) of title 49, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H30AE1388F22C4502811A42BE0910CE9A" style="OLC">
						<paragraph commented="no" id="H263290D1F0E74F0EB161C07881FC86DF"><enum>(16)</enum><header>Applicability</header><text display-inline="yes-display-inline">This subsection shall cease to be effective
				on the date specified in regulations issued under subsection
				(i).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HC946BF797B8C484393EA2B93BEF4D2F8"><enum>(b)</enum><header>Establishment of
			 FAA pilot records database</header><text>Section 44703 of such title is
			 amended—</text>
					<paragraph id="H32E00DF13DDA4A34AD74AF9353F46C97"><enum>(1)</enum><text>by redesignating
			 subsections (i) and (j) as subsections (j) and (k), respectively; and</text>
					</paragraph><paragraph id="H1AD1CC2802B549DF8896E76239A436B9"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H14F5A8FC50AB490892BBF28C7EA177BF" style="USC">
							<subsection id="HCFF6A1FDAD7E435286DEAEFECB3EEF8E"><enum>(i)</enum><header>FAA pilot
				records database</header>
								<paragraph id="H96E3DA5989C44D25A971A52CE5C60B97"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Before allowing an
				individual to begin service as a pilot, an air carrier shall access and
				evaluate, in accordance with the requirements of this subsection, information
				pertaining to the individual from the pilot records database established under
				paragraph (2).</text>
								</paragraph><paragraph id="H326CF509895F434CA7E2302E7837580D"><enum>(2)</enum><header>Pilot records
				database</header><text>The Administrator shall establish an electronic database
				(in this subsection referred to as the <quote>database</quote>) containing the
				following records:</text>
									<subparagraph id="HFEA94BB828784A8D8F46C7833219086A"><enum>(A)</enum><header>FAA
				records</header><text>From the Administrator—</text>
										<clause id="HF29631977BCC4CE3ABCB4999586B595F"><enum>(i)</enum><text>records that are
				maintained by the Administrator concerning current airman certificates,
				including airman medical certificates and associated type ratings and
				information on any limitations to those certificates and ratings;</text>
										</clause><clause id="H3F304338F8BA44D58103C5314CD309B4"><enum>(ii)</enum><text display-inline="yes-display-inline">records that are maintained by the
				Administrator concerning any failed attempt of an individual to pass a
				practical test required to obtain a certificate or type rating under part 61 of
				title 14, Code of Federal Regulations; and</text>
										</clause><clause id="HDFD3F99F667E43E5B4734BBD7FE72095"><enum>(iii)</enum><text>summaries of
				legal enforcement actions resulting in a finding by the Administrator of a
				violation of this title or a regulation prescribed or order issued under this
				title that was not subsequently overturned.</text>
										</clause></subparagraph><subparagraph id="H8180AAC059A34C3C9DA075C24DBBF3FB"><enum>(B)</enum><header>Air carrier and
				other records</header><text>From any air carrier or other person (except a
				branch of the Armed Forces, the National Guard, or a reserve component of the
				Armed Forces) that has employed an individual as a pilot of a civil or public
				aircraft, or from the trustee in bankruptcy for the air carrier or
				person—</text>
										<clause id="HBD28ACF96DE24E7997F5695C11B3E142"><enum>(i)</enum><text>records pertaining
				to the individual that are maintained by the air carrier (other than records
				relating to flight time, duty time, or rest time) or person, including records
				under regulations set forth in—</text>
											<subclause id="HE02CC8EF540C42C1B67A696D5DBCF49A"><enum>(I)</enum><text>section 121.683 of
				title 14, Code of Federal Regulations;</text>
											</subclause><subclause commented="no" id="HBDBDED28DF0B4AC2B08876D996B79FD8"><enum>(II)</enum><text>section
				121.111(a) of such title;</text>
											</subclause><subclause commented="no" id="H1907729C049A44A19D8B85AD0DA9FE4F"><enum>(III)</enum><text>section
				121.219(a) of such title;</text>
											</subclause><subclause id="H2D5734FC8EC549688FE774C4031AD1CF"><enum>(IV)</enum><text>section 125.401
				of such title; and</text>
											</subclause><subclause id="H72C45E53251D451694A9BF024507526A"><enum>(V)</enum><text>section
				135.63(a)(4) of such title; and</text>
											</subclause></clause><clause id="H3225037775F3478BA59E5A8FDBC89262"><enum>(ii)</enum><text>other records
				pertaining to the individual’s performance as a pilot that are maintained by
				the air carrier or person concerning—</text>
											<subclause id="HC37DDA56AF334E229A6C2A7B71E7BCAB"><enum>(I)</enum><text>the training,
				qualifications, proficiency, or professional competence of the individual,
				including comments and evaluations made by a check airman designated in
				accordance with section 121.411, 125.295, or 135.337 of such title;</text>
											</subclause><subclause id="H4165B96ACADA40F7931488583FF22800"><enum>(II)</enum><text>any disciplinary
				action taken with respect to the individual that was not subsequently
				overturned; and</text>
											</subclause><subclause id="H3C1B64741B0D4E48B1DEA0965766C9F1"><enum>(III)</enum><text>any release from
				employment or resignation, termination, or disqualification with respect to
				employment.</text>
											</subclause></clause></subparagraph><subparagraph id="H0777B8B9476D4C10BEB620C9AE4D7A54"><enum>(C)</enum><header>National Driver
				Register records</header><text>In accordance with section 30305(b)(8) of this
				title, from the chief driver licensing official of a State, information
				concerning the motor vehicle driving record of the individual.</text>
									</subparagraph></paragraph><paragraph id="H6E6CAAA4DD10431CAABB2B4F3700282C"><enum>(3)</enum><header>Written consent;
				release from liability</header><text display-inline="yes-display-inline">An air
				carrier—</text>
									<subparagraph id="H22D123290F964C728507F9F1B31F8147"><enum>(A)</enum><text>shall obtain the
				written consent of an individual before accessing records pertaining to the
				individual under paragraph (1); and</text>
									</subparagraph><subparagraph commented="no" id="H64579E958ADC4A75837B7006BBF09ED7"><enum>(B)</enum><text>may,
				notwithstanding any other provision of law or agreement to the contrary,
				require an individual with respect to whom the carrier is accessing records
				under paragraph (1) to execute a release from liability for any claim arising
				from accessing the records or the use of such records by the air carrier in
				accordance with this section (other than a claim arising from furnishing
				information known to be false and maintained in violation of a criminal
				statute).</text>
									</subparagraph></paragraph><paragraph id="H64FD792E54334797A55D92E3E4EC748C"><enum>(4)</enum><header>Reporting</header>
									<subparagraph id="H1F8BD64922CF4F9C911157BD53519101"><enum>(A)</enum><header>Reporting by
				Administrator</header><text>The Administrator shall enter data described in
				paragraph (2)(A) into the database promptly to ensure that an individual’s
				records are current.</text>
									</subparagraph><subparagraph id="H40FACF8A4DF44E74B0A47676A49A6337"><enum>(B)</enum><header>Reporting by air
				carriers and other persons</header>
										<clause id="H584597307E334E149E948C541B91D9A0"><enum>(i)</enum><header>In
				general</header><text>Air carriers and other persons shall report data
				described in paragraphs (2)(B) and (2)(C) to the Administrator promptly for
				entry into the database.</text>
										</clause><clause id="HB225247020C540A4B14C265E25D87ABA"><enum>(ii)</enum><header>Data to be
				reported</header><text display-inline="yes-display-inline">Air carriers and
				other persons shall report, at a minimum, under clause (i) the following data
				described in paragraph (2)(B):</text>
											<subclause id="H56AC57A87E114DDEB79F395B66910CF4"><enum>(I)</enum><text>Records that are
				generated by the air carrier or other person after the date of enactment of
				this paragraph.</text>
											</subclause><subclause id="H9BA94CEA934C465CBBA4BD4701F9371F"><enum>(II)</enum><text>Records that the
				air carrier or other person is maintaining, on such date of enactment, pursuant
				to subsection (h)(4).</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="H454AF7D3CD1743C2BA4E897A4EEE2C08"><enum>(5)</enum><header>Requirement to
				maintain records</header><text display-inline="yes-display-inline">The
				Administrator—</text>
									<subparagraph id="HA1D55527DFD54E34BDA4A73980426D5E"><enum>(A)</enum><text>shall maintain all
				records entered into the database under paragraph (2) pertaining to an
				individual until the date of receipt of notification that the individual is
				deceased; and</text>
									</subparagraph><subparagraph id="H9402F94114064341B2E8A4956986BE65"><enum>(B)</enum><text>may remove the
				individual’s records from the database after that date.</text>
									</subparagraph></paragraph><paragraph id="H95CEA3C385544E04A1721791994AA9C0"><enum>(6)</enum><header>Receipt of
				consent</header><text display-inline="yes-display-inline">The Administrator
				shall not permit an air carrier to access records pertaining to an individual
				from the database under paragraph (1) without the air carrier first
				demonstrating to the satisfaction of the Administrator that the air carrier has
				obtained the written consent of the individual.</text>
								</paragraph><paragraph id="H642B8D2ACED94A26A9346BA8BE332B2F"><enum>(7)</enum><header>Right of pilot
				to review certain records and correct
				inaccuracies</header><text>Notwithstanding any other provision of law or
				agreement, the Administrator, upon receipt of written request from an
				individual—</text>
									<subparagraph id="H2AC2BFF952B246189511B430E274C17B"><enum>(A)</enum><text>shall make
				available, not later than 30 days after the date of the request, to the
				individual for review all records referred to in paragraph (2) pertaining to
				the individual; and</text>
									</subparagraph><subparagraph id="HDDB727BCD06C454FA94589F7A67AA1F1"><enum>(B)</enum><text>shall provide the
				individual with a reasonable opportunity to submit written comments to correct
				any inaccuracies contained in the records.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H2F5D6EF68EF54EBA9760B644487FE654"><enum>(8)</enum><header>Reasonable
				charges for processing requests and furnishing copies</header>
									<subparagraph id="HD35DAD477BB24F8687E5D7E0B5E9D26D"><enum>(A)</enum><header>In
				general</header><text>The Administrator may establish a reasonable charge for
				the cost of processing a request under paragraph (1) or (7) and for the cost of
				furnishing copies of requested records under paragraph (7).</text>
									</subparagraph><subparagraph display-inline="no-display-inline" id="H0F0D615DCD984E9082F2545B4D297B2B"><enum>(B)</enum><header>Crediting
				appropriations</header><text display-inline="yes-display-inline">Funds received
				by the Administrator pursuant to this paragraph shall—</text>
										<clause id="H162F0D545E864352A46CFA8C99E9D359"><enum>(i)</enum><text>be
				credited to the appropriation current when the amount is received;</text>
										</clause><clause id="H6FB58BEE58824C258344BBC5E79B29FF"><enum>(ii)</enum><text>be merged with
				and available for the purposes of such appropriation; and</text>
										</clause><clause id="H6E8BACE240F94EF9A376E8731390B8EF"><enum>(iii)</enum><text>remain available
				until expended.</text>
										</clause></subparagraph></paragraph><paragraph id="H92D04B0CB56A4111AD09E94BF60477AD"><enum>(9)</enum><header>Privacy
				protections</header>
									<subparagraph id="H3ECB8AB1A3A64E279450B05830116F96"><enum>(A)</enum><header>Use of
				records</header><text>An air carrier that accesses records pertaining to an
				individual under paragraph (1) may use the records only to assess the
				qualifications of the individual in deciding whether or not to hire the
				individual as a pilot. The air carrier shall take such actions as may be
				necessary to protect the privacy of the individual and the confidentiality of
				the records accessed, including ensuring that information contained in the
				records is not divulged to any individual that is not directly involved in the
				hiring decision.</text>
									</subparagraph><subparagraph commented="no" id="H5B536C1BC7614F06A32546C25A985BC7"><enum>(B)</enum><header>Disclosure of
				information</header>
										<clause id="H74F88C222BF345B6ADA8D3160B638D0C"><enum>(i)</enum><header>In
				general</header><text>Except as provided by clause (ii), information collected
				by the Administrator under paragraph (2) shall be exempt from the disclosure
				requirements of section 552 of title 5.</text>
										</clause><clause id="H8BB3AA08278A40FAB1ADF0EED81EC9BE"><enum>(ii)</enum><header>Exceptions</header><text>Clause
				(i) shall not apply to—</text>
											<subclause commented="no" id="H5D019D126A874B94B621DD3CC5F22FEA"><enum>(I)</enum><text>deidentified,
				summarized information to explain the need for changes in policies and
				regulations;</text>
											</subclause><subclause commented="no" id="HED036020F77E40878E7D8BC467B0D8BE"><enum>(II)</enum><text>information to
				correct a condition that compromises safety;</text>
											</subclause><subclause commented="no" id="HC6C623A137FC489FB9D76B8BC984EAB6"><enum>(III)</enum><text>information to
				carry out a criminal investigation or prosecution;</text>
											</subclause><subclause commented="no" id="HAE1980AC056240B7A801F0AA4FF2096D"><enum>(IV)</enum><text>information to
				comply with section 44905, regarding information about threats to civil
				aviation; and</text>
											</subclause><subclause commented="no" id="HC42CEB80DBBA4A7D933EB2A58C918B4F"><enum>(V)</enum><text>such information
				as the Administrator determines necessary, if withholding the information would
				not be consistent with the safety responsibilities of the Federal Aviation
				Administration.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="HDD763ED641994A0DBC231FDC265D431B"><enum>(10)</enum><header>Periodic
				review</header><text>Not later than 18 months after the date of enactment of
				this paragraph, and at least once every 3 years thereafter, the Administrator
				shall transmit to Congress a statement that contains, taking into account
				recent developments in the aviation industry—</text>
									<subparagraph id="H385A3C53B9874114935CD7D2B84F1A29"><enum>(A)</enum><text>recommendations by
				the Administrator concerning proposed changes to Federal Aviation
				Administration records, air carrier records, and other records required to be
				included in the database under paragraph (2); or</text>
									</subparagraph><subparagraph id="H61233AE6FDCE4F1591288E4C5394C9F7"><enum>(B)</enum><text>reasons why the
				Administrator does not recommend any proposed changes to the records referred
				to in subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="H54D2887487094A3291CE69A1DBD8069B"><enum>(11)</enum><header>Regulations for
				protection and security of records</header><text>The Administrator shall
				prescribe such regulations as may be necessary—</text>
									<subparagraph id="H63C313178C6E4EA48E98609951B45CF7"><enum>(A)</enum><text>to protect and
				secure—</text>
										<clause id="HF0F0619BCC064A8DBC848B6AEF2C06DA"><enum>(i)</enum><text>the personal
				privacy of any individual whose records are accessed under paragraph (1);
				and</text>
										</clause><clause id="HAAE7D27AD1B2461D84ECB1263965F983"><enum>(ii)</enum><text>the
				confidentiality of those records; and</text>
										</clause></subparagraph><subparagraph id="H855131A5712D41E08F39B3085BDD2768"><enum>(B)</enum><text>to preclude the
				further dissemination of records received under paragraph (1) by the person who
				accessed the records.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H4569F981ACED42239A30A627F445A21D"><enum>(12)</enum><header>Good faith
				exception</header><text display-inline="yes-display-inline">Notwithstanding
				paragraph (1), an air carrier may allow an individual to begin service as a
				pilot, without first obtaining information described in paragraph (2)(B) from
				the database pertaining to the individual, if—</text>
									<subparagraph commented="no" id="HD14BF1826181443D92280BC960A12CF3"><enum>(A)</enum><text>the air carrier
				has made a documented good faith attempt to access the information from the
				database; and</text>
									</subparagraph><subparagraph commented="no" id="HBBA878B33E374B2E92EAB52E6901BA76"><enum>(B)</enum><text>the air carrier
				has received written notice from the Administrator that the information is not
				contained in the database because the individual was employed by an air carrier
				or other person that no longer exists or by a foreign government or other
				entity that has not provided the information to the database.</text>
									</subparagraph></paragraph><paragraph id="HF755097480684D3C9B70F5FD8679E818"><enum>(13)</enum><header>Limitations on
				electronic access to records</header>
									<subparagraph id="HAE73B2F15EC04D1BBE2C6E48D3799AFC"><enum>(A)</enum><header>Access by
				individuals designated by air carriers</header><text>For the purpose of
				increasing timely and efficient access to records described in paragraph (2),
				the Administrator may allow, under terms established by the Administrator, an
				individual designated by an air carrier to have electronic access to the
				database.</text>
									</subparagraph><subparagraph id="H0B9641025D704FB2B22896B0FB0C3DC3"><enum>(B)</enum><header>Terms</header><text>The
				terms established by the Administrator under subparagraph (A) for allowing a
				designated individual to have electronic access to the database shall limit
				such access to instances in which information in the database is required by
				the designated individual in making a hiring decision concerning a pilot
				applicant and shall require that the designated individual provide assurances
				satisfactory to the Administrator that—</text>
										<clause id="H38187075EC4D4A57A106F2AD03F15EB3"><enum>(i)</enum><text>the designated
				individual has received the written consent of the pilot applicant to access
				the information; and</text>
										</clause><clause id="HC3D56565A07A43A4AE2FE272C8043F08"><enum>(ii)</enum><text>information
				obtained using such access will not be used for any purpose other than making
				the hiring decision.</text>
										</clause></subparagraph></paragraph><paragraph id="H94867012E2634ADEA1C3776BF776C3B5"><enum>(14)</enum><header>Authorized
				expenditures</header><text>Of amounts appropriated under section 106(k)(1), a
				total of $6,000,000 for fiscal years 2010 through 2013 may be used to carry out
				this subsection.</text>
								</paragraph><paragraph commented="no" id="H3C825D64D3E6415C94743FF660CFC33E"><enum>(15)</enum><header>Regulations</header>
									<subparagraph commented="no" id="H405E02EE6F3D4138B18898B6802DDD62"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall issue regulations to carry out
				this subsection.</text>
									</subparagraph><subparagraph commented="no" id="H26CAC8A2EAA14721AC45AA77B4958CA7"><enum>(B)</enum><header>Effective
				date</header><text>The regulations shall specify the date on which the
				requirements of this subsection take effect and the date on which the
				requirements of subsection (h) cease to be effective.</text>
									</subparagraph><subparagraph commented="no" id="H9116A52385B3416BA9E79ED195AADDA4"><enum>(C)</enum><header>Exceptions</header><text>Notwithstanding
				subparagraph (B)—</text>
										<clause commented="no" id="HE0FD3402FFCC40B9844F447449AF7051"><enum>(i)</enum><text>the Administrator
				shall begin to establish the database under paragraph (2) not later than 90
				days after the date of enactment of this paragraph;</text>
										</clause><clause commented="no" id="H26F899090990482CBDB8AC88663A3177"><enum>(ii)</enum><text>the Administrator
				shall maintain records in accordance with paragraph (5) beginning on the date
				of enactment of this paragraph; and</text>
										</clause><clause id="H7F5B69EE80E1464FA5362B535CA211FF"><enum>(iii)</enum><text display-inline="yes-display-inline">air carriers and other persons shall
				maintain records to be reported to the database under paragraph (4)(B) in the
				period beginning on such date of enactment and ending on the date that is 5
				years after the requirements of subsection (h) cease to be effective pursuant
				to subparagraph (B).</text>
										</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE2A4F3A87C93477081AE678B3A88D603"><enum>(16)</enum><header>Special
				rule</header><text display-inline="yes-display-inline">During the one-year
				period beginning on the date on which the requirements of this section become
				effective pursuant to paragraph (15)(B), paragraph (7)(A) shall be applied by
				substituting <quote>45 days</quote> for <quote>30
				days</quote>.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H99E7E7E83E244B7BBC40F479583FFB9F"><enum>(c)</enum><header>Conforming
			 amendments</header>
					<paragraph id="HF898E4C2B86E478983A71CB4FC9E510C"><enum>(1)</enum><header>Limitation on
			 liability; preemption of State law</header><text>Section 44703(j) (as
			 redesignated by subsection (b)(1) of this section) is amended—</text>
						<subparagraph id="HBFB5793D1661433CBEF3720BEA7ABA5F"><enum>(A)</enum><text>in the subsection
			 heading by striking <quote><header-in-text level="subsection" style="OLC">Limitation</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Limitations</header-in-text></quote>;</text>
						</subparagraph><subparagraph id="H328187D2567B4C39B8513DD84F0A1586"><enum>(B)</enum><text>in paragraph
			 (1)—</text>

			 by striking <quote>subsection (h)</quote> and inserting <quote>subsection (h)
			 or (i)</quote>;</text>
						</subparagraph><subparagraph commented="no" id="H19452B83D4EE473C9F2A2391199B8F79"><enum>(D)</enum><text>in paragraph (3),
			 in the matter preceding subparagraph (A), by inserting <quote>or who furnished
			 information to the database established under subsection (i)(2)</quote> after
			 <quote>subsection (h)(1)</quote>; and</text>
						</subparagraph><subparagraph id="H691E00C719C74F53BD2A203637A880A7"><enum>(E)</enum><text>by adding at the
			 end the following:</text>

				actions and proceedings against air carriers</header>
									<subparagraph id="H2134AF2CE3CB4E259DEFFF46C8BB5C15"><enum>(A)</enum><header>Hiring
				decisions</header><text display-inline="yes-display-inline">An air carrier may
				refuse to hire an individual as a pilot if the individual did not provide
				written consent for the air carrier to receive records under subsection
				(h)(2)(A) or (i)(3)(A) or did not execute the release from liability requested
				under subsection (h)(2)(B) or (i)(3)(B).</text>
									</subparagraph><subparagraph id="HCC56FBC41767493395EF1250B3E6A2E1"><enum>(B)</enum><header>Actions and
				proceedings</header><text>No action or proceeding may be brought against an air
				carrier by or on behalf of an individual who has applied for or is seeking a
				position as a pilot with the air carrier if the air carrier refused to hire the
				individual after the individual did not provide written consent for the air
				carrier to receive records under subsection (h)(2)(A) or (i)(3)(A) or did not
				execute a release from liability requested under subsection (h)(2)(B) or
				(i)(3)(B).</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H5613B73346DF423487D679DBEC70E1CD"><enum>(2)</enum><header>Limitation on
			 statutory construction</header><text display-inline="yes-display-inline">Section 44703(k) (as redesignated by
			 subsection (b)(1) of this section) is amended by striking <quote>subsection
			 (h)</quote> and inserting <quote>subsection (h) or (i)</quote>.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H20C7FB261EFB4810ACF4EB18E5717475" section-type="subsequent-section"><enum>204.</enum><header>FAA Task Force on
			 Air Carrier Safety and Pilot Training</header>
				<subsection id="H1E5F50D0A7F94F39A9BB7D4E1659BBD2"><enum>(a)</enum><header>Establishment</header><text>The
			 Administrator of the Federal Aviation Administration shall establish a special
			 task force to be known as the FAA Task Force on Air Carrier Safety and Pilot
			 Training (in this section referred to as the <quote>Task Force</quote>).</text>
				</subsection><subsection id="H7C5526581FE64324AE16BE17ADCC81C3"><enum>(b)</enum><header>Composition</header><text>The
			 Task Force shall consist of members appointed by the Administrator and shall
			 include air carrier representatives, labor union representatives, and aviation
			 safety experts with knowledge of foreign and domestic regulatory requirements
			 for flight crewmember education and training.</text>
				</subsection><subsection id="HEC52EE68D6E04B3294634B12E50C83EF"><enum>(c)</enum><header>Duties</header><text>The
			 duties of the Task Force shall include, at a minimum, evaluating best practices
			 in the air carrier industry and providing recommendations in the following
			 areas:</text>
					<paragraph id="HD994C9DCD5AE4CF09EED1969D853809D"><enum>(1)</enum><text>Air carrier
			 management responsibilities for flight crewmember education and support.</text>
					</paragraph><paragraph id="HEFBDDB6F36124501980ABC81D7DF0FD3"><enum>(2)</enum><text>Flight crewmember
			 professional standards.</text>
					</paragraph><paragraph id="H961CDBE89F564232BCFDD71D56DB97E1"><enum>(3)</enum><text>Flight crewmember
			 training standards and performance.</text>
					</paragraph><paragraph id="H7D334C8FDA9E4EE69B5D4B87B5140C02"><enum>(4)</enum><text>Mentoring and
			 information sharing between air carriers.</text>
					</paragraph></subsection><subsection id="HC225A1C3F3F64CF7B419728D82E73863"><enum>(d)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, and before the
			 last day of each one-year period thereafter until termination of the Task
			 Force, the Task Force shall submit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on Commerce,
			 Science, and Transportation of the Senate a report detailing—</text>
					<paragraph id="H9A24617C66244037B3419A2F4806C4E2"><enum>(1)</enum><text>the progress of
			 the Task Force in identifying best practices in the air carrier
			 industry;</text>
					</paragraph><paragraph id="H9459881B2FEE48339D4E0495648E716D"><enum>(2)</enum><text>the progress of
			 air carriers and labor unions in implementing the best practices identified by
			 the Task Force;</text>
					</paragraph><paragraph id="H7C1D7527DE7D415DA528AE227BA62BA4"><enum>(3)</enum><text>recommendations of
			 the Task Force, if any, for legislative or regulatory actions;</text>
					</paragraph><paragraph id="H3BB863CEA48747A8B25BC5BCA485CC7E"><enum>(4)</enum><text>the progress of
			 air carriers and labor unions in implementing training-related, nonregulatory
			 actions recommended by the Administrator; and</text>
					</paragraph><paragraph id="H42F30273F0B749598E362CEBFB6F3E4F"><enum>(5)</enum><text>the progress of
			 air carriers in developing specific programs to share safety data and ensure
			 implementation of the most effective safety practices.</text>
					</paragraph></subsection><subsection id="H778E84237C3842288507D8C3F6E7DECC"><enum>(e)</enum><header>Termination</header><text>The
			 Task Force shall terminate on September 30, 2012.</text>
				</subsection><subsection id="H7C701C928C4E4D9C8C9EBEB06033A073"><enum>(f)</enum><header>Applicability of
			 Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act
			 (5 U.S.C. App.) shall not apply to the Task Force.</text>
				</subsection></section><section id="HD6C935E8822848B095F9B796B5631A32"><enum>205.</enum><header>Aviation safety
			 inspectors and operational research analysts</header>
				<subsection id="H68BB4690BE0F4AF6852E5CDCCE01FFC6"><enum>(a)</enum><header>Review by DOT
			 Inspector General</header><text display-inline="yes-display-inline">Not later
			 than 9 months after the date of enactment of this Act, the Inspector General of
			 the Department of Transportation shall conduct a review of the aviation safety
			 inspectors and operational research analysts of the Federal Aviation
			 Administration assigned to part 121 air carriers and submit to the
			 Administrator of the Federal Aviation Administration a report on the results of
			 the review.</text>
				</subsection><subsection id="HDB21ACDF6E244E869264D6693E7C5509"><enum>(b)</enum><header>Purposes</header><text>The
			 purpose of the review shall be, at a minimum—</text>
					<paragraph id="H24B98A82AF1D42C994279A065DC7BE5A"><enum>(1)</enum><text>to review the
			 level of the Administration’s oversight of each part 121 air carrier;</text>
					</paragraph><paragraph id="HCE5B518678C64E0F9B2CF1CE9EBA28C8"><enum>(2)</enum><text>to make
			 recommendations to ensure that each part 121 air carrier is receiving an
			 equivalent level of oversight;</text>
					</paragraph><paragraph id="H5BFF699755B84F7B90452630AD984ECD"><enum>(3)</enum><text>to assess the
			 number and level of experience of aviation safety inspectors assigned to each
			 part 121 air carrier;</text>
					</paragraph><paragraph id="H00AD10F9C86946B594E02D4432FD50E1"><enum>(4)</enum><text>to evaluate how
			 the Administration is making assignments of aviation safety inspectors to each
			 part 121 air carrier;</text>
					</paragraph><paragraph id="H01AFA306925A4A19BC98783B25D56FD9"><enum>(5)</enum><text>to review various
			 safety inspector oversight programs, including the geographic inspector
			 program;</text>
					</paragraph><paragraph id="HFF7457BDEFAB4CDDB4BD74FA7D20D6AD"><enum>(6)</enum><text>to evaluate the
			 adequacy of the number of operational research analysts assigned to each part
			 121 air carrier;</text>
					</paragraph><paragraph id="H10DF61EE1B824EB6A0E379B7BCB88D71"><enum>(7)</enum><text>to evaluate the
			 surveillance responsibilities of aviation safety inspectors, including en route
			 inspections;</text>
					</paragraph><paragraph id="H0471C5CD0198497D84C708278AB14856"><enum>(8)</enum><text>to evaluate
			 whether inspectors are able to effectively use data sources, such as the Safety
			 Performance Analysis System and the Air Transportation Oversight System, to
			 assist in targeting oversight of each part 121 air carrier;</text>
					</paragraph><paragraph id="H419E983058854D4399F4035CE5D51776"><enum>(9)</enum><text>to assess the
			 feasibility of establishment by the Administration of a comprehensive
			 repository of information that encompasses multiple Administration data sources
			 and allows access by aviation safety inspectors and operational research
			 analysts to assist in the oversight of each part 121 air carrier; and</text>
					</paragraph><paragraph id="HCC44EF902D16494AB3F7BC98C55C5205"><enum>(10)</enum><text>to conduct such
			 other analyses as the Inspector General considers relevant to the
			 review.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="HBFDCEE6BA2B1446BB186B94737B7D5E4" section-type="subsequent-section"><enum>206.</enum><header>Flight crewmember
			 mentoring, professional development, and leadership</header>
				<subsection id="H3E0F030C09D44CA7A4AFF4BDCC90F391"><enum>(a)</enum><header>Aviation
			 rulemaking committee</header>
					<paragraph id="HD87F3AF3A05A46C8894929DB182D9751"><enum>(1)</enum><header>In
			 general</header><text>The Administrator of the Federal Aviation Administration
			 shall convene an aviation rulemaking committee to develop procedures for each
			 part 121 air carrier to take the following actions:</text>
						<subparagraph id="H978AB101A6164BF4A386ED14D2437237"><enum>(A)</enum><text>Establish flight
			 crewmember mentoring programs under which the air carrier will pair highly
			 experienced flight crewmembers who will serve as mentor pilots and be paired
			 with newly employed flight crewmembers. Mentor pilots should be provided, at a
			 minimum, specific instruction on techniques for instilling and reinforcing the
			 highest standards of technical performance, airmanship, and professionalism in
			 newly employed flight crewmembers.</text>
						</subparagraph><subparagraph id="HDCB83A7CF66E472381C57092BB3387F0"><enum>(B)</enum><text>Establish flight
			 crewmember professional development committees made up of air carrier
			 management and labor union or professional association representatives to
			 develop, administer, and oversee formal mentoring programs of the carrier to
			 assist flight crewmembers to reach their maximum potential as safe, seasoned,
			 and proficient flight crewmembers.</text>
						</subparagraph><subparagraph id="HAF18384BD86B49D395A8BEB96EE67B58"><enum>(C)</enum><text>Establish or
			 modify training programs to accommodate substantially different levels and
			 types of flight experience by newly employed flight crewmembers.</text>
						</subparagraph><subparagraph id="H1F3B7DBF4C9C4C91903177C11652A265"><enum>(D)</enum><text>Establish or
			 modify training programs for second-in-command flight crewmembers attempting to
			 qualify as pilot-in-command flight crewmembers for the first time in a specific
			 aircraft type and ensure that such programs include leadership and command
			 training.</text>
						</subparagraph><subparagraph id="HA3FBD31ED3A8450CB42A1BFDF629B333"><enum>(E)</enum><text>Ensure that
			 recurrent training for pilots in command includes leadership and command
			 training.</text>
						</subparagraph><subparagraph id="H889BD1130DF24FA39196A06074E436EB"><enum>(F)</enum><text>Such other actions
			 as the aviation rulemaking committee determines appropriate to enhance flight
			 crewmember professional development.</text>
						</subparagraph></paragraph><paragraph id="H476E78206EBC49EEA333A7B4E6B47A01"><enum>(2)</enum><header>Compliance with
			 sterile cockpit rule</header><text>Leadership and command training described in
			 paragraphs (1)(D) and (1)(E) shall include instruction on compliance with
			 flight crewmember duties under part 121.542 of title 14, Code of Federal
			 Regulations.</text>
					</paragraph><paragraph id="H7BC2FF78E6CE4731BC9D7CF108589705"><enum>(3)</enum><header>Streamlined
			 program review</header>
						<subparagraph id="H69E8AD60978A41D884EF27F10B7D0D11"><enum>(A)</enum><header>In
			 general</header><text>As part of the rulemaking required by subsection (b), the
			 Administrator shall establish a streamlined review process for part 121 air
			 carriers that have in effect, as of the date of enactment of this Act, the
			 programs described in paragraph (1).</text>
						</subparagraph><subparagraph id="HF14FE62C33C745A0A6D636EFA961CA1E"><enum>(B)</enum><header>Expedited
			 approvals</header><text>Under the streamlined review process, the Administrator
			 shall—</text>
							<clause id="HA325B9523739400DBC22A35A29043920"><enum>(i)</enum><text>review the
			 programs of such part 121 air carriers to determine whether the programs meet
			 the requirements set forth in the final rule referred to in subsection (b)(2);
			 and</text>
							</clause><clause id="H345137D1D4404D2EB8EACBC4DE9EDC60"><enum>(ii)</enum><text>expedite the
			 approval of the programs that the Administrator determines meet such
			 requirements.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="H84C7CF56FE8742DEAFA573C07C693024"><enum>(b)</enum><header>Rulemaking</header><text>The
			 Administrator shall issue—</text>
					<paragraph id="H3D580DCA508F449B9DF941CF0D565B98"><enum>(1)</enum><text>not later than one
			 year after the date of enactment of this Act, a notice of proposed rulemaking
			 based on the recommendations of the aviation rulemaking committee convened
			 under subsection (a); and</text>
					</paragraph><paragraph id="H09BC709743AF4812B53D9F4AE2B21919"><enum>(2)</enum><text>not later than 36
			 months after such date of enactment, a final rule based on such
			 recommendations.</text>
					</paragraph></subsection></section><section id="H5D6E5B20996443AAB063A5A56A7A663B"><enum>207.</enum><header>Flight
			 crewmember pairing and crew resource management techniques</header>
				<subsection id="HD111A49D8B114A36A2EB291D2033F03E"><enum>(a)</enum><header>Study</header><text>The
			 Administrator of the Federal Aviation Administration shall conduct a study on
			 aviation industry best practices with regard to flight crewmember pairing, crew
			 resource management techniques, and pilot commuting.</text>
				</subsection><subsection id="H40A7ED70F82F485E985C7BE3B0F6C7E8"><enum>(b)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, the Administrator
			 shall submit to the Committee on Transportation and Infrastructure of the House
			 of Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report on the results of the study.</text>
				</subsection></section><section display-inline="no-display-inline" id="H62D13DF5C0C448E2813FE35B85AA745D" section-type="subsequent-section"><enum>208.</enum><header>Implementation of
			 NTSB flight crewmember training recommendations</header>
				<subsection id="HC6A8622D1F334781A9013742665B88BC"><enum>(a)</enum><header>Rulemaking
			 proceedings</header>
					<paragraph id="HECE72DD3075149AAB3FF2DF340045073"><enum>(1)</enum><header>Stall and upset
			 recognition and recovery training</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation
			 Administration shall conduct a rulemaking proceeding to require part 121 air
			 carriers to provide flight crewmembers with ground training and flight training
			 or flight simulator training—</text>
						<subparagraph id="HBEB1C650E8A140D89DB78A83BF7A973D"><enum>(A)</enum><text>to recognize and
			 avoid a stall of an aircraft or, if not avoided, to recover from the stall;
			 and</text>
						</subparagraph><subparagraph id="H5116C9527F92453E929E6A1D9CCF308B"><enum>(B)</enum><text>to recognize and
			 avoid an upset of an aircraft or, if not avoided, to execute such techniques as
			 available data indicate are appropriate to recover from the upset in a given
			 make, model, and series of aircraft.</text>
						</subparagraph></paragraph><paragraph id="H169967FD26DB40F697E7E855AF47FF42"><enum>(2)</enum><header>Remedial
			 training programs</header><text>The Administrator shall conduct a rulemaking
			 proceeding to require part 121 air carriers to establish remedial training
			 programs for flight crewmembers who have demonstrated performance deficiencies
			 or experienced failures in the training environment.</text>
					</paragraph><paragraph id="HBDE46BD8A8E54FB1897262BBE2ED9DCB"><enum>(3)</enum><header>Deadlines</header><text display-inline="yes-display-inline">The Administrator shall—</text>
						<subparagraph id="HCB1C1E148C4945139A7123F684F82316"><enum>(A)</enum><text>not later than one
			 year after the date of enactment of this Act, issue a notice of proposed
			 rulemaking under each of paragraphs (1) and (2); and</text>
						</subparagraph><subparagraph id="H6A5AA608F5BF49E58DCD5F18BEBD80B3"><enum>(B)</enum><text>not later than 36
			 months after the date of enactment of this Act, issue a final rule for the
			 rulemaking under each of paragraphs (1) and (2).</text>
						</subparagraph></paragraph></subsection><subsection id="H84193B46AFB3451C94A651F937F0CE59"><enum>(b)</enum><header>Stick pusher
			 training and weather event training</header>
					<paragraph id="H8325FF586B224497855086CFEF6A9E0F"><enum>(1)</enum><header>Multidisciplinary
			 panel</header><text>Not later than 120 days after the date of enactment of this
			 Act, the Administrator shall convene a multidisciplinary panel of specialists
			 in aircraft operations, flight crewmember training, human factors, and aviation
			 safety to study and submit to the Administrator a report on methods to increase
			 the familiarity of flight crewmembers with, and improve the response of flight
			 crewmembers to, stick pusher systems, icing conditions, and microburst and
			 windshear weather events.</text>
					</paragraph><paragraph id="H46DFBFB6B7D9496D9BD5C1854EBC9504"><enum>(2)</enum><header>Report to
			 Congress and NTSB</header><text>Not later than one year after the date on which
			 the Administrator convenes the panel, the Administrator shall—</text>
						<subparagraph id="H53AA025BAEE44ADB8DB43487433CF58C"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Committee on Transportation
			 and Infrastructure of the House of Representatives, the Committee on Commerce,
			 Science, and Transportation of the Senate, and the National Transportation
			 Safety Board a report based on the findings of the panel; and</text>
						</subparagraph><subparagraph id="HFDD4B684F48742B185AC5EE5F6D3A23D"><enum>(B)</enum><text>with respect to
			 stick pusher systems, initiate appropriate actions to implement the
			 recommendations of the panel.</text>
						</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H94583D934894496881496B9729DBAC96"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions
			 apply:</text>
					<paragraph id="H89DF777DF240495E9A20810B0F030FF5"><enum>(1)</enum><header>Flight training
			 and flight simulator</header><text>The terms <quote>flight training</quote> and
			 <quote>flight simulator</quote> have the meanings given those terms in part
			 61.1 of title 14, Code of Federal Regulations (or any successor
			 regulation).</text>
					</paragraph><paragraph id="HDAD7E7E4598E4C6494561DF44884B91C"><enum>(2)</enum><header>Stall</header><text>The
			 term <quote>stall</quote> means an aerodynamic loss of lift caused by exceeding
			 the critical angle of attack.</text>
					</paragraph><paragraph id="H82F4C58415B94298A66CCFEC2F5BF1CB"><enum>(3)</enum><header>Stick
			 pusher</header><text display-inline="yes-display-inline">The term ‘‘stick
			 pusher’’ means a device that, at or near a stall, applies a nose down pitch
			 force to an aircraft’s control columns to attempt to decrease the aircraft’s
			 angle of attack.</text>
					</paragraph><paragraph id="H6BDEB72BF577451E92A563655841F067"><enum>(4)</enum><header>Upset</header><text>The
			 term <quote>upset</quote> means an unusual aircraft attitude.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H79D1936A3EB443A7808A4494E96A334C" section-type="subsequent-section"><enum>209.</enum><header>FAA rulemaking on
			 training programs</header>
				<subsection id="HDB1F89513A67447F90BC2ECB6248FDF1"><enum>(a)</enum><header>Completion of
			 rulemaking on training programs</header><text>Not later than 14 months after
			 the date of enactment of this Act, the Administrator of the Federal Aviation
			 Administration shall issue a final rule with respect to the notice of proposed
			 rulemaking published in the Federal Register on January 12, 2009 (74 Fed. Reg.
			 1280; relating to training programs for flight crewmembers and aircraft
			 dispatchers).</text>
				</subsection><subsection id="H5F302D1D568941388E4C030C8DD82C1E"><enum>(b)</enum><header>Expert panel To
			 review part 121 and part 135 training hours</header>
					<paragraph id="H8C9346180258402981EA7D870E6D024E"><enum>(1)</enum><header>Establishment</header><text>Not
			 later than 60 days after the date of enactment of this Act, the Administrator
			 shall convene a multidisciplinary expert panel comprised of, at a minimum, air
			 carrier representatives, training facility representatives, instructional
			 design experts, aircraft manufacturers, safety organization representatives,
			 and labor union representatives.</text>
					</paragraph><paragraph id="HA1F26897B80C40AB8833700006C0D778"><enum>(2)</enum><header>Assessment and
			 recommendations</header><text>The panel shall assess and make recommendations
			 concerning—</text>
						<subparagraph display-inline="no-display-inline" id="H9A51A1BF17024ED1917979215203000B"><enum>(A)</enum><text display-inline="yes-display-inline">the best methods and optimal time needed
			 for flight crewmembers of part 121 air carriers and flight crewmembers of part
			 135 air carriers to master aircraft systems, maneuvers, procedures, takeoffs
			 and landings, and crew coordination;</text>
						</subparagraph><subparagraph id="H3212FF8287A54E0AA6DB6A85E29A5030"><enum>(B)</enum><text>initial and
			 recurrent testing requirements for pilots, including the rigor and consistency
			 of testing programs such as check rides;</text>
						</subparagraph><subparagraph id="H92C27832FE414C6CB0CBF21B4B2C400B"><enum>(C)</enum><text>the optimal length
			 of time between training events for such flight crewmembers, including
			 recurrent training events;</text>
						</subparagraph><subparagraph id="HE906510AA43349CE89242BDBD9B3AEF0"><enum>(D)</enum><text display-inline="yes-display-inline">the best methods reliably to evaluate
			 mastery by such flight crewmembers of aircraft systems, maneuvers, procedures,
			 takeoffs and landings, and crew coordination;</text>
						</subparagraph><subparagraph id="HC6B5F11105094A1B9495FDCB8124314B"><enum>(E)</enum><text>classroom
			 instruction requirements governing curriculum content and hours of
			 instruction;</text>
						</subparagraph><subparagraph id="H44FC1A3909934A62A4FABEE4FF2D3C82"><enum>(F)</enum><text display-inline="yes-display-inline">the best methods to allow specific academic
			 training courses to be credited toward the total flight hours required to
			 receive an airline transport pilot certificate; and</text>
						</subparagraph><subparagraph id="HCABEF6F75B084A0D89DEAEB2865C70AC"><enum>(G)</enum><text display-inline="yes-display-inline">crew leadership training.</text>
						</subparagraph></paragraph><paragraph id="H89AF06A05D9F461CB5F6585D3EBAE035"><enum>(3)</enum><header>Best
			 practices</header><text>In making recommendations under subsection (b)(2), the
			 panel shall consider, if appropriate, best practices in the aviation industry
			 with respect to training protocols, methods, and procedures.</text>
					</paragraph><paragraph id="H269761323E12406F897A60A56B63E784"><enum>(4)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, the Administrator
			 shall submit to the Committee on Transportation and Infrastructure of the House
			 of Representatives, the Committee on Commerce, Science, and Transportation of
			 the Senate, and the National Transportation Safety Board a report based on the
			 findings of the panel.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="HA8C73CC7882B4F808F5076F8507DD275" section-type="subsequent-section"><enum>210.</enum><header>Disclosure of air
			 carriers operating flights for tickets sold for air
			 transportation</header><text display-inline="no-display-inline">Section 41712
			 of title 49, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H939371064E8F44C890AA990C09C0C73B" style="OLC">
					<subsection id="H87A0F19E2826490993D5BF63992177F2"><enum>(c)</enum><header>Disclosure
				requirement for sellers of tickets for flights</header>
						<paragraph id="HE5BA8074943447F6B5D1DBC932C5492E"><enum>(1)</enum><header>In
				general</header><text>It shall be an unfair or deceptive practice under
				subsection (a) for any ticket agent, air carrier, foreign air carrier, or other
				person offering to sell tickets for air transportation on a flight of an air
				carrier to fail to disclose, whether verbally in oral communication or in
				writing in written or electronic communication, prior to the purchase of a
				ticket—</text>
							<subparagraph id="H1280CA641BC84C699E709435376DBB23"><enum>(A)</enum><text>the name of the
				air carrier providing the air transportation; and</text>
							</subparagraph><subparagraph id="HB7A077B6D8124FE79BF253C8B3657FBD"><enum>(B)</enum><text display-inline="yes-display-inline">if the flight has more than one flight
				segment, the name of each air carrier providing the air transportation for each
				such flight segment.</text>
							</subparagraph></paragraph><paragraph id="H20C7E6FB71104479B99D5E72A3D7699B"><enum>(2)</enum><header>Internet
				offers</header><text>In the case of an offer to sell tickets described in
				paragraph (1) on an Internet Web site, disclosure of the information required
				by paragraph (1) shall be provided on the first display of the Web site
				following a search of a requested itinerary in a format that is easily visible
				to a viewer.</text>
						</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HF04299C11FC241968D854072B6A6C6BA" section-type="subsequent-section"><enum>211.</enum><header>Safety inspections
			 of regional air carriers</header><text display-inline="no-display-inline">The
			 Administrator of the Federal Aviation Administration shall perform, not less
			 frequently than once each year, random, onsite inspections of air carriers that
			 provide air transportation pursuant to a contract with a part 121 air carrier
			 to ensure that such air carriers are complying with all applicable safety
			 standards of the Administration.</text>
			</section><section id="H6F9AB3A96C9F4E0C8AD80A52698ADEB8" section-type="subsequent-section"><enum>212.</enum><header>Pilot
			 fatigue</header>
				<subsection id="HFAF230BA70C44C798451818C4C83938C"><enum>(a)</enum><header>Flight and duty
			 time regulations</header>
					<paragraph id="HAA23771804C74293A866AD390469F9DF"><enum>(1)</enum><header>In
			 general</header><text>In accordance with paragraph (3), the Administrator of
			 the Federal Aviation Administration shall issue regulations, based on the best
			 available scientific information, to specify limitations on the hours of flight
			 and duty time allowed for pilots to address problems relating to pilot
			 fatigue.</text>
					</paragraph><paragraph id="H6F0962B9D1DB47C9A2628F8E44578697"><enum>(2)</enum><header>Matters to be
			 addressed</header><text>In conducting the rulemaking proceeding under this
			 subsection, the Administrator shall consider and review the following:</text>
						<subparagraph id="HE4AA093B7B3A4851B4FE065D1FF7E1EF"><enum>(A)</enum><text>Time of day of
			 flights in a duty period.</text>
						</subparagraph><subparagraph id="H43C12FF2A6E94621BFF0F903ECA9C3B8"><enum>(B)</enum><text>Number of takeoff
			 and landings in a duty period.</text>
						</subparagraph><subparagraph id="H4EAED749049D40CF8AB434717AACF82F"><enum>(C)</enum><text>Number of time
			 zones crossed in a duty period.</text>
						</subparagraph><subparagraph id="H36173191AF694FEFA200244B2444F27F"><enum>(D)</enum><text>The impact of
			 functioning in multiple time zones or on different daily schedules.</text>
						</subparagraph><subparagraph id="HABC87D59A3AB4F46A16870578FFB2485"><enum>(E)</enum><text>Research conducted
			 on fatigue, sleep, and circadian rhythms.</text>
						</subparagraph><subparagraph id="HD44C426BB23D4DF4B86D8C6288714805"><enum>(F)</enum><text>Sleep and rest
			 requirements recommended by the National Transportation Safety Board and the
			 National Aeronautics and Space Administration.</text>
						</subparagraph><subparagraph id="HD4D503FEB4354276B9FC3E44D7F0C732"><enum>(G)</enum><text>International
			 standards regarding flight schedules and duty periods.</text>
						</subparagraph><subparagraph id="H7734E467FE8049658644CFD2F01A88CF"><enum>(H)</enum><text>Alternative
			 procedures to facilitate alertness in the cockpit.</text>
						</subparagraph><subparagraph id="H495B78FE48FE49A1B5C849E6810E77EC"><enum>(I)</enum><text>Scheduling and
			 attendance policies and practices, including sick leave.</text>
						</subparagraph><subparagraph id="H2058B159540A4B18AF37EDAAB872191D"><enum>(J)</enum><text>The effects of
			 commuting, the means of commuting, and the length of the commute.</text>
						</subparagraph><subparagraph id="HABA966BA5E214D44B5ED38958B6DB751"><enum>(K)</enum><text>Medical screening
			 and treatment.</text>
						</subparagraph><subparagraph id="H29360C5EE3F84FE596CED5139EB8D3CF"><enum>(L)</enum><text>Rest
			 environments.</text>
						</subparagraph><subparagraph id="H74269CD4BBFC4F258CBD486E79DB509B"><enum>(M)</enum><text>Any other matters
			 the Administrator considers appropriate.</text>
						</subparagraph></paragraph><paragraph id="H901D8E5D89974E31BD40F4914F17046D"><enum>(3)</enum><header>Rulemaking</header><text>The
			 Administrator shall issue—</text>
						<subparagraph id="HF9ECF6A131934D2186ADC0481F4B412A"><enum>(A)</enum><text>not later than 180
			 days after the date of enactment of this Act, a notice of proposed rulemaking
			 under paragraph (1); and</text>
						</subparagraph><subparagraph id="H8A1E772AA28A4E0ABC09E80927E6C7ED"><enum>(B)</enum><text>not later than one
			 year after the date of enactment of this Act, a final rule under paragraph
			 (1).</text>
						</subparagraph></paragraph></subsection><subsection id="H54C46FD0D13344079E4E6280981CE23F"><enum>(b)</enum><header>Fatigue risk
			 management plan</header>
					<paragraph id="HEAA1BFF460A54DA683D9CC0B995B6FD4"><enum>(1)</enum><header>Submission of
			 fatigue risk management plan by part 121 air carriers</header><text>Not later
			 than 90 days after the date of enactment of this Act, each part 121 air carrier
			 shall submit to the Administrator for review and acceptance a fatigue risk
			 management plan for the carrier’s pilots.</text>
					</paragraph><paragraph id="H6271ED2E62E648E0B8E001860B74BCF0"><enum>(2)</enum><header>Contents of
			 plan</header><text>A fatigue risk management plan submitted by a part 121 air
			 carrier under paragraph (1) shall include the following:</text>
						<subparagraph id="H655A32A803F24B728F960400469A1902"><enum>(A)</enum><text>Current flight
			 time and duty period limitations.</text>
						</subparagraph><subparagraph id="H00FD170DB27145E285602775FAF57608"><enum>(B)</enum><text>A rest scheme
			 consistent with such limitations that enables the management of pilot fatigue,
			 including annual training to increase awareness of—</text>
							<clause id="H2D33FA80AB44488FA1A33EAD31B5EAFB"><enum>(i)</enum><text>fatigue;</text>
							</clause><clause id="H2B832BC0A8224B258396B21B518D7F79"><enum>(ii)</enum><text>the
			 effects of fatigue on pilots; and</text>
							</clause><clause id="H0372C2D3A8E54C5894170C2FD79BED71"><enum>(iii)</enum><text>fatigue
			 countermeasures.</text>
							</clause></subparagraph><subparagraph id="H11A37CD261D04A56AF970140382D1A0E"><enum>(C)</enum><text>Development and
			 use of a methodology that continually assesses the effectiveness of the
			 program, including the ability of the program—</text>
							<clause id="H68585AE435584C6B8FB8CF4772DA0273"><enum>(i)</enum><text>to
			 improve alertness; and</text>
							</clause><clause id="H544E225D8C4D47A0BDB0BFB335ACCBEB"><enum>(ii)</enum><text>to
			 mitigate performance errors.</text>
							</clause></subparagraph></paragraph><paragraph id="HCC59424380C94C95894AA96829E8946F"><enum>(3)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 12 months after the date of
			 enactment of this Act, the Administrator shall review and accept or reject the
			 fatigue risk management plans submitted under this subsection. If the
			 Administrator rejects a plan, the Administrator shall provide suggested
			 modifications for resubmission of the plan.</text>
					</paragraph><paragraph id="H029714840FA148B092DF52E815E31B6B"><enum>(4)</enum><header>Plan
			 updates</header>
						<subparagraph id="HFBA63CC82CDA43CFA4FC953E83BCC695"><enum>(A)</enum><header>In
			 general</header><text>A part 121 air carrier shall update its fatigue risk
			 management plan under paragraph (1) every 2 years and submit the update to the
			 Administrator for review and acceptance.</text>
						</subparagraph><subparagraph id="H10FAB9853A1B4CEA8639AD4BBF7411F3"><enum>(B)</enum><header>Review</header><text>Not
			 later than 12 months after the date of submission of a plan update under
			 subparagraph (A), the Administrator shall review and accept or reject the
			 update. If the Administrator rejects an update, the Administrator shall provide
			 suggested modifications for resubmission of the update.</text>
						</subparagraph></paragraph><paragraph id="H919E3F4AB658437A9FD4A6F8B70B5F02"><enum>(5)</enum><header>Compliance</header><text>A
			 part 121 air carrier shall comply with the fatigue risk management plan of the
			 air carrier that is accepted by the Administrator under this subsection.</text>
					</paragraph><paragraph id="H65E14E894BC64AAA9D0B4A493323A49A"><enum>(6)</enum><header>Civil
			 penalties</header><text>A violation of this subsection by a part 121 air
			 carrier shall be treated as a violation of chapter 447 of title 49, United
			 States Code, for purposes of the application of civil penalties under chapter
			 463 of that title.</text>
					</paragraph></subsection><subsection id="H40E4875C2D394A27978AD6AAE75017DF"><enum>(c)</enum><header>Effect of
			 commuting on fatigue</header>
					<paragraph id="HF533CA918A4341919C4D55A4A7064445"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the date of enactment of
			 this Act, the Administrator shall enter into appropriate arrangements with the
			 National Academy of Sciences to conduct a study of the effects of commuting on
			 pilot fatigue and report its findings to the Administrator.</text>
					</paragraph><paragraph id="HAE02E6D75C6848218E4D54AD67F752F6"><enum>(2)</enum><header>Study</header><text>In
			 conducting the study, the National Academy of Sciences shall consider—</text>
						<subparagraph id="H74792D6C565C4CA8858374E3AF74AD47"><enum>(A)</enum><text>the prevalence of
			 pilot commuting in the commercial air carrier industry, including the number
			 and percentage of pilots who commute;</text>
						</subparagraph><subparagraph id="HF962A7E0488C4353AD6FCB71FA114067"><enum>(B)</enum><text>information
			 relating to commuting by pilots, including distances traveled, time zones
			 crossed, time spent, and methods used;</text>
						</subparagraph><subparagraph id="H75DD43232F64427AA0DE5F1B3BE73262"><enum>(C)</enum><text>research on the
			 impact of commuting on pilot fatigue, sleep, and circadian rhythms;</text>
						</subparagraph><subparagraph id="H5EFA0B4A56BC41EFA80E1E845169B010"><enum>(D)</enum><text>commuting policies
			 of commercial air carriers (including passenger and all-cargo air carriers),
			 including pilot check-in requirements and sick leave and fatigue
			 policies;</text>
						</subparagraph><subparagraph id="H83612F9718554E7D80B3A6DBB4CDFD9A"><enum>(E)</enum><text>postconference
			 materials from the Federal Aviation Administration’s June 2008 symposium titled
			 <quote>Aviation Fatigue Management Symposium: Partnerships for
			 Solutions</quote>;</text>
						</subparagraph><subparagraph id="H71E87F4738AF4C50A29DA51AABFA1559"><enum>(F)</enum><text>Federal Aviation
			 Administration and international policies and guidance regarding commuting;
			 and</text>
						</subparagraph><subparagraph id="H637A3B480A744BA3983C0CC34962CE65"><enum>(G)</enum><text>any other matters
			 as the Administrator considers appropriate.</text>
						</subparagraph></paragraph><paragraph id="H2DF9ADD250524BCFA926C3C6814B2A37"><enum>(3)</enum><header>Preliminary
			 findings</header><text>Not later than 120 days after the date of entering into
			 arrangements under paragraph (1), the National Academy of Sciences shall submit
			 to the Administrator its preliminary findings under the study.</text>
					</paragraph><paragraph id="HCF99F5B2DDED4716BC379FB7E88A6D51"><enum>(4)</enum><header>Report</header><text>Not
			 later than 9 months after the date of entering into arrangements under
			 paragraph (1), the National Academy of Sciences shall submit a report to the
			 Administrator containing its findings under the study and any recommendations
			 for regulatory or administrative actions by the Federal Aviation Administration
			 concerning commuting by pilots.</text>
					</paragraph><paragraph id="HB112855E2ACA40FDB93C752254A58C0B"><enum>(5)</enum><header>Rulemaking</header><text>Following
			 receipt of the report of the National Academy of Sciences under paragraph (4),
			 the Administrator shall—</text>
						<subparagraph id="H5F9DCB7994FC4202B2B606FD065A8DDF"><enum>(A)</enum><text>consider the
			 findings and recommendations in the report; and</text>
						</subparagraph><subparagraph id="H176C051A312046ADA86AC9A9A4A04447"><enum>(B)</enum><text>update, as
			 appropriate based on scientific data, regulations required by subsection (a) on
			 flight and duty time.</text>
						</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="HFD10C4B62919452E8C1822A22D7DF501" section-type="subsequent-section"><enum>213.</enum><header>Voluntary safety
			 programs</header>
				<subsection id="HB542B19F142745A494ADE71691698849"><enum>(a)</enum><header>Report</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Administrator
			 of the Federal Aviation Administration shall submit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report on
			 the aviation safety action program, the flight operational quality assurance
			 program, the line operations safety audit, and the advanced qualification
			 program.</text>
				</subsection><subsection id="H8F7DF3E48DE34D908A6202196E6ABB96"><enum>(b)</enum><header>Contents</header><text>The
			 report shall include—</text>
					<paragraph id="HA301CAC6859E4685949D00938993B69B"><enum>(1)</enum><text>a
			 list of—</text>
						<subparagraph id="H021026DFF4064F82AD2BB634ACF0F676"><enum>(A)</enum><text>which air carriers
			 are using one or more of the voluntary safety programs referred to in
			 subsection (a); and</text>
						</subparagraph><subparagraph id="H7BED621951AC4ED3ACB4D41215C46B6C"><enum>(B)</enum><text>the voluntary
			 safety programs each air carrier is using;</text>
						</subparagraph></paragraph><paragraph id="HEE8D56BB421542E68DD9853BAD1CC3CC"><enum>(2)</enum><text>if an air carrier
			 is not using one or more of the voluntary safety programs—</text>
						<subparagraph id="H70BF7EB962EA408CB1115F160FA54F0F"><enum>(A)</enum><text>a list of such
			 programs the carrier is not using; and</text>
						</subparagraph><subparagraph id="H19A8DA3CB017407E9B4883498CA4E543"><enum>(B)</enum><text>the reasons the
			 carrier is not using each such program;</text>
						</subparagraph></paragraph><paragraph id="H62CE6CAFA9F94BEC9DAF201F957D4C13"><enum>(3)</enum><text>if an air carrier
			 is using one or more of the voluntary safety programs, an explanation of the
			 benefits and challenges of using each such program;</text>
					</paragraph><paragraph id="H71153458430544899310C62DD2451609"><enum>(4)</enum><text>a
			 detailed analysis of how the Administration is using data derived from each of
			 the voluntary safety programs as safety analysis and accident or incident
			 prevention tools and a detailed plan on how the Administration intends to
			 expand data analysis of such programs;</text>
					</paragraph><paragraph id="HCE178206755F4EDCBE6C6CA8AD7E9027"><enum>(5)</enum><text>an explanation
			 of—</text>
						<subparagraph id="H1AE4DDAB4B514B84BF2DE22EE6AB56AA"><enum>(A)</enum><text>where the data
			 derived from the voluntary safety programs is stored;</text>
						</subparagraph><subparagraph id="H4AC7478979E74AF5B2240663C67B7C9E"><enum>(B)</enum><text>how the data
			 derived from such programs is protected and secured; and</text>
						</subparagraph><subparagraph id="HC53BD919CF5347A7ACC14AA6168253E5"><enum>(C)</enum><text>what data analysis
			 processes air carriers are implementing to ensure the effective use of the data
			 derived from such programs;</text>
						</subparagraph></paragraph><paragraph id="H2F82BC58379343448119C9F3FFCF6CD0"><enum>(6)</enum><text>a
			 description of the extent to which aviation safety inspectors are able to
			 review data derived from the voluntary safety programs to enhance their
			 oversight responsibilities;</text>
					</paragraph><paragraph id="H75FCAE63BCEC4A05931221FFD1628D95"><enum>(7)</enum><text>a
			 description of how the Administration plans to incorporate operational trends
			 identified under the voluntary safety programs into the air transport oversight
			 system and other surveillance databases so that such system and databases are
			 more effectively utilized;</text>
					</paragraph><paragraph id="H48AA371B41B840A3B8EAADF9FBAD0523"><enum>(8)</enum><text>other plans to
			 strengthen the voluntary safety programs, taking into account reviews of such
			 programs by the Inspector General of the Department of Transportation;
			 and</text>
					</paragraph><paragraph id="H4FD28A4A71274453945028BE0FA8DD95"><enum>(9)</enum><text>such other matters
			 as the Administrator determines are appropriate.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H7622EF4DF3824FB0B5E9BE4D80F212D8" section-type="subsequent-section"><enum>214.</enum><header>ASAP and FOQA
			 implementation plan</header>
				<subsection id="H077FD6A85F724C9482B8F3DCF854B400"><enum>(a)</enum><header>Development and
			 implementation plan</header><text>The Administrator of the Federal Aviation
			 Administration shall develop and implement a plan to facilitate the
			 establishment of an aviation safety action program and a flight operational
			 quality assurance program by all part 121 air carriers.</text>
				</subsection><subsection id="H12A1202F1E20404B9D8D67ECC218E755"><enum>(b)</enum><header>Matters To be
			 considered</header><text>In developing the plan under subsection (a), the
			 Administrator shall consider—</text>
					<paragraph id="H1FB70DF2C5AD476881905B3803FE6B38"><enum>(1)</enum><text>how the
			 Administration can assist part 121 air carriers with smaller fleet sizes to
			 derive a benefit from establishing a flight operational quality assurance
			 program;</text>
					</paragraph><paragraph id="H839C66A3F3284C8A86A9242725273B01"><enum>(2)</enum><text>how part 121 air
			 carriers with established aviation safety action and flight operational quality
			 assurance programs can quickly begin to report data into the aviation safety
			 information analysis sharing database; and</text>
					</paragraph><paragraph id="HBE9B7B044EBF4C57909FBB989D0CB022"><enum>(3)</enum><text>how part 121 air
			 carriers and aviation safety inspectors can better utilize data from such
			 database as accident and incident prevention tools.</text>
					</paragraph></subsection><subsection id="H0C0449D910E34BDFAFF489C9427943DD"><enum>(c)</enum><header>Report</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Administrator
			 shall submit to the Committee on Transportation and Infrastructure of the House
			 of Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a copy of the plan developed under subsection (a) and an
			 explanation of how the Administration will implement the plan.</text>
				</subsection><subsection id="H061FAF06D00447028E03DD9AC6C0B20F"><enum>(d)</enum><header>Deadline for
			 beginning implementation of plan</header><text>Not later than one year after
			 the date of enactment of this Act, the Administrator shall begin implementation
			 of the plan developed under subsection (a).</text>
				</subsection></section><section display-inline="no-display-inline" id="HA07FD815601140768846FC3AB37DFB9F" section-type="subsequent-section"><enum>215.</enum><header>Safety management
			 systems</header>
				<subsection id="H99881CEA8E2245809EAEA93B21CAF376"><enum>(a)</enum><header>Rulemaking</header><text>The
			 Administrator of the Federal Aviation Administration shall conduct a rulemaking
			 proceeding to require all part 121 air carriers to implement a safety
			 management system.</text>
				</subsection><subsection id="HC04B6EFBF4D14E80B0B8803C852F9429"><enum>(b)</enum><header>Matters To
			 consider</header><text>In conducting the rulemaking under subsection (a), the
			 Administrator shall consider, at a minimum, including each of the following as
			 a part of the safety management system:</text>
					<paragraph id="H029B988377AB48088A92EF23ACE3C8EB"><enum>(1)</enum><text>An aviation safety
			 action program.</text>
					</paragraph><paragraph id="H90CB56728BB44EC9B0BC115B8DE6204B"><enum>(2)</enum><text>A
			 flight operational quality assurance program.</text>
					</paragraph><paragraph id="H65768D4E73C9432E9D92EE507DBB92A1"><enum>(3)</enum><text>A
			 line operations safety audit.</text>
					</paragraph><paragraph id="H8440EACC76DE4481BF0309C08AD556F5"><enum>(4)</enum><text>An advanced
			 qualification program.</text>
					</paragraph></subsection><subsection id="HD3C25395ACEF4EB295A243F4359BD898"><enum>(c)</enum><header>Deadlines</header><text>The
			 Administrator shall issue—</text>
					<paragraph id="H56C1FC10FB954EEC8C77E0DA4EBB51BC"><enum>(1)</enum><text>not later than 90
			 days after the date of enactment of this Act, a notice of proposed rulemaking
			 under subsection (a); and</text>
					</paragraph><paragraph id="H19ACEEE2CAD0470CBD3318194D1A97F9"><enum>(2)</enum><text>not later than 24
			 months after the date of enactment of this Act, a final rule under subsection
			 (a).</text>
					</paragraph></subsection><subsection id="H8B3B231570AF493DB9450D2682C24873"><enum>(d)</enum><header>Safety
			 management system defined</header><text>In this section, the term <quote>safety
			 management system</quote> means the program established by the Federal Aviation
			 Administration in Advisory Circular 120–92, dated June 22, 2006, including any
			 subsequent revisions thereto.</text>
				</subsection></section><section display-inline="no-display-inline" id="HCDD69E8B648D4A389B05BC02E480EF9C" section-type="subsequent-section"><enum>216.</enum><header>Flight crewmember
			 screening and qualifications</header>
				<subsection id="HD98420AEF00C4EF68E0DFD38039E790C"><enum>(a)</enum><header>Requirements</header>
					<paragraph id="HBCAC9319EAD5473CB86CC1FD783FC695"><enum>(1)</enum><header>Rulemaking
			 proceeding</header><text display-inline="yes-display-inline">The Administrator
			 of the Federal Aviation Administration shall conduct a rulemaking proceeding to
			 require part 121 air carriers to develop and implement means and methods for
			 ensuring that flight crewmembers have proper qualifications and
			 experience.</text>
					</paragraph><paragraph id="HDADC4023CEBA40DAA95D7385BF9EDB8B"><enum>(2)</enum><header>Minimum
			 requirements</header>
						<subparagraph id="H41005C5F8516450880F2D9D8FE2B36FE"><enum>(A)</enum><header>Prospective
			 flight crewmembers</header><text>Rules issued under paragraph (1) shall ensure
			 that prospective flight crewmembers undergo comprehensive preemployment
			 screening, including an assessment of the skills, aptitudes, airmanship, and
			 suitability of each applicant for a position as a flight crewmember in terms of
			 functioning effectively in the air carrier’s operational environment.</text>
						</subparagraph><subparagraph id="H7A5A68ADA3674594BE2CCCECCFB98BEE"><enum>(B)</enum><header>All flight
			 crewmembers</header><text display-inline="yes-display-inline">Rules issued
			 under paragraph (1) shall ensure that, after the date that is 3 years after the
			 date of enactment of this Act, all flight crewmembers—</text>
							<clause id="H5FE4084FE6F440E3B8EC0810BD95ABD3"><enum>(i)</enum><text>have
			 obtained an airline transport pilot certificate under part 61 of title 14, Code
			 of Federal Regulations; and</text>
							</clause><clause id="H6FD9EEAB513B49308956A326F3898A4B"><enum>(ii)</enum><text>have appropriate
			 multi-engine aircraft flight experience, as determined by the
			 Administrator.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="H5E51239176FB467D9FCC7DD40A529B15"><enum>(b)</enum><header>Deadlines</header><text>The
			 Administrator shall issue—</text>
					<paragraph id="HBED0D051B28446B69E8A3DA579E50665"><enum>(1)</enum><text>not later than 180
			 days after the date of enactment of this Act, a notice of proposed rulemaking
			 under subsection (a); and</text>
					</paragraph><paragraph id="HD97C747E276249CE862B08073534A317"><enum>(2)</enum><text>not later than 24
			 months after such date of enactment, a final rule under subsection (a).</text>
					</paragraph></subsection><subsection id="HB599625BFA214F65A4C8105B2807E5FE"><enum>(c)</enum><header>Default</header><text>The
			 requirement that each flight crewmember for a part 121 air carrier hold an
			 airline transport pilot certificate under part 61 of title 14, Code of Federal
			 Regulations, shall begin to apply on the date that is 3 years after the date of
			 enactment of this Act even if the Administrator fails to meet a deadline
			 established under this section.</text>
				</subsection></section><section display-inline="no-display-inline" id="H83A9BB604B7F42B08B3AB473BBD63F61" section-type="subsequent-section"><enum>217.</enum><header>Airline transport
			 pilot certification</header>
				<subsection id="HCBEF8880F12646EAA897D7607DEDB49E"><enum>(a)</enum><header>Rulemaking
			 proceeding</header><text>The Administrator of the Federal Aviation
			 Administration shall conduct a rulemaking proceeding to amend part 61 of title
			 14, Code of Federal Regulations, to modify requirements for the issuance of an
			 airline transport pilot certificate.</text>
				</subsection><subsection id="H4B37F1C458304B378C56C0872F1CF106"><enum>(b)</enum><header>Minimum
			 requirements</header><text>To be qualified to receive an airline transport
			 pilot certificate pursuant to subsection (a), an individual shall—</text>
					<paragraph id="H262C01449CCE428FACC09EF53783EABB"><enum>(1)</enum><text>have sufficient
			 flight hours, as determined by the Administrator, to enable a pilot to function
			 effectively in an air carrier operational environment; and</text>
					</paragraph><paragraph id="H26B8043470004A0BAC0346C00C2FF09C"><enum>(2)</enum><text>have received
			 flight training, academic training, or operational experience that will prepare
			 a pilot, at a minimum, to—</text>
						<subparagraph id="H396B6CABD4E8470F94D3B3F116F8A4BD"><enum>(A)</enum><text>function
			 effectively in a multipilot environment;</text>
						</subparagraph><subparagraph id="H6C48734F62684ABDAED631D0E11F35F5"><enum>(B)</enum><text>function
			 effectively in adverse weather conditions, including icing conditions;</text>
						</subparagraph><subparagraph id="H8B5F665F3D654DE3BBB91E4F9718DB9B"><enum>(C)</enum><text>function
			 effectively during high altitude operations;</text>
						</subparagraph><subparagraph id="H53201207A81B4E01A6AB1971205884DA"><enum>(D)</enum><text>adhere to the
			 highest professional standards; and</text>
						</subparagraph><subparagraph id="H24DD4525906E43BA970DDD015DBB7B4D"><enum>(E)</enum><text display-inline="yes-display-inline">function effectively in an air carrier
			 operational environment.</text>
						</subparagraph></paragraph></subsection><subsection id="H27523BA4B65A49F995A862FD74A494AB"><enum>(c)</enum><header>Flight
			 hours</header>
					<paragraph id="HA406F494B75A433188D36EB6D7D7BDA2"><enum>(1)</enum><header>Numbers of
			 flight hours</header><text>The total flight hours required by the Administrator
			 under subsection (b)(1) shall be at least 1,500 flight hours.</text>
					</paragraph><paragraph id="HE2D5F468E0754B058B1913CB63524DA3"><enum>(2)</enum><header>Flight hours in
			 difficult operational conditions</header><text>The total flight hours required
			 by the Administrator under subsection (b)(1) shall include sufficient flight
			 hours, as determined by the Administrator, in difficult operational conditions
			 that may be encountered by an air carrier to enable a pilot to operate safely
			 in such conditions.</text>
					</paragraph></subsection><subsection id="HEF98608A7BCB4DBBA96E9D377CF69F97"><enum>(d)</enum><header>Credit toward
			 flight hours</header><text>The Administrator may allow specific academic
			 training courses, beyond those required under subsection (b)(2), to be credited
			 toward the total flight hours required under subsection (c). The Administrator
			 may allow such credit based on a determination by the Administrator that
			 allowing a pilot to take specific academic training courses will enhance safety
			 more than requiring the pilot to fully comply with the flight hours
			 requirement.</text>
				</subsection><subsection id="HEE07852BECA6439F895B33DB7222391F"><enum>(e)</enum><header>Recommendations
			 of expert panel</header><text>In conducting the rulemaking proceeding under
			 this section, the Administrator shall review and consider the assessment and
			 recommendations of the expert panel to review part 121 and part 135 training
			 hours established by section 209(b) of this Act.</text>
				</subsection><subsection commented="no" id="H7557910EBBCC47B69907EB410F6615AD"><enum>(f)</enum><header>Deadline</header><text>Not
			 later than 36 months after the date of enactment of this Act, the Administrator
			 shall issue a final rule under subsection (a).</text>
