<section id="H1BEBEEEF3F334EEEB909444D54BBAD99"><enum>2.</enum><header>Amendments to Public Works and Economic Development Act of 1965</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or a repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Public Works and Economic Development Act of 1965 (42 U.S.C. 3121 et seq.).</text></section> 
<section id="H251D02B4FF234893BFF977A15F693562"><enum>3.</enum><header>Findings and declarations</header> 
<subsection id="HF4ADA39633B64F398C9DAB68A12332DA"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Section 2(a) (42 U.S.C. 3121(a)) is amended to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H5867DF8A92F24F2BB1612A69E8275C63"> 
<subsection id="H9D92679EF3E148DEADAEA87AEEF9516F"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text> 
<paragraph id="HA53C1021896B4DD7BAB5C472788EA72D"><enum>(1)</enum><text display-inline="yes-display-inline">sustainable economic growth in the 21st century depends upon economic development strategies that include investment in essential infrastructure that fosters innovation, entrepreneurship, and competition in the global marketplace;</text></paragraph> 
<paragraph id="H7FE498B4710E484FB4D64D28B2BA6688"><enum>(2)</enum><text display-inline="yes-display-inline">there continue to be areas of the United States experiencing chronic high unemployment, underemployment, outmigration, and low per capita income, as well as areas facing sudden and severe economic dislocations due to structural economic changes, increasing international competition, certain Federal actions (including defense-related facility closures and realignment and actions required to counteract the depletion of natural resources), and natural disasters;</text></paragraph> 
<paragraph id="HEC14A231B710453C8912B84F62FEEE36"><enum>(3)</enum><text>the goal of Federal economic development programs is to raise the standard of living for all citizens and increase the wealth and overall rate of growth of the economy by encouraging regions and communities to develop a more competitive and diversified economic base, including by—</text> 
<subparagraph id="H0DAFB51A3CDA47978EA708BD6F9B059E"><enum>(A)</enum><text>expanding economic opportunities, increasing international competitiveness, and creating a climate supportive of job creation and business development;</text></subparagraph> 
<subparagraph id="HF75C2E386A7C4ED8858E59D5F8A3B19B"><enum>(B)</enum><text>creating an environment that promotes public infrastructure investments that maximize sustainable development practices;</text></subparagraph> 
<subparagraph id="HF10D703464A34565A793FC64DD9C6B13"><enum>(C)</enum><text>promoting private sector job creation through increased innovation, productivity, and entrepreneurship; and</text></subparagraph> 
<subparagraph id="HCE3C65B2F0FB4DC8BD33FF28F04293FB"><enum>(D)</enum><text display-inline="yes-display-inline">empowering local and regional communities experiencing chronic high unemployment, underemployment, outmigration, and low per capita income to develop private sector business and attract increased domestic and foreign private sector capital investment, including through the location of information technology, agribusiness, alternative energy, manufacturing, and bioscience jobs in the United States and the relocation of such jobs to the United States;</text></subparagraph></paragraph> 
<paragraph id="HC2BBB0B1CBB84A51AF79E7528036A842"><enum>(4)</enum><text display-inline="yes-display-inline">economic growth in the States, including in both cities and rural areas, can best be promoted by helping communities invest in regional strategies that build upon unique competitive advantages and are designed to foster innovation and entrepreneurship in all segments of the community’s economy;</text></paragraph> 
<paragraph id="H3751B60D552945BAA326CD8AAF906F28"><enum>(5)</enum><text display-inline="yes-display-inline">while economic development is an inherently local process, the Federal Government should work in partnership with public and private organizations at the State, regional, tribal, and local levels to maximize the impact of existing resources and enable regions, communities, and citizens to participate more fully in the American dream and national prosperity;</text></paragraph> 
<paragraph id="HAA4B0EC5C0E74F7B86218C748491CB44"><enum>(6)</enum><text>in order to avoid duplication of effort and achieve meaningful, long-lasting results, Federal, State, tribal, and local economic development activities should have a clear focus, improved coordination, a comprehensive approach, and simplified and consistent requirements; and</text></paragraph> 
<paragraph id="H576AB10B1EF949DDA794AB716D44F2BF"><enum>(7)</enum><text>Federal economic development efforts will be more effective if the efforts are coordinated with, and build upon, the trade, workforce investment, higher education, transportation, energy, environmental protection, and technology programs of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1A615345EC584283B0386A2CA40AA25A"><enum>(b)</enum><header>Declarations</header><text display-inline="yes-display-inline">Section 2(b) (42 U.S.C. 3121(b)) is amended to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H092FCD346EEC48109DE3BA9570A6DBE1"> 
<subsection id="H6AE4038A284B45CEAED6C5C7782E3200"><enum>(b)</enum><header>Declarations</header><text display-inline="yes-display-inline">In order to promote a strong and growing economy throughout the United States, Congress declares that—</text> 
<paragraph id="HA4A929492E1F47438DE929B74600697C"><enum>(1)</enum><text display-inline="yes-display-inline">assistance under this Act should be made available to distressed communities in both rural and urban areas;</text></paragraph> 
<paragraph id="H984334ECC0FD4286BD49FAAC826455A7"><enum>(2)</enum><text>local communities should work in partnership with neighboring communities, economic development districts, States, Indian tribes, institutions of higher education, national security laboratories, the private sector, and the Federal Government to increase the capacity of those local communities to develop and implement comprehensive economic development strategies to alleviate economic distress and enhance competitiveness in the global economy, including national security laboratories;</text></paragraph> 
<paragraph id="HE9C604FE8D85425AA44A339154BBF7BD"><enum>(3)</enum><text display-inline="yes-display-inline">whether suffering from long-term distress or a sudden dislocation, distressed communities should be encouraged to take affirmative steps to promote innovation and entrepreneurship, including through the formation of business incubators, to help create higher skill, higher wage jobs and foster the participation of those distressed communities in the global marketplace;</text></paragraph> 
<paragraph id="H6B8A28E68C9E4582A2E6052A7FB4EA95"><enum>(4)</enum><text display-inline="yes-display-inline">assistance under this Act should be made available to promote sustainable economic development practices, to assist communities with the productive reuse of abandoned industrial facilities and the redevelopment of brownfields, and to leverage significant Federal investments in high-speed rail corridors and other transportation infrastructure; and</text></paragraph> 
<paragraph id="H1FE768E84FA94E6A84F56BF8E0BBE40E"><enum>(5)</enum><text>research assistance under this Act should help regions across the United States leverage the economic assets of those regions in a comprehensive manner and should enhance the Economic Development Administration’s ability to provide an economic development framework to assist distressed communities and regions, with particular emphasis on revitalizing the manufacturing, agribusiness, and bioscience industries and the linkages between urban and rural communities.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H6C07C64909264E7D960CF36A081DB38B"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3(8) (42 U.S.C. 3122(8)) is amended—</text> 
<paragraph id="HDFE9F93DE59B41E4B5906F03E4AFA4C4"><enum>(1)</enum><text>in subparagraph (C) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H3F029BF9C9044215AC2EB624B4A73415"><enum>(2)</enum><text>in subparagraph (D) by striking the period at the end and inserting a semicolon; and </text></paragraph>

<subsection id="H4A16A36934214F228F8F1434F2E8D2CB"><enum>(a)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">Section 101(b) (42 U.S.C. 3131(b)) is amended—</text> 
<paragraph id="H354B64B5B8AC40629A7910103A2DCE4F"><enum>(1)</enum><text>in the matter preceding paragraph (1) by inserting after <quote>nonprofit organizations</quote> the following: <quote>, including economic development districts and university centers,</quote>; and</text></paragraph>

<section id="H498867BDC99E4E60B7DDAA40CD67DAF1"><enum>105.</enum><header>Coordination with respect to high-speed rail</header><text display-inline="no-display-inline">The Secretary shall coordinate activities carried out under this Act, as appropriate, with the Department of Transportation and other relevant Federal agencies, State and local governments, economic development districts, Indian tribes, and planning and development organizations to leverage and maximize the economic development potential of Federal investments in high-speed rail projects. In carrying out this section, the Secretary shall conduct studies and disseminate reports, as appropriate, with respect to high-speed rail projects.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H12629B8059E64AE1B1E9C272274FF238"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II (42 U.S.C. 3141 et seq.) is amended by inserting after section 207 the following:</text>

<section id="HEA84152E54984EC6BA22778C90FF34B5"><enum>208.</enum><header>Financial assistance for business incubators and science and research parks</header> 
<subsection id="HC2541D0403114B31A8F6A139049CB869"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply:</text> 
<paragraph id="HEE2C54685FAA48E9896FFB9747D251D2"><enum>(1)</enum><header>Business incubator</header><text display-inline="yes-display-inline">The term <term>business incubator</term> means a program established to foster the creation of new businesses and accelerate the growth of early-stage businesses by providing entrepreneurs and early-stage businesses with the resources and services to produce viable businesses that can help create jobs in and restore vitality to communities.</text></paragraph> 
<paragraph id="H60CBDFCFD913415A8BB239F3E2ACA20B" commented="no"><enum>(2)</enum><header>Business incubator development project</header><text>The term <term>business incubator development project</term> means a project to construct or alter facilities for a business incubator, including the acquisition of real property necessary to carry out the construction or alteration.</text></paragraph> 
<paragraph id="H5EA3F1B718AC482FBE9ED626A206A16C"><enum>(3)</enum><header>Science and research park</header><text>The term <term>science and research park</term> means a program that—</text> 
<subparagraph id="HCEA27F6F898447DF8F06419DF9F32E7C"><enum>(A)</enum><text>includes property and buildings designed primarily for—</text> 
<clause id="H77CB0A899E5943A5B5BB090498BC5937"><enum>(i)</enum><text>research and development activities conducted by public-private partners;</text></clause> 
<clause id="HABC858CFAF6643459625D7BD55A99E93"><enum>(ii)</enum><text>technology- and science-based businesses; or</text></clause> 
<clause id="HAA54DCDE4490477FA33D6F9F5EFF0FA7"><enum>(iii)</enum><text>research and development support services;</text></clause></subparagraph> 
<subparagraph id="H0824157D6BC4482CBD08018D4B5310ED"><enum>(B)</enum><text display-inline="yes-display-inline"> includes a contractual relationship with one or more institutions of higher education or government or nonprofit research laboratories, including national security laboratories;</text></subparagraph> 
<subparagraph id="HFBD331011B56424F84FB584DB3224EC8"><enum>(C)</enum><text display-inline="yes-display-inline"> has a primary mission of—</text> 
<clause id="HC41364329A0C4C218392DDA6FD0DFB21"><enum>(i)</enum><text>promoting research and development through industry partnerships, assisting the growth of new ventures, and promoting innovation-driven economic development;</text></clause> 
<clause id="H4531AAC8A0124C60ADA6CBC7A60381FB"><enum>(ii)</enum><text display-inline="yes-display-inline">facilitating the transfer of technology and business skills between researchers and industry teams; and</text></clause> 
<clause id="HEE586CFC82BF468587C66E5477C7F50D"><enum>(iii)</enum><text display-inline="yes-display-inline">promoting technology-led economic development for the community or region in which the program is located; and</text></clause></subparagraph> 
<subparagraph id="HDD122846C43946DAB484067A74497632"><enum>(D)</enum><text>is owned by a government or nonprofit entity (although the government or nonprofit entity may enter into partnerships or joint ventures with for-profit entities to develop or manage specific components of the program).</text></subparagraph></paragraph> 
<paragraph id="H11F560450BA24032AFD302C9D43DA706" commented="no"><enum>(4)</enum><header>Science and research park development project</header><text display-inline="yes-display-inline">The term <term>science and research park development project</term> means a project to construct or alter facilities for a science and research park, including the acquisition of real property necessary to carry out the construction or alteration.</text></paragraph></subsection> 
<subsection id="H28384D28488048C4AECD5FA1CA63F82C"><enum>(b)</enum><header>Financial Assistance</header><text>On the application of an eligible recipient, the Secretary may provide financial assistance in accordance with this section to assist the development of business incubators and science and research parks.</text></subsection> 
<subsection id="H4FB9006CE9CC4DF1B13F16A4E263905E"><enum>(c)</enum><header>Grants for plans for science and research parks</header> 
<paragraph id="H9E0D5F9096264866BA6A198A45C3BB50"><enum>(1)</enum><header>Grant authority</header><text>In accordance with this subsection, the Secretary may award a grant to an eligible recipient for the development of a feasibility study or development plan, or both, with respect to a science and research park development project.</text></paragraph> 
<paragraph id="H41895C3679394A49B05991196EF9274B"><enum>(2)</enum><header>Amount of a grant</header><text>A grant awarded under paragraph (1) may not be in an amount that exceeds $750,000.</text></paragraph> 
<paragraph id="H4DC6B13094484F69B37232D71BF0FDC2"><enum>(3)</enum><header>Selection process</header> 
<subparagraph id="HBB2F250C791F4E738B79BE66CD91CBB6"><enum>(A)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the Economic Revitalization and Innovation Act of 2010, the Secretary shall publish the criteria to be utilized for the selection of grant recipients under paragraph (1).</text></subparagraph> 
<subparagraph id="HD966BA512F804FEFB562D89E289CBAD4"><enum>(B)</enum><header>Competition required</header><text>The Secretary shall award grants under paragraph (1) pursuant to a full and open competition.</text></subparagraph> 
<subparagraph id="HE06C76366D284E3B958F6930AC1262C0"><enum>(C)</enum><header>Geographic diversity</header><text>In awarding grants under paragraph (1), the Secretary shall ensure, to the extent practicable, that grant recipients represent diverse geographic areas of the United States, including rural and urban areas.</text></subparagraph></paragraph> 
<paragraph id="H309FDD6E3878442687A08E1557B4DC0E"><enum>(4)</enum><header>Program limit</header><text>The Secretary may not award, in the aggregate, more than $7,500,000 in grants under paragraph (1).</text></paragraph></subsection> 
<subsection id="H8888EF040E824A9FA0561F0F87C80C94"><enum>(d)</enum><header>Loan guarantees for business incubators and science and research parks</header> 
<paragraph id="HA92C113F185C4A9B947804CB430F36F8" display-inline="no-display-inline"><enum>(1)</enum><header>Guarantee authority</header><text>In accordance with this subsection, the Secretary may guarantee a loan of an eligible recipient to assist the carrying out of a business incubator development project or a science and research park development project.</text></paragraph> 
<paragraph id="HE275091C78D942DDB8D401EAA05AE1A6"><enum>(2)</enum><header>Guarantee percentage</header><text>In guaranteeing a loan under paragraph (1), the Secretary may guarantee up to 80 percent of the principal amount of the loan.</text></paragraph> 
<paragraph id="H9E386A3EDCE4436EAFA314F511D60DCD"><enum>(3)</enum><header>Selection of guarantee recipients</header> 
<subparagraph id="H24C0CFA332CA4C069ADD363DD4CDE5DB"><enum>(A)</enum><header>Creditworthiness</header><text display-inline="yes-display-inline">The Secretary may not guarantee a loan under paragraph (1) unless the Secretary has determined that there is a reasonable assurance of repayment with respect to the loan.</text></subparagraph> 
<subparagraph id="H1AB02FCDF9CC4CB6A72B31F44ABF9013"><enum>(B)</enum><header>Grant recipients</header><text>A recipient of a grant under subsection (c) for the development of a feasability study or development plan, or both, is not eligible for a loan guarantee under paragraph (1) until the recipient has completed the study or plan, or both, for which the grant was provided (as determined by the Secretary).</text></subparagraph></paragraph> 
<paragraph id="H906B060F2FDB4D868CDA28C9B229EE20"><enum>(4)</enum><header>Term of loan</header><text>The term of a loan guaranteed under paragraph (1) may not exceed the lesser of—</text> 
<subparagraph id="HDCBDAF00661B4D628AD5AFBD5EF25E0B"><enum>(A)</enum><text display-inline="yes-display-inline">30 years; or</text></subparagraph> 
<subparagraph id="H612384F9EDD54793924C81B1EB9F5C5C"><enum>(B)</enum><text>90 percent of the useful life of any physical asset to be financed by such loan.</text></subparagraph></paragraph> 
<paragraph id="H9FEB5C97C4164C39B09DA4F3C0F6C0D5"><enum>(5)</enum><header>Subordination</header><text display-inline="yes-display-inline">An obligation relating to a loan guarantee under paragraph (1) may not be subordinated to another debt contracted by the borrower or to any other claims against the borrower in the case of default.</text></paragraph> 
<paragraph id="HA3A7467A7F9349179D65C3A6F811E3A1"><enum>(6)</enum><header>Other terms and conditions</header><text>Except as otherwise specified in this subsection, a loan guarantee under paragraph (1) shall be subject to such terms and conditions as the Secretary may prescribe.</text></paragraph> 
<paragraph id="H40444B94DA2B4D52843915CAC0300003"><enum>(7)</enum><header>Review</header> 
<subparagraph id="H54144D98F9AD4C1982AEAFA9D255EEB3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall periodically assess the risks associated with loans guaranteed under paragraph (1).</text></subparagraph> 
<subparagraph id="H0F8332A9E8024FEBAE787EDF09B9C16D"><enum>(B)</enum><header>Comptroller General report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the Economic Revitalization and Innovation Act of 2010, the Comptroller General shall—</text> 
<clause id="H0820366983E24F49B352727EAE2FE177"><enum>(i)</enum><text>conduct a comprehensive review of the program under this subsection; and</text></clause> 
<clause id="H25A590BCD90F4018BD3ADF9F1042663E"><enum>(ii)</enum><text>submit to Congress a report on the results of the review.</text></clause></subparagraph></paragraph> 
<paragraph id="H4E09134DAC6B4B07B8C0C36D31F1743F"><enum>(8)</enum><header>Program levels</header><text display-inline="yes-display-inline">In carrying out paragraph (1) during fiscal years 2011 through 2015, the Secretary may not guarantee loans in an amount that exceeds—</text> 
<subparagraph id="H5617F35288DC445690ABBF38D3F5B74D"><enum>(A)</enum><text>$50,000,000 for a single project;</text></subparagraph> 
<subparagraph id="H355486E726C54D658D6E7AC4957D561B"><enum>(B)</enum><text display-inline="yes-display-inline">$235,000,000 in a single fiscal year; and</text></subparagraph> 
<subparagraph id="H5401036F78A14324BF6E6F5C213135A3"><enum>(C)</enum><text display-inline="yes-display-inline">$500,000,000 in the aggregate.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H8720EAFACCA245A598D6DB23B3B0BD34"><enum>(6)</enum><text display-inline="yes-display-inline">a lack of technology infrastructure, including inadequate access to broadband capacity sufficient to support economic development objectives;</text></paragraph> 
<paragraph id="H7EA014947B0C484993ADE2CAE0373278"><enum>(7)</enum><text>an inability to utilize alternative means of energy production and distribution; or</text></paragraph> 
<paragraph id="H31E647EEC1E14FEBA83BC26B54EB69AF"><enum>(8)</enum><text display-inline="yes-display-inline">insufficient access to capital and credit necessary for business retention and expansion, entrepreneurship, and innovation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6057CF1B54444F8F84AC48ED1A968006"><enum>(c)</enum><header>Special provisions relating to revolving loan fund grants</header><text>Section 209(d) (42 U.S.C. 3149(d)) is amended—</text> 
<paragraph id="H212694E9B65A4F4DA5CF1C949D2AC74C"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H1D404EA0A30A425FA739BB9D5A608C25"><enum>(A)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively; and</text></subparagraph>

<subparagraph id="HBA32A761944748148A006523CBBE8E59"><enum>(A)</enum><header>Authority</header><text display-inline="yes-display-inline">At the request of a grant recipient, the Secretary may approve the use of the assets of a revolving loan fund established by the grant recipient with assistance under this section for another project, if—</text> 
<clause id="H5BAC104AAD564C27A38A944DAD9C36EC"><enum>(i)</enum><text>the project is eligible for assistance under this Act; and</text></clause> 
<clause id="H713DC51D87184D90902F1F332D4C978C"><enum>(ii)</enum><text>the Secretary determines that the revolving loan fund is no longer necessary and the grant recipient, as a result of changed economic development needs, will make better use of the assets by carrying out the project.</text></clause></subparagraph> 
<subparagraph id="H7BAB2AB4500745D5BE20515F3526FF10"><enum>(B)</enum><header>Methods of conversion</header><text>If conversion of a revolving loan fund is approved under subparagraph (A), the applicable grant recipient may convert the assets of the revolving loan fund by—</text> 
<clause id="H06E739E69AB64DA69CD056BB35DAB94C"><enum>(i)</enum><text>selling to a third party any assets of the revolving loan fund; or</text></clause> 
<clause id="H109E265192884DB1B859EB254C7DD9AD"><enum>(ii)</enum><text>retaining repayments of principal and interest amounts made on loans provided through the revolving loan fund.</text></clause></subparagraph> 
<subparagraph id="H9919990140B247C4918F4B0A642ED173"><enum>(C)</enum><header>Terms and conditions</header><text>Except as otherwise provided under this paragraph, the Secretary may establish such terms and conditions with respect to the conversion of a revolving loan fund under this paragraph as the Secretary determines appropriate.</text></subparagraph> 
<subparagraph id="H55592D43C6B54CE3ADA98E4A2B994EE6"><enum>(D)</enum><header>Expediency requirement</header><text>The Secretary shall ensure that any assets of a revolving loan fund converted under this paragraph are used in an expeditious manner.</text></subparagraph></paragraph> 
<paragraph id="HC4C76232091D4F27A68F0538BCB1BAFD"><enum>(6)</enum><header>Release</header><text display-inline="yes-display-inline">The Secretary may release, subject to terms and conditions the Secretary determines appropriate, the Federal Government’s interest in a revolving loan fund established by a grant recipient with assistance under this section on or after the date that is 7 years after the date on which the applicable grant was fully disbursed, if the Secretary determines that—</text> 
<subparagraph id="H82388A08DEBB4128935EF0E6C61C5B5F"><enum>(A)</enum><text>the grant recipient has carried out the terms of the grant in a satisfactory manner;</text></subparagraph> 
<subparagraph id="H3F77B4F06A7647E88B5D15AD712C7E68"><enum>(B)</enum><text>any proceeds realized after the release of the Federal Government’s interest will be used for one or more activities that carry out the economic development purposes of this Act; and</text></subparagraph> 
<subparagraph id="H007947680D5B442BBB8C3D93190E005E"><enum>(C)</enum><text>the grant recipient will continue to satisfy the requirements of section 602.</text></subparagraph></paragraph> 
<paragraph id="H616ABA3E054A4655B688CFB31827D496"><enum>(7)</enum><header>Equity investment demonstration program</header> 
<subparagraph id="H4BDF06CDCE55466191E7DFF471159667"><enum>(A)</enum><header>Authority</header> 
<clause id="HC1464F58758D4A4EA853A1779A3F694C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">To determine the feasibility and utility of providing equity investments through revolving loan funds established by grant recipients with assistance under this section, the Secretary may authorize, at the request of a grant recipient, the use of the capital base of a revolving loan fund for equity investments in businesses in need of capital to start up operations or expand operations beyond the startup phase.</text></clause> 
<clause id="HD8DB0976FEEC4BFA81259D935BE13BE3"><enum>(ii)</enum><header>Demonstrated capacity</header><text display-inline="yes-display-inline">Before authorizing a grant recipient to make equity investments under clause (i), the Secretary shall determine that the grant recipient has the demonstrated capacity for engaging in equity investments or will contract with another company or organization with a proven track record with respect to equity investments.</text></clause> 
<clause id="H9C0F20F2ED1B40B392F5B88DF15535D4"><enum>(iii)</enum><header>Preferential consideration</header><text display-inline="yes-display-inline">In authorizing grant recipients to make equity investments under clause (i), the Secretary shall give preferential consideration to requests from grant recipients that intend to focus their investment activities in support of business incubators (as defined in section 208(a)), companies commercializing technologies in conjunction with institutions of higher education, science and research parks (as defined in section 208(a)), or technology or manufacturing companies relocating to the United States from outside the United States. </text></clause> 
<clause id="HBF6B156DB9D948FEBEFB19D9C17B399E"><enum>(iv)</enum><header>Geographic diversity</header><text display-inline="yes-display-inline">In authorizing grant recipients to make equity investments under clause (i), the Secretary shall ensure, to the extent practicable, that grant recipients authorized represent diverse geographic areas of the United States, including rural and urban areas.</text></clause></subparagraph> 
<subparagraph id="H85BEA2F3AB014AC08BE1766B11D2DECF"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">In authorizing a grant recipient to make equity investments under subparagraph (A)(i), the Secretary shall ensure that—</text> 
<clause id="HA0BD2E1ED32C4D948C0ADE26C0E865D2"><enum>(i)</enum><text display-inline="yes-display-inline">not more than 25 percent of the capital base of the revolving loan fund of the grant recipient will be used for equity investments;</text></clause> 
<clause id="H4E1520D32E1240A4860825D6DFE08CDC"><enum>(ii)</enum><text display-inline="yes-display-inline">the Federal share of the amount used for an equity investment made by the grant recipient will not exceed 50 percent; and</text></clause> 
<clause id="H34C26F5241E44BD49E41D5D77D36C3C6"><enum>(iii)</enum><text display-inline="yes-display-inline">the total amount of the equity investments made by the grant recipient in any one business will not exceed $250,000.</text></clause></subparagraph> 
<subparagraph id="H52236EA3CAE44BE8AC35CF81C75F6EE0"><enum>(C)</enum><header>Other terms and conditions</header><text>Except as otherwise provided in this paragraph, the Secretary may authorize grant recipients to make equity investments under subparagraph (A)(i) subject to terms and conditions the Secretary determines are appropriate.</text></subparagraph> 
<subparagraph id="H5992F767F4574EBC934013B7D62CAA9B"><enum>(D)</enum><header>Disposition of equity securities</header><text display-inline="yes-display-inline">In the event that the Secretary acquires equity securities as a result of a default by any party under any agreement relating to the terms of the Secretary’s extension of assistance under this paragraph, the Secretary shall liquidate the Federal interest in such securities as soon as possible and for such consideration as the Secretary determines appropriate. The Secretary may assign or transfer the securities to a third party for purposes of liquidation and the third party may retain proceeds from the disposition of the securities to defray costs related to the liquidation. </text></subparagraph> 
<subparagraph id="H3BF8BFCB0E05498F9076D5FD0383334A"><enum>(E)</enum><header>Definitions</header><text>In this paragraph the following definitions apply:</text> 
<clause id="HCD99C4B252AC4C2BBCCC2E597FAA13E9"><enum>(i)</enum><header>Capital base</header><text display-inline="yes-display-inline">The term <term>capital base</term> means the amount of the funding, from a grant under this section and from non-Federal sources, initially provided to establish a revolving loan fund under this section.</text></clause> 
<clause id="H23834A5F5D87445DB09693D7F130C2F0"><enum>(ii)</enum><header>Equity investment</header><text>The term <term>equity investment</term> means an investment of funds in a business that results in the acquisition of an equity security.</text></clause> 
<clause id="HDF84C47BA3E04F14B204DC4E8F3EBEFF"><enum>(iii)</enum><header>Equity security</header><text>The term <term>equity security</term> means an instrument that signifies an ownership interest in a business.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H27235F21E9CE4ED8A17B68FC20525AE9"><enum>207.</enum><header>Sustainable economic development demonstration program</header> 
<subsection id="H9DC5F97307E7461A880D2FFA29CB74A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 218 (42 U.S.C. 3154d) is amended to read as follows:</text>

<subsection id="H1801B19BF6894E67A279F494E50B8F21"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">On the application of an eligible recipient, the Secretary may provide technical assistance, make grants, enter into contracts, or otherwise provide funding for a project—</text> 
<paragraph id="H985A0F2B60404A3EB7E4DEE0EDA73A82"><enum>(1)</enum><text display-inline="yes-display-inline">to promote energy efficiency to enhance the economic competitiveness of an area;</text></paragraph> 
<paragraph id="H09662F36D4444023ADE426CF0CE4EF24"><enum>(2)</enum><text display-inline="yes-display-inline">to increase the use of renewable energy technologies, including solar, wind, or geothermal technologies, to support sustainable economic development and job growth, with a priority given to projects that incorporate photovoltaics or relate to agribusiness, including in both urban and rural areas;</text></paragraph> 
<paragraph id="H542902E5C4F84601AC746241CA00D376"><enum>(3)</enum><text display-inline="yes-display-inline">to support energy efficiency or alternative energy development plans, studies, or analysis (including with respect to job training, attraction, or retention) to enhance a comprehensive economic development strategy with respect to which funding has been provided under this Act;</text></paragraph> 
<paragraph id="H9B977722942C42F79DEDFD9C2A35BF05"><enum>(4)</enum><text display-inline="yes-display-inline">to support the efforts of a community to have a technology or manufacturing business located outside the United States relocate to the United States; and</text></paragraph> 
<paragraph id="H551FDDBBB3424F2DB43A6EBFAF748511"><enum>(5)</enum><text display-inline="yes-display-inline">to supplement another project funded by a Federal grant, loan, or loan guarantee provided for a purpose described in paragraphs (1) through (4).</text></paragraph></subsection> 
<subsection id="H6946BA2C8C7F4223966114EBA65BFE6B"><enum>(b)</enum><header>Federal share</header><text>Notwithstanding section 204, the Federal share of the cost of a project funded under this section—</text> 
<paragraph id="HD6E66266ACB24A578A25ED7DEA5FBECA"><enum>(1)</enum><text>if described in paragraph (1), (2), (3), or (4) of subsection (a), shall not exceed 80 percent; and</text></paragraph> 
<paragraph id="H11221A00F18F4303AB82C56F7F304615"><enum>(2)</enum><text>if described in subsection (a)(5), shall not exceed 100 percent.</text></paragraph></subsection> 
<subsection id="H2068FC906E55455A90D5AB828679102E"><enum>(c)</enum><header>Solicitation of applications</header><text>Not later than 60 days after a date on which funds are made available to carry out this section, the Secretary shall solicit applications for assistance under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H4DBB1AB239BB4E469D797BA0C8786A08"><enum>(1)</enum><header>Establishment</header><text>To carry out the purposes of this Act, before providing investment assistance for a construction project under this Act, the Secretary shall establish the expected period during which the recipient of the assistance shall make best efforts to achieve the economic development objectives of the assistance.</text></paragraph> 
<paragraph id="HD518BE7EA4FA41519263696596766C1A"><enum>(2)</enum><header>Treatment of property</header><text>To obtain the best efforts of a recipient during the period established under paragraph (1), during that period—</text> 
<subparagraph id="HF0B900914F7D4EEA844A1A0738D3D735"><enum>(A)</enum><text>any property that is acquired or improved, in whole or in part, using investment assistance under this Act shall be held in trust by the recipient for the benefit of the project; and</text></subparagraph> 
<subparagraph id="HDB6D697D4E0048369B7BC64E1CCA2250"><enum>(B)</enum><text>the Secretary shall retain an undivided equitable reversionary interest in the property.</text></subparagraph></paragraph> 
<paragraph id="HCF4A51149EDB4EE58BC1792A0C58DB76"><enum>(3)</enum><header>Termination of Federal interest</header> 
<subparagraph id="HE400BD76204F4D68972D9EC26E111C9D"><enum>(A)</enum><header>In general</header><text>Beginning on the date on which the Secretary determines that a recipient has fulfilled the obligations of the recipient for the applicable period under paragraph (1), taking into consideration the economic conditions existing during that period, the Secretary may terminate the reversionary interest of the Secretary in any applicable property under paragraph (2)(B).</text></subparagraph> 
<subparagraph id="H92533B0F4923481A8CE0303652C6BFC5"><enum>(B)</enum><header>Alternative method of termination</header> 
<clause id="H815AA02914BE4728B833D8312A0FC042"><enum>(i)</enum><header>In general</header><text>On a determination by a recipient that the economic development needs of the recipient have changed during the period beginning on the date on which investment assistance for a construction project is provided under this Act and ending on the expiration of the expected period established for the project under paragraph (1), the recipient may submit to the Secretary a request to terminate the reversionary interest of the Secretary in property of the project under paragraph (2)(B) before the date described in subparagraph (A).</text></clause> 
<clause id="HA6C3C0E3BA504590A94D9A622C3E3321"><enum>(ii)</enum><header>Approval</header><text>The Secretary may approve a request of a recipient under clause (i) if—</text> 
<subclause id="H4EF54209C15048AA9BA1BF9D934E4F06"><enum>(I)</enum><text>in any case in which the request is submitted during the 10-year period beginning on the date on which assistance is initially provided under this Act for the applicable project, the recipient repays to the Secretary an amount equal to 100 percent of the fair market value of the pro rata Federal share of the project; or</text></subclause> 
<subclause id="H19773869631F427D89B778F92B0DD6F5"><enum>(II)</enum><text>in any case in which the request is submitted after the expiration of the 10-year period described in subclause (I), the recipient repays to the Secretary an amount equal to the fair market value of the pro rata Federal share of the project as if that value had been amortized over the period established under paragraph (1), based on a straight-line depreciation of the project throughout the estimated useful life of the project.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HB2AF1053C6DE42239A5088E244A07723"><enum>(b)</enum><header>Terms and conditions</header> 
<paragraph id="HAD2886DAB67941B7B7AF3BDAB9057F23"><enum>(1)</enum><header>In general</header><text>The Secretary may establish such terms and conditions under this section as the Secretary determines to be appropriate, including by extending the period of a reversionary interest of the Secretary under subsection (a)(2)(B) in any case in which the Secretary determines that the performance of a recipient is unsatisfactory.</text></paragraph> 
<paragraph id="H925969E0383A46F5BC71BF1AF4D31936" commented="no"><enum>(2)</enum><header>Maintenance of standards</header><text display-inline="yes-display-inline">The Secretary may not terminate a reversionary interest of the Secretary under subsection (a)(2)(B) if the Secretary has not received adequate assurances that the applicable recipient will continue to satisfy the requirements of section 602 after the termination.</text></paragraph></subsection> 
<subsection id="H4B11F1E8C94E436893678BA545CA7BAE" display-inline="no-display-inline"><enum>(c)</enum><header>Previously extended assistance</header><text>With respect to any recipient to which the term of provision of assistance was extended under this Act before the date of enactment of this section, the Secretary may approve a request of the recipient under subsection (a) in accordance with the requirements of this section to ensure uniform administration of this Act, notwithstanding any estimated useful life period that otherwise relates to the assistance.</text></subsection> 
<subsection id="H6B89300D983143DAABAB420F5D24B408"><enum>(d)</enum><header>Conversion of use</header><text>If a recipient of assistance under this Act demonstrates to the Secretary that the intended use of the project for which assistance was provided under this Act no longer represents the best use of the property used for the project, the Secretary may approve a request by the recipient to convert the property to a different use for the remainder of the term of the Federal interest in the property, subject to the condition that the new use shall be consistent with the purposes of this Act.</text></subsection> 
<subsection id="H8AB537612A974358A0856E986FF75EE6"><enum>(e)</enum><header>Status of authority</header><text>The authority of the Secretary under this section is in addition to any authority of the Secretary pursuant to any law or grant agreement in effect on the date of enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H6D5D349B7A9A442DA9D050FAC76B4413"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII (42 U.S.C. 3231 et seq.), as amended by this Act, is further amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H6959C9B72DC44FF38A6CD9C7636CDC09" display-inline="no-display-inline"> 
<section id="HBD21931C19014E97B92FC9862A8D3337"><enum>707.</enum><header>Funding for grants for training, research, and technical assistance</header><text display-inline="no-display-inline">Of the amounts made available under section 701 for each fiscal year, not less than $10,000,000 shall be made available for grants provided under section 207 and, of that amount, not less than $1,125,000 shall be made available for grants under section 207 to establish university centers in States that do not have a university center.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE5F625F33B02482D98D4B4B8035C427B"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b), as amended by this Act, is further amended by inserting after the item relating to section 706 the following:</text>
