general</header><text>The total budget resources made available from the Harbor
Maintenance Trust Fund each fiscal year pursuant to section 9505(c) of the
Internal Revenue Code of 1986 (relating to expenditures from the Harbor
Maintenance Trust Fund) shall be equal to the level of receipts plus interest
credited to the Harbor Maintenance Trust Fund for that fiscal year. Such
amounts may be used only for harbor maintenance programs described in section
9505(c) of such Code.</text>
</paragraph><paragraph commented="no" id="HDABCD103565D4BF3AA8B3B6EA415AE42"><enum>(2)</enum><header>Guarantee</header><text>No
funds may be appropriated for harbor maintenance programs described in such
section unless the amount described in paragraph (1) has been provided.</text>
</paragraph></subsection><subsection commented="no" id="HFD6F6DD7F2E1447AA19F29F26B593208"><enum>(b)</enum><header>Definitions</header><text>In
this section, the following definitions apply:</text>
<paragraph commented="no" id="H5010ECB6941A4556965F17DF2E5D5072"><enum>(1)</enum><header>Total budget
resources</header><text>The term <term>total budget resources</term> means the
total amount made available by appropriations Acts from the Harbor Maintenance
Trust Fund for a fiscal year for making expenditures under section 9505(c) of
the Internal Revenue Code of 1986.</text>
</paragraph><paragraph commented="no" id="HAD9146FB0E8E41B191617385E4CD53B5"><enum>(2)</enum><header>Level of receipts plus
interest</header><text>The term <term>level of receipts plus interest</term>
means the level of taxes and interest credited to the Harbor Maintenance Trust
Fund under section 9505 of the Internal Revenue Code of 1986 for a fiscal year
as set forth in the President’s budget baseline projection as defined in
section 257 of the Balanced Budget and Emergency Deficit Control Act of 1985
(Public Law 99–177) for that fiscal year submitted pursuant to section 1105 of
title 31, United States Code.</text>
</paragraph></subsection></section><section id="HDE3E121BD2BE4D649C9086EFE6198B14"><enum>2008.</enum><header>Funding to process
permits</header><text display-inline="no-display-inline">Section 214 of the
Water Resources Development Act of 2000 (33 U.S.C. 2201 note; 114 Stat. 2594;
119 Stat. 2169; 120 Stat. 318; 120 Stat. 3197; 121 Stat. 1067; 123 Stat. 3478)
is amended—</text>

decisionmaking</header><text>In carrying out this section, the Secretary shall
ensure that the evaluation of permits carried out using funds accepted under
this section shall—</text>
<subparagraph id="H539627892ED3438D8305A0458674F97C"><enum>(A)</enum><text>be reviewed by the
District Commander of the Corps District in which the project or activity is
located, unless the evaluation of the permit is initially conducted by the
District Commander whereby the review shall be conducted by the Commander of
the Corps Division in which the District is located; and</text>
</subparagraph><subparagraph id="H85F98EB208694559B35D848D3E982349"><enum>(B)</enum><text>utilize the same
procedures for decisions that would otherwise be required for the evaluation of
permits for similar projects or activities not carried out using funds
authorized under this section.</text>
</subparagraph></paragraph></subsection><subsection id="H0C633843BEA34FE6B29350971F42C4E9"><enum>(c)</enum><header>Limitation on use of
funds</header><text>None of the funds accepted under this section shall be used
to carry out a review of the evaluation of permits required under subsection
(b)(2)(A).</text>
</subsection><subsection id="H69907ED25B3E4C86A48141624380E671"><enum>(d)</enum><header>Public
availability</header><text>The Secretary shall ensure that all final permit
decisions carried out using funds authorized under this section are made
available to the public, including on the
Internet.</text>
</subsection><after-quoted-block>;

project, based on a 100 percent increase in the period for implementation of
the recommended
plan.</text>

</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section display-inline="no-display-inline" id="HF117E82344D54D59A560F4E27996FBA0" section-type="subsequent-section"><enum>2015.</enum><header>Use of American
iron, steel, and manufactured goods</header>
<subsection id="H9E4EB708B08A4B7CBBD16AACDC9EAB16"><enum>(a)</enum><header>Restriction</header><text display-inline="yes-display-inline">None of the funds authorized or otherwise
made available by this Act may be used for a project unless all of the iron,
steel, and manufactured goods used in the project are produced in the United
States.</text>
</subsection><subsection id="H76334AFA0D3F4AFAA1161579BDA952AD"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply in any case
or category of cases in which the Secretary finds that—</text>
<paragraph id="H50D9AD4714BE4A429A67DC779D52C0B6"><enum>(1)</enum><text display-inline="yes-display-inline">applying subsection (a) would be
inconsistent with the public interest;</text>
</paragraph><paragraph id="HB636B317AB9846EDB7723EC0D8696E80"><enum>(2)</enum><text display-inline="yes-display-inline">iron, steel, and the relevant manufactured
goods are not produced in the United States in sufficient and reasonably
available quantities and of a satisfactory quality; or</text>
</paragraph><paragraph id="HAFD76CF2F6934D9DB6D58E1B9A626697"><enum>(3)</enum><text display-inline="yes-display-inline">inclusion of iron, steel, and manufactured
goods produced in the United States will increase the cost of the overall
project by more than 25 percent.</text>
</paragraph></subsection><subsection id="H103DFCF2906B415ABB4CC792F699DDC7"><enum>(c)</enum><header>Public notice of waiver
request</header><text display-inline="yes-display-inline">If the Secretary
receives a request to waive the application of subsection (a), the Secretary
shall publish in a timely manner that request online and in the Federal
Register.</text>
</subsection><subsection id="HF09E78E7D1154F598B594FAB2C8F068F"><enum>(d)</enum><header>Justification for
waiver</header><text display-inline="yes-display-inline">If the Secretary
determines that it is necessary to waive the application of subsection (a)
based on a finding under subsection (b), the Secretary shall publish online and
in the Federal Register a detailed written justification as to why the
provision is being waived.</text>
</subsection><subsection id="H250C98450C934262A77776CCE8B86AA0"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">This section shall be applied in a manner
consistent with United States obligations under international
agreements.</text>
</subsection></section><enum>III</enum><header>Project-Related
Provisions</header>
<section id="H77CBA59F72B348A9B5E94F0D42C0D1B5"><enum>3001.</enum><header>Douglas Harbor,
Juneau, Alaska</header><text display-inline="no-display-inline">The maximum
amount of Federal funds that may be expended for the project for navigation,
Douglas Harbor, Juneau, Alaska, being carried out under section 107 of the
River and Harbor Act of 1960 (33 U.S.C. 577), shall be $7,000,000.</text>
</section><section id="H13361A054D2B498C83E2A32655DD452A"><enum>3002.</enum><header>Nogales Wash and
tributaries flood control project, Arizona</header><text display-inline="no-display-inline">The project for flood control, Nogales Wash
and tributaries, Arizona, authorized by section 101(a)(4) of the Water
Resources Development Act of 1990 (104 Stat. 4606) and modified by section 303
of the Water Resources Development Act of 1996 (110 Stat. 3711), section 302 of
the Water Resources Development Act of 2000 (114 Stat. 2600), and section 3008
of the Water Resources Development Act of 2007 (121 Stat. 1107), is further
modified to authorize the Secretary to construct the project at a total cost of
$55,500,000, with an estimated Federal cost of $50,100,000 and an estimated
non-Federal cost of $5,400,000.</text>
</section><section id="H2A358CC24F534D3D9994A7C21715E4A3"><enum>3003.</enum><header>Rio de Flag,
Arizona</header><text display-inline="no-display-inline">The project for flood
damage reduction, Rio de Flag, Flagstaff, Arizona, authorized by section
101(b)(3) of the Water Resources Development Act of 2000 (114 Stat. 2576) and
modified by section 3007 of the Water Resources Development Act of 2007 (121
Stat. 1107), is further modified to authorize the Secretary to construct the
project at a total cost of $77,000,000, with an estimated Federal cost of
$50,000,000 and an estimated non-Federal cost of $27,000,000.</text>
</section><section id="HBA23C66D71004C7D91932B7458032FBB"><enum>3004.</enum><header>Tres Rios,
Arizona</header><text display-inline="no-display-inline">The project for
ecosystem restoration, Tres Rios, Arizona, authorized by section 101(b)(4) of
the Water Resources Development Act of 2000 (114 Stat. 2577), is modified to
authorize the Secretary to construct the project at a total cost of
$230,000,000, with an estimated Federal cost of $149,500,000 and an estimated
non-Federal cost of $80,500,000.</text>
</section><section display-inline="no-display-inline" id="HE0F80592D1A043A7BB00DE3BAA2E4A36"><enum>3005.</enum><header>Russian River
project, Sonoma County, California</header><text display-inline="no-display-inline">The project for flood control, water
conservation, and related purposes in the Russian River basin, California,
authorized by section 204 of the Flood Control Act of 1950 (64 Stat. 177), and
the project for Russian River, Dry Creek, California, authorized by section 203
of the Flood Control Act of 1962 (76 Stat. 1192), are modified as
follows:</text>
<paragraph id="HC4E6FA66C8484C80806C121BEC71E9B6"><enum>(1)</enum><text>The Secretary shall
review the biological opinion on the water supply, flood control, and channel
maintenance operations conducted by the Corps of Engineers, the Sonoma County
Water Agency, and the Mendocino County Russian River Flood Control District, as
transmitted by the National Oceanic and Atmospheric Administration on September

section 1001(20) of the Water Resources Development Act of 2007 (121 Stat.
1053), is modified to authorize the Secretary to construct the project at a
total cost of $120,000,000, with an estimated Federal cost of $78,000,000 and
an estimated non-Federal cost of $42,000,000.</text>
</section><section id="HA9BB920A3DC740CE80BC376827E7F18A"><enum>3016.</enum><header>Little Calumet River,
Indiana</header><text display-inline="no-display-inline">The project for flood

</section><section display-inline="no-display-inline" id="H3775A087AAE6452DA284DC69FA2D694E"><enum>4065.</enum><header>Chesapeake Bay
Shoreline study, Maryland, Pennsylvania, and Virginia</header><text display-inline="no-display-inline">In carrying out the study for the Chesapeake
Bay Shoreline, Maryland, Pennsylvania, and Virginia, being carried out under
the Committee Resolution of the Committee on Environment and Public Works of
the United States Senate, adopted May 23, 2001, the Secretary shall determine
the feasibility of carrying out projects on federally owned property for
shoreline protection, environmental restoration, and improvement of water
quality of the Chesapeake Bay.</text>

Hampshire</header><text display-inline="no-display-inline">The Secretary, in
collaboration with all relevant Federal and non-Federal entities, including
State and local governments, nonprofit organizations, academia, and the general
public, shall conduct a comprehensive watershed study of all watersheds in New
Hampshire for water quality, habitat degradation, environmental restoration,
water supply, and potential impacts of climate change for New Hampshire.</text>

Hampshire.</text>

watershed, Ocean and Monmouth Counties, New Jersey</header><text display-inline="no-display-inline">The Secretary shall conduct a comprehensive watershed study to determine the
feasibility of carrying out projects for flood damage reduction, shoreline
protection, environmental restoration, and related water resource purposes for
Barnegat Bay watershed, Ocean and Monmouth Counties, New Jersey.</text>

Hamilton Beach, New York</header><text display-inline="no-display-inline">The
Secretary shall conduct a study to determine the feasibility of carrying out
projects for storm damage reduction, shoreline protection, and environmental
restoration for Hawtree basin, Hamilton Beach, New York.</text>

Richmond, Staten Island, New York</header><text display-inline="no-display-inline">The Secretary shall conduct a study to

Richmond, Staten Island, New York.</text>
</section><section id="H55AEFA89A2F8484D89835FE36B6A4706"><enum>4106.</enum><header>Mariners Marsh and
Arlington Marsh, Staten Island, New York</header><text display-inline="no-display-inline">The Secretary shall conduct a study to
determine the feasibility of carrying out a project for environmental
restoration for Mariners Marsh and Arlington Marsh, Staten Island, New
York.</text>
</section><section commented="no" id="HC35837589B0D4BC49026A2F85D2B0E46"><enum>4107.</enum><header>New York, New
York</header>
<subsection id="H20E2651201854A3D9B42607BB52105BE"><enum>(a)</enum><header>Inventory and
assessment of bulkheads and seawalls</header>
<paragraph id="H5D1D497A7E6844FC8584F6972585744C"><enum>(1)</enum><header>Inventory</header><text>The
Secretary shall conduct an inventory of bulkheads and seawalls constructed
around the city of New York, New York, including the boroughs of Brooklyn, the
Bronx, Manhattan, Staten Island, and Queens.</text>
</paragraph><paragraph id="HD2AA48FAEA724C5D82B41A77678FA5DD"><enum>(2)</enum><header>Assessment of
rehabilitation needs</header><text display-inline="yes-display-inline">In
conducting the inventory required under paragraph (1), the Secretary shall
assess the condition of the bulkheads and seawalls and the need for
rehabilitation or modification of the bulkheads and seawalls.</text>
</paragraph></subsection><subsection id="HA8A2CB2FED5044E8958F78DC5606E8A3"><enum>(b)</enum><header>Report to
Congress</header><text display-inline="yes-display-inline">Not later than 2
years after the date of enactment of this Act, the Secretary shall transmit to
Congress a report containing the inventory and assessment required by
subsection (a).</text>
</subsection><subsection id="H6D4ABE601EEB4141B375E6846F4C5B36"><enum>(c)</enum><header>Interim
actions</header><text display-inline="yes-display-inline">If the Secretary
determines that a bulkhead or seawall referred to in subsection (a) presents an
imminent and substantial risk to public safety, the Secretary may carry out
measures to prevent or mitigate that risk.</text>
</subsection><subsection id="H2C9A5BDCE7564B92A5A0EF20766D0723"><enum>(d)</enum><header>Federal
share</header><text>The Federal share of the cost of assistance provided under
this section shall be 65 percent.</text>

<subsection id="HACB061B9A577437A8DCF1AB8CEA9CBDA"><enum>(a)</enum><header>Inventory and
Assessment of Navigation Jetties and Breakwaters</header>
<paragraph id="H3321491F9B744A4992F4847CE7336161"><enum>(1)</enum><header>Inventory</header><text>The
Secretary shall conduct an inventory of federally constructed navigation
jetties and breakwaters in the State of Oregon.</text>
</paragraph><paragraph id="H18345C4DC651480EA1AA42DE427C9EE1"><enum>(2)</enum><header>Assessment of
rehabilitation needs</header><text>In conducting the inventory required under
paragraph (1), the Secretary shall assess the condition of the navigation
jetties and breakwaters and the need for rehabilitation or modification of the
jetties and breakwaters.</text>
</paragraph></subsection><subsection id="HFD5DF5C04EF24B8A947379E48D4F0AC1"><enum>(b)</enum><header>Report to
Congress</header><text>Not later than 2 years after the date of enactment of
this Act, the Secretary shall transmit to Congress a report containing the
inventory and assessment required by subsection (a).</text>
</subsection><subsection id="HB84F2FC93A5D4E3782E197FEBEB2B680"><enum>(c)</enum><header>Interim
Actions</header><text>If the Secretary determines that a jetty or breakwater
referred to in subsection (a) presents an imminent and substantial risk to
public safety, the Secretary may carry out measures to prevent or mitigate that
risk.</text>
</subsection><subsection id="H1C290C4DB7BB4E0ABAC7DDF099BE9475"><enum>(d)</enum><header>Federal
share</header><text>The Federal share of the cost of assistance provided under
this section shall be 65 percent.</text>
</subsection><subsection id="H9123F285D43D4A0C8CC397B664DB35EE"><enum>(e)</enum><header>Coordination</header><text>In
carrying out this section, the Secretary shall coordinate with the appropriate
officials of the State of Oregon.</text>

Stat. 3679).</text>

collaboration with all relevant Federal and non-Federal entities, including
State and local governments, nonprofit organizations, academia, and the general
public, shall conduct comprehensive watershed studies of all 8 watersheds in
South Carolina for water quality, habitat condition, environmental restoration,
water supply, and the potential impacts of climate change for South
Carolina.</text>
</section><section display-inline="no-display-inline" id="H16D4360DC6C449798369492AB95AE731"><enum>4142.</enum><header>James River, South
Dakota</header><text display-inline="no-display-inline">The Secretary shall
conduct a study to determine the feasibility of modifying the project for
channel restoration and improvements on the James River, South Dakota,
authorized by section 401(b) of the Water Resources Development Act of 1986
(100 Stat. 4128) to add ecosystem restoration and watershed improvements as
project purposes.</text>

years after the date of enactment of this Act, the Secretary shall develop at
Federal expense and submit to Congress a comprehensive plan to prioritize
projects within the Chesapeake Bay watershed, including projects in the
Anacostia, Elizabeth, James, Patapsco, Patuxent, Potomac, Rappahannock,
Susquehanna, and York River basins.</text>
</paragraph><paragraph id="H742CC2CD5A6B40418FE87F9091C44772"><enum>(2)</enum><header>Requirements</header><text>The
Secretary shall ensure that the plan developed under paragraph (1)—</text>
<subparagraph id="HF9DE658C44124135A3147135FA48538F"><enum>(A)</enum><text display-inline="yes-display-inline">focuses on integrating existing and
potential future work of the Corps of Engineers;</text>
</subparagraph><subparagraph commented="no" id="HF2DC7B0A66EA490F9C80B3E7EECD0BDE"><enum>(B)</enum><text>is developed in
consultation with the Chesapeake Bay Program maintained under section 117 of
the Federal Water Pollution Control Act (33 U.S.C. 1267)); and</text>

of the Corps of Engineers that are necessary to assist in the implementation of
the goals of the Chesapeake Bay Agreement, as defined in section 117 of the
Federal Water Pollution Control Act (33 U.S.C. 1267)).</text>

Region ecosystem restoration</header>
<subsection id="HF6527A47F60741E39F648CD1DFB0715A"><enum>(a)</enum><header>In
general</header><text>The Secretary shall plan, design, and construct projects
for aquatic ecosystem restoration within the coastal waters of the Northeastern
United States from Virginia to Maine, including associated bays, estuaries, and
critical riverine areas.</text>
</subsection><subsection id="H9C0C645F32CD4EA6A256B00E7062BE23"><enum>(b)</enum><header>General coastal
management plan</header>
<paragraph id="H793FC7B9EF2242078E70ACC469C83E03"><enum>(1)</enum><header>Assessment</header><text>The
Secretary, in coordination with the Administrator of the Environmental
Protection Agency, the heads of other appropriate Federal agencies, the
Governors of the coastal States from Virginia to Maine, nonprofit
organizations, and other interested parties, shall assess the needs regarding,
and opportunities for, aquatic ecosystem restoration within the coastal waters
of the Northeastern United States.</text>
</paragraph><paragraph id="HA9A6059597FA4148901675A3830A7243"><enum>(2)</enum><header>Plan</header><text>The
Secretary shall develop a general coastal management plan based on the
assessment carried out under paragraph (1), maximizing the use of existing
plans and investigations. The Secretary shall include in the plan the
following:</text>
<subparagraph id="HD40EE3C6878B4BACBBE4C9BBA6D33E1D"><enum>(A)</enum><text display-inline="yes-display-inline">An inventory and evaluation of coastal
habitats.</text>
</subparagraph><subparagraph id="H2CF3FB08B1A04E4397040656BD62DA53"><enum>(B)</enum><text>Identification of aquatic
resources in need of improvement.</text>
</subparagraph><subparagraph id="H14C4DFDF7A5742FD9E4D800DD3C622F0"><enum>(C)</enum><text>Identification and
prioritization of potential aquatic habitat restoration projects.</text>
</subparagraph><subparagraph commented="no" id="H61DE466CD7FF4EC1AA43B9429DC2FBC0"><enum>(D)</enum><text>Identification of
geographical and ecological areas of concern, including—</text>
<clause commented="no" id="H926ED931C86042D082E0D1BAEBE64EC4"><enum>(i)</enum><text>finfish habitats;</text>
</clause><clause commented="no" id="HFE5C65CB5624454286ED05F7061B58C7"><enum>(ii)</enum><text>diadromous fisheries
migratory corridors;</text>
</clause><clause commented="no" id="HF48EEB3BC7FA426DBF4FACE38AB133FA"><enum>(iii)</enum><text>shellfish
habitats;</text>
</clause><clause commented="no" id="H77804E52D5004FF1944F729F40B5B7E4"><enum>(iv)</enum><text>submerged aquatic
vegetation;</text>
</clause><clause commented="no" id="H087B5975B0F04BCE8B929531F2EE14AD"><enum>(v)</enum><text>wetlands; and</text>
</clause><clause commented="no" id="H740543950860460397ECC2E147DD0A12"><enum>(vi)</enum><text>beach dune complexes and
other similar habitats.</text>
</clause></subparagraph></paragraph></subsection><subsection id="H11445CF949EA4E1EB55EB964CF3DC857"><enum>(c)</enum><header>Eligible
projects</header><text display-inline="yes-display-inline">The Secretary may
carry out an aquatic ecosystem restoration project under this section if the
project—</text>
<paragraph id="H0A47B9CF932B4C078CF79F49D23F8D8E"><enum>(1)</enum><text>is consistent with the
management plan developed under subsection (b); and</text>
</paragraph><paragraph id="HB50F9ACB68C840E5AE1052CDDEC402A8"><enum>(2)</enum><text>provides for—</text>
<subparagraph id="H708E3964D37A42B9A6DCC98EC4000BC0"><enum>(A)</enum><text display-inline="yes-display-inline">the restoration of degraded aquatic habitat
(including coastal, saltmarsh, benthic, and riverine habitat);</text>
</subparagraph><subparagraph id="H15A1D0B589BE44D8BFDD308F17332A6E"><enum>(B)</enum><text>the restoration of
geographical or ecological areas of concern, including the restoration of
natural river and stream characteristics;</text>
</subparagraph><subparagraph id="HBF8992A42A374E3989110075D0CBF47E"><enum>(C)</enum><text>the improvement of water
quality; or</text>
</subparagraph><subparagraph id="HA4B52038F2C44B8F93F7E9D371DCCDFF"><enum>(D)</enum><text>other projects or
activities determined to be appropriate by the Secretary.</text>
</subparagraph></paragraph></subsection><subsection id="H9D28CED764AD446C854AAFC5685A6C20"><enum>(d)</enum><header>Cost sharing</header>
<paragraph id="HD98828F3FB084755A88B1E115FFA7D67"><enum>(1)</enum><header>Management
plan</header><text>The management plan developed under subsection (b) shall be
completed at Federal expense.</text>
</paragraph><paragraph id="HAD8A6DF0E20141C3AB007F28E4800196"><enum>(2)</enum><header>Restoration
projects</header><text>The non-Federal share of the cost of a project carried
out under this section shall be 35 percent.</text>
</paragraph></subsection><subsection id="HDC615F83818C422B9EEAA2C633909559"><enum>(e)</enum><header>Cost
limitation</header><text>Not more than $10,000,000 in Federal funds may be
allocated under this section for an eligible project.</text>
</subsection><subsection id="H6D23293214024C5792EB8D58D22B219E"><enum>(f)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to carry
out this section $25,000,000 for fiscal year 2011 and each fiscal year
thereafter, including funds for the completion of the management plan.</text>
</subsection></section><section display-inline="no-display-inline" id="HEB324D0D706F4A2FBD24665224018761" section-type="subsequent-section"><enum>5006.</enum><header>Anacostia
watershed, District of Columbia and Maryland</header>
<subsection id="HF911CB3DBA41470EA85F771D0970089E"><enum>(a)</enum><header>In
general</header><text>The Secretary may participate in the ecosystem
restoration, navigation, flood damage reduction, emergency streambank
protection, and aquatic plant control components of the Anacostia River
Watershed Restoration Plan, developed pursuant to section 5060 of the Water
Resources Development Act of 2007 (121 Stat. 1215), if the Secretary determines
that such component is feasible.</text>
</subsection><subsection id="H7C94710620B442D8B63BF2146713C387"><enum>(b)</enum><header>Consultation</header><text>In
carrying out this section, the Secretary shall consult with the Anacostia
Watershed Restoration Partnership.</text>
</subsection><subsection id="H617B3DAA444F407FBA3B0A7FCA613894"><enum>(c)</enum><header>Federal
lands</header><text>In carrying out a project component under subsection (a),
the Secretary shall waive any cost share to be provided by non-Federal
interests for any portion of the project component that benefits federally
owned property.</text>
</subsection><subsection id="H28D618E3431B427E9C21FC4E68D1BA24"><enum>(d)</enum><header>Authorization of
appropriations</header><text>There is authorized to be appropriated to carry
out this section $25,000,000. Such sums shall remain available until
expended.</text>
</subsection></section><section display-inline="no-display-inline" id="HD51286684EF6424F98BA376A72E637E3" section-type="subsequent-section"><enum>5007.</enum><header>Egmont Key,
Florida</header><text display-inline="no-display-inline">The Secretary shall
accept funds from the Director of the United States Fish and Wildlife Service
to carry out those portions of the project for shoreline stabilization, Egmont
Key, Florida, carried out under section 3 of the Act entitled <quote>An Act
authorizing Federal participation in the cost of protecting the shores of
publicly owned property</quote>, approved August 13, 1946 (33 U.S.C. 426g),
that benefit federally owned property.</text>
</section><section id="H1DD0180998064BAB89108834B6761E1A"><enum>5008.</enum><header>Cambridge,
Maryland</header><text display-inline="no-display-inline">The Secretary is
authorized to carry out projects for environmental protection and restoration
at the Blackwater Wildlife Refuge, Cambridge, Maryland. In carrying out such
projects, the Secretary shall accept funds from the Director of the United
States Fish and Wildlife Service.</text>
</section><section display-inline="no-display-inline" id="H4A3BE2CBEB7440FD84B1E7BEA7728B8A"><enum>5009.</enum><header>Hart-Miller Island,
Maryland</header><text display-inline="no-display-inline">After the date of
enactment of this Act, the Secretary may not consider the use or expansion of
Hart-Miller Island, Maryland, in any dredged material management plan.</text>
</section><section id="HD021AD89A8104020BD9405AEC776E59A"><enum>5010.</enum><header>Gallops Island,
Boston, Massachusetts</header><text display-inline="no-display-inline">The
Secretary is authorized to carry out a project for the environmental
remediation of Gallops Island, Boston, Massachusetts. In carrying out such
project, the Secretary shall accept funds from the Director of the National
Park Service.</text>
</section><section commented="no" id="H540E8B8E301D46EEA08E6C3333E37B1E"><enum>5011.</enum><header>Sharkey County,
Mississippi</header><text display-inline="no-display-inline">Funding for the
operation and maintenance of the multiagency wildlife and environmental
interpretative and education center, authorized by section 145(f) of Division H
of Public Law 108–199 (118 Stat. 443), shall be provided by the Secretary of
the Interior.</text>
</section><section display-inline="no-display-inline" id="HCB27A77F4C6E4FFA875E681BC83CDA8C"><enum>5012.</enum><header>Charleston Harbor
Post 45 Project, Charleston, South Carolina</header><text display-inline="no-display-inline">The Secretary shall expedite completion of
the reconnaissance and feasibility studies for the Charleston Harbor Post 45
Project, Charleston, South Carolina, and if the Secretary determines that the
project is feasible, shall proceed directly to project preconstruction,
engineering, and design.</text>

received several awards of the United States Army, including 2 Bronze Stars, 4
Legions of Merit, and numerous lesser awards.</text>
</paragraph><paragraph id="HDB68DC8B5DE04C00B5CD53FD4862FB32"><enum>(4)</enum><text>On October 27, 2010, the
Committee on Armed Services of the Senate unanimously approved the nomination
of General Walsh to the rank of Major General, United States Army.</text>
</paragraph><paragraph id="H30CF5754C40F4CF4AB83ADD063DF84AE"><enum>(5)</enum><text>General Walsh’s
nomination was unreasonably delayed on the floor of the Senate for 7
months.</text>
</paragraph><paragraph id="HB3C0A589418A4D7EA1738E124DDB3106"><enum>(6)</enum><text>On May 19, 2010, the
nomination of General Walsh to Major General of the United States Army was
confirmed by the United States Senate by unanimous consent.</text>
</paragraph><paragraph id="H51007507BF454EBC915C54C3087E51F5"><enum>(7)</enum><text>On June 2, 2010,
Brigadier General Walsh was formally promoted to the rank of Major
General.</text>
