		  improve the reporting on sales of livestock and dairy products, and for other

		<section id="H160CC7ECC4C4443289422DC543D9BA5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mandatory Price Reporting Act of
			 2010</short-title></quote>.</text>
		</section><section id="HFDB83D18FF4D4CB58777C3C3A238D3F1" section-type="subsequent-section"><enum>2.</enum><header>Livestock mandatory
			 reporting</header>
			<subsection id="H0728323511CC4348A7A6F9ECA7554353"><enum>(a)</enum><header>Extension of
			 authority</header>
				<paragraph id="HA883FDE710DB433386708F838025B714"><enum>(1)</enum><header>In
			 general</header><text>Section 260 of the Agricultural Marketing Act of 1946 (7
			 U.S.C. 1636i) is amended by striking <quote>September 30, 2010</quote> and
			 inserting <quote>September 30, 2015</quote>.</text>
				</paragraph><paragraph id="HE9590569378946198749EEF1AA917897"><enum>(2)</enum><header>Conforming
			 amendment and extension</header><text>Section 942 of the Livestock Mandatory
			 Reporting Act of 1999 (7 U.S.C. 1635 note; Public Law 106–78) is amended by
			 striking <quote>September 30, 2010</quote> and inserting <quote>September 30,
			 2015</quote>.</text>
				</paragraph></subsection><subsection id="H6DEF5ED7EAA642BEB06571C2FE4C7359"><enum>(b)</enum><header>Wholesale pork
			 cuts</header>
				<paragraph id="HF688E56FB42147FC95F2C2C523CC4F31"><enum>(1)</enum><header>Reporting</header><text>Chapter
			 3 of subtitle B of the Agricultural Marketing Act of 1946 (7 U.S.C. 1635i et
			 seq.) is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HB5FD74CF126F48C3A56D8AFD75193194" style="OLC">
						<section id="H8D4D752C839B44309D293EE348047ABD"><enum>233.</enum><header>Mandatory
				reporting of wholesale pork cuts</header>
							<subsection id="HC24D169C38FB4C688C62C3820EE043B2"><enum>(a)</enum><header>Reporting</header><text display-inline="yes-display-inline">The corporate officers or officially
				designated representatives of each packer shall report to the Secretary
				information concerning the price and volume of wholesale pork cuts, as the
				Secretary determines is necessary and appropriate.</text>
							</subsection><subsection id="H00843C635BA14C0593D750CFE07AD2CC"><enum>(b)</enum><header>Publication</header><text>The
				Secretary shall publish information reported under subsection (a) as the
				Secretary determines necessary and
				appropriate.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1A0C547167754AD889498E65B563618C"><enum>(2)</enum><header>Negotiated
			 Rulemaking</header><text>The Secretary of Agriculture shall establish a
			 negotiated rulemaking process pursuant to subchapter III of chapter 5 of title
			 5, United States Code, to negotiate and develop a proposed rule to implement
			 the amendment made by paragraph (1).</text>
				</paragraph><paragraph id="HFBC004DFA47D430797C77CDC44CD37E0"><enum>(3)</enum><header>Negotiated
			 rulemaking committee</header>
					<subparagraph id="HB8E48F81AF604BB4A9296F78CF4D4B0C"><enum>(A)</enum><header>Representation</header><text>Any
			 negotiated rulemaking committee established by the Secretary of Agriculture
			 pursuant to paragraph (2) shall include representatives from—</text>
						<clause id="H3819172E4D7D4C52B6E8481A719D3182"><enum>(i)</enum><text>organizations
			 representing swine producers;</text>
						</clause><clause id="H18627B46A23A453D8342EC7C5CFD159F"><enum>(ii)</enum><text>organizations
			 representing packers of pork, processors of pork, retailers of pork, and buyers
			 of wholesale pork;</text>
						</clause><clause id="H541A9FA5AECD414D989A768A526537D1"><enum>(iii)</enum><text>the Department
			 of Agriculture; and</text>
						</clause><clause id="H9C69272AA81847EBB69F2DC924EDD99A"><enum>(iv)</enum><text>among interested
			 parties that participate in swine or pork production.</text>
						</clause></subparagraph><subparagraph id="H282B2CE19D034C869FCE3E7F708531EC"><enum>(B)</enum><header>Inapplicability
			 of Federal Advisory Committee Act</header><text>Any negotiated rulemaking
			 committee established by the Secretary of Agriculture pursuant to paragraph (2)
			 shall not be subject to the Federal Advisory Committee Act (5 U.S.C.
			 App.).</text>
					</subparagraph></paragraph><paragraph id="H496FCCE6114F4149B5E6145B2D7F5A61"><enum>(4)</enum><header>Timing of
			 proposed and final rules</header><text>In carrying out the negotiated
			 rulemaking process under paragraph (2), the Secretary of Agriculture shall
			 ensure that—</text>
					<subparagraph id="H3063BA06BF0046DAB0BF8A7D23860165"><enum>(A)</enum><text>any recommendation
			 for a proposed rule or report is provided to the Secretary of Agriculture not
			 later than 180 days after the date of the enactment of this Act; and</text>
					</subparagraph><subparagraph id="H8E9ACEEB1D664A16BAEAD0BB51CD7CA8"><enum>(B)</enum><text>a final rule is
			 promulgated not later than one and a half years after the date of the enactment
			 of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="HE80AF71D80EC4165859B113E142C840D"><enum>(c)</enum><header>Pork export
			 reporting</header><text>Section 602(a)(1) of the Agricultural Trade Act of 1978
			 (7 U.S.C. 5712(a)(1)) is amended by striking <quote>cotton,</quote> and
			 inserting <quote>cotton, pork,</quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="H17D097914BCB487F87D99FE51F90853E" section-type="subsequent-section"><enum>3.</enum><header>Dairy mandatory
			 reporting</header>
			<subsection id="HC3D200348A314B088C4217F4AC91B0B4"><enum>(a)</enum><header>Electronic
			 reporting required</header><text display-inline="yes-display-inline">Subsection
			 (d) of section 273 of the Agricultural Marketing Act of 1946 (7 U.S.C. 1637b)
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H5CC208FB9A794C90AF6FE2DDE7BFC1CB" style="OLC">
					<subsection id="HA7C9250DD8CD449884393F4C982D0156"><enum>(d)</enum><header>Electronic
				Reporting</header>
						<paragraph id="HA731F24EC8BB431796C1DEB2675355A4"><enum>(1)</enum><header>Electronic
				reporting system required</header><text display-inline="yes-display-inline">The
				Secretary shall establish an electronic reporting system to carry out this
				section.</text>
						</paragraph><paragraph id="H212053EFC7FE4EEBB248B73CF3CBBD53"><enum>(2)</enum><header>Publication</header><text>Not
				later than 3:00 p.m. Eastern Time on the Wednesday of each week, the Secretary
				shall publish a report containing the information obtained under this section
				for the preceding
				week.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H194F35BA4C3441A59E7D51CF591D74A0"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 enactment of this Act, the Secretary of Agriculture shall implement the
			 electronic reporting system required by subsection (d) of section 273 of the
			 Agricultural Marketing Act of 1946 (7 U.S.C. 1637b), as amended by subsection
			 (a). Until the electronic reporting system is implemented, the Secretary shall
			 continue to conduct mandatory dairy product information reporting under the
			 authority of such section, as in effect on the day before the date of enactment
			 of this Act.</text>
