<official-title>To require persons to certify that they have not violated foreign corrupt practices statutes before being awarded Government contracts, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="H10592296D789471E8D4DADFDD3ED802" section-type="section-one"><enum>1.</enum><header>Required certification by persons prior to award of Federal contracts</header> 
<subsection id="HB25AF448DBB24EA7ADDA92DDCC514DDF"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">An Executive agency—</text> 
<paragraph id="H957CEF9D35124AB7B2D172EF81F395C"><enum>(1)</enum><text>may not enter into a contract for the procurement of goods or services with any person or entity unless that person or entity has certified that the person or entity, and each of its officers, employees, and agents, have not violated section 30A of the Securities Exchange Act of 1934, section 104 or 104A of the Foreign Corrupt Practices Act of 1977, or any comparable law of any other country; and</text> </paragraph>
<paragraph id="H9EDF4A67339549F392672E00ECB5677"><enum>(2)</enum><text>may not allow any contractor awarded a contract by the agency to enter into a subcontract (at any tier) under the contract with any person or entity that has not made the certification described in paragraph (1).</text> </paragraph></subsection>
<subsection id="H4F789A3093384B96B42F9299B5C098C9"><enum>(b)</enum><header>Executive agency defined</header><text>In this Act, the term <term>Executive agency</term> has the meaning provided in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text> </subsection>
<subsection id="HF7FB9C89C652423B9234DEB53F008E59"><enum>(c)</enum><header>Applicability</header><text>Subsection (a) applies—</text> 
<paragraph id="H7FC170235AAD416FB07477B39534DFAB"><enum>(1)</enum><text>to contracts entered into after the date of the enactment of this Act; and</text> </paragraph>
<paragraph id="H23B435667C2E4C1DB624B9E860004123"><enum>(2)</enum><text>to subcontracts (at any tier) awarded under such contracts.</text> </paragraph></subsection></section>
