		<official-title>To provide for improved border security and to ensure
		  that employers that participate in the E-Verify Program are not subject to
		  unjustified penalties.</official-title>

		<section id="H16BF2C41F234401C9E1F6520F0F25934" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Border Security and Employee
			 Verification Improvement Act of 2010</short-title></quote>.</text>
		</section><section id="H788A54278B9A4BB38C6A8FF70B4C364F" section-type="subsequent-section"><enum>2.</enum><header>Increase in Border
			 Patrol agents</header>
			<subsection id="HD4F05384EEE44C12A883ACCD5C09A78F"><enum>(a)</enum><header>Annual
			 increases</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security shall, subject to the availability of appropriations for such
			 purpose, increase the number of positions for full-time active-duty Border
			 Patrol agents within the Department of Homeland Security (above the number of
			 positions for which funds were appropriated for the preceding fiscal year),
			 by—</text>
				<paragraph id="H9F57AFC3B3B9484986DEE3014264B74B"><enum>(1)</enum><text>2,000 in fiscal
			 year 2011;</text>
				</paragraph><paragraph id="H87513D09C2BD481FA969A2EED9E4F79B"><enum>(2)</enum><text>2,000 in fiscal
			 year 2012; and</text>
				</paragraph><paragraph id="H719BA8D448B445339FB506B541C9736A"><enum>(3)</enum><text>2,000 in fiscal
			 year 2013.</text>
				</paragraph></subsection><subsection id="H5BEF38ABE8024F319B96AECB2C2AD862"><enum>(b)</enum><header>Allocations</header><text>Of
			 the Border Patrol agents specified in subsection (a), 100 percent shall be
			 deployed along the southern border of the United States.</text>
			</subsection></section><section id="HDC8BADF6BD1C43AFB3B89433EBE364D0"><enum>3.</enum><header>Infrastructure
			 improvements</header><text display-inline="no-display-inline">The Secretary of
			 Homeland Security shall, as the case may be and subject to the availability of
			 appropriations for such purposes, construct or purchase—</text>
			<paragraph id="H39232BC8764443C79EFBFC217BD7AA71"><enum>(1)</enum><text>office facilities
			 to accommodate additional Border Patrol agents;</text>
			</paragraph><paragraph id="H7A8DF4287D8F4DFDAAC990CB682AEDAF"><enum>(2)</enum><text>sport utility
			 vehicles or all terrain vehicles for such agents;</text>
			</paragraph><paragraph commented="no" id="H90A0E2C718CC4571845E0208F67BAC9F"><enum>(3)</enum><text>additional fencing
			 in urban areas of the southern border of the United States; and</text>
			</paragraph><paragraph id="H6C1FF6CE0598423798B969DB1DAC0E8F"><enum>(4)</enum><text>vehicle barriers
			 to support, not replace, manpower in rural and remote areas of the southern
			 border of the United States to achieve operational control of such
			 border.</text>
			</paragraph></section><section id="H7B9B38FECB734C2EA2EF8E6EEDF16235"><enum>4.</enum><header>Two-layered
			 reinforced fencing along the southern border of the United States</header>
			<subsection id="HDBCC2E99D3F241E28195DD570DEC8FF3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 102(b)(1)(A)
			 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8
			 U.S.C. 1103 note) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HAB4235E7D00241899F6DEA200E387DF9" style="OLC">
					<subparagraph id="H924C199AE1A54859B8D49DEB0A2AD3D8"><enum>(A)</enum><header>Two-layered
				reinforced fencing</header>
						<clause id="H091A1894897549AD8391647568CFB5DC"><enum>(i)</enum><header>In
				general</header><text>In carrying out subsection (a), the Secretary of Homeland
				Security shall construct two layers of reinforced physical fencing along not
				fewer than 150 miles of the southern border of the United States where such
				fencing would be most practical and effective to deter and prevent unlawful
				border crossings.</text>
						</clause><clause id="H2EDDE4B40F2447F3B0D31DBBCF56CD6E"><enum>(ii)</enum><header>Border Patrol
				access road</header><text>The two-layered reinforced physical fencing required
				under clause (i) shall be separated by a Border Patrol access road.</text>
						</clause><clause id="H1ECA793188244F6D87293719271791FC"><enum>(iii)</enum><header>Construction
				deadline</header>
							<subclause id="HAB2CD67B47A940E1A27B3F942EF8BDFE"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than three
				years after the date of the enactment of this subparagraph, the Secretary of
				Homeland Security shall ensure the completion of the construction of the
				two-layered reinforced fencing required under clause (i) and the construction
				of the Border Patrol access road required under clause (ii).</text>
							</subclause><subclause id="H82D52EC3F1CA4A19869B2EEFE849A8F5"><enum>(II)</enum><header>Report</header><text>If
				the Secretary of Homeland Security is unable to complete the construction of
				such fencing and access road by the date specified in subclause (I), the
				Secretary shall submit to Congress a report describing why such construction
				was not so completed.</text>
							</subclause></clause><clause id="H862A304A0329438AA0DCAE1401CAA637"><enum>(iv)</enum><header>Prohibition on
				preexisting fencing to satisfy mileage requirement</header><text>In carrying
				out clause (i), the Secretary of Homeland Security may not consider fencing
				along the southern border of the United States in existence on the date of the
				enactment of this subparagraph for purposes of satisfying the mileage
				requirement specified in such
				clause.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H91EA2EB0FB734D1AA9213CF9E29CB099"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Secretary
			 of Homeland Security shall submit to the Committee on Homeland Security of the
			 House of Representatives and the Committee on Homeland Security and
			 Governmental Affairs of the Senate a report containing a plan for construction
			 of a physical fence along the entire southern border of the United States and
			 including the following information:</text>
				<paragraph id="H380BC43A86B541858B90CD7179FBEBFF"><enum>(1)</enum><text>The amount of
			 fencing (measured in miles) necessary to complete such plan.</text>
				</paragraph><paragraph id="H191D6B31BA7C4A64A7A4D659A9D96388"><enum>(2)</enum><text>A
			 timeline for completion of such plan.</text>
				</paragraph><paragraph id="H525EEAA04B344EE58D1A1376EF2B7138"><enum>(3)</enum><text>An identification
			 of high-traffic areas that are prioritized for such construction.</text>
				</paragraph><paragraph id="H7C1AE15EBBBD4AC8AAE1A0CC496263D9"><enum>(4)</enum><text>Additional
			 resources needed from Congress relating to such construction.</text>
				</paragraph></subsection></section><section id="H70780EB7D2E845DCB5B09E2968D78825"><enum>5.</enum><header>Study on E-Verify
			 Program</header><text display-inline="no-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary of Homeland
			 Security shall conduct a study on the E-Verify Program established under title
			 IV of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996
			 (8 U.S.C. 1324a note). The study shall include the following:</text>
			<paragraph id="H7293D16B4E464162B70BEECC5E684CA8"><enum>(1)</enum><text>The number of
			 employers that voluntarily participate in the E-Verify Program.</text>
			</paragraph><paragraph id="H0F8678C39E54402BB045600544A47197"><enum>(2)</enum><text>The number of
			 employers required by law to participate in the E-Verify Program.</text>
			</paragraph><paragraph id="H5B18EB0FD1C34A15A7312CF47428B2EB"><enum>(3)</enum><text>The number of
			 employers that, while fully participating in the E-Verify program, employed
			 unauthorized aliens (as such term is defined in section 274A(h)(3) of the
			 Immigration and Nationality Act (8 U.S.C. 1324a(h)(3))).</text>
			</paragraph><paragraph id="H388B6F20FF9D4A84904644C7C0EB4914"><enum>(4)</enum><text display-inline="yes-display-inline">A determination by the Secretary as to the
			 feasibility of improving the E-Verify Program by incorporating additional
			 sources of information, including—</text>
				<subparagraph id="H4B144C6F7F314467BAA5F1F1A9FE4419"><enum>(A)</enum><text>the databases and
			 resources used by United States Immigration and Customs Enforcement in an I–9
			 audit;</text>
				</subparagraph><subparagraph id="HCBB091541906402190BC69FDD7C14181"><enum>(B)</enum><text display-inline="yes-display-inline">State-owned databases and information from
			 State documents; and</text>
				</subparagraph><subparagraph id="H269281A4223F4D1EAB83CBCBDF7F6C7B"><enum>(C)</enum><text display-inline="yes-display-inline">information about reported lost or stolen
			 identities.</text>
				</subparagraph></paragraph><paragraph id="HDAD4910B731A403FBA48413720CE799A"><enum>(5)</enum><text display-inline="yes-display-inline">A determination by the Secretary as to
			 whether existing legal protections for employers who properly participate in
			 the E-Verify program are sufficient to fully protect them from civil or
			 criminal liability for the employment of unauthorized aliens (as such term is
			 defined in section 274A(h)(3) of the Immigration and Nationality Act (8 U.S.C.
			 1324a(h)(3))).</text>
