		<official-title>To provide for competitive grants for the establishment
		  and expansion of programs that use networks of public, private, and faith-based
		  organizations to recruit and train foster and adoptive parents and provide
		  support services to foster children and their families.</official-title>

		<section id="H32CA461938A949CB9DEB66CA7243B1A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>One Church, One Child Act of
			 2010</short-title></quote>.</text>
		</section><section id="HC97EA703D6F5479EA09CDBCF6FF24ACE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following
			 findings:</text>
			<paragraph id="HC78B86D4F673403AB0A7E368FC0E9EC1"><enum>(1)</enum><text display-inline="yes-display-inline">Many States are facing serious shortages of
			 qualified foster parents and qualified adoptive parents.</text>
			</paragraph><paragraph id="H67B9A876971D453E8970AD1D469D5157"><enum>(2)</enum><text>Though family
			 foster care remains the preferred placement setting for most children in foster
			 care, numerous studies have documented States’ inability to effectively recruit
			 and retain qualified foster families. In 2008, almost 30 percent of children in
			 foster care were placed in a non-family placement setting.</text>
			</paragraph><paragraph id="HB329E66AAC0E4CE68A21C38188FB3DF7"><enum>(3)</enum><text>The shortage of
			 adoptive parents is equally dire—while 55,000 children were adopted out of
			 foster care in 2008, as many as 123,000 were awaiting adoption. On average,
			 these waiting children had been in continuous foster care for 38 months.</text>
			</paragraph><paragraph id="H8DBD1319983F4349BC5577EAEFE7FD68"><enum>(4)</enum><text>The costs of not
			 finding adoptive homes for foster children awaiting adoption are great. Youth
			 who “age out” of the foster care system—almost 30,000 youth in 2008—are at
			 higher risk of becoming pregnant, homeless, unemployed, and incarcerated than
			 their peers.</text>
			</paragraph><paragraph id="H9AA773A5687C4B1CB5479D43EB55CF8B"><enum>(5)</enum><text>A
			 2005 study found that “a strong personal connection” does more to attract
			 adoptive parents to foster care adoption than the media and other costlier
			 recruitment strategies.</text>
			</paragraph><paragraph id="H974138CE93EE4FBFAC39901D3E85C9CA"><enum>(6)</enum><text>The rapid increase
			 in the annual number of adoptions from foster care since the enactment of the
			 Adoption and Safe Families Act of 1997 has created a growing need for
			 post-adoption services and for service providers with the knowledge and skills
			 required to address the unique issues adoptive families and children may
			 face.</text>
			</paragraph><paragraph id="H7247EF9B853648EFBF7DC6393DDE9693"><enum>(7)</enum><text>One Church, One
			 Child is a national faith- and community-based foster care and adoption
			 ministry established in Chicago, Illinois, in 1980 by Father George Clements,
			 whose mission is to provide comprehensive services that promote the well-being
			 of at-risk children and the strengthening and empowerment of adoptive, foster,
			 and kinship families. Since its formation, the organization and programs based
			 on its model have successfully placed more than 140,000 children in adoptive
			 families nationwide.</text>
			</paragraph><paragraph id="HA565439A13234B3F9A30AD47C93A98B2"><enum>(8)</enum><text>Despite its
			 success as a model for providing recruitment, training, and support services
			 for certified foster and adoptive parents, One Church, One Child programs and
			 programs based on this concept have received limited Federal funding.</text>
			</paragraph><paragraph id="HF7EE36FA393345828CB6A5E2F3F79E0C"><enum>(9)</enum><text>The creation of a
			 federally funded grant program to support the establishment and expansion of
			 programs for the recruitment of foster parents and adoptive parents which are
			 modeled on the One Church, One Child concept will benefit the Nation’s abused
			 and neglected children by increasing the pool of qualified adoptive parents and
			 qualified foster parents.</text>
			</paragraph></section><section id="HCCD9D85D92084F1C82D48AF1AF2E81DD"><enum>3.</enum><header>One church, one
			 child grants</header><text display-inline="no-display-inline">Part E of title
			 IV of the Social Security Act (42 U.S.C. 670–679c) is amended by adding at the
			 end the following:</text>

				<section id="H4BE3FB1F64934E189F9805DF11F68D3B"><enum>479C.</enum><header>One church,
				one child grants</header>
					<subsection id="H812B2A05592141379794FCBE51C55E0C"><enum>(a)</enum><header>Competitive
				grants to eligible entities To conduct one church, one child foster parent and
				adoption parent recruitment programs</header>
						<paragraph id="H95F1911F6EC846F69F0FA29CEBEDDC95"><enum>(1)</enum><header>Grant
				authority</header>
							<subparagraph id="H58E5796704C548D09BEE74DD77642AD8"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall make grants, on a competitive basis,
				to eligible entities to support the establishment or expansion of programs that
				use networks of public, private and faith-based organizations to recruit and
				train qualified foster parents and qualified adoptive parents and provide
				support services to adoptive and foster children and their families.</text>
							</subparagraph><subparagraph id="HD0C517DD69644603BAD26405693C72F2"><enum>(B)</enum><header>Eligible
				entity</header><text>In this section, the term <term>eligible entity</term>
				means a State or local government, local public agency, community-based or
				nonprofit organization, or private entity, including any charitable or
				faith-based organization, that submits to the Secretary, at such time, in such
				form, and in such manner as the Secretary may require, an application that
				contains such information as the Secretary may require and the
				following:</text>
								<clause id="H9C475910C9CB4FF7BE2C7D1C559B015D"><enum>(i)</enum><header>Project
				description</header><text>A description of the programs or activities the
				entity intends to carry out with funds provided under this section, including
				an estimate of the number of children to be served under such programs or
				activities and a description of the services to be provided to prospective
				adoptive and foster parents, including post-placement supportive
				services.</text>
								</clause><clause id="H1DBBD239D92040B5A7DA11EAC176EC56"><enum>(ii)</enum><header>Coordination of
				efforts</header><text>A description of how the entity will coordinate and
				cooperate with State and local entities responsible for carrying out programs
				related to the recruitment of foster parents and adoptive parents, and with the
				national clearinghouse established under section 479D.</text>
								</clause><clause id="H1701649B003942D79871304326CA6204"><enum>(iii)</enum><header>Records,
				reports, and audits</header><text>An agreement to maintain such records, submit
				such reports, and cooperate with such reviews and audits as the Secretary finds
				necessary for purposes of oversight.</text>
								</clause></subparagraph></paragraph><paragraph id="HD206AC436B07481795C5EBD631F145E5"><enum>(2)</enum><header>Definition of
				state</header><text>In this section, the term <term>State</term> means each of
				the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the
				United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the
				Northern Mariana Islands.</text>
						</paragraph><paragraph id="H342757217E13498CBB9E644B6D266178"><enum>(3)</enum><header>Limitations on
				authorization of appropriations</header><text>To carry out this section, there
				are authorized to be appropriated to the Secretary not more than $20,000,000
				for each of fiscal years 2011 through 2015.</text>
						</paragraph><paragraph id="HC15E204950484A65AA2AAF0C456397A7"><enum>(4)</enum><header>3-year
				availability of grant funds</header><text>An eligible entity to which a grant
				is made under this section for a fiscal year shall remit to the Secretary any
				part of the grant that is not expended by the end of the second succeeding
				fiscal year, together with any earnings on such unexpended amount.</text>
						</paragraph><paragraph id="H55EE9EC7A6CB41189253A58B5AFCDACC"><enum>(5)</enum><header>Redistribution
				of unused grant funds</header><text>The Secretary shall redistribute any funds
				remitted under paragraph (4) among eligible entities that the Secretary
				determines have a need for additional funds to carry out the programs and
				activities referred to in paragraph (1)(B)(i).</text>
						</paragraph></subsection><subsection id="H2653D207D8894717BDA8DAD7F9EA625B"><enum>(b)</enum><header>Provisions
				relating to religious organizations</header>
						<paragraph id="H843B197665504FBCADFDBC80192D347D"><enum>(1)</enum><header>Nondiscrimination</header><text>For
				the purpose of awarding grants under this section, the Secretary shall consider
				religious organizations on the same basis as other nongovernmental
				organizations, so long as the grant is to be implemented in a manner consistent
				with the Establishment Clause of the First Amendment to the Constitution of the
				United States. A State or local government receiving funds under this section
				shall not discriminate against an organization that seeks to participate in a
				program funded under this section on the basis that the organization has a
				religious character.</text>
						</paragraph><paragraph id="HC5A49BA47F38468391C31254BFB9F938"><enum>(2)</enum><header>Noninterference</header><text>Neither
				the Federal Government nor a State or local government shall require a
				religious organization—</text>
							<subparagraph id="H2AA2184E543D42CB90E568C0FB5F04C5"><enum>(A)</enum><text>to alter its form
				of internal governance; or</text>
							</subparagraph><subparagraph id="H145E10156DDF4DE5A3E8FE97C7B20D90"><enum>(B)</enum><text>to remove from its
				premises religious art, icons, scripture, or other symbols,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">in order
				to be eligible to receive a grant under this section or to participate in a
				program funded under this section.</continuation-text></paragraph><paragraph id="H1821F27F513C411FA48487F37B4562E4"><enum>(3)</enum><header>Limitations on
				use of funds</header><text>Funds provided directly to a religious organization
				to carry out a program funded under this section shall not be expended for
				sectarian worship, instruction, or proselytization.</text>
						</paragraph><paragraph id="H7654F5502B174E18BBEB9C28C61A8A59"><enum>(4)</enum><header>Fiscal
				accountability</header>
							<subparagraph id="H30FBE8737BFF49568E766B5E4B1CA867"><enum>(A)</enum><header>In
				general</header><text>Except as provided in paragraph (B), a religious
				organization receiving funds under this section shall be subject to the same
				regulations as other nongovernmental organizations to account in accord with
				generally accepted accounting principles for the use of such funds.</text>
							</subparagraph><subparagraph id="H49F4B20ACC504640AE59657BE06A9FEF"><enum>(B)</enum><header>Separation of
				funds</header><text>Such an organization shall keep all funds provided under
				this section in an account separate from all other funds of the
				organization.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD6FE08A29D8B497E93A080F3F43BB82B"><enum>4.</enum><header>National
			 clearinghouse for adoption promotion and foster parent programs; annual report
			 to Congress</header><text display-inline="no-display-inline">Part E of title IV
			 of the Social Security Act (42 U.S.C. 670–679c) is further amended by adding at
			 the end the following:</text>

				<section id="HD6683280BA0D493B86EAB54F8647A73E"><enum>479D.</enum><header>National
				clearinghouse for adoption promotion and foster parent recruitment programs;
				annual report to Congress</header>
					<subsection id="H6B2CC8C02CB2487895F7EFAB79D7547E"><enum>(a)</enum><header>National
				clearinghouse for adoption promotion and foster parent recruitment
				programs</header>
						<paragraph id="HCE8D0C10F39648CA97B09CA60B3710B6"><enum>(1)</enum><header>National
				clearinghouse</header>
							<subparagraph id="H8DE2ACDBD6E34D52B1968C6B43B5E10C"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall enter into a contract with a
				nationally recognized, nonprofit adoption promotion and foster parent
				recruitment organization described in subparagraph (B) to—</text>
								<clause id="HA65963A01BD843109437CF7AF64EC761"><enum>(i)</enum><text>assist State and
				local governments, local public agencies, community-based organizations,
				nonprofit organizations, and private entities, including charitable and
				faith-based organizations in coordinating their activities relating to
				recruitment of foster parents and adoptive parents and the provision of
				post-placement support to foster families and adoptive families;</text>
								</clause><clause id="HC18335F1F8244AAB803D71DC32F25823"><enum>(ii)</enum><text>design and
				provide technical assistance and training for grantees and identify and
				disseminate to grantees <quote>best practices</quote> for recruiting and
				training prospective foster and adoptive parents and providing post-placement
				support to foster families and adoptive families;</text>
								</clause><clause id="H71B5A8694BAA4DAD81B8226C9DBC5526"><enum>(iii)</enum><text>collect
				information on the effectiveness of the programs funded under section 479C,
				including the number of children placed under the programs, the number of
				foster parents and adoptive parents recruited under such programs, and such
				other data as the Secretary requires for evaluating the effectiveness of such
				programs; and</text>
								</clause><clause id="H2B49B87C47A14904A964AD768F32A6A7"><enum>(iv)</enum><text>assist the
				Secretary in the preparation of the reports required by subsection (b).</text>
								</clause></subparagraph><subparagraph id="H3B1E3A602ED843DFBAA1F2DEA0384635"><enum>(B)</enum><header>Nationally
				recognized, nonprofit adoption promotion and foster parent recruitment
				organization described</header><text>The nationally recognized, nonprofit
				adoption promotion and foster parent recruitment organization described in this
				subparagraph is an organization, selected by the Secretary on a competitive
				basis, that—</text>
								<clause id="H3ECC2C724AC64378822C7ABE65BBCFE4"><enum>(i)</enum><text>has demonstrated
				experience in providing consultation and training to faith-based and community
				organizations interested in adoption promotion and foster parent
				recruitment;</text>
								</clause><clause id="H9DE9A13A11634E6B8DC00C1B66DE678B"><enum>(ii)</enum><text>has an
				established national reputation in working with faith-based and community
				organizations to recruit and train prospective foster and adoptive parents;
				and</text>
								</clause><clause id="HB8F2CEAFBB024A70B6D3CF6A06C15CA1"><enum>(iii)</enum><text>has extensive
				experience in establishing and working with programs based on the One Church,
				One Child model.</text>
								</clause></subparagraph></paragraph><paragraph id="H600DB428703E4559841C3E9256876713"><enum>(2)</enum><header>Limitations on
				authorization of appropriations</header><text>To carry out this subsection,
				there are authorized to be appropriated not more than $1,000,000 for each of
				fiscal years 2011 through 2015.</text>
						</paragraph></subsection><subsection id="H019BB1ABE5F44E9AA0569BAD2DEC52EF"><enum>(b)</enum><header>Annual
				reports</header><text>Not later than 1 year after the date a grant is first
				made under section 479C and annually thereafter, the Secretary shall prepare
				and submit to the Congress a report that includes the following with respect to
				the year involved:</text>
						<paragraph id="H90901DBE613C4868B74A3A2C60CA4115"><enum>(1)</enum><text>A specification of
				the number of entities to which grants have been made under section
				479C.</text>
						</paragraph><paragraph id="H65A7F119DC184BE4B3F38E19BDAA4AB8"><enum>(2)</enum><text>A specification of
				the number of foster parents and adoptive families recruited by the programs
				which have been supported with the grants.</text>
						</paragraph><paragraph id="HD014E240DDA340FEBA267754811A2C28"><enum>(3)</enum><text>A specification of
				the number of children placed with such foster parents and adoptive families,
				and the outcomes of such placements.</text>
						</paragraph><paragraph id="H551904C23E354CB2ADDB07AC220515A7"><enum>(4)</enum><text>Any other
				information that the Secretary determines is relevant to the evaluation of the
				program under section
				479C.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
