		<official-title>To direct the Secretary of Transportation to establish a
		  grant program to develop a roadway safety training institute to deliver
		  comprehensive and uniform roadway safety training to roadway
		  workers.</official-title>

		<section id="H2F980F84F8FE4C7EBA1EF69E44CBFA4F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Roadway Safety Training and Access Act of
			 2010</short-title></quote>.</text>
		</section><section id="H6922AF6677604201B7CAE8875E16C79B"><enum>2.</enum><header>Roadway safety
			 training institute grant program</header>
			<subsection id="H711C02A6EE01436CA2F4E6D62FDD4371"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation shall establish and implement a grant program to develop a
			 roadway safety training institute.</text>
			</subsection><subsection id="H366788CDDEB041AFB5044937C5D6A0C0"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary shall make grants to one
			 eligible entity to develop a roadway safety training institute in accordance
			 with this section.</text>
			</subsection><subsection id="HEB3CE124949543D4B3177A793DE8B564"><enum>(c)</enum><header>Applications</header><text>An
			 eligible entity seeking a grant under this section shall submit an application
			 to the Secretary in such form, and containing such information, as the
			 Secretary may require.</text>
			</subsection><subsection id="H1DD4149821BB47498D263751E4B79CFC"><enum>(d)</enum><header>Eligible
			 activities</header><text display-inline="yes-display-inline">An eligible entity
			 receiving a grant under this section may use funds from the grant to develop
			 and deliver comprehensive and uniform roadway safety training to roadway
			 workers across the United States, including through the following
			 activities:</text>
				<paragraph id="HA18F74A57E0C4642A8ABB157A0BA59DE"><enum>(1)</enum><text>Development,
			 updating, and delivery of training courses on—</text>
					<subparagraph id="H28D518A891EB421AB84A3949CE2E8E61"><enum>(A)</enum><text>guardrail
			 installation, maintenance, and inspection;</text>
					</subparagraph><subparagraph id="H28850D4E0C3146CAB5D71C4BE8E2A800"><enum>(B)</enum><text>identification by
			 law enforcement personnel of potential engineering improvements at crash
			 locations;</text>
					</subparagraph><subparagraph id="HEAEF411A0CEF4FCFBE2C7762BF416711"><enum>(C)</enum><text>traffic control
			 for incident responders;</text>
					</subparagraph><subparagraph id="HDA4816B3440248D8ABFD5557A99AC31C"><enum>(D)</enum><text>law enforcement in
			 roadway work zones;</text>
					</subparagraph><subparagraph id="H8FD71F8C0AE44D199766106A72537EE5"><enum>(E)</enum><text>traffic control
			 for utility workers; and</text>
					</subparagraph><subparagraph id="HD863278D424B42F091AEB8AE8D850802"><enum>(F)</enum><text>traffic control
			 for other individuals for whom temporary traffic control may be an incidental
			 part of their employment duties.</text>
					</subparagraph></paragraph><paragraph id="HBC292A3799D241319E34A5B345A20A43"><enum>(2)</enum><text>Sponsorship of
			 demonstration projects to assess roadway work zone devices for disabled
			 pedestrians, in partnership with local governments, manufacturers, and disabled
			 users.</text>
				</paragraph></subsection><subsection id="HCF0A0AB2614D4498891931959CBBE1CE"><enum>(e)</enum><header>Authorization of
			 appropriations</header>
				<paragraph id="HB9E5117966A94799850C79335978C6F3"><enum>(1)</enum><header>In
			 general</header><text>There is authorized to be appropriated out of the Highway
			 Trust Fund (other than the Mass Transit Account) $2,750,000 to carry out this
			 section for each of fiscal years 2011 through 2016.</text>
				</paragraph><paragraph commented="no" id="HC9AE8B83737F44CD9FBB0D3FFB41C663"><enum>(2)</enum><header>Applicability of
			 title 23</header><text display-inline="yes-display-inline">Funds authorized to
			 be appropriated to carry out this section shall be available for obligation and
			 administered in the same manner as if such funds were appropriated under
			 chapter 1 of title 23, United States Code, except that such funds shall remain
			 available until expended and shall not be transferable.</text>
				</paragraph></subsection></section><section id="H78D44FA0C51740E9A8779A9FBBE4F128"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="HE9D129B2EB094507A34A8911E4F48A50"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means a
			 not-for-profit organization that has demonstrated experience in developing and
			 delivering roadway work zone safety training to roadway workers.</text>
			</paragraph><paragraph id="H3145DDB688114E6E841BBCB45369FA33"><enum>(2)</enum><header>Incident
			 responder</header><text>The term <term>incident responder</term> means an
			 individual whose job requires responding to surface transportation incidents,
			 including fire and emergency medical personnel and vehicle tow truck operators.</text>
			</paragraph><paragraph id="H7DCF47C9809247839D902C2B9A14231A"><enum>(3)</enum><header>Roadway
			 worker</header><text>The term <term>roadway worker</term> means an individual
			 whose job requires working on or near a roadway work zone, including incident
			 responders, law enforcement personnel, utility workers, and individuals
			 involved in guardrail installation, maintenance, and inspection.</text>
