		<section id="H053A946F59374FCC9D25D80FF281B3D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Inspector General Authority
			 Improvement Act of 2010</short-title></quote>.</text>
		</section><section id="H6433C5966FBD444BA0E6E14F480DAE40"><enum>2.</enum><header>Subpoena
			 authority for Inspectors General to require testimony of certain
			 persons</header><text display-inline="no-display-inline">Section 6 of the
			 Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text>
			<paragraph id="H5F8E305A2B534BEEB3C36B7C0298C408"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H4D7B568271354053B931F4FB4952F96F"><enum>(A)</enum><text>at the end of
			 paragraph (8), by striking <quote>and</quote>;</text>
				</subparagraph><subparagraph id="H139D7301D7DB458F89F50F6580C08C08"><enum>(B)</enum><text>at the end of
			 paragraph (9), by striking the period and inserting <quote>; and</quote>;
			 and</text>
				</subparagraph><subparagraph id="H456A806829FB4B5D8A47DC22F88A0CEF"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HC18F9C894450410BAB5CE60D2C3D58C8" style="OLC">
						<paragraph id="H37390229DCD44A42B74E50EFF4BBC752"><enum>(10)</enum><text display-inline="yes-display-inline">to require by subpoena the attendance and
				testimony of witnesses necessary in the performance of the functions assigned
				to the Inspector General by this Act, except as provided for and subject to the
				provisions in subsection (g).</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H04674F30442E44078BC3A1F93D5C8F86"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB29D5DCD98DE4D8CB7717F9CC92D114C" style="OLC">
					<subsection id="H2DC397DB07DD491CAD28F7C65D957A6B"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H914637096B0F42238B6C96FE524C38F4"><enum>(1)</enum><text display-inline="yes-display-inline">An Inspector General shall use procedures
				other than subpoenas to obtain attendance and testimony from Federal
				employees.</text>
						</paragraph><paragraph id="id09192B79475F4D87B6776E35CD45471A" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id46496B635EF145458BE3B10AB386D09C"><enum>(A)</enum><text display-inline="yes-display-inline">A subpoena issued under subsection (a)(10)
				shall provide reasonable notice to the individual whose testimony is sought and
				shall state the name of the individual and the place of taking the
				testimony.</text>
							</subparagraph><subparagraph id="idA7CFDFD063804B58A8499D877B2E811D" indent="up1"><enum>(B)</enum><text>Except as provided in subparagraph
				(C), a subpoena issued under subsection (a)(10), in the case of contumacy or
				refusal to obey, shall be enforceable in the United States District Court in
				the district where the individual whose testimony is sought by subpoena resides
				or in the district of the individual’s place of employment.</text>
							</subparagraph><subparagraph id="H06C6C00B408340BEAE00292DC75C1955" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A
				proceeding to enforce a subpoena may be brought in the United States District
				Court for the District of Columbia if the individual whose testimony is sought
				by the subpoena resides within 25 miles of the District of Columbia and if the
				complaint seeking enforcement alleges that a significant portion of the matters
				that are expected to be the subject of the investigation, audit, inspection,
				evaluation, or review occurred in the District of Columbia.</text>
							</subparagraph><subparagraph id="HCA02D2E51C724AD584EEF5DE7FD0AB0F" indent="up1"><enum>(D)</enum><text>The Attorney General shall represent
				an Office of Inspector General in the enforcement of a subpoena under this
				subsection.</text>
							</subparagraph></paragraph><paragraph id="id47D2213AFAA8401AB57F50EEFBA84FC8" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7098D91460E64358990FA13EE41BCD7C"><enum>(A)</enum><text>An Inspector General
				may not issue a subpoena under subsection (a)(10) if the subpoena is being
				issued in connection with a matter in which the Inspector General has
				reasonable grounds to believe there has been a violation of Federal criminal
				law or section 3729 of title 31, United States Code, unless the Inspector
				General notifies the Attorney General of the intention of the Inspector General
				to issue the subpoena, including the name of the individual whose testimony is
				sought and the nature of the testimony sought, at least 15 days before issuing
				the subpoena.</text>
							</subparagraph><subparagraph id="H7CBF950CE49D44E0A7008FCD6C9FFAC4" indent="up1"><enum>(B)</enum><text>The Inspector General may not issue
				the subpoena if the Attorney General informs the Inspector General, within 14
				days after receipt of the notification under subparagraph (A), that the
				Attorney General objects to the issuance of the subpoena on one or more of the
				grounds listed in clauses (i) through (iii) of subparagraph (C).</text>
							</subparagraph><subparagraph commented="no" id="H6EAD9060642A464C99811A4739539C69" indent="up1"><enum>(C)</enum><text>If the Attorney General objects to
				the issuance of the subpoena as described in subparagraph (B) and the Inspector
				General does not agree with the objection of the Attorney General, the Attorney
				General shall, within 30 days after receipt of the notification under
				subparagraph (A), submit an explanation to the Inspector General that the
				taking of the testimony—</text>
								<clause commented="no" id="H855AD7D9EFB24E808F85638B3A14D708"><enum>(i)</enum><text>is likely to endanger the national
				security of the United States;</text>
								</clause><clause commented="no" id="HC2CB5EE0CD59461FA81FA456BA97D330"><enum>(ii)</enum><text>is likely to interfere with any
				Federal or State criminal investigation or prosecution; or</text>
								</clause><clause commented="no" id="HA2C77ADBF2AD46888A0DB0A290FD5D50"><enum>(iii)</enum><text>is likely to interfere with any
				pending investigation under section 3729 of title 31, United States Code, or
				any civil litigation to which the United States is or is likely to be a
				party.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H07500ECC02BC45CBAADEF16239AFA6D5" section-type="subsequent-section"><enum>3.</enum><header>Investigations,
			 audits, inspections, evaluations, and reviews conducted by Inspectors
			 General</header><text display-inline="no-display-inline">Section 3518(c) of
			 title 44, United States Code, is amended—</text>
			<paragraph id="H702DA87F02904932A63939ED367E6D25"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>paragraph (2)</quote> and inserting <quote>paragraph (3)</quote>;</text>
			</paragraph><paragraph id="H78B7DAF56CDD4E5EA8857341483B5D7E"><enum>(2)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
			</paragraph><paragraph id="H10F7349303A644309DA54847310B577E"><enum>(3)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H3BFE97A2C06D4FA49CCB8510F3CBE5C7" style="OLC">
					<paragraph id="HF84943A5601E4E06AE17388AE8CD4FE6" indent="up1"><enum>(2)</enum><text>Notwithstanding paragraph (3), this
				subchapter shall not apply to the collection of information during the conduct
				of any investigation, audit, inspection, evaluation, or other review conducted
				by—</text>
						<subparagraph id="H4C45948874F44BE7A1903937C3F9E724"><enum>(A)</enum><text>any Federal office of Inspector
				General, including—</text>
							<clause id="H8B7671BF60CD4BF2983CD73DAC42F63D"><enum>(i)</enum><text>any office of Inspector General of
				any establishment, Federal entity, or designated Federal entity as those terms
				are defined under sections 12(2), 8G(a)(1), and 8G(a)(2) of the Inspector
				General Act of 1978 (5 U.S.C. App.), respectively; or</text>
							</clause><clause id="H29AD1558A36A489490A047179EC31FAE"><enum>(ii)</enum><text>any office of Special Inspector
				General established by statute;</text>
							</clause></subparagraph><subparagraph id="H2B117A80B9114FC39533B945DE21EFEE"><enum>(B)</enum><text>the Council of the Inspectors General
				on Integrity and Efficiency established under section 11 of the Inspector
				General Act of 1978 (5 U.S.C. App.); or</text>
						</subparagraph><subparagraph id="H7A256A7F20394AC98EFEE75D72750D58"><enum>(C)</enum><text>the Recovery Accountability and
				Transparency Board established under section 1521 of division A of the American
				Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat.
				289).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="H803CA91EF5754DEB8BBB92B862787300"><enum>4.</enum><header>Enhanced
			 Inspectors General Authority for Computer Matching</header><text display-inline="no-display-inline">Section
			 6(a) of the Inspector General Act of 1978 (5 U.S.C. App.), as amended by
			 section 2, is further amended—</text>
			<paragraph commented="no" id="H15AA0D7713B84DE89BAC3E5C83157458"><enum>(1)</enum><text>at the end of
			 paragraph (9), by striking <quote>and</quote>;</text>
			</paragraph><paragraph commented="no" id="H2651E1E0FA024BBD8FC45DE00F4079BC"><enum>(2)</enum><text>at the end of
			 paragraph (10), by striking the period and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph commented="no" id="H2FCD7695B0F44D3580EBF3998C1C3947"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HE9893CA2ED204E47AA105CF4569048CE" style="OLC">
					<paragraph commented="no" id="H19924BF340334599B3698D1A0B2D87C7"><enum>(11)</enum><text display-inline="yes-display-inline">notwithstanding subsections (o), (p), (q),
				(r), and (u) of section 552a of title 5, United States Code, to compare,
				through a matching program (as defined in such section), any Federal records
				with other Federal or non-Federal records while conducting an audit,
				inspection, or investigation authorized under this Act to identify weaknesses
				that make a program vulnerable to fraud, waste, or abuse and to detect improper
				payments and
				fraud.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" commented="no" committee-id="HGO00" display-inline="no-display-inline" id="H6903290CB41F44C687CB919C9DC28BD3" reported-display-style="strikethrough"><enum>5.</enum><header>Reports and
			 responses to identified problems, abuses, and deficiencies</header>
			<subsection commented="no" id="H2155113FEF474D8A927954DFDF0A7BD3"><enum>(a)</enum><header>Additional
			 requirements for the Inspector General report</header><text display-inline="yes-display-inline">Section 5(b) of the Inspector General Act
			 of 1978 (5 U.S.C. App.) is amended—</text>
				<paragraph commented="no" id="H5ED7C408D83746A1B43E5B9E769E1FB5"><enum>(1)</enum><text>by redesignating
			 paragraphs (2), (3), and (4) as paragraphs (4), (5), and (6), respectively;
			 and</text>
				</paragraph><paragraph commented="no" id="H5650C209BA6D4B518D2EE433B7E1538B"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>

						</paragraph><paragraph commented="no" id="H9B11911FCFD8443CAAC57D587D511EF1"><enum>(3)</enum><text>any certification
				required under subsection
				(e)(2);</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="HFC31A106EBED401D8768C176A48D6ADD"><enum>(b)</enum><header>Corrective
			 action</header><text display-inline="yes-display-inline">Section 5 of the
			 Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text>
				<paragraph commented="no" id="H26960E7C3FAA4DB2B975B7EBE83414A1"><enum>(1)</enum><text>by redesignating
			 subsections (e) and (f) as subsections (f) and (g), respectively; and</text>
				</paragraph><paragraph commented="no" id="H8C18B7EEC69A4784A1953DC0E7A49BA5"><enum>(2)</enum><text>by inserting after
			 subsection (d) the following new subsection:</text>

				use, significant problems, abuses, or deficiencies identified by the Inspector
				General of such establishment.</text>
							</paragraph><paragraph commented="no" id="H5F1F17580E3B4040A05241380227EE8F"><enum>(2)</enum><header>Certification to
				Congress</header><text display-inline="yes-display-inline">If the head of the
				establishment determines that no action is necessary or appropriate with
				respect to any questioned costs, a recommendation that funds be put to better
				use, significant problems, abuses, or deficiencies identified by the Inspector
				General of such establishment, such head shall submit a certification to
				Congress that no such action is necessary or
				appropriate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="added" committee-id="HGO00" id="H8CAFF2146B2947C3AABAB65C9F3A521B" reported-display-style="italic"><enum>5.</enum><header>Reports and responses to
			 identified problems, abuses, and deficiencies</header>

			 for the Inspector General report</header><text display-inline="yes-display-inline">Section 5(b) of the Inspector General Act
			 of 1978 (5 U.S.C. App.) is amended—</text>

				Congress</header><text display-inline="yes-display-inline">If the head of the
				establishment determines that no action is necessary or appropriate with
				respect to any questioned costs, a recommendation that funds be put to better
				use, or any significant problems, abuses, or deficiencies identified by the
				Inspector General of such establishment, such head shall submit a certification
				to Congress that no such action is necessary or appropriate, with a detailed
				explanation why no such action is necessary or
				appropriate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HA2F48C3E050D4359AFC7C8C5FEB602C6"><enum>6.</enum><header>Codification of
			 certain provisions of the Inspector General Reform Act of 2008 and other
			 technical amendments</header>
			<subsection id="H6630A680DB7245A7AF15BC1DDFE36547"><enum>(a)</enum><header>Inspectors
			 General of Designated Federal Entities</header>
				<paragraph id="H7A7D390437B241EFAEAFD23A24D29B90"><enum>(1)</enum><header>Amendment to the
			 Inspector General Act of <enum-in-header>1978</enum-in-header></header><text display-inline="yes-display-inline">Section 8G of the Inspector General Act of
			 1978 (5 U.S.C. App.) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H814EB50201774072BA79E69D18B4679D" style="OLC">
						<subsection id="H091A9973990E4A7685CC6F0CC25546F8"><enum>(i)</enum><header>Inspectors
				General of Designated Federal Entities</header>
							<paragraph id="H375963C526D8400FBD9727847818FA74"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, the Inspector General of each designated Federal entity
				shall, for pay and all other purposes, be classified at a grade, level, or rank
				designation, as the case may be, at or above those of a majority of the senior
				level executives of that designated Federal entity (such as a General Counsel,
				Chief Information Officer, Chief Financial Officer, Chief Human Capital
				Officer, or Chief Acquisition Officer). The pay of an Inspector General of a
				designated Federal entity shall be not less than the average total compensation
				(including bonuses) of the senior level executives of that designated Federal
				entity calculated on an annual basis.</text>
							</paragraph><paragraph id="H1657DDE87F804A078CB7035DD7587A70"><enum>(2)</enum><header>Limitation on
				adjustment</header>
								<subparagraph id="HB314069665DE400889EE83711CF16C27"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				Inspector General of a designated Federal entity whose pay is adjusted under
				paragraph (1), the total increase in pay in any fiscal year resulting from that
				adjustment may not exceed 25 percent of the average total compensation
				(including bonuses) of the Inspector General of that entity for the preceding 3
				fiscal years.</text>
								</subparagraph><subparagraph id="H791E36B2555C40FAB2A5287D5EAD44B7"><enum>(B)</enum><header>Sunset of
				limitation</header><text display-inline="yes-display-inline">The limitation
				under subparagraph (A) shall not apply to any adjustment made in fiscal year
				2013 or each fiscal year
				thereafter.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H12B449EB4C4B44D6A74B558DCF2E2750"><enum>(2)</enum><header>Conforming
			 repeal</header><text>Section 4(b) of the Inspector General Reform Act of 2008
			 (Public Law 110–409; 122 Stat. 4304; 5 U.S.C. App. 3 note) is repealed.</text>
				</paragraph></subsection><subsection id="H7438F7181BE74733BE4A199152854B47"><enum>(b)</enum><header>Pay
			 retention</header>
				<paragraph id="HE4AABA917CEE41589888E426CCEAD697"><enum>(1)</enum><header>Amendment to the
			 Inspector General Act of <enum-in-header>1978</enum-in-header></header><text display-inline="yes-display-inline">The Inspector General Act of 1978 (5 U.S.C.
			 App.) is amended by adding after section 8L the following new section:</text>

						<section id="H518753F6CC42453A9E5093DFC3EA43E1"><enum>8M.</enum><header>Pay
				Retention</header>
							<subsection id="HF7F1475255AA4096ADFE5CA4479B77AB"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The provisions of
				section 3392(c) of title 5, United States Code, other than the terms
				<term>performance awards</term> and <term>awarding of ranks</term> in paragraph
				(1) of such section, shall apply to career appointees of the Senior Executive
				Service who are appointed to the position of Inspector General on or after
				October 14, 2008.</text>
							</subsection><subsection id="HF152E9413E694A9193041D46D3E809D9"><enum>(b)</enum><header>Nonreduction in
				pay</header><text display-inline="yes-display-inline">Notwithstanding any other
				provision of law, career Federal employees serving on an appointment made
				pursuant to statutory authority found other than in section 3392 of title 5,
				United States Code, shall not suffer a reduction in pay, not including any
				bonus or performance award, as a result of being appointed to the position of
				Inspector
				General.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H06B0DA2263704C50B40C6811F6F4D3C6"><enum>(2)</enum><header>Conforming
			 repeal</header><text display-inline="yes-display-inline">Section 4(c) of the
			 Inspector General Reform Act of 2008 (Public Law 110–409; 122 Stat. 4304; 5
			 U.S.C. App. 3 note) is repealed.</text>
				</paragraph></subsection><subsection id="HA16F055BAE9D487C912208D948579532"><enum>(c)</enum><header>Allegations of
			 Wrongdoing against Special Counsel or Deputy Special Counsel</header>
				<paragraph id="H6963FBCA93154A338E6DE7F140C53773"><enum>(1)</enum><header>Amendment to the
			 Inspector General Act of <enum-in-header>1978</enum-in-header></header><text display-inline="yes-display-inline">Section 11(d) of the Inspector General Act
			 of 1978 (5 U.S.C. App.) is amended by adding at the end the following new
			 paragraph:</text>

						<paragraph id="H032CAC3B4984445E9E5487A0BD19B870"><enum>(12)</enum><header>Allegations of
				wrongdoing against Special Counsel or Deputy Special Counsel</header>
							<subparagraph id="H09D5181CF82C437A8161FA449DFCCCCF"><enum>(A)</enum><header>Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <term>Special
				Counsel</term> refers to the Special Counsel appointed under section 1211(b) of
				title 5, United States Code.</text>
							</subparagraph><subparagraph id="H32132CDE4DC148C3A3A2D094AF89186D"><enum>(B)</enum><header>Authority of
				Integrity Committee</header>
								<clause id="H007544DB89F84512A64025A84CA64520"><enum>(i)</enum><header>In
				general</header><text>An allegation of wrongdoing against the Special Counsel
				or the Deputy Special Counsel may be received, reviewed, and referred for
				investigation by the Integrity Committee to the same extent and in the same
				manner as in the case of an allegation against an Inspector General (or a
				member of the staff of an Office of Inspector General), subject to the
				requirement that the Special Counsel recuse himself or herself from the
				consideration of any allegation brought under this subparagraph.</text>
								</clause><clause id="HA2181D20FF2A4514BA42EC7BCEBC4760"><enum>(ii)</enum><header>Coordination
				with existing provisions of law</header><text display-inline="yes-display-inline">This paragraph does not eliminate access to
				the Merit Systems Protection Board for review under section 7701 of title 5,
				United States Code. To the extent that an allegation brought under this
				paragraph involves section 2302(b)(8) of that title, a failure to obtain
				corrective action within 120 days after the date on which that allegation is
				received by the Integrity Committee shall, for purposes of section 1221 of such
				title, be considered to satisfy section 1214(a)(3)(B) of that title.</text>
								</clause></subparagraph><subparagraph id="H5163EEDBF05D4181A874DCB34754D9AA"><enum>(C)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Integrity Committee may prescribe any
				rules or regulations necessary to carry out this paragraph, subject to such
				consultation or other requirements as might otherwise
				apply.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC680D0C29DC34C77BFD6979AC3488FA2"><enum>(2)</enum><header>Conforming
			 repeal</header><text>Section 7(b) of the Inspector General Reform Act of 2008
			 (Public Law 110–409; 122 Stat. 4312; 5 U.S.C. 1211 note) is repealed.</text>

			 amendments</header>

			 Act of 1978 (5 U.S.C. App.) is amended—</text>
