		  for small-duct high-velocity air conditioning and heat pump systems, and for
		  other purposes.</official-title>

		<section id="HF2E2A8422C6B4E20B54DF6C95FD0E5F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>SDHV Energy Efficiency Standards for
			 America Act of 2010</short-title></quote>.</text>
		</section><section id="H3DC19AFFB96F42D494CC5919B8CD62DF"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="HFD26642EAF2445299BC1694ACDFA381F"><enum>(1)</enum><text display-inline="yes-display-inline">The Department of Energy grouped small-duct
			 high-velocity systems with all air conditioners and heat pumps in a final rule
			 published on January 22, 2001.</text>
			</paragraph><paragraph id="H544C25ACC34E4A79B146268BBF593F52"><enum>(2)</enum><text display-inline="yes-display-inline">The Department of Energy subsequently
			 published and established the minimum efficiency standard for small-duct
			 high-velocity systems and informed all manufacturers of these products to
			 request exception relief in order to legally sell these products in the United
			 States.</text>
			</paragraph></section><section id="H4F38A0817BE14CB79073EA64A28C5E61"><enum>3.</enum><header>Standards for
			 small-duct high-velocity air conditioning and heat pump systems</header>
			<subsection id="HBC7A493F63FC4D88920CA665F30B9750"><enum>(a)</enum><header>Standards</header><text display-inline="yes-display-inline">Section 325(d) of the Energy Policy and
			 Conservation Act (42 U.S.C. 6295(d)) is amended—</text>
				<paragraph id="H5A115644CE714A69B425A8DC4C230405"><enum>(1)</enum><text>in paragraph (1),
			 by adding at the end the following:</text>
					<quoted-block id="H9C9C5573C7834EEA8D071F3EF382FA01" style="OLC">
						<subparagraph id="H87749782BF0E44ABB9338806D37D4797"><enum>(C)</enum><text>Small-duct
				high-velocity systems: 11.00 for products manufactured on or after January 23,
				2006.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2300AD808C18492190E7426C9C7767D1"><enum>(2)</enum><text>in paragraph (2),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF2319204F2A14B39A4BEAF8B5B2EFEC8" style="OLC">
						<subparagraph id="H10172D036E01412081E5E8F5119CA781"><enum>(C)</enum><text display-inline="yes-display-inline">Small-duct high-velocity systems: 6.8 for
				products manufactured on or after January 23,
				2006.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H055C6808332B4235B70867D9AF593333"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 321 of the Energy Policy and
			 Conservation Act (42 U.S.C. 6291) is amended by adding at the end the following
			 new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H0A49E0A7CF6041D7979B302D7CF09FCD" style="OLC">
					<paragraph id="HE2DC57FD5B7B49CD95FA554E945091A9"><enum>(67)</enum><header>Small-duct,
				high velocity system</header><text>The term <term>small-duct, high-velocity
				system</term> means a heating and cooling product that contains a blower and
				indoor coil combination that—</text>
						<subparagraph id="HF108B441FA5F41F8B3C30C2583582F5D"><enum>(A)</enum><text>is designed for,
				and produces, at least 1.2 inches of external static pressure when operated at
				the certified air volume rate of 220–350 cubic feet per minute per rated ton of
				cooling; and</text>
						</subparagraph><subparagraph id="H1E454F4DB334414986C44B30A5F062F0"><enum>(B)</enum><text display-inline="yes-display-inline">when applied in the field, uses high
				velocity room outlets generally greater than 1,000 feet per minute that have
				less than 6.0 square inches of free
				area.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFB294FA284C4443E9E7E91C97A13D72D"><enum>(c)</enum><header>Amendment of
			 standards</header>
				<paragraph id="H3FF2F5B6A2264E79B0C95214FC84F4A3"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may, by rule, amend the standards
			 established for small-duct high-velocity air conditioning and heat pump systems
			 under the amendments made by this section.</text>
				</paragraph><paragraph id="H33BE038560A34DE1B3C2F774525E3535"><enum>(2)</enum><header>Effective
			 date</header><text>Standards as amended pursuant to paragraph (1) shall not
			 take effect less than 5 years after the final rule making the amendment is
			 published.</text>
				</paragraph><paragraph id="H7833A0BF988A46C1BE7061EADC751E77"><enum>(3)</enum><header>Determination</header><text display-inline="yes-display-inline">Not later than June 30, 2011, the Secretary
			 shall publish a final rule to determine whether standards for small-duct,
			 high-velocity systems should be amended.</text>
				</paragraph></subsection></section><section id="HE776DB898D67432DA765FC8377B03F90"><enum>4.</enum><header>Credit for
			 nonbusiness small-duct, high-velocity air conditioning and heat pump
			 systems</header>
			<subsection id="H73633E36E7E4416BA1ED9BD7A685E111"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (3) of
			 section 25C(d) of the Internal Revenue Code of 1986 (relating to
			 energy-efficient building property) is amended by striking <quote>and</quote>
			 at the end of subparagraph (D), by striking the period at the end of
			 subparagraph (E) and inserting <quote>, and</quote>, and by adding at the end
			 the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H10E336E5C0594345B8982AE3FE63C98E" style="OLC">
					<subparagraph id="HED72527EED47431C8D1C4E2DF6504333"><enum>(F)</enum><text display-inline="yes-display-inline">a small-duct high-velocity central air
				conditioning and heat pump system which has—</text>
						<clause id="HD99F85D577D54B378C919E66AF9724E2"><enum>(i)</enum><text>a
				seasonal energy efficiency ratio of no less than 11.00,</text>
						</clause><clause id="H55FD4527D7B94C76934BE7261FAC7601"><enum>(ii)</enum><text>a
				heating seasonal performance factor of no less than 6.80, and</text>
						</clause><clause id="H02D53766BD00453FB75C410810E033D5"><enum>(iii)</enum><text>a duct system
				that has less than 5 percent air
				leakage.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFAAB8EFC6E4D45A28F913875F1AC41A3"><enum>(b)</enum><header>Small-Duct
			 high-Velocity central air conditioning and heat pump system</header><text display-inline="yes-display-inline">Subsection (d) of section 25C of such Code
			 is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HFA817D67011C456486648F6A85BA8F49" style="OLC">
					<paragraph id="H52FDA5FDA2024B709EAD1BBC0A755381"><enum>(7)</enum><header>Small-duct
				high-velocity central air conditioning and heat pump system</header><text display-inline="yes-display-inline">The term <term>small-duct high-velocity
				central air conditioning and heat pump system</term> means a heating and
				cooling product that contains a blower and indoor coil combination that—</text>
						<subparagraph id="HBFC8118D67DA4A8DA6DBC0A834F0155D"><enum>(A)</enum><text>is designed for,
				and produces, at least 1.2 inches of external static pressure when operated at
				the certified air volume rate of 220–350 cubic feet per minute per rated ton of
				cooling, and</text>
						</subparagraph><subparagraph id="H198B399956BC4880A5CF15B6AE5D884C"><enum>(B)</enum><text>when applied in
				the field, uses room outlets—</text>
							<clause id="H9FAE5183C81843CAAECB70DAABE5F3BA"><enum>(i)</enum><text>having a velocity
				which is generally greater than 1,000 feet per minute, and</text>
							</clause><clause id="HC686C3BDEB74480D922CA5EA80C4A3D1"><enum>(ii)</enum><text>having less than
				6 square inches of free
				area.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6B66B2F797544083A46397855E3F4E22"><enum>(c)</enum><header>Termination</header><text>Paragraph
			 (2) of section 25C(g) of such Code (relating to termination) is amended by
			 inserting <quote>(December 31, 2013, in the case of small-duct high-velocity
			 central air conditioning and heat pump systems)</quote> after <quote>December
			 31, 2010</quote>.</text>
			</subsection><subsection id="H58942981AB204BB5AC80DF8BC237D888"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to property
			 placed in service after the date of the enactment of this Act in taxable years
			 ending after such date.</text>
