		<section id="H075C122277A1428383A62EB9AB1FA98C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Renewable Fuels Marketing Act of
			 2010</short-title></quote>.</text>
		</section><section id="HEF7DF47F26F54E98AB91A8270306128F"><enum>2.</enum><header>Fuel
			 compatibility with infrastructure</header>
			<subsection id="HB97F61E67DA640ABB2805579AB804EEC"><enum>(a)</enum><header>Compatibility</header><text display-inline="yes-display-inline">Subtitle I of the Solid Waste Disposal Act
			 (42 U.S.C. 6991 et seq.) is amended as follows:</text>
				<paragraph id="H8C3C07CE69C94954B8F41FC56B0BD7C9"><enum>(1)</enum><text display-inline="yes-display-inline">By redesignating section 9014 as section
			 9015.</text>
				</paragraph><paragraph id="H8047D199F56A40D1A815B3B73FFA3512"><enum>(2)</enum><text display-inline="yes-display-inline">By inserting after section 9013 the
			 following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H79992EC780DC4C8FAFE826B83C64156F" style="OLC">
						<section id="H496860106CF44DE1B6CDB6E9C5AF1638"><enum>9014.</enum><header>Compatibility</header>
							<subsection id="H1C955CD8330740CB910AC8933B5338AB"><enum>(a)</enum><header>Compatibility
				with renewable fuels</header>
								<paragraph id="HE1DDCE85930541AEAB5911D1F6656DAD"><enum>(1)</enum><header>Guidelines</header><text>Not
				later than 1 year after the date of enactment of the Renewable Fuels Marketing
				Act of 2010, the Administrator shall issue guidelines for determining whether
				underground storage tanks and associated dispensing equipment are compatible
				with any fuel or fuel additive that is authorized by the Administrator or by
				statute for use in a motor vehicle, nonroad vehicle, or engine.</text>
								</paragraph><paragraph id="H6B743373F6424C2BAED7EBFA81560A16"><enum>(2)</enum><header>Application</header><text>Guidelines
				issued under this subsection shall apply with respect to existing underground
				storage tanks and associated dispensing equipment and with respect to new
				underground storage tanks and associated dispensing equipment.</text>
								</paragraph><paragraph id="HA988FE58795742758E1206D6202565C3"><enum>(3)</enum><header>Previously
				listed as compatible</header><text>Underground storage tanks and associated
				dispensing equipment that, as of the date of enactment of this section, have
				been listed by a nationally recognized testing laboratory as compatible with a
				fuel or fuel additive described in paragraph (1) shall be deemed compatible
				under the guidelines issued under this subsection.</text>
								</paragraph></subsection><subsection commented="no" id="HF38D12147089442D91644AC7AE9B73BC"><enum>(b)</enum><header>Liability</header><text display-inline="yes-display-inline">No person shall be liable under any
				provision of this Act or any other provision of Federal or State law on the
				basis that an underground storage tank or associated dispensing equipment that
				stores or dispenses any fuel or fuel additive described in subsection (a)(1) is
				not compatible with such fuel or fuel additive if such tank or equipment has
				been determined to be compatible with such fuel or fuel additive pursuant to
				the guidelines issued under such subsection.</text>
							</subsection><subsection id="HA3245D67A1EA45C9BB03689EF425CB36"><enum>(c)</enum><header>Financial
				assurance</header><text>A provider of financial assurance may not deny payment
				for a claim on the basis that an underground storage tank or associated
				dispensing equipment is not compatible with any fuel or fuel additive described
				in subsection (a)(1) if such tank or equipment is determined to be compatible
				with such fuel or fuel additive pursuant to the guidelines issued under such
				subsection.</text>
							</subsection><subsection id="HB2006C3FB5E3400386BC8B1BB9765ED5"><enum>(d)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="HC3012B8DC8C84D7CA2DCDD687169BB95"><enum>(1)</enum><header>Associated
				dispensing equipment</header><text display-inline="yes-display-inline">The term
				<term>associated dispensing equipment</term> means equipment that is—</text>
									<subparagraph id="H04E77B1D5E2246AE9B3F61F4AF5909AF"><enum>(A)</enum><text>for the dispensing
				or storage at retail of any fuel or fuel additive described in subsection
				(a)(1); and</text>
									</subparagraph><subparagraph id="HCFFF82AA35444D8C90B5C29117240D4D"><enum>(B)</enum><text>subject to
				regulation under section 1926.152 of title 29, Code of Federal Regulations, as
				in effect on the date of enactment of the Renewable Fuels Marketing Act of
				2010.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H79EF6C66194F43D9B4010158DC1C96AC"><enum>(2)</enum><header>Compatible</header><text display-inline="yes-display-inline">The term <term>compatible</term> has the
				meaning given such term in section 280.12 of title 40, Code of Federal
				Regulations, as in effect on the date of enactment of the Renewable Fuels
				Marketing Act of 2010.</text>
								</paragraph><paragraph id="H9B9F912FA1A144888BAC4268015EFB3C"><enum>(3)</enum><header>Provider of
				financial assurance</header><text display-inline="yes-display-inline">The term
				<term>provider of financial assurance</term> has the meaning given such term in
				section 280.92 of title 40, Code of Federal Regulations, as in effect on the
				date of enactment of the Renewable Fuels Marketing Act of 2010.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF6A4E8FB1D464EDB92163BD0723772C2"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents in section 1001 of the Solid Waste
			 Disposal Act (42 U.S.C. 6901) is amended by striking the item related to
			 section 9014 and inserting the following:</text>

			</subsection></section><section id="HD66969105501419797E70048C8FDDD0C"><enum>3.</enum><header>Misfueling</header>
			<subsection id="HCF5A9539E5334ECEBC3964A0C6A23D87"><enum>(a)</enum><header>Misfueling</header><text display-inline="yes-display-inline">Section 211(g) of the Clean Air Act (42
			 U.S.C. 7545(g)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HDC7A5B7C2F7E405BABE94A02B66D2244" style="OLC">
					<paragraph id="HDD75D65D8DB447C9BE40D73CEFBA15AD" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2A088A1671F344DE9282ADA27898DB1F"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than one year after the date of
				enactment of the Renewable Fuels Marketing Act of 2010, the Administrator shall
				promulgate regulations that set forth requirements for the labeling of
				associated dispensing equipment as the Administrator determines necessary to
				prevent the introduction of any transportation fuel described in subparagraph
				(C) into a motor vehicle, nonroad vehicle, or engine that is not compatible
				with such transportation fuel.</text>
						</subparagraph><subparagraph commented="no" id="H6E125C900ECE440D985583C9AF006D0F" indent="up1"><enum>(B)</enum><text>A person selling a transportation
				fuel described in subparagraph (C) who complies with the regulations under
				subparagraph (A) shall not be liable, under any provision of this Act or any
				other provision of Federal or State law, for—</text>
							<clause id="H648CCD4EF9DB45A4A966F1B11D836DE1"><enum>(i)</enum><text>a self-service purchaser’s
				introduction of such a transportation fuel into a motor vehicle, nonroad
				vehicle, or engine that is not compatible with such transportation fuel;
				or</text>
							</clause><clause id="HCE2D65E99EDD4E5BB1090C5D15B4DFAB"><enum>(ii)</enum><text>the voiding of the manufacturer’s
				warranty of such a vehicle or engine from such introduction of such a
				transportation fuel.</text>
							</clause></subparagraph><subparagraph id="H8F98F8DC72E347F29CBCB605BD0910B7" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A
				transportation fuel described in this subparagraph is a fuel that contains a
				fuel or fuel additive that is authorized, after January 1, 2010, by the
				Administrator or by statute, for use in a motor vehicle, nonroad vehicle, or
				engine.</text>
						</subparagraph><subparagraph id="H8B59A498D6A34D96A132396CF037A728" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">In this paragraph the term <term>associated
				dispensing equipment</term> has the meaning given such term in section 9014(d)
				of the Solid Waste Disposal
				Act.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H86E3A11425214EC29A4AA7216CC6E9A4"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 211(d) of the Clean Air Act (42
			 U.S.C. 7545(d)) is amended—</text>
				<paragraph id="HB8D646357A754601AC9521D7E6FD9FAA"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>(g), </quote> after <quote>or the regulations prescribed
			 under subsection (c),</quote>; and</text>
				</paragraph><paragraph id="H688F84106F3D4E5FB38B419490055C1A"><enum>(2)</enum><text>in paragraph (2),
			 by inserting <quote>(g),</quote> after <quote>of the regulations prescribed
			 under subsections (c),</quote>.</text>
