		<section id="HC9DFEC6EC7F54204BA74E3563F2FD1C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Grant Accessibility and Transparency
			 Enhancement Act of 2010</short-title></quote>.</text>
		</section><section id="HA52E22F3B90A4C42A874E5EC73C37FD8" section-type="subsequent-section"><enum>2.</enum><header>National Commission on
			 Earmark Reform</header>
			<subsection id="H5B98537B8DC8482A8D5A425A8EF4DA4B"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President shall establish a commission
			 to be known as the <quote>National Commission on Earmark Reform</quote> (in
			 this section referred to as the <term>Commission</term>.</text>
			</subsection><subsection id="H85400128406342B3B82EA803AA0ED08B"><enum>(b)</enum><header>Duties of
			 Commission</header><text>The duties of the Commission are—</text>
				<paragraph id="H34DC6243B5A24C2DBDD210C8A334B734"><enum>(1)</enum><text display-inline="yes-display-inline">to study the laws and practices related to
			 replacing earmarks with a full grant-making process; and</text>
				</paragraph><paragraph id="H1F9570887BFD4BD297EF059EC7A525B6"><enum>(2)</enum><text>to develop a
			 proposed plan that includes objectives, priorities, policies, and long-term
			 plans to transition from congressional member-directed earmarks to a
			 grant-making process.</text>
				</paragraph></subsection><subsection id="H460B5D193774425EA59BE0E307A50041"><enum>(c)</enum><header>Membership</header><text>The
			 Commission shall be composed of—</text>
				<paragraph id="HD2E25BDC8489436891F8148F7EE88177"><enum>(1)</enum><text>the Director of
			 the Office of Management and Budget, who shall be the chairman of the
			 Commission; and</text>
				</paragraph><paragraph id="H2280755F051A479AA2EB559C8D6DAEC0"><enum>(2)</enum><text>such other members
			 as the President may appoint, after consultation with the majority and minority
			 leadership of the Senate and the House of Representatives.</text>
				</paragraph></subsection><subsection id="H2D39B90AFB5249EDB5D88F824AC44C27"><enum>(d)</enum><header>Expert grant
			 award panels</header><text display-inline="yes-display-inline">In carrying out
			 its duties, the Commission shall propose legislative or regulatory changes to
			 implement a grant-making application and review process modeled after the
			 Assistance to Firefighters Grant Program of the Federal Emergency Management
			 Agency, under which a panel of subject area experts (including representatives
			 of the Federal agency with appropriate jurisdiction) receives, reviews, and
			 awards grant funding on a merit-based system. At a minimum, the Commission
			 shall propose changes that establish rules for—</text>
				<paragraph id="HE2E20A8372094BD68464704DAAFAA7AA"><enum>(1)</enum><text display-inline="yes-display-inline">the review and reporting of grant
			 applications and awards;</text>
				</paragraph><paragraph id="H364F42253F1E4F239AA5DBF9E58D9731"><enum>(2)</enum><text>hardship
			 exemptions from specific reporting or application requirements; and</text>
				</paragraph><paragraph id="HAE29DA50C2DA43039BA81A36292B2409"><enum>(3)</enum><text>recommended
			 changes in law to support the implementation of expert grant award
			 panels.</text>
				</paragraph></subsection><subsection id="H1AB03C943FE64CFB820C4DB3DDD6E9DC"><enum>(e)</enum><header>Consolidation
			 and streamlining of grants management structure</header><text display-inline="yes-display-inline">In carrying out its duties, the Commission
			 shall propose legislative or regulatory changes to implement a specific
			 governance structure for all grant functions, including grants management,
			 within the Federal Government. At a minimum, the Commission shall propose
			 changes for ensuring that the activities at Grants.gov and the policy
			 recommendations of the Grants Policy Committee (of the Chief Financial Officers
			 Council) are connected, by proposing the establishment of an Office of Grant
			 Making within the Office of Management and Budget to cover all grants activity
			 of the Federal Government, including the management of Grants.gov. The
			 Commission shall include, at a minimum, in its recommendations regarding the
			 Office of Grant Making, the following:</text>
				<paragraph id="HAC2B3921B0224555AA3115248C177DBC"><enum>(1)</enum><text display-inline="yes-display-inline">The Office should have an advisory
			 committee that includes representation from elected local, State, Federal and
			 tribal governments, institutions of higher education, vendors, and
			 non-profits.</text>
				</paragraph><paragraph id="HC61FE8B82E36414999DEB73106150CA0"><enum>(2)</enum><text>The meetings of
			 the advisory committee should be conducted in an open and transparent
			 way.</text>
				</paragraph><paragraph id="H179D0EED87504DCC93ED3B5ACB8B6AA1"><enum>(3)</enum><text>The Office should
			 review all grant programs, including the implementation of the expert grant
			 award panels, and ensure the consistency of audits of grant programs.</text>
				</paragraph></subsection><subsection id="H5B397E5AB8DB40EBA8CDE9E887EF2A5C"><enum>(f)</enum><header>Involvement of
			 stakeholders</header><text>In carrying out its duties, the Commission shall
			 propose legislative or regulatory changes to involve non-Federal participants
			 in the grant-making process, including involvement through—</text>
				<paragraph id="H8FEEB867FE9F43D9BEF8DE2ACA75AF78"><enum>(1)</enum><text display-inline="yes-display-inline">consultation with representatives of
			 elected local, State, and tribal governments, institutions of higher education,
			 vendors, non-profits, and other non-Federal participants as early as possible
			 to get their input on any effort by the Federal Government to change or improve
			 proposed grant products, including new forms and formats, and or to change or
			 improve the tracking and reporting of Federal fund data; and</text>
				</paragraph><paragraph id="H4C805586075E47A4A02D4EC435047C84"><enum>(2)</enum><text>participation and
			 collaboration in the development of a training and certification program for
			 grants management professionals.</text>
				</paragraph></subsection><subsection id="H870DA3474FDE4E40A4B104F7F05474B7"><enum>(g)</enum><header>Operations of
			 Commission</header><text>In carrying out its duties, the Commission
			 shall—</text>
				<paragraph id="H4057304E85B04B7BB71194CF09D0674C"><enum>(1)</enum><text>operate a publicly
			 accessible Web site and make available information about the Commission,
			 including its membership and the report required under subsection (h);</text>
				</paragraph><paragraph id="H2422366F23EA4183A46A67890F8C1EEF"><enum>(2)</enum><text>hold 8 public
			 hearings before publication of the report required under subsection (h);
			 and</text>
				</paragraph><paragraph id="HB3C4D80D25514FC9B1739DAFBEC96DD9"><enum>(3)</enum><text>provide for a
			 period of 45 days immediately before publication of the report required under
			 subsection (h) for submission of comments and recommendations from private and
			 public groups and individuals.</text>
				</paragraph></subsection><subsection id="H39D647B5C5414E118072E92AE7DD01E3"><enum>(h)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Commission
			 shall—</text>
				<paragraph id="H176547BA9EEE49A1811372843CAFF885"><enum>(1)</enum><text>submit to Congress
			 a report containing the plan developed under subsection (b) and its findings
			 and recommendations; and</text>
				</paragraph><paragraph id="H14A0C98CACE24A92B6F09A1C18612199"><enum>(2)</enum><text>publish the report
			 on the Commission’s publicly accessible Web site.</text>
				</paragraph></subsection><subsection id="H708D0BACC254437F8C19C27793D596C4"><enum>(i)</enum><header>Appropriations</header><text>There
			 is authorized to be appropriated $1,000,000 for the Commission to carry out
			 this section.</text>
			</subsection></section><section display-inline="no-display-inline" id="HC477B0D1D60044388D9F3AB08BD9DE86" section-type="subsequent-section"><enum>3.</enum><header>Office of Grant
			 Making</header>
			<subsection id="HDEABFA77355848DEA46517B2B8EA1799"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 30 days after the publication of the Commission report under section
			 2(h), the Director of the Office of Management and Budget shall establish an
			 office within the Office of Management and Budget to be known as the
			 <quote>Office of Grant Making</quote> (in this section referred to as the
			 <term>Office</term>).</text>
			</subsection><subsection id="H6A7DD6794DF64E1B8834CAE47D69CD20"><enum>(b)</enum><header>Director</header><text>The
			 Office shall be overseen by a Director, who shall be designated from among
			 Federal officers and employees by the Director of the Office of Management and
			 Budget.</text>
			</subsection><subsection id="H5C15C06012CD4FEDAA9BEAC8708F6282"><enum>(c)</enum><header>Functions</header>
				<paragraph id="H4AFCF353E0CA4B43943340567C4DADF9"><enum>(1)</enum><header>In
			 general</header><text>The Office and Director shall—</text>
					<subparagraph id="H608DF64CE3D44165B510C2175DAF570C"><enum>(A)</enum><text>in consultation
			 with agency heads, representatives of local, State and Federal Government, and
			 other non-Federal entities, direct and coordinate the development of the expert
			 grant award panels (referred to in section 2) and the specific recommendations
			 of the National Commission on Earmark Reform; and</text>
					</subparagraph><subparagraph id="HF2EAC7D4CDD04921A08F8989093DF7C5"><enum>(B)</enum><text>be responsible for
			 maintaining Grants.gov, in accordance with section 5.</text>
					</subparagraph></paragraph><paragraph id="H0DE056FE33514AB3B744E15E6DE9C7D6"><enum>(2)</enum><header>Additional
			 responsibilities</header><text>The Director shall also support Federal agencies
			 in establishing—</text>
					<subparagraph id="H15191D1EA2CC4D4CB14CDED8363FF685"><enum>(A)</enum><text>a common grant
			 application and reporting system; and</text>
					</subparagraph><subparagraph id="H37BFE6321AE743A7B176B4F70E052992"><enum>(B)</enum><text>an interagency
			 process for addressing the following:</text>
						<clause id="H9A26C919D67541408E0AE57657A85958"><enum>(i)</enum><text>Ways
			 to streamline and simplify Federal grant administrative procedures and
			 reporting requirements for non-Federal entities.</text>
						</clause><clause id="H3BF45BEC2459461DBBBC86C1917BB73F"><enum>(ii)</enum><text>Improved
			 interagency and intergovernmental coordination of information collection and
			 sharing of data pertaining to Federal grants.</text>
						</clause><clause id="H77C05934F6A147F38E26A659E6069BCA"><enum>(iii)</enum><text>Improvements in
			 the timeliness, completeness, and quality of information received by Federal
			 agencies from recipients of Federal grants.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H6BC0F39E2BA142FF937F7357D9C446C1"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated $30,000,000
			 for fiscal years 2011 through 2013 for purposes of establishing and operating
			 the Office.</text>
			</subsection></section><section id="HB52509CB5B8D49D8B64D940806303611"><enum>4.</enum><header>Streamlining of
			 role of Federal agencies in grant making process</header>
			<subsection id="H5F9CECEC085C4BFCB3791DF46CE82E9F"><enum>(a)</enum><header>Requirement for
			 plan</header><text>Not later than 180 days after the date of the enactment of
			 this Act, each Federal agency shall develop and implement a plan that—</text>
				<paragraph id="H5FC4483EFC1D4C59A236DBAF0717CD89"><enum>(1)</enum><text>streamlines and
			 simplifies the application, administrative, and reporting procedures for
			 Federal grants administered by the agency;</text>
				</paragraph><paragraph id="HF43AD4C67AB442A9AAAE0FE536A9EF78"><enum>(2)</enum><text>demonstrates a
			 process to actively participate in the expert grants awards panels referred to
			 in section 2;</text>
				</paragraph><paragraph id="H57D52EBA2755451FA6407F5637DF0A6F"><enum>(3)</enum><text>demonstrates
			 appropriate agency use, or plans for use, of a common grant application and
			 reporting system;</text>
				</paragraph><paragraph id="H4C7D45E5871847B0B33731E75D23BCB3"><enum>(4)</enum><text>designates a lead
			 agency official for carrying out the responsibilities of the agency under this
			 Act;</text>
				</paragraph><paragraph id="HCC920B2222DE469D8E449202B3A048F8"><enum>(5)</enum><text>allows grant
			 applicants to electronically apply for, and report on the use of funds from,
			 the Federal grants administered by the agency;</text>
				</paragraph><paragraph id="H328204CCBF134C94A674B6AC62135078"><enum>(6)</enum><text>ensures recipients
			 of Federal grants provide timely, complete, and high-quality information in
			 response to Federal reporting requirements; and</text>
				</paragraph><paragraph id="HC7A6173FB0FB47519B6BF808109D75F9"><enum>(7)</enum><text>in cooperation
			 with recipients of Federal grants, establishes specific annual goals and
			 objectives to further the purposes of this Act and measures annual performance
			 in achieving those goals and objectives.</text>
				</paragraph></subsection><subsection id="H2B7D2B9B41F8467E9BD2CF0E6437CA13"><enum>(b)</enum><header>Extension</header><text>If
			 a Federal agency is unable to comply with subsection (a), the Director of the
			 Office of Management and Budget may extend for up to 30 days the period for the
			 agency to develop and implement a plan.</text>
			</subsection><subsection id="H33FADA5AB30B485CA3C154DA4C74D34F"><enum>(c)</enum><header>Comment and
			 consultation on agency plans</header>
				<paragraph id="H85DCBEEA3FA14F16B1A6C701C373204B"><enum>(1)</enum><header>Comment</header><text>Each
			 agency shall publish the plan developed under this section in the Federal
			 Register and receive public comment on the plan through the Federal Register
			 and other means (including electronic means). To the maximum extent
			 practicable, each Federal agency shall hold public forums on the plan.</text>
				</paragraph><paragraph id="H0786443618A7461E90B5FEC3F5C0129C"><enum>(2)</enum><header>Consultation</header><text>The
			 lead official designated by each Agency shall consult with representatives of
			 State, local, and tribal governments, and other non-Federal entities, during
			 development and implementation of the plan.</text>
				</paragraph></subsection><subsection id="HFE0E86C1D3E640608B67D8CFF5C3488A"><enum>(d)</enum><header>Submission of
			 Plan</header><text>Each Federal agency shall submit the plan developed under
			 this section to the Director of the Office of Grant Making and Congress and
			 report annually thereafter on the implementation of the plan and performance of
			 the agency in meeting the requirements for the plan specified in subsection
			 (a).</text>
			</subsection></section><section id="H7FEA5189C0D4415F870CCEFD8CF380AA"><enum>5.</enum><header>Expansion of the
			 use and functionality of Grants.gov</header>
			<subsection id="HBE33A7546221408488E0A96C5984145C"><enum>(a)</enum><header>Transfer to
			 Office of Grant Making</header><text display-inline="yes-display-inline">The
			 Director of the Office of Grant Making shall be responsible for maintaining
			 Grants.gov.</text>
			</subsection><subsection id="H823657A4F3C14D8FA49DF5D18191852B"><enum>(b)</enum><header>Requirement To
			 post all grants</header><text>All Federal grants, both formula and
			 discretionary, from all grant-making agencies shall be posted on
			 Grants.gov.</text>
			</subsection><subsection id="HDF23DFA0DFEF4A1EA6633B543011BE76"><enum>(c)</enum><header>Duplicative hard
			 copy applications not required</header><text>Grant applications in hard copy
			 that are duplicative of applications submitted electronically shall not be
			 required from grant applicants.</text>
			</subsection><subsection id="H27E8FC1539614A30BCEB3D40BD0092DE"><enum>(d)</enum><header>Expansion of
			 functionality</header><text>The Director of the Office of Grant Making shall
			 ensure that Grants.gov is able to handle the following functions:</text>
				<paragraph id="H38D2BE940E004DE0A8301781D1640E24"><enum>(1)</enum><text>Finding
			 grants.</text>
				</paragraph><paragraph id="H3636E1453A7E418E9BF9AF59C173DF5B"><enum>(2)</enum><text>Applying for
			 grants.</text>
				</paragraph><paragraph id="HDF2744256AF44849A36B173CC6FA1D03"><enum>(3)</enum><text>Submitting and
			 receiving grant applications.</text>
				</paragraph><paragraph id="HCEBBBDB5A8C848288AE3F40645A482F8"><enum>(4)</enum><text>Sending grant
			 award notifications and other documents.</text>
				</paragraph><paragraph id="HC430ED0424AB408B95363CC5133231FC"><enum>(5)</enum><text>Submitting and
			 receiving post-grant-award management reports.</text>
				</paragraph><paragraph id="H032B9BCBAF35479FA36B23D139196A07"><enum>(6)</enum><text>Closeout tools
			 related to grants.</text>
				</paragraph><paragraph id="H8BB2BC811B17429EAC039BA24049C1A0"><enum>(7)</enum><text>Grant award
			 tracking.</text>
				</paragraph><paragraph id="HFCEB361C50ED4F7C90B9796D920C6F9D"><enum>(8)</enum><text>Training and
			 technical assistance, as described in subsection (f).</text>
				</paragraph></subsection><subsection id="H3FC2B31B96BA4EA0B521B4BFBA51F198"><enum>(e)</enum><header>Avoidance of
			 duplication with USASpending.gov</header><text>The Director of the Office of
			 Grant Making shall ensure that duplication of effort and dual systems related
			 to online Federal grant activity are no longer in effect by merging
			 USASpending.gov into Grants.gov. Other Federal agencies shall cooperate to the
			 extent necessary to assist the Director in carrying out this subsection.</text>
			</subsection><subsection id="H53B39E256B51461C827DAD0ABBB30BE5"><enum>(f)</enum><header>Training and
			 other technical assistance</header><text display-inline="yes-display-inline">The Director shall ensure that Grants.gov
			 includes technical assistance information and resources, including—</text>
				<paragraph id="HBF5CF7FFE63C43FD90810B85CB531BEB"><enum>(1)</enum><text>online or recorded
			 training sessions conducted by other Federal agencies;</text>
				</paragraph><paragraph id="HA7CD9092241D4BB5A8C7CBAE06EF313D"><enum>(2)</enum><text>online or recorded
			 training sessions on how to use Grants.gov; and</text>
				</paragraph><paragraph id="H34374A5D2DDA47259BD8B7F9DF336A94"><enum>(3)</enum><text>such other
			 technical assistance as the Director considers appropriate.</text>
				</paragraph></subsection></section><section id="H87F9B29B108F428EA14772319435720B" section-type="subsequent-section"><enum>6.</enum><header>Ending congressional
			 earmarks, limited tax benefits, and limited tariff benefits</header>
			<subsection id="HCB37B0A7FD1B476F81270FFCD3F364F6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 312 of the
			 Congressional Budget Act of 1974 is amended by adding at the end the following
			 new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H56183B3AA2934415A95E561D4DB4162B" style="OLC">
					<subsection id="H8FF0E536EEAA4E109D903F0696D03ECF"><enum>(g)</enum><header>Prohibition on
				congressional earmarks, limited tax benefits, and limited tariff
				benefits</header><paragraph commented="no" display-inline="yes-display-inline" id="HBE12FA42C03044DBB5E69F06A70C1158"><enum>(1)</enum><text display-inline="yes-display-inline">It shall not be in order in the House of
				Representatives or the Senate to consider any bill or joint resolution, or
				amendment thereto or conference report thereon, if it or any accompanying
				report contains any congressional earmark, limited tax benefit, or limited
				tariff benefit.</text>
						</paragraph><paragraph id="H3EDA73F12F7D4B3E9625504BD0BEF738" indent="up1"><enum>(2)</enum><text>As used in this subsection, the terms
				<term>congressional earmark</term>, <term>limited tax benefit</term>, and
				<term>limited tariff benefit</term> have the meanings given to such terms in
				clause 9 of rule XXI of the Rules of the House of
				Representatives.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE44326AB40D84CD2A4D74DD7472C8D1A"><enum>(b)</enum><header>Super majority
			 in the Senate</header><text display-inline="yes-display-inline">Subsections
			 (c)(1) and (d)(2) of section 904 of the Congressional Budget Act of 1974 are
			 each amended by inserting <quote>312(g),</quote> after
			 <quote>310(d)(2),</quote>.</text>
			</subsection><subsection id="HA2845F783DF24C3E86DDD82309CEF860"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsections (a) and (b) shall take effect 1 year after the date of the
			 enactment of this Act.</text>
