		<official-title>Making supplemental appropriations for the fiscal year
		  ending September 30, 2010, and for other purposes.</official-title>

		</section><section display-inline="yes-display-inline" id="HC0345304C0EB4864BB51685D05D3FB1B" section-type="undesignated-section"><text>the following sums are appropriated,
			 out of any money in the Treasury not otherwise appropriated, for the fiscal
			 year ending September 30, 2010, and for other purposes, namely:</text>
		</section><title id="H849B8A1C2C964F1E8AE9C7FB0CDEDF66"><enum>I</enum>
			<chapter id="HA2767489CBCF4D3B92AB62E68B240A4B"><enum>1</enum>
				<appropriations-major id="H938A6EC47E4C4517AC962228660900BA"><header>DEPARTMENT OF
		  AGRICULTURE</header>
				</appropriations-major><appropriations-intermediate id="H23D1C618E3664CE1B0D35B8604E23546"><header>Farm Service
		  Agency</header>
				</appropriations-intermediate><appropriations-small id="H53E6B523D26C4414ABC2C01FDB1C3EFC"><header>Agricultural credit insurance
		  fund program account</header><text display-inline="no-display-inline">For an
		  additional amount for gross obligations for the principal amount of direct and
		  guaranteed farm ownership (7 U.S.C. 1922 et seq.) and operating (7 U.S.C. 1941
		  et seq.) loans, to be available from funds in the Agricultural Credit Insurance
		  Fund, as follows: guaranteed farm ownership loans, $300,000,000; operating
		  loans, $650,000,000, of which $250,000,000 shall be for unsubsidized guaranteed
		  loans, $50,000,000 shall be for subsidized guaranteed loans, and $350,000,000
		  shall be for direct loans.</text><text display-inline="no-display-inline">For
		  an additional amount for the cost of direct and guaranteed loans, including the
		  cost of modifying loans as defined in section 502 of the Congressional Budget
		  Act of 1974, as follows: guaranteed farm ownership loans, $1,110,000; operating
		  loans, $29,470,000, of which $5,850,000 shall be for unsubsidized guaranteed
		  loans, $7,030,000 shall be for subsidized guaranteed loans, and $16,590,000
		  shall be for direct loans.</text><text display-inline="no-display-inline">For
		  an additional amount for administrative expenses necessary to carry out the
		  direct and guaranteed loan programs, $1,000,000.</text>
				</appropriations-small><appropriations-intermediate id="HD4CADA9E47574FB5BCECFF2E174757AD"><header>Emergency Forest Restoration
		  Program</header><text display-inline="no-display-inline">For implementation of
		  the emergency forest restoration program established under section 407 of the
		  Agricultural Credit Act of 1978 (16 U.S.C. 2206) for expenses resulting from
		  natural disasters that occurred on or after January 1, 2010, and for other
		  purposes, $18,000,000, to remain available until expended: 
		  <proviso><italic>Provided,</italic></proviso> That the program: (1)
		  shall be carried out without regard to chapter 35 of title 44, United States
		  Code (commonly known as the <quote>Paperwork Reduction Act</quote>) and the
		  Statement of Policy of the Secretary of Agriculture effective July 24, 1971 (36
		  Fed. Reg. 13804), relating to notices of proposed rulemaking and public
		  participation in rulemaking; and (2) with rules issued without a prior
		  opportunity for notice and comment except, as determined to be appropriate by
		  the Farm Service Agency, rules may be promulgated by an interim rule effective
		  on publication with an opportunity for notice and comment: 
		  <proviso><italic>Provided further,</italic></proviso> That in carrying
		  out this program, the Secretary shall use the authority provided under section
		  808(2) of title 5, United States Code: 
		  <proviso><italic>Provided further,</italic></proviso> That to reduce
		  Federal costs in administering this heading, the emergency forest restoration
		  program shall be considered to have met the requirements of the National
		  Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) for activities
		  similar in nature and quantity to those of the emergency conservation program
		  established under title IV of the Agricultural Credit Act of 1978 (16 U.S.C.
		  2201 et seq.).</text>
				</appropriations-intermediate><appropriations-intermediate id="HE061ED6A2B8E4B439FE8180CA7877559"><header>Foreign Agricultural
		  Service</header>
				</appropriations-intermediate><appropriations-small id="H2BF5C068123B45B7BF7217DF74D6B540"><header>Food for
		  Peace Title II Grants</header>
				</appropriations-small><appropriations-intermediate id="H768015240B1E4D2BB59B59EBD9D3A25D"><text display-inline="no-display-inline">For an additional amount for <quote>Food for
		  Peace Title II Grants</quote> for emergency relief and rehabilitation, and
		  other expenses related to Haiti following the earthquake of January 12, 2010,
		  and for other disaster-response activities relating to the earthquake,
		  $150,000,000, to remain available until
		  expended.</text>
				</appropriations-intermediate><appropriations-major id="HEEDD9254201B4222A65BBCD697A8EBED"><header>GENERAL
		  PROVISIONS—THIS CHAPTER</header>
				</appropriations-major><section id="HC77934C0CE0C4A65B724D7AC978B3018" section-type="subsequent-section"><enum>101.</enum><text display-inline="yes-display-inline">None of the funds appropriated or made
			 available by this or any other Act shall be used to pay the salaries and
			 expenses of personnel to carry out a biomass crop assistance program as
			 authorized by section 9011 of Public Law 107–171 in excess of $552,000,000 in
			 fiscal year 2010 or $432,000,000 in fiscal year 2011: 
			 <proviso><italic>Provided</italic></proviso>, That section 3002 shall
			 not apply to the amount under this section.</text>
				</section><section id="HC685F14282334927872D5C020507BE56"><enum>102.</enum><subsection commented="no" display-inline="yes-display-inline" id="HA62A7058930C498DAF604121F0AE5E28"><enum>(a)</enum><text display-inline="yes-display-inline">Section 502(h)(8) of the Housing Act of
			 1949 (42 U.S.C. 1472(h)(8)) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H8E22CE7607DF43EE8E2FAFBC106DBFE6" style="appropriations">
							<paragraph id="H6013E0BBD57A44279938F5AB1643DBC0"><enum>(8)</enum><header>Fees</header><text display-inline="yes-display-inline">Notwithstanding paragraph (14)(D), with
				respect to a guaranteed loan issued or modified under this subsection, the
				Secretary may collect from the lender—</text>
								<subparagraph id="HD09F81D9D0504493842B47F84C1D8338"><enum>(A)</enum><text display-inline="yes-display-inline">at the time of issuance of the guarantee or
				modification, a fee not to exceed 3.5 percent of the principal obligation of
				the loan; and</text>
								</subparagraph><subparagraph id="HBEC23DB60F3843FCA59CEE31AD3CCE62"><enum>(B)</enum><text display-inline="yes-display-inline">an annual fee not to exceed 0.5 percent of
				the outstanding principal balance of the loan for the life of the
				loan.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HD41F1854B501495B9ABA8C7F753F2A18"><enum>(b)</enum><text>Section 739 of the
			 Agriculture, Rural Development, Food and Drug Administration, and Related
			 Agencies Appropriation Act, 2001 (H.R. 5426 as enacted by Public Law 106–387,
			 115 Stat. 1549A–34) is repealed.</text>
					</subsection><subsection id="H363954A2FA6941038F88A58D8CC7C36D"><enum>(c)</enum><text>For gross
			 obligations for the principal amount of guaranteed loans as authorized by title
			 V of the Housing Act of 1949, to be available from funds in the rural housing
			 insurance fund, an additional amount shall be for section 502 unsubsidized
			 guaranteed loans sufficient to meet the remaining fiscal year 2010 demand,
			 provided that existing program underwriting standards are maintained, and
			 provided further that the Secretary may waive fees described herein for very
			 low- and low-income borrowers, not to exceed $697,000,000 in loan
			 guarantees.</text>
					</subsection></section></chapter><chapter id="H682E3FDA48784CD6825EE94F22831096"><enum>2</enum>
				<appropriations-major id="H5B9B7A5A59084F0B9D26E153C541132F"><header>DEPARTMENT OF
		  COMMERCE</header>
				</appropriations-major><appropriations-intermediate id="HFF8EF6E301BB43759B9A01B982DC4FCD"><header>National Telecommunications and
		  Information Administration</header>
				</appropriations-intermediate><appropriations-small id="H0495E890A53B499F9CF3EBD8BDE2C336"><header>(Rescission)</header><text display-inline="no-display-inline">Of the funds made available under the
		  heading <quote>National Telecommunications and Information
		  Administration</quote> for Digital-to-Analog Converter Box Program in prior
		  years, $111,500,000 are rescinded.</text>
				</appropriations-small><appropriations-intermediate id="H06FD415914C94AB6A6FE55471A9734BA"><header>Economic development
		  administration</header>
				</appropriations-intermediate><appropriations-small id="H56C1DB191B9346F1BFDBE5A42E2D9C0E"><header>ECONOMIC
		  DEVELOPMENT ASSISTANCE PROGRAMS</header><text display-inline="no-display-inline">Pursuant to section 703 of the Public Works
		  and Economic Development Act (42 U.S.C. 3233), for an additional amount for
		  ‘‘Economic Development Assistance Programs’’, for necessary expenses related to
		  disaster relief, long-term recovery, and restoration of infrastructure in
		  States that experienced damage due to severe storms and flooding during March
		  2010 through May 2010 for which the President declared a major disaster
		  covering an entire State or States with more than 20 counties declared major
		  disasters under title IV of the Robert T. Stafford Disaster Relief and
		  Emergency Assistance Act of 1974, $49,000,000, to remain available until
		  expended.</text>
				</appropriations-small><appropriations-intermediate id="HD1A421D2F04A46258AB147350C4F607B"><header>National oceanic and atmospheric
		  administration</header>
				</appropriations-intermediate><appropriations-small id="HE82E0FBBC663442DB2E28C11286F2EA0"><header>OPERATIONS, RESEARCH, AND
		  FACILITIES</header><text display-inline="no-display-inline">For an additional
		  amount for <quote>Operations, Research, and Facilities</quote>, $5,000,000, for
		  necessary expenses related to commercial fishery failures as determined by the
		  Secretary of Commerce in January 2010.</text>
				</appropriations-small><appropriations-major id="HF2EB8B5A06A04F3D9A11E570EE39A46A"><header>NATIONAL
		  AERONAUTICS AND SPACE ADMINISTRATION</header>
				</appropriations-major><appropriations-intermediate id="H9379420439694E73896C67C5B0E93A1F"><header>Exploration</header><text display-inline="no-display-inline">The matter contained in title III of
		  division B of Public Law 111–117 regarding <quote>National Aeronautics and
		  Space Administration Exploration</quote> is amended by inserting at the end of
		  the last proviso <quote>: 
		  <proviso><italic>Provided further,</italic></proviso> That
		  notwithstanding any other provision of law or regulation, funds made available
		  for Constellation in fiscal year 2010 for <quote>National Aeronautics and Space
		  Administration Exploration</quote> and from previous appropriations for
		  <quote>National Aeronautics and Space Administration Exploration</quote> shall
		  be available to fund continued performance of Constellation contracts, and
		  performance of such Constellation contracts may not be terminated for
		  convenience by the National Aeronautics and Space Administration in fiscal year
		  2010</quote>.</text>

				</appropriations-small><section id="H66D04C3FB2664811BE5E29C1C2D57DA3"><enum>1004.</enum><subsection commented="no" display-inline="yes-display-inline" id="H1384C32923FC45688FF5A22556EA02EC"><enum>(a)</enum><text display-inline="yes-display-inline">The terms and conditions of sections
			 1102(a), (b)(1), (c), and (d) of Public Law 111–32 shall apply to funds
			 appropriated in this chapter that are available for assistance for
			 Afghanistan.</text>
					</subsection><subsection id="HE22BD35E1F994275B99A339512C4CCDA"><enum>(b)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter and in
			 prior Acts making appropriations for the Department of State, foreign
			 operations, and related programs under the headings <quote>Economic Support
			 Fund</quote> and <quote>International Narcotics Control and Law
			 Enforcement</quote> that are available for assistance for Afghanistan may be
			 obligated only if the Secretary of State reports to the Committees on
			 Appropriations that prior to the disbursement of funds, representatives of the
			 Afghan national, provincial or local government, local communities and civil
			 society organizations, as appropriate, will be consulted and participate in the
			 design of programs, projects, and activities, and following such disbursement
			 will participate in implementation and oversight, and progress will be measured
			 against specific benchmarks.</text>
					</subsection><subsection id="H5FE4E3F1C97B47908AF036930BBC7CA8"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2AD3A83440AE4ADBAC94AF5E24C4485C"><enum>(1)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter may be
			 made available for assistance for the Government of Afghanistan only if the
			 Secretary of State determines and reports to the Committees on Appropriations
			 that the Government of Afghanistan is—</text>
							<subparagraph id="HFBB65276DD6F40AA86ED6EB8D5B5B18B" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">cooperating with United States
			 reconstruction and reform efforts;</text>
							</subparagraph><subparagraph id="HCCFD1A3C83834C59A41DAA1AB3A0767E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrating a commitment to
			 accountability by removing corrupt officials, implementing fiscal transparency
			 and other necessary reforms of government institutions, and facilitating active
			 public engagement in governance and oversight of public resources; and</text>
							</subparagraph><subparagraph id="H5F28DB64C7F04FD39E3DD74E3274D245" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">respecting the internationally recognized
			 human rights of Afghan women.</text>
							</subparagraph></paragraph><paragraph id="H9FAEC3A73B8149D6A5A11D2135ED1694" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If at any time after making the
			 determination required in paragraph (1) the Secretary receives credible
			 information that the factual basis for such determination no longer exists, the
			 Secretary should suspend assistance and promptly inform the relevant Afghan
			 authorities that such assistance is suspended until sufficient factual basis
			 exists to support the determination.</text>
						</paragraph></subsection><subsection id="H79FB4DD806254542A50516FACF37D560"><enum>(d)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter and in
			 prior Acts that are available for assistance for Afghanistan may be made
			 available to support reconciliation with, or reintegration of, former
			 combatants only if the Secretary of State determines and reports to the
			 Committees on Appropriations that—</text>
						<paragraph id="HC13413D7D5EE4EA184794F46867BB3BA"><enum>(1)</enum><text display-inline="yes-display-inline">Afghan women are participating at national,
			 provincial and local levels of government in the design, policy formulation and
			 implementation of the reconciliation or reintegration process, and women’s
			 internationally recognized human rights are protected in such process;
			 and</text>
						</paragraph><paragraph id="HE44EC5BC7D4E4B6D974BAD107F3C61AE"><enum>(2)</enum><text display-inline="yes-display-inline">such funds will not be used to support any
			 pardon, immunity from prosecution or amnesty, or any position in the Government
			 of Afghanistan or security forces, for any leader of an armed group responsible
			 for crimes against humanity, war crimes, or other violations of internationally
			 recognized human rights.</text>
						</paragraph></subsection><subsection id="H6887E969A93547638748109DC00751D9"><enum>(e)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter that are
			 available for assistance for Afghanistan may be made available to support the
			 work of the Independent Electoral Commission and the Electoral Complaints
			 Commission in Afghanistan only if the Secretary of State determines and reports
			 to the Committees on Appropriations that—</text>
						<paragraph id="H0D0F6D5E3E6746AD902593DBA5DED355"><enum>(1)</enum><text display-inline="yes-display-inline">the Independent Electoral Commission has no
			 members or other employees who participated in, or helped to cover up, acts of
			 fraud in the 2009 elections for president in Afghanistan, and the Electoral
			 Complaints Commission is a genuinely independent body with all the authorities
			 that were invested in it under Afghanistan law as of December 31, 2009, and
			 with no members appointed by the President of Afghanistan; and</text>
						</paragraph><paragraph id="H1563AFF73EF144439AD9E07FC1A1E36F"><enum>(2)</enum><text display-inline="yes-display-inline">the central Government of Afghanistan has
			 taken steps to ensure that women are able to exercise their rights to political
			 participation, whether as candidates or voters.</text>
						</paragraph></subsection><subsection id="H2426C30E921542BF8481AF2BF5E77631"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HFA938786976347519A651C80C2CFD726"><enum>(1)</enum><text display-inline="yes-display-inline">Not more than 45 days after enactment of
			 this Act, the Secretary of State, in consultation with the Administrator of the
			 United States Agency for International Development, shall submit to the
			 Committees on Appropriations a strategy to address the needs and protect the
			 rights of Afghan women and girls, including planned expenditures of funds
			 appropriated in this chapter, and detailed plans for implementing and
			 monitoring such strategy.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H041F17154DD44F449069EE66FF72EB95" indent="up1"><enum>(2)</enum><text>Such strategy shall be coordinated
			 with and support the goals and objectives of the National Action Plan for Women
			 of Afghanistan and the Afghan National Development Strategy and shall include a
			 defined scope and methodology to measure the impact of such assistance.</text>
						</paragraph></subsection><subsection id="HB7BD79875D534E518A5114144A8F8EE5"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H05324E2B4C5149D6B7E7CF4C33F5FE57"><enum>(1)</enum><text>Notwithstanding section
			 303 of the Federal Property and Administrative Services Act of 1949 (41 U.S.C.
			 253) and requirements for awarding task orders under task and delivery order
			 contracts under section 303J of such Act (41 U.S.C. 253j), the Secretary of
			 State may award task orders for police training in Afghanistan under current
			 Department of State contracts for police training.</text>
						</paragraph><paragraph id="HFC4C2D5AA0D0494DB82A6BBF2A3C9F99" indent="up1"><enum>(2)</enum><text>Any task order awarded under
			 paragraph (1) shall be for a limited term and shall remain in performance only
			 until a successor contract or contracts awarded by the Department of Defense
			 using full and open competition have entered into full performance after
			 completion of any start-up or transition periods.</text>
						</paragraph></subsection></section><appropriations-small id="H7717212728794F9EA034B423E3D5A52B"><header>Pakistan</header>
				</appropriations-small><section id="H73BF8CCA396D4F78AE6F35CF6DF362E7"><enum>1005.</enum><subsection commented="no" display-inline="yes-display-inline" id="H5A17B4F6150E4E868EF22F7E55C04B22"><enum>(a)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter and in
			 prior Acts making appropriations for the Department of State, foreign
			 operations, and related programs under the headings <quote>Foreign Military
			 Financing Program</quote> and <quote>Pakistan Counterinsurgency Capability
			 Fund</quote> shall be made available—</text>
						<paragraph id="HB7881F27F03E417192F7574D64A78F93"><enum>(1)</enum><text display-inline="yes-display-inline">in a manner that promotes unimpeded access
			 by humanitarian organizations to detainees, internally displaced persons, and
			 other Pakistani civilians adversely affected by the conflict; and</text>
						</paragraph><paragraph id="H42665931B03B4D3B98873239233C1ADE"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with section 620J of the
			 Foreign Assistance Act of 1961, and the Secretary of State shall inform
			 relevant Pakistani authorities of the requirements of section 620J and of its
			 application, and regularly monitor units of Pakistani security forces that
			 receive United States assistance and the performance of such units.</text>
						</paragraph></subsection><subsection id="H24A0423635DF4BB4BA072497CCA439C9"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HC4E7B5C2EBF84B1BAD5BACC93228D21D"><enum>(1)</enum><text display-inline="yes-display-inline">Of the funds appropriated in this chapter
			 under the heading <quote>Economic Support Fund</quote> for assistance for
			 Pakistan, $5,000,000 shall be made available through the Bureau of Democracy,
			 Human Rights and Labor, Department of State, for human rights programs in
			 Pakistan, including training of government officials and security forces, and
			 assistance for human rights organizations.</text>
						</paragraph><paragraph id="HC9997F805A3746F2B72EB7C32631682B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 90 days after enactment of
			 this Act and prior to the obligation of funds under this subsection, the
			 Secretary of State shall submit to the Committees on Appropriations a human
			 rights strategy in Pakistan including the proposed uses of funds.</text>
						</paragraph></subsection><subsection id="H7F668049715B47FB89E93A1E952C3D11"><enum>(c)</enum><text>Of the funds
			 appropriated in this chapter under the heading <quote>Economic Support
			 Fund</quote> for assistance for Pakistan, up to $1,500,000 should be made
			 available to the Department of State and the United States Agency for
			 International Development for the lease of aircraft to implement programs and
			 conduct oversight in northwestern Pakistan, which shall be coordinated under
			 the authority of the United States Chief of Mission in Pakistan.</text>
					</subsection></section><appropriations-small id="H4EB6BC0C1337403F8F7FBBFC7E609FB1"><header>IRAQ</header>
				</appropriations-small><section id="H6228AA11706D4549B2498409A5054004"><enum>1006.</enum><subsection commented="no" display-inline="yes-display-inline" id="H2570BA9592074AC6B84EC4A767EDC721"><enum>(a)</enum><text display-inline="yes-display-inline">The uses of aircraft in Iraq purchased or
			 leased with funds made available under the headings <quote>International
			 Narcotics Control and Law Enforcement</quote> and <quote>Diplomatic and
			 Consular Affairs</quote> in this chapter and in prior Acts making
			 appropriations for the Department of State, foreign operations, and related
			 programs shall be coordinated under the authority of the United States Chief of
			 Mission in Iraq.</text>
					</subsection><subsection id="H218FD5A6477B4A3CBF51BD05561CD683"><enum>(b)</enum><text display-inline="yes-display-inline">The terms and conditions of section 1106(b)
			 of Public Law 111–32 shall apply to funds made available in this chapter for
			 assistance for Iraq under the heading <quote>International Narcotics Control
			 and Law Enforcement</quote>.</text>
					</subsection><subsection id="H77A5D8FE5F9046CAA0C44FB35A200A5E"><enum>(c)</enum><text>Of the funds
			 appropriated in this chapter and in prior acts making appropriations for the
			 Department of State, foreign operations, and related programs under the
			 headings “Diplomatic and Consular Programs” and “Embassy Security,
			 Construction, and Maintenance” for Afghanistan, Pakistan and Iraq, up to
			 $300,000,000 may, after consultation with the Committees on Appropriations, be
			 transferred between, and merged with, such appropriations for activities
			 related to security for civilian led operations in such countries.</text>
					</subsection></section><appropriations-small id="H38AE59C1D487468CA4E3CA39FFADA39C"><header>Haiti</header>
				</appropriations-small><section id="HF6DE4F14FA97448284F19D5E68E25F5B"><enum>1007.</enum><subsection commented="no" display-inline="yes-display-inline" id="H3D44A1310811419280713B164BBDABE0"><enum>(a)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter and in
			 prior Acts making appropriations for the Department of State, foreign
			 operations, and related programs under the headings <quote>Economic Support
			 Fund</quote> and <quote>International Narcotics Control and Law
			 Enforcement</quote> that are available for assistance for Haiti may be
			 obligated only if the Secretary of State reports to the Committees on
			 Appropriations that prior to the disbursement of funds, representatives of the
			 Haitian national, provincial or local government, local communities and civil
			 society organizations, as appropriate, will be consulted and participate in the
			 design of programs, projects, and activities, and following such disbursement
			 will participate in implementation and oversight, and progress will be measured
			 against specific benchmarks.</text>
					</subsection><subsection id="H01795A3464A24A01B4F20E36F498AA8A"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HCA1D5DC2E4824216BE2F8CAC10E7B1C9"><enum>(1)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter under
			 the headings <quote>Economic Support Fund</quote> and <quote>International
			 Narcotics Control and Law Enforcement</quote> may be made available for
			 assistance for the Government of Haiti only if the Secretary of State
			 determines and reports to the Committees on Appropriations that the Government
			 of Haiti is—</text>
							<subparagraph id="H134C31C12750490B9CEE32ADF9DCB6FE" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">cooperating with United States
			 reconstruction and reform efforts; and</text>
							</subparagraph><subparagraph id="H3080E884A2414306A416FC1514D312A5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrating a commitment to
			 accountability by removing corrupt officials, implementing fiscal transparency
			 and other necessary reforms of government institutions, and facilitating active
			 public engagement in governance and oversight of public resources.</text>
							</subparagraph></paragraph><paragraph id="H703E9E07901D42B9B879449F91C74AB6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If at any time after making the
			 determination required in paragraph (1) the Secretary receives credible
			 information that the factual basis for making such determination no longer
			 exists, the Secretary should suspend assistance and promptly inform the
			 relevant Haitian authorities that such assistance is suspended until sufficient
			 factual basis exists to support the determination.</text>
						</paragraph></subsection><subsection id="H4AA94FB28CBE4C63BEDF30A0AF7FAE05"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5DCB1813AC584F1984B99BA3DA4FEE79"><enum>(1)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter for
			 bilateral assistance for Haiti may be provided as direct budget support to the
			 central Government of Haiti only if the Secretary of State reports to the
			 Committees on Appropriations that the Government of the United States and the
			 Government of Haiti have agreed, in writing, to clear and achievable goals and
			 objectives for the use of such funds, and have established mechanisms within
			 each implementing agency to ensure that such funds are used for the purposes
			 for which they were intended.</text>
						</paragraph><paragraph id="H52986B3A3B4145678D408BD348894DA9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary should suspend any such
			 direct budget support to an implementing agency if the Secretary has credible
			 evidence of misuse of such funds by any such agency.</text>
						</paragraph><paragraph id="HF3795A2E56554193B503FDB6C98378DA" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any such direct budget support shall be
			 subject to prior consultation with the Committees on Appropriations.</text>
						</paragraph></subsection><subsection id="HA49E8D7127DF4E88AA91F14BEDF1FAE8"><enum>(d)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter that are
			 made available for assistance for Haiti shall be made available, to the maximum
			 extent practicable, in a manner that emphasizes the participation and
			 leadership of Haitian women and directly improves the security, economic and
			 social well-being, and political status of Haitian women and girls.</text>
					</subsection><subsection id="H9B0AE6406078460CA0CEFCEDCA3FB3B4"><enum>(e)</enum><text>Funds appropriated
			 in this chapter may be made available for assistance for Haiti notwithstanding
			 any other provision of law, except for section 620J of the Foreign Assistance
			 Act of 1961 and provisions of this chapter.</text>
					</subsection></section><appropriations-small id="H49C4D7CB144042AEBC96DD933A993FDD"><header>HAITI DEBT
		  RELIEF</header>
				</appropriations-small><section id="HF1453AA0C6504059BC34D5900758B163"><enum>1008.</enum><subsection commented="no" display-inline="yes-display-inline" id="H09A6B1B746FA483AACC51CF090457420"><enum>(a)</enum><text display-inline="yes-display-inline">For an additional amount for
			 <quote>Contribution to the Inter-American Development Bank</quote>,
			 <quote>Contribution to the International Development Association</quote>, and
			 <quote>Contribution to the International Fund for Agricultural
			 Development</quote>, to cancel Haiti’s existing debts and repayments on
			 disbursements from loans committed prior to January 12, 2010, and for the
			 United States share of an increase in the resources of the Fund for Special
			 Operations of the Inter-American Development Bank, to the extent separately
			 authorized in this chapter, in furtherance of providing debt relief for Haiti
			 in view of the Cancun Declaration of March 21, 2010, a total of $212,000,000,
			 to remain available until September 30, 2012.</text>
					</subsection><subsection id="H5C1C33391E3946EDA3FBDD0106FFA2DC"><enum>(b)</enum><text display-inline="yes-display-inline">Up to $40,000,000 of the amounts
			 appropriated under the heading <quote>Department of the Treasury, Debt
			 Restructuring</quote> in prior Acts making appropriations for the Department of
			 State, foreign operations, and related programs may be used to cancel Haiti’s
			 existing debts and repayments on disbursements from loans committed prior to
			 January 12, 2010, to the Inter-American Development Bank, the International
			 Development Association, and the International Fund for Agricultural
			 Development, and for the United States share of an increase in the resources of
			 the Fund for Special Operations of the Inter-American Development Bank in
			 furtherance of providing debt relief to Haiti in view of the Cancun Declaration
			 of March 21, 2010.</text>
					</subsection></section><appropriations-small id="HE13EDBE3C35F495A8DA1D552B923F987"><header>HAITI DEBT RELIEF
		  AUTHORITY</header>
				</appropriations-small><section id="H7B9E20E64CCF4DED9D9AB0495B3BD69E"><enum>1009.</enum><text display-inline="yes-display-inline">The Inter-American Development Bank Act,
			 Public Law 86–147, as amended (22 U.S.C. 283 et seq.), is further amended by
			 adding at the end thereof the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H1716DDDFC3274286BE551593A2FA4E16" style="OLC">
						<section id="HA28FE35DBC584E768494BDF838781089"><enum>40.</enum><text display-inline="yes-display-inline">AUTHORITY TO VOTE FOR AND CONTRIBUTE TO AN
				INCREASE IN RESOURCES OF THE FUND FOR SPECIAL OPERATIONS; PROVIDING DEBT RELIEF
				TO HAITI.</text>
							<subsection id="H7843D6D56BCD4775B71DC0811C2BAE93"><enum>(a)</enum><header>Vote
				authorized</header><text display-inline="yes-display-inline">In accordance with
				section 5 of this Act, the United States Governor of the Bank is authorized to
				vote in favor of a resolution to increase the resources of the Fund for Special
				Operations up to $479,000,000, in furtherance of providing debt relief for
				Haiti in view of the Cancun Declaration of March 21, 2010, which provides
				that:</text>
								<paragraph id="H0F0480FC401240F7BE778FDF7A03996A"><enum>(1)</enum><text display-inline="yes-display-inline">Haiti’s debts to the Fund for Special
				Operations are to be cancelled;</text>
								</paragraph><paragraph id="HF9CFD8A8D59C4EE9A78F3AAFCA027E74"><enum>(2)</enum><text display-inline="yes-display-inline">Haiti’s remaining local currency conversion
				obligations to the Fund for Special Operations are to be cancelled;</text>
								</paragraph><paragraph id="HC7D9E11634BC45DBA8315E0E2783250B"><enum>(3)</enum><text display-inline="yes-display-inline">undisbursed balances of existing loans of
				the Fund for Special Operations to Haiti are to be converted to grants;
				and</text>
								</paragraph><paragraph id="H96F73087B7FC4628B6DD9AACF03479F4"><enum>(4)</enum><text display-inline="yes-display-inline">the Fund for Special Operations is to make
				available significant and immediate grant financing to Haiti as well as
				appropriate resources to other countries remaining as borrowers within the Fund
				for Special Operations, consistent with paragraph 6 of the Cancun Declaration
				of March 21, 2010.</text>
								</paragraph></subsection><subsection id="H8E666E7133D24A9AB632C9A0F9FE9880"><enum>(b)</enum><header>Contribution
				authority</header><text display-inline="yes-display-inline">To the extent and
				in the amount provided in advance in appropriations Acts the United States
				Governor of the Bank may, on behalf of the United States and in accordance with
				section 5 of this Act, contribute up to $252,000,000 to the Fund for Special
				Operations, which will provide for debt relief of:</text>
								<paragraph id="HE968C240423C438B9DC5989038F50D35"><enum>(1)</enum><text display-inline="yes-display-inline">up to $240,000,000 to the Fund for Special
				Operations;</text>
								</paragraph><paragraph id="HA9DDBABFD7C743A4B34EE034931FCB5C"><enum>(2)</enum><text display-inline="yes-display-inline">up to $8,000,000 to the International Fund
				For Agricultural Development (IFAD); and</text>
								</paragraph><paragraph id="HF9E5AD3FE48E4C69A6AFADDFAEBA0848"><enum>(3)</enum><text display-inline="yes-display-inline">up to $4,000,000 for the International
				Development Association (IDA).</text>
								</paragraph></subsection><subsection id="H0D9F99013FE5406B882410E05CE2D0D2"><enum>(c)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">To pay for the
				contribution authorized under subsection (b), there are authorized to be
				appropriated, without fiscal year limitation, for payment by the Secretary of
				the Treasury $212,000,000, for the United States contribution to the Fund for
				Special
				Operations.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					<appropriations-small id="H8D7B2D1E3BD0417699595E058E1CC667"><header>Mexico</header>
					</appropriations-small></section><section id="H3A4DFD6735D34D89896D1566761EBE70"><enum>1010.</enum><subsection commented="no" display-inline="yes-display-inline" id="H42E2ED41C5D54B49A8470829E1645401"><enum>(a)</enum><text display-inline="yes-display-inline">For purposes of funds appropriated in this
			 chapter and in prior Acts making appropriations for the Department of State,
			 foreign operations, and related programs under the heading <quote>International
			 Narcotics Control and Law Enforcement</quote> that are made available for
			 assistance for Mexico, the provisions of paragraphs (1) through (3) of section
			 7045(e) of the Department of State, Foreign Operations, and Related Programs
			 Appropriations Act, 2009 (division H of Public Law 111–8) shall apply and the
			 report required in paragraph (1) shall be based on a determination by the
			 Secretary of State of compliance with each of the requirements in paragraph
			 (1)(A) through (D).</text>
					</subsection><subsection id="H8A2ADB82F6C5482EA7FFCD0FB8C3BDE9"><enum>(b)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter under
			 the heading <quote>International Narcotics Control and Law Enforcement</quote>
			 that are available for assistance for Mexico may be made available only after
			 the Secretary of State submits a report to the Committees on Appropriations
			 detailing a coordinated, multi-year, interagency strategy to address the causes
			 of drug-related violence and other organized criminal activity in Central and
			 South America, Mexico, and the Caribbean, which shall describe—</text>
						<paragraph id="HCFD9353C2FAA4A66BBE7608D77EFCE57"><enum>(1)</enum><text display-inline="yes-display-inline">the United States multi-year strategy for
			 the region, including a description of key challenges in the source, transit,
			 and demand zones; the key objectives of the strategy; and a detailed
			 description of outcome indicators for measuring progress toward such
			 objectives;</text>
						</paragraph><paragraph id="H84C107424E3841E4BE6987C69086EB62"><enum>(2)</enum><text display-inline="yes-display-inline">the integration of diplomatic,
			 administration of justice, law enforcement, civil society, economic
			 development, demand reduction, and other assistance to achieve such
			 objectives;</text>
						</paragraph><paragraph id="HD999FAD7D6484D21B6FF62AE292A0F2D"><enum>(3)</enum><text display-inline="yes-display-inline">progress in phasing out law enforcement
			 activities of the militaries of each recipient country, as applicable;
			 and</text>
						</paragraph><paragraph id="H3CD3FA90289F41FBBA00146792B35474"><enum>(4)</enum><text display-inline="yes-display-inline">governmental efforts to investigate and
			 prosecute violations of internationally recognized human rights.</text>
						</paragraph></subsection><subsection id="H7D0A2FEE874F48CCBE9B6E3C8297F597"><enum>(c)</enum><text display-inline="yes-display-inline">Of the funds appropriated in this chapter
			 under the heading <quote>Diplomatic and Consular Programs</quote>, up to
			 $5,000,000 may be made available for armored vehicles and other emergency
			 diplomatic security support for United States Government personnel in
			 Mexico.</text>

			 competence could otherwise be applied to weapons development, provided such
			 projects are executed through existing science and technology centers and
			 notwithstanding sections 503 and 504 of the FREEDOM Support Act (Public Law
			 102–511), and following consultation with the Committees on Appropriations, the
			 Committee on Foreign Relations of the Senate and the Committee on Foreign
			 Affairs of the House of Representatives.</text>

		  AGENCY</header>

			 President is authorized to accept the statute of, and to maintain membership of

		  PERSONNEL</header>
					</appropriations-small></section><section id="H7F504E44AD08405B95D5C84A92733388"><enum>1015.</enum><subsection commented="no" display-inline="yes-display-inline" id="HC685E49F27DF41B8BF02D6820ACEFB3B"><enum>(a)</enum><text display-inline="yes-display-inline">Funds appropriated in this chapter for the
			 United States Agency for International Development Office of Inspector General
			 (OIG) may be made available to contract with United States citizens for
			 personal services when the Inspector General determines that the personnel
			 resources of the OIG are otherwise insufficient.</text>
						<paragraph id="H0EC5365120CF43E79FEAF8F99B6A8657"><enum>(1)</enum><text display-inline="yes-display-inline">Not more than 5 percent of the OIG
			 personnel (determined on a full-time equivalent basis), as of any given date,
			 are serving under personal services contracts.</text>
						</paragraph><paragraph id="H5C4A3D6C0D7648F5B4F92462E309FE16"><enum>(2)</enum><text display-inline="yes-display-inline">Contracts under this paragraph shall not
			 exceed a term of 2 years unless the Inspector General determines that
			 exceptional circumstances justify an extension of up to 1 additional year, and
			 contractors under this paragraph shall not be considered employees of the
			 Federal Government for purposes of title 5, United States Code, or members of
			 the Foreign Service for purposes of title 22, United States Code.</text>
						</paragraph></subsection><subsection id="H419E60D3A8F74D27AE4156DFD7AF5DCA"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE7C31CAB94484C248383E4512DB1B48C"><enum>(1)</enum><text display-inline="yes-display-inline">The Inspector General may waive subsections
			 (a) through (d) of section 8344, and subsections (a) through (e) of section
			 8468 of title 5, United States Code, and subsections (a) through (d) of section
			 4064 of title 22, United States Code, on behalf of any re-employed annuitant
			 serving in a position within the OIG to facilitate the assignment of persons to
			 positions in Iraq, Pakistan, Afghanistan, and Haiti or to positions vacated by

			 shall be exercised on a case-by-case basis for positions for which there is
			 difficulty recruiting or retaining a qualified employee or to address a
			 temporary emergency hiring need, individuals employed by the OIG under this
			 paragraph shall not be considered employees for purposes of subchapter III of
			 chapter 83 of title 5, United States Code, or chapter 84 of such title, and the
			 authorities of the Inspector General under this paragraph shall terminate on
			 October 1, 2012.</text>
						</paragraph></subsection></section><appropriations-small id="H38410196B7614550AB52BB399D30C8B8"><header>AUTHORITY TO REPROGRAM
		  FUNDS</header>

			 State under the final rule entitled <quote>Lead; Renovation, Repair, and
			 Painting Program; Lead Hazard Information Pamphlet; Notice of Availability;
			 Final Rule</quote> (73 Fed. Reg. 21692 (April 22, 2008)), and the final rule
			 entitled <quote>Lead; Amendment to the Opt-out and Recordkeeping Provisions in
			 the Renovation, Repair, and Painting Program</quote> signed by the
			 Administrator on April 22, 2010.</text>
			</section><section id="HA324D915E5FD45F8BBDC685EEA6F0B21"><enum>2003.</enum><header>Right-of-way</header><subsection commented="no" display-inline="yes-display-inline" id="H19E8CAE4B6E4452295116A54F13046A5"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of the Interior shall—</text>
					<paragraph id="H6FD3B6D9E0FD49068BC67D64A140FB74"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 30 days after the date of
			 enactment of this Act, amend Right-of-Way Grants No.
			 NVN–49781/IDI–26446/NVN–85211/NVN–85210 of the Bureau of Land Management to
			 shift the 200-foot right-of-way for the 500-kilovolt transmission line project
			 to the alignment depicted on the maps entitled <quote>Southwest Intertie
			 Project</quote> and dated December 10, 2009, and May 21, 2010, and approve the
			 construction, operation and maintenance plans of the project; and</text>
					</paragraph><paragraph id="H79456611284A42BE9CABB063F3925858"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 90 days after the date of
			 enactment of this Act, issue a notice to proceed with construction of the
			 project in accordance with the amended grants and approved plans described in
			 paragraph (1).</text>
					</paragraph></subsection><subsection id="H8A6B50D9C631464DA0855C344900A5D2"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Energy may provide or facilitate federal financing for the
			 project described in subsection (a) under the American Recovery and
			 Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 115) or the Energy Policy
			 Act of 2005 (42 U.S.C. 15801 et seq.), based on the comprehensive reviews and
			 consultations performed by the Secretary of the Interior.</text>
				</subsection></section><section id="HC3B0CCFDF2BE47AC9D102E021A34E7EF"><enum>2004.</enum><header>Funding for environmental and fisheries
		impacts</header><subsection commented="no" display-inline="yes-display-inline" id="H3A9C9E1E48A740D4B57814BA843E5412"><enum>(1)</enum><header>Fisheries disaster
			 relief</header><text>For an additional amount, in addition to other amounts
			 provided in this Act for the National Oceanic and Atmospheric Administration,
			 $15,000,000 to be available to provide fisheries disaster relief under section
			 312 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C.
			 1861a) related to a commercial fishery failure due to a fishery resource
			 disaster in the Gulf of Mexico that resulted from the Deepwater Horizon oil
			 discharge.</text>
					<paragraph id="HF739195BDDEE4FCDAD82B672C04ABA6E"><enum>(2)</enum><header>Expanded stock
			 assessment of fisheries</header><text>For an additional amount, in addition to
			 other amounts provided in this Act for the National Oceanic and Atmospheric
			 Administration, $10,000,000 to conduct an expanded stock assessment of the
			 fisheries of the Gulf of Mexico. Such expanded stock assessment shall include
			 an assessment of the commercial and recreational catch and biological sampling,
			 observer programs, data management and processing activities, the conduct of
			 assessments, and follow-up evaluations of such fisheries.</text>
					</paragraph><paragraph id="H74D0E3020E104D9DB402D078F75EF386"><enum>(3)</enum><header>Ecosystem
			 services impacts study</header><text>For an additional amount, in addition to
			 other amounts provided for the Department of Commerce, $1,000,000 to be
			 available for the National Academy of Sciences to conduct a study of the
			 long-term ecosystem service impacts of the Deepwater Horizon oil discharge.
			 Such study shall assess long-term costs to the public of lost water filtration,
			 hunting, and fishing (commercial and recreational), and other ecosystem
			 services associated with the Gulf of Mexico.</text>
					</paragraph><paragraph id="HF560437E70454171BC380C3885D0100D"><enum>(4)</enum><header>In
			 general</header><text>Of the amounts appropriated or made available under
			 division B, title I of Public Law 111–117 that remain unobligated as of the
			 date of the enactment of this Act under Procurement, Acquisition, and
			 Construction for the National Oceanic and Atmospheric Administration,
			 $26,000,000 of the amounts appropriated are hereby rescinded.</text>
					</paragraph></subsection></section></title><title id="H582DA26F840B4103806FAA559E384C73"><enum>III</enum>
			<appropriations-major id="H408458AF243F4E3B96B28B92CD380BEA"><header>GENERAL PROVISIONS—THIS
		  ACT</header>
			</appropriations-major><appropriations-small commented="no" id="HA1C99EB5B49C44C3A9649DB4DA6C55A8"><header display-inline="yes-display-inline">AVAILABILITY OF
		  FUNDS</header>
			</appropriations-small><section commented="no" display-inline="no-display-inline" id="HC2B4962AE5924598B85B4EA062141878" section-type="subsequent-section"><enum>3001.</enum><text display-inline="yes-display-inline">No part of any appropriation contained in
			 this Act shall remain available for obligation beyond the current fiscal year
			 unless expressly so provided herein.</text>
				<appropriations-small id="H63E85259907640428987766ECED18ADD"><header>Emergency
		  designation</header>
				</appropriations-small></section><section id="HBC6B494616E74F7A8F501986A7E85CC9"><enum>3002.</enum><text display-inline="yes-display-inline">Unless otherwise specified, each amount in
			 this Act is designated as an emergency requirement and necessary to meet
			 emergency needs pursuant to sections 403(a) and 423(b) of S. Con. Res. 13
			 (111th Congress), the concurrent resolution on the budget for fiscal year
			 2010.</text>
			</section><section id="H164D7227165D412B8C44F75CC7ED4570"><enum>3003.</enum><subsection commented="no" display-inline="yes-display-inline" id="HEB032D28FBE94ED2A30863DC0913B26B"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 for fiscal year 2010 only, all funds received from sales, bonuses, royalties,
			 and rentals under the Geothermal Steam Act of 1970 (30 U.S.C. 1001 et seq.)
			 shall be deposited in the Treasury, of which—</text>
					<paragraph id="H85C4DB436F62480783BBFEEBC86418FB"><enum>(1)</enum><text display-inline="yes-display-inline">50 percent shall be used by the Secretary
			 of the Treasury to make payments to States within the boundaries of which the
			 leased land and geothermal resources are located;</text>
					</paragraph><paragraph id="HABA09754854D4A80B0CE715320C5BECC"><enum>(2)</enum><text display-inline="yes-display-inline">25 percent shall be used by the Secretary
			 of the Treasury to make payments to the counties within the boundaries of which
			 the leased land or geothermal resources are located; and</text>
					</paragraph><paragraph id="H65B26CD754DB4713BF8BA7BB0233B1FE"><enum>(3)</enum><text display-inline="yes-display-inline">25 percent shall be deposited in
			 miscellaneous receipts.</text>
					</paragraph></subsection><subsection id="H80C3435A393548769DBDFA59AE203873"><enum>(b)</enum><text>Section 3002 shall
			 not apply to this section.</text>
				</subsection></section><section id="H4290F4935B1240B0A5DF97F075E6C1EA"><enum>3004.</enum><subsection commented="no" display-inline="yes-display-inline" id="HEAE4B6891053473DBF32E2205DBB1558"><enum>(a)</enum><text display-inline="yes-display-inline">Public Law 111–88, the Interior,
			 Environment, and Related Agencies Appropriations Act, 2010, is amended under
			 the heading <quote>Office of the Special Trustee for American Indians</quote>
			 by—</text>
					<paragraph id="H6123A90DE0ED4275B8638174A1174338"><enum>(1)</enum><text display-inline="yes-display-inline">striking <quote>$185,984,000</quote> and
			 inserting <quote>$176,984,000</quote>; and</text>
					</paragraph><paragraph id="H9B5312A5D2264B17A53AD0528BC8E30F"><enum>(2)</enum><text display-inline="yes-display-inline">striking <quote>$56,536,000</quote> and
			 inserting <quote>$47,536,000</quote>.</text>
					</paragraph></subsection><subsection id="H4970768A3D6F4DC38ECFAACEF3B8F191"><enum>(b)</enum><text>Section 3002 shall
			 not apply to the amounts in this section.</text>
				</subsection></section><section id="HC26A73F2DF2B483CA9796F42CB9196F9"><enum>3005.</enum><text display-inline="yes-display-inline">Section 502(c) of the Chesapeake Bay
			 Initiative Act of 1998 (16 U.S.C. 461 note; Public Law 105–312) is amended by
			 striking <quote>2008</quote> and inserting <quote>2011</quote>.</text>
			</section><section id="H3E1E771B4E84419D872809B38CFBAFD8"><enum>3006.</enum><text display-inline="yes-display-inline">For fiscal years 2010 and 2011—</text>
				<paragraph id="HD97D5D6F3AD446DB9D5C985BE187516A"><enum>(1)</enum><text display-inline="yes-display-inline">the National Park Service Recreation Fee
			 Program account may be available for the cost of adjustments and changes within
			 the original scope of contracts for National Park Service projects funded by
			 Public Law 111–5 and for associated administrative costs when no funds are
			 otherwise available for such purposes;</text>
				</paragraph><paragraph id="HC15CC2168FEA4D65A95EFE390A3806F8"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding section 430 of division E
			 of Public Law 111–8 and section 444 of Public Law 111–88, the Secretary of the
			 Interior may utilize unobligated balances for adjustments and changes within
			 the original scope of projects funded through division A, title VII, of Public
			 Law 111–5 and for associated administrative costs when no funds are otherwise
			 available;</text>
				</paragraph><paragraph id="HAD22D6550ECA403FB1EBCBF3651ABB11"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of the Interior shall ensure
			 that any unobligated balances utilized pursuant to paragraph (2) shall be
			 derived from the bureau and account for which the project was funded in Public
			 Law 111–5; and</text>
				</paragraph><paragraph id="HBD8CB162E1974C008FFEBDC72E62817E"><enum>(4)</enum><text display-inline="yes-display-inline">the Secretary of the Interior shall consult
			 with the Committees on Appropriations prior to making any charges authorized by
			 this section.</text>
				</paragraph></section><section id="HD55E4658605C49189D50F3F8618CE846"><enum>3007.</enum><subsection commented="no" display-inline="yes-display-inline" id="H398981473DCE4C3C88D7C22A9E6097FF"><enum>(a)</enum><text display-inline="yes-display-inline">Section 205(d) of the Federal Land
			 Transaction Facilitation Act (43 U.S.C. 2304(d)) is amended by striking
			 <quote>10 years</quote> and inserting <quote>11 years</quote>.</text>
				</subsection><subsection id="HB3E6E3910A504FD98BB6717EF64F43E1"><enum>(b)</enum><text>Section 3002 shall
			 not apply to this section.</text>
				</subsection></section><section id="H953CCBAE7C53466D838C2F0526F6FA33"><enum>3008.</enum><text display-inline="yes-display-inline">Of the amounts appropriated for the Edward
			 Byrne Memorial Justice Assistance Grant Program under subpart 1 of part E of
			 title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3750 et seq.) under the heading <quote><header-in-text level="appropriations-small" style="appropriations">State and Local Law
			 Enforcement Assistance</header-in-text></quote> under the heading
			 <quote><header-in-text level="appropriations-intermediate" style="OLC">Office
			 of Justice Programs</header-in-text></quote> under the heading
			 <quote><header-in-text level="appropriations-intermediate" style="OLC">State
			 and Local Law Enforcement Activities</header-in-text></quote> under title II of
			 the Omnibus Appropriations Act, 2009 (Public Law 111–8; 123 Stat. 579), at the
			 discretion of the Attorney General, the amounts to be made available to Genesee
			 County, Michigan for assistance for individuals transitioning from prison in
			 Genesee County, Michigan pursuant to the joint statement of managers
			 accompanying that Act may be made available to My Brother's Keeper of Genesee
			 County, Michigan to provide assistance for individuals transitioning from
			 prison in Genesee County, Michigan.</text>
			</section><section id="H8A37DF87BFE941A39F758694362F81A5"><enum>3009.</enum><text display-inline="yes-display-inline">Section 159(b)(2)(C) of title I of division
			 A of the Consolidated Appropriations Act, 2010 (49 U.S.C. 24305 note) is
			 amended by striking clauses (i) and (ii) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7A70C6B030964CE1BD8F42365A0200C0" style="OLC">
					<clause id="HC7291A168CEB4B86A2BD6A93F0A7A5C0"><enum>(i)</enum><text>requiring
				inspections of any container containing a firearm or ammunition; and</text>
					</clause><clause id="H78C4624B59304608BCA8BB8B24EB2249"><enum>(ii)</enum><text>the temporary
				suspension of firearm carriage service if credible intelligence information
				indicates a threat related to the national rail system or specific routes or
				trains.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBE2663C77BBE461AAD9869B79ADDE5AF"><enum>3010.</enum><header>Public availability of contractor
		integrity and performance database</header><text display-inline="yes-display-inline">Section 872(e)(1) of the Clean Contracting
			 Act of 2008 (subtitle G of title VIII of Public Law 110–417; 41 U.S.C.
			 417b(e)(1)) is amended by adding at the end the following: <quote>In addition,
			 the Administrator shall post all such information, excluding past performance
			 reviews, on a publicly available Internet website.</quote>.</text>
			</section><section id="HD4BD44B3169A49E08D750D27C8CA739D"><enum>3011.</enum><header>Assessments on Guantanamo Bay
		detainees</header><subsection commented="no" display-inline="yes-display-inline" id="HC0E8BD5A21CF4F84BC0DB9156302C8C7"><enum>(a)</enum><header>Submission of
			 information related to disposition decisions</header><text display-inline="yes-display-inline">Not later than 45 days after the date of
			 the enactment of this Act, the Director of National Intelligence, in
			 coordination with the participants of the interagency review of Guantanamo Bay
			 detainees conducted pursuant to Executive Order 13492 (10 U.S.C. 801 note),
			 shall fully inform the congressional intelligence committees concerning the
			 basis for the disposition decisions reached by the Guantanamo Review Task
			 Force, and shall provide to the congressional intelligence committees—</text>
					<paragraph id="H631C88DEBE7D4405902542A1729DA2FA"><enum>(1)</enum><text>the written threat
			 analyses prepared on each detainee by the Guantanamo Review Task Force
			 established pursuant to Executive Order 13492; and</text>
					</paragraph><paragraph id="H3D4CC486B6204CC5BBF20885A4F299BA"><enum>(2)</enum><text>access to the
			 intelligence information that formed the basis of any such specific assessments
			 or threat analyses.</text>
					</paragraph></subsection><subsection id="HB50A9D6E60B84DB7BADAF60ACCB98823"><enum>(b)</enum><header>Future
			 Submissions</header><text>In addition to the analyses, assessments, and
			 information required under subsection (a) and not later than 10 days after the
			 date that a threat assessment described in subsection (a) is disseminated, the
			 Director of National Intelligence shall provide to the congressional
			 intelligence committees—</text>
					<paragraph id="HBA802E18096D4612AE48C1BCDF5B8D88"><enum>(1)</enum><text>any new threat
			 assessment prepared by any element of the intelligence community of a
			 Guantanamo Bay detainee who remains in detention or is pending release or
			 transfer; and</text>
					</paragraph><paragraph id="H06828C41D35048CAB0EEEE71EA765789"><enum>(2)</enum><text>access to the
			 intelligence information that formed the basis of such threat
			 assessment.</text>
					</paragraph></subsection><subsection id="HC9DBB253864A4062BABB57EF15999A45"><enum>(c)</enum><header>Congressional
			 intelligence committees defined</header><text>In this section, the term
			 <term>congressional intelligence committees</term> has the meaning given that
			 term in section 3(7) of the National Security Act of 1947 (50 U.S.C.
			 401a(7)).</text>
				</subsection></section><section id="H3CBAD2E027DD4C99932D7097DBFF3197"><enum>3012.</enum><text display-inline="yes-display-inline">Of the amounts appropriated for the Edward
			 Byrne Memorial Justice Assistance Grant Program under subpart 1 of part E of
			 title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3750 et seq.) under the heading <quote><header-in-text level="appropriations-small" style="appropriations">State and Local Law
			 Enforcement Assistance</header-in-text></quote> under the heading
			 <quote><header-in-text level="appropriations-intermediate" style="OLC">Office
			 of Justice Programs</header-in-text></quote> under the heading
			 <quote><header-in-text level="appropriations-intermediate" style="OLC">State
			 and Local Law Enforcement Activities</header-in-text></quote> under title II of
			 the Omnibus Appropriations Act, 2009 (Public Law 111–8; 123 Stat. 579), at the
			 discretion of the Attorney General, the amounts to be made available to the
			 Marcus Institute, Atlanta, Georgia, to provide remediation for the potential
			 consequences of childhood abuse and neglect, pursuant to the joint statement of
			 managers accompanying that Act, may be made available to the Georgia State
			 University Center for Healthy Development, Atlanta, Georgia.</text>
			</section><section id="H3F94D2A2EB674AA0A329C55AAED18BFF"><enum>3013.</enum><header>Coastal impact
		assistance</header><text display-inline="yes-display-inline">Section 31 of the Outer Continental Shelf
			 Lands Act (43 U.S.C. 1356a) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HB556794BC0C04891ABDC85852FB7A4AA" style="appropriations">
					<subsection id="H54F6AE1035394586A503E3933F7B12FD"><enum>(e)</enum><header>Emergency
				funding</header>
						<paragraph id="HED9662C54D6E427BB7A52EF6393414F7"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In response to a
				spill of national significance under the Oil Pollution Act of 1990 (33 U.S.C.
				2701 et seq.), at the request of a producing State or coastal political
				subdivision and notwithstanding the requirements of part 12 of title 43, Code
				of Federal Regulations (or a successor regulation), the Secretary may
				immediately disburse funds allocated under this section for 1 or more
				individual projects that are—</text>
							<subparagraph id="H6DAD514DB3AD415B854C2D719EDF3A5B"><enum>(A)</enum><text display-inline="yes-display-inline">consistent with subsection (d); and</text>
							</subparagraph><subparagraph id="HE6EB0A1FF0BF40E0957C2A306C33ED8C"><enum>(B)</enum><text display-inline="yes-display-inline">specifically designed to respond to the
				spill of national significance.</text>
							</subparagraph></paragraph><paragraph id="H87D7BA70FC6D46B39BBAE4B1A6FF9C08"><enum>(2)</enum><header>Approval by
				Secretary</header><text display-inline="yes-display-inline">The Secretary may,
				in the sole discretion of the Secretary, approve, on a project by project
				basis, the immediate disbursal of the funds under paragraph (1).</text>
						</paragraph><paragraph id="H6DC91ABFB824420688E635D81FCF6EC0"><enum>(3)</enum><header>State
				requirements</header>
							<subparagraph id="H0210A1344B44422DB7E68BBB05688023"><enum>(A)</enum><header>Additional
				information</header><text display-inline="yes-display-inline">If the Secretary
				approves a project for funding under this subsection that is included in a plan
				previously approved under subsection (c), not later than 90 days after the date
				of the funding approval, the producing State or coastal political subdivision
				shall submit to the Secretary any additional information that the Secretary
				determines to be necessary to ensure that the project is in compliance with
				subsection (d).</text>
							</subparagraph><subparagraph id="HAFC68E4D67274E459AE1FB57825EDD9A"><enum>(B)</enum><header>Amendment to
				plan</header><text display-inline="yes-display-inline">If the Secretary
				approves a project for funding under this subsection that is not included in a
				plan previously approved under subsection (c), not later than 90 days after the
				date of the funding approval, the producing State or coastal political
				subdivision shall submit to the Secretary for approval an amendment to the plan
				that includes any projects funded under paragraph (1), as well as any
				information about such projects that the Secretary determines to be necessary
				to ensure that the project is in compliance with subsection (d).</text>
							</subparagraph><subparagraph id="H22EA819218A34AF69A7B724556A0EEB0"><enum>(C)</enum><header>Limitation</header><text display-inline="yes-display-inline">If a producing State or coastal political
				subdivision does not submit the additional information or amendments to the
				plan required by this paragraph, or if, based on the information submitted by
				the Secretary determines that the project is not in compliance with subsection
				(d), by the deadlines specified in this paragraph, the Secretary shall not
				disburse any additional funds to the producing State or the coastal political
				subdivisions until the date on which the additional information or amendment to
				the plan has been approved by the
				Secretary.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				<appropriations-small id="HF637D8F1A46243DAB61162DFA1AD780C"><text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Supplemental Appropriations Act,
		  2010</short-title></quote>.</text>
