		<section id="H26F86CB961B24A9F9CB633BA1DC67EAB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Contracting Oversight and
			 Reform Act of 2010</short-title></quote>.</text>
		</section><section id="H03B9540EBE624FB48447EBC234EF38D0" section-type="subsequent-section"><enum>2.</enum><header>Appropriate
			 congressional committees defined</header><text display-inline="no-display-inline">In this Act, the term <term>appropriate
			 congressional committees</term> means the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental
			 Affairs</committee-name><committee-name committee-id="SSAS00"> of the
			 Senate</committee-name> and the <committee-name committee-id=""></committee-name><committee-name committee-id=""></committee-name><committee-name committee-id="">Committee on
			 Oversight and Government Reform of the House of
			 Representatives</committee-name>.</text>
		</section><section id="HF368B628AEB34D80B44835FD6C4A6112"><enum>3.</enum><header>Congressional
			 oversight</header><text display-inline="no-display-inline">Section 872(e)(1) of
			 the Clean Contracting Act of 2008 (subtitle G of title VIII of Public Law
			 110–417; 41 U.S.C. 417b(e)(1)) is amended by striking <quote>to the Chairman
			 and Ranking Member of the committees of Congress having jurisdiction</quote>
			 and inserting <quote>to any Member of Congress</quote>.</text>
		</section><section id="HE946FF945C2B41718ACD0F62CCB35952"><enum>4.</enum><header>Compliance</header>
			<subsection id="HFC6703D53FAD47CE9063E332BC283F36"><enum>(a)</enum><header>Self-Reporting
			 requirement</header><text display-inline="yes-display-inline">Section 872(f) of
			 the Clean Contracting Act of 2008 (subtitle G of title VIII of Public Law
			 110–417; 41 U.S.C. 417b(f) is amended to read as follows:</text>

					<subsection id="H159C872D26F44FC1B5B0F9D425575259"><enum>(f)</enum><header>Self-Reporting
				requirement</header>
						<paragraph commented="no" id="H71BAD9ABA0DC4410BC6471C32DED1D65"><enum>(1)</enum><header>Contracts in
				excess of simplified acquisition threshold</header><text>No funds appropriated
				or otherwise made available by any Act may be used for any Federal contract for
				the procurement of property or services in excess of the simplified acquisition
				threshold unless the contractor has first made the certifications set forth in
				section 52.209–5 of the Federal Acquisition Regulation.</text>
						</paragraph><paragraph commented="no" id="HDE046B8C63B84078A58938B08C8FE7C7"><enum>(2)</enum><header>Contracts in
				excess of $500,000</header><text>No funds appropriated or otherwise made
				available by any Act may be used for any Federal contract for the procurement
				of property or services in excess of $500,000 unless the contractor—</text>
							<subparagraph commented="no" id="HB93FA22771E64AF7B47C6C16CE5EEDF4"><enum>(A)</enum><text>certifies that the
				contractor has submitted to the Administrator the information required under
				subsection (c) and that such information is current as of the date of such
				certification; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC526C083BFF24CE5B7FBCC58CAE74BAB"><enum>(B)</enum><text>certifies that the
				contractor has cumulative active Federal contracts and grants with a total
				value of less than
				$10,000,000.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC954AB9A9668403C98EF7096F43A2607"><enum>(b)</enum><header>Periodic
			 inspection or review of contract files</header><text>Section 872(e)(2) of the
			 Clean Contracting Act of 2008 (subtitle G of title VIII of Public Law 110–417;
			 41 U.S.C. 417b(e)(2)) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H0CB7719F33EB4F98A74C06CC80F11890" style="OLC">
					<subparagraph id="H64F8D14D7CF84DF5A5E3346970C3FABC"><enum>(C)</enum><header>Periodic
				inspection or review</header><text>The Inspector General of each Federal agency
				shall periodically—</text>
						<clause id="H78BFC67F0D744D5397E994825DDE7E01"><enum>(i)</enum><text>conduct an
				inspection or review of the contract files required under subparagraph (B) to
				determine if the agency is providing appropriate consideration of the
				information included in the database created pursuant to subsection (c);
				and</text>
						</clause><clause id="H9BAD9B095928474CA0AADBF08BAEA396"><enum>(ii)</enum><text>submit a report
				containing the results of the inspection or review conducted under clause (i)
				to the <committee-name committee-id="SSGA00">Committee on Homeland Security and
				Governmental Affairs of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Oversight and Government Reform of
				the House of
				Representatives</committee-name>.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H864EC309494548999BD53F8C88A86029"><enum>(c)</enum><header>Annual
			 report</header><text>The Comptroller General of the United States shall
			 annually submit a report to the appropriate congressional committees describing
			 the extent to which suspended or debarred contractors on the Excluded Parties
			 List System—</text>
				<paragraph id="HF9A42E4C574744FFA4DC2CEBF182B9B9"><enum>(1)</enum><text>are identified as
			 having received Federal contracts on USAspending.gov; or</text>
				</paragraph><paragraph id="H1AD81188499844C4ADEE837E9FC956FE"><enum>(2)</enum><text>were granted
			 waivers from Federal agencies from suspension or debarment for purposes of
			 entering into Federal contracts.</text>
				</paragraph></subsection></section><section id="HE34212BA51AD4A75B42A45E1AF48DF61"><enum>5.</enum><header>Consolidation of
			 contracting information databases</header>
			<subsection id="HD90818CAFC3F4B93BD7B2E6EC583D228"><enum>(a)</enum><header>In
			 general</header><text>Not later than one year after the date of the enactment
			 of this Act, the Director of the Office of Management and Budget, in
			 consultation with the Administrator of General Services, shall submit to the
			 appropriate congressional committees a plan for integrating and consolidating
			 existing contracting information databases, including the databases set forth
			 in subsection (b), into a single searchable and linked network.</text>
			</subsection><subsection id="HE33ACB04B14D4E988CB221025923C736"><enum>(b)</enum><header>Included
			 databases</header><text>The single network described in subsection (a) shall
			 include information from all relevant contracting information databases,
			 including—</text>
				<paragraph id="HE6EFF8B789F247C4A396229D0F037365"><enum>(1)</enum><text>the Excluded
			 Parties List System (EPLS);</text>
				</paragraph><paragraph id="H2F581CBE3A424686BEFFDE334C55F140"><enum>(2)</enum><text>the Central
			 Contractor Registry (CCR);</text>
				</paragraph><paragraph id="HB264E337A77548A98A56AE4960E6A5B7"><enum>(3)</enum><text>the Contractor
			 Performance Assessment Reporting System (CPARS);</text>
				</paragraph><paragraph id="H6A75C0FD72B147ADBAEE127311A72CD4"><enum>(4)</enum><text>the Federal
			 Assistance Award Data System (FAADS);</text>
				</paragraph><paragraph id="H291320619524468B8AE8846CA636AED1"><enum>(5)</enum><text>the Federal
			 Awardee Performance and Integrity Information System (FAPIIS);</text>
				</paragraph><paragraph id="HD67CFF5734614576BECE73834DDC7A01"><enum>(6)</enum><text>the Federal
			 Business Opportunities Database (FBO);</text>
				</paragraph><paragraph id="H0FD054F637C84F71A771E9F5F608FD03"><enum>(7)</enum><text>the Federal
			 Procurement Data System-Next Generation (FPDS–NG);</text>
				</paragraph><paragraph id="H7BF3247386C249B9912DE8A5C428D70B"><enum>(8)</enum><text>the Past
			 Performance Information Retrieval System (PPIRS); and</text>
				</paragraph><paragraph id="HE31AF0E0D7784F3DB11DD9197D94FE90"><enum>(9)</enum><text>USAspending.gov.</text>
				</paragraph></subsection></section><section id="H87AFE744D4AB4B29AC1F940C8E35D5E9"><enum>6.</enum><header>Unique
			 identifying number</header>
			<subsection id="HB7700431883446BCB950E6A688C77F73"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Inspector General of the General
			 Services Administration shall conduct a study on the use of identifying numbers
			 for Federal contractors to—</text>
				<paragraph id="HDDADEA331B22473C91A8D9B9C5F1C71A"><enum>(1)</enum><text display-inline="yes-display-inline">determine if the system of contractor
			 identifying numbers in use as of the date of the enactment of this Act is
			 adequately tracking Federal contractors;</text>
				</paragraph><paragraph id="HAD3288522EF24438B95170E09F9EED91"><enum>(2)</enum><text>assess the
			 feasibility of developing and adopting a new unique Federal contractor
			 identification system; and</text>
				</paragraph><paragraph id="HE15753D258A14D5689C16AE50A58D995"><enum>(3)</enum><text>determine whether
			 such a system would more effectively track Federal contractors.</text>
				</paragraph></subsection><subsection id="HD005028D8ED74F4EA2EFD7642D9D4D2D"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Inspector
			 General shall submit to the appropriate congressional committees a report on
			 the study conducted under subsection (a).</text>
			</subsection></section><section id="H922FD081FBFD41108749027DA09CB8C9"><enum>7.</enum><header>Database
			 scope</header><text display-inline="no-display-inline">Section 872(c) of the
			 Clean Contracting Act of 2008 (subtitle G of title VIII of Public Law 110–417;
			 41 U.S.C. 417(c)) is amended—</text>
			<paragraph id="HDDE62E78100F401C91051E862BC23DD3"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>5-year period</quote> and inserting
			 <quote>10-year period</quote>; and</text>
			</paragraph><paragraph id="H773D08F9D7CB4F33BAE8A23868014C37"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph id="HFDC9C07B40804D65A2D2FC5F998B7D95"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>with the Federal
			 Government</quote>;</text>
				</subparagraph><subparagraph id="H5436BF433AFA47168B4387DA5B5FA249"><enum>(B)</enum><text>in subparagraph
			 (C), by striking <quote>In an administrative proceeding, a finding of fault and
			 liability</quote> and inserting <quote>An administrative proceeding</quote>;
			 and</text>
				</subparagraph><subparagraph id="H98DC61BA9C5E4CB39A93C5A1EBAA90E9"><enum>(C)</enum><text>in subparagraph
			 (D), by striking <quote>with an acknowledgment of fault by the
			 person</quote>.</text>
