		<official-title>To amend the Outer Continental Shelf Lands Act to
		  require, as a condition and term of any exploration plan or development and
		  production plan submitted under that Act, that the applicant for the plan must
		  submit an oil spill containment and clean-up plan capable of handling a
		  worst-case scenario oil spill, and for other purposes.</official-title>

		<section id="HBB98AFC8D9E54589B38216719368184D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oil Spill Preparation and Protection
			 Act</short-title></quote>.</text>
		</section><section id="H7178EC0CB35747FF9436BC5902324BD8" section-type="subsequent-section"><enum>2.</enum><header>Offshore oil and gas
			 oil spill containment and clean-up plans</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (43
			 U.S.C. 1331 et seq.) is amended by adding at the end the following new
			 section:</text>

				<section id="HF45740BA55284CD492644C85C9DDB634"><enum>32.</enum><header>oil spill
				containment and clean-up plans</header>
					<subsection id="H0D8C905BD8894DD0A4F6C296E0472A39"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				require, as a condition and term of any exploration plan or any development and
				production plan submitted under this Act, that—</text>
						<paragraph id="H3D69C9F8EDD04A6C846EE987F7874EEC"><enum>(1)</enum><text>the applicant
				submit and implement an oil spill containment and clean-up plan capable of
				handling a worst-case scenario oil spill; and</text>
						</paragraph><paragraph id="H99FD6E791D9D416CAF9C8B648E099F46"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary and the Administrator of the
				Environmental Protection Agency must approve the plan.</text>
						</paragraph></subsection><subsection id="H29D62097483C4BD99E7865DC0EBF7F65"><enum>(b)</enum><header>Contents</header><text>The
				plan required under paragraph (1) shall—</text>
						<paragraph id="H4656CA36FA584939887A6785E0888D32"><enum>(1)</enum><text display-inline="yes-display-inline">address the factors of—</text>
							<subparagraph id="H74122FF55DF0464DB209FA9C866B8653"><enum>(A)</enum><text>a continuous oil
				spill;</text>
							</subparagraph><subparagraph id="H3E8A0D74EA554D59AE78935811BA5CAC"><enum>(B)</enum><text>depth of an oil
				spill;</text>
							</subparagraph><subparagraph id="H5B6017834CF842E19F12270E66F2BF40"><enum>(C)</enum><text>multiple
				events;</text>
							</subparagraph><subparagraph id="H7A70EE3A69F64F7586C6E528FA89FD9C"><enum>(D)</enum><text>inclement
				weather;</text>
							</subparagraph><subparagraph id="HCA9ACBB826C9437FAF116C7E8B61C8F5"><enum>(E)</enum><text>changes in
				technology;</text>
							</subparagraph><subparagraph id="HC1DCEDF909D74C36AF656C3083756203"><enum>(F)</enum><text>seafloor
				instability and processes; and</text>
							</subparagraph><subparagraph id="HD662D915A6E743128639055BABC6D1EF"><enum>(G)</enum><text>the formation of
				methane hydrates;</text>
							</subparagraph></paragraph><paragraph id="H064874BD5E6D4DEDA186F4477D90D87C"><enum>(2)</enum><text>address such other
				factors as the Secretary considers appropriate;</text>
						</paragraph><paragraph id="H469EA4C00E224FA7BFA67D6A0455B7C3"><enum>(3)</enum><text>address the
				contingency that early attempts to contain a spill may fail;</text>
						</paragraph><paragraph id="HAB9C728ECCF44E56849028BB46BAF616"><enum>(4)</enum><text>include specific
				redundancy mechanisms to contain a spill;</text>
						</paragraph><paragraph id="H7F0E3F1EB8EC45D3ABC0CE0A6B9F5C0D"><enum>(5)</enum><text>use best available
				control technology both to contain a spill and mitigate its environmental
				impacts; and</text>
						</paragraph><paragraph id="H9870C48F230740DF80D4444AED6EB2B5"><enum>(6)</enum><text>demonstrate
				adequate technology, organization, resources, and capacity to both contain and
				to prevent shoreline contamination by a significant proportion of a worst-case
				spill, and to provide for long-term clean-up and remediation of the marine and
				coastal environments.</text>
						</paragraph></subsection><subsection id="HC285DE297D2348F4B7D2B45F1B5C5D6C"><enum>(c)</enum><header>Submission to
				EPA</header><text display-inline="yes-display-inline">The Secretary shall
				submit the oil spill containment and clean-up plan to the Administrator of the
				Environmental Protection Agency for approval, denial, or approval conditional
				upon modification. The Administrator shall give approval only if the applicant
				has demonstrated adequate technology, organization, resources, and capacity
				both to contain and to prevent shoreline contamination by a significant
				proportion of a worst-case spill, and to provide for long-term clean-up and
				remediation of the marine and coastal environments.</text>
					</subsection><subsection id="HE94893C7E6484485A572641ABB5FA16B"><enum>(d)</enum><header>Lease
				cancellation</header>
						<paragraph id="HC3A934BC3B3B48EF854C8FE00F004651"><enum>(1)</enum><header>In
				general</header><text>If the holder of a lease under this Act fails to submit
				an exploration plan or development and production plan in accordance with this
				section, or fails to implement an oil spill containment and clean-up plan
				approved by the Secretary and the Administrator for purposes of this section,
				the Secretary may cancel the lease.</text>
						</paragraph><paragraph id="HDCDF108101594A58ADF8E394D46357CA"><enum>(2)</enum><header>Compensation not
				required</header><text>Cancellation of a lease under this subsection shall not
				entitle a lessee to any compensation.</text>
						</paragraph></subsection><subsection id="H19AAE39C7BCD44BF962B48CFDABC5067"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">This section shall only apply with respect
				to exploration plans and development and production plans required under leases
				under this Act issued after the date of the enactment of the
				<short-title>Oil Spill Preparation and Protection
				Act</short-title>.</text>
