		<section commented="no" display-inline="no-display-inline" id="H065F948AB4F34CC08FB4058255C1DD11" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>African Burial Ground International
			 Memorial Museum and Educational Center Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H078A3F07219448639DF474E09DC8DF0E" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H0A69B2C04CA14C478D43E6B27D94116E"><enum>(1)</enum><text display-inline="yes-display-inline">the African Burial Ground National Historic
			 Landmark in New York, New York, holds the remains of up to 20,000 enslaved
			 Africans and early-generation African-Americans from the colonial era;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD681E6E1739448D49E71C82695B82E87"><enum>(2)</enum><text display-inline="yes-display-inline">the Africans and African-Americans that
			 suffered under slavery show us the strength of the human character and provide
			 us with a model of courage, commitment, and perseverance;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6787DF1835444D26B66770D568A8ECB7"><enum>(3)</enum><text display-inline="yes-display-inline">as President George W. Bush stated on July
			 8, 2003, during his remarks at Goree Island, Senegal: “For 250 years the
			 captives endured an assault on their culture and their dignity. The spirit of
			 Africans in America did not break … All the generations of oppression under the
			 laws of man could not crush the hope of freedom and defeat the purposes of
			 God.”;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDAB44ECC263345798BFFA947A122EA04"><enum>(4)</enum><text display-inline="yes-display-inline">on February 27, 2006, President George W.
			 Bush established the National Monument, which was comprised of the
			 approximately 15,000-square foot parcel of the National Historic Landmark that
			 was bounded by Duane and Elk Streets in Lower Manhattan;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4241488D3E8C4621AF558A565F95F5EF"><enum>(5)</enum><text display-inline="yes-display-inline">an international memorial museum facility
			 dedicated to those individuals who suffered the grave injustice of slavery in
			 the United States, while at the same time helping to build the country,
			 would—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H31CDE94BA42C4CE791212242F188B971"><enum>(A)</enum><text display-inline="yes-display-inline">reflect the significance of the African
			 Burial Ground; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H032F21F4AAF045389E18FDE1BE2F4E18"><enum>(B)</enum><text display-inline="yes-display-inline">help the people of the United States
			 understand the past and honor the history of all people in the United
			 States;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H643EB23E3F7440468D3F5422A2B3C86E"><enum>(6)</enum><text display-inline="yes-display-inline">in 1998, the Secretary of the Smithsonian
			 Institution—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HE099D6E0137848A9A86254A9EB2AF3AB"><enum>(A)</enum><text display-inline="yes-display-inline">stated that the African Burial Ground
			 affords the perfect opportunity to gain insight into—</text>
					<clause commented="no" display-inline="no-display-inline" id="HD9BCB37C4D5E43B1AF4DDA5450E65D38"><enum>(i)</enum><text display-inline="yes-display-inline">the institution of slavery, as practiced in
			 urban, rural, northern, and southern parts of the United States; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H864025EC37394EC7BC64E69879132ACA"><enum>(ii)</enum><text display-inline="yes-display-inline">the international slave trade; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D44CFE16DF245DA992505432F4E3E1A"><enum>(B)</enum><text display-inline="yes-display-inline">proposed that a partnership be formed among
			 the Smithsonian, the National Park Service, and the General Services
			 Administration to further develop the African Burial Ground;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H483B6328B64C456CB7C936851054403D"><enum>(7)</enum><text display-inline="yes-display-inline">the National Museum of African American
			 History and Culture Act (20 U.S.C. 80r et seq.), which authorized construction
			 of a museum in Washington, DC, identified the period of slavery as 1 of the
			 periods of the African-American diaspora that would be encompassed by the
			 museum;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A227AD79C054D6D840C2930D9A41183"><enum>(8)</enum><text display-inline="yes-display-inline">the African Burial Ground—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H05B29C0491BC4E5CB2F3895E1569745F"><enum>(A)</enum><text display-inline="yes-display-inline">is unlike any other anthropological and
			 symbolic site in the United States or the world;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H274738972E014B7590B2660B271DB944"><enum>(B)</enum><text display-inline="yes-display-inline">includes DNA samples from the remarkably
			 well-preserved human remains that will enable researchers to trace the home
			 <quote>roots</quote> in Africa of those individuals buried at the African
			 Burial Ground; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4CF75ABDD8FC4EDEB2EA9C74B4A473F4"><enum>(C)</enum><text display-inline="yes-display-inline">provides a fitting location for a national
			 memorial facility, relating to the National Museum of African American History
			 and Culture that would—</text>
					<clause commented="no" display-inline="no-display-inline" id="H3C639409315D406EA0FC65FFAC0DAB8D"><enum>(i)</enum><text display-inline="yes-display-inline">pay special tribute to—</text>
						<subclause commented="no" display-inline="no-display-inline" id="HA170A43B39664687B0AEE2CF09A4583F"><enum>(I)</enum><text display-inline="yes-display-inline">the thousands of enslaved individuals who
			 are buried at the African Burial Ground; and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HEDCC6EFCC47C4A60A6FD461B531BB591"><enum>(II)</enum><text display-inline="yes-display-inline">all of the individuals who were enslaved
			 during the history of the United States;</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H0E7104D918984A7EB60870F00EE9F7A3"><enum>(ii)</enum><text display-inline="yes-display-inline">examine the African cultural traditions
			 brought to the United States by the enslaved; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H619456398A1D43C7939B6C23ED8D0953"><enum>(iii)</enum><text display-inline="yes-display-inline">explore in-depth the institution of
			 slavery;</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35F06ED5E9C74B9889BD026C772B2AAB"><enum>(9)</enum><text display-inline="yes-display-inline">a memorial museum at the site of the
			 African Burial Ground—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H6D002980A25144EC986CEFCA0B900053"><enum>(A)</enum><text display-inline="yes-display-inline">was first recommended by a Federal steering
			 committee in 1992; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5BA8888F1A3F4F729271A22255C197C1"><enum>(B)</enum><text display-inline="yes-display-inline">in conjunction with the planned World Trade
			 Center memorial and other nearby sites, would attract millions of visitors from
			 the United States and abroad, making a substantial contribution to the
			 development and revitalization of Lower Manhattan in response to the attacks on
			 the World Trade Center of September 11, 2001;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C9EB82D71B04C34BB9D532DA3D322B7"><enum>(10)</enum><text display-inline="yes-display-inline">Public Law 99–511 (100 Stat. 2080)
			 encouraged support for the establishment of a commemorative structure within
			 the National Park System or on other Federal land that is dedicated to the
			 promotion of understanding, knowledge, opportunity, and equality for all
			 people;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA05499F6AA424792BBDBF28FE5C9C86E"><enum>(11)</enum><text display-inline="yes-display-inline">similar to the National Museum of the
			 Native American that was established by section 3(a) of the National Museum of
			 the American Indian Act (20 U.S.C. 80q–1(a)), a memorial museum at the site of
			 the African Burial Ground would benefit from a partnership among—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H19C3462FB0B24990A3F04632888BB084"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal Government;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8590C5230EB9489B8444AD7D1CF871CE"><enum>(B)</enum><text display-inline="yes-display-inline">the State of New York;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF8C33A5A9C5A41C0BC2DF5B0A9D344E0"><enum>(C)</enum><text display-inline="yes-display-inline">the city of New York; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA03FD3CFBB82483BB7106F3D80D3369C"><enum>(D)</enum><text display-inline="yes-display-inline">members of the private sector;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE2080ED4B890408794B8629EDAF7BD66"><enum>(12)</enum><text display-inline="yes-display-inline">the African Burial Ground—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H882ADA8E018743A7ADE66BEE97178163"><enum>(A)</enum><text display-inline="yes-display-inline">has been determined to be nationally
			 significant as—</text>
					<clause commented="no" display-inline="no-display-inline" id="H1803F0B9B56C4036A19C08BEBD89A30B"><enum>(i)</enum><text display-inline="yes-display-inline">a National Historic Landmark; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H371C248DC78A4661B2F9F8D622A7F9D2"><enum>(ii)</enum><text display-inline="yes-display-inline">a National Monument; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBF759863F8384822852FC4F3E7572D6A"><enum>(B)</enum><text display-inline="yes-display-inline">provides an important opportunity for
			 interpretation, understanding, partnership and pride; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9414FB177C6B4ECF89A951F3E3464ACE"><enum>(13)</enum><text display-inline="yes-display-inline">the National Park Service—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H213C1C19B94F43BDBFA6280D552A8C56"><enum>(A)</enum><text display-inline="yes-display-inline">has played an important role in the
			 development of the African Burial Ground (including the designation of the
			 African Burial Ground as a National Monument);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE8367991AE24A708770293BAF450BDC"><enum>(B)</enum><text display-inline="yes-display-inline">successfully operates other national
			 facilities in the city of New York that symbolize freedom and the quest for
			 freedom in America, including—</text>
					<clause commented="no" display-inline="no-display-inline" id="H0289930FB1054F4FA5776A616A99F99B"><enum>(i)</enum><text display-inline="yes-display-inline">the Statue of Liberty National Monument;
			 and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H6D4F68DD8A454CF2ACEF415E879595B7"><enum>(ii)</enum><text display-inline="yes-display-inline">Ellis Island National Monument;</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5C325DFF17E40B0A857D8EF27E201C2"><enum>(C)</enum><text display-inline="yes-display-inline">provided key support to the Presidential
			 Study Commission for the National Museum of African American History and
			 Culture; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H91B307887A254CBFBA66DBDC18260442"><enum>(D)</enum><text display-inline="yes-display-inline">is well-suited to assume a leadership role
			 with respect to the creation of the Museum.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H11096CD822C6474AAB0EC1FD61F3C589" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H55C77E2BA4B749FB9B38E5A4D314F656"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the General Services Administration.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCDE930ADE758493FB5D7A5617031F241"><enum>(2)</enum><header display-inline="yes-display-inline">Advisory council</header><text display-inline="yes-display-inline">The term <term>Advisory Council</term>
			 means the African Burial Ground Advisory Council established by section
			 7(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDE7F55A9935F439089E3B35EF92A5D8F"><enum>(3)</enum><header display-inline="yes-display-inline">City</header><text display-inline="yes-display-inline">The term <term>City</term> means the city
			 of New York, New York.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB75A0DC7F01A4482ADDDE1C2559EB7A0"><enum>(4)</enum><header display-inline="yes-display-inline">Expansion property</header><text display-inline="yes-display-inline">The term <term>expansion property</term>
			 means the property that is acquired by the Secretary under section 5(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACF07A2FA0A44C10BD7EFB81381C7596"><enum>(5)</enum><header display-inline="yes-display-inline">Museum</header><text display-inline="yes-display-inline">The term <term>Museum</term> means the
			 African Burial Ground International Memorial Museum and Educational Center
			 established by section 4(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H63A6B36FA7314F0EAC3E9F1E0206115A"><enum>(6)</enum><header display-inline="yes-display-inline">National landmark</header><text display-inline="yes-display-inline">The term <term>National Landmark</term>
			 means the African Burial Ground National Historic Landmark in the City.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF4563CABF6CE467D9E419D759586690F"><enum>(7)</enum><header display-inline="yes-display-inline">National monument</header><text display-inline="yes-display-inline">The term <term>National Monument</term>
			 means the African Burial Ground National Monument in the City.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H48C6BA59980C4720BFF61EB9DB795E0A"><enum>(8)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior, acting through the Director of the National Park
			 Service.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA298E46931CA4CDD974D52CB88CF42C1"><enum>(9)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State
			 of New York.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H3246FDAB9A8E47218B1CE08051040CDB" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Establishment of Museum</header>
			<subsection commented="no" display-inline="no-display-inline" id="H3D2A88F3ABDC46C584491EC1F5D3D642"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established at the National
			 Monument a memorial museum and educational center, to be known as the
			 <quote>African Burial Ground International Memorial Museum and Educational
			 Center</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4159476A4D514334B5309187967F186B"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of the Museum are—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H22321AAD20474F85B13E116A9B97C6B1"><enum>(1)</enum><text display-inline="yes-display-inline">to serve as a permanent living
			 memorial—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H21AE31275E714BD18DB436F482F879C3"><enum>(A)</enum><text display-inline="yes-display-inline">to the enslaved who are buried at the
			 African Burial Ground; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBDAD72839D404251B2F70679A1C8B187"><enum>(B)</enum><text display-inline="yes-display-inline">to other Africans and African-Americans who
			 were enslaved;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H261994764A2A48BBA0EB0313D4A4F187"><enum>(2)</enum><text display-inline="yes-display-inline">to examine the African cultural traditions
			 brought to the United States by the enslaved;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0532475C865A404883AE937C1D7329F6"><enum>(3)</enum><text display-inline="yes-display-inline">to explore in-depth the institution of
			 slavery in the United States and other parts of the world;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CDBAA67242949B5BE1DB2DA37DB6492"><enum>(4)</enum><text display-inline="yes-display-inline">to provide a space for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H23065F7927634B519BFC839992BD69CC"><enum>(A)</enum><text display-inline="yes-display-inline">permanent and temporary exhibits;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43BBFB6696DE4BF284BFD9A5D7DE767C"><enum>(B)</enum><text display-inline="yes-display-inline">the collection and study of artifacts and
			 documents; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16D08E39B939442DB47A9F69489E7A04"><enum>(5)</enum><text display-inline="yes-display-inline">to encourage collaboration between the
			 Museum and the National Museum of African American History and Culture, other
			 museums, historically Black colleges and universities, historical societies,
			 educational institutions, and other appropriate entities and organizations,
			 including collaboration with respect to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HB4C7D1398BA44B1E874860BFE5CC6BB7"><enum>(A)</enum><text display-inline="yes-display-inline">the development of cooperative programs and
			 exhibitions, including through digital, electronic, and interactive
			 technologies;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B26C8D7CEDB4F0590F66EF3B4807DB9"><enum>(B)</enum><text display-inline="yes-display-inline">the identification, management, and care of
			 Museum collections; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE06C47333F5148E8974128304C07B03C"><enum>(C)</enum><text display-inline="yes-display-inline">the training of Museum and National Park
			 Service professionals and other persons concerned with heritage
			 preservation.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8945CB116D9C4BD29FBB729AC20C7252"><enum>(c)</enum><header display-inline="yes-display-inline">Association with national
			 museum</header><text display-inline="yes-display-inline">The Museum shall
			 become associated with the National Museum of African American History and
			 Culture, in a manner to be determined by the Secretary, in consultation with
			 the Advisory Council and the Board of Regents of the Smithsonian
			 Institution.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HAA720FC683CB451480335FDAB886D8F5" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Site acquisition and development</header>
			<subsection commented="no" display-inline="no-display-inline" id="H74E3D0A6AB2843DDA9616A12498D0BCA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
			 Administrator, the Secretary of the Smithsonian Institution, the City, the
			 State, and the Advisory Council, shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H14ADC24B654B42549EB88215BC845642"><enum>(1)</enum><text display-inline="yes-display-inline">acquire for the Museum property that is
			 located—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H2480CBB8074A4AAAB60B4ABE496BD002"><enum>(A)</enum><text display-inline="yes-display-inline">adjacent to the National Monument;
			 or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE75874DADEA54DB291E1D216B7C58870"><enum>(B)</enum><text display-inline="yes-display-inline">in any other area of the National Landmark
			 other than the location described in subparagraph (A); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H45185A7463B744F5953EEF40EA38A34F"><enum>(2)</enum><text display-inline="yes-display-inline">plan, design, and construct the Museum on
			 the property acquired under paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2564C1F132204D06AFEF5B5153B083D5"><enum>(b)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">The Secretary shall pay
			 <fraction>2/3</fraction> of the total costs of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H73F840ADF11D4791A3A720888AB10A75"><enum>(1)</enum><text display-inline="yes-display-inline">acquiring property for the Museum;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H10FB8EEF45C54DD9A7116A513416A39A"><enum>(2)</enum><text display-inline="yes-display-inline">planning, designing, constructing,
			 reconstructing, and renovating, as applicable, the Museum.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H45EDB5ADB6474D32A8D3872E818821CF"><enum>(c)</enum><header display-inline="yes-display-inline">Contracting authority</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA1579387A8494D00BE3AFAC9BFE7964E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary and the Administrator may
			 enter into any agreements with each other, the City, the State, and other
			 parties that are necessary for the acquisition, by donation or other means, of
			 property for—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5B550B56BED84168B9C0AC51D5682AAA"><enum>(A)</enum><text display-inline="yes-display-inline">establishing the Museum; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H89A20EBD496647ACA587E02C858647F8"><enum>(B)</enum><text display-inline="yes-display-inline">planning, designing, constructing,
			 reconstructing, and renovating, as applicable, the Museum.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEE8E0644657E4FF08AF06F6876A0E586"><enum>(2)</enum><header display-inline="yes-display-inline">Site acquisition</header><text display-inline="yes-display-inline">The Secretary may acquire property under
			 subsection (a)(1) by purchase, long-term lease, or any other appropriate means
			 of acquisition, as determined by the Secretary.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H03E1E52F100A464092BDC8C46FFA8590"><enum>(d)</enum><header display-inline="yes-display-inline">Expansion of National
			 Monument</header><text display-inline="yes-display-inline">The expansion
			 property is incorporated in, and shall be managed as part of, the National
			 Monument.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HEC524F42414D4106825C731AFDAEAFD4" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Operation of the Museum</header>
			<subsection commented="no" display-inline="no-display-inline" id="H43E5051AF4E04A46B7B8E93310BA7444"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
			 Advisory Council, shall operate the Museum.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H8A8A2AB677BD451FB575F87A0443CB35"><enum>(b)</enum><header display-inline="yes-display-inline">Authorities</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
			 Advisory Council, may—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HAAE853241F1B40C995126D9B496B0B19"><enum>(1)</enum><text display-inline="yes-display-inline">purchase, accept, borrow, and otherwise
			 acquire artifacts for the collections of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9B173FCD2213485ABDD2D76924B704AA"><enum>(2)</enum><text display-inline="yes-display-inline">loan, exchange, sell, and otherwise dispose
			 of any part of the collections of the Museum, if the proceeds of the
			 disposition are used for additions to the collections of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2DB8CCB388CF4F568E79E9391F9B36C4"><enum>(3)</enum><text display-inline="yes-display-inline">specify criteria with respect to the use of
			 the collections and resources of the Museum, including policies on programming,
			 education, exhibitions, and research;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H732EA32C899B41E69EB0875E48DC9B38"><enum>(4)</enum><text display-inline="yes-display-inline">provide for preservation, restoration, and
			 maintenance of the collections of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0074017763DB41768ADC6A83664CD397"><enum>(5)</enum><text display-inline="yes-display-inline">solicit, accept, use, and dispose of gifts,
			 bequests, and devises of real and personal property for the purpose of
			 facilitating the work of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H894BBA91308C41A892EA740850FD8683"><enum>(6)</enum><text display-inline="yes-display-inline">contract with such parties as may be
			 necessary to facilitate the operation of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB7FD0B97449546B3B2E64514F3566BD0"><enum>(7)</enum><text display-inline="yes-display-inline">administer the National Monument as a unit
			 of the National Park System in accordance with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H947CEDAFEC4F4D078F5C7D8284269842"><enum>(A)</enum><text display-inline="yes-display-inline">this Act; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H63C139B278434088B98F2D336242695B"><enum>(B)</enum><text display-inline="yes-display-inline">the laws generally applicable to units of
			 the National Park System, including the Act of August 25, 1916 (commonly known
			 as the <quote>National Park Service Organic Act</quote>) (16 U.S.C. 1 et seq.);
			 and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95C1BEC5E6F542DB8E2A35F1C3A549F5"><enum>(8)</enum><text display-inline="yes-display-inline">conduct any other activities that are
			 necessary to carry out the purposes of this Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD4A5577C65724F4D9F862C91CE29FE72" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Advisory council</header>
			<subsection commented="no" display-inline="no-display-inline" id="H3D387D44C0B74F87841CFD66BCCC0B9E"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established within the Department
			 of the Interior an advisory council to be known as the <quote>African Burial
			 Ground Advisory Council</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5836743E007049BB923286CCC124FBEF"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H05FF41006970499E8A685BE6AC055221"><enum>(1)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Advisory Council shall be composed of
			 the following members or their designees:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4B96E2301C7E4ADEB61F9BBEDF51F3B4"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary, who shall serve as
			 Chairperson of the Advisory Council.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0E485AB38BFE45DEB6ED51BD01916F71"><enum>(B)</enum><text display-inline="yes-display-inline">The Director of the National Park
			 Service.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7905794FDDB497388BEF6BA2BA39E87"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of the Smithsonian
			 Institution.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3DCEEA180BF7402A882D9CC76039341F"><enum>(D)</enum><text display-inline="yes-display-inline">The Administrator.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB5E2527A17004CF1A640A3A3945713EC"><enum>(E)</enum><text display-inline="yes-display-inline">The Governor of the State.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2FE85E04F49F46B2A3B3B66C7641409E"><enum>(F)</enum><text display-inline="yes-display-inline">The Mayor of the City.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAAB5C3CE68FA42A29248C00E8A4D9C22"><enum>(G)</enum><text display-inline="yes-display-inline">The President of the Borough of
			 Manhattan.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H21DC8AE6FD4F4096B3D836A9269983B6"><enum>(H)</enum><text display-inline="yes-display-inline">Fourteen members, to be appointed by the
			 Secretary, taking into consideration—</text>
						<clause commented="no" display-inline="no-display-inline" id="HB594834E79A044EC83C093A9FE8DE150"><enum>(i)</enum><text display-inline="yes-display-inline">recommendations from organizations and
			 entities that are committed to the legacy of the African Burial Ground;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H554546E5CC484641B7503FABD16EBC9C"><enum>(ii)</enum><text display-inline="yes-display-inline">recommendations from the members of the
			 Advisory Council.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4B2364767C34277962F9E691ACF7EEE"><enum>(2)</enum><header display-inline="yes-display-inline">Nonvoting members</header><text display-inline="yes-display-inline">The Secretary may appoint as nonvoting
			 members of the Advisory Council—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3D7BFC84BA214A008469AE6E876ADD7F"><enum>(A)</enum><text display-inline="yes-display-inline">members of the United States Senate;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9CA7BED00FED41438E7EFB3E97AC8282"><enum>(B)</enum><text display-inline="yes-display-inline">members of the House of
			 Representatives;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4454CFB5F26B4F41A39EAF8A59833218"><enum>(C)</enum><text display-inline="yes-display-inline">officials representing the City;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H581F1460ED78416FB522ECCB771234EB"><enum>(D)</enum><text display-inline="yes-display-inline">officials representing the State;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9C26662333C54AB6B70A3E0CDC28F0A3"><enum>(E)</enum><text display-inline="yes-display-inline">any other individuals that the Secretary,
			 in consultation with the members of the Advisory Council, determines to be
			 appropriate.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBBB21AFAEE054FA4963D32B868307EC1"><enum>(3)</enum><header display-inline="yes-display-inline">Date of appointments</header><text display-inline="yes-display-inline">The initial appointment of a member under
			 paragraph (1) shall be made not later than 180 days after the date of enactment
			 of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H940B5C49C6584CF3B3714918DD0B8978"><enum>(c)</enum><header display-inline="yes-display-inline">Terms</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H023A912D98D948D7A4D3F0E7E288F69A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), each
			 member of the Advisory Council shall be appointed for a term of 3 years.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF0BD8FC91622436A823E86A1A619080E"><enum>(2)</enum><header display-inline="yes-display-inline">Initial appointees</header><text display-inline="yes-display-inline">Of the members first appointed under
			 subsection (b)(1)(H)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4836F3A6404E4007B92EFE82DB933E02"><enum>(A)</enum><text display-inline="yes-display-inline">5 members shall be appointed for a term of
			 1 year;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40567EF213634CE0B274A9D031068687"><enum>(B)</enum><text display-inline="yes-display-inline">5 members shall be appointed for a term of
			 2 years; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD6B581E56302494E8F0D5AAC3E7B06B2"><enum>(C)</enum><text display-inline="yes-display-inline">4 members shall be appointed for a term of
			 3 years.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAEC5F8EAF3642498EFC49CF30088FFE"><enum>(3)</enum><header display-inline="yes-display-inline">Reappointment</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4572C2B2E45B4DAB884A968C112439FF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A member of the Advisory Council may be
			 reappointed, except that no individual may serve on the Advisory Council for a
			 total of more than 2 terms.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6B3BDE912EB841779A8E6DE7918B8D53"><enum>(B)</enum><header display-inline="yes-display-inline">Vacancy appointments</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the
			 number of terms an individual serves on the Advisory Council shall not include
			 any portion of a term for which an individual is appointed to fill a vacancy
			 under paragraph (4)(B).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1485B956531140C5ADF0C00AB3DE1924"><enum>(4)</enum><header display-inline="yes-display-inline">Vacancies</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H0D8BBAE7DD884921A9000490FC9DDDFC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A vacancy on the Advisory Council—</text>
						<clause commented="no" display-inline="no-display-inline" id="H582F0D81A0954D418B5E9381E0170638"><enum>(i)</enum><text display-inline="yes-display-inline">shall not affect the powers of the Advisory
			 Council; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H6CD312AA1D5F47FBB059406FAFFC15EA"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be filled in the same manner as the
			 original appointment was made.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7058EF0561FE4FB69C1F84A5E0216A75"><enum>(B)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">Any member of the Advisory Council
			 appointed to fill a vacancy occurring before the expiration of the term for
			 which the member’s predecessor was appointed shall be appointed for the
			 remainder of that term.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0AFAC3463EA44F1FB9895642F25CE5AF"><enum>(d)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Advisory Council shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HDFF2D3AF05C94A81B8E6A230E96F1A1A"><enum>(1)</enum><text display-inline="yes-display-inline">make recommendations to the Secretary on
			 the planning, design, and construction of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C52673BA59A451DA892D47852CDB00F"><enum>(2)</enum><text display-inline="yes-display-inline">advise and assist the Secretary on all
			 matters relating to the administration, operation, maintenance, and
			 preservation of the Museum;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9BF8F04A728B484891976640C2BC0D17"><enum>(3)</enum><text display-inline="yes-display-inline">provide significant opportunities for
			 public input with respect to carrying out the duties under paragraphs (1) and
			 (2); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF52673820B804F5AAE07C431A64B4810"><enum>(4)</enum><text display-inline="yes-display-inline">adopt bylaws for the operation of the
			 Advisory Council.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2675CD4BCB4247A39729810B75852733"><enum>(e)</enum><header display-inline="yes-display-inline">Compensation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HB111C57D88254275B6154FB9214D0951"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a
			 member of the Advisory Council shall serve without compensation.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE411A9E350394F96BD965A6C50ADE45E"><enum>(2)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">A member of the Council shall be allowed
			 travel expenses, including per diem in lieu of subsistence, at rates authorized
			 for an employee of an agency under subchapter I of chapter 57 of title 5,
			 United States Code, while away from the home or regular place of business of
			 the member in the performance of the duties of the Advisory Council.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9D0DA24AD5424A978788389989FEBE43"><enum>(f)</enum><header display-inline="yes-display-inline">Meetings</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HA2218E55B1B24C72983CEB0FA2C66785"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Advisory Council shall meet at the call
			 of the chairperson or on the written request of a majority of the members of
			 the Advisory Council, but not fewer than 2 times each year.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD2C873F0A6924379B2DA7579087C6B17"><enum>(2)</enum><header display-inline="yes-display-inline">Initial meetings</header><text display-inline="yes-display-inline">During the 1-year period beginning on the
			 date of the first meeting of the Advisory Council, the Advisory Council shall
			 meet not fewer than 4 times for the purpose of carrying out the duties of the
			 Advisory Council.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H657BBF2D4E3E4C03ABBFF217FA18F9C2"><enum>(g)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">A majority of the members of the Advisory
			 Council shall constitute a quorum for the purpose of conducting business, but a
			 lesser number may receive information on behalf of the Advisory Council.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H9EC76B8894BF43E8A80CA1587438CDD4" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Director and staff</header>
			<subsection commented="no" display-inline="no-display-inline" id="HF07D2C142CC8423C92B3BFD0DD63533F"><enum>(a)</enum><header display-inline="yes-display-inline">Director</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HBA996E18EC56416793E01EBDC106EFBC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall appoint a Director for
			 the Museum, taking into consideration recommendations by the Advisory
			 Council.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5E52CA45601458F8E0FCE4A89DEECC4"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Director of the Museum shall manage the
			 Museum, in accordance with any policies established by the Secretary, in
			 consultation with the Advisory Council.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H97178051420D493BB5ECDE7F8A0048C7"><enum>(b)</enum><header display-inline="yes-display-inline">Staff</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H655F856107AA4B0BBA0F1FF7131FD10E"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The Secretary may, without regard to the
			 civil service laws, appoint 2 employees to assist the Director of the Museum in
			 carrying out the duties of the Director.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H33E625E936874E5F9EFF432D52B1D271"><enum>(2)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">The employees appointed under subsection
			 (b) may be paid without regard to the provisions of chapter 51 and subchapter
			 III of chapter 53 of title 5, United States Code.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H6C07D163898540D6A2E5235B3B496E2B" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="HD19147C69DB4433DB239B027DE14723C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), there
			 are authorized to be appropriated to the Secretary to carry out this
			 Act—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H07E0F45F05924853ACE22C0FCA5996A1"><enum>(1)</enum><text display-inline="yes-display-inline">$15,000,000 for fiscal year 2008;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA0EAE767FC3F44D5A9EBBF282ACF5A5D"><enum>(2)</enum><text display-inline="yes-display-inline">such sums as are necessary for each fiscal
			 year thereafter.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE74E0333329645DBB262933E99FB1E7F"><enum>(b)</enum><header display-inline="yes-display-inline">Acquisition of museum site</header><text display-inline="yes-display-inline">There are authorized to be appropriated
			 such sums as are necessary to carry out section 5.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC6D3DA35B60E4C7EB34B976BAA81CBF9"><enum>(c)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Amounts made available under subsections
			 (a) and (b) shall remain available, without fiscal year limitation, until
			 expended.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HFFC6F669F5334180B591B3542D5F08F1"><enum>(d)</enum><header display-inline="yes-display-inline">Use of funds for fund-Raising</header><text display-inline="yes-display-inline">Amounts made available under this section
			 may be used to raise funds from private sources to support and promote the
			 Museum.</text>
