		<official-title>To amend the Outer Continental Shelf Lands Act to require
		  the making of royalty and other payments for oil that is removed under an
		  offshore oil and gas lease under that Act and discharged into waters of the
		  United States or ocean waters, and for other purposes.</official-title>

		<section id="HD483A1F6BDFE4C6683AF159349ACDC40" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oil Pollution Taxpayer and Environment
			 Protection Act</short-title></quote>.</text>
		</section><section id="HDBCF5AA04E8344E4B0252B2061057D3D"><enum>2.</enum><header>Royalties and
			 other payments under offshore oil and gas leases </header>
			<subsection display-inline="no-display-inline" id="H6441B6D00A334C4BBCCDCED255668418"><enum>(a)</enum><header>Application of
			 royalty to oil discharged under offshore oil and gas
			 leases</header><text>Section 8(a) of the Outer Continental Shelf Lands Act (43
			 U.S.C. 1337(a)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H818067A9F42242BCAF7307995CDD1456" style="OLC">
					<paragraph id="H761E52431E174388A194EA9053FB71E1" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H312DDD72817C490E8BD15443C2703483"><enum>(A)</enum><text>Notwithstanding the
				terms of any bidding otherwise authorized by paragraph (1) and the authority of
				the Secretary to reduce or eliminate royalty or net profit share under
				paragraph (3), any royalty under a lease under this section shall apply to all
				oil that is removed under the lease and discharged into waters of the United
				States or ocean waters.</text>
						</subparagraph><subparagraph id="H24BAC1D3A180417E987A122FE50CD4C2" indent="up1"><enum>(B)</enum><text>In this paragraph the term
				<term>discharged</term> means any emission (other than natural seepage),
				intentional or unintentional, and includes, but is not limited to, spilling,
				leaking, pumping, pouring, emitting, emptying, or
				dumping.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H192CE2B30E3543BF92074AECE155EB97"><enum>(b)</enum><header>Minimum royalty
			 under offshore oil and gas leases</header><text>Section 8(a) of the Outer
			 Continental Shelf Lands Act (43 U.S.C. 1336(a)) is amended—</text>
				<paragraph id="H8EC9BB1B5CEF4115A8259713C6B17B6C"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H2B35714C4EFA445FB7F20D13BA5F7790"><enum>(A)</enum><text>by striking
			 <quote>12<fraction>½</fraction> per centum</quote> each place it appears and
			 inserting <quote>20 percent</quote>;</text>
					</subparagraph><subparagraph id="H7AED207037AB485BB986275370CC3D47"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (H) by striking <quote>12
			 and <fraction>½</fraction> per centum</quote> and inserting <quote>20
			 percent</quote>;</text>
					</subparagraph><subparagraph id="H7B068C249B1E4852BBD6D70F718EE7EA"><enum>(C)</enum><text>in paragraph
			 (3)(C)(i), by inserting <quote>and paragraph (9)</quote> after <quote>other
			 than this subparagraph</quote>; and</text>
					</subparagraph><subparagraph id="HD7D669D4A9C44DE8AE18DBA91B2E3989"><enum>(D)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H3E512CA651F4407AB9EAE2EAB0103C32" style="OLC">
							<paragraph id="H0F16059ABBA94B758551301D755164F8" indent="up1"><enum>(9)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				Act, the royalty under any lease under this Act shall be not less than 20
				percent in amount or value of production saved, removed, or sold.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H83A5C28311F64FA3A48379B291767F9A"><enum>(c)</enum><header>Ensuring fair
			 return to the American taxpayer</header><text>Section 8(a) of the Outer
			 Continental Shelf Lands Act (43 U.S.C. 1336(a)) is further amended by adding at
			 the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HD0DC79E4101C4A209BE1BC4785545496" style="OLC">
					<paragraph display-inline="no-display-inline" id="H8FF9860378D349FEA29531523B76BFDF" indent="up1"><enum>(10)</enum><text display-inline="yes-display-inline">The Secretary shall—</text>
						<subparagraph id="H571CA2D5A28C4D859C15C0CE249FCBB9"><enum>(A)</enum><text>ensure that royalty and other payments
				required for each lease under this section provide a fair return to the United
				States; and</text>
						</subparagraph><subparagraph id="HC9CEC0FF5D0046C29A8294E4F36C671B"><enum>(B)</enum><text display-inline="yes-display-inline">publish in the Federal Register for each
				such lease an explanation of how such royalty and other payments were
				derived.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2B149B9DD5FD4768BD676DBDBF7FC413"><enum>(d)</enum><header>Consideration of
			 average royalty rates in other countries</header><text>Section 8(a) of the
			 Outer Continental Shelf Lands Act (43 U.S.C. 1336(a)) is further amended by
			 adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H04089B1EBC2E45B491B2FC6C9AB1942D" style="OLC">
					<paragraph display-inline="no-display-inline" id="H967442A5AB8B4E5983874F2DA8B9D647" indent="up1"><enum>(11)</enum><text display-inline="yes-display-inline">In establishing the royalty and other
				payments required for a lease under this section, the Secretary shall consider
				average rates for those payments that are required by other
				countries.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H439D439B22D8418195FAB57FED18EF82"><enum>(e)</enum><header>electronic flow
			 monitoring systems</header>
				<paragraph id="HD31812D195FC447BADC29E00104771A4"><enum>(1)</enum><header>Requirement</header><text>Section
			 8(a) of the Outer Continental Shelf Lands Act (43 U.S.C. 1336(a)) is further
			 amended by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H1A9A281BB48549D3851070A8068B6A8E" style="OLC">
						<paragraph id="HA625D12E0A7F48559132EA9100393930" indent="up1"><enum>(12)</enum><text display-inline="yes-display-inline">The Secretary shall—</text>
							<subparagraph id="H1867C67C3DAF48D9BD8AE3F646853366"><enum>(A)</enum><text>require the use of an electronic flow
				monitoring system on each well drilled under a lease under this section that
				provides an accurate accounting of oil and gas removed under the lease;
				and</text>
							</subparagraph><subparagraph id="HFBED9454F40E4E91AD825F0096C0C15E"><enum>(B)</enum><text>collect data produced by such
				system.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA11C17525CA54F7DA54672560A97E8AB"><enum>(2)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">The Secretary of the Interior shall issue a
			 rule within 90 days after the date of enactment of this Act to implement the
			 amendment made by this subsection, including the establishment of standards and
			 specifications for electronic flow monitoring systems required under the
			 amendment.</text>
				</paragraph></subsection><subsection id="H8D308829E396493384FADFFB3F8D4228"><enum>(f)</enum><header>Repeal of outer
			 Continental Shelf deep water and deep gas royalty relief</header>
				<paragraph id="HBDB21688445648CDB1AA695C37AD266E"><enum>(1)</enum><header>In
			 general</header><text>Sections 344 and 345 of the Energy Policy Act of 2005 (42
			 U.S.C. 15904, 15905) are repealed.</text>
				</paragraph><paragraph id="HF85CEDA457BE4AA7A7D55855862188F2"><enum>(2)</enum><header>Administration</header><text>The
			 Secretary of the Interior shall not be required to provide for royalty relief
			 in the lease sale terms beginning with the first lease sale held on or after
			 the date of enactment of this Act for which a final notice of sale has not been
			 published.</text>
				</paragraph></subsection></section></legis-body>
