		<section id="H19F8287056A24AFCBFCBAB3E4FB36766" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>End Big Oil Tax Subsidies Act of
			 2010</short-title></quote>.</text>
		</section><section id="H613E8E05AB80426A8B3436C9203B815C" section-type="subsequent-section"><enum>2.</enum><header>Amortization of
			 geological and geophysical expenditures</header>
			<subsection id="H846754CC376F4BB6A39392A5823862CC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 167(h)(5) of the Internal Revenue Code of 1986 is amended by striking
			 <quote>major integrated oil company</quote> and inserting <quote>covered large
			 oil company</quote>.</text>
			</subsection><subsection id="H354FC1CC53CE436595CBAEE2B983D604"><enum>(b)</enum><header>Covered large
			 oil company</header><text>Paragraph (5) of section 167(h) of such Act is
			 amended by redesignating subparagraph (B) as subparagraph (C) and by inserting
			 after subparagraph (A) the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H8F86AE7D432C4E20986EA79A79AD2607" style="OLC">
					<subparagraph id="H069DDE225E5E491786F6CE9A5EC9BA0A"><enum>(B)</enum><header>Covered large
				oil company</header><text display-inline="yes-display-inline">For purposes of
				this paragraph, the term <term>covered large oil company</term> means a
				taxpayer which—</text>
						<clause id="H9D0C808537174EA3AE45BAEB4DAA5C96"><enum>(i)</enum><text>is
				a major integrated oil company, or</text>
						</clause><clause id="H7C1E0E33CB3244DEB6BE99219B35648A"><enum>(ii)</enum><text>has gross
				receipts in excess of $50,000,000 for the taxable year.</text>
						</clause><continuation-text continuation-text-level="subparagraph">For
				purposes of clause (ii), all persons treated as a single employer under
				subsections (a) and (b) of section 52 shall be treated as 1
				person.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4104D014DCCD4B0DBB6C68CEEBA58844"><enum>(c)</enum><header>Conforming
			 amendment</header><text>The heading for paragraph (5) of section 167(h) of such
			 Code is amended by inserting <quote><header-in-text level="paragraph" style="OLC">and other large taxpayers</header-in-text></quote>.</text>
			</subsection><subsection id="H5578E997394B40CFA5BBFC035032BEF4"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to amounts
			 paid or incurred in taxable years beginning after December 31, 2010.</text>
			</subsection></section><section id="HF03C113CF9B54F72937B9797AC0588F5"><enum>3.</enum><header>Producing oil and
			 gas from marginal wells</header>
			<subsection id="HD51DBE1480FC4C57B0E1C8A673726A3A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 45I of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>

					<subsection id="H4D364920034746F2B702C0752F79B728"><enum>(e)</enum><header>Exception for
				taxpayer who is not small, independent oil and gas company</header>
						<paragraph id="H6A2F9EDF32064430B5FCB4F0C53F1B91"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subsection (a) shall
				not apply to any taxpayer which is not a small, independent oil and gas company
				for the taxable year.</text>
						</paragraph><paragraph id="HFAD3A1B0282E46C494888970C5AABC84"><enum>(2)</enum><header>Aggregation
				rule</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), all persons treated as a single employer under subsections (a)
				and (b) of section 52 shall be treated as 1

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBBC87ACDD27D484F8E942748E2DDA9F8"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply to credits determined for taxable years beginning
			 after December 31, 2010.</text>
			</subsection></section><section id="H7F11FF155BF240B092F36C35441652E6"><enum>4.</enum><header>Enhanced oil
			 recovery credit</header>
			<subsection id="H66613908F59C4D999BFD3284DD1D4FC3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 43 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>

					<subsection id="HB824154881C7492485765CF84A6A23A8"><enum>(f)</enum><header>Exception for
				taxpayer who is not small, independent oil and gas company</header>

				general</header><text display-inline="yes-display-inline">Subsection (a) shall
				not apply to any taxpayer which is not a small, independent oil and gas company
				for the taxable year.</text>

			</subsection></section><section id="HC9397A217D174BEDB4081CBD46129EAD"><enum>5.</enum><header>Intangible
			 drilling and development costs in the case of oil and gas wells</header>
			<subsection commented="no" display-inline="no-display-inline" id="H22ABB75BC5FF4E4EAEED1CFBAB8294E0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 263 of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following new sentence: <quote>This subsection shall not apply to
			 amounts paid or incurred by a taxpayer in any taxable year in which such
			 taxpayer is not a small, independent oil and gas company, determined by deeming
			 all persons treated as a single employer under subsections (a) and (b) of
			 section 52 as 1 person.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9101ADB4EAED4318B46015AEFF80C5A5"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to amounts paid or incurred in taxable years beginning
			 after December 31, 2010.</text>
			</subsection></section><section id="HFB0A3C6111D24EF794F5AB1382F699DA"><enum>6.</enum><header>Percentage
			 depletion</header>
			<subsection id="HB8A06850281E452CAACF6A42FB0F3A0B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 613A of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB42D1A84B7154853A96CCB771CE2A770" style="OLC">
					<subsection id="HB349C780854741EE9DED9BB19AEB89F9"><enum>(f)</enum><header>Exception for
				taxpayer who is not small, independent oil and gas company</header>
						<paragraph id="H81DDAF839141424097D9CFE519A5D9FA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">This section and
				section 611 shall not apply to any taxpayer which is not a small, independent
				oil and gas company for the taxable year.</text>
						</paragraph><paragraph id="HADD47A796B974F8ABC3E589979C3CA9B"><enum>(2)</enum><header>Aggregation
				rule</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), all persons treated as a single employer under subsections (a)
				and (b) of section 52 shall be treated as 1

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2826A0E69BD14BA1BE866CEDADDB3DD7"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 613A(c)(1) of such Code is amended by striking
			 <quote>subsection (d)</quote> and inserting <quote>subsections (d) and
			 (f)</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7B99F4AF16014274904BEFB6E419C93A"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to taxable years beginning after December 31,
			 2010.</text>
			</subsection></section><section id="H1B1D656486B9481FB38AF191798C5F1D"><enum>7.</enum><header>Tertiary
			 injectants</header>
			<subsection id="HDC7BD11490CE43C59FCE772A0AF1ADAD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 193 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HFEB45E667C2C401B8E334130DC1BF107" style="OLC">
					<subsection id="H14DCC6636B2F419E9BCC738E1DF962F8"><enum>(d)</enum><header>Exception for
				taxpayer who is not small, independent oil and gas company</header>
						<paragraph id="H5F8374FE890F4595B18C7F2884FBF9BC"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subsection (a) shall
				not apply to any taxpayer which is not a small, independent oil and gas company
				for the taxable year.</text>
						</paragraph><paragraph id="H75C374E6AE694F79B558F997A37092D8"><enum>(2)</enum><header>Exception for
				qualified carbon dioxide disposed in secure geological
				storage</header><text>Paragraph (1) shall not apply in the case of any
				qualified tertiary injectant expense paid or incurred for any tertiary
				injectant is qualified carbon dioxide (as defined in section 45Q(b)) which is
				disposed of by the taxpayer in secure geological storage (as defined by section
				45Q(d)).</text>
						</paragraph><paragraph id="H59DA16AE923645C0BC6381EF28C72481"><enum>(3)</enum><header>Aggregation
				rule</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), all persons treated as a single employer under subsections (a)
				and (b) of section 52 shall be treated as 1
				person.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H81C43335794B467B8E258774D1020A7F"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to expenses incurred after December 31, 2010.</text>
			</subsection></section><section id="HB0595598412E48709DC914CAB1B56D1C"><enum>8.</enum><header>Passive activity
			 losses and credits limited</header>
			<subsection id="H3C1D624C3C08435F8F8A99170B3B72E0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (3) of
			 section 469(c) of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAA947C3AF6F340A7A20661517F9E65EA" style="OLC">
					<subparagraph id="HBD5F866AD3474E9DBD81E660AEA219CC"><enum>(C)</enum><header>Exception for
				taxpayer who is not small, independent oil and gas company</header>
						<clause id="H52F911A7EFB64C5682C0690694D54C51"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subparagraph (A)
				shall not apply to any taxpayer which is not a small, independent oil and gas
				company for the taxable year.</text>
						</clause><clause id="H499AA8E51535450281EAC88F9B714342"><enum>(ii)</enum><header>Aggregation
				rule</header><text display-inline="yes-display-inline">For purposes of clause
				(i), all persons treated as a single employer under subsections (a) and (b) of
				section 52 shall be treated as 1

						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HF323BDE9796C474D8811EC1199C0E115"><enum>9.</enum><header>Income
			 attributable to domestic production activities</header>
			<subsection id="H2F9C9137AFD344C9B424DD79AF366967"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 199 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA00FED53C2D14E02A1D3D1D0859AD222" style="OLC">
					<subsection id="H3BF498760CF745A89A9B36E27CE6A705"><enum>(e)</enum><header>Exception for
				taxpayer who is not small, independent oil and gas company</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to the
				income derived from the production, transportation, or distribution of oil,
				natural gas, or any primary product (within the meaning of subsection (d)(9))
				thereof by any taxpayer which for the taxable year is an oil and gas company
				which is not a small, independent oil and gas
				company.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H26C0C687F2AE4DAABFABEDB53883F670"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to taxable years beginning after December 31,
			 2010.</text>
			</subsection></section><section display-inline="no-display-inline" id="HBFC99237D3BC45A187FDFF794E37C732" section-type="subsequent-section"><enum>10.</enum><header>Prohibition on using
			 last in, first-out accounting for major integrated oil companies</header>
			<subsection id="H2BE2CE1676B046A49F5DC984946A5A11"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 472 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HD044073F6BEF4E2F9E0B02832F641EDB" style="OLC">
					<subsection id="HED5084D55D314041A17974E1DF0D689B"><enum>(h)</enum><header>Major integrated
				oil companies</header><text display-inline="yes-display-inline">Notwithstanding
				any other provision of this section, a major integrated oil company (as defined
				in section 167(h)) may not use the method provided in subsection (b) in
				inventorying of any
				goods.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H240084E9C49E4B5D98D3401E8F011D72"><enum>(b)</enum><header>Effective date
			 and special rule</header>
				<paragraph id="HC183EDC2433E4AC9B013224406514705"><enum>(1)</enum><header>In
			 general</header><text>The amendment made by subsection (a) shall apply to
			 taxable years beginning after December 31, 2010.</text>
				</paragraph><paragraph id="H05417E2648314754A61BF300705A7DCF"><enum>(2)</enum><header>Change in method
			 of accounting</header><text display-inline="yes-display-inline">In the case of
			 any taxpayer required by the amendment made by this section to change its
			 method of accounting for its first taxable year beginning after the date of the
			 enactment of this Act—</text>
					<subparagraph id="H3E9EE1348744402A9BACAD12C2645CCF"><enum>(A)</enum><text>such change shall
			 be treated as initiated by the taxpayer,</text>
					</subparagraph><subparagraph id="H069B13D62FF54012BAD17D0D1AEC30E3"><enum>(B)</enum><text>such change shall
			 be treated as made with the consent of the Secretary of the Treasury,
			 and</text>
					</subparagraph><subparagraph id="HD5DAC7E511234AD4BC2E9B30D697FE80"><enum>(C)</enum><text>the net amount of
			 the adjustments required to be taken into account by the taxpayer under section
			 481 of the Internal Revenue Code of 1986 shall be taken into account ratably
			 over a period (not greater than 8 taxable years) beginning with such first
			 taxable year.</text>
					</subparagraph></paragraph></subsection></section><section id="HE6073192E01F4C95B1C943A2394A7646"><enum>11.</enum><header>No expensing for
			 refineries processing liquid fuel from tar sands, shale, or coal</header>
			<subsection id="H1A0BA3FD6CA04CC2885BB89AABEBAD44"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (f) of
			 section 179C of the Internal Revenue Code of 1986 is amended by striking
			 <quote>or</quote> at the end of paragraph (1), by striking the period at the
			 end of paragraph (2) and inserting <quote>, or</quote>, and by inserting after
			 paragraph (2) the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HF4356D26DE2E49A79144217F3F4DDBF2" style="OLC">
					<paragraph id="H1EF896B92FC7450A90D8F16D37BC829C"><enum>(3)</enum><text display-inline="yes-display-inline">which is used to process liquid fuel from
				tar sands, shale, or coal (including
				lignite).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF2231161AC6D4098AC32BB1463917992"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to taxable
			 years beginning after December 31, 2010.</text>
