		<official-title>To amend title XXI of the Social Security Act to require
		  States to provide priority under the State Children’s Health Insurance Program
		  (SCHIP) to children in families with gross income below 200 percent of the
		  Federal poverty level.</official-title>

		<section id="H4864E9444A344E6481C86375B8C185E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>SCHIP Expansion for Kids in Need Act of
			 2009</short-title></quote>.</text>
		</section><section id="H9113A2191AE84EA880304C28908F087D"><enum>2.</enum><header>Requiring
			 priority for SCHIP coverage of children in families with income under 200
			 percent of the Federal poverty level</header>
			<subsection id="HC9C6F1364C9A41B38C95F7A40009F64"><enum>(a)</enum><header>Data collection
			 requirement</header><text display-inline="yes-display-inline">Section 2108 of
			 the Social Security Act (42 U.S.C. 1397hh) is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA6FDFEC11B694E4AB9008238E94E827" style="OLC">
					<subsection id="H183937E93029490DBBC4BDE386A3B52B"><enum>(e)</enum><header>Inclusion of
				certain income-related data</header>
						<paragraph id="H77089B1F21764BCD815F0612A6404108"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each annual report
				under this section for each fiscal year (beginning with fiscal year 2010) shall
				include information, consistent with regulations promulgated under paragraph
				(2), on the success of the State in providing health insurance coverage for
				children at various family income levels.</text>
						</paragraph><paragraph id="HF15CAED51F24469CB1C999D9BAA95879"><enum>(2)</enum><header>Regulations</header><text>In
				order to provide consistency in the reporting of information under paragraph
				(1), the Secretary shall promulgate, not later than September 30, 2009,
				standards for data collection and statistical methodologies that must be used
				in submitting such information. Such standards shall provide for family income
				levels to be determined based on gross income relative to percentages of the
				poverty line for a family of the size
				involved.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4786A701FB1847F8BBC595D71CB674AE"><enum>(b)</enum><header>Plan for
			 coverage of low income children</header><text display-inline="yes-display-inline">Section 2101 of such Act (42 U.S.C. 1397aa)
			 is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC14C77C2D0134528998738F614674300" style="OLC">
					<subsection id="HAABF68E21CAB44969F73F12D7C068331"><enum>(e)</enum><header>Inclusion of
				plan for coverage of low income children</header>
						<paragraph id="H7A98F1F14F7F4C8C8ED6CE1D20DE47D"><enum>(1)</enum><header>Development</header><text>No
				State child health plan shall be considered approved under section 2106 for a
				fiscal year (beginning with fiscal year 2010) unless—</text>
							<subparagraph id="HFE1A8D7040FB48DDA32170FE7E2666C1"><enum>(A)</enum><text>the State has
				developed and submitted to the Secretary, not later than 6 months after the
				date of the enactment of this subsection, a plan to assure that all qualified
				low-income children (as defined in paragraph (3)) are covered by creditable
				health coverage;</text>
							</subparagraph><subparagraph id="H1124B081D5FF45D08C44123794848583"><enum>(B)</enum><text>such a plan has
				been approved under paragraph (2); and</text>
							</subparagraph><subparagraph id="H87E4119C9363466F8F7EA8F2ECB225D"><enum>(C)</enum><text>the State
				implements such plan beginning with fiscal year 2010.</text>
							</subparagraph></paragraph><paragraph id="H377EE6C6B6F9497FBD615D37FE004FD8"><enum>(2)</enum><header>Review and
				approval</header><text display-inline="yes-display-inline">The Secretary
				shall—</text>
							<subparagraph id="HED8789E4E673468994137F00723EFF53"><enum>(A)</enum><text>promptly review
				plans submitted under paragraph (1)(A);</text>
							</subparagraph><subparagraph id="H456358478C65433986B79DFBEC543390"><enum>(B)</enum><text>approve such plan
				if the Secretary determines that the plan is reasonably designed to assure the
				coverage described in such paragraph, effective as for the plan year beginning
				in fiscal year 2010; or</text>
							</subparagraph><subparagraph id="HB4BD7891CEB942B8AC868938919E2CF9"><enum>(C)</enum><text>disapprove such
				plan if the Secretary determines that the plan is not so reasonably
				designed.</text>
							</subparagraph></paragraph><paragraph id="HA5EA35CB85FA4D098502941247D814E"><enum>(3)</enum><header>Opportunity for
				resubmittal</header><text>If the Secretary disapproves a plan under paragraph
				(2)(C), the Secretary shall provide the State with an opportunity to resubmit a
				modified plan under paragraph (1)(A) that meets the requirement of paragraph
				(2)(B).</text>
						</paragraph><paragraph id="HFDC569EECA6F4A26831293E49E00D101"><enum>(4)</enum><header>Notification</header><text>The
				Secretary shall promptly notify the State involved of the approval or
				disapproval of a plan submitted under paragraph (1)(A), or resubmitted under
				paragraph (3).</text>
						</paragraph><paragraph id="HD8E297108A274B10B90764D208C749E3"><enum>(5)</enum><header>Qualified
				low-income children</header><text>In this subsection and section 2105(c)(8),
				the term <term>qualified low-income child</term> means a child—</text>
							<subparagraph id="H1E53F0E8B5F741DEB5DDBE90001FE784"><enum>(A)</enum><text>the gross income
				of whose family does not exceed 200 percent of the poverty line for a family of
				the size involved; and</text>
							</subparagraph><subparagraph id="HB6B0394302A54338ABB5D161379E4737"><enum>(B)</enum><text>who meets all
				eligibility requirements, other than those related to income, to be a targeted
				low-income
				child.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7E349E04CCB84CF5A45B3EFCE30019D2"><enum>(c)</enum><header>Limitation on
			 use of SCHIP funds</header><text display-inline="yes-display-inline">Section
			 2105(c) of such Act (42 U.S.C. 1397ee(c)) is amended by adding at the end the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H4B21B8C85D3F4A98909200F129F58662" style="OLC">
					<paragraph id="HD385C9B6D53349A48DAADAE80066AF8D"><enum>(8)</enum><header>Limitation based
				on increases in income eligibility</header>
						<subparagraph id="HE0DBF64087504A3F92AD4388984C1918"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), in the case of a State that
				increases its income eligibility level under its State child health plan above
				the level in effect as of the date of the enactment of this paragraph, payment
				shall not be made to a State under this section for any amount expended for an
				individual whose family income exceeds the income eligibility level under its
				State child health plan as of such date unless the State demonstrates to the
				satisfaction of the Secretary that no more than 10 percent of qualified
				low-income children (as defined in section 2101(e)(5)) residing in the State
				are not covered under creditable health coverage.</text>
						</subparagraph><subparagraph id="H66A561DF4B45458B9511A00014C3B05"><enum>(B)</enum><header>Safe harbor for
				qualified low-income children and currently eligible
				children</header><text>Subparagraph (A) shall not apply to limit payment under
				this section for amounts expended for—</text>
							<clause id="HD9D3F1D4BF754B65BC04B83FE0DACB4B"><enum>(i)</enum><text>qualified
				low-income children (as so defined); or</text>
							</clause><clause id="H4BB4E4E924E449C98CCE35537ED0F9E0"><enum>(ii)</enum><text>any child who
				meets eligibility standards under the State child health plan as in effect as
				of the date of the enactment of this
				paragraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
