		<official-title>To amend the Federal Property and Administrative Services
		  Act of 1949 and title 10, United States Code, to allow contracting officers to
		  consider information regarding domestic employment before awarding a Federal
		  contract, and for other purposes.</official-title>

		<section id="H80F5D5D395374C8F90D5E9BD2FAA7EAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Jobs Matter Act of
			 2010</short-title></quote>.</text>
		</section><section id="H6A1A06EE44624829A030AC727292DA4C" section-type="subsequent-section"><enum>2.</enum><header>Consideration and
			 verification of information relating to effect on domestic employment of award
			 of Federal contracts</header>
			<subsection id="HE6B4A7D1473F48AE9994866D2EFEE2BA"><enum>(a)</enum><header>Civilian agency
			 contracts</header><text display-inline="yes-display-inline">Section 303A of the
			 Federal Property and Administrative Services Act of 1949 (41 U.S.C. 253a) is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HCDB7BA9452904B268C56F30BC28015A0" style="OLC">
					<subsection id="H56034B72EF714F43A1BB5F8D6F239D79"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6594E82A3E884823A6414466D5754DF5"><enum>(1)</enum><text>An executive agency, in
				issuing a solicitation for competitive proposals, shall state in the
				solicitation that the offeror may submit information (in this subsection
				referred to as a <term>jobs impact statement</term>) with its offer related to
				the effects on employment within the United States of the contract if it is
				awarded to the offeror.</text>
						</paragraph><paragraph id="HD803B2A1627E44D69EFAE91EA6995488" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The information that may be included in a
				jobs impact statement may include the following:</text>
							<subparagraph id="H3C23055412264F20B17DD4AE2582E3D3"><enum>(A)</enum><text>The number of jobs expected to be
				created in the United States, or the number of jobs retained that otherwise
				would be lost, if the contract is awarded to the offeror.</text>
							</subparagraph><subparagraph id="HF8068A6F81A44F5E89761CC80189A45A"><enum>(B)</enum><text>The number of jobs created or retained
				in the United States by the subcontractors expected to be used by the offeror
				in the performance of the contract.</text>
							</subparagraph><subparagraph id="H7E819BE24DF8491ABEDBB805877E76BB"><enum>(C)</enum><text>A guarantee from the offeror that jobs
				created or retained in the United States will not be moved outside the United
				States after award of the contract.</text>
							</subparagraph></paragraph><paragraph id="HC23C989D53A84E22B1D1F78200B716EA" indent="up1"><enum>(3)</enum><text>The contracting officer may consider
				the information in the jobs impact statement in the evaluation of the offer and
				may request further information from the offeror in order to verify the
				accuracy of any such information submitted.</text>
						</paragraph><paragraph id="HE3EA6811B3B14B34B994BA4698FEA822" indent="up1"><enum>(4)</enum><text>The head of each executive agency
				shall submit to Congress an annual report on the frequency of use within the
				agency of jobs impact statements in the evaluation of competitive proposals.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6F478A5B65E64D20A33FC5CF6AC0C17D"><enum>(b)</enum><header>Defense
			 contracts</header><text>Section 2305(a) of title 10, United States Code, is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H0255876442104858BC5487934B6EE692" style="USC">
					<paragraph display-inline="no-display-inline" id="H53F510A8FCFD474A824FFC32B1E50C3D" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H343C30E3EA5F4B65B26DA22742898732"><enum>(A)</enum><text>The head of an agency,
				in issuing a solicitation for competitive proposals, shall state in the
				solicitation that the offeror may submit information (in this paragraph
				referred to as a <term>jobs impact statement</term>) with its offer related to
				the effects on employment within the United States of the contract if it is
				awarded to the offeror.</text>
						</subparagraph><subparagraph id="H0DAFC71F28D14E26A4CDB98064004A69" indent="up1"><enum>(B)</enum><text>The information that may be included
				in a jobs impact statement may include the following:</text>
							<clause id="H22388EBAC9E64648B36A850BF0ADD012"><enum>(i)</enum><text>The number of jobs expected to be
				created in the United States, or the number of jobs retained that otherwise
				would be lost, if the contract is awarded to the offeror.</text>
							</clause><clause id="H4DEDF6C1E0E04CBB89382B584CA9EB81"><enum>(ii)</enum><text>The number of jobs created or
				retained in the United States by the subcontractors expected to be used by the
				offeror in the performance of the contract.</text>
							</clause><clause id="HF3A7D1BC93BB4295BD0A359D4E909B0B"><enum>(iii)</enum><text display-inline="yes-display-inline">A guarantee from the offeror that jobs
				created or retained in the United States will not be moved outside the United
				States after award of the contract.</text>
							</clause></subparagraph><subparagraph id="H10A8422C088B4349B5F442838ADD8B62" indent="up1"><enum>(C)</enum><text>The contracting officer may consider
				the information in the jobs impact statement in the evaluation of the offer and
				may request further information from the offeror in order to verify the
				accuracy of any such information submitted.</text>
						</subparagraph><subparagraph id="H38D96EDCC73941CEA4F94FA82F875553" indent="up1"><enum>(D)</enum><text>The Secretary of Defense shall submit
				to Congress an annual report on the frequency of use within the Department of
				Defense of jobs impact statements in the evaluation of competitive proposals.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
