		<section id="H4147331D4AF84534877495CCE86ECEB2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Fuels Choice Act of
			 2010</short-title></quote>.</text>
		</section><section id="H4D95ED3C4E2048B7A510A495836746DF" section-type="subsequent-section"><enum>2.</enum><header>Blender pump
			 promotion</header>
			<subsection id="H8B87A5C29A574480870212484BB56D07"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HE226D5640FFB477781D511CEBD462F9E"><enum>(1)</enum><header>Blender
			 pump</header><text>The term <term>blender pump</term> means an automotive fuel
			 dispensing pump capable of dispensing at least 3 different blends of gasoline
			 and ethanol, as selected by the pump operator, including blends ranging from 0
			 percent ethanol to 85 percent denatured ethanol, as determined by the
			 Secretary.</text>
				</paragraph><paragraph id="H93F06C249A574A5BA78D4274E2D53033"><enum>(2)</enum><header>E–85
			 fuel</header><text>The term <term>E–85 fuel</term> means a blend of gasoline
			 approximately 85 percent of the content of which is ethanol.</text>
				</paragraph><paragraph id="HA3349762F8AC43C58E3A6CB68EAF6F1A"><enum>(3)</enum><header>Ethanol fuel
			 blend</header><text>The term <term>ethanol fuel blend</term> means a blend of
			 gasoline and ethanol, with a minimum of 0 percent and maximum of 85 percent of
			 the content of which is denatured ethanol.</text>
				</paragraph><paragraph id="HE6DF4BDDA2304162B71DB433D3EE363A"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph></subsection><subsection id="HCA831CCF2E3C4B15B5B843BE2D4A99BA"><enum>(b)</enum><header>Grants</header><text>The
			 Secretary shall make grants under this section to eligible facilities (as
			 determined by the Secretary) to pay the Federal share of—</text>
				<paragraph id="H1426603621B14C2D87C999FC39A1CEC5"><enum>(1)</enum><text>installing blender
			 pump fuel infrastructure, including infrastructure necessary—</text>
					<subparagraph id="HB66CDD50BAC34E148EDA3FBD2FB31550"><enum>(A)</enum><text>for the direct
			 retail sale of ethanol fuel blends (including E–85 fuel), including blender
			 pumps and storage tanks; and</text>
					</subparagraph><subparagraph id="HC0CA61952F614B029D7CC472F974ABF5"><enum>(B)</enum><text>to directly market
			 ethanol fuel blends (including E–85 fuel) to gas retailers, including inline
			 blending equipment, pumps, storage tanks, and loadout equipment; and</text>
					</subparagraph></paragraph><paragraph id="H7CA96308C99A4D93B75ACE7B63BD1E6D"><enum>(2)</enum><text>providing
			 subgrants to direct retailers of ethanol fuel blends (including E–85 fuel) for
			 the purpose of installing fuel infrastructure for the direct retail sale of
			 ethanol fuel blends (including E–85 fuel), including blender pumps and storage
			 tanks.</text>
				</paragraph></subsection><subsection id="H52AADAAC0D484754AC32AE317FE773E7"><enum>(c)</enum><header>Federal
			 share</header><text>The Federal share of the cost of a project carried out
			 under this section shall be 50 percent of the total cost of the project.</text>
			</subsection><subsection id="HD3AE217A7A274CEC9D70CEA4BA9D704C"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary to carry out this section, to remain available until expended—</text>
				<paragraph id="H3783B7DF999342D798F7FFAD7F42135E"><enum>(1)</enum><text>$50,000,000 for
			 fiscal year 2010;</text>
				</paragraph><paragraph id="H8BB97E9C1C58490E8E6730B23C9D896F"><enum>(2)</enum><text>$100,000,000 for
			 fiscal year 2011;</text>
				</paragraph><paragraph id="HCD9EAA21585F46DDB0E9668DDAD8DEC1"><enum>(3)</enum><text>$200,000,000 for
			 fiscal year 2012;</text>
				</paragraph><paragraph id="H502B93F6C0874CE38D7A764746711348"><enum>(4)</enum><text>$300,000,000 for
			 fiscal year 2013; and</text>
				</paragraph><paragraph id="HE7C0D51EDE224DBA811E3004FDFEAECF"><enum>(5)</enum><text>$350,000,000 for
			 fiscal year 2014.</text>
				</paragraph></subsection></section></legis-body>
