			 Oil Pollution Act of 1990 (33 U.S.C. 2704) is amended—</text>

					<subparagraph id="HCF585E14B9FD4590AE7A43AA8A47418F"><enum>(A)</enum><text>in paragraph (2)—</text>
						<clause id="H3B4D5F14A33D44EBBEB0E66B8FE6BB85"><enum>(i)</enum><text>by striking
			 <quote>$800,000,,</quote> and inserting <quote>$800,000,</quote>; and</text>
						</clause><clause id="H68A040259E954F2A9233F0FE9EAC9272"><enum>(ii)</enum><text>by adding
			 <quote>and</quote> after the semicolon at the end;</text>

				limits on liability specified in subsection (a) and shall by regulation revise
				such limits upward to reflect either the amount of liability that the President
				determines is commensurate with the risk of discharge of oil presented by a
				particular category of vessel or any increase in the Consumer Price Index,
				whichever is
				greater.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9C727579C81A4B88BFDC761E25AC0CEF"><enum>(b)</enum><header>Application</header><text>The
			 repeals and amendments made by this section shall apply to all claims arising
			 from events or activities occurring on or after April 19, 2010, including to
			 claims pending on or before the date of enactment of this Act.</text>
			</subsection></section><section commented="no" id="H6659F64B376C43C9B6A97A9EDAFCB57A"><enum>3.</enum><header>Evidence of financial
			 responsibility for offshore facilities</header>
			<subsection id="H0E5E61411B1143BA85FCF710791C4695"><enum>(a)</enum><header>Modification</header><text display-inline="yes-display-inline">Section 1016(c)(1) of the Oil Pollution Act
			 of 1990 (33 U.S.C. 2716(c)(1)) is amended—</text>
				<paragraph commented="no" id="H3A31BA7092C843E48D0D19BFBA22AA5A"><enum>(1)</enum><text>in subparagraph (B) by
			 striking <quote>subparagraph (A) is</quote> and all that follows before the
			 period and inserting <quote>subparagraph (A) is $1,500,000,000</quote>;</text>
				</paragraph><paragraph id="H5F1B33CB1D4344FCA805E93317C99299"><enum>(2)</enum><text>by striking subparagraph
			 (C) and inserting the following:</text>
					<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H1AE2FFF7C5F74921800753542548F1BF" reported-display-style="italic" style="OLC">
						<subparagraph id="H91877EECF31847B0987CA6FE70375102"><enum>(C)</enum><header>Greater amount</header>
							<clause id="H31D9A39A01254B289C2BAE3A3DED46B6"><enum>(i)</enum><header>Specific
				facilities</header><text display-inline="yes-display-inline">If the President
				determines that an amount of financial responsibility for a responsible party
				that is greater than the amount required by subparagraph (B) is justified based
				on the relative operational, environmental, human health, and other risks posed
				by the quantity, quality, or location of oil that is explored for, drilled for,
				produced, or transported by the responsible party, the evidence of financial
				responsibility required shall be for an amount determined by the
				President.</text>
							</clause><clause commented="no" id="H3CF08845A3694DCA8C78C61126AF54F1"><enum>(ii)</enum><header>Adjustment for all
				offshore facilities</header>
								<subclause commented="no" id="H0518639022814873B8B1E28AF8D7951D"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 3
				years after the date of enactment of the <short-title>Oil
				Spill Accountability and Environmental Protection Act of 2010</short-title>,
				and at least once every 3 years thereafter, the President shall review the
				level of financial responsibility specified in subparagraph (B) and may by
				regulation revise such level upwards to a level that the President determines
				is justified based on the relative operational, environmental, human health,
				and other risks posed by the quantity, quality, or location of oil that is
				explored for, drilled for, produced, or transported by the responsible
				party.</text>
								</subclause><subclause commented="no" id="H88A2768469F2464AA07B75FA329ED348"><enum>(II)</enum><header>Notice to
				Congress</header><text display-inline="yes-display-inline">Upon completion of a
				review specified in subclause (I), the President shall notify Congress as to
				whether the President will revise the levels of financial responsibility and
				the factors for making such
				determination.</text>
								</subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H292B8D498583459B8816E474C4229B84"><enum>(3)</enum><text>by striking subparagraph
			 (E).</text>
				</paragraph></subsection><subsection commented="no" id="H32EC7FA9B86A4FF9BE6994B89E7C12B8"><enum>(b)</enum><header>Application; Transition
			 period</header>
				<paragraph commented="no" id="H43C9D39B1B4847868C06E94CDCB299D7"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The amendments made
			 by this section shall take effect on the date of enactment of this Act and
			 shall apply to any lease for exploration, development, or production of
			 minerals, as defined by the Outer Continental Shelf Lands Act (43 U.S.C. 1331
			 et seq.), that the Secretary of the Interior awards after the date of enactment
			 of this Act.</text>
				</paragraph><paragraph commented="no" id="H6188A09B2D494F0AA7F8A69EA803EF47"><enum>(2)</enum><header>Transition
			 period</header><text>Notwithstanding paragraph (1), not later than 6 months
			 after the date of enactment of this Act, the President shall require any person
			 who holds, on the date of enactment of this Act, a lease for exploration,
			 development, or production of minerals, as defined by the Outer Continental
			 Shelf Lands Act (43 U.S.C. 1331 et seq.), located in the navigable waters,
			 adjoining shoreline, or the Exclusive Economic Zone of the United States to
			 provide evidence of financial responsibility consistent with the amendments
			 made by this section.</text>
				</paragraph></subsection></section><section commented="no" id="H80EE1ED6812E4F3394C2A1F63B4F0848"><enum>4.</enum><header>Damages to human
			 health</header>
			<subsection id="HD7AB9FCCDFF3407CBB3EDCE15C5B253D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1002(b)(2) of
			 the Oil Pollution Act of 1990 (33 U.S.C. 2702(b)(2)) is amended by adding at
			 the end the following:</text>
				<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H6DB3124BF8C649A6AB60FE6F38ADC011" reported-display-style="italic" style="OLC">
					<subparagraph commented="no" id="H8AA41E92AA4D457BA991E6AF53B51643"><enum>(G)</enum><header>Human health</header>
						<clause id="H40FD140077754A15B4630B2707CA3A54"><enum>(i)</enum><header>In
				general</header><text>Damages to human health, including fatal injuries, which
				shall be recoverable by any claimant who has a demonstrable, adverse impact to
				human health or, in the case of a fatal injury to an individual, a claimant
				filing a claim on behalf of such individual.</text>
						</clause><clause id="HD4641DE09C49400DADEC1AE426F1CC22"><enum>(ii)</enum><header>Inclusion</header><text>For
				purposes of clause (i), the term <quote>human health</quote> includes mental
				health.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6DD93FD4356E4C42B511F9B4A11BDAB2"><enum>(b)</enum><header>Application</header><text>The
			 amendment made by subsection (a) shall apply to all claims arising from events
			 or activities occurring on or after April 19, 2010, including such claims
			 pending on or before the date of enactment of this Act.</text>
			</subsection></section><section commented="no" id="H1654A5B2190949778E4E99DC0BF1B943"><enum>5.</enum><header>Clarification of
			 liability for discharges from mobile offshore drilling units</header>
			<subsection id="HF58464120AFD4FF48FEAAD4FD9BFF963"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1004(b)(2) of
			 the Oil Pollution Act of 1990 (33 U.S.C. 2704(b)(2)) is amended—</text>
				<paragraph commented="no" id="HCB5C424BA3A343D69FD971BC1639C1F0"><enum>(1)</enum><text>by striking <quote>from
			 any incident described in paragraph (1)</quote> and inserting <quote>from any
			 discharge of oil, or substantial threat of a discharge of oil, into or upon the
			 water</quote>; and</text>
				</paragraph><paragraph commented="no" id="H5DD650B176674A70AEB82144DADC6EE2"><enum>(2)</enum><text>by striking
			 <quote>liable</quote> and inserting <quote>liable as described in paragraph
			 (1)</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4AAFF790E26C4755A25D5E4DE37B10AA"><enum>(b)</enum><header>Application</header><text>The
			 amendments made by subsection (a) shall apply to all claims arising from events
			 or activities occurring on or after April 19, 2010, including such claims
			 pending on or before the date of enactment of this Act.</text>
			</subsection></section><section id="H774C8C433A8E4999B24D9852214BCF59"><enum>6.</enum><header>Standard of review for
			 damage assessment</header><text display-inline="no-display-inline">Section
			 1006(e)(2) of the Oil Pollution Act of 1990 (33 U.S.C. 2706(e)(2)) is
			 amended—</text>
			<paragraph id="HDF77132C71174571BCD512BCAFF0A100"><enum>(1)</enum><text>in the heading by
			 striking <quote><header-in-text level="paragraph" style="OLC">Rebuttable
			 presumption</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Judicial review of assessments</header-in-text></quote>; and</text>
			</paragraph><paragraph id="HE0F266F2C897454EA30B6C93ACD4AA7F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>have the force and
			 effect</quote> and all that follows before the period and inserting the
			 following: <quote>be subject to judicial review under subchapter II of chapter
			 5 of title 5, United States Code (commonly known as the Administrative
			 Procedure Act), on the basis of the administrative record developed by the lead
			 Federal trustee as provided in such regulations</quote>.</text>
			</paragraph></section><section id="HF1B9D2EC5DBE44DBADEABA57A70D2C36"><enum>7.</enum><header>Information on
			 claims</header>
			<subsection id="H9F10454601A343029E4FF9FFE235B169"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title I of the Oil
			 Pollution Act of 1990 (33 U.S.C. 2701 et seq.) is amended by inserting after
			 section 1013 the following:</text>

				of national significance, the President may require a responsible party or a
				guarantor of a source designated under section 1014(a) to provide to the
				President any information on or related to claims, either individually, in the
				aggregate, or both, that the President requests, including—</text>
						<paragraph id="H795B26347858408393AFB277C05632A5"><enum>(1)</enum><text>the transaction date or
				dates of such claims, including processing times; and</text>
						</paragraph><paragraph id="HDF3A6747F5B740DC95E67F2313C72917"><enum>(2)</enum><text>any other data pertaining
				to such claims necessary to ensure the performance of the responsible party or
				the guarantor with regard to the processing and adjudication of such
				claims.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5BB1B12C82144239B3082D5ABB5A57DA"><enum>(b)</enum><header>Conforming

			 Act</header>

			 general</header><text>The Death on the High Seas Act (chapter 303 of title 46,
			 United States Code), is amended—</text>
				<paragraph id="H10860EEEB7B24F59B48A62897DA5FF64"><enum>(1)</enum><text>in section 30302—</text>
					<subparagraph id="H53ED36431D274228AF4A67E67734E923"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or law</quote> after
			 <quote>admiralty</quote>; and</text>
					</subparagraph><subparagraph id="H66F8346FCC784CFC805E71BD05BD25EF"><enum>(B)</enum><text>by striking the last
			 sentence and inserting <quote>The action shall be for the exclusive benefit of
			 the survivors, including the decedent’s spouse, parent, child, or dependent

			</subsection></section><section id="H3755E710ABA14446916BF801A8657A97" section-type="subsequent-section"><enum>11.</enum><header>Americanization of
			 offshore operations in the Exclusive Economic Zone</header>
			<subsection id="HAC2BAFC83EB84EFE9F9C73B2C60480E9"><enum>(a)</enum><header>Registry endorsement
			 required</header>
				<paragraph id="H72ED1347A769435894F89E7B576A73D3"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 12111 of
			 title 46, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H9814F3D0583F49E8B09A2F3016531220" reported-display-style="italic" style="USC">
						<subsection id="H65DA12518F754DEDA0319CA03E05D541"><enum>(e)</enum><header>Resource activities in

				requiring an endorsement under sections 12112 or 12113, only a vessel for which
				a certificate of documentation with a registry endorsement is issued and that
				is owned by a citizen of the United States (as determined under section
				50501(d)) may engage in support of exploration, development, or production of
				resources in, on, above, or below the exclusive economic zone or any other
				activity in the exclusive economic zone to the extent that the regulation of
				such activity is not prohibited under customary international
				law.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H29551BF6040048A5AE705EBE7BC51288"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) applies
			 only with respect to exploration, development, production, and support
			 activities that commence on or after July 1, 2011.</text>
				</paragraph></subsection><subsection commented="no" id="HD5C89071D21F4DB6B79612E23DF2D5D2"><enum>(b)</enum><header>Legal
			 authority</header><text>Section 2301 of title 46, United States Code, is
			 amended—</text>
				<paragraph commented="no" id="H1679F6BCC1C6491DA87B5CF09DF7B5F3"><enum>(1)</enum><text>by striking
			 <quote>chapter</quote> and inserting <quote>title</quote>; and</text>
				</paragraph><paragraph commented="no" id="H38807EB03CDF4CBAB2CF5CB6680EB0F2"><enum>(2)</enum><text>by inserting after
			 <quote>1988</quote> the following: <quote>and the exclusive economic zone to
			 the extent that the regulation of such operation is not prohibited under
			 customary international law</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H5554CACAF1824B63B6A9B383CF4BCAC6"><enum>(c)</enum><header>Training for Coast
			 Guard personnel</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Secretary of the department in which the Coast Guard
			 is operating shall establish a program to provide Coast Guard personnel with
			 the training necessary for the implementation of the amendments made by this
			 section.</text>
			</subsection></section><section id="H45D1B2330B6E47F4B6771529A09BAB34"><enum>12.</enum><header>Safety management
			 systems for mobile offshore drilling units</header><text display-inline="no-display-inline">Section 3203 of title 46, United States
			 Code, is amended—</text>
			<paragraph id="HA34E3899C217406DA51BBE7A4C5ED9C8"><enum>(1)</enum><text>by redesignating
			 subsection (b) as subsection (c); and</text>
			</paragraph><paragraph id="HDDD773193D544295B3510C137F3B8A5A"><enum>(2)</enum><text>by inserting after
			 subsection (a) the following:</text>
				<quoted-block changed="added" committee-id="HPW00" id="HEB99306A61EE4BCF88B3721B3C0B8A39" reported-display-style="italic" style="OLC">
					<subsection id="HA8243F3EF907408A89574078A8D0D80D"><enum>(b)</enum><header>Mobile offshore
				drilling units</header><text>The safety management system described in
				subsection (a) for a mobile offshore drilling unit operating in waters subject
				to the jurisdiction of the United States (including the exclusive economic
				zone) shall include processes, procedures, and policies related to the safe
				operation and maintenance of the machinery and systems on board the unit that
				are used for the industrial business and functions of the unit, including
				drilling
				operations.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H59F65459830A40B88BCE87BAE922FF9F"><enum>13.</enum><header>Safety standards for
			 mobile offshore drilling units</header><text display-inline="no-display-inline">Section 3306 of title 46, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H847A1D0C7E5A4F2F8EBF65C1A8FA2D94" reported-display-style="italic" style="OLC">
				<subsection id="H0068185B364E40B6A5468886E2248F99"><enum>(k)</enum><text display-inline="yes-display-inline">In prescribing regulations for mobile
				offshore drilling units, the Secretary shall develop standards to address a
				worst-case event involving a discharge as that term is defined in section 1001
				of the Oil Pollution Act of 1990 (33 U.S.C.
				2701).</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6D0B567D238A461EA96167C256DEAF55"><enum>14.</enum><header>Coast Guard marine
			 safety workforce</header>
			<subsection id="HC00FAF6E7E7A454888DD5D0924739E43"><enum>(a)</enum><header>In
			 general</header><text>Chapter 5 of title 14, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H4F2BF58F9CFD4F09B5A94E5E3CB307D6" reported-display-style="italic" style="USC">
					<section id="HFA6CCBA0EBAD45CBAE48071DBB031612"><enum>99.</enum><header>Marine safety
				workforce</header>
						<subsection id="H0D29E12B63034529AEAEAEDC5AAF553C"><enum>(a)</enum><header>Marine safety
				workforce</header><text display-inline="yes-display-inline">The Secretary,
				acting through the Commandant—</text>
							<paragraph id="HBD34913EC545460B9EB5D820801BF9DE"><enum>(1)</enum><text>shall designate a
				sufficient number of positions to be in the Coast Guard’s marine safety
				workforce to perform vessel inspections and marine casualty investigations;
				and</text>
							</paragraph><paragraph id="H5D603B5D08DC46A2B03D899FC185E46C"><enum>(2)</enum><text>shall ensure that a
				sufficient number of fully qualified officers, members, and civilian employees
				of the Coast Guard are assigned to those positions.</text>
							</paragraph></subsection><subsection id="HAAD2F79415324A7BBBB8B69E3D622108"><enum>(b)</enum><header>Career
				paths</header><text display-inline="yes-display-inline">The Secretary, acting
				through the Commandant, shall ensure that appropriate career paths for an
				officer, member, or civilian employee of the Coast Guard who wishes to pursue a
				career in marine safety are identified in terms of the education, training,
				experience, and assignments necessary for career progression to the most senior
				marine safety positions. The Secretary shall make available published
				information on such career paths.</text>
						</subsection><subsection id="HA011AC1B959B448093278CD372567260"><enum>(c)</enum><header>Qualifications</header><text>With
				regard to the marine safety workforce, an officer, member, or civilian employee
				of the Coast Guard assigned as a—</text>
							<paragraph id="H4B89B4415BAB44878F917ABB49B04FAB"><enum>(1)</enum><text>marine inspector shall
				have the training, experience, and qualifications equivalent to that required
				for a similar position at a classification society recognized by the Secretary
				under section 3316 of title 46 for the type of vessel, system, or equipment
				that is inspected;</text>
							</paragraph><paragraph id="H8C93B44802B144C1AFB5233D2874595F"><enum>(2)</enum><text>marine casualty
				investigator shall have training, experience, and qualifications in
				investigation, marine casualty reconstruction, evidence collection and
				preservation, human factors, and documentation using best investigation
				practices by Federal and non-Federal entities;</text>
							</paragraph><paragraph id="HD6216F7B0A6D453084591CC89D6A34AA"><enum>(3)</enum><text>marine safety engineer
				shall have knowledge, skill, and practical experience in—</text>
								<subparagraph id="H8297559BDE674F47B0170EB0AD67C383"><enum>(A)</enum><text>the construction and
				operation of commercial vessels;</text>
								</subparagraph><subparagraph id="H8019CF39B9BF484DAD67F10710785B2A"><enum>(B)</enum><text>judging the character,
				strength, stability, and safety qualities of such vessels and their equipment;
				or</text>
								</subparagraph><subparagraph id="H2F7C115998BE43C89DF530A1446BFA87"><enum>(C)</enum><text>the qualifications and
				training of vessel personnel; or</text>
								</subparagraph></paragraph><paragraph id="HEC3EF63C0AF74F31BA835BB3B9BEDF54"><enum>(4)</enum><text display-inline="yes-display-inline">marine inspector inspecting mobile offshore
				drilling units shall have knowledge, skill, and practical experience in—</text>
								<subparagraph id="H15359D5EF2D3419A91E94CA3458B625C"><enum>(A)</enum><text>Federal, State, and
				international law compliance;</text>
								</subparagraph><subparagraph id="HA78960EB589F4F93B0FA89D015ECB0CF"><enum>(B)</enum><text>personnel
				training;</text>
								</subparagraph><subparagraph id="H3EC259F70A4243CB89CA24DBA3F2B000"><enum>(C)</enum><text>drilling
				operations;</text>
								</subparagraph><subparagraph id="H5BA1B3EE2D1A4B8CB85E2E4C5EB2F6B0"><enum>(D)</enum><text>mobile offshore drilling
				unit and maritime safety;</text>
								</subparagraph><subparagraph id="H65D3C9A8A91846C7B9EE3EB22DBF821D"><enum>(E)</enum><text>the effect of weather on
				mobile offshore drilling unit safety and operations;</text>
								</subparagraph><subparagraph id="HE4559851616E4694AD7B0ABCE00E8673"><enum>(F)</enum><text>ship handling and
				positioning; and</text>
								</subparagraph><subparagraph id="H59E780862E6948E1AEAD94D798844F6C"><enum>(G)</enum><text>emergency
				procedures.</text>
								</subparagraph></paragraph></subsection><subsection id="HF28FAF80B134441A85702845AD5E22AD"><enum>(d)</enum><header>Apprenticeship
				requirements</header>
							<paragraph id="H50712426AF134CE5A473BCAEA9E891EF"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">An officer, member,
				or civilian employee of the Coast Guard in training to become a marine
				inspector, marine casualty investigator, or a marine safety engineer shall
				serve a minimum of one-year apprenticeship, unless otherwise directed by the
				Commandant, under the guidance of a qualified marine inspector (including an
				inspector of mobile offshore drilling units), marine casualty investigator, or
				marine safety engineer. The Commandant may authorize shorter apprenticeship
				periods for certain qualifications, as appropriate.</text>
							</paragraph><paragraph id="HBF1E62F46A4C43FDA5DEBEED6511CFC3"><enum>(2)</enum><header>Highly specialized
				vessels</header>
								<subparagraph id="H01CC9DD6C68745E8B14BC97A0FC9CF39"><enum>(A)</enum><header>In
				general</header><text>In addition to the requirement under paragraph (1), any
				officer, member, or employee of the Coast Guard assigned as a marine inspector
				or marine casualty investigator with responsibility for inspecting or
				responding to casualties involving highly specialized vessels must have served
				a minimum of 6 months apprenticeship with those vessels.</text>
								</subparagraph><subparagraph id="H8E377B502CDF4ECAA47BD0CD7A46111D"><enum>(B)</enum><header>Highly specialized
				vessels defined</header><text>In this paragraph the term <term>highly
				specialized vessel</term> includes mobile offshore drilling units, tank
				vessels, and vessels carrying certain dangerous cargoes as defined by the
				Commandant.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCF35A2FE3BF64D9A952E0B092212D5A8"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The analysis at the
			 beginning of such chapter is amended by adding at the end the following:</text>

			 report</header><text>The Secretary of the department in which the Coast Guard
			 is operating shall review and report to Congress on the needs of maritime
			 safety and security teams participating in patrols and setup of safety zones
			 for, and management of, the discharge of oil that began in 2010 in connection
			 with the explosion on, and sinking of, the mobile offshore drilling unit
			 <italic>Deepwater Horizon</italic>.</text>

			 substances</header><text display-inline="yes-display-inline">Section 311(d) of
			 the Federal Water Pollution Control Act (33 U.S.C. 1321(d)) is amended by
			 adding at the end the following:</text>

				enactment of this paragraph, the President, acting through the Administrator,
				after providing notice and an opportunity for public comment, shall issue a
				revised regulation for the development of the schedule for the use of
				dispersants, other chemicals, and other spill mitigating devices and substances
				developed under paragraph (2)(G) in a manner that is consistent with the
				requirements of this paragraph and shall modify the existing schedule to take
				into account the requirements of the revised regulation.</text>
						</subparagraph><subparagraph id="H1CDF42C83EFD4BD3BB618850F2182E37"><enum>(B)</enum><header>Schedule listing
				requirements</header><text display-inline="yes-display-inline">In issuing the
				regulation under subparagraph (A), the Administrator shall—</text>
							<clause id="HBDF2EEC6BF0C49FEBAF93375E604B3BD"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to dispersants, other
				chemicals, and other spill mitigating substances included or proposed to be
				included on the schedule under paragraph (2)(G)—</text>
								<subclause id="H1531C9B830D7469FA70802E81E2031F6"><enum>(I)</enum><text>establish minimum
				toxicity and efficacy testing criteria, taking into account the results of the
				study carried out under subparagraph (C);</text>
								</subclause><subclause id="HAC004BAF3DD14B199969F4A004F5E8AC"><enum>(II)</enum><text>provide for testing or
				other verification (independent from the information provided by an applicant
				seeking the inclusion of such dispersant, chemical, or substance on the
				schedule) related to the toxicity and effectiveness of such dispersant,
				chemical, or substance;</text>
								</subclause><subclause id="H24FF605EABD541868C39E06B5571C60B"><enum>(III)</enum><text>establish a framework
				for the application of any such dispersant, chemical, or substance,
				including—</text>
									<item id="HF562BD7C5683495893CF30CEB27599AA"><enum>(aa)</enum><text>quantity restrictions or
				application conditions;</text>
									</item><item id="H3D8EA1D183794250BBCBB5E7B515D4D2"><enum>(bb)</enum><text>the quantity thresholds
				for which consultation with and approval by the Regional Response Team and the
				Federal On-Scene Coordinator is required;</text>
									</item><item id="H0C887001B74D4AAD880214B7FE7DEC0C"><enum>(cc)</enum><text>the criteria to be used
				to develop the appropriate maximum quantity of any such dispersant, chemical,
				or substance that the Administrator determines may be used, both on a daily and
				cumulative basis; and</text>
									</item><item id="HA6C6CDE7E7B64AC2A84EBCFE8CEA9677"><enum>(dd)</enum><text display-inline="yes-display-inline">a ranking, by geographic area, of any such
				dispersant, chemical, or substance based on a combination of its effectiveness
				for each type of oil and its level of toxicity;</text>
									</item></subclause><subclause id="HBAC06805773C493A922DC2226690F903"><enum>(IV)</enum><text display-inline="yes-display-inline">establish a requirement that the volume of
				oil or hazardous substance discharged, and the volume and location of any such
				dispersant, chemical, or substance used, be measured and made publicly
				available;</text>
								</subclause><subclause id="HCF7673A78FE54A6EA576C74B93A71E78"><enum>(V)</enum><text>notwithstanding any other
				provision of law, require the public disclosure of the specific chemical
				identity, including the chemical and common name of any ingredients contained
				in, and specific chemical formulas or mixtures of, any such dispersant,
				chemical, or substance; and</text>
								</subclause><subclause id="HEB23EF3ABF9F429E8AA10BAD53622773"><enum>(VI)</enum><text>in addition to existing
				authority, expressly provide a mechanism for the delisting of any such
				dispersant, chemical, or substance based on any information made available to
				the Administrator that demonstrates that such dispersant, chemical, or
				substance poses a significant risk to or impact on human health or the
				environment;</text>
								</subclause></clause><clause id="HDD47891069454E9BB3F4C1FB32F703B3"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to a dispersant, other
				chemical, and other spill mitigating substance not specifically identified on
				the schedule, and prior to the use of such dispersant, chemical, or substance
				in accordance with paragraph (2)(G), establish—</text>
								<subclause id="HCA7C95B43A20457787129C2B3D246E9F"><enum>(I)</enum><text>the minimum toxicity and
				efficacy levels for such dispersant, chemical, or substance;</text>
								</subclause><subclause id="H4351A44F4D5744538AABF20C50D6E2F1"><enum>(II)</enum><text>the information,
				including the specific chemical identity, formula, and mixtures, on such
				dispersant, other chemical, or other spill mitigating substance that shall be
				made publicly available; and</text>
								</subclause><subclause id="HF6A9A2B5DBC045D18571D94500CEF649"><enum>(III)</enum><text>such additional
				information as the Administrator determines necessary; and</text>
								</subclause></clause><clause id="H3F6FEB9A408F41EF91F56B18D986EA86"><enum>(iii)</enum><text>with respect to other
				spill mitigating devices included or proposed to be included on the schedule
				under paragraph (2)(G)—</text>
								<subclause id="HF1FC2FEB94C7426D856212DFF64C17E9"><enum>(I)</enum><text>require the manufacturer
				of such device to carry out a study of the risks and effectiveness of the
				device according to guidelines developed and published by the Administrator;
				and</text>
								</subclause><subclause id="H2F2FD261A08849A1A2D46DB8AB879B45"><enum>(II)</enum><text>in addition to existing
				authority, expressly provide a mechanism for the delisting of any such device
				based on any information made available to the Administrator that demonstrates
				that such device poses a significant risk to or impact on human health or the
				environment.</text>
								</subclause></clause></subparagraph><subparagraph id="HE7CDFA89D0614AB2A3EAC7ABE6437124"><enum>(C)</enum><header>Study</header>
							<clause id="H6EC502D78A6F4C31AB6C123352764B7C"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 3
				months after the date of enactment of this paragraph, the Administrator shall
				initiate a study of the potential risks and impacts to human health and the
				environment, including acute and chronic risks, from the use of dispersants,
				other chemicals, and other spill mitigating substances, if any, that may be
				used to carry out the National Contingency Plan, including an assessment of
				such risks and impacts—</text>
								<subclause id="HA9DCD9DA35BC42478E97D2679D0073B2"><enum>(I)</enum><text display-inline="yes-display-inline">on a representative sample of biota and
				types of oil from locations where such dispersants, chemicals, or substances
				may potentially be used;</text>
								</subclause><subclause id="H692775972F2843C8BE14774147221B7D"><enum>(II)</enum><text>on human health,
				including individuals most likely to come into contact with such dispersants,
				chemicals, or substances, such as oil spill response action workers; and</text>
								</subclause><subclause id="HF237264D2D3842008D91760B9B7D3449"><enum>(III)</enum><text>that result from any
				by-products created from the use of such dispersants, chemicals, or
				substances.</text>
								</subclause></clause><clause id="HB0DCDAE90DFB4B298E5D6958A6D8345B"><enum>(ii)</enum><header>Information from
				manufacturers</header>
								<subclause id="HCCB125E554FA494E98332CA98EAD3832"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">In conjunction with
				the study authorized by clause (i), the Administrator shall determine the
				requirements for manufacturers of dispersants, chemicals, or substances to
				evaluate the potential risks and impacts to human health and the environment,
				including acute and chronic risks, associated with the use of the dispersants,
				chemicals, or substances and any byproducts generated by such use and to
				provide the details of such evaluation as a condition for listing on the
				schedule according to guidelines developed and published by the
				Administrator.</text>
								</subclause><subclause id="HAE2A3358F3604C8FABFA6F7AEA31C8D3"><enum>(II)</enum><header>Minimum requirements
				for evaluation</header><text display-inline="yes-display-inline">Any evaluation
				carried out by a manufacturer under this clause shall include—</text>
									<item id="H06F8299BB63C42A4BB3B74F4833FCB2B"><enum>(aa)</enum><text display-inline="yes-display-inline">information on the oils and locations where
				such dispersants, chemicals, or substances may potentially be used;</text>
									</item><item id="H88A02879CE2F434C89767C7221C74EDA"><enum>(bb)</enum><text>an evaluation of the
				variety of different dispersants, chemicals, or substances that may be used in
				a response; and</text>
									</item><item id="H983FCD28AC94410CA1C154FF08DB740A"><enum>(cc)</enum><text>an assessment of
				application and impacts from subsea use of the dispersant, chemical, or
				substance, including the potential long term effects of such use.</text>
									</item></subclause></clause></subparagraph><subparagraph id="H4A1FCC0E7CDB45DEB8831515560AC82E"><enum>(D)</enum><header>Periodic
				revisions</header>
							<clause id="H98BEFB3035F54071B66FB92E6EAAE1DB"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 5
				years after the date of the issuance of the regulation under this paragraph,
				and at least once every 5 years thereafter, the Administrator shall review the
				schedule for the use of dispersants, other chemicals, and other spill
				mitigating devices and substances that may be used to carry out the National
				Contingency Plan and update or revise the schedule, as necessary, to ensure the
				protection of human health and the environment.</text>
							</clause><clause id="HB492F9B90C854A4CBBC894B1114294A4"><enum>(ii)</enum><header>Effectiveness</header><text display-inline="yes-display-inline">The Administrator shall ensure, to the
				maximum extent practicable, that each update or revision to the schedule
				increases the minimum effectiveness value necessary for listing a dispersant,
				other chemical, or other spill mitigating device or substance on the
				schedule.</text>
							</clause></subparagraph><subparagraph id="H0F610A2637C641AA86EB4931FF7C8816"><enum>(E)</enum><header>Approval of use and
				application of dispersants</header>
							<clause id="H5BF0A89B9FE9400297E89EB88299B6C4"><enum>(i)</enum><header>In
				general</header><text>In issuing the regulation under subparagraph (A), the
				Administrator shall require the approval of the Federal On-Scene Coordinator,
				in coordination with the Administrator, for all uses of a dispersant, other
				chemical, or other spill mitigating substance in any removal action,
				including—</text>
								<subclause id="H2928ADE606BD4959AEADE8540AE90417"><enum>(I)</enum><text>any such dispersant,
				chemical, or substance that is included on the schedule developed pursuant to
				this subsection; or</text>
								</subclause><subclause id="H1BEC0D7CFE664B52920A5A99536F3CA6"><enum>(II)</enum><text>any dispersant,
				chemical, or other substance that is included as part an approved area
				contingency plan or response plan developed under this section.</text>
								</subclause></clause><clause commented="no" id="H38366C052F66486A99AC63AE5C0F60AA"><enum>(ii)</enum><header>Repeal</header><text>Any
				part of section 300.910 of title 40, Code of Federal Regulations, that is
				inconsistent with this paragraph is hereby repealed.</text>
							</clause></subparagraph></paragraph><paragraph id="HE0CDEFFB3622422DA374C7676FE8D2BF"><enum>(6)</enum><header>Review of and
				Development of Criteria for Evaluating Response Plans</header>
						<subparagraph id="HAEB30702E8BF485E97CBBE0372EE3837"><enum>(A)</enum><header>Review</header><text>Not
				later than 6 months after the date of enactment of this paragraph, the
				President shall review the procedures and standards developed under paragraph
				(2)(J) to determine their sufficiency in ceasing and removing a worst case
				discharge of oil or hazardous substances, and for mitigating or preventing a
				substantial threat of such a discharge.</text>
						</subparagraph><subparagraph id="H8B74A6883552427F915173431BB7A000"><enum>(B)</enum><header>Rulemaking</header><text>Not
				later than 1 year after the date of enactment of this paragraph, the President,
				after providing notice and an opportunity for public comment, shall undertake a
				rulemaking to—</text>
							<clause id="HB538535A41324B7D9BE510B0369F37CD"><enum>(i)</enum><text>revise the procedures and
				standards for ceasing and removing a worst case discharge of oil or hazardous
				substances, and for mitigating or preventing a substantial threat of such a
				discharge; and</text>
							</clause><clause id="HEFB28DE8CF554B62925C8E4F8D58F985"><enum>(ii)</enum><text>develop a metric for
				evaluating the National Contingency Plan, Area Contingency Plans, and tank
				vessel, nontank vessel, and facility response plans consistent with the
				procedures and standards developed pursuant to this
				paragraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE498EC4413F34939AD151AD88E7701C4"><enum>(c)</enum><header>Inclusion of
			 containment booms in Area Contingency Plans</header><text display-inline="yes-display-inline">Section 311(j)(4)(C)(iv) of such Act (33
			 U.S.C. 1321(j)(4)(C)(iv)) is amended by striking <quote>(including firefighting
			 equipment)</quote> and inserting <quote>(including firefighting equipment and
			 containment booms)</quote>.</text>
			</subsection></section><section commented="no" id="H6D3A74BAC2134B6F9161D5FAB8013733"><enum>20.</enum><header>Tracking
			 Database</header><text display-inline="no-display-inline">Section 311(b) of the
			 Federal Water Pollution Control Act (33 U.S.C. 1321(b)) is amended by adding at

				database</header>
					<subparagraph commented="no" id="H9487209BC2EC4117B686C1BB6BCF41DA"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President shall
				create a database to track all discharges of oil or hazardous
				substances—</text>
						<clause commented="no" id="HA9604FDF34A6416A93C114C66C02DEF3"><enum>(i)</enum><text>into the waters of the
				United States, adjoining shorelines, or into or upon the waters of the
				contiguous zone;</text>
						</clause><clause id="HF162011F803043F1ABAE60204A811E78"><enum>(ii)</enum><text>in connection with
				activities under the Outer Continental Shelf Lands Act (43 U.S.C. 1331 et seq.)
				or the Deepwater Port Act of 1974 (33 U.S.C. 1501 et seq.); or</text>
						</clause><clause id="HE232365F410D4EDFA4DBB30CF9B2F55D"><enum>(iii)</enum><text>which may affect
				natural resources belonging to, appertaining to, or under the exclusive
				management authority of the United States (including resources under the
				Fishery Conservation and Management Act of 1976 (16 U.S.C. 1801 et
				seq.)).</text>
						</clause></subparagraph><subparagraph commented="no" id="HDC7BDED86CF44F06A3C4D2394424D0A3"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The database shall—</text>
						<clause commented="no" id="HA3D988AC18D14646B4386198BAF344B2"><enum>(i)</enum><text display-inline="yes-display-inline">include—</text>
							<subclause id="HD9DF245D57184463BE784A808D961E48"><enum>(I)</enum><text>the name of the vessel or
				facility;</text>
							</subclause><subclause id="HBD37B81892BB458394922792BB884FB4"><enum>(II)</enum><text>the name of the owner,
				operator, or person in charge of the vessel or facility;</text>
							</subclause><subclause id="H2230E65F6BE24CEE9E9B975D0875B367"><enum>(III)</enum><text>the date of the
				discharge;</text>
							</subclause><subclause id="H0748D12DC4584B9C9399846AF559C907"><enum>(IV)</enum><text>the volume of the
				discharge;</text>
							</subclause><subclause id="HA855EEC29EA54A78BDA693E15A1959C6"><enum>(V)</enum><text>the location of the
				discharge, including an identification of any receiving waters that are or
				could be affected by the discharge;</text>
							</subclause><subclause id="H041C3D7376BD499CB95EE21C8784CEA8"><enum>(VI)</enum><text>a record of any
				determination of a violation of this section or section 1002 of the Oil
				Pollution Act of 1990 (33 U.S.C. 2702);</text>
							</subclause><subclause id="HBDF8C5BF656A4EBFA294ABA63F075A3F"><enum>(VII)</enum><text>a record of any
				administrative or enforcement action taken against the owner, operator, or
				person in charge; and</text>
							</subclause><subclause id="HFC11EB24F6564E5CAE6038E56C0B6248"><enum>(VIII)</enum><text>any additional
				information that the President determines necessary;</text>
							</subclause></clause><clause commented="no" id="HF7BD9618C9C94BA7B0A4EFC221D33D69"><enum>(ii)</enum><text>use data provided by the
				Environmental Protection Agency, the Coast Guard, the Pipeline and Hazardous
				Materials Safety Administration, and other appropriate Federal agencies;</text>
						</clause><clause commented="no" id="H88CD60F22E504BCFA304A9AE21090C4A"><enum>(iii)</enum><text>use data protocols
				developed and managed by the Environmental Protection Agency; and</text>
						</clause><clause commented="no" id="H994DD403F42F48F686CF5A330A867C47"><enum>(iv)</enum><text>be publicly accessible,
				including by electronic
				means.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB7C97DF3ED0E4F40917D869AC07876A4"><enum>21.</enum><header>Safety of
			 transportation-related offshore platforms</header>
			<subsection id="HB99C7BCF954D4FA091E913840BD4C94F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 601 of title
			 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H59FA5C74EBD344FF9E497FBDD9D00C94" reported-display-style="italic" style="USC">
					<section id="H15833954A91841168EA67FE4B2D644EE"><enum>60138.</enum><header>Safety of
				transportation-related offshore platforms</header>
						<subsection id="H4C00CD7E0DF1423EBCD7665B8DE60A53"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				Transportation shall conduct an analysis of the adequacy of existing
				regulations and standards for the safety of transportation-related offshore
				platforms and the impact of the integrity of such platforms on pipeline
				safety.</text>
						</subsection><subsection id="HF59940C2E09948E0A4A6A5CE5BD114C5"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out subsection (a), the
				Secretary may consult with any agency, organization, or person with expertise
				in the design, construction, testing, operation, or maintenance of offshore
				platforms.</text>
						</subsection><subsection id="H4D0DB8A63E784B5DB35A4BEE928193FE"><enum>(c)</enum><header>Report to
				Congress</header><text display-inline="yes-display-inline">Not later than 24
				months after the date of enactment of this section, the Secretary shall submit
				to the Committee on Transportation and Infrastructure of the House of
				Representatives and the Committee on Commerce, Science, and Transportation of
				the Senate a report describing the results of the analysis conducted under
				subsection (a). The report shall include any recommendations the Secretary may
				have for addressing the safety or integrity of transportation-related offshore
				platforms, including any recommendations for legislative or regulatory
				action.</text>
						</subsection><subsection id="HD15E9498AE0B40B4B1D30ED10BB00032"><enum>(d)</enum><header>Transportation-Related
				offshore platform defined</header><text display-inline="yes-display-inline">In
				this section, the term <term>transportation-related offshore platform</term>
				means any platform—</text>
							<paragraph id="H6529FE1858ED4819A8C4360E9324D086"><enum>(1)</enum><text>located beyond the
				shoreline of the United States in State or Federal waters;</text>
							</paragraph><paragraph id="H7A90582A64F5452EA9E3C2DC08E1EF99"><enum>(2)</enum><text>used for transporting gas
				or hazardous liquid; and</text>
							</paragraph><paragraph id="H67CB74C3F0C344F6A3EFA74D05FF17AB"><enum>(3)</enum><text>the design, construction,
				testing, operation, maintenance, and security of which is not regulated by
				another Federal agency.</text>
							</paragraph></subsection><subsection id="H9F0C5C1055414D7EBAB1945C34AC0CAF"><enum>(e)</enum><header>Limitation</header><text>Nothing
				in this section applies to a production
				facility.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBEB58B1413E44F33B62B782671E73266"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>

			 of response plans; maximum penalties</header>
			<subsection id="H4A939B8BA6B146AAB1F186F493C59B2A"><enum>(a)</enum><header>Agency review of
			 response plans</header>
				<paragraph id="H5D0A23AB3CA445F0A3E7D6E66C9F3E9E"><enum>(1)</enum><header>Lead Federal agency for
			 review of response plans</header><text>Section 311(j)(5)(A) of the Federal
			 Water Pollution Control Act (33 U.S.C. 1321(j)(5)(A)) is amended by adding at
			 the end the following:</text>
					<quoted-block changed="added" committee-id="HPW00" id="H5881B1D762FD4EDCBC24CE9F6025EF08" reported-display-style="italic" style="OLC">
						<clause id="HF32FD204585D45FDAD40717C936E8346" indent="up2"><enum>(iii)</enum><text>In issuing the
				regulations under this paragraph, the President shall ensure that—</text>
							<subclause id="H314F322F20674FC485750089C7C6E308"><enum>(I)</enum><text display-inline="yes-display-inline">the owner, operator, or person in charge of
				a tank vessel, nontank vessel, or offshore facility described in subparagraph
				(C) will not be considered to have complied with this paragraph until the
				owner, operator, or person in charge submits a plan under clause (i) or (ii),
				as appropriate, to the Secretary of the department in which the Coast Guard is
				operating, or the Administrator, with respect to such offshore facilities as
				the President may designate, and the Secretary or Administrator, as
				appropriate, determines and notifies the owner, operator, or person in charge
				that the plan, if implemented, will provide an adequate response to a worst
				case discharge of oil or a hazardous substance or a substantial threat of such
				a discharge; and</text>
							</subclause><subclause id="H4515188477CA4DB88891F2DA34CC2FD7"><enum>(II)</enum><text>the owner, operator, or
				person in charge of an onshore facility described in subparagraph (C)(iv) will
				not be considered to have complied with this paragraph until the owner,
				operator, or person in charge submits a plan under clause (i) either to the
				Secretary of Transportation, with respect to transportation-related onshore
				facilities, or the Administrator, with respect to all other onshore facilities,
				and the Secretary or Administrator, as appropriate, determines and notifies the
				owner, operator, or person in charge that the plan, if implemented, will
				provide an adequate response to a worst-case discharge of oil or a hazardous
				substance or a substantial threat of such a discharge.</text>
							</subclause></clause><clause id="H8776F0EDB3874603AA4911BD7FA3DCF6" indent="up2"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="H5F9F20CA6CAA4B9A956E325BF0C54A27"><enum>(I)</enum><text>The Secretary of the
				department in which the Coast Guard is operating, the Secretary of
				Transportation, or the Administrator, as appropriate, shall require that a plan
				submitted to the Secretary or Administrator for a vessel or facility under
				clause (iii)(I) or (iii)(II) by an owner, operator, or person in charge—</text>
								<item changed="added" committee-id="HPW00" id="H405AA25479124DD4A7890CE67A9177A2" indent="up1" reported-display-style="italic"><enum>(aa)</enum><text display-inline="yes-display-inline">contain a probabilistic risk analysis for
				all critical engineered systems of the vessel or facility; and</text>
								</item><item changed="added" committee-id="HPW00" id="HF6E741F73E574F43BBDD88C05E208180" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text display-inline="yes-display-inline">adequately address all risks identified in
				the risk analysis.</text>
								</item></subclause><subclause changed="added" committee-id="HPW00" id="H6FB81967E4B54A93901C761DAE906516" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">The Secretary or Administrator, as
				appropriate, shall require that a risk analysis developed under subclause (I)
				include, at a minimum, the following:</text>
								<item id="H10E7B1849D0544B29DC533169BBE15EB"><enum>(aa)</enum><text display-inline="yes-display-inline">An analysis of human factors risks,
				including both organizational and management failure risks.</text>
								</item><item id="H5DA66C18106E4D5793C25589A395A4B3"><enum>(bb)</enum><text display-inline="yes-display-inline">An analysis of technical failure risks,
				including both component technologies and integrated systems risks.</text>
								</item><item id="H5348C7CE209C489AA7F95A513226C1B3"><enum>(cc)</enum><text display-inline="yes-display-inline">An analysis of interactions between humans
				and critical engineered systems.</text>
								</item><item id="H4A24199CDDC0437093267DF6F0CBCA92"><enum>(dd)</enum><text display-inline="yes-display-inline">Quantification of the likelihood of modes
				of failure and potential consequences.</text>
								</item><item id="H9AB39BCBD0C543818759B24C16EE59C0"><enum>(ee)</enum><text display-inline="yes-display-inline">A description of methods for reducing known
				risks.</text>
								</item></subclause><subclause changed="added" committee-id="HPW00" id="H60A3FB9E068747769118413A0615D94D" indent="up1" reported-display-style="italic"><enum>(III)</enum><text display-inline="yes-display-inline">The Secretary or Administrator, as
				appropriate, shall require an owner, operator, or person in charge that
				develops a risk analysis under subclause (I) to make the risk analysis
				available to the
				public.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H78EF432FDEC34EC09BFEF171188440D4"><enum>(2)</enum><header>Review and Approval of
			 response plans</header><text>Section 311(j)(5)(E) of such Act (33 U.S.C.
			 1321(j)(5)(E)) is amended to read as follows:</text>
					<quoted-block changed="added" committee-id="HPW00" id="H83442F436E1649F5BA9F301A8A8D021F" reported-display-style="italic" style="OLC">
						<subparagraph id="H25C7E8E1D0584B869F636EC6181D7A9C" indent="up1"><enum>(E)</enum><text>With respect to any
				response plan submitted under this paragraph for an onshore facility that,
				because of its location, could reasonably be expected to cause significant and
				substantial harm to the environment by discharging into or on the navigable
				waters or adjoining shorelines or the exclusive economic zone, and with respect
				to each response plan submitted under this paragraph for a tank vessel, nontank
				vessel, or offshore facility, the President shall—</text>
							<clause id="H6F66D12FE8D646FDBF579AEE17B8FEEA"><enum>(i)</enum><text>promptly review the
				response plan;</text>
							</clause><clause id="HCBB92095D91E49D2ABAFC0004BE143DF"><enum>(ii)</enum><text display-inline="yes-display-inline">verify that the response plan complies with
				subparagraph (A)(iv), relating to risk analyses;</text>
							</clause><clause id="H1B6AD4E6F1864B119E8AE1D3FAD04038"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to a plan for an offshore or
				onshore facility or a tank vessel that carries liquefied natural gas, provide
				an opportunity for public notice and comment on the response plan;</text>
							</clause><clause id="HC6D19C4D5A1741449414C91500D89CCA"><enum>(iv)</enum><text>taking into
				consideration any public comments received and other appropriate factors, as
				determined by the President, require revisions to the response plan;</text>
							</clause><clause id="H9DC07A22436B4B888612378602828CDA"><enum>(v)</enum><text>approve, approve with
				revisions, or disapprove the response plan;</text>
							</clause><clause id="H627315952D6A49189289FA012E5FD738"><enum>(vi)</enum><text>review the response plan
				periodically thereafter, and if applicable requirements are not met, acting
				through the head of the appropriate Federal department or agency—</text>
								<subclause id="H8BA9186A56D94E00B6E552C0355E7067"><enum>(I)</enum><text>issue administrative
				orders directing the owner, operator, or person in charge to comply with the
				response plan or any regulation issued under this section; or</text>
								</subclause><subclause id="H6290C5F2612B4E24BF8913A763169CDF"><enum>(II)</enum><text>assess civil penalties
				or conduct other appropriate enforcement actions in accordance with subsections
				(b)(6), (b)(7), and (b)(8) for failure to develop, submit, receive approval of,
				adhere to, or maintain the capability to implement the response plan, or
				failure to comply with any other requirement of this section;</text>
								</subclause></clause><clause id="HBC9DEF77EFCE439985B4737CC459F5F5"><enum>(vii)</enum><text>acting through the head
				of the appropriate Federal department or agency, require, at a minimum,
				biennial inspections conducted by such agency of the tank vessel, nontank
				vessel, or facility to ensure compliance with the response plan or identify
				deficiencies in such plan;</text>
							</clause><clause id="HE7D739B36AE6414DA87797311FB6CAF9"><enum>(viii)</enum><text>acting through the
				head of the appropriate Federal department or agency, make the response plan
				available to the public, including on the Internet; and</text>
							</clause><clause id="H1D8CD86E2883407080178EDE23C3F84B"><enum>(ix)</enum><text>in the case of a plan
				for a nontank vessel, consider any applicable State-mandated response plan in
				effect on the date of enactment of the Coast Guard and Maritime Transportation
				Act of 2004 and ensure consistency to the extent
				practicable.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD58D6EE256BF40A19F0DAF1A9A4ED399"><enum>(3)</enum><header>Biennial
			 report</header><text>Section 311(j)(5) of such Act (33 U.S.C. 1321(j)(5)) is
			 amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HPW00" id="H25440774F2484C11A6BF7EB92300B90A" reported-display-style="italic" style="OLC">
						<subparagraph id="H15F215A058764F4A86389A805EBEB943" indent="up1"><enum>(J)</enum><text>Not later than 2 years
				after the date of enactment of this subparagraph, and biennially thereafter,
				the President, acting through the Administrator, the Secretary of the
				department in which the Coast Guard is operating, and the Secretary of
				Transportation, shall submit to Congress a report containing the following
				information for each owner, operator, or person in charge that submitted a
				response plan for a tank vessel, nontank vessel, or other facility under this
				paragraph:</text>
							<clause id="HA2880BA8F05B4865A4221F95BBF395D2"><enum>(i)</enum><text>The number of response
				plans approved, disapproved, or approved with revisions under subparagraph (E)
				annually for tank vessels, nontank vessels, and facilities of the owner,
				operator, or person in charge.</text>
							</clause><clause id="HA02997F642E64C96B3BE73D12676EB74"><enum>(ii)</enum><text>The number of
				inspections conducted under subparagraph (E) annually for tank vessels, nontank
				vessels, and facilities of the owner, operator, or person in charge.</text>
							</clause><clause id="HFACDCED879234D329420DC131AA5F820"><enum>(iii)</enum><text>A summary of each
				administrative or enforcement action taken with respect each tank vessel,
				nontank vessel, and facility of the owner, operator, or person in charge,
				including a description of the violation, the date of violation, the amount of
				each penalty proposed, and the final assessment of each penalty and an
				explanation for any reduction in a
				penalty.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H52B358E972C44FAA88F6BDF2FA938E2A"><enum>(4)</enum><header>Administrative
			 provisions for facilities</header><text>Section 311(m)(2) of such Act (33
			 U.S.C. 1321(m)(2)) is amended in each of subparagraphs (A) and (B) by inserting
			 <quote>, the Secretary of Transportation,</quote> before <quote>or the
			 Secretary of the department in which the Coast Guard is
			 operating</quote>.</text>
				</paragraph></subsection><subsection id="H8B01DBAC770944FE97AF422DBE32F26F"><enum>(b)</enum><header>Penalties</header>
				<paragraph id="H017075050AFB4CBB8DFB8567B2BF24ED"><enum>(1)</enum><header>Administrative
			 penalties</header>
					<subparagraph id="H136F3EB31CDF40D9B1E3672E52778BB8"><enum>(A)</enum><header>Authority of Secretary
			 of Transportation to assess penalties</header><text>Section 311(b)(6)(A) of
			 such Act (33 U.S.C. 1321(b)(6)(A)) is amended by inserting <quote>, the
			 Secretary of Transportation,</quote> before <quote>or the
			 Administrator</quote>.</text>
					</subparagraph><subparagraph id="HA875B91929CA4B86B9785254583CB062"><enum>(B)</enum><header>Administrative
			 Penalties for Failure to Provide Notice</header><text display-inline="yes-display-inline">Section 311(b)(6)(A) of such Act (33 U.S.C.
			 1321(b)(6)(A)) is further amended—</text>

			 <quote>paragraph (3), or</quote> and inserting <quote>paragraph

			 striking <quote>any regulation</quote> and inserting <quote>any order or action
			 required by the President under subsection (c) or (e) or any

			 (ii) as clause (iii);</text>

			 clause (i) the following:</text>

						</clause><clause id="HA69549748C694BE8BD81399C684B4E88"><enum>(v)</enum><text>by adding at the end the
			 following: <quote>Whenever the President delegates the authority to issue
			 regulations under subsection (j), the agency that issues regulations pursuant
			 to that authority shall have the authority to assess a civil penalty in
			 accordance with this section for violations of such
			 regulations.</quote>.</text>
						</clause></subparagraph><subparagraph id="HB72BCB9E552441B69997C27E0CCC654A"><enum>(C)</enum><header>Penalty
			 amounts</header><text>Section 311(b)(6)(B) of such Act (33 U.S.C.
			 1321(b)(6)(B)) is amended—</text>

			 amendments made by this subsection shall apply to violations occurring on or
			 after April 19, 2010.</text>
				</paragraph></subsection><subsection id="H4B0AC8248F2D4A4D9B0C92D5EDA11396"><enum>(c)</enum><header>Clarification of
			 Federal removal authority</header><text display-inline="yes-display-inline">Section 311(c)(1)(B)(ii) of such Act (33
			 U.S.C. 1321(c)(1)(B)(ii)) is amended by striking the term <term>monitor
			 all</term> and inserting <quote>monitor, including through the use of an
			 administrative order, all</quote>.</text>
			</subsection></section><section id="H6EA35FFB6A114B9AB54C708A6EAF3407"><enum>23.</enum><header>Oil and hazardous
			 substance cleanup technologies</header><text display-inline="no-display-inline">Section 311(j) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1321(j)) is amended by adding at the end the
			 following:</text>
			<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H436852F1CEFA41A895E710B5C75B056B" reported-display-style="italic" style="OLC">
				<paragraph id="H94BEC7F533D748518DDFB17B577AB4AC"><enum>(9)</enum><header>Oil and hazardous
				substance cleanup technologies</header><text display-inline="yes-display-inline">The President, acting through the Secretary
				of the department in which the Coast Guard is operating, shall—</text>
					<subparagraph id="HCF7CF7DF78F747C0A285E19AA1CB6CB7"><enum>(A)</enum><text>in coordination with the
				heads of other appropriate Federal agencies, establish a process for—</text>
						<clause id="H64E8A3DB3DF9447883CCE199820D1D37"><enum>(i)</enum><text>quickly and effectively
				soliciting, assessing, and deploying offshore oil and hazardous substance
				cleanup technologies in the event of a discharge or substantial threat of a
				discharge of oil or a hazardous substance in United States waters; and</text>
						</clause><clause id="H1BB3A1D92F674D919321239E0FC37ED7"><enum>(ii)</enum><text display-inline="yes-display-inline">effectively coordinating with other
				appropriate agencies, industry, academia, small businesses, and others to
				ensure the best technology available is implemented in the event of such a
				discharge or threat; and</text>
						</clause></subparagraph><subparagraph id="H4F9901FB63FA4EF1BDD22F3F8BBBD8DB"><enum>(B)</enum><text display-inline="yes-display-inline">in coordination with the heads of other
				appropriate Federal agencies, maintain a database on best available oil and
				hazardous substance cleanup technologies in the event of a discharge or
				substantial threat of a discharge of oil or a hazardous substance in United
				States
				waters.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="H84B8E66C93E94143AE3C7241A839006D"><enum>24.</enum><header>Implementation of oil
			 spill prevention and response authorities</header><text display-inline="no-display-inline">Section 311(l) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1321(l)) is amended—</text>

				monitoring, prevention, preparedness, and response authorities related to the
				discharge or substantial threat of a discharge of oil or a hazardous

							</clause><clause commented="no" id="HC478AB5B62CE4BF689B19562EA9CE183"><enum>(ii)</enum><text>to protect human health
				and safety from impacts of a discharge or substantial threat of a discharge of
				oil or a hazardous substance;</text>
							</clause><clause id="HF9C315EA7D5B406FAA212FF96282C86B"><enum>(iii)</enum><text>to review and approve
				of, disapprove of, or require revisions (if necessary) to onshore facility
				response plans and to carry out all other responsibilities under subsection

				general</header><text display-inline="yes-display-inline">The President shall
				delegate the responsibilities under subparagraph (B) to the Secretary of the
				department in which the Coast Guard is operating.</text>
						</subparagraph><subparagraph commented="no" id="HF1E80A0B64B04B868E00AC813952591B"><enum>(B)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Secretary shall ensure that Coast Guard
				personnel develop and maintain operational capability—</text>
							<clause commented="no" id="H14E2F0A116924E8BA86117D327CD0AB8"><enum>(i)</enum><text>to establish and enforce
				regulations and standards for procedures, methods, equipment, and other
				requirements to prevent and to contain a discharge of oil or a hazardous
				substance from a tank vessel, nontank vessel, or offshore facility;</text>
							</clause><clause commented="no" id="H5848833137D94F668871DABB68907D7E"><enum>(ii)</enum><text>to establish and enforce
				regulations, and to carry out all other responsibilities, under subsection
				(j)(5)(A);</text>
							</clause><clause commented="no" id="HE2BD7609B1A44A7FAE714BC5B7E4ADE3"><enum>(iii)</enum><text>to review and approve
				of, disapprove of, or require revisions (if necessary) to tank vessel, nontank
				vessel, and offshore facility response plans and to carry out all other
				responsibilities under subsection (j)(5)(E);</text>
							</clause><clause commented="no" id="H66C5B7CE83894A588E9117D09F804CE5"><enum>(iv)</enum><text>for effective
				inspection, monitoring, prevention, preparedness, and response authorities
				related to the discharge or substantial threat of a discharge of oil or a
				hazardous substance from a tank vessel, nontank vessel, or offshore
				facility;</text>
							</clause><clause commented="no" id="H856E5B3B9AE54E528B12DE6AB489EFE0"><enum>(v)</enum><text>to protect the public
				from impacts of a discharge or substantial threat of a discharge of oil or a
				hazardous substance in United States waters; and</text>
							</clause><clause commented="no" id="HB6260B324C484C188309F666848AC17B"><enum>(vi)</enum><text>to protect the
				environment and natural resources from impacts of a discharge or substantial
				threat of a discharge of oil or a hazardous substance in United States
				waters.</text>
							</clause></subparagraph><subparagraph id="HE761F88E994642DB8551A7719B2C45F8"><enum>(C)</enum><header>Role as first
				responder</header>
							<clause id="H03F67955597D4CF887FADFF702943542"><enum>(i)</enum><header>In
				general</header><text>The responsibilities delegated to the Secretary under
				subparagraph (B) shall be sufficient to allow the Coast Guard to act as a first
				responder to a discharge or substantial threat of a discharge of oil or a
				hazardous substance from a tank vessel, nontank vessel, or offshore
				facility.</text>
							</clause><clause id="HE0114115C7AE49F7BA7F598C9428C45C"><enum>(ii)</enum><header>Capabilities</header><text display-inline="yes-display-inline">The President shall ensure that the Coast
				Guard has sufficient personnel and resources to act as a first responder as
				described in clause (i), including the resources necessary for on-going
				training of personnel, acquisition of equipment (including containment booms,
				dispersants, and skimmers), and prepositioning of equipment.</text>
							</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H48ECF70D4FF54F009EA5D1A7C4586CB6"><enum>(D)</enum><header>Contracts</header><text>The
				Secretary may enter into contracts with private and nonprofit organizations for
				personnel and equipment in carrying out the responsibilities delegated to the
				Secretary under subparagraph (B).</text>
						</subparagraph></paragraph><paragraph commented="no" id="H4C91947C151948038E5925BFCA263437"><enum>(4)</enum><header>Department of
				Transportation</header>
						<subparagraph commented="no" id="H13F7D21E64674117BB4C22F6A4AA5DC3"><enum>(A)</enum><header>In
				general</header><text>The President shall delegate the responsibilities under
				subparagraph (B) to the Secretary of Transportation.</text>
						</subparagraph><subparagraph commented="no" id="H230949D503DC489CA9AFA67142B665E1"><enum>(B)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Secretary of Transportation
				shall—</text>
							<clause commented="no" id="H383B68ADA1A3497890FCB4FB41347467"><enum>(i)</enum><text display-inline="yes-display-inline">establish and enforce regulations and
				standards for procedures, methods, equipment, and other requirements to prevent
				and to contain discharges of oil and hazardous substances from
				transportation-related onshore facilities;</text>
							</clause><clause commented="no" id="HF07EE27CD313477781806C3D70D5EC32"><enum>(ii)</enum><text>have the authority to
				review and approve of, disapprove of, or require revisions (if necessary) to
				transportation-related onshore facility response plans and to carry out all
				other responsibilities under subsection (j)(5)(E); and</text>
							</clause><clause commented="no" id="H3F8BD5A6E0064A58A340AEE2603FA2F1"><enum>(iii)</enum><text>ensure that Department
				of Transportation personnel develop and maintain operational capability—</text>
								<subclause commented="no" id="HA5766D112BBC4ACA81E01F6C27DE34C8"><enum>(I)</enum><text>for effective inspection,
				monitoring, prevention, preparedness, and response authorities related to the
				discharge or substantial threat of a discharge of oil or a hazardous substance
				from a transportation-related onshore facility;</text>
								</subclause><subclause commented="no" id="H4FA0A93C42884328875D35B9BE177B30"><enum>(II)</enum><text display-inline="yes-display-inline">to protect the public from the impacts of a
				discharge or substantial threat of a discharge of oil or a hazardous substance
				from a transportation-related onshore facility; and</text>
								</subclause><subclause commented="no" id="H938FB877F1A04BBAA8959EAC8AD5FFC7"><enum>(III)</enum><text display-inline="yes-display-inline">to protect the environment and natural
				resources from the impacts of a discharge or substantial threat of a discharge
				of oil or a hazardous substance from a transportation-related onshore
				facility.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="HD257BE9AEBA641C8891CE22A15309256" section-type="subsequent-section"><enum>25.</enum><header>Disaster damage
			 notification and assessment</header>
			<subsection id="H6CA214640BB045A684C2A690DC6BC817"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 60108 of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="HBDEA1A2E100044D080BC09BFA81DCE36" reported-display-style="italic" style="OLC">
					<subsection id="H20CFA65D3E3C4D5086CE2B77742209B7"><enum>(e)</enum><header>Disaster damage
				notification and assessment</header>
						<paragraph id="H5EAACA92D46E4E7A9E7AF5A6F84BFE6F"><enum>(1)</enum><header>Notification
				required</header><text>In the event of a manmade or natural disaster, the
				operator of a pipeline facility in an affected location shall notify the
				Secretary not later than 12 hours after the cessation of the disaster, as
				determined by the Secretary, or an earlier time determined appropriate by the
				Secretary, of any changes to the operational status of the pipeline facility,
				including information concerning physical damages, releases of highly volatile
				liquid, other hazardous liquid, or gas, disruptions in service, and projected
				dates for return to service.</text>
						</paragraph><paragraph id="HC15D702AACA544779DEF09A1AE5674D4"><enum>(2)</enum><header>Preparation of damage
				assessments</header><text display-inline="yes-display-inline">Not later than 30
				days after the cessation of a manmade or natural disaster, as determined by the
				Secretary, the operator of a pipeline facility in an affected location shall
				develop and transmit to the Secretary a written damage assessment. The damage
				assessment, at a minimum, shall—</text>
							<subparagraph id="HDBB6BF9291404C21AB009FD0F1942DD3"><enum>(A)</enum><text>identify any physical
				damage to the pipeline facility and any other credible threat or hazard to the
				pipeline facility;</text>
							</subparagraph><subparagraph id="H47ABD70CCCA24947AC2DFFE116C1CDCD"><enum>(B)</enum><text>assess the extent of any
				physical damage to the pipeline facility and any other credible threat or
				hazard to the pipeline facility;</text>
							</subparagraph><subparagraph id="HBCD293DEB75246809592CA71965E9352"><enum>(C)</enum><text>evaluate the integrity of
				the pipeline facility;</text>
							</subparagraph><subparagraph id="H4A7A12F48A124890BADE9311686DEF10"><enum>(D)</enum><text>if necessary, provide a
				schedule for repairing or abandoning the pipeline facility; and</text>
							</subparagraph><subparagraph id="H269699094DBF4D7BA7071F8B8F5C3E4E"><enum>(E)</enum><text>meet any other
				requirements the Secretary determines are appropriate by regulation.</text>
							</subparagraph></paragraph><paragraph id="H027A607CAE114A498C80A203BF900B48"><enum>(3)</enum><header>Abandonment</header><text>An
				operator of a pipeline facility shall notify the Secretary promptly if the
				operator determines that the pipeline facility must be abandoned as a result of
				a manmade or natural disaster.</text>
						</paragraph><paragraph id="H190659DCC5274C0AB97BD7080A842301"><enum>(4)</enum><header>Other</header><text>An
				operator of a pipeline facility shall retain, and make available to the
				Secretary on request, a copy of any report prepared under this subsection for
				at least 5 years.</text>
						</paragraph><paragraph id="H96C985680D304A5D9B8F69344BDD67E4"><enum>(5)</enum><header>Definitions</header><text>In
				this subsection, the following definitions apply:</text>
							<subparagraph id="HEF02A17199D7479287A2D8B4CE9577DA"><enum>(A)</enum><header>Abandon</header><text>The
				term <term>abandon</term> means permanently remove from service.</text>
							</subparagraph><subparagraph id="HE653E0D3B19141B98297E2FE920260EB"><enum>(B)</enum><header>Affected
				location</header><text>The term <term>affected location</term> means any area
				directly or substantially affected by a manmade or natural disaster, as
				determined by the Secretary.</text>
							</subparagraph><subparagraph id="H2318D14F018D4FC9A015F33B99945983"><enum>(C)</enum><header>Manmade or natural
				disaster</header><text display-inline="yes-display-inline">The term
				<term>manmade or natural disaster</term> means any hurricane, tornado, tidal
				wave, tsunami, earthquake, volcanic eruption, or, regardless of cause, any
				fire, flood, or explosion, or any similar catastrophe in the United States that
				causes, or may cause, substantial damage or injury to persons, property, or the
				environment, as determined by the
				Secretary.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9E57AE667C1448E599FA97762B6E226D"><enum>(b)</enum><header>Regulations</header>
				<paragraph id="HEA83EE014DC6485D8DB793ED73900C62"><enum>(1)</enum><header>Final
			 rule</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation shall issue a final rule establishing procedures to carry out
			 section 60108(e) of title 49, United States Code, not later than 1 year after
			 the date of enactment of this Act.</text>
				</paragraph><paragraph id="H8DA471B94DE149C68693434CBE33B243"><enum>(2)</enum><header>Interim
			 guidance</header><text>For the period beginning on the date of enactment of
			 this Act and ending on the date of issuance of a rule under paragraph (1), or
			 the date that is 45 days after such date of enactment, whichever is earlier,
			 the Secretary shall issue interim guidance to the operator of a pipeline
			 facility requiring notification of the Secretary and an assessment of pipeline
			 facilities located in an affected area in the case of a manmade or natural
			 disaster.</text>
				</paragraph></subsection></section><section id="H5AAA0D1FF08C4B65AD9CC9EDED32C9E2"><enum>26.</enum><header>Impacts to Indian
			 Tribes</header><text display-inline="no-display-inline">Section 1002(b)(2) of
			 the Oil Pollution Act of 1990 (33 U.S.C. 2702(b)(2)) is amended—</text>
			<paragraph id="H1C442F22E98D415CA70833547ADD469E"><enum>(1)</enum><text>in subparagraph (D) by
			 striking <quote>or a political subdivision thereof</quote> and inserting
			 <quote>a political subdivision of a State, or an Indian tribe</quote>;
			 and</text>
			</paragraph><paragraph id="HFB2DE69B04424B448261FEBDC6B59340"><enum>(2)</enum><text>in subparagraph (F) by
			 striking <quote>or a political subdivision of a State</quote> and inserting
			 <quote>a political subdivision of a State, or an Indian tribe</quote>.</text>
			</paragraph></section><section commented="no" id="HA431A9EB56C4456A8D44D68923F45012"><enum>27.</enum><header>National Commission
			 study of Federal management and oversight of offshore drilling</header>
			<subsection commented="no" id="HFFFC05D6C41B4A779A431C576AA815C6"><enum>(a)</enum><header>In
			 general</header><text>The National Commission on the BP Deepwater Horizon Oil
			 Spill and Offshore Drilling established by Executive Order No. 13543 dated May
			 21, 2010 (in this section referred to as the <quote>Commission</quote>), shall
			 develop recommendations for—</text>
				<paragraph commented="no" id="HD8D3F02140164B7B89469A8040F52FEF"><enum>(1)</enum><text>improvements to Federal
			 laws, regulations, and industry practices applicable to offshore drilling that
			 would—</text>
					<subparagraph commented="no" id="H0DB84C03638E465CB49902D454188D15"><enum>(A)</enum><text>ensure the effective
			 oversight, inspection, monitoring, and response capabilities; and</text>
					</subparagraph><subparagraph commented="no" id="H80304B2E1B0641F399292D7FFECDE6C1"><enum>(B)</enum><text>protect human health and
			 safety, occupational health and safety, and the environment and natural
			 resources; and</text>
					</subparagraph></paragraph><paragraph commented="no" id="HD774E31E079A4544B9587397AF655DFE"><enum>(2)</enum><text>organizational or other
			 reforms of Federal agencies or processes, including the creation of new
			 agencies, as necessary, to ensure that the improvements described in paragraph
			 (1) are implemented and maintained.</text>
				</paragraph></subsection><subsection commented="no" id="H261043B17D8C47E9B9F8DC12C2FBC490"><enum>(b)</enum><header>Purposes</header><text>In
			 developing recommendations under subsection (a), the Commission shall ensure
			 that the following goals are met:</text>
				<paragraph commented="no" id="HD7A4B27DEFCD49F1B98DEAA7C37959B6"><enum>(1)</enum><text>Ensuring the safe
			 operation and maintenance of offshore drilling platforms or vessels.</text>
				</paragraph><paragraph commented="no" id="H4EADDD86660C464588E9225BFE3B93C6"><enum>(2)</enum><text>Protecting the health and
			 safety of workers on offshore drilling platforms or vessels.</text>
				</paragraph><paragraph commented="no" id="H61363BDE7B494231AC34C3957A7238D1"><enum>(3)</enum><text>Protecting the overall
			 environment and natural resources surrounding ongoing and potential offshore
			 drilling sites.</text>
				</paragraph><paragraph commented="no" id="HE7751A3FF144457489105325E6B8E441"><enum>(4)</enum><text>Protecting the health and
			 safety of workers that service offshore drilling platforms or vessels.</text>
				</paragraph><paragraph commented="no" id="HC5323589AC6A4DE29D80CFCC46807A6C"><enum>(5)</enum><text>Developing and
			 maintaining Federal agency expertise on the safe and effective use of offshore
			 drilling technologies, including technologies to minimize the risk of release
			 of oil from offshore drilling platforms or vessels.</text>
				</paragraph><paragraph commented="no" id="H83583BDFFCB545159E44D00C3E79A912"><enum>(6)</enum><text>Encouraging the
			 development and implementation of efficient and effective oil spill response
			 techniques and technologies that minimize or eliminate any adverse effects on
			 natural resources or the environment that result from response
			 activities.</text>
				</paragraph><paragraph commented="no" id="HB051AC89108D4AA2900A8CE07B089F1B"><enum>(7)</enum><text>Protecting the health and
			 safety of first responders against releases of oil from offshore drilling
			 platforms or vessels.</text>
				</paragraph><paragraph commented="no" id="HEAF300D8B1AD45059E048511F20F29FC"><enum>(8)</enum><text>Ensuring that the Federal
			 agencies regulating offshore drilling are staffed with, and managed by, career
			 professionals, who are—</text>
					<subparagraph commented="no" id="H12601333166446A18A25D3EA792E763D"><enum>(A)</enum><text>permitted to exercise
			 independent professional judgments and make safety the highest priority in
			 carrying out their responsibilities;</text>
					</subparagraph><subparagraph commented="no" id="H1EC3F8702A784B898AB539A556AF9C90"><enum>(B)</enum><text>not subject to undue
			 influence from regulated interests or political appointees; and</text>
					</subparagraph><subparagraph commented="no" id="H3CBEE850AFAA424FAEE1E37BEDD4EC38"><enum>(C)</enum><text>subject to strict
			 regulation to prevent improper relationships with regulated interests and to
			 eliminate real or perceived conflicts of interests.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H6811BD48B0AF490D9D64B43D1E021053"><enum>(c)</enum><header>Report to
			 Congress</header><text>In coordination with the final public report to the
			 President, the Commission shall submit to Congress a report containing the
			 recommendations developed under subsection (a).</text>
			</subsection></section><section id="H69B0824222DD4AA18FE58609C9B86118"><enum>28.</enum><header>Federal enforcement
			 actions</header><text display-inline="no-display-inline">Section 309(g)(6)(A)
			 of the Federal Water Pollution Control Act (33 U.S.C. 1319(g)(6)(A)) is amended
			 by striking <quote>or section 311(b)</quote>.</text>
		</section><section id="HD394F46128BA48AE9FAA12B1C4451660" section-type="subsequent-section"><enum>29.</enum><header>Time required before
			 electing to proceed with judicial claim or against the Fund</header><text display-inline="no-display-inline">Paragraph (2) of section 1013(c) of the Oil
			 Pollution Act of 1990 (33 U.S.C. 2713(c)) is amended by striking
			 <quote>90</quote> and inserting <quote>45</quote>.</text>
		</section><section id="H4FB7341848B84AA79950D62B34F6F1BC"><enum>30.</enum><header>Report on former Coast
			 Guard officials employed by recognized organizations of foreign flag
			 administrations</header>
			<subsection id="HBB721B7D58D84B2C9EE64E09C3DA3261"><enum>(a)</enum><header>Report
			 required</header><text>Not later than 1 year after the date of enactment of
			 this Act and annually thereafter, the Comptroller General of the United States
			 shall submit a report to the Committee on Transportation and Infrastructure of
			 the House of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate on the employment during the preceding year of
			 individuals who were Coast Guard officials in the previous 5-year period, by
			 recognized organizations contracted to administer maritime programs for foreign
			 flag administrations.</text>
			</subsection><subsection id="HDAC3CBB4854F416AB6546D4EC5D0D325"><enum>(b)</enum><header>Objectives of
			 report</header><text>At a minimum, the report required by this section shall
			 assess the extent to which former Coast Guard officials who received
			 compensation from recognized organizations were assigned to work on matters
			 over which the former Coast Guard officials had oversight, inspection
			 responsibility, or decision-making authority when the officials served in or
			 worked for the Coast Guard. The report shall assess the extent to which former
			 Coast Guard officials were provided compensation by recognized organizations
			 and the positions held by former Coast Guard officials in the preceding
			 calendar year.</text>
			</subsection><subsection id="H13A7111A09864C3F8933DEAA2518D260"><enum>(c)</enum><header>Confidentiality
			 requirement</header><text>The report required by this subsection shall not
			 include the names of the former Coast Guard officials who received compensation
			 from recognized organizations.</text>
			</subsection><subsection id="H9C96993885014AA8AFF2FFB9437E70C9"><enum>(d)</enum><header>Access to
			 information</header><text>The Comptroller General may seek agreements with
			 recognized organizations to obtain access to information for the purpose of
			 preparing reports required by this section.</text>
			</subsection><subsection id="HD53E44A77BA944C38AFAAFC4BC892A67"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H4B8D97CCAB0F4F8B821D6B291F7CF689"><enum>(1)</enum><header>Foreign flag
			 administration</header><text>The term <term>foreign flag administration</term>
			 means the maritime administration, maritime agency, or similar governmental
			 organization of a country other than the United States that maintains a
			 register of vessels and performs some or all of the following statutory
			 functions with respect to maritime programs:</text>
					<subparagraph id="H1CF396EE08714AD0892D122A1E952E89"><enum>(A)</enum><text>Issues certificates of
			 registry and manning certificates.</text>
					</subparagraph><subparagraph id="H5E26BAFFD30F4EAEAC9353CEC082816A"><enum>(B)</enum><text>Conducts or contracts
			 with recognized organizations to conduct safety inspections.</text>
					</subparagraph><subparagraph id="H66AE607F5D794768A1A17460E2860476"><enum>(C)</enum><text>Issues radio station
			 licenses.</text>
					</subparagraph><subparagraph id="H0AA448CA3F0D4748B030A91EF5E556B1"><enum>(D)</enum><text>Certifies maritime
			 officers and unlicensed seamen and conducts inquiries into charges of
			 incompetence or misconduct.</text>
					</subparagraph><subparagraph id="H240001D6C48E4B96883FE3B614218BFD"><enum>(E)</enum><text>Regulates the
			 construction, equipment, and operation of vessels under its flag.</text>
					</subparagraph><subparagraph id="H319565EDFBEC4CF5989BF1F7D3C5089F"><enum>(F)</enum><text>Monitors vessels’
			 compliance with international and national standards for marine safety,
			 pollution prevention, and security.</text>
					</subparagraph><subparagraph id="HFF4CBF5473D84391BFCCC0F5C75066D1"><enum>(G)</enum><text>Investigates marine
			 casualties.</text>
					</subparagraph></paragraph><paragraph id="HA8F5DD6EFC194D8FA5F6A88B6E054FD8"><enum>(2)</enum><header>Recognized
			 organization</header><text>The term <term>recognized organization</term> means
			 an organization, such as a classification society or a corporation, to which a
			 foreign flag administration has delegated some or all of its statutory
			 functions with respect to maritime programs.</text>
				</paragraph><paragraph id="HE976C13F51B44D0DB785FF3F3222C57E"><enum>(3)</enum><header>Coast Guard
			 official</header><text>The term <term>Coast Guard official</term> includes
			 former Coast Guard officers, enlisted personnel, or civilian employees who had
			 responsibilities for—</text>
					<subparagraph id="H289852EB2FD64F8FB24C4772F967A1C5"><enum>(A)</enum><text>issuing certificates of
			 registry and manning certificates;</text>
					</subparagraph><subparagraph id="HFA9061470FE8463BBAB5D1D002C8875C"><enum>(B)</enum><text>safety
			 inspections;</text>
					</subparagraph><subparagraph id="HB9A5C50399C64FFFB6942D45F6489AFD"><enum>(C)</enum><text>certification of maritime
			 officers and unlicensed seamen;</text>
					</subparagraph><subparagraph id="HEA895A65DDD046518281A3FCF36FD67E"><enum>(D)</enum><text>conducting inquiries into
			 charges of incompetence or misconduct of maritime officers and unlicensed
			 seamen;</text>
					</subparagraph><subparagraph id="HE8F5F63FA6824786AD129880074F657E"><enum>(E)</enum><text>regulation of the
			 construction, equipment, and operation of vessels;</text>
					</subparagraph><subparagraph id="H51ECF71C99C44AEA94E499CBCBD0D90F"><enum>(F)</enum><text>monitoring vessels’
			 compliance with international and national standards for marine safety,
			 pollution prevention, and security; or</text>
					</subparagraph><subparagraph id="H94EB04E7BC054632935FD3BC20595898"><enum>(G)</enum><text>investigating marine
			 casualties.</text>
					</subparagraph></paragraph></subsection></section><section id="H2D3703E64E594EEAB8C0EB1DFEBBE16E"><enum>31.</enum><header>Authorized level of
			 Coast Guard personnel</header><text display-inline="no-display-inline">The
			 Coast Guard is authorized an end-of-year strength for active duty personnel of
			 47,300 for fiscal year 2011, of which at least 300 personnel shall be assigned
			 to implement the activities of the Coast Guard under this Act, including the
			 amendments made by this Act.</text>
		</section><section id="HCE0D66E7CD494DF28760C5ED2D5A305D"><enum>32.</enum><header>Clarification of
			 memorandums of understanding</header><text display-inline="no-display-inline">Not later than September 30, 2011, the
			 President (acting through the head of the appropriate Federal department or
			 agency) shall implement or revise, as appropriate, memorandums of understanding
			 to clarify the roles and jurisdictional responsibilities of the Environmental
			 Protection Agency, the Coast Guard, the Department of Transportation, and other
			 Federal agencies relating to the prevention of oil discharges from tank
			 vessels, nontank vessels, and facilities subject to the Oil Pollution Act of
			 1990.</text>
		</section><section display-inline="no-display-inline" id="HDD6C496998BA4188B1A968FA3603171C"><enum>33.</enum><header>Study of health effects
			 of oil spill</header>
			<subsection id="H9AD0F8F42CA34EE9B0129CD7EC425DDB"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Director of the Agency for Toxic
			 Substances and Disease Registry and the Director of the Centers for Disease
			 Control and Prevention shall jointly—</text>
				<paragraph id="H6325C701EE2B449DB11C82BB053E8228"><enum>(1)</enum><text>conduct a comprehensive
			 study of—</text>
					<subparagraph id="H50B57151D3024BDF8BB59853A783BDBF"><enum>(A)</enum><text>the effects on human
			 health of exposure to petroleum and other substances released in the oil spill
			 or used or produced in response to the oil spill, including chemicals used to
			 disperse the oil;</text>
					</subparagraph><subparagraph id="H34282C0A193746ACB3E24641E39524A6"><enum>(B)</enum><text>the effects on human
			 health of secondary exposure to such substances in an aerosolized form;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H8F07A7CF2AC943888D982EEF5C1F6BFA"><enum>(C)</enum><text>whether such substances
			 include or produce airborne carcinogens, and the effects of any such
			 carcinogens; and</text>
					</subparagraph><subparagraph id="H3765AC83BFF04125B77F70137B55FAC4"><enum>(D)</enum><text display-inline="yes-display-inline">the effects of exposure described in
			 subparagraphs (A) and (B) on a child of an individual born after the individual
			 has been subject to such exposure; and</text>
					</subparagraph></paragraph><paragraph id="H65131C03CD6E4B5EBBC185AF606A91F6"><enum>(2)</enum><text>beginning as soon as
			 practicable after the date of enactment of this Act, complete a baseline
			 assessment to determine the health status of individuals exposed as described
			 in subparagraph (A) or (B) of paragraph (1) in order to gather data that may be
			 compared with data gathered later under paragraph (1) to determine any change
			 in health status from continued exposure.</text>
				</paragraph></subsection><subsection commented="no" id="HFA8DE789E7774A05AE7839D3CE0CAE8B"><enum>(b)</enum><header>Public Health
			 Assessment</header><text>The Director of the Agency for Toxic Substances and
			 Disease Registry shall conduct a public health assessment of persons who are
			 thought to have an epidemiological link to the substances described in
			 subsection (a)(1)(A).</text>
			</subsection><subsection id="HF2D860797702466AB7E7BBCC4CB5D7EF"><enum>(c)</enum><header>Report</header><text>The
			 Directors shall submit to Congress a report on the results of the study and
			 baseline assessment under subsection (a) and the assessment under subsection
			 (b). The report shall be submitted not later than two years after the date of
			 enactment of this Act and shall include the findings of the Directors on the
			 matters covered by the report. The Directors shall include in the report a list
			 of diseases or conditions that are found to exist within the populations
			 specified in subsection (a)(1) and their rate of occurrence compared to the
			 general population.</text>
			</subsection><subsection id="H9BCF74EB6BB647148C0F55AF2A012909"><enum>(d)</enum><header>Oil spill
			 defined</header><text display-inline="yes-display-inline">For purposes of this
			 section, the term <term>oil spill</term> means the oil spill resulting from the
			 explosion and collapse of the mobile offshore drilling unit <italic>Deepwater
			 Horizon</italic>.</text>
			</subsection></section><section commented="no" id="H0633679DD5BD4D1E97AD110CC049D0E7"><enum>34.</enum><header>Offshore energy
			 security</header>
			<subsection commented="no" id="HDE0BBDCF920B4010BC37D6FAEB1D1C70"><enum>(a)</enum><text>Offshore facilities
			 constructed after the date of enactment of this Act for operation in the United
			 States Exclusive Economic Zone for purposes of any form of energy production
			 shall be built in the United States.</text>
			</subsection><subsection commented="no" id="H86B0766A4DB04674BE7C65A92D518360"><enum>(b)</enum><text>Foreign-built offshore
			 facilities not operating in the United States Exclusive Economic Zone for
			 purposes of any form of energy production on the date of enactment of this Act
			 shall not operate in the United States Exclusive Economic Zone for such
			 purposes after the date of enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H918BAB76FBA445538C7904CE8C2164B0"><enum>35.</enum><header>Oil spill response
			 vessel database</header>
			<subsection id="H2F59EB08294842BE8957893B74C396A0"><enum>(a)</enum><header>Requirement</header><text>Not
			 later than 90 days after the date of enactment of this Act, the Commandant of
			 the Coast Guard shall complete an inventory of all vessels operating in the
			 waters of the United States that are capable of meeting oil spill response
			 needs designated in the National Contingency Plan authorized by section 311(d)
			 of the Federal Water Pollution Control Act (33 U.S.C. 1321(d)).</text>
			</subsection><subsection id="H6E69F369A3B5472DB7A9AB12637989F2"><enum>(b)</enum><header>Categorization</header><text>The
			 inventory required under subsection (a) shall categorize such vessels by
			 capabilities, type, function, and location.</text>
			</subsection><subsection id="H72EC22C42A36420B8AF107A34D570825"><enum>(c)</enum><header>Maintenance of
			 database</header><text display-inline="yes-display-inline">The Commandant shall
			 maintain a database containing the results of the inventory required under
			 subsection (a) and update the information in the database on no less than a
			 quarterly basis.</text>
			</subsection><subsection id="H602F3D1EA106493FB06BC10EB1CF72DC"><enum>(d)</enum><header>Availability</header><text display-inline="yes-display-inline">The Commandant may make information
			 regarding the location and capabilities of oil spill response vessels available
			 to a Federal On-Scene Coordinator designated under section 311 of such Act (33
			 U.S.C. 1321) to assist in the response to an oil spill or other incident in the
			 waters of the United States.</text>
			</subsection></section><section id="HD1A99D5680914719973294E6951B77F2"><enum>36.</enum><header>Offshore sensing and
			 monitoring systems</header>
			<subsection id="H9F69D8660DD245479D6077E0260A9CFC"><enum>(a)</enum><header>Requirement</header><text>Subtitle
			 A of title IV of the Oil Pollution Act of 1990 is amended by adding at the end
			 the following new section:</text>

					<section id="H424BF8D116BE46E2A877658F452AFCDA"><enum>4119.</enum><header>Offshore sensing and
				monitoring systems</header>
						<subsection id="HC7CA916D147443089906977216FC7391"><enum>(a)</enum><header>In
				general</header><text>The equipment required to be available under section
				311(j)(5)(D)(iii) of the Federal Water Pollution Control Act for facilities
				listed in section 311(j)(5)(C)(iii) of such Act and located in more than 500
				feet of water includes sensing and monitoring systems that meet the
				requirements of this section.</text>
						</subsection><subsection id="H64CEC376B0884C159CCFAFE6B23F95F0"><enum>(b)</enum><header>Systems
				requirements</header><text>Sensing and monitoring systems required under
				subsection (a) shall—</text>
							<paragraph id="HB5799D2280E04BBEAEA29965E0B69CC6"><enum>(1)</enum><text>use an integrated,
				modular, expandable, multi-sensor, open-architecture design and technology with
				interoperable capability;</text>
							</paragraph><paragraph id="H00AE2D664FE84DE59067B020912E3165"><enum>(2)</enum><text display-inline="yes-display-inline">be capable of—</text>
								<subparagraph id="HD59E46F88D204747A94682BF3FC8E792"><enum>(A)</enum><text>operating for at least 25
				years;</text>
								</subparagraph><subparagraph id="H98265283C1634C92B6BA97D30165355C"><enum>(B)</enum><text>real-time physical,
				biological, geological, and environmental monitoring;</text>
								</subparagraph><subparagraph id="H52DBA7A087B44314A10E605B9F3B9547"><enum>(C)</enum><text>providing alerts in the
				event of anomalous circumstances;</text>
								</subparagraph><subparagraph id="H52186AF4AF364E839E9A961F937058A8"><enum>(D)</enum><text>providing docking bases
				to accommodate spatial sensors for remote inspection and monitoring; and</text>
								</subparagraph><subparagraph id="H571E40CDA8B541EA8147AC98C29354ED"><enum>(E)</enum><text>collecting chemical
				boundary condition data for drift and flow modeling; and</text>
								</subparagraph></paragraph><paragraph id="H6E89158C8D55450BA07D078B69E51077"><enum>(3)</enum><text display-inline="yes-display-inline">include—</text>
								<subparagraph id="HE15A800E143D42DF9C765B709413B3D1"><enum>(A)</enum><text>an uninterruptible power
				source;</text>
								</subparagraph><subparagraph id="H46CB7F9CF77E408F99963A3B64DFB55A"><enum>(B)</enum><text>a spatial sensor;
				and</text>
								</subparagraph><subparagraph id="H405D0C30E3BA4EED81BD7154113F73E5"><enum>(C)</enum><text>secure Internet access to
				real-time physical, biological, geological, and environmental monitoring data
				gathered by the system
				sensors.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H83AA8505FCD6469090B749269A02382C"><enum>(b)</enum><header>Request for
			 information</header><text>Within 60 days after the date of enactment of this
			 Act, the Secretary of the department in which the Coast Guard is operating
			 shall issue a request for information to determine the most capable and
			 efficient domestic systems that meet the requirements under section 4119 of the
			 Oil Pollution Act of 1990, as amended by this section.</text>
			</subsection><subsection id="H7E5157D4ED0E417AB343F1E8D65052ED"><enum>(c)</enum><header>Implementing
			 regulations</header><text>Within 180 days after the date of enactment of this
			 Act, the Secretary of the department in which the Coast Guard is operating
			 shall issue regulations to implement section 4119 of the Oil Pollution Act of
			 1990 as amended by this section.</text>
			</subsection><subsection id="H6719BCB0209440F1B5076D9FF8446CC0"><enum>(d)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 2 of the Oil Pollution
			 Act of 1990 is amended by adding at the end of the items relating to such
			 subtitle the following new item:</text>

							</paragraph></subsection><subsection id="H209DC8EF95994344A0D3870BE63B06BC"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H79C90F47F4F6448B9E8E71B1491009FE"><enum>(1)</enum><text>The appointment and the
				grade of vice admiral shall be effective on the date the officer assumes that
				duty and, except as provided in paragraph (2) of this subsection or in section
				51(d) of this title, shall terminate on the date the officer is detached from
				that duty.</text>
							</paragraph><paragraph changed="added" committee-id="HPW00" id="HA1A178B6A7F247EB9534C4BD4426C204" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>An officer who is
				appointed to a position designated under subsection (a) shall continue to hold
				the grade of vice admiral—</text>
								<subparagraph id="H969939280E544B4290D6EBA38A615242"><enum>(A)</enum><text>while under orders
				transferring the officer to another position designated under subsection (a),
				beginning on the date the officer is detached from that duty and terminating on
				the date before the day the officer assumes the subsequent duty, but not for
				more than 60 days;</text>
								</subparagraph><subparagraph id="H47726B6E190840629DDE569A1DC6C237"><enum>(B)</enum><text>while hospitalized,
				beginning on the day of the hospitalization and ending on the day the officer
				is discharged from the hospital, but not for more than 180 days; and</text>
								</subparagraph><subparagraph id="H88481E578E264CCEBF9401D44131051C"><enum>(C)</enum><text>while awaiting
				retirement, beginning on the date the officer is detached from duty and ending
				on the day before the officer’s retirement, but not for more than 60
				days.</text>
								</subparagraph></paragraph></subsection><subsection id="H65123B468DDE418484A5CA2B2065375B"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H088210FD4E9F45C6BAFBF2B76CECE994"><enum>(1)</enum><text>An appointment of an
				officer under subsection (a) does not vacate the permanent grade held by the
				officer.</text>
							</paragraph><paragraph changed="added" committee-id="HPW00" id="H26BFE6444A04429588C4602DFC8A32F6" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>An officer serving in a
				grade above rear admiral who holds the permanent grade of rear admiral (lower
				half) shall be considered for promotion to the permanent grade of rear admiral
				as if the officer was serving in the officer’s permanent grade.</text>
							</paragraph></subsection><subsection id="H819C4B093DC74F8894D3BA22B80117EC"><enum>(d)</enum><text>Whenever a vacancy occurs
				in a position designated under subsection (a), the Commandant shall inform the
				President of the qualifications needed by an officer serving in that position
				or office to carry out effectively the duties and responsibilities of that
				position or
				office.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H675BE410D641490C82BDBAACB4C37CFB"><enum>(c)</enum><header>Repeal</header><text>Section
			 50a of such title is repealed.</text>
			</subsection><subsection id="H8B1198233D5F428D917B6BB6590ADD50"><enum>(d)</enum><header>Conforming
			 amendments</header><text>Section 51 of such title is amended—</text>
				<paragraph id="H7C75E7004BF84DB799C9057A8FDDD340"><enum>(1)</enum><text>by striking subsections
			 (a), (b), and (c) and inserting the following:</text>
					<quoted-block changed="added" committee-id="HPW00" id="HA7D11BBB4D354528A05B3C16D4E25011" reported-display-style="italic" style="OLC">
						<subsection id="H4F9555E5C2314B959106400B001A082E"><enum>(a)</enum><text>An officer, other than
				the Commandant, who, while serving in the grade of admiral or vice admiral, is
				retired for physical disability shall be placed on the retired list with the
				highest grade in which that officer served.</text>
						</subsection><subsection id="H6B2373E7FDEA4674952D5DD670D50564"><enum>(b)</enum><text>An officer, other than
				the Commandant, who is retired while serving in the grade of admiral or vice
				admiral, or who, after serving at least 2<fraction>½</fraction> years in the
				grade of admiral or vice admiral, is retired while serving in a lower grade,
				may in the discretion of the President, be retired with the highest grade in
				which that officer served.</text>
						</subsection><subsection id="H5EC720ACA2EC4F59B0126C973B5EAEC6"><enum>(c)</enum><text>An officer, other than
				the Commandant, who, after serving less than 2<fraction>½</fraction> years in
				the grade of admiral or vice admiral, is retired while serving in a lower
				grade, shall be retired in his permanent
				grade.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H079A3F44794748C28559EF6A1DFB2122"><enum>(2)</enum><text>by striking <quote>Area
			 Commander, or Chief of Staff</quote> in subsection (d)(2) and inserting
			 <quote>or Vice Admiral</quote>.</text>
				</paragraph></subsection><subsection id="H80058A2BCB1E47EEBF928B8C22341A50"><enum>(e)</enum><header>Continuity of
			 grade</header><text>Section 52 of such title is amended by inserting <quote>or
			 admiral</quote> after <quote>vice admiral</quote> the first place it
			 appears.</text>
			</subsection><subsection id="HDD76C42A7CCC4AE99D7C3B1AF0DD7A1C"><enum>(f)</enum><header>Continuation on active
			 duty</header><text>The second sentence of section 290(a) of such title is
			 amended to read as follows: <quote>Officers, other than the Commandant, serving
			 for the time being or who have served in the grade of vice admiral or admiral
			 are not subject to consideration for continuation under this subsection, and as
			 to all other provisions of this section shall be considered as having been
			 continued at the grade of rear admiral.</quote>.</text>

			 be reappointed by reason of the enactment of that Act.</text>
					</subparagraph></paragraph><paragraph id="H379A8DDB25764A52BC44BE2CEAEBB98F"><enum>(2)</enum><text>Notwithstanding any other
			 provision of law, an officer who, on the date of enactment of this Act, is
			 serving as Chief of Staff, Commander, Atlantic Area, or Commander, Pacific
			 Area—</text>
					<subparagraph id="H6D47DC4EA667499EB9BE99616F101EE3"><enum>(A)</enum><text>shall continue to have
			 the grade of vice admiral with pay and allowance of that grade until such time
			 that the officer is relieved of his duties and appointed and confirmed to
			 another position as a vice admiral or admiral; or</text>
					</subparagraph><subparagraph id="H7E84DCF861FE404DBA21C093DC4AFCCC"><enum>(B)</enum><text>for the purposes of
			 transition, may continue at the grade of vice admiral with pay and allowance of
			 that grade, for not more than 1 year after the date of enactment of this Act,
			 to perform the duties of the officer’s former position and any other such
			 duties that the Commandant prescribes.</text>
					</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="H8468CA1E8A3D4C5896327808DE3A32AB"><enum>38.</enum><header>Oil and gas exploration
			 and production</header><text display-inline="no-display-inline">Section 502 of
			 the Federal Water Pollution Control Act (33 U.S.C. 1362) is amended—</text>
			<paragraph id="H03CAE634842E4AE28781EC57185E7128"><enum>(1)</enum><text>by striking paragraph
			 (24); and</text>
			</paragraph><paragraph id="HA26EB35F56C0445CB2FAE2A23E2E226C"><enum>(2)</enum><text>by redesignating
			 paragraph (25) as paragraph (24).</text>
			</paragraph></section><section id="H6C8C9FB3D3EF4F3A925E1C26EDC76A35"><enum>39.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="HAD8BCA81C0D0418F9365243CA7189C37"><enum>(a)</enum><header>Coast
			 Guard</header><text display-inline="yes-display-inline">In addition to amounts
			 made available pursuant to section 1012(a)(5)(A) of the Oil Pollution Act of
			 1990 (33 U.S.C. 2712(a)(5)(A)), there is authorized to be appropriated to the
			 Secretary of the department in which the Coast Guard is operating from the Oil
			 Spill Liability Trust Fund established by section 9509 of the Internal Revenue
			 Code of 1986 (26 U.S.C. 9509) the following:</text>
				<paragraph id="H8728D6A41E50432089D3304E48905210"><enum>(1)</enum><text display-inline="yes-display-inline">For fiscal year 2011, $15,000,000.</text>
				</paragraph><paragraph id="H2EF0E8B9B93A48D893A34052F7129B96"><enum>(2)</enum><text display-inline="yes-display-inline">For each of fiscal years 2012 through 2015,
			 $16,000,000.</text>
				</paragraph></subsection><subsection id="H14AB959F11904A839C379ADFFD167CD3"><enum>(b)</enum><header>Environmental
			 Protection Agency</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Administrator of the Environmental
			 Protection Agency from the Oil Spill Liability Trust Fund to implement this Act
			 and the amendments made by this Act $10,000,000 for each of fiscal years 2011
			 through 2015.</text>
			</subsection><subsection id="H8B09E484929F41D3A0E74EE7C06A528C"><enum>(c)</enum><header>Department of
			 Transportation</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary of Transportation from the Oil
			 Spill Liability Trust Fund to carry out the purposes of this Act and the
			 amendments made by this Act the following:</text>
