			 <quote><short-title>Restoration of Emergency Unemployment
			 Compensation Act of 2010</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H0B67F8D804E8466A969164D2AA7C249A" section-type="subsequent-section"><enum>2.</enum><header>Extension of
			 unemployment insurance provisions</header>
			<subsection display-inline="no-display-inline" id="H5E013840D16F4208A702958648BD25D9"><enum>(a)</enum><header>In
			 general</header><paragraph commented="no" display-inline="yes-display-inline" id="H9BC315814DC94A1EAB8694C5F3B1633A"><enum>(1)</enum><text>Section 4007 of the
			 Supplemental Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended—</text>
					<subparagraph id="H465A7F82A4B249D58146568A5790B5A1" indent="up1"><enum>(A)</enum><text>by striking <quote>June 2,
			 2010</quote> each place it appears and inserting <quote>November 30,
			 2010</quote>;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H7CE404D9FB2C47C28E607E62932C43DB" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">in the heading for subsection (b)(2), by
			 striking <quote><header-in-text level="paragraph" style="OLC">June 2,

			 444), is amended—</text>
					<subparagraph id="HB56A4E442AC5413A9A29B20DA165BBA5"><enum>(A)</enum><text>by striking <quote>June 2,
			 2010</quote> each place it appears and inserting <quote>December 1,
			 2010</quote>; and</text>
					</subparagraph><subparagraph id="HE65EE09895674274AC592CB569A805BA"><enum>(B)</enum><text>in subsection (c), by striking
			 <quote>November 6, 2010</quote> and inserting <quote>May 1,
			 2011</quote>.</text>
					</subparagraph></paragraph><paragraph id="H1E5338710C7A4DDEA38B3F756ED736A0" indent="up1"><enum>(3)</enum><text>Section 5 of the Unemployment
			 Compensation Extension Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/449">Public Law 110–449</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended by striking <quote>November 6,
			 2010</quote> and inserting <quote>April 30, 2011</quote>.</text>
				</paragraph></subsection><subsection id="HA742878F98F64FFA9FE0CC2383B3D930"><enum>(b)</enum><header>Funding</header><text>Section
			 4004(e)(1) of the Supplemental Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law
			 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended—</text>
				<paragraph id="H9ABE188CA21D4DA784011A5D01EFD669"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
			 <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="HDFCF32CC5D7F46B4A9ED86A1CFA1E304"><enum>(2)</enum><text>by inserting after
			 subparagraph (E) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HAB2AA83A2C214417AB586D12803A2179" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="H2CFDE6150B9549DFBBE22AADB166CDD7"><enum>(F)</enum><text>the amendments
				made by section 2(a)(1) of the <short-title>Restoration of
				Emergency Unemployment Compensation Act of 2010</short-title>;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HE24585EA3EA949319ED8753536B6A027"><enum>(c)</enum><header>Conditions for
			 receiving emergency unemployment compensation</header><text display-inline="yes-display-inline">Section 4001(d)(2) of the Supplemental
			 Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended, in the matter preceding subparagraph
			 (A), by inserting before <quote>shall apply</quote> the following:
			 <quote>(including terms and conditions relating to availability for work,
			 active search for work, and refusal to accept work)</quote>.</text>
			</subsection><subsection id="H72FD9E4DD70B4464B2C0A15DC0157D17"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of the Continuing Extension Act of 2010
			 (<external-xref legal-doc="public-law" parsable-cite="pl/111/157">Public Law
			 111–157</external-xref>).</text>
			</subsection></section><section id="H380645878E4B496F90FDD51B7C42AED8"><enum>3.</enum><header>Coordination of
			 emergency unemployment compensation with regular compensation</header>
			<subsection display-inline="no-display-inline" id="H757769B94349438AAE9BFBB267D9803A"><enum>(a)</enum><header>Certain
			 individuals not ineligible by reason of new entitlement to regular
			 benefits</header><text>Section 4002 of the Supplemental Appropriations Act,
			 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public
			 Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended by adding at the end the
			 following:</text>
				<quoted-block id="H03FAFABED7064B19B2387B4267C53154" style="OLC">
					<subsection id="H1BF4355EEE2A4817B6F480BD26878870"><enum>(g)</enum><header>Coordination of
				emergency unemployment compensation with regular compensation</header>
						<paragraph id="HB436FCD1A6A94F19B4211CE6D3CF3903"><enum>(1)</enum><text>If—</text>
							<subparagraph id="HF234F5E8C50547CDA373642B7377F3C2"><enum>(A)</enum><text>an individual has
				been determined to be entitled to emergency unemployment compensation with
				respect to a benefit year,</text>
							</subparagraph><subparagraph id="H1120337AA642429688EE5E15699F8136"><enum>(B)</enum><text>that benefit year
				has expired,</text>
							</subparagraph><subparagraph id="HEC1F34F4A47B452F9C667B5192FCF861"><enum>(C)</enum><text>that individual
				has remaining entitlement to emergency unemployment compensation with respect
				to that benefit year, and</text>
							</subparagraph><subparagraph id="HFB7982771FD141CF944CC26C944F6191"><enum>(D)</enum><text>that individual
				would qualify for a new benefit year in which the weekly benefit amount of
				regular compensation is at least either $100 or 25 percent less than the
				individual’s weekly benefit amount in the benefit year referred to in
				subparagraph (A),</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">then the
				State shall determine eligibility for compensation as provided in paragraph
				(2).</continuation-text></paragraph><paragraph id="H9EC9DD428C4748B5ABCFDB56ABE3FD12"><enum>(2)</enum><text>For individuals
				described in paragraph (1), the State shall determine whether the individual is
				to be paid emergency unemployment compensation or regular compensation for a
				week of unemployment using one of the following methods:</text>
							<subparagraph id="HAE6CC4942D514DF4895F85BF9EB81C71"><enum>(A)</enum><text>The State shall,
				if permitted by State law, establish a new benefit year, but defer the payment
				of regular compensation with respect to that new benefit year until exhaustion
				of all emergency unemployment compensation payable with respect to the benefit
				year referred to in paragraph (1)(A);</text>
							</subparagraph><subparagraph id="HFDBCA90F9AAB416D91BECD0EAC13D90E"><enum>(B)</enum><text>The State shall,
				if permitted by State law, defer the establishment of a new benefit year (which
				uses all the wages and employment which would have been used to establish a
				benefit year but for the application of this paragraph), until exhaustion of
				all emergency unemployment compensation payable with respect to the benefit
				year referred to in paragraph (1)(A);</text>
							</subparagraph><subparagraph id="H90BAA84FF27D4D22A9808F1D96A45A4B"><enum>(C)</enum><text>The State shall
				pay, if permitted by State law—</text>
								<clause id="H1B53C16E7B424A30A48B0DF87234E5F6"><enum>(i)</enum><text>regular
				compensation equal to the weekly benefit amount established under the new
				benefit year, and</text>
								</clause><clause id="H1C74087E64994E15A23EBCA55BCDC052"><enum>(ii)</enum><text>emergency
				unemployment compensation equal to the difference between that weekly benefit
				amount and the weekly benefit amount for the expired benefit year; or</text>
								</clause></subparagraph><subparagraph id="HFE103D17CFB9411293EDF62080B6E129"><enum>(D)</enum><text>The State shall
				determine rights to emergency unemployment compensation without regard to any
				rights to regular compensation if the individual elects to not file a claim for
				regular compensation under the new benefit
				year.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H3345289642E74BB9932D50D52DCF3CF3"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to
			 individuals whose benefit years, as described in section 4002(g)(1)(B) the
			 Supplemental Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note), as amended by this section, expire after the date
			 of enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H5648CBE87B274FAB90EFD26166278756" section-type="subsequent-section"><enum>4.</enum><header>Requiring States to
			 not reduce regular compensation in order to be eligible for funds under the
			 emergency unemployment compensation program</header><text display-inline="no-display-inline">Section 4001 of the Supplemental
			 Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HECE12E0CCA6F4E509CBDA8EEA4DFB023" style="OLC">
				<subsection id="HED5C82F748244BD3AC1D53E7C0D4C55A"><enum>(g)</enum><header>Nonreduction
				rule</header><text>An agreement under this section shall not apply (or shall
				cease to apply) with respect to a State upon a determination by the Secretary
				that the method governing the computation of regular compensation under the
				State law of that State has been modified in a manner such that—</text>
					<paragraph id="H7163C31F31284DA3B547F60BCC69170C"><enum>(1)</enum><text>the average weekly
				benefit amount of regular compensation which will be payable during the period
				of the agreement occurring on or after June 2, 2010 (determined disregarding
				any additional amounts attributable to the modification described in section
				2002(b)(1) of the Assistance for Unemployed Workers and Struggling Families
				Act, as contained in
				<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law
				111–5</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note; 123 Stat.
				438)), will be less than</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H12000E921189445D940922B84B0EA320"><enum>(2)</enum><text>the average weekly
				benefit amount of regular compensation which would otherwise have been payable
				during such period under the State law, as in effect on June 2,
				2010.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="HFCE21018C5B146F1A7C8F704AB6FF207"><enum>5.</enum><header>Procedures</header><text display-inline="no-display-inline">Section 4001 of the Supplemental
			 Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note), as amended by section 4, is amended by adding at
			 the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HE45E28FDBF9947549DE09D2C537F2177" style="OLC">
				<subsection id="H4BBC3F7EEF184789A0358F77FA876D62"><enum>(h)</enum><header>Procedures</header><text display-inline="yes-display-inline">Any State with an agreement under this Act
				shall implement reasonable procedures to—</text>
					<paragraph id="H527B3F97665F4406A7A8BA7730FB2E99"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that benefits under this Act are not
				provided to any person who appears on any current list of known or suspected
				terrorists provided to the State by any government agency;</text>
					</paragraph><paragraph id="H75DD9EED59084EA69A2D45434589107A"><enum>(2)</enum><text>ensure that
				benefits under this Act are not provided to any individual convicted of a sex
				offense against a minor (as such terms are defined in section 111 of the Sex
				Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>)); and</text>
					</paragraph><paragraph id="HE265D616B5DE45A190E4C04943AB26FE"><enum>(3)</enum><text>ensure that the
				State is enforcing requirements under subsection (f) of this section to bar
				unauthorized aliens from receiving emergency unemployment compensation under
				this
				Act.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6D55ADC9BCBE4F9AA85C101263C93547"><enum>6.</enum><header>Budgetary
			 provisions</header>
			<subsection id="HC794BA58F313401E8098FF164DABF748"><enum>(a)</enum><header>Statutory
			 PAYGO</header><text display-inline="yes-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 ‘Budgetary Effects of PAYGO Legislation’ for this Act, submitted for printing
			 in the Congressional Record by the Chairman of the House Budget Committee,
			 provided that such statement has been submitted prior to the vote on
			 passage.</text>
			</subsection><subsection id="HF895668FEE3D42BD8EABB9C4AB1474CD"><enum>(b)</enum><header>Emergency
			 designations</header><text>Sections 2 and 3—</text>
				<paragraph id="H964D8B205EAD4A4D90D84E0D3E7107F3"><enum>(1)</enum><text display-inline="yes-display-inline">are designated as an emergency requirement
			 pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010
			 (<external-xref legal-doc="public-law" parsable-cite="pl/111/139">Public Law
			 111–139</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C.
			 933(g)</external-xref>);</text>
				</paragraph><paragraph id="HA1C0B83EB657455BBC77A104555FDACC"><enum>(2)</enum><text>in the House of
			 Representatives, are designated as an emergency for purposes of pay-as-you-go
			 principles; and</text>
				</paragraph><paragraph id="H790A21619F9B40809D37771446699AEA"><enum>(3)</enum><text>in the Senate, are
			 designated as an emergency requirement pursuant to section 403(a) of S. Con.
			 Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal
			 year 2010.</text>
				</paragraph></subsection></section></legis-body>
