		<official-title display="yes">To provide a technical adjustment with
		  respect to funding for independent living centers under the Rehabilitation Act
		  of 1973 in order to ensure stability for such centers.</official-title>

		<section id="HFED3CFC02EE4456E9D296BD94C0ED2D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Independent Living Centers Technical
			 Adjustment Act</short-title></quote>.</text>
		</section><section id="HF79BFC0C826342DDB28916C5BCDA3AD1"><enum>2.</enum><header>Independent
			 living centers technical adjustment</header>
			<subsection id="HF0D718289A8A4803866E8D75A76FB940"><enum>(a)</enum><header>Grants to
			 centers for independent living in States in which Federal funding exceeds State
			 funding</header>
				<paragraph id="H3334F7F3207742DA891D67BFCA97020C"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the conditions
			 described in paragraph (2) are satisfied with respect to a State, in awarding
			 funds to existing centers for independent living (described in section 722(c)
			 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f-1">29 U.S.C.
			 796f–1(c)</external-xref>)) in the State, the Commissioner of the
			 Rehabilitation Services Administration—</text>
					<subparagraph id="H891A3B36DC524A48A0EAE46DF649985A"><enum>(A)</enum><text>in fiscal year
			 2010—</text>
						<clause commented="no" id="H3BD65F98397545D6BF913605AC3B546A"><enum>(i)</enum><text display-inline="yes-display-inline">shall distribute among such centers funds
			 appropriated for the centers for independent living program under part C of
			 title VII of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et seq.</external-xref>) by any Act
			 other than the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law
			 111–5</external-xref>) in the same proportion as such funds were distributed
			 among such centers in the State in fiscal year 2009, notwithstanding section
			 722(e) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f-1">29 U.S.C. 796f–1(e)</external-xref>) and any
			 contrary provision of a State plan submitted under section 704 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/796c">29 U.S.C.
			 796c</external-xref>); and</text>
						</clause><clause id="HD1D2C49F565B4F828F82BC2C0B704AB4"><enum>(ii)</enum><text>shall disregard
			 any funds provided to such centers from funds appropriated by the American
			 Recovery and Reinvestment Act of 2009 for the centers for independent living
			 program under part C of title VII of the Rehabilitation Act of 1973
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et
			 seq.</external-xref>); and</text>
						</clause></subparagraph><subparagraph id="H8543CFC98D7D4B7AB1AC82B5CC9FA80A"><enum>(B)</enum><text display-inline="yes-display-inline">in fiscal year 2011 and subsequent fiscal
			 years, shall disregard any funds provided to such centers from funds
			 appropriated by the American Recovery and Reinvestment Act of 2009
			 (<external-xref legal-doc="public-law" parsable-cite="pl/111/5">Public Law
			 111–5</external-xref>) for the centers for independent living program under
			 part C of title VII of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et seq.</external-xref>).</text>
					</subparagraph></paragraph><paragraph id="H9C66E6F0AE5E4795A6879730CFD4113F"><enum>(2)</enum><header>Conditions</header><text display-inline="yes-display-inline">The conditions described in this paragraph
			 are the following:</text>
					<subparagraph id="HA8543604B4B74C4881BF3DC3D0B796A0"><enum>(A)</enum><text>The Commissioner
			 receives a request from the State, not later than July 30, 2010, jointly signed
			 by the State’s designated State unit (referred to in section 704(c) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/796c">29 U.S.C.
			 796c(c)</external-xref>)) and the State’s Statewide Independent Living Council
			 (established under section 705 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/796d">29 U.S.C. 796d</external-xref>)), for the
			 Commissioner to disregard any funds provided to centers for independent living
			 in the State from funds appropriated by the American Recovery and Reinvestment
			 Act of 2009 for the centers for independent living program under part C of
			 title VII of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et seq.</external-xref>).</text>
					</subparagraph><subparagraph id="H6083EDC8FEC5415BB06A8B1720B1ED92"><enum>(B)</enum><text display-inline="yes-display-inline">The Commissioner is not conducting a
			 competition to establish a new part C center for independent living with funds
			 appropriated by the American Recovery and Reinvestment Act of 2009 in the
			 State.</text>
					</subparagraph></paragraph></subsection><subsection id="HD7D274FD87364099AC7A1F5FF83E8CE5"><enum>(b)</enum><header>Grants to
			 centers for independent living in States in which State funding equals or
			 exceeds Federal funding</header><text display-inline="yes-display-inline">In
			 awarding funds to existing centers for independent living (described in section
			 723(c) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f-2">29 U.S.C. 796f–2(c)</external-xref>)) in a State,
			 the director of the designated State unit that has approval to make such
			 awards—</text>
				<paragraph commented="no" id="HDF05A632CA614EE1946D93201D77A2AF"><enum>(1)</enum><text display-inline="yes-display-inline">in fiscal year 2010—</text>
					<subparagraph id="H4A54CBC38E14460FBBCCD1B18FFB1CDD"><enum>(A)</enum><text>may distribute
			 among such centers funds appropriated for the centers for independent living
			 program under part C of title VII of the Rehabilitation Act of 1973
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et
			 seq.</external-xref>) by any Act other than the American Recovery and
			 Reinvestment Act of 2009 in the same proportion as such funds were distributed
			 among such centers in the State in fiscal year 2009, notwithstanding section
			 723(e) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f-2">29 U.S.C. 796f–2(e)</external-xref>) and any
			 contrary provision of a State plan submitted under section 704 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/796c">29 U.S.C.

					</subparagraph><subparagraph id="HBA48BF6BC56F4E9DA920A1F22BEDEE97"><enum>(B)</enum><text>may disregard any
			 funds provided to such centers from funds appropriated by the American Recovery
			 and Reinvestment Act of 2009 for the centers for independent living program
			 under part C of title VII of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f et
			 seq.</external-xref>); and</text>
					</subparagraph></paragraph><paragraph id="H2076B8CD0F6C4E1DA2F444F6D98E452A"><enum>(2)</enum><text display-inline="yes-display-inline">in fiscal year 2011 and subsequent fiscal
			 years, may disregard any funds provided to such centers from funds appropriated
			 by the American Recovery and Reinvestment Act of 2009 for the centers for
			 independent living program under part C of title VII of the Rehabilitation Act
			 of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C.
			 796f et seq.</external-xref>).</text>
				</paragraph></subsection></section></legis-body>
