		<section commented="no" display-inline="no-display-inline" id="HCE20D3B27652463D8440092BBE3227A6" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Equity in Excellence Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H977D80EC197E47FDB86B8EDE4502CB4D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Equity in excellence grants</header>
			<subsection commented="no" display-inline="no-display-inline" id="H80BE58C3BAA348A783FAA54B409E1852"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title I of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6301 et seq.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H959C74FB875A4ED0838A19EE9B6A94C3"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating part I as part J;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD838F243A8404E488A3A956EFEC231E3"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 1830 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HA14AE947C17F45CE914657D69611DAF7" style="OLC">
						<part commented="no" id="H281FE780B74E4D34A4EFC3E8A91FA267" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Equity in excellence grants</header>
							<section commented="no" display-inline="no-display-inline" id="HF341488BE22549F9A6756668AC36C272" section-type="subsequent-section"><enum>1841.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this part is to support
				high-need local educational agencies to develop programs that ensure that the
				rate of growth in academic achievement of high-achieving, educationally
				disadvantaged students in grades 1 through 4 who are served by the high-need
				local educational agencies is comparable to that of such students' more
				advantaged, high-achieving peers.</text>
							</section><section commented="no" display-inline="no-display-inline" id="HCBD824BDC32A4AE6ADE715DA1224BA0A" section-type="subsequent-section"><enum>1842.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this part:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H403CCAFA13364A5E8BB0164859206703"><enum>(1)</enum><header display-inline="yes-display-inline">Cohort</header><text display-inline="yes-display-inline">The term <term>cohort</term> means a group
				of high-achieving students in any of grades 1 through 4 who attend schools
				served by the same local educational agency.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8D06EEAB87C40A58AB41ADB19C0AF2F"><enum>(2)</enum><header display-inline="yes-display-inline">Educationally disadvantaged
				student</header><text display-inline="yes-display-inline">The term
				<term>educationally disadvantaged student</term> means a student who is from a
				low-income family, as determined by the measure of poverty used for the
				purposes of section 1113(a)(5) by the local educational agency serving the
				student.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F6744A1EB894A90970BAF77B406AC7D"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term>
				means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H97F3147D3EFE43379AA0FC2C7A372AC8"><enum>(A)</enum><text display-inline="yes-display-inline">a high-need local educational
				agency;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6BE991547E154743AE2778D8DDA579A1"><enum>(B)</enum><text display-inline="yes-display-inline">a consortium of local educational agencies
				that includes a high-need local educational agency; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9845A2F48252471D8424FCC563D40DF9"><enum>(C)</enum><text display-inline="yes-display-inline">an eligible partnership.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E89F169DE184302BCB0D2677CC00D9E"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible partnership</header><text display-inline="yes-display-inline">The term <term>eligible partnership</term>
				means a partnership consisting of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H4957C2D271D64DD2B22050AD249EA303"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 1 eligible high-need local
				educational agency; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4EF283D775464E19AC850BF7BB7A4715"><enum>(B)</enum><text display-inline="yes-display-inline">not less than 1 institution of higher
				education, or nonprofit organization, with significant expertise in educating
				students with gifts and talents.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6DBBDB094784A6C8FD18F675BDFE789"><enum>(5)</enum><header display-inline="yes-display-inline">High-achieving</header><text display-inline="yes-display-inline">The term <term>high-achieving</term>, when
				used with respect to a student, means a student who—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HD5966705BBC64044B43E6FAC9D743CBC"><enum>(A)</enum><text display-inline="yes-display-inline">based on a valid and reliable assessment
				administered upon the student's entry into grade 1, is performing academically
				in the top 10 percent of the students entering grade 1 at the school, for any
				subgroup described in section 1111(b)(2)(C)(v)(II) that includes the student;
				or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1DC1CCBF388F48C2A8CDD37351251AD9"><enum>(B)</enum><text display-inline="yes-display-inline">is identified by the local educational
				agency or elementary school for gifted education services through teacher or
				family referrals.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83983BC306D341798A66C3CB500783EE"><enum>(6)</enum><header display-inline="yes-display-inline">High-need local educational
				agency</header><text display-inline="yes-display-inline">The term
				<term>high-need local educational agency</term> means a local educational
				agency that meets the requirements of section 2102(3)(A).</text>
								</paragraph></section><section commented="no" display-inline="no-display-inline" id="H450F41BEC99348918E069E16C7D42BD3" section-type="subsequent-section"><enum>1843.</enum><header display-inline="yes-display-inline">Equity in excellence grants</header>
								<subsection commented="no" display-inline="no-display-inline" id="H33F6CEE3A3124836A2BB1A8909C0DB0C"><enum>(a)</enum><header display-inline="yes-display-inline">Program authorized</header>
									<paragraph commented="no" display-inline="no-display-inline" id="H3724885D6BCA46D8B23E8E7578AB3DA2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From amounts appropriated to carry out this
				part and not reserved under section 1845(b)(2), the Secretary is authorized to
				award demonstration grants, on a competitive basis, to eligible entities to
				enable the eligible entities to develop targeted interventions and academic
				services to ensure that, among the students served by high-need local
				educational agencies, the rate of growth in academic achievement of the cohort
				of high-achieving, educationally disadvantaged students is comparable to the
				cohort of such students' more advantaged, high-achieving peers.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6CA0D55E293149E1B78C61FE6A7068C3"><enum>(2)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">A grant awarded under this part shall be
				for a period of not more than 3 years and may be extended by the Secretary for
				an additional 2 years, in accordance with section 1845(a)(2).</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7469E7AD90084906822BFA7D6EBFE27E"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">An eligible entity desiring a grant under
				this part shall submit an application to the Secretary at such time, in such
				manner, and containing such information as the Secretary may require.</text>
								</subsection></section><section commented="no" display-inline="no-display-inline" id="H440C01F70B914CE182428DC7F102E11A" section-type="subsequent-section"><enum>1844.</enum><header display-inline="yes-display-inline">Authorized use of funds</header><text display-inline="no-display-inline">An eligible entity receiving a grant under
				this part shall use grant funds to carry out, for the cohorts of high-achieving
				students served by the high-need local educational agency participating in the
				eligible entity, all of the following activities:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H2E44B418BA194E9E9780DBB987145B24"><enum>(1)</enum><text display-inline="yes-display-inline">Ensuring that assessments provide
				diagnostic information that informs instruction for high-achieving
				students.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H46045759F6D748D29E21D31CEB1DC305"><enum>(2)</enum><text display-inline="yes-display-inline">Implementing evidence-based, innovative
				educational strategies, such as enrichment programs and academic acceleration
				strategies, designed to maximize the learning of high-potential and
				high-achieving students.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H836101E204FE4F3E9F22ABF39BD8A213"><enum>(3)</enum><text display-inline="yes-display-inline">Procuring or utilizing high-quality
				instructional materials.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB566BCC00F54A3ABA9149A28E8CE3CF"><enum>(4)</enum><text display-inline="yes-display-inline">Carrying out training and professional
				development for school personnel involved in the teaching of high-achieving,
				educationally disadvantaged students, such as instructional staff, principals,
				counselors, and psychologists.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H43E7927D6E674629B1ADF6DE8ECD5458"><enum>(5)</enum><text display-inline="yes-display-inline">Conducting education and training for
				parents of high-achieving, educationally disadvantaged students to support
				educational excellence for such students.</text>
								</paragraph></section><section commented="no" display-inline="no-display-inline" id="HC4460EA5E8F84B15A17F019D3954BED6" section-type="subsequent-section"><enum>1845.</enum><header display-inline="yes-display-inline">Reports and data collection</header>
								<subsection commented="no" display-inline="no-display-inline" id="H4EF3FC5F21C843498BA0A979D89F9B94"><enum>(a)</enum><header display-inline="yes-display-inline">Third-Year report</header>
									<paragraph commented="no" display-inline="no-display-inline" id="H680F71C851D64A52932DB7CC59FCB108"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">At the end of the third year of a grant
				under this part, the eligible entity receiving such grant shall prepare, and
				submit to the Secretary, a report regarding—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="H1EB045B08CB740F595F856569A8A3ECD"><enum>(A)</enum><text display-inline="yes-display-inline">how grant funds were expended; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD6A307EFE548473BB96AB8DE8B337DC8"><enum>(B)</enum><text display-inline="yes-display-inline">the outcomes produced by the grant.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8017B7FDB4EE4C7AB8B0073BEE3D0C5E"><enum>(2)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Upon review of a third-year report
				submitted by an eligible entity under paragraph (1), the Secretary may extend a
				grant awarded under this part for not more than 2 more years based on the
				eligible entity's performance.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB7FFA3B4EEAB4331B54FABFF467DA62A"><enum>(b)</enum><header display-inline="yes-display-inline">Data collection</header>
									<paragraph commented="no" display-inline="no-display-inline" id="H3C4951CB28C749D1BB887FFAA9C338C1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Institute of Education Sciences, shall—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="H53F36024C301415A938689ED1EA5842B"><enum>(A)</enum><text display-inline="yes-display-inline">collect data annually comparing
				longitudinal achievement levels of the cohorts of high-achieving, educationally
				disadvantaged students served by a grant under this part with such students'
				more advantaged peers; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB62B582D8D8349A7AE8E766FF0B52862"><enum>(B)</enum><text display-inline="yes-display-inline">release such data for analysis by
				independent research institutions.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2520A27CDE8C493CB255DC86FBF30FD6"><enum>(2)</enum><header display-inline="yes-display-inline">Reservation</header><text display-inline="yes-display-inline">The Secretary may reserve not more than 1
				percent of the total amount appropriated for this part to carry out subsection
				(a).</text>
									</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H4D9ED4932EE843BE8E828DBAACF38C37" section-type="subsequent-section"><enum>1846.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">Nothing in this part shall be construed to
				prohibit a recipient of a grant under this part from serving high-achieving,
				educationally disadvantaged students simultaneously with students with similar
				educational needs in the same educational settings, where
				appropriate.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H88DC1755F3884CA49F0CD38CF5488FE5"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">The Elementary and Secondary Education Act
			 of 1965 (20 U.S.C. 6301 et seq.) is further amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HCD7AF313C76F4691850B0ECA2BE9004B"><enum>(1)</enum><text display-inline="yes-display-inline">in the table of contents in section
			 2—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HA1CC520C25DA4986BFF61B732AF1681C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the item relating to part I and
