		<section display-inline="no-display-inline" id="H190485D3ADE54528981804D3F09DAA73" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cell Phone Early Termination Fee,
			 Transparency, and Fairness Act</short-title></quote> or the <quote><short-title>Cell Phone ETF Act</short-title></quote>.</text>
		</section><section id="HE9B23DC514384D9B8EF8A29A1917FB1F"><enum>2.</enum><header>Pro-rated early
			 termination fees for cell phones</header>
			<subsection id="H333FEC9249FA473D9E3A3B8A9D32C135"><enum>(a)</enum><header>In
			 General</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Federal Communications Commission shall promulgate regulations
			 requiring, at a minimum, that providers of commercial mobile service (as
			 defined in section 332(d)(1) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47 U.S.C.
			 332(d)(1))—</text>
				<paragraph id="H8B9D053347F54C3998BE303D2A2C7A4B"><enum>(1)</enum><text>prorate any early
			 termination fee over the term of a subscriber’s contract; and</text>
				</paragraph><paragraph id="HDC1A2F06E03D46C1BC1685EC4234B7BF"><enum>(2)</enum><text>link the fee to
			 the cost to the provider of the handset device provided to the subscriber,
			 reduced by the price paid by the subscriber for the handset device at the start
			 of a subscriber’s contract.</text>
				</paragraph></subsection><subsection id="HE3030DFBAE974A3EA9CFC1A7C4CB00FE"><enum>(b)</enum><header>Rate of
			 Reduction and Other Considerations</header><text>In promulgating the
			 regulations required by subsection (a), the Commission—</text>
				<paragraph id="H962582DC75EC4C25876637F9257F0819"><enum>(1)</enum><text>shall prohibit an
			 early termination fee that exceeds the cost to the provider of the handset
			 device provided to the subscriber, reduced by the price paid by the subscriber
			 for the handset device at the start of a subscriber’s contract;</text>
				</paragraph><paragraph id="H30EA5AB0E2694563ACDBCFBA8639F486"><enum>(2)</enum><text>shall require a
			 ratable reduction of the early termination fee over the term of the
			 contract;</text>
				</paragraph><paragraph id="H4D8B7338700A45E690F3B1263608AC55"><enum>(3)</enum><text>shall require
			 clear and conspicuous disclosure of the early termination fee at the point of
			 purchase and disclosure on customers’ monthly statements of account of the
			 prorated early termination fee that would be due if the contract were
			 terminated before the end of the next billing cycle;</text>
				</paragraph><paragraph id="H75A7DEE68A4248499C127F338F2BB8FA"><enum>(4)</enum><text>shall consider,
			 among other things, the effect of early termination fees on competition and on
			 the ability of consumers to select and change providers of commercial mobile
			 service; and</text>
				</paragraph><paragraph id="H61FE89E97C8D4A629C318726F4EE38E2"><enum>(5)</enum><text>shall consider the
			 economic basis and business rationale for the imposition of early termination
			 fees by providers of commercial mobile service.</text>
				</paragraph></subsection></section><section id="H7A976F2822D54551A6070C833C767E60"><enum>3.</enum><header>No
			 preemption of State law</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 preempt the laws of any State or local government regulating early termination
			 fees chargeable to residents of that State or jurisdiction by commercial mobile
			 service providers to which section 2 applies.</text>
