		<official-title display="yes">To establish a program of research,
		  recovery, and other activities to provide for the recovery of the southern sea
		  otter.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H93B99CB405E34656A17B49BC74874166" style="OLC">
		<section id="H0E4E66FF36654B998A200895113F48FD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Southern Sea Otter Recovery and
			 Research Act</short-title></quote>.</text>
		</section><section id="H140D2A180F8B4834BE2048F5AED234EC"><enum>2.</enum><header>Southern sea
			 otter recovery and research program</header>
			<subsection id="H75D883BAF5664CCC9474DC0201F8FF7E"><enum>(a)</enum><header>In
			 General</header><text>The Secretary of the Interior, acting through the United
			 States Fish and Wildlife Service and the United States Geological Survey, shall
			 carry out a recovery and research program for southern sea otter populations
			 along the coast of California, informed by the prioritized research
			 recommendations of the Final Revised Recovery Plan for the southern sea otter
			 (Enhydra lutris nereis) published by the United States Fish and Wildlife
			 Service and dated February 24, 2003, the Research Plan for California Sea Otter
			 Recovery issued by the United States Fish and Wildlife Service Southern Sea
			 Otter Recovery Implementation Team and dated March 2, 2007, and any other
			 recovery, research, or conservation plan adopted by the United States Fish and
			 Wildlife Service after the date of enactment of this Act in accordance with
			 otherwise applicable law. The Recovery and Research Program shall include the
			 following:</text>
				<paragraph id="H96A7F6D8842F452998C0A915708293E1"><enum>(1)</enum><text display-inline="yes-display-inline">Monitoring, analysis, and assessment of
			 southern sea otter population demographics, health, causes of mortality, and
			 life history parameters, including range-wide population surveys.</text>
				</paragraph><paragraph id="H0EA5E5A464A345BD8C024BDACDD61FF1"><enum>(2)</enum><text>Development and
			 implementation of measures to reduce or eliminate potential factors limiting
			 southern sea otter populations that are related to marine ecosystem health or
			 human activities.</text>
				</paragraph></subsection><subsection id="H8D18DC1B93B14407A79DABFB823987B1"><enum>(b)</enum><header>Reappointment of
			 recovery implementation team</header><text>Not later than one year after the
			 date of enactment of this Act, the Secretary shall appoint persons to a
			 southern sea otter recovery implementation team as authorized under section
			 4(f)(2) of the Endangered Species Act of 1973 (16 U.S.C. 1533(f)(2)).</text>
			</subsection><subsection id="H79A932D6B97644969AF9C7E33FE44DE1"><enum>(c)</enum><header>Southern sea
			 otter research and recovery grants</header>
				<paragraph id="H2515FF48E97C484F81DA4E42CD66CC63"><enum>(1)</enum><header>Grant
			 authority</header><text>The Secretary shall establish a peer-reviewed,
			 merit-based process to award competitive grants for research regarding southern
			 sea otters and for projects assisting the recovery of southern sea otter
			 populations.</text>
				</paragraph><paragraph id="H97F4039511FB45D49E9D4078E5DA8A92"><enum>(2)</enum><header>Peer review
			 panel</header><text>The Secretary shall establish as necessary a peer review
			 panel to provide scientific advice and guidance to prioritize proposals for
			 grants under this subsection.</text>
				</paragraph><paragraph id="H534B442B341646DEA8A945B537C6E236"><enum>(3)</enum><header>Research grant
			 subjects</header><text>Research funded with grants under this subsection shall
			 be in accordance with the research recommendations of any plan referred to in
			 subsection (a), and may include the following topics:</text>
					<subparagraph id="H7E34E0AFF228463786A5D819278BDE43"><enum>(A)</enum><text>Causes of sea
			 otter mortality.</text>
					</subparagraph><subparagraph id="H37A096A91411433C881B49493CC0690C"><enum>(B)</enum><text>Southern sea otter
			 demographics and natural history.</text>
					</subparagraph><subparagraph id="H2A2BA29663264F7F801E16F28A88EDB7"><enum>(C)</enum><text>Effects and
			 sources of pollutants, nutrients, and toxicants on southern sea otters and
			 sequestration of contaminants.</text>
					</subparagraph><subparagraph id="HC930A27403AB4415B51EF7DCE382353C"><enum>(D)</enum><text>Effects and
			 sources of infectious diseases and parasites affecting southern sea
			 otters.</text>
					</subparagraph><subparagraph id="HC7B78C9C22A444C0A4DD55037848D0E1"><enum>(E)</enum><text>Limitations on the
			 availability of food resources for southern sea otters and the impacts of food
			 limitation on southern sea otter carrying capacity.</text>
					</subparagraph><subparagraph id="HED312E2717E3455C9FA496E6DD49A827"><enum>(F)</enum><text>Interactions
			 between southern sea otters and coastal fisheries and other human activities in
			 the marine environment.</text>
					</subparagraph><subparagraph id="H15D91064A5DD4BBFAAA964462D8527FE"><enum>(G)</enum><text>Assessment of the
			 keystone ecological role of sea otters in southern and central California’s
			 coastal marine ecosystems, including both the direct and indirect effects of
			 sea otter predation, especially as these effects influence human welfare,
			 resource utilization, and ecosystem services.</text>
					</subparagraph><subparagraph id="HF912E58EFF1A4C3385BAE033BC1017CC"><enum>(H)</enum><text>Assessment of the
			 adequacy of emergency response and contingency plans.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H647C1AF470174EE981A2FBDE25C79595"><enum>(4)</enum><header>Recovery project
			 subjects</header><text display-inline="yes-display-inline">Recovery projects
			 funded with grants under this subsection shall be conducted in accordance with
			 recovery recommendations of any plan referred to in subsection (a), and may
			 include projects to—</text>
					<subparagraph id="H0A0DB2C470D14E5F91E1BCDDEC738D83"><enum>(A)</enum><text>protect and
			 recover southern sea otters;</text>
					</subparagraph><subparagraph id="HEE5C341976D845369AA81EC913559D52"><enum>(B)</enum><text display-inline="yes-display-inline">reduce, mitigate, or eliminate potential
			 factors limiting southern sea otter populations that are related to human
			 activities, including projects to—</text>
						<clause id="H6C678669A0FA4C409290D7C4FBD4DBFD"><enum>(i)</enum><text>reduce, mitigate,
			 or eliminate factors contributing to mortality, adversely affecting health, or
			 restricting distribution and abundance; and</text>
						</clause><clause id="H49BB89C3EFD14C0DA665EAF99F4578AB"><enum>(ii)</enum><text>reduce, mitigate,
			 or eliminate factors that harm or reduce the quality of southern sea otter
			 habitat or the health of coastal marine ecosystems; and</text>
						</clause></subparagraph><subparagraph id="H2925079934C3483B913B0B97DA77F3D8"><enum>(C)</enum><text>implement
			 emergency response and contingency plans.</text>
					</subparagraph></paragraph></subsection><subsection id="H62306D476F4C4FCEB96E8C603E31E9B7"><enum>(d)</enum><header>Report</header><text>The
			 Secretary shall—</text>
				<paragraph id="H99F4560235324ED495B827E10DDC357F"><enum>(1)</enum><text>within 12 months
			 after the date of enactment of this Act, report to Congress on—</text>
					<subparagraph id="HCBEB42F5A0974AA5A2877F66A9027784"><enum>(A)</enum><text>the status of
			 southern sea otter populations;</text>
					</subparagraph><subparagraph id="H7671E58B8F4041B3A95EE61C8C0CB434"><enum>(B)</enum><text>implementation of
			 the Recovery and Research Program and the grant program; and</text>
					</subparagraph><subparagraph commented="no" id="H3E0A97D99241473E8C08FC09AC8B431E"><enum>(C)</enum><text>any relevant
			 formal consultations conducted under section 7 of the Endangered Species Act of
			 1973 (16 U.S.C. 1536) with respect to the southern sea otter; and</text>
					</subparagraph></paragraph><paragraph id="H25AA83AA8C414B3A9EABFDE04A5B1AA6"><enum>(2)</enum><text display-inline="yes-display-inline">within 24 months after the date of
			 enactment of this Act and every 5 years thereafter, and in consultation with a
			 southern sea otter recovery implementation team (if any) that is otherwise
			 being utilized by the Secretary under section 4(f) of the Endangered Species
			 Act of 1973 (16 U.S.C. 1533(f)), report to Congress and the public on—</text>
					<subparagraph id="HC46E1EE16BC34763ACB04F7038CB2C91"><enum>(A)</enum><text>an evaluation of
			 southern sea otter health, causes of southern sea otter mortality, and the
			 interactions of southern sea otters with California’s coastal marine
			 ecosystems;</text>
					</subparagraph><subparagraph id="HC218FC63D71B4A9C9176EB99FA570AC6"><enum>(B)</enum><text>an evaluation of
			 actions taken to improve southern sea otter health, reduce southern sea otter
			 mortality, and improve southern sea otter habitat;</text>
					</subparagraph><subparagraph id="HAE882E168B224B749A82C6AC8B91FE6A"><enum>(C)</enum><text>recommendation for
			 actions, pursuant to current law, to improve southern sea otter health, reduce
			 the occurrence of human-related mortality, and improve the health of such
			 coastal marine ecosystems; and</text>
					</subparagraph><subparagraph id="HDFBDB41EC4EC4016B5F5B74B23CC813B"><enum>(D)</enum><text>recommendations
			 for funding to carry out this Act.</text>
					</subparagraph></paragraph></subsection></section><section id="HE4FE18235D0D43DDA0A994D7E9396AD8"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H19B90C5E2B844AEA93085D34B89E09E5"><enum>(1)</enum><header>Recovery and
			 research program</header><text>The term <quote>Recovery and Research
			 Program</quote> means the recovery and research program under section
			 2(a).</text>
			</paragraph><paragraph id="HB017D7D699E64ED6BD882C62BCEBA417"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior, acting
			 through the United States Fish and Wildlife Service and the United States
			 Geological Survey.</text>
			</paragraph></section><section id="H067EABA3A9EB41DFBAF9D835B07BCA4C"><enum>4.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H9C3F74E2230342EE8A907E32AA6AF169"><enum>(a)</enum><header>In
			 general</header><text>There is authorized to be appropriated to the Secretary
			 to carry out this Act $5,000,000 for each of fiscal years 2010 through 2015 of
			 which—</text>
				<paragraph id="H76FD7614FBF149D39D8A045701BA2670"><enum>(1)</enum><text>no less than 30
			 percent shall be for research grants under section 2(c)(3); and</text>
				</paragraph><paragraph id="H3A61480FE59543E7AD1ECD4D02218890"><enum>(2)</enum><text>no less than 30
			 percent shall be for recovery projects under section 2(c)(4).</text>
				</paragraph></subsection><subsection id="HC2507CBAB5064EA587B8A338C66C1614"><enum>(b)</enum><header>Administrative
			 expenses</header><text>Of amounts available each fiscal year to carry out this
			 Act, the Secretary may expend not more than 7 percent to pay the administrative
			 expenses necessary to carry out this Act.</text>
			</subsection></section><section id="H11C84A6E33AE41F68979C9C5B3787D37"><enum>5.</enum><header>Termination</header><text display-inline="no-display-inline">This Act shall have no force or effect on
			 and after the date the Secretary (as that term is used in section 4(c)(2) of
			 the Endangered Species Act of 1973 (16 U.S.C. 1533(c)(2)) publishes a
			 determination that the southern sea otter should be removed from the lists
			 published under section 4(c) of the Endangered Species Act of 1973 (16 U.S.C.
			 1533(c)).</text>
