2.The Congress finds the following:
(1)United States
cities play an important role in the prosperity of the United States, driving
innovation and economic growth by employing many highly skilled workers.
(2)The dropout rate is higher at secondary
schools in urban areas and the elementary and secondary school students of
urban areas typically score below State and national averages on performance
exams.
(3)Schools in urban
areas often have teacher shortages in high-need subject areas such as
mathematics and science.
(4)Certain
neighborhoods in urban areas are stricken with poverty and struggle to attract
businesses and services.
(5)Health disparities
are pervasive in urban settings, and result, in part, from an insufficient and
ethnically imbalanced health workforce.
(6)Investing in
research and initiatives to solve the challenges of urban areas will bolster
the economic competitiveness of the United States and make the cities a better
place to live.
(7)Urban universities
are an essential part of education for many and enroll a large number of
students from local school districts, often training these students to be
educators in urban areas.
(8)Urban universities
are prominent employers, real estate developers, and business
incubators.
(9)Urban universities
are able to produce an urban health workforce, conduct interdisciplinary
research, provide clinical resources, and organize community and academic
partnerships on chronic diseases and health disparities.
(10)The Federal
Government should make investments to encourage urban universities to
coordinate, evaluate, and disseminate solutions to urban problems related to
education, community revitalization, health, and quality of life.
<enum>I</enum><header>Strengthening
communities</header>

<section id="H09404EF0914840828154C47FC810EE91" section-type="subsequent-section"><enum>101.</enum><header>Community outreach
partnership centers</header>
<subsection id="H3BAC4082FA6F4987B49B8C58EC66C15A"><enum>(a)</enum><header>Grant
program</header><text>The Secretary of Housing and Urban Development may make
grants under this section in accordance with subsection (b) to institutions of
higher education or consortia of such institutions—</text>
<paragraph display-inline="no-display-inline" id="H47B11E4E753249A089D58B4D8AC9E0E4"><enum>(1)</enum><text>to support new or
expand existing activities in community engagement by institutions of higher
education;</text>
</paragraph><paragraph commented="no" id="H940675EBB2A0446C9FE3767921229210"><enum>(2)</enum><text>to encourage
institutions of higher education to establish partnerships with their local
communities;</text>
</paragraph><paragraph id="H7A48BA87D5F8440798AE8C0F9C81A345"><enum>(3)</enum><text>to align teaching,
research, and service by institutions of higher education with the needs of
their local communities;</text>
</paragraph><paragraph id="H4AD7459A04BD4F978336F515EFF2DD68"><enum>(4)</enum><text>to solve urban
problems through research, outreach, and exchange of information; and</text>
</paragraph><paragraph commented="no" id="H26DEB20FDA3A400B9E7FB2C1378FC9BD"><enum>(5)</enum><text>to improve the
quality of life and economic opportunity in urban areas.</text>
</paragraph></subsection><subsection id="H2DAA5964E34C412C9B451553DC80F5D3"><enum>(b)</enum><header>Activities</header><text display-inline="yes-display-inline">Each institution of higher education or
consortium of institutions of higher education that receives a grant shall use
such amounts—</text>
<paragraph id="H2742F6C748454F6EBD7D9961CD06EBF3"><enum>(1)</enum><text>to establish and
maintain community outreach partnership centers (in this section referred to as
<quote>Centers</quote>) that address the problems of urban areas
through—</text>
<subparagraph id="H1F486BFF683F4487997021EF7CBD1261"><enum>(A)</enum><text>conducting
research about theoretical or practical problems in large and small cities;
and</text>
</subparagraph><subparagraph id="H7ECD97AB82DD4CE385C6A63F9205AC20"><enum>(B)</enum><text>facilitating
partnerships and encouraging outreach activities between institutions of higher
education, local communities, and local governments; and</text>
</subparagraph></paragraph><paragraph id="H25B8949EF6824C8DA4D8E3FF4CE24550"><enum>(2)</enum><text>to expand existing
activities in community engagement that address the problems of urban
areas.</text>
</paragraph></subsection><subsection id="H7D6B184AEFA24627853A93BAD9056577"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
this section, an institution of higher education or a consortia of institutions
of higher education shall prepare and submit an application to the Secretary at
such time, in such form, and containing such information and assurances as the
Secretary may require.</text>
</subsection><subsection id="H559578D7EB524E7CB06312B41F2CBA7D"><enum>(d)</enum><header>Selection
criteria</header>
<paragraph id="HBAD7DDBA47D54E498EE2954FA0B793E5"><enum>(1)</enum><header>In
general</header><text>The Secretary shall select recipients of grants under
this section on the basis of the following criteria:</text>
<subparagraph id="HDF25E81B9F4B4E2AA34721B1B3CB6BCD"><enum>(A)</enum><text display-inline="yes-display-inline">The extent of research and outreach
resources that the applicant demonstrates are available for carrying out the
project and activities the applicant proposes to carry out under the
grant.</text>
</subparagraph><subparagraph id="HCAC39D40C3C041FDBF14AA884D9C5495"><enum>(B)</enum><text>The capability of
the applicant to provide leadership in solving community problems and in making
national contributions to solving long-term and immediate problems of urban
areas.</text>
</subparagraph><subparagraph id="HAD68B57006A14464AC9B05D6D5D80457"><enum>(C)</enum><text>The extent of the
commitment that the applicant demonstrates is available for supporting urban
research and outreach programs by providing matching contributions for any
Federal assistance received.</text>
</subparagraph><subparagraph id="H8B0D6F4D281147F5B09BB5E8A75153C8"><enum>(D)</enum><text>The extent of the
ability of the applicant to disseminate results of research and successful
strategies developed through outreach activities to other Centers and
communities served by grants provided under this section.</text>
</subparagraph><subparagraph id="H4C85B22D01E1439CA4F8EF35425F6950"><enum>(E)</enum><text>The need for the
projects and activities that the applicant proposes to carry out under the
grant.</text>
</subparagraph><subparagraph id="HB6238AF808A74D47A16226C7628917E2"><enum>(F)</enum><text>The extent to
which the projects and activities of the applicant will contribute to the goals
of the community partners of the applicant in the urban area of the
applicant.</text>
</subparagraph><subparagraph id="HFAABB12F6459450A9B6D9CBBDD7A8CBD"><enum>(G)</enum><text display-inline="yes-display-inline">The extent to which the community partners
of the applicant will contribute to the educational and research goals of the
applicant.</text>
</subparagraph><subparagraph id="HC4CE53F320AC4FCE956C501BA32980B1"><enum>(H)</enum><text>The effectiveness
of the strategy of the applicant to provide outreach activities to
communities.</text>
</subparagraph><subparagraph id="H887296A2120C4B0C95D47F6A717D7C21"><enum>(I)</enum><text>The value to the
community of the project and activities the applicant proposes to carry out
under the grant.</text>
</subparagraph><subparagraph id="HD7A3C01054F6434BB00A1ACE5D5B8AE1"><enum>(J)</enum><text display-inline="yes-display-inline">The demonstrated ability of the applicant
to communicate, coordinate, and involve community partners throughout the
decision making process of planning and implementing projects and activities
the applicant proposes to carry out under the grant.</text>
</subparagraph><subparagraph id="H22D908B4361D4D1FAD31EC663B9BB05F"><enum>(K)</enum><text>The proposed
schedule for the projects and activities of the applicant.</text>
</subparagraph><subparagraph id="H1C192D2B773F478A9B21FF59025AFA8A"><enum>(L)</enum><text display-inline="yes-display-inline">The extent of the capability of the
applicant to evaluate the projects and activities the applicant proposes to
carry out under the grant.</text>
</subparagraph><subparagraph id="H5EE40DA077164821A68D97BDA1B881C7"><enum>(M)</enum><text>The extent of the
ability of the applicant to continue funding the projects and activities after
the expiration of a grant received under this section.</text>
</subparagraph><subparagraph id="H4C7BC4AB72974C81B83C1BF11C398F8C"><enum>(N)</enum><text>Other criteria the
Secretary determines are appropriate.</text>
</subparagraph></paragraph><paragraph id="H15B25EA57C3244AFAE01195DD6AD387F"><enum>(2)</enum><header>
Priority</header><text display-inline="yes-display-inline">In making grants
under this section, the Secretary shall give priority to any applicant
that—</text>
<subparagraph id="HB0D7D30104764880B871C2286164CF69"><enum>(A)</enum><text>will undertake
research and outreach activities by bringing together knowledge and expertise
in various social science and technical disciplines that relate to urban
problems;</text>
</subparagraph><subparagraph id="H6AB41965744845E2B5F008A56EDBBC20"><enum>(B)</enum><text>demonstrates a
record of engagement with communities located in the urban area in which the
applicant is located;</text>
</subparagraph><subparagraph id="H80CC91F344DD46588863CAA84600DCF8"><enum>(C)</enum><text>demonstrates a
record of supporting the economic development of the local community of the
applicant through their human resource, purchasing, and investment policies;
and</text>
</subparagraph><subparagraph id="H30F119770E1C4C0890F46CB0B80213D5"><enum>(D)</enum><text>demonstrates a
record of cooperating and coordinating efforts with community partners and
other institutions of higher education.</text>
</subparagraph></paragraph></subsection><subsection id="H9BB3782297B348ACB5D9154A43F6D92C"><enum>(e)</enum><header>Federal
share</header><text display-inline="yes-display-inline">The amount of a grant
under this section may not exceed, for the duration of the grant—</text>
<paragraph id="H88B12A9C640D4684974B5274EA390146"><enum>(1)</enum><text>50 percent of the
cost of establishing and operating the research activities of a Center;
and</text>
</paragraph><paragraph id="HEB6D86D2961A4717A56202854BD4BC8C"><enum>(2)</enum><text display-inline="yes-display-inline">75 percent of the cost of establishing and
operating the outreach activities of a Center.</text>
</paragraph></subsection><subsection id="HA992235AB16149F1AC14DFF579C55E89"><enum>(f)</enum><header>Non-Federal
share</header><text>The non-Federal share of the cost of projects and
activities funded under this section may include cash, or the value of noncash
contributions, equipment, or other in-kind contributions the Secretary
determines are appropriate.</text>
</subsection><subsection commented="no" id="H2D70CB1C332E4D3DB45B258CB5FFE505"><enum>(g)</enum><header>Duration</header><text>Each
grant shall provide funds for each year of a 5-year period.</text>
</subsection><subsection id="H7C8CB71639FB4152A52D7ED073EE529F"><enum>(h)</enum><header>Center
requirements</header><text>A Center established with amounts from a grant under
this section shall—</text>
<paragraph id="HD1A519A8E2DE478F8C775086E9EFD9D3"><enum>(1)</enum><text>employ the
research and outreach resources of the institution of higher education that
sponsors the Center to solve specific urban problems identified by the
communities to be served by the Center;</text>
</paragraph><paragraph id="H91BB0E0B026246E79665835423903FB4"><enum>(2)</enum><text>establish outreach
activities in areas identified in the grant application as the communities to
be served;</text>
</paragraph><paragraph id="HE7E7323D60DE4A588FF4B9132CF87609"><enum>(3)</enum><text>establish a
community advisory committee comprised of representatives of local institutions
and residents of the communities to be served to assist in identifying needs of
the local community and advise on the development and implementation of
strategies to address those needs;</text>
</paragraph><paragraph id="H6E56DB09C2B144AC8FE70600E7817C71"><enum>(4)</enum><text>coordinate
outreach activities in communities to be served by the Center;</text>
</paragraph><paragraph id="H7B6CAD1406324AA491D6D78CEE5497DF"><enum>(5)</enum><text>facilitate public
service projects in the communities to be served by the Center;</text>
</paragraph><paragraph id="H361BD83094054BEFB6840838FC1AF0D2"><enum>(6)</enum><text>develop
instructional programs, convene conferences, and provide training for local
community leaders, where appropriate; and</text>
</paragraph><paragraph id="HCDB7CC689D4A4304B398F945F587B65B"><enum>(7)</enum><text>exchange
information with other Centers.</text>
</paragraph></subsection><subsection commented="no" id="H6CD8C108755B43DCA013AA90F42A8E01"><enum>(i)</enum><header>Reports</header>
<paragraph commented="no" id="H07E3EF4BFCE84834A8722835BA9E5F45"><enum>(1)</enum><header>Periodic
reports</header><text>Grant recipients shall submit progress reports annually
during the 5-year grant term to the Secretary on the progress of activities and
projects funded under this section.</text>
</paragraph><paragraph commented="no" id="H4E323D61DF2545B984D44246E88ACEF6"><enum>(2)</enum><header>Final
report</header><text display-inline="yes-display-inline">Not later than 6
months after the end of the 5-year grant period, each grant recipient under
this section shall submit a final report to the Secretary that
describes—</text>
<subparagraph commented="no" id="H054E2A48620D48EEA6FD404D6FFDC74B"><enum>(A)</enum><text>what the grant
funds were used for;</text>
</subparagraph><subparagraph commented="no" id="H123B4657C7824C01A2DD5CE19418CC43"><enum>(B)</enum><text>the relationship
between the institution of higher education or consortium and the community
partner upon the expiration of a grant under this section;</text>
</subparagraph><subparagraph commented="no" id="H625CEC71F4464D638F952419817CACBC"><enum>(C)</enum><text>the overall impact
of the grant on the local community;</text>
</subparagraph><subparagraph commented="no" id="H8A13A5AC88FF4F648077743A9F31AB61"><enum>(D)</enum><text>the overall impact
of the grant on the institution of higher education;</text>
</subparagraph><subparagraph commented="no" id="H43177588A27C41F5BBD4B3FDB99DC0AE"><enum>(E)</enum><text>the overall impact
of the grant on the urban area served by the center established with grant
funds;</text>
</subparagraph><subparagraph commented="no" id="H64300FA963194AC0907463B8DC7112B6"><enum>(F)</enum><text>the extent to
which the impact of the grant meets the purposes for which the grant funds were
provided, including—</text>
<clause commented="no" id="H1B009EE2FDB74945BE92FB39A5FF2FB1"><enum>(i)</enum><text>how the
institution of higher education contributed to the goals of its community
partners; and</text>
</clause><clause commented="no" id="H8C3D1B2961C944468C65370E5385E7F7"><enum>(ii)</enum><text>how the community
partners contributed to the educational and research goals of the institution
of higher education; and</text>
</clause></subparagraph><subparagraph commented="no" id="HBCD6ECB832FF47BF996DADB6DB515AC4"><enum>(G)</enum><text>how and to what
extent the institution of higher education institutionalized the community
engagement activities as a result of the grant.</text>
</subparagraph></paragraph></subsection></section><section id="H796E443E51E042A4B232BD8A5A4F9B08"><enum>102.</enum><header>Urban capacity
building community engagement grants</header>
<subsection id="H474B33DBBC894EA3982B4510366E2534"><enum>(a)</enum><header>Grant
program</header><text>The Secretary may make grants under this section in
accordance with
<internal-xref idref="H5083030B3F15443D805FFCD13F9520FE" legis-path="102.(b)">subsection (b)</internal-xref> to institutions of higher
education—</text>
<paragraph display-inline="no-display-inline" id="H0CD867656DDF407297E491F02A101513"><enum>(1)</enum><text display-inline="yes-display-inline">to expand community engagement in academic
and administrative practices and policies of such institutions;</text>
</paragraph><paragraph id="HD67D3C31A82C4855942B6ABFF03196E7"><enum>(2)</enum><text display-inline="yes-display-inline">to establish faculty and administrator
support throughout such institutions for community outreach; or</text>
</paragraph><paragraph id="H7FE0C24CA15C4F20B1C69D4001F37E31"><enum>(3)</enum><text>to create and
sustain a campus-wide culture for community engagement.</text>
</paragraph></subsection><subsection id="H5083030B3F15443D805FFCD13F9520FE"><enum>(b)</enum><header>Required
activities</header><text>Each institution of higher education that receives a
grant under this section shall use such amounts—</text>
<paragraph id="H654826EC7F474F8FB0E9CEB4D0BB4218"><enum>(1)</enum><text>to establish a
task force—</text>
<subparagraph id="H9DFE70F1836446EC93F813B8C9D7B1B9"><enum>(A)</enum><text>to assess the
existing capacity and resources of such institution to create and sustain
community engagement and outreach efforts with the local communities of such
institution; and</text>
</subparagraph><subparagraph id="H0C0D14D8ABE34BD8B663A1D1D50FB672"><enum>(B)</enum><text display-inline="yes-display-inline">to develop a strategic plan to expand the
capacity and resources of such institution to create and sustain community
engagement and outreach efforts with the local communities of such
institution.</text>
</subparagraph></paragraph><paragraph id="HAEAA3344F59742E4AE04A7DC64F78D84"><enum>(2)</enum><text>to establish or
expand an administrative unit, center, institute, or other entity of such
institution to centralize, align, coordinate, and monitor outreach and
community engagement on behalf of such institution; and</text>
</paragraph><paragraph id="H397159B7BE1E4556B2FEBA472DF6EE4C"><enum>(3)</enum><text>to develop funding
mechanisms to generate and sustain internal and external financial support and
resources throughout the institution for various community partnership
initiatives and activities.</text>
</paragraph></subsection><subsection id="HBCF8A74225F04527B725B68937A4C190"><enum>(c)</enum><header>Allowable
activities</header><text>In addition to the mandatory uses of grant funds under
<internal-xref idref="H5083030B3F15443D805FFCD13F9520FE" legis-path="102.(b)">subsection (b)</internal-xref>, an institution of higher
education may use grant funds under this section—</text>
<paragraph id="H971EBED9EE2C4878B05E6FF1D09D303D"><enum>(1)</enum><text>to establish an
interdisciplinary research center on community engagement;</text>
</paragraph><paragraph id="H36D97A2BFEA24D1DBDF91808DBBC70EA"><enum>(2)</enum><text>to create, with
other outside groups, a separate organization to plan, execute, and sustain
community engagement and outreach efforts with the local communities of such
institution;</text>
</paragraph><paragraph commented="no" id="H0F8CFB07EE134A708EA761C960595209"><enum>(3)</enum><text>to create
strategies and policies for such institution to collaborate with and involve
local communities in such institution;</text>
</paragraph><paragraph commented="no" id="H9866E4BA444D4B81861A481359B8738F"><enum>(4)</enum><text>to recruit faculty
and administration of such institution to support scholarship, technical
expertise, organization, and management of community engagement and outreach
efforts with the local communities of such institution;</text>
</paragraph><paragraph id="HB26DEF4CE3C645AC9F803C2C6E42058F"><enum>(5)</enum><text>to develop
academic programs, courses, curriculum, service learning, internships, clinical
experiences, and pre-professional workshops for both undergraduate and graduate
students on community engagement;</text>
</paragraph><paragraph id="H9C4CAD0544FE4837A33C8EB7F132B794"><enum>(6)</enum><text>to establish a
technical assistance program, resource center, or community facility dedicated
to delivering services to the local community;</text>
</paragraph><paragraph id="H5CABE8A6534C48FEB77A6BE3E51470C1"><enum>(7)</enum><text>to provide
incentives and assistance to faculty to pursue research that seeks to address
problems of the local communities of such institution;</text>
</paragraph><paragraph id="H7CC9EC99F02B479D8FD8469CC09A9F5B"><enum>(8)</enum><text display-inline="yes-display-inline">to augment or revise the promotion and
tenure system of such institution to reflect a commitment to pursue research
that seeks to address problems of the local communities of such
institution;</text>
</paragraph><paragraph id="H8D6262FCB2114B38A1D2071BC64F4B63"><enum>(9)</enum><text>to provide faculty
and student training and mentoring programs in community engagement; and</text>
</paragraph><paragraph id="H737F0EE4271E4C43892D491E345655D9"><enum>(10)</enum><text>to establish
scholarships and grants for student service and internships.</text>
</paragraph></subsection><subsection id="HCADDA2C8CF0945DF829E8F0E484B95A4"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
this section, an institution of higher education shall prepare and submit an
application to the Secretary at such time, in such form, and containing such
information and assurances as the Secretary may require.</text>
</subsection><subsection id="HF43238DEB9FB4936B71C62847686A905"><enum>(e)</enum><header>Priority</header><text>The
Secretary shall give priority to any public institution of higher education
that—</text>
<paragraph id="H18B9A4A9537D4F65B7F22D638345FF28"><enum>(1)</enum><text>is located in an
urban area;</text>
</paragraph><paragraph id="HFD9CDFABD3D04B82BE16C0DB2A732DCB"><enum>(2)</enum><text>has the capacity
to conduct applicable research, as demonstrated by enrolling, either
individually or jointly with another institution of higher education, at least
10 doctoral students per academic year;</text>
</paragraph><paragraph id="H65FAD39812624441947D722EFC7ED369"><enum>(3)</enum><text>demonstrates a
record of effective engagement with the communities in the urban areas of such
institutions that build knowledge, teach students, and generate programs that
will positively advance and address the conditions of urban change;</text>
</paragraph><paragraph id="H81BAE06A3F99405699FB1E1D7CFBFD24"><enum>(4)</enum><text>demonstrates a
record of supporting the economic development of the local community of such
institutions through human resource, purchasing, and investment policies of
such institutions; and</text>
</paragraph><paragraph id="H7F425131F59B4345A9CC95DDCCFA0E7E"><enum>(5)</enum><text>demonstrates a
record of cooperating and coordinating efforts with community partners and
other institutions of higher education.</text>
</paragraph></subsection><subsection id="H57F7553915EF4FE098D1BF4643A4ADA6"><enum>(f)</enum><header>Federal
share</header><text display-inline="yes-display-inline">The amount of a grant
under this section may not exceed the non-Federal share provided by the
institution of higher education for the program or activity.</text>
</subsection><subsection id="H9AC2AA87B65146F6A9D60841A0CC5AC6"><enum>(g)</enum><header>Non-Federal
shares</header><text display-inline="yes-display-inline">The non-Federal share
of the cost of projects and activities under this section may include cash, or
the value of noncash contributions, equipment, or other in-kind contributions
the Secretary determines are appropriate.</text>
</subsection><subsection id="HF6F1DB863C4C458F8779CB710761BD98"><enum>(h)</enum><header>Duration</header><text display-inline="yes-display-inline">Each grant shall provide funds for each
year of a 5-year period.</text>
</subsection><subsection id="HF59954E60E50465CAEA8D1D98AAAE511"><enum>(i)</enum><header>Reports</header>
<paragraph id="H2CE36291DAC64029B7E7F09067B940EA"><enum>(1)</enum><header>Periodic
reports</header><text display-inline="yes-display-inline">Grant recipients
shall submit progress reports annually during the 5-year grant term to the
Secretary on the progress of activities and projects funded under this
section.</text>
</paragraph><paragraph id="H7052C91339DA4BB1BACABC437C66E3AC"><enum>(2)</enum><header>Final
report</header><text display-inline="yes-display-inline">Not later than 6
months after the grant expires a grant recipient shall submit to the Secretary
a final report on activities and projects funded under this section as
determined by the Secretary.</text>
</paragraph></subsection></section><section id="HAB3282C9B8CA4883B989E8EFBCC2680B"><enum>103.</enum><header>Early career
grants for researchers</header>
<subsection id="H32F15286624E49B9847F7AA208BFCBE3"><enum>(a)</enum><header>Grant
program</header><text>The Secretary may make grants to eligible researchers to
conduct research in fields that focus on problems of urban areas.</text>
</subsection><subsection id="HA058C3A0C3324A1B8B19154E3EF8911C"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
this section, an eligible researcher shall prepare and submit an application to
the Secretary at such time, in such form, and containing such information and
assurances as the Secretary may require.</text>
</subsection><subsection id="H4873EA666F6940B99496786CE4E4B664"><enum>(c)</enum><header>Selection
criteria</header>
<paragraph id="HC0BB525D51274AE39FD4D6536AE654E8"><enum>(1)</enum><header>In
general</header><text>The Secretary shall select recipients of grants under
this section through a competition based on the following criteria:</text>
<subparagraph display-inline="no-display-inline" id="HA097766655B44516B22427558E289280"><enum>(A)</enum><text display-inline="yes-display-inline">The extent of the intellectual merit of the
research proposed to be conducted with grant amounts.</text>
</subparagraph><subparagraph id="H05B8379B4E004C458DAE63E5EABA94B0"><enum>(B)</enum><text display-inline="yes-display-inline">The extent of the innovative nature of the
proposed research.</text>
</subparagraph><subparagraph id="H18E06F02168545AD8161B93615FDDD23"><enum>(C)</enum><text display-inline="yes-display-inline">The extent of the relevancy of the proposed
research to issues impacting the local community of the institution of higher
education of the researcher.</text>
</subparagraph><subparagraph id="H1A015FABB7A94056997D41908FB20EBC"><enum>(D)</enum><text display-inline="yes-display-inline">The extent of the relevancy of the proposed
research to nationwide problems identified by the Secretary.</text>
</subparagraph><subparagraph id="HDE1836F5CB4D47FE994DD787690997D9"><enum>(E)</enum><text>The extent to
which the application integrates research, teaching, and service, including
undergraduate education.</text>
</subparagraph></paragraph><paragraph id="HA142BBF990004BE394034EE5C98CE311"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under this section, the
Secretary shall give priority to eligible researchers that address regional
economic development issues.</text>
</paragraph></subsection><subsection id="H233C62C09E674884AFC6AE0AC3346577"><enum>(d)</enum><header>Eligible
researcher defined</header><text display-inline="yes-display-inline">For
purposes of this section, the term <quote>eligible researcher</quote> means an
individual that—</text>
<paragraph id="H2E015C64471A49ABA555A3F1EAF5767C"><enum>(1)</enum><text>has completed a
doctorate or other terminal degree not more than 10 years before the date on
which the application for a grant is submitted pursuant to subsection
(b);</text>
</paragraph><paragraph id="HC7284955069740E0B623BF5382CDB773"><enum>(2)</enum><text>has demonstrated
expertise in a field relevant to the problems of urban areas; and</text>
</paragraph><paragraph id="H955DF45F636E4A2AA0E825A5091D293C"><enum>(3)</enum><text>is employed in a
tenure-track position as an assistant professor or equivalent position at an
institution of higher education in the United States.</text>
</paragraph></subsection><subsection id="HA34C723B7B8C4471A8A75305A627F92C"><enum>(e)</enum><header>Amount and
duration</header>
<paragraph id="HB3312E8CD2DC4729819FE6D445469767"><enum>(1)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of a grant under this section
shall be not less than $50,000 and not more than $100,000 each year.</text>
</paragraph><paragraph id="H5607E2325A22465D97D4830091C0C49D"><enum>(2)</enum><header>Duration</header><text>The
term of a grant under this section shall be for a period of not more than 5
years.</text>
</paragraph></subsection></section><section id="H04A6FD7318914270B94020EE56705F0E"><enum>104.</enum><header>National urban
grant university program</header>
<subsection commented="no" id="H3681EC59E8994961A5794969313FCC1D"><enum>(a)</enum><header>Purpose</header><text>The
purposes of this section are—</text>
<paragraph commented="no" id="H590C7DA7A96347B396D3A320560B2EBD"><enum>(1)</enum><text>to identify
institutional leaders in community engagement;</text>
</paragraph><paragraph commented="no" id="H52B7F37690534BC5902EEF42CF2E3742"><enum>(2)</enum><text>to designate
institutions of higher education as urban grant universities; and</text>
</paragraph><paragraph commented="no" id="H4EA5DF248A614752BBC6B90FE1603A68"><enum>(3)</enum><text>to promote
innovative research, education, training, and service activities in fields
related to the problems of urban areas.</text>
</paragraph></subsection><subsection id="H3350910A80624D08A73CDC59B07BB4DE"><enum>(b)</enum><header>Urban grant
university</header>
<paragraph id="H90A335930A77488F8B3972168D0FF968"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The Secretary shall designate public
institutions of higher education that meet the requirements of paragraph (2) as
urban grant universities in a manner and number determined by the
Secretary.</text>
</paragraph><paragraph id="H1ACC111899244298A580DBC0FFEEAF18"><enum>(2)</enum><header>Criteria</header><text>A
public institution of higher education meets the requirements of this
subsection only if the institution—</text>
<subparagraph id="H82A16FDA07A940F3ADCA1CFB85159FF2"><enum>(A)</enum><text>is located in an
urban area;</text>
</subparagraph><subparagraph id="HF590068EEA0342548C28860AD8099D0D"><enum>(B)</enum><text>has the capacity
to conduct applicable, engaged research, as demonstrated by enrolling, either
individually or jointly with another institution of higher education, at least
10 doctoral students per academic year;</text>
</subparagraph><subparagraph id="H9472F07F697546B385C6DD7C6469A700"><enum>(C)</enum><text>has an existing
broad base of competence in fields related to the problems of urban
areas;</text>
</subparagraph><subparagraph id="H3B2B511C804246E896750F80F58261EA"><enum>(D)</enum><text display-inline="yes-display-inline">is recognized for excellence in fields
related to the problems of urban areas, as determined by the Secretary;</text>
</subparagraph><subparagraph commented="no" id="HA9C862EEC1EF4F1582810D4D5615D706"><enum>(E)</enum><text>demonstrates a
record of effective engagement with the communities in the urban areas of such
institution that builds knowledge, teaches students, and generates programs
that will positively advance and address the conditions of urban change;</text>
</subparagraph><subparagraph id="H19A19D917E43413598735F08CB487525"><enum>(F)</enum><text>demonstrates an
institution-wide commitment to community engagement;</text>
</subparagraph><subparagraph id="H06D32A87E3E247B2AE9DBDB8CA106B7C"><enum>(G)</enum><text>demonstrates a
record of supporting the economic development of the local community through
the human resource, purchasing, and investment policies of such
institution;</text>
</subparagraph><subparagraph id="H1D1470F11B684074BFCE9175A2D8A121"><enum>(H)</enum><text>cooperates and
coordinates efforts with community partners, other urban grant universities,
and other institutions of higher education to solve the problems of urban
areas;</text>
</subparagraph><subparagraph id="HFC846E94788A497685448BFC58D310F5"><enum>(I)</enum><text display-inline="yes-display-inline">makes a long-term commitment to promote
innovative research, education, training, and service activities in fields
related to problems of urban areas; and</text>
</subparagraph><subparagraph id="H9116DA11BDB64178ABC2A91677DDCA3C"><enum>(J)</enum><text>meets other such
qualifications as the Secretary, in consultation with the University
Partnerships Advisory Council established under
<internal-xref idref="H271B3F282F624049BA4C29F3184CDBC0" legis-path="105.">section 105</internal-xref>, determines is
appropriate.</text>
</subparagraph></paragraph><paragraph id="H318B1C3220C648C2831068F515AEAD52"><enum>(3)</enum><header>Suspension or
termination of designation</header><text>The Secretary may determine on the
record after opportunity for a hearing that a designation made under paragraph
(1) is suspended or terminated.</text>
</paragraph><paragraph commented="no" id="H60D1314A9E4B42C99939570094049B1C"><enum>(4)</enum><header>Duties</header><text>Subject
to any regulations prescribed or guidelines established by the Secretary, each
urban grant university shall develop and implement, in consultation with the
Secretary and the University Partnerships Advisory Council, a program that is
consistent with the guidelines and priorities established under
<internal-xref idref="H3308CFE7D95C45BEA5A51F53D0965C08" legis-path="105.(b)(3)">section 105(b)(3)</internal-xref>.</text>
</paragraph></subsection><subsection commented="no" id="H36BF028E8E2A4807A1E1E53D7CA352BE"><enum>(c)</enum><header>Grants</header>
<paragraph id="HF05CD72711404DBDBFBBF85958783886"><enum>(1)</enum><header>Authority</header><text>The
Secretary may make grants and enter into contracts with urban grant
universities designated under this section, to assist such universities in
implementing programs or projects that promote innovative research, education,
training, and service activities in fields related to the problems of urban
areas.</text>
</paragraph><paragraph commented="no" id="H4DC24D53A18F462F8F129D39D3144164"><enum>(2)</enum><header>Amount</header><text>Except
as provided under
<internal-xref idref="HB22FDECF9AE940AA86EFB9C0E4462DE2" legis-path="104.(c)(3)">paragraph (3)</internal-xref>, the total amount paid
under any grant or contract under this section may not be more than 66 percent
of the total cost of the program or project involved.</text>
</paragraph><paragraph commented="no" id="HB22FDECF9AE940AA86EFB9C0E4462DE2"><enum>(3)</enum><header>Special
grants</header>
<subparagraph id="H0F7B083DE3CC4FD0BCEC362C68A9DA7B"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary may
make special grants under this section to urban grant universities designated
under this section to promote innovative research, education, training, and
service activities in fields related to the problems of urban areas.</text>
</subparagraph><subparagraph id="HFC75C42EF5944B378C929FC18CD44918"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">A special grant made under this paragraph
may be 100 percent, or any lesser percent, of the total cost of the program or
project if the Secretary finds that—</text>
<clause commented="no" id="HA606F73D0C49460C88A5B7C84CA31C23"><enum>(i)</enum><text>no reasonable
means is available through which the applicant can meet the matching
requirement for a grant under
<internal-xref idref="H4DC24D53A18F462F8F129D39D3144164" legis-path="104.(c)(2)">paragraph (2)</internal-xref>;</text>
</clause><clause commented="no" id="H0DDC2893961C4A78957EC13D3158E70F"><enum>(ii)</enum><text>the probable
benefit of such project outweighs the public interest in such matching
requirement; and</text>
</clause><clause commented="no" id="HD57DBDB935E445759D58B81550A9A957"><enum>(iii)</enum><text>the same or
equivalent benefit cannot be obtained through a contract or grant under
paragraph (1).</text>
</clause></subparagraph><subparagraph id="HF88C0D425D06422F86AEB0228757288D"><enum>(C)</enum><header>Total
amount</header><text>The total amount that may be provided for grants under
this paragraph during any fiscal year shall not exceed an amount equal to 1
percent of the total funds appropriated for such fiscal year under this
section.</text>
</subparagraph></paragraph><paragraph commented="no" id="H23FFB5F561BA494F9BFD22569DF551B8"><enum>(4)</enum><header>Terms and
conditions</header>
<subparagraph id="H95962869AD0842B8A46212EDA0B35FD0"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">Except as provided in
subparagraph (B), a grant made under this section may not be used for—</text>
<clause commented="no" id="H630B2885E9B84B28970F27B4FB5AA2CE"><enum>(i)</enum><text>the purchase or
rental of land; or</text>
</clause><clause commented="no" id="H9D3FB6341B4A405DA6C7AFCDF4CA6C43"><enum>(ii)</enum><text>the purchase,
rental, construction, preservation, or repair of a building.</text>
</clause></subparagraph><subparagraph id="HAF61F9DD1A8D44BEBD2773FD8E0610C1"><enum>(B)</enum><header>Exception</header><text>A
grant may be used for the short-term rental of buildings or facilities for
meetings that support a program or project funded with amounts from a grant
under this section.</text>
</subparagraph></paragraph></subsection><subsection id="H4E7AB878A86C4BCD907FCCBCBE61050A"><enum>(d)</enum><header>Fellowships</header>
<paragraph id="HB083957EE8694431B017C691201F077A"><enum>(1)</enum><header>In
general</header><text>To carry out the educational and training component
objectives of this section, the Secretary may award fellowships to individuals
at urban grant universities designated under this section who are pursuing a
course of study at the graduate level in fields that focus on the problems of
urban areas.</text>
</paragraph><paragraph id="H430D4D928773480DBDFAF0031A0CB5AB"><enum>(2)</enum><header>Amount</header><text>The
total amount that may be provided for grants under this subsection during any
fiscal year shall not exceed an amount equal to 25 percent of the total funds
appropriated for such fiscal year under this section.</text>
</paragraph></subsection></section><section id="H271B3F282F624049BA4C29F3184CDBC0"><enum>105.</enum><header>University
partnerships advisory council</header>
<subsection id="HE70B852EDDF34C729ED978E5693702DE"><enum>(a)</enum><header>Establishment</header><text>There
is established an independent council to be known as the University
Partnerships Advisory Council (in this section referred to as the
<quote>Council</quote>).</text>
</subsection><subsection id="H268A5E27910A4767985D25B3F3F7F923"><enum>(b)</enum><header>Duties of the
Council</header><text>The Council shall advise the Secretary and the Deputy
Assistant Secretary for University Partnerships of the Office of University
Partnerships of the Department of Housing and Urban Development
concerning—</text>
<paragraph id="H05176A53B7BB41E2AE2019A75323095E"><enum>(1)</enum><text>the designation
and operation of urban grant universities under
<internal-xref idref="H04A6FD7318914270B94020EE56705F0E" legis-path="104.">section 104</internal-xref>;</text>
</paragraph><paragraph id="HFC13C0AF60EB4F4A8528102A5308E013"><enum>(2)</enum><text>long-term
strategic priorities for the urban grant university program;</text>
</paragraph><paragraph id="H3308CFE7D95C45BEA5A51F53D0965C08"><enum>(3)</enum><text>the formulation
and application of guidelines related to activities and responsibilities of
urban grant universities;</text>
</paragraph><paragraph id="H9B7160E885B041EBA06EC0D2BDD028F7"><enum>(4)</enum><text>applications or
proposals for grants and contracts under this part;</text>
</paragraph><paragraph id="HD23D64B72C774BC7B3B1DADDBF9A628A"><enum>(5)</enum><text>evaluation and
performance of grants under this part;</text>
</paragraph><paragraph id="HEDB326F3E1EA4181B63485D5B2968E4C"><enum>(6)</enum><text>dissemination of
the results of research and activities carried out under this part; and</text>
</paragraph><paragraph id="H9C68765DC7274E7D9FEBB9F2A4BB244D"><enum>(7)</enum><text display-inline="yes-display-inline">such other matters as the Secretary and the
Deputy Assistant Secretary refers to the Council for review and advice.</text>
</paragraph></subsection><subsection id="HE0730D3977AA4D95ACF5C6B9F5F7CB07"><enum>(c)</enum><header>Membership</header>
<paragraph id="H088BC52B4FD640CBBB51DA212E3D0A0D"><enum>(1)</enum><header>Number and
appointment</header><text display-inline="yes-display-inline">The Council shall
be composed of 19 members appointed by the Secretary as follows:</text>
<subparagraph id="H29EA650962CE4BB391DED74DA6FF8CD7"><enum>(A)</enum><text>5 representatives
from institutions of higher education, 2 of whom are from urban grant
universities designated under
<internal-xref idref="H04A6FD7318914270B94020EE56705F0E" legis-path="104.">section 104</internal-xref>.</text>
</subparagraph><subparagraph id="H76733357E0A346C4B773DEF4F1015F27"><enum>(B)</enum><text>5 representatives
from community or nonprofit organizations.</text>
</subparagraph><subparagraph id="H1576CC5586664E39AEBE618AD7F2F84F"><enum>(C)</enum><text>3 representatives
from State or local governments.</text>
</subparagraph><subparagraph id="H882B31A18D30433290FAEB6AAC9ADBF7"><enum>(D)</enum><text>3 representatives
from the business community.</text>
</subparagraph><subparagraph id="H74562FFCBB70405EBACA10E24C5BDBCF"><enum>(E)</enum><text>3 representatives
from organizations that possess significant expertise in urban issues.</text>
</subparagraph></paragraph><paragraph id="H3460C324FE4F430582950A4BBABCE203"><enum>(2)</enum><header>Terms</header>
<subparagraph id="HBB74EB369E9B456DB631B74D30075E16"><enum>(A)</enum><header>In
general</header><text>Each member shall be appointed for a term of 3 years,
except as provided in subparagraphs (B) and (C).</text>
</subparagraph><subparagraph id="HCF589DB2B85C423DB71771B589B554DE"><enum>(B)</enum><header>Terms of initial
appointees</header><text>As designated by the Secretary at the time of
appointment, of the members first appointed—</text>
<clause id="HBDEBDBC325D64D14837F36856DBEDC55"><enum>(i)</enum><text>7
shall be appointed for a term of 1 year;</text>
</clause><clause id="H632F7A1378DD458CA00C22A78DF7BC86"><enum>(ii)</enum><text>6
shall be appointed for a term of 2 years; and</text>
</clause><clause id="H2FFA8E3785524647B416C98DACB05FDD"><enum>(iii)</enum><text>6
shall be appointed for a term of 3 years.</text>
</clause></subparagraph><subparagraph id="HF180C7C99CC0481A909F336A04E32315"><enum>(C)</enum><header>Multiple
terms</header><text>A member may not be appointed for more than 3 terms.</text>
</subparagraph><subparagraph commented="no" id="HFA50C1B6C3EB4C608ABAFC8A4BEB563D"><enum>(D)</enum><header>Vacancies</header><text>Any
member appointed to fill a vacancy occurring before the expiration of the term
for which the member’s predecessor was appointed shall be appointed only for
the remainder of that term. A member may serve after the expiration of that
member’s term until a successor has taken office. A vacancy in the Council
shall be filled in the manner in which the original appointment was
made.</text>
</subparagraph></paragraph><paragraph id="H53F0393A6C7248D0AF360A85E116D394"><enum>(3)</enum><header>Chairperson;
vice chairperson</header>
<subparagraph id="HF98E56DCCC83415EAC5CD26B0E2EF78B"><enum>(A)</enum><header>In
general</header><text>The Council shall elect a Chairperson and a Vice
Chairperson.</text>
</subparagraph><subparagraph id="H4F50BA2F50354BC192FD8E7EE026CDD1"><enum>(B)</enum><header>Absence or
incapacity of Chairperson</header><text>The Vice Chairperson shall act as the
Chairperson in the absence or incapacity of the Chairperson.</text>
</subparagraph></paragraph><paragraph id="H6ECC9061C37E4FEB983A3AB2C1299031"><enum>(4)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Council shall meet on a semi-annual
basis and, at any other time, at the call of the Chairperson, the request of a
majority of the members, the Deputy Assistant Secretary, or the
Secretary.</text>
</paragraph><paragraph id="H934A883482D84784B22C88E78C3E79BB"><enum>(5)</enum><header>Powers of
Council</header><text>The Council may exercise such powers as are reasonably
necessary in order to carry out the duties under subsection (b).</text>
</paragraph></subsection><subsection id="HBEF17FECEF9844D29B45EEA5E8802826"><enum>(d)</enum><header>Information,
personnel, and administrative services and assistance</header><text>The
Secretary shall make available to the Council such information, personnel, and
administrative services and assistance as the Council may reasonably require to
carry out its duties.</text>
</subsection></section><section id="HE950B7A39FAA4784BC8161B122CF7931"><enum>106.</enum><header>Housing
assistance</header>
<subsection commented="no" id="HF5C99E6AA94E4475B6BFB45149EF0E64"><enum>(a)</enum><header>Purpose</header><text>The
purposes of this section are to—</text>
<paragraph commented="no" id="H09A353BB67C94DC18D4BE753A7056B72"><enum>(1)</enum><text>increase home
ownership and real estate values in local communities;</text>
</paragraph><paragraph commented="no" id="HF14FEFAF40734D7790D3CA30F1EA130D"><enum>(2)</enum><text>establish and
sustain local businesses;</text>
</paragraph><paragraph commented="no" id="H748A932943E34E0CA57303106BAFEA59"><enum>(3)</enum><text>provide training
and educational opportunities for local residents and development
organizations; and</text>
</paragraph><paragraph commented="no" id="H5B911ECF3F4443CE85892018031F513D"><enum>(4)</enum><text>increase student,
faculty, administration, and institutional involvement in the community.</text>
</paragraph></subsection><subsection id="H95FDAB790DAF4C12AACDE33CC4C736E8"><enum>(b)</enum><header>Grant
program</header>
<paragraph id="HFA46E898055D4C92B1BCC3C1DF2215A2"><enum>(1)</enum><header>In
general</header><text>The Secretary may make grants to provide technical and
financial assistance to local nonprofit organizations to undertake community
development and affordable housing projects serving persons of low and moderate
income to the following:</text>
<subparagraph id="HF13F2D8F51E34F3A8EB3FE95F30C73CB"><enum>(A)</enum><text display-inline="yes-display-inline">An institution of higher education.</text>
</subparagraph><subparagraph id="HAD4452FFDC08471BA2909D894629543B"><enum>(B)</enum><text>A partnership that
includes—</text>
<clause id="H2768FF193EB746DFAAB339F1837DF9F7"><enum>(i)</enum><text>one
institution of higher education; and</text>
</clause><clause id="H56D1E743746848969D9F50D92A48A094"><enum>(ii)</enum><text>one
of the following:</text>
<subclause id="HD10D8B2E093B4F47A44D5B64FD00F3C6"><enum>(I)</enum><text>A
local government.</text>
</subclause><subclause id="HB0533738D907455BBD685EF2A36DD86C"><enum>(II)</enum><text>A public housing
agency.</text>
</subclause><subclause id="HC9C6F0058F39462AA13599BFA8668937"><enum>(III)</enum><text>A community
development corporation.</text>
</subclause><subclause id="H4944CD47509A4A369209FF915D71334D"><enum>(IV)</enum><text>An assisted
housing owner.</text>
</subclause><subclause id="H2748286ABDB24828BE72F457750BECF0"><enum>(V)</enum><text>Other entities, as
determined by the Secretary.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="HC1A8999FD26A4E7E84BFBC3A2666FD74"><enum>(2)</enum><header>Use of
grants</header><text>Grants under this section shall be used—</text>
<subparagraph id="HE7B07F3D06984D329AE75EB3B1E37945"><enum>(A)</enum><text>to provide
technical and financial assistance for site acquisition and development,
construction financing, and short- and long-term financing for housing,
community facilities, and economic development primarily benefitting persons of
low and moderate income;</text>
</subparagraph><subparagraph id="HA5043739DDD740468C9A123F132DAB38"><enum>(B)</enum><text display-inline="yes-display-inline">to provide technical assistance, training,
support, and advice to develop the management, financial, and administrative
capabilities of housing development organizations serving primarily persons of
low and moderate income; and</text>
</subparagraph><subparagraph id="H9AAA4057050C425D89E5F40248005520"><enum>(C)</enum><text>to leverage
capital from private entities, including private financial institutions,
insurance companies, and private philanthropic organizations to provide
assistance under subparagraphs (A) and (B).</text>
</subparagraph></paragraph></subsection><subsection id="H8C02A0E7C2144BE399B65D1CDD8C6044"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
this section, an institution of higher education or a partnership described in
subsection (b)(1)(B) shall prepare and submit an application to the Secretary
at such time, in such form, and containing such information and assurances as
the Secretary may require.</text>
</subsection><subsection id="H0EFD29726391405BBE63BD04CB75C0AD"><enum>(d)</enum><header>Selection
criteria</header>
<paragraph id="HC3EAF59537DB46DAA549BD0C9097D1C7"><enum>(1)</enum><header>In
general</header><text>The Secretary shall select recipients of grants under
this section on the basis of the following criteria:</text>
<subparagraph id="HD3C1B6F4513D4E0E91025F366329CA7E"><enum>(A)</enum><text>The results of a
real estate market study of the area targeted for the proposed use of

the applicant to provide leadership in solving community problems and in making
national contributions to solving long-term and immediate problems or urban
areas.</text>
</subparagraph><subparagraph id="H4F83D4D6B0D840BCA2D30BCC33CE0B9D"><enum>(D)</enum><text>The demonstrated
commitment of the applicant to supporting development by providing matching
contributions for any Federal assistance received.</text>
</subparagraph><subparagraph id="H5DBD41F8DBEA455C9F57A8C844870CDA"><enum>(E)</enum><text>The ability of the
applicant to secure the best financial deal for the proposed use of
funds.</text>
</subparagraph><subparagraph id="HD3E333AEA211440C9E0E15634C869B64"><enum>(F)</enum><text>The extent to
which the proposed projects and activities will contribute to the goals of the
community partners.</text>
</subparagraph><subparagraph id="HBC9B2F2159074AFFB2924342D6F24C3A"><enum>(G)</enum><text>The extent to
which the community partners will contribute to the educational and research
goals of the university.</text>
</subparagraph><subparagraph id="HB0A7EE61C8834B058BC73D8B79034FF7"><enum>(H)</enum><text>The extent of need
in the communities to be served by the applicant.</text>
</subparagraph><subparagraph id="H45FB5F82C3D34EC4B115645C00BD463C"><enum>(I)</enum><text>The ability of the
applicant to communicate, coordinate, and involve community representatives in
the policy formulation and decision-making process.</text>
</subparagraph><subparagraph id="H12B1E5F7D5504FB9AA9A552DA5EFE9DC"><enum>(J)</enum><text>The reasonableness
of the timeline for the proposed activities and projects.</text>
</subparagraph><subparagraph id="HAB004BEAACAE4829B53635AE6D4E5D9D"><enum>(K)</enum><text>The demonstrated
capability of the applicant to evaluate the proposed projects and
activities.</text>
</subparagraph><subparagraph id="H61BF010CDAA54124B0A1FB9E58CAEC41"><enum>(L)</enum><text>The ability of the
applicant to sustain funding for projects and activities after the expiration
of a grant received under this section.</text>
</subparagraph><subparagraph id="H17A0D9EB2C4D41FBB869893D84BFBA41"><enum>(M)</enum><text>Other criteria the
Secretary determines is appropriate.</text>
</subparagraph></paragraph></subsection><subsection id="H7C36DC3F022D48E4AB50C4E92F92D7F0"><enum>(e)</enum><header>Priority</header><text>In
making grants under this section, the Secretary shall give priority to any
public institution of higher education that—</text>
<paragraph id="HF7656E77029E48BBA2996B0A4E88C8A0"><enum>(1)</enum><text>is located in an
urban area;</text>
</paragraph><paragraph id="HF194D9DF087941DFB639A0786D093B38"><enum>(2)</enum><text>has the capacity
to conduct applicable research, as demonstrated by enrolling, either
individually or jointly with another institution of higher education, at least
10 doctoral students per academic year;</text>
</paragraph><paragraph id="H1E787876BEF34120A5BB47AA34E186E2"><enum>(3)</enum><text>demonstrates a
record of effective engagement with the communities in the urban areas of such
institutions that build knowledge, teach students, and generate programs that
will positively advance and address the conditions of urban change;</text>
</paragraph><paragraph id="H03B3B9181AE34D73A20845E4C16D5428"><enum>(4)</enum><text>demonstrates a
record of supporting the economic development of the local community through
the human resource, purchasing, and investment policies of such institution;
and</text>
</paragraph><paragraph id="H382704DDDB834669B465C7CB54F30E70"><enum>(5)</enum><text>demonstrates a
record of cooperating and coordinating efforts with community partners and
other institutions of higher education.</text>
</paragraph></subsection><subsection id="HCC0A5B40A0914347BBFD742171324F53"><enum>(f)</enum><header>Federal
share</header><text display-inline="yes-display-inline">The amount of a grant
under this section may not exceed the non-Federal share provided by the
institution of higher education for the program or activity.</text>
</subsection><subsection id="H6D7CB2F2F5BE499F9909E1A8E6A70A86"><enum>(g)</enum><header>Non-Federal
share</header><text>The non-Federal share of the cost of projects and
activities under this section may include cash, or the value of noncash
contributions, equipment, or other in-kind contributions the Secretary
determines are appropriate.</text>
</subsection><subsection id="H3D07F937100F4A58B658A4C514928955"><enum>(h)</enum><header>Duration</header><text display-inline="yes-display-inline">Each grant shall provide funds for each
year of a 5-year period.</text>
</subsection><subsection id="H68C430DC18EF47BEAC64655057B74D2B"><enum>(i)</enum><header>Reports</header>
<paragraph id="H7A9A3FAF06E34E1E877488A79F496E32"><enum>(1)</enum><header>Periodic
reports</header><text display-inline="yes-display-inline">Grant recipients
shall submit progress reports annually during the 5-year grant term to the
Secretary on the progress of activities and projects funded under this
section.</text>
</paragraph><paragraph id="HD825E13922964399BED78A51609E1D60"><enum>(2)</enum><header>Final
report</header><text display-inline="yes-display-inline">Not later than 6
months after the grant expires a grant recipient shall submit a final report to
the Secretary.</text>
</paragraph></subsection></section><section id="HABBBC4746C5C4ABEA4FEB9922BBE0E61"><enum>107.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>

partner</header><text>The term <quote>community partner</quote> includes units
of a local government, a local business, a community based organization, and a
local nonprofit organization.</text>

training, education, crime prevention, urban planning, community organizing,
environmental sustainability, transportation, information technology, child
welfare, and other issues the Secretary determines are appropriate.</text>
</paragraph><paragraph id="HEF2C38D9C51E4FF4A2665701EFC66C68"><enum>(5)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of Housing and Urban
Development.</text>

area</header><text display-inline="yes-display-inline">The term <quote>urban
area</quote> means a metropolitan statistical area that has a population of

initiative</header><text>The term <term>cluster initiative</term> means a
formally organized effort to promote cluster growth and competitiveness through
collaborative activities among cluster participants.</text>
</paragraph><paragraph id="H01268F0BC1BD44B8A5A7AD176C598329"><enum>(6)</enum><header>CLUSTER
program</header><text>The term <term>CLUSTER program</term> means the
Competitive Leadership for the United States Through its Economic Regions
program established under section 116 to create and sustain a series of
initiatives to promote economic growth in industry groups.</text>

term <term>innovation</term> means the achievement of meaningful increases in
productivity through the introduction or diffusion of a new or improved
product, service, process, source of supply of materials, business structure,
business practice, business model, or methods of production, delivery,
distribution, financing, marketing, packaging, promoting, or pricing.</text>
</paragraph><paragraph id="H9F2D2397E28945E7851B944189B713B0"><enum>(11)</enum><header>Productivity</header><text>The
term <term>productivity</term> means the measure of the quality or quantity of
economic output relative to the input required to produce that output.</text>
</paragraph><paragraph id="H4168492309584384AE16A6B83E1B25EF"><enum>(12)</enum><header>United
States</header><text display-inline="yes-display-inline">The term <term>United
States</term> means States of the United States, the District of Columbia, the
Commonwealth of Puerto Rico, and the territories and possessions of the United

</paragraph></section><section id="HB75421460C0942EE9F88617815B6175F"><enum>112.</enum><header>National
innovation council</header>
<subsection id="H3AC6566F37A04FFDB8F946EE432A5F68"><enum>(a)</enum><header>Establishment</header>
<paragraph id="HEE68128EC4514F62A2790EEDB9E2FAE7"><enum>(1)</enum><header>In
general</header><text>There is established in the Executive Office of the
President a council to be known as the National Innovation Council which shall
coordinate Federal innovation policy for the Federal Government and provide
financial assistance for State and local innovation initiatives.</text>
</paragraph><paragraph id="H5F4326DA4A8848A19F2A4C80EC6082F6"><enum>(2)</enum><header>Director</header><text>The
Council shall have a Director, who shall be appointed by the President, by and
with the advice and consent of the Senate.</text>
</paragraph><paragraph id="H717DDB2F24BE46DC8F3DD46EBDDA2214"><enum>(3)</enum><header>Staff</header>
<subparagraph id="HE933FE514314426B819AEADDA74A2941"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">Subject to the rules
prescribed by the Council, the Director may appoint and fix the pay of
personnel as the Director considers appropriate to enable the Council to
perform its duties under this part.</text>
</subparagraph><subparagraph id="HDDD46901D8B14BE8A54043A38E970B67"><enum>(B)</enum><header>Experts and
consultants</header><text>The Director may procure temporary and intermittent
services under section 3109(b) of title 5, United States Code, for such
professional or technical staff as the Director determines is necessary to
carry out specific functions under this part.</text>
</subparagraph></paragraph></subsection><subsection id="H40CC98976C494B488EB694E55145B67B"><enum>(b)</enum><header>Powers and
responsibilities</header>
<paragraph id="H6A01E8BBBF034517B5DB3EB5704E1932"><enum>(1)</enum><header>Policy
formulation, advocacy, and assistance</header><text>The Council shall formulate
and advocate for the innovation policy of the Federal Government by—</text>
<subparagraph id="H43E10DE06EDC40939866431B7DC9239B"><enum>(A)</enum><text>providing
assistance to other agencies with respect to innovation, upon request;</text>
</subparagraph><subparagraph id="H2E95B1EF5A57423FA3953790256C354C"><enum>(B)</enum><text>assisting and
providing funding to the Bureau of the Census, the Bureau of Economic Analysis,
the Bureau of Labor Statistics, other statistical agencies, and the National
Science Foundation in developing operational measures of innovation that can be
included in new or existing economic data sources;</text>
</subparagraph><subparagraph commented="no" id="HAD36A9C01ACC47838179F74E4AD4CCBD"><enum>(C)</enum><text>providing agencies
and companies with the necessary information to promote innovation and
productivity; and</text>
</subparagraph><subparagraph id="H2205C25003C240849DD9DB7B46BF925B"><enum>(D)</enum><text>assisting
companies with innovation activities, including the following:</text>
<clause id="H8DCF2C97239B409A8277931852B02349"><enum>(i)</enum><text>Joint
industry-university research partnerships.</text>
</clause><clause id="HF36E24E19C914CE39CECAB2AF23012CF"><enum>(ii)</enum><text>Technology
transfer from laboratories to businesses.</text>
</clause><clause id="HF7F22C1A4CF64AC199738CFB0C11952A"><enum>(iii)</enum><text>Technology-based
entrepreneurship.</text>
</clause><clause id="H513609D89AB0466A95C95AA1D2444FA4"><enum>(iv)</enum><text>Industrial
modernization through the adoption of best practice technologies and business
practices.</text>
</clause><clause id="HA0F4CEF3F4FE4F64AC21597AC246CE8E"><enum>(v)</enum><text>Incumbent worker
training.</text>
</clause></subparagraph></paragraph><paragraph id="H3A23BBE1D2544E7392426FB3205F3950"><enum>(2)</enum><header>Innovation
measurement, research program, and advocacy</header><text display-inline="yes-display-inline">The Council shall—</text>
<subparagraph id="H6C02F76C0AEE42DDAB48FD43C422329E"><enum>(A)</enum><text>develop methods of
measuring innovation and productivity in the United States;</text>
</subparagraph><subparagraph commented="no" id="HBA1CF6CE246F435397476C50D69E945C"><enum>(B)</enum><text display-inline="yes-display-inline">carry out a program of research on
innovation and productivity; and</text>
</subparagraph><subparagraph id="H810CCDB078D547BAA7791E8E6E699537"><enum>(C)</enum><text>recommend specific
measures to improve innovation and productivity in the United States.</text>
</subparagraph></paragraph></subsection><subsection id="H8B908127AA0C402889FAD44C7D5CB740"><enum>(c)</enum><header>Collaboration</header><text>The
Council shall collaborate with and provide funding to the Bureau of the Census,
the Bureau of Economic Analysis, the Bureau of Labor Statistics, other
statistical agencies, and the National Science Foundation to develop—</text>
<paragraph id="H9C0E98FD988D4A669452B6A01CDCE686"><enum>(1)</enum><text>measures of
productivity in the service sector;</text>
</paragraph><paragraph commented="no" id="H8DCF5AF0DA484246B4541F977EFD47E1"><enum>(2)</enum><text>measures of total
factor productivity, reflecting capital, materials, energy, purchased services,
labor, and other relevant factors as productive inputs for all
industries;</text>
</paragraph><paragraph id="H30263063C24E4F43A7588BA5A1B5BA1A"><enum>(3)</enum><text>measures of gross
product and productivity for counties and metropolitan areas; and</text>
</paragraph><paragraph id="HA5CBF219D03C4260846AB9E14B6591E9"><enum>(4)</enum><text>measures of
private rates of return from research and development.</text>
</paragraph></subsection><subsection id="H15312EF2F5914398B799F18100EBE48B"><enum>(d)</enum><header>Data collection
and Analysis</header><text>The Council shall—</text>
<paragraph id="H21F0835578AA406CB62A1AF50797399E"><enum>(1)</enum><text>collect and
analyze data necessary to evaluate the impact on productivity resulting from
the activities of the Council; and</text>
</paragraph><paragraph id="H0BBAD9DE265C47F1807EB277A72BECFF"><enum>(2)</enum><text>require recipients
of funding or other assistance from the Council to provide information
necessary to measure improvements in productivity resulting from such funding
or other assistance.</text>
</paragraph></subsection><subsection id="HF48158870DAA4444885B56CEF27999A8"><enum>(e)</enum><header>Annual
report</header><text>Beginning not later than one year after the date of
enactment of this Act, the Council shall submit to Congress a report each year
on the following:</text>
<paragraph id="HEB7876D4350C4E4CAA4D273B59D085A9"><enum>(1)</enum><text>The current and
foreseeable trends in innovation and productivity in the United States.</text>
</paragraph><paragraph id="HBB05C53D749341DD8007FB5B1AB048EB"><enum>(2)</enum><text>A
review and analysis of recent domestic and international developments affecting
innovation and productivity in the United States.</text>
</paragraph><paragraph id="HC5EDE66197A841FFAFC910C4F014FE9C"><enum>(3)</enum><text>Goals for improved
innovation and productivity in the United States.</text>
</paragraph><paragraph id="H9853B3005FFC44D28B768CA28AE32E8C"><enum>(4)</enum><text>A
description of the activities designed to improve innovation and productivity
in the United States.</text>
</paragraph><paragraph commented="no" id="HEFB030A6407A4D5A811C071949B976F2"><enum>(5)</enum><text>Recommendations
for legislation the President considers appropriate.</text>
</paragraph></subsection></section><section id="H574727C2D45C443994A1C22812738913"><enum>113.</enum><header>National
innovation council board</header>
<subsection id="H036A086F74FA4B1290AD9065AF80B639"><enum>(a)</enum><header>Establishment</header><text>The
Council shall be under the direction of the National Innovation Council Board.
The Board shall be composed of 11 members as follows:</text>
<paragraph id="H35E67D480BDB47F5BD53D8BC85A0F48C"><enum>(1)</enum><text>The Secretary of
Commerce.</text>
</paragraph><paragraph id="H65F7E50D4D4B4528BDD93F5CDEC063CD"><enum>(2)</enum><text>The Secretary of
Labor.</text>
</paragraph><paragraph id="H602B1474FED042E690C88422F8CE045F"><enum>(3)</enum><text>Nine members
appointed by the President.</text>
</paragraph></subsection><subsection id="H3C295FE16AF349EE9AFE43A446B92108"><enum>(b)</enum><header>Appointment
criteria</header>
<paragraph id="H8CB201EE55944DD3A487C52D389281E7"><enum>(1)</enum><header>Qualifications</header><text>Each
member of the Board shall—</text>
<subparagraph id="H02717FC5184C4F03A80CEE01AF621308"><enum>(A)</enum><text>be in the field of
business, economic development, health care, applied sciences, engineering,
education, or public affairs;</text>
</subparagraph><subparagraph id="H57D20222940446ED92EB5B2684B36D12"><enum>(B)</enum><text>have a record of
distinguished service in the field of the member; and</text>
</subparagraph><subparagraph id="HA614F232E6D246CB895C80B29A7B16CD"><enum>(C)</enum><text>have demonstrated
knowledge and appreciation of the value of innovation.</text>
</subparagraph></paragraph><paragraph id="H171DCAA2AED04DDD9379D2CAB740EF11"><enum>(2)</enum><header>Representation</header><text>In
making appointments under this section, the President shall—</text>
<subparagraph id="H79A11781F11C4C1AB8B39AC941127ADB"><enum>(A)</enum><text>give due regard to
equitable representation of members who are women or who represent minority
groups;</text>
</subparagraph><subparagraph id="HC4C0504A763A45988EDA91B6BD5E1759"><enum>(B)</enum><text>provide
representation of the views of leaders in economic development and innovation
in all areas of the United States; and</text>
</subparagraph><subparagraph id="HD0F412E0BD414E4E9EEBD94D963C99BF"><enum>(C)</enum><text>appoint not less
than—</text>
<clause id="H83A14BF9DA0B4057800B86D23EDF13D5"><enum>(i)</enum><text>one
member with a background in manufacturing;</text>
</clause><clause id="HA6553B6746D5434CAA20473FF6B6188E"><enum>(ii)</enum><text display-inline="yes-display-inline">one member with a background in the service
industry;</text>
</clause><clause id="H9CA1C2D6F643448E804113E1F3038AF8"><enum>(iii)</enum><text display-inline="yes-display-inline">one member from a university in a major
metropolitan area;</text>
</clause><clause id="H33D6C7BFDCC244CD9CDB024618AC0B78"><enum>(iv)</enum><text display-inline="yes-display-inline">one member from a State or local
government;</text>
</clause><clause id="H38C69E326A6E48DCA9D7DCD5E39015F3"><enum>(v)</enum><text display-inline="yes-display-inline">one member from organized labor;</text>
</clause><clause id="H0FD91B733BBD4459B17916FC90DFD00E"><enum>(vi)</enum><text display-inline="yes-display-inline">one member from the nonprofit
sector;</text>
</clause><clause id="H208C27E31ACB455FB5A4478B970594F0"><enum>(vii)</enum><text display-inline="yes-display-inline">one member from an economic development
organization;</text>
</clause><clause id="HE9AE6AFACFF84621A3AAFFF4C70D2EBF"><enum>(viii)</enum><text display-inline="yes-display-inline">one member from a professional business or
industry association; and</text>
</clause><clause id="HA4B46863B6944D29931A2305287DE6ED"><enum>(ix)</enum><text>one
member who is a recognized expert in innovation.</text>
</clause></subparagraph></paragraph><paragraph id="H44F9051FCD0746AFACE51BBF2718C2F6"><enum>(3)</enum><header>Terms</header><text>Each
member of the Board shall be appointed for a term of 4 years.</text>
</paragraph></subsection></section><section id="H78317EE109B843C19757C5E4B66741E3"><enum>114.</enum><header>Coordination of
programs and functions</header><text display-inline="no-display-inline">The
Council shall monitor, align, guide, and assess the integration and performance
of the functions, personnel, assets, and liabilities of the following to better
address science, technology, and economic opportunities and challenges relevant

purpose of the CLIC is to promote the collection, development, and
dissemination of data and analysis about clusters throughout the United
States.</text>
</subsection><subsection id="H735C02CC179C47C58D59D43ECA853AD0"><enum>(c)</enum><header>Databases</header><text>The
Director of the Council shall compile databases for the CLIC from Federal data
sets available from the following:</text>

initiatives, and CLUSTER programs under section 116;</text>
</subparagraph><subparagraph id="H2A97C02E217B4189B1EC03610155CC18"><enum>(B)</enum><text display-inline="yes-display-inline">gather, analyze, and disseminate
information on the best practices for the development of clusters, cluster
initiatives, and CLUSTER programs in the United States and in other countries,
specifically determining how productivity, innovation, and competitive
advantage can be maximized through clusters, cluster initiatives, and CLUSTER
programs;</text>
</subparagraph><subparagraph id="H085FDA5AC28446A29436F238488D8DCF"><enum>(C)</enum><text>develop technical
assistance guides for regional cluster analysis and cluster initiative and
initiative program development and operations; and</text>
</subparagraph><subparagraph id="HAD41428B932E41ADAC5D153307E727CE"><enum>(D)</enum><text>bring together
representatives of clusters, cluster initiatives, and CLUSTER programs,
experts, and scholars to disseminate developments in cluster initiatives and
programs.</text>
</subparagraph></paragraph><paragraph id="H75956682EC994684B14C996A34ED6395"><enum>(2)</enum><header>Data
collection</header><text>The CLIC shall collect and make available data on
cluster activity showing the following:</text>
<subparagraph id="H9DA83ED162A6428BA74853ACFF67EE73"><enum>(A)</enum><header>Breadth</header><text>A
geographically specific picture of the array of clusters in each key industry,
as determined by the Council, throughout the United States, with data on size,
specialization, and competitiveness of the clusters in each State, region, and
major metropolitan area.</text>
</subparagraph><subparagraph id="HE597F74DD97A42B5B3938F805C212B01"><enum>(B)</enum><header>Depth</header><text>For
each cluster, detailed data such as regional domestic product contribution,
total jobs and earnings by key occupations, job openings and skill sets needed,
establishment size, nature of specialization, patents, Federal research and
development spending, citation patterns, and trade.</text>
</subparagraph><subparagraph id="H4FC851AFFC444C278FCA4745E0C3FF4C"><enum>(C)</enum><header>Flow</header><text>Estimates
of supply chain product and service flows within and between clusters.</text>
</subparagraph></paragraph><paragraph id="H0A668A7AF9D04003B6B6388563D5C905"><enum>(3)</enum><header>Report</header><text>The
CLIC shall—</text>
<subparagraph id="H8A44847424C54C46AA598B1EA0800976"><enum>(A)</enum><text display-inline="yes-display-inline">monitor the extent to which the available
data is sufficient for proper analysis of cluster activity; and</text>
</subparagraph><subparagraph id="H1153179E2C7C4DE28444205BC4403109"><enum>(B)</enum><text display-inline="yes-display-inline">not later than one year after the date of
enactment of this Act, submit a report to Congress that includes
recommendations regarding further authorization for data collection, as
necessary.</text>
</subparagraph></paragraph><paragraph id="H6F5D2668B36741C78F044416117FDC80"><enum>(4)</enum><header>Dissemination of
analyses</header><text>Data and analysis compiled by the CLIC shall be made
available to other agencies, State and local governments, and nonprofit and
for-profit entities, to guide investments in cluster activities that will lead
to increased productivity, innovation, and competitive advantage,
including—</text>
<subparagraph id="HCFA406921FBE43F7848F75CDFF05868E"><enum>(A)</enum><text>cluster
development;</text>
</subparagraph><subparagraph id="HC4341A7F1AD9452BAE21344809C0320B"><enum>(B)</enum><text>economic
development;</text>
</subparagraph><subparagraph id="H99C130B6FD6C45279F87CC036C5FE28B"><enum>(C)</enum><text>workforce
development;</text>
</subparagraph><subparagraph id="H3C04164AE235489A91B2F5AE7BFE5B71"><enum>(D)</enum><text>research and
development;</text>
</subparagraph><subparagraph id="H615EE81367A24CDCA63C2B7DAB558EC2"><enum>(E)</enum><text>business site
locations;</text>
</subparagraph><subparagraph id="H1D89E458CCC249F8AB034953991FBF81"><enum>(F)</enum><text>analysis of United
States competitiveness, by industry, cluster, and geography; and</text>
</subparagraph><subparagraph id="H118A91E2667F4EB0A8239AEA03CFF057"><enum>(G)</enum><text>other appropriate
activities as determined by the Council.</text>
</subparagraph></paragraph></subsection><subsection id="HB9CE569FA08C4C44957BE53BEC4AC2BC"><enum>(e)</enum><header>Cluster
initiative and cluster program registry</header>
<paragraph id="HE63677CFC1FD48F688F07945A3B8565D"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The CLIC shall
maintain a publicly available registry of cluster initiatives that meet the
requirements of
<internal-xref idref="H88BC8C85DEDC46BE98FF5187A9BBD11C" legis-path="115.(e)(2)">paragraph (2)</internal-xref> and CLUSTER programs
under section 116 that contain useful information to the study and analysis of
Cluster initiatives and CLUSTER programs, including—</text>
<subparagraph id="HD13C6F03D73D479EB770804E5DB56AA0"><enum>(A)</enum><text>organizational
structure;</text>
</subparagraph><subparagraph id="H102862B726524CFE8546600EB7FA4B83"><enum>(B)</enum><text>membership;</text>
</subparagraph><subparagraph id="H9B18A2F8C7774708B7A88F7535FEF851"><enum>(C)</enum><text>activities;</text>
</subparagraph><subparagraph id="H75639E6A524D4CC79C1E3BE421328757"><enum>(D)</enum><text>funding;
and</text>
</subparagraph><subparagraph id="H2122074E217A42C58DE97531D74583F1"><enum>(E)</enum><text>perceived impacts
of registered cluster initiatives and CLUSTER programs.</text>
</subparagraph></paragraph><paragraph id="H88BC8C85DEDC46BE98FF5187A9BBD11C"><enum>(2)</enum><header>Information
collected</header><text>At the time a cluster initiative is registered, the
CLIC shall collect sufficient information to demonstrate that the cluster
initiative—</text>
<subparagraph id="HC828BE80068542C093F9D3DC54D26E7A"><enum>(A)</enum><text>is an industry-led
effort with not less than five companies and one lead organizing entity;</text>
</subparagraph><subparagraph id="HA4A39C20FC3F4E8F9F94E1D28176BB81"><enum>(B)</enum><text>involves not less
than three cluster support organizations, such as workforce boards, community
colleges, universities, and industry associations; and</text>
</subparagraph><subparagraph id="HD839B84D60FC408A9D90F00CC4060F5E"><enum>(C)</enum><text>has a strategy to
enhance the competitive position of the cluster.</text>
</subparagraph></paragraph><paragraph commented="no" id="H092575C43D194C58870E8E415114E562"><enum>(3)</enum><header>Priority
funding</header><text display-inline="yes-display-inline">Registered cluster
initiatives and CLUSTER programs under section 116 shall receive priority for
funding from the Council and the CLIC.</text>
</paragraph><paragraph id="H68445AC923A94D669BD94DA6E6BC2152"><enum>(4)</enum><header>Use of
information</header><text>Information contained in the cluster initiative and
CLUSTER program registry shall be made available to other agencies, State and
local governments, and nonprofit and for-profit entities.</text>
</paragraph></subsection><subsection id="H9461CBE5725043A2B7976DC0B0D00918"><enum>(f)</enum><header>Outside
Contracts</header><text>The Director of the Council may enter into contracts
with an external organization such as another agency, a university, a nonprofit
research entity, or a private company, to conduct the operations.</text>
</subsection></section><section id="H74EE162F16C74B87AF97763098CC4A8A"><enum>116.</enum><header>CLUSTER grant
program</header>
<subsection id="H41A6016440F64F58AC42B4EABB9CE204"><enum>(a)</enum><header>CLUSTER grant
program</header>
<paragraph id="H6D610755D09F4313AC1906429512F4B1"><enum>(1)</enum><header>In
general</header><text>The Council may make grants to eligible entities to
operate a CLUSTER grant program for the purpose of awarding grants to cluster
initiatives in accordance with the requirements under this subsection.</text>
</paragraph><paragraph id="HF69ACA0BD4A94B178ACBF1FF28024726"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
this section, an eligible entity shall prepare and submit to the Director an
application at such time, in such form, and containing such information and
assurances as the Director may require.</text>
</paragraph><paragraph commented="no" id="H7239CF28A8D3425E918C10D68CF205D8"><enum>(3)</enum><header>Use of
funds</header><text>Each grantee that receives grant funds under this
subsection shall ensure, as determined by the Council, that cluster initiatives
supported by such funds—</text>
<subparagraph commented="no" id="HD638C5466DCF4D7B8E968D74A9D7DD61"><enum>(A)</enum><text>are operated in a
manner consistent with the <quote>best practices</quote> established by the
CLUSTER program;</text>
</subparagraph><subparagraph commented="no" id="HDDE5461F0BDD41199C336BE4A9609342"><enum>(B)</enum><text>are industry
led;</text>
</subparagraph><subparagraph commented="no" id="HD87EE3B6FC96431B9E47704E9B2284F5"><enum>(C)</enum><text>are inclusive,
seeking organizations that might benefit from participation, including
startups, firms not locally owned, and firms rival to existing members;</text>
</subparagraph><subparagraph commented="no" id="H165C94040C8549AD8B0C208904EFA027"><enum>(D)</enum><text>encourage broad
participation by and collaboration among all types of participants;</text>
</subparagraph><subparagraph commented="no" id="HA3B3030E9F014CFF8A08DD246BEBDA54"><enum>(E)</enum><text>involve key State
and local government actors; and</text>
</subparagraph><subparagraph commented="no" id="H4F11D5EB31974909AC5F0F3F85F71829"><enum>(F)</enum><text>participate in the
CLIC registry and research activities described in section
<internal-xref idref="HB9CE569FA08C4C44957BE53BEC4AC2BC" legis-path="115.(e)">section 115(e)</internal-xref>.</text>
</subparagraph></paragraph><paragraph id="H36E5F57D9A524E98AABDEF3B3298660B"><enum>(4)</enum><header>Grant
types</header>
<subparagraph id="H8198A337D5D042A8B5EF63325C2A5EE7"><enum>(A)</enum><header>Feasibility
study grants</header><text display-inline="yes-display-inline">A grant in an
amount not to exceed $250,000 may be awarded to not less than one eligible
grantee in each State, on a one-time basis, with no matching funds required,
for CLUSTER program feasibility studies, planning, and operations.</text>
</subparagraph><subparagraph id="H4919EB62CC88444CB8C4CA8172ECB913"><enum>(B)</enum><header>Startup and
annual grants</header>
<clause id="HE4C9667E5E4D47F486B361AD69528A9D"><enum>(i)</enum><header>Startup
grant</header><text>A 1-year grant in an amount not to exceed $1,000,000 may be
awarded to not less than one new CLUSTER program in each State to support
planning studies, provide technical assistance, and fund startup
activities.</text>
</clause><clause id="HDD82F1DDFD75446380E48E40D22CB437"><enum>(ii)</enum><header>Annual
grant</header><text>An annual grant shall be awarded to not less than one
early-stage CLUSTER program in each State to provide technical assistance and
fund operating activities.</text>
</clause><clause id="HD432A5B778CA46F4868D3B3FDBE84886"><enum>(iii)</enum><header>Renewal</header><text>Grants
awarded under clause (ii) may be renewed for up to five additional 1-year
periods.</text>
</clause><clause id="H70D0831B870240A8B781BF5B2F4BFB36"><enum>(iv)</enum><header>Matching funds
requirement</header>
<subclause id="H60B2DC7B615142F5942F2B66F146AD49"><enum>(I)</enum><header>Initial
period</header><text>During the first 2 years in which an eligible entity
receives grant funding under this subparagraph, the eligible entity shall
provide matching funds in an amount equal to the amount of funds received under
this subparagraph.</text>
</subclause><subclause id="H19B2255006E54C8D9622DCDB46EF3639"><enum>(II)</enum><header>Subsequent
period</header><text>If the Council determines, in accordance with criteria
established by the CLUSTER program, that an eligible grantee has demonstrated
greater effectiveness than other grant recipients during the period described
in subclause (I), the non-Federal matching requirement for such eligible
grantee in future years may be reduced.</text>
</subclause></clause></subparagraph><subparagraph id="H140F96B73ACE496397FBD7F6A457F5C0"><enum>(C)</enum><header>Matching grants
for cluster initiatives</header>
<clause id="H3DA3F880326E435C95506C603683FAA8"><enum>(i)</enum><header>In
general</header><text>A grant in an amount between $1,000,000 and $15,000,000
may be awarded, on a competitive basis, to CLUSTER programs, as determined by
the Council, to support cluster initiatives.</text>
</clause><clause id="H2D7AA1DB317541E5B8C88BD30153A34D"><enum>(ii)</enum><header>Matching
requirement</header><text>An eligible entity receiving a grant under this
subparagraph shall provide matching funds in an amount equal to the amount of
grant funds received under this subparagraph.</text>
</clause><clause id="H66A51B07F30A40679E81CDB6C3984B49"><enum>(iii)</enum><header>Selection
criteria</header><text>In selecting grant recipients under this subparagraph,
the Council shall consider—</text>
<subclause id="H0CC72A44EE154A52A4C43F064D1967D7"><enum>(I)</enum><text>the probable
impact of the proposed effort on the competitiveness of the area’s traded
sector;</text>
</subclause><subclause id="HA93C22123B9842E8B9B065E98815B585"><enum>(II)</enum><text>if the proposed
effort fits within a broader achievable economic development strategy;</text>
</subclause><subclause id="HA149A03995F0437791B607170E8D4424"><enum>(III)</enum><text>the capacity and
commitment of the sponsoring organization;</text>
</subclause><subclause id="HEC65078FC44F4384816FD56C10C2C184"><enum>(IV)</enum><text>the degree of
support and involvement from relevant State and regional economic and workforce
development organizations, other public purpose institutions (such as
universities, community colleges, and workforce boards), and the private
sector, including industry associations;</text>
</subclause><subclause id="HA689EDFF7FB44C1BBC63D24EB0C1C62F"><enum>(V)</enum><text>the eligible
grantee’s expected ability to access additional funds from Federal, State, and
local sources;</text>
</subclause><subclause id="H0EDE54A7A3ED41079AA8DCF80DF5ECE3"><enum>(VI)</enum><text>the eligible
grantee’s capacity to sustain activities once grant funds have been expended;
and</text>
</subclause><subclause id="H062C388C95164153ABA3A6A65F067816"><enum>(VII)</enum><text>the extent to
which economic diversity across regions of the United States would be increased
through the grant.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="H1093D8E8746F400485EF533D2CCF293A"><enum>(5)</enum><header>Application
process</header><text>The application process for grants awarded under this
subsection shall be on a rolling basis.</text>
</paragraph></subsection><subsection id="H598D1D3E53AE43839B8A623C6E6AE99E"><enum>(b)</enum><header>National sector
research grants</header>
<paragraph id="H918BD3BDBD1E4DF0ABCEDCD9AB8E55A5"><enum>(1)</enum><header>Grants
authorized</header><text>The Council shall award competitive grants to eligible
companies and joint ventures to encourage innovation through research
partnerships between academic institutions located in major metropolitan areas
in the United States and industry research alliances.</text>
</paragraph><paragraph id="HF5608921486C4D24A4A10957A8294A1F"><enum>(2)</enum><header>Eligibility</header><text>Each
company and joint venture desiring a grant under this subsection shall—</text>
<subparagraph id="HF1126FA129A94D3BB9A3C6EA92468781"><enum>(A)</enum><text>submit an
application to the Council containing such information and assurances as the
Council may reasonably require;</text>
</subparagraph><subparagraph id="HEFD5D61E1961453C81F053C56EBE3BEF"><enum>(B)</enum><text>form an
industry-led research consortium consisting of at least five companies;
and</text>
</subparagraph><subparagraph id="HB30FC92125A248F2BEC870AC9735D236"><enum>(C)</enum><text>agree to develop a
3- to 10-year technology roadmap that charts out generic science and technology
needs that the companies share.</text>
</subparagraph></paragraph><paragraph id="HD14AAFBC47CC4EF38DEBFBB4E3323ABD"><enum>(3)</enum><header>Federal cost
share</header><text>The Federal share of a project funded by a grant under this
subsection may not exceed 50 percent of the total project cost.</text>
</paragraph></subsection><subsection id="HBE571B41DB0D45DF9E0A3EC8853224C1"><enum>(c)</enum><header>Productivity
enhancement research grants</header><text>The Council shall award grants to
academic institutions located in major metropolitan areas in the United States
and to joint ventures comprised of academic institutions located in major
metropolitan areas and private companies to support early-stage research into
methods of increasing productivity and innovation, with broad application for a
range of industries, including—</text>
<paragraph id="H4DDD6CF8D25D4BB4AA950F1DFBBB306F"><enum>(1)</enum><text>automated
manufacturing or service processes;</text>
</paragraph><paragraph id="H8C29C14C1D6A46F796C5F8DAB5D73FA8"><enum>(2)</enum><text>technology-enabled
remote service delivery;</text>
</paragraph><paragraph id="H4AA3D2A461EF4801830752DF6D9107BE"><enum>(3)</enum><text>quality
improvement; and</text>
</paragraph><paragraph id="H58AA89D1ECF54B119FDDE9F32E44CFF0"><enum>(4)</enum><text>other methods of
improving productivity and innovation.</text>
</paragraph></subsection><subsection id="H5E94ABC5DCFC4F67BD91C892BA6B91D9"><enum>(d)</enum><header>State
innovation-Based economic development partnership grants</header>
<paragraph id="HBE1F2D8A3C3C45EF8F5D0F1317755799"><enum>(1)</enum><header>Grants
authorized</header><text>The Council shall award innovation-based economic
development partnership grants to State economic development entities
designated by each State.</text>
</paragraph><paragraph id="H65947B42028F45B9B00128C97CA46B51"><enum>(2)</enum><header>Grant
types</header>
<subparagraph id="H4C8A18A7B7694C1F82DB284851DFAF39"><enum>(A)</enum><header>Feasibility
study grants</header>
<clause id="H33B3134ECBD9457387161C911116BA1F"><enum>(i)</enum><header>In
general</header><text>A grant in an amount not to exceed $250,000 each shall be
awarded to States, to be determined by the Council, for feasibility studies,
planning, and operations.</text>
</clause><clause id="H889CFF2D49F44F0AA5152C0527C236CE"><enum>(ii)</enum><header>Conditions</header><text>A
feasibility study grant shall be awarded to not less than one eligible grantee
in each State on a one-time basis, with no matching funds required.</text>
</clause></subparagraph><subparagraph id="HD782EBBE24CC49E0972FAA11D57E62C3"><enum>(B)</enum><header>Startup and
annual grants</header>
<clause id="H978861E76ABC4DE68BD7C42DE735CDB2"><enum>(i)</enum><header>Startup
grant</header><text>A 1-year grant in an amount not to exceed $2,000,000 each
shall be awarded to States to support planning studies, provide technical
assistance, and fund startup activities.</text>
</clause><clause id="H3E443D0D74BF489BA039B5815C2F5A36"><enum>(ii)</enum><header>Annual
grants</header><text>In addition to the grants authorized under clause (i),
annual grants may be awarded to States to provide technical assistance and fund
operating activities. Grants awarded under this clause may be renewed
indefinitely.</text>
</clause><clause id="H9ECDCCE29BB94F13ABB99FB5CC64FF7E"><enum>(iii)</enum><header>Minimum
grants</header><text>Each State shall be awarded not less than one grant under
this subparagraph.</text>
</clause><clause id="HBC18F5EBB4E847ADBDD8CFDE6F599369"><enum>(iv)</enum><header>Matching funds
requirement</header><text>A State receiving a startup grant under clause (i)
shall provide—</text>
<subclause id="HB430451AFE3F4459ABCEEA5B9D2EC228"><enum>(I)</enum><text>for the first
$1,000,000 in grant funds, a match of $1 for every $2 received in grant funds;
and</text>
</subclause><subclause id="H2B7D02BE4F1C4CAC9D5706086D24CE8D"><enum>(II)</enum><text>for any
additional amount in grant funds, a match of $2 for every $1 received in grant
funds.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="HE13659465B804B509D34E1949DB29406"><enum>(3)</enum><header>IBED
plans</header>
<subparagraph id="H80CA6A21C81847BB955235C7CF1B162A"><enum>(A)</enum><header>Initial
plans</header><text>Each State desiring a grant under this subsection shall
submit to the Council an initial innovation-based economic development plan
(referred to in this paragraph as the <quote>IBED plan</quote>) that
describes—</text>
<clause id="H4752171D1BA246C2AE36FC2D62F2D23C"><enum>(i)</enum><text>how
grant funds would be used to support the creation of alliances for the
dissemination of innovation among local governments, businesses, educational
institutions, and other institutions;</text>
</clause><clause id="HCBCDB6DDA4C14D6FB18E63989FA4BBBC"><enum>(ii)</enum><text>how
companies within the State would benefit from the activities funded through a
grant under this subsection; and</text>
</clause><clause id="HF2FECF1B708D41BCBA8C8BFB7924FEDC"><enum>(iii)</enum><text>how innovation
would be disseminated through the activities described in
<internal-xref idref="H4EC9147BBCFE42E1884CACABFA59FF12" legis-path="115.(d)(4)">paragraph (4)</internal-xref> to companies within the
State.</text>
</clause></subparagraph><subparagraph id="HF370734AB56345F2A3F97741ECB821FC"><enum>(B)</enum><header>Review</header><text>The
Council and an outside panel of experts shall—</text>
<clause id="H574FAEB1EE194A6B8C1C62A717CE228D"><enum>(i)</enum><text>review the initial
IBED plans submitted under
<internal-xref idref="H80CA6A21C81847BB955235C7CF1B162A" legis-path="115.(d)(3)(A)">subparagraph (A)</internal-xref>; and</text>
</clause><clause id="H7C1242ED9FEA4912911E79A102491BCD"><enum>(ii)</enum><text>notify the States
of any suggested modifications to such plans.</text>
</clause></subparagraph><subparagraph id="H1A743BB1D721493CAAFB4158B413DD83"><enum>(C)</enum><header>Resubmission of
plans</header><text>States may submit modified IBED plans to the
Council.</text>
</subparagraph><subparagraph id="H5D71E57A2794449A9F2CC42D8B1C1D12"><enum>(D)</enum><header>Use of
plans</header><text>The Council shall assign a score to an IBED plan submitted
under this section and award competitive grants to States under this
subsection, to the extent available, on the basis of such score. In scoring
plans under this subparagraph, the Council shall award additional points for
multistate and regional innovation-based economic development efforts.</text>
</subparagraph></paragraph><paragraph id="H4EC9147BBCFE42E1884CACABFA59FF12"><enum>(4)</enum><header>Use of
funds</header><text>Grant funds received under this subsection may be used to
establish—</text>
<subparagraph id="H0EFAFE1FB9654F43A089C6DAD337C57D"><enum>(A)</enum><text>technology
commercialization centers;</text>
</subparagraph><subparagraph id="HD3D601D6B3EB4D56A5869D2B1F82BAC5"><enum>(B)</enum><text>industry-university
research centers;</text>
</subparagraph><subparagraph id="HB469F874CC4F449FBD716EC3ECF7F715"><enum>(C)</enum><text>regional cluster
development programs;</text>
</subparagraph><subparagraph id="HDD2938839B8345E7A92D112A95B210F2"><enum>(D)</enum><text>regional skills
alliances;</text>
</subparagraph><subparagraph id="H239D762148744DCAB872A4AE21CF628B"><enum>(E)</enum><text>entrepreneurial
support programs;</text>
</subparagraph><subparagraph id="H006F60785F984946B07ECF8E5312AC64"><enum>(F)</enum><text>science parks;
and</text>
</subparagraph><subparagraph id="H6C45F7F301234C9BB1CA9ADF70A80D71"><enum>(G)</enum><text>related activities
to spur innovation or productivity.</text>
</subparagraph></paragraph><paragraph id="HB17566CA7D144309A3CBB33AEF4309CC"><enum>(5)</enum><header>Federal cost
share</header><text>The Federal share of a project funded by a grant under this
subsection may not exceed <fraction>1/3</fraction> of the total project
cost.</text>
</paragraph><paragraph id="HF0ABD303FA3746808BB5F1E7E431BEDD"><enum>(6)</enum><header>Noncompetitive
grants</header><text>The Council shall award noncompetitive planning and
technical assistance grants to States that do not receive a competitive grant
under this subsection, which shall be used to improve the quality of the
States’ proposals for subsequent grants under this section.</text>
</paragraph></subsection><subsection id="H80D8F69C3E1D4A42AE10930046D280B7"><enum>(e)</enum><header>Technology
Diffusion Grants</header>
<paragraph id="HC0CDA19915834A809D887C5DF843146A"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Council shall
award grants to Regional Centers for the Transfer of Manufacturing Technology
established under section 25 of the National Institute of Standards and
Technology Act (15 U.S.C. 278k) (in this section referred to as <quote>regional
centers</quote>) in each State to promote the diffusion of existing
technological innovations to companies in which such innovations are
underutilized.</text>
</paragraph><paragraph id="H5443D223DFA748338963A1B0DBD69714"><enum>(2)</enum><header>Grant
activities</header><text>Notwithstanding any other provision of law, regional
centers may use grant funds awarded under this subsection for activities in the
service sector that comply with the requirements under this subsection.</text>
</paragraph><paragraph id="H7E15A90188764C7D951172329E6655B8"><enum>(3)</enum><header>Grant
types</header>
<subparagraph id="H1E72300D11C64FC895BE6A00FD6084BA"><enum>(A)</enum><header>Feasibility
study grants</header>
<clause id="H0243280B6D874AFAB5DCE6052B2AB9E4"><enum>(i)</enum><header>In
general</header><text>A grant in an amount not to exceed $250,000 each shall be
awarded to regional centers for feasibility studies, planning, and
operations.</text>
</clause><clause id="H7AB3E68D5F364A0C97B92CBCA428288E"><enum>(ii)</enum><header>Conditions</header><text>A
feasibility study grant shall be awarded under clause (i) to not less than one
eligible grantee in each State on a one-time basis, with no matching funds
required.</text>
</clause></subparagraph><subparagraph id="HE997384732434E33878D8843DC38530C"><enum>(B)</enum><header>Startup and
annual grants</header>
<clause id="H8FC95D1916D64E61B592DE294BFC70B9"><enum>(i)</enum><header>Startup
grant</header><text>A 1-year grant in an amount not to exceed $2,000,000 shall
be awarded to a regional center in each State to support planning studies,
provide technical assistance, and fund startup activities.</text>
</clause><clause id="H0A6572B4FDB24DB394C8C45D91A798FB"><enum>(ii)</enum><header>Annual
grants</header><text>In addition to the grants authorized under
<internal-xref idref="H8FC95D1916D64E61B592DE294BFC70B9" legis-path="115.(e)(3)(B)(i)">clause (i)</internal-xref>, annual grants shall
be awarded to regional centers in each State to provide technical assistance
and fund operating activities. Grants awarded under this clause may be renewed
indefinitely.</text>
</clause><clause id="HF4959C04106C43B4A6FF116A5EEB84B2"><enum>(iii)</enum><header>Matching funds
requirement</header><text>A regional center receiving a grant under this
subparagraph shall provide—</text>
<subclause id="H3B1ABF41F53147DDBCB6B0112E562621"><enum>(I)</enum><text>for the first
$1,000,000 in grant funds, a match of $1 for every $2 received in grant funds;
and</text>
</subclause><subclause id="HAB3628386DC64276824B30A4175F20CF"><enum>(II)</enum><text>for any
additional amount in grant funds, a match of $2 for every $1 received in grant
funds.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="H57DA32F2FC4D4DBE978427F4C835AA96"><enum>(4)</enum><header>Use of
funds</header><text>Grants funds received under this subsection may be used
to—</text>
<subparagraph id="H756465C7492E4B12BF51253AF579F981"><enum>(A)</enum><text>establish other
regional centers in each State to provide—</text>
<clause id="HD4B10499C958489FB5D675ECEDD8792D"><enum>(i)</enum><text>support for
manufacturing and services; and</text>
</clause><clause id="H8B7879F9B9F84AEFAFEE9467C3BD7D18"><enum>(ii)</enum><text>innovation
awards; and</text>
</clause></subparagraph><subparagraph id="HC947DA8357F343A2942724D7146DA99F"><enum>(B)</enum><text>support the
diffusion of innovation in any sector of the economy, including the service
sector.</text>
</subparagraph></paragraph><paragraph id="HF51D245A59D94FA4BE751AA41B724331"><enum>(5)</enum><header>Evaluation
process</header><text>In evaluating proposals for grants under this subsection,
the Council shall—</text>
<subparagraph id="H929E8424643B4A0BB45FFED0868F66ED"><enum>(A)</enum><text>determine the
degree to which measurable productivity gains are expected to be achieved
through each applicant’s proposed diffusion of innovation;</text>
</subparagraph><subparagraph id="H3F3AC6316ADF412989C9B6C36322C506"><enum>(B)</enum><text>follow the process
established under
<internal-xref idref="HE13659465B804B509D34E1949DB29406" legis-path="115.(d)(3)">subsection (d)(3)</internal-xref> for grants to carry
out the activities described in
<internal-xref idref="H1E72300D11C64FC895BE6A00FD6084BA" legis-path="115.(e)(3)(A)">paragraph (4)(A)</internal-xref>; and</text>
</subparagraph><subparagraph id="HFCF8D08D5576455488EC0143E34F0D8A"><enum>(C)</enum><text>require regional
centers to submit a plan to carry out the activities described in
<internal-xref idref="HC947DA8357F343A2942724D7146DA99F" legis-path="115.(e)(4)(B)">paragraph (4)(B)</internal-xref>.</text>
</subparagraph></paragraph></subsection><subsection id="HEB3368C9F9464EE2AD30B0C1C48EF924"><enum>(f)</enum><header>Use of
grants</header><text>Grant funds received under this section shall be used
to—</text>
<paragraph id="HB736524BD27D46A5828116789CCE3BA7"><enum>(1)</enum><text>perform
Council-supported grant work in the United States; and</text>
</paragraph><paragraph id="H85D5D3F6DEE84FEF99D60A73E61EEC79"><enum>(2)</enum><text>promote the
production of any resulting goods or services in the United States.</text>
</paragraph></subsection><subsection id="H14BBCA33256E43E6ADE417922CED7BB4"><enum>(g)</enum><header>Award
criteria</header><text>In evaluating proposals for grants under this section,
the Council—</text>
<paragraph id="HEEA6A636D5F748F4AA663203549A8783"><enum>(1)</enum><text>shall determine,
as one award factor, the extent to which a grant to each State or regional
center is expected to increase production, wages, or employment in the United
States;</text>
</paragraph><paragraph id="HBB745653E0AA4182860735C8CC461EA9"><enum>(2)</enum><text>may not award any
grant which the Council believes could result in a decrease in production,
wages, or employment in the United States; and</text>
</paragraph><paragraph id="H0754ED11234545D0A4FEF705D1888B1C"><enum>(3)</enum><text>shall consult with
technology-specific boards staffed with experts in fields appropriate to the
proposals for grants being evaluated.</text>
</paragraph></subsection><subsection id="H2E88D839272E453CB70263801F32D85B"><enum>(h)</enum><header>Minimum Funding
Level</header>
<paragraph id="H59638B5EFA8447658C19DE6D0621B51B"><enum>(1)</enum><header>In
general</header><text>For each of the grant programs established under
subsections (a), (d), and (e) not less than one grant shall be awarded to a
grantee in each State.</text>
</paragraph><paragraph id="H7689D645A51B407E8F9BCACE879AAF0A"><enum>(2)</enum><header>Population-based
allocations</header><text display-inline="yes-display-inline">In each State,
the total amount of grant funds awarded to grantees in such State under
subsections (a), (d), and (e) shall be not less than 50 percent of the product
of—</text>
<subparagraph id="H157452A1BC6B41D090450A68F1AA6BB9"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage of the population of the
United States who are residents of such State, according to the most recent
decennial census; and</text>
</subparagraph><subparagraph id="H5D6D1FEA4A714B3A858CDABC26A0E6D8"><enum>(B)</enum><text display-inline="yes-display-inline">the total amount of grant funds awarded
under subsections (a) through (e).</text>
</subparagraph></paragraph></subsection><subsection id="H11733EF3012E4F64B1ADB7FD6FA0D00C"><enum>(i)</enum><header>Coordination of
Funds</header><text display-inline="yes-display-inline">Recipients of grants
under this section may use, as matching funds, amounts received from the
agencies listed in
<internal-xref idref="H78317EE109B843C19757C5E4B66741E3" legis-path="114.">section 114</internal-xref>, to the extent approved by the
Council and such agencies.</text>

Economic Development Act of 1965 (42 U.S.C. 3121 et seq.) is amended by
inserting after section 207 the following:</text>

university centers</header>

general</header><text>On the application of an eligible recipient, the
Secretary may make grants for the establishment of university centers for the
purpose of assisting such centers in conducting applied research, providing
technical assistance to public and private sector organizations, and conducting
other activities to enhance regional economic development by promoting a
favorable business environment that attracts private capital investment and
higher-skill, higher-wage jobs.</text>
</subsection><subsection id="H60DC91AF28A14C8D800991828A6F66AF"><enum>(b)</enum><header>Grant
amounts</header>
<paragraph id="H9D16D4699A1348DF9452429C045C9D76"><enum>(1)</enum><header>In
general</header><text>A grant made under subsection (a) shall be in an amount
that is not less than $200,000 for each year in which grant amounts are
received.</text>
</paragraph><paragraph id="HAB09551564674FCC90F556EDAAD5AD72"><enum>(2)</enum><header>Determinations</header><text>In
determining the amount of a grant made under subsection (a), the Secretary
shall consider the size of the population and area to be served by the
applicable university center.</text>
</paragraph></subsection><subsection id="H63F73AA20F7140039C77C7A52F056F50"><enum>(c)</enum><header>Priority</header><text>In
making grants under subsection (a), the Secretary shall give priority to
eligible recipients that, as determined by the Secretary—</text>
<paragraph id="H3B71D318F27642E3BA37E5A45DF0BBF3"><enum>(1)</enum><text>demonstrate that a
substantial portion of their activities will benefit distressed areas;</text>
</paragraph><paragraph id="H047EAA404EF6480C9CF59CC675A0B07E"><enum>(2)</enum><text>demonstrate a
history of working in distressed communities; and</text>
</paragraph><paragraph id="H91B4002432A6474BBB883348C4D67FD3"><enum>(3)</enum><text>demonstrate that
activities assisted by a grant will take place in major metropolitan
areas.</text>

institutions of higher education or consortia of such institutions—</text>
<paragraph display-inline="no-display-inline" id="H4F4046BBA9844F458D95E8942D928959"><enum>(1)</enum><text>to support new or
expand existing activities and approaches in community engagement by
institutions of higher education;</text>
</paragraph><paragraph id="H5D7A65FFFEC94982A0C44F9572A9348B"><enum>(2)</enum><text>to encourage
greater participation by institutions of higher education in establishing
partnerships with their local communities;</text>
</paragraph><paragraph id="HC2412D456EB345A4BBCFD1A08DCD0B34"><enum>(3)</enum><text>to align teaching,
research, and service by institutions of higher education with the needs and
expectations of their local communities;</text>
</paragraph><paragraph id="HD969FD725B5940508D2A4150CE2E6F61"><enum>(4)</enum><text display-inline="yes-display-inline">to solve problems in local communities with
a high concentration of environmental problems through research, outreach, and
exchange of information; or</text>
</paragraph><paragraph id="HC845E093D2C94AD693AFB088884F68E3"><enum>(5)</enum><text>to improve the
quality of life and economic opportunity in such local communities.</text>
</paragraph></subsection><subsection id="H52442CB3C31B4AB3A80BC62D6AF745F3"><enum>(b)</enum><header>Grant
uses</header><text>Each institution of higher education or consortium of
institutions of higher education that receives a grant under this section shall
use such amounts—</text>
<paragraph id="H9C3AA63401024585B4E6794CF63D7077"><enum>(1)</enum><text>to establish and
maintain community outreach partnership centers (in this section referred to as
<quote>Centers</quote>) that address problems in local communities with a high
concentration of environmental problems, as determined by the Administrator,
through</text>
</paragraph><paragraph id="H96B18337A80B4487B0091EC903857A2C"><enum>(2)</enum><text display-inline="yes-display-inline">conducting research on theoretical or
practical problems in such local communities; or</text>
</paragraph><paragraph id="HBEAF27DFEC7048F59910D9DFEA5E2D21"><enum>(3)</enum><text>facilitating
partnerships and outreach activities between such institutions and local
community organizations, local businesses, and local governments to address
environmental problems in such local communities.</text>
</paragraph></subsection><subsection id="H00747840F0C04BE48B55C67DE8169D4F"><enum>(c)</enum><header>Environmental
problems</header><text>Research and outreach activities assisted under this Act
shall focus on environmental problems associated with air quality, carbon
emissions, clean water, toxins, pesticides, human health, ecosystems, land
protection and restoration, and other areas the Administrator determines are
appropriate.</text>
</subsection><subsection id="H039093BFB22B47E294D7C2F2F3C40C39"><enum>(d)</enum><header>Application</header><text>To
be eligible to receive a grant under this section, an institution of higher
education or a consortium of institutions of higher education shall prepare and
submit an application to the Administrator at such time, in such form, and
containing such information and assurances as the Administrator may
require.</text>
</subsection><subsection id="H164F1A533E5A4CE9B4A067DCA00D9993"><enum>(e)</enum><header>Selection
criteria</header>
<paragraph id="HC01314D8E60445BE9CF45890C602418C"><enum>(1)</enum><header>In
general</header><text>The Administrator shall select recipients of grants under
this section on the basis of the following criteria:</text>
<subparagraph id="H60759BEB839A4BBFBFFDB35A011484F2"><enum>(A)</enum><text>The demonstrated
research and outreach resources available to the applicant for carrying out the
purposes of this section.</text>

the applicant to provide leadership in solving local community problems and in
making national contributions to solving long-term and immediate environmental

commitment of the applicant to supporting environmental research and outreach
programs by providing matching contributions for any Federal assistance
received.</text>
</subparagraph><subparagraph id="H94A575E0AC6D43B9A94DE6E662AB0D89"><enum>(D)</enum><text>The demonstrated
ability of the applicant to disseminate results of research and successful
strategies developed through outreach activities to other Centers and
communities served by grants under this section.</text>
</subparagraph><subparagraph id="H00E2780C1105453EAA9705BBCB087AE7"><enum>(E)</enum><text>The projects and
activities that the applicant proposes to carry out under the grant.</text>
</subparagraph><subparagraph id="H89C6A888E4AD43B8A5AFA15C34EE27C8"><enum>(F)</enum><text>The extent to
which the projects and activities of the applicant will contribute to the goals
of its community partners in the region.</text>
</subparagraph><subparagraph id="H50CF4A36D3B541929A88C45AB065CB41"><enum>(G)</enum><text>The extent to
which the community partners will contribute to the educational and research
goals of the applicant.</text>
</subparagraph><subparagraph id="HC66FDEAC999D4AB5AC53447AC1B6313B"><enum>(H)</enum><text>The effectiveness
of the strategy of the applicant to provide environmental outreach activities
to communities.</text>
</subparagraph><subparagraph id="H0A6308B5DE7C4E9186CCB9F57C51A562"><enum>(I)</enum><text>The extent of need
in the communities to be served by the Centers.</text>
</subparagraph><subparagraph id="H3600A14047054252A3094322F4940A88"><enum>(J)</enum><text>The demonstrated
ability of the applicant to communicate, coordinate, and involve community
representatives and other key partners in the policy formulation and decision
making process.</text>
</subparagraph><subparagraph id="HB4DF79D1B2934F6B983D47C4E3B23C71"><enum>(K)</enum><text>The proposed time
line for the activities and projects of the applicant.</text>
</subparagraph><subparagraph id="HAB7C9695DE384228A248B5502B166896"><enum>(L)</enum><text display-inline="yes-display-inline">The demonstrated capability of the
applicant to evaluate the proposed activities and projects.</text>
</subparagraph><subparagraph id="HCD863E507514439EBF652AF23CF6B538"><enum>(M)</enum><text display-inline="yes-display-inline">The ability of the applicant to continue
funding the activities and projects after the expiration of a grant received
under this section.</text>
</subparagraph><subparagraph id="HE6B4562E6F5A40EAA111461F5DA9D129"><enum>(N)</enum><text>Other criteria
that the Administrator determines are appropriate.</text>
</subparagraph></paragraph><paragraph id="HA6C6C2EEECB0432AA199E77F2CFD0C83"><enum>(2)</enum><header>Priority</header><text>In
making grants under this section, the Administrator shall give priority to
applicants that—</text>
<subparagraph id="HBD743162FDCD47A2A6E86692BCD51725"><enum>(A)</enum><text display-inline="yes-display-inline">undertake research and outreach activities
that address environmental problems that are linked to or caused by the
emission of greenhouse gases, as determined by the Administrator;</text>
</subparagraph><subparagraph id="HE78B2E81D31B49A0AEC2D8FC6E2F955F"><enum>(B)</enum><text>undertake research
and outreach activities that are a key component of what students are learning
inside and outside of the classroom; and</text>
</subparagraph><subparagraph id="H0AF51AC8C4AE41F3A5428ED907738616"><enum>(C)</enum><text>demonstrate a
record of engagement with local communities, that have a high concentration of
environmental problems, in ways that build knowledge, teach students, and
generate programs that will address environmental problems.</text>
</subparagraph></paragraph></subsection><subsection id="HBB9D4A98AB08498D8CA12AA651A2A728"><enum>(f)</enum><header>Federal
share</header><text>The amount of a grant under this section may not exceed,
for the duration of the grant award—</text>
<paragraph id="H25BA73772DAC498EB8C2C169CB172A2A"><enum>(1)</enum><text display-inline="yes-display-inline">50 percent of the cost of establishing and
operating the research activities of a Center described in subsection (b)(2);
and</text>
</paragraph><paragraph id="H6D96B9CBC2E746F58947DDDDF37C0F1F"><enum>(2)</enum><text display-inline="yes-display-inline">75 percent of the cost of facilitating
partnerships and establishing and operating the outreach activities of a Center
described in subsection (b)(3).</text>
</paragraph></subsection><subsection id="H55487F7A55BC4F879B4944226023C355"><enum>(g)</enum><header>Non-Federal
share</header><text display-inline="yes-display-inline">The non-Federal share
of the cost of projects and activities funded under this section may include
cash, or the value of noncash contributions, equipment, or other in-kind
contributions that the Administrator determines are appropriate.</text>
</subsection><subsection id="HB0B2A13248324803A0C53008808AF54A"><enum>(h)</enum><header>Duration</header><text>The
term of a grant under this section may not exceed a period of 5 years.</text>
</subsection><subsection id="H24BA33A1072943A193ED251D1085E164"><enum>(i)</enum><header>Center
requirements</header><text>A Center established under this section
shall—</text>
<paragraph id="H7DAE2BA3BAC04D45A57EF35818149B70"><enum>(1)</enum><text>use the research
and outreach resources of the institution of higher education or consortium of
institutions of higher education that sponsors the Center to solve specific
environmental problems identified by local communities served by the
Center;</text>
</paragraph><paragraph commented="no" id="HF8989C0C429E4F37848576CFC3A64144"><enum>(2)</enum><text>establish and
coordinate outreach activities in local communities identified in the grant
application as the local communities to be served by the Center;</text>
</paragraph><paragraph id="H7069133572F24306B3A07D8E15E24AFF"><enum>(3)</enum><text>establish a
community advisory committee comprised of representatives of local institutions
and residents of each community to be served to assist in identifying local
needs of the local community and advise on the development and implementation
of strategies to address those needs;</text>
</paragraph><paragraph id="HF7A1491781EB4405859176FE6592719B"><enum>(4)</enum><text>facilitate public
service projects in the communities to be served by the Center;</text>
</paragraph><paragraph id="H20414188F3424192A719D1FA512AD501"><enum>(5)</enum><text>act as a
clearinghouse for the dissemination of information;</text>
</paragraph><paragraph id="H4E93C0A546CE40C5A74E016670FFB570"><enum>(6)</enum><text>develop
instructional programs, hold conferences, and provide training for local
community leaders, when appropriate; and</text>
</paragraph><paragraph id="H86D590CAD4C54DF2923A0CED5A490A63"><enum>(7)</enum><text>exchange
information with other Centers.</text>
</paragraph></subsection><subsection id="H1717A636DD05494DA66E46F9D847F042"><enum>(j)</enum><header>Reports</header>
<paragraph id="HC14377E99CD940F093F15B0E24951294"><enum>(1)</enum><header>Periodic
reports</header><text>Grant recipients shall submit annual progress reports to
the Administrator on the progress of activities and projects funded under this
section, beginning on the date that is one year after the grant money is
received by the grant recipient.</text>
</paragraph><paragraph id="HC48843DA9BC247DB91277CF1C8D24E51"><enum>(2)</enum><header>Final
report</header><text>Not later than 6 months after the grant expires a grant
recipient shall submit to the Administrator a final report that
describes—</text>
<subparagraph id="H5CFE277F30D24A5D96E5A0E249E39254"><enum>(A)</enum><text display-inline="yes-display-inline">the relationship between the institution of
higher education and the local community partners upon the expiration of a
grant under this section;</text>
</subparagraph><subparagraph id="H77A179E9B69D401EB1063FCD0DA2C68D"><enum>(B)</enum><text>the overall impact
of the grant on each local community served;</text>
</subparagraph><subparagraph id="H152918FBD0AE44CCBD31BC0785192FC0"><enum>(C)</enum><text>the overall impact
of the grant on the institution of higher education or consortium of
institutions of higher education;</text>
</subparagraph><subparagraph id="H292D38B91C8E444CA10CC6F8F6CBBCFC"><enum>(D)</enum><text>how the impact of
the grant matches the intended goals for the grant, including—</text>
<clause id="HBA8AB10EDFB441DCAD2AE84E4A2202F5"><enum>(i)</enum><text>how the
institution of higher education contributed to the goals of its community
partners; and</text>
</clause><clause id="H27A92659BCFB49EB9A7F5AFE0F911F52"><enum>(ii)</enum><text>how the community
partners contributed to the educational and research goals of the institution
of higher education; and</text>
</clause></subparagraph><subparagraph commented="no" id="H2643F20A67F3417BA9564EC4D840C9BD"><enum>(E)</enum><text>how and to what
extent the institution of higher education was able to expand and sustain
engagement activities throughout the institution as a result of a grant.</text>
</subparagraph></paragraph></subsection><subsection id="HC52FCDB8BD614F1A83B7E1B972022292"><enum>(k)</enum><header>Institution of
higher education defined</header><text display-inline="yes-display-inline">In
this section, the term <quote>institution of higher education</quote> has the
meaning given that term in section 101 of the Higher Education Act of 1965 (20
U.S.C.
1001).</text>

general</header><text>The Secretary shall establish and carry out an urban
pilot partnership program between high-need urban local educational agencies
and urban universities to improve teacher effectiveness in urban schools. The
program shall support the development and implementation of model programs and
shall facilitate the dissemination of best practices to high-need urban local
educational agencies and urban universities throughout the United
States.</text>
</paragraph><paragraph commented="no" id="HB78FC895F86C4014BF54D4E7BDD8AE0F"><enum>(2)</enum><header>Grants</header><text>The
Secretary shall carry out paragraph (1) by making grants to eligible
partnerships to develop and implement innovative partnerships to improve
teacher effectiveness in urban schools, including activities such as—</text>
<subparagraph commented="no" id="H82F07AC2B0A940DCBCE5CDC539B51584"><enum>(A)</enum><text>designing and
implementing distinctively urban teacher preparation programs that provide
pedagogical training and clinical experience specifically designed for teachers
to be effective in urban schools and communities;</text>
</subparagraph><subparagraph commented="no" id="HCFAB5AF50406461381177DCF0F0C266B"><enum>(B)</enum><text>establishing
transition programs for new urban teachers, such as residency programs,
induction programs, and peer mentors;</text>
</subparagraph><subparagraph commented="no" id="HE1310234722A496F90FC5C58B4DBCB3C"><enum>(C)</enum><text>creating
opportunities for ongoing professional development that focuses on pedagogical
skills to enhance teaching in urban environments;</text>
</subparagraph><subparagraph commented="no" id="HC63E7E4F99AE4467ABD3B1C2AAEBB298"><enum>(D)</enum><text>conducting
scientifically based research and employing empirically based practice to
update curriculum taught in pre-service and in-service courses for urban
teachers;</text>
</subparagraph><subparagraph commented="no" id="HD26A5F63A0BB4B1D9FDDA04055C68ADC"><enum>(E)</enum><text>creating financial
incentives to recruit and retain highly qualified teachers in urban schools,
including tuition scholarships, stipends, loan forgiveness, and differential
and bonus pay; and</text>
</subparagraph><subparagraph commented="no" id="HA60CA783DA454861AEB9811D50B2DB46"><enum>(F)</enum><text>establishing local
data systems that enable both local educational agencies and the universities
to track teacher mobility and attrition.</text>
</subparagraph></paragraph><paragraph commented="no" id="H6B5437B548024E4DB94DFC4E7A69FF32"><enum>(3)</enum><header>Eligible
partnership</header><text>In this subsection, the term <quote>eligible
partnership</quote>—</text>
<subparagraph commented="no" id="H23CE43CFE9FD43BBB9FD93A29ECA3720"><enum>(A)</enum><text>shall
include—</text>
<clause commented="no" id="H8D03D5A98ED84E168B202C3F49B1D247"><enum>(i)</enum><text>a high-need urban
local educational; and</text>
</clause><clause commented="no" id="H241CBF0AB40140A79BF7C126DD5D6CAA"><enum>(ii)</enum><text>an urban
university; and</text>
</clause></subparagraph><subparagraph commented="no" id="H0AED7688859D43CBB67772916AC39652"><enum>(B)</enum><text>may also include
one or more nonprofit or community-based organizations or businesses.</text>
</subparagraph></paragraph><paragraph commented="no" id="H128C7564F60E447E994AEB80D3F85E0D"><enum>(4)</enum><header>Report</header>
<subparagraph commented="no" id="HF032D4F576B846DE894AD54B0C42F81A"><enum>(A)</enum><text>The Secretary
shall require grant recipients to submit a report to the Secretary on the
partnership’s ability to—</text>
<clause commented="no" id="H526895717DD84D47AD55753E8788090B"><enum>(i)</enum><text>increase the
number of highly qualified teachers placed in schools located in the high-need
urban local educational agency;</text>
</clause><clause commented="no" id="H90A84569213A4EE691F43121B4EC9209"><enum>(ii)</enum><text>increase the
retention rate of teachers in the high-need urban local educational
agency;</text>
</clause><clause commented="no" id="H6E46CA1AB3684BBFB7F2B9F187223AAD"><enum>(iii)</enum><text display-inline="yes-display-inline">improve student achievement on State
academic; and</text>
</clause><clause commented="no" id="H5C73867157564B04BA6A076E2C9243F1"><enum>(iv)</enum><text>increase college
enrollment rates.</text>
</clause></subparagraph><subparagraph commented="no" id="HBB641585D7824C4C899B44A7401F5A9C"><enum>(B)</enum><text>The Secretary
shall evaluate the effectiveness of activities carried out under the grant
program and identify model programs, best practices, and materials developed by
grantees. A report documenting the results of that evaluation shall be
submitted to the Committee on Education and Labor of the House of
Representatives and the Committee on Health, Education, Labor, and Pensions of
the Senate not later than 5 years after the date of enactment of this Act. The
report shall also be widely disseminated to high-need urban local educational
agencies and urban universities throughout the United States.</text>
</subparagraph></paragraph><paragraph commented="no" id="HF9F66AF189DC4859BB2F7ED1F7DA088F"><enum>(5)</enum><header>Definitions</header><text>In
this subsection:</text>
<subparagraph commented="no" id="HC17E9BCDE8744FFB99A0BD32BD0BFBAE"><enum>(A)</enum><header>Urban
area</header><text>The term <quote>urban area</quote> means a metropolitan
statistical area having a population of not less than 450,000.</text>
</subparagraph><subparagraph commented="no" id="H1A418C1D24B8456CB9695C129437EAA2"><enum>(B)</enum><header>Urban
university</header><text>The term <quote>urban university</quote> means an
institution of higher education that—</text>
<clause commented="no" id="H3E33AEE9F0D84F8BAF3D5BE26AB7417F"><enum>(i)</enum><text>has the meaning
given the term <quote>institution of higher education</quote> in section 101 of
the Higher Education Act of 1965 (20 U.S.C. 1001);</text>
</clause><clause commented="no" id="H7179FF79D16C4AA2B3555FA4F173EFB0"><enum>(ii)</enum><text>is located in an
urban area;</text>
</clause><clause commented="no" id="H1A46E150387749BF82B8623485B3C2F1"><enum>(iii)</enum><text>has a school of
education;</text>
</clause><clause commented="no" id="H9401A753CEAC462EBD1339CFE7CD611E"><enum>(iv)</enum><text>has the capacity
to conduct applicable research, as demonstrated by enrolling, either
individually or jointly with another institution of higher education, at least
10 doctoral students per academic year;</text>
</clause><clause commented="no" id="H139546A7E2D2441EB9252A55C0708436"><enum>(v)</enum><text>draws a
substantial portion of its students from the urban area in which such
institution is located; and</text>
</clause><clause commented="no" id="H91579714284F433B8F77FB67DA44706B"><enum>(vi)</enum><text>has demonstrated
and sustained a sense of responsibility to such urban area and the people of
such area.</text>
</clause></subparagraph><subparagraph id="H754CACCB9EE5495FB1A058FA2AF428C1"><enum>(C)</enum><header>High-need urban
local educational agency</header><text>The term <quote>high-need urban local
educational agency</quote> means a local educational agency—</text>
<clause id="HBA9974BB7E2E46988F301CF4A0D43D88"><enum>(i)</enum><text>in
which—</text>
<subclause id="H560ED4E0C0E4487CB573C80E57ADF47C"><enum>(I)</enum><text>not fewer than
10,000 children served by the agency are from families with incomes below the
poverty line; or</text>
</subclause><subclause id="HB545AAE1C2A3433A92CDF8C334881726"><enum>(II)</enum><text>not less than 20
percent of the children served by the agency are from families with incomes
below the poverty line; and</text>
</subclause></clause><clause id="HDA84BA9B21B04A6A83508468000C0C83"><enum>(ii)</enum><text>for which there
is a high percentage—</text>
<subclause id="HDF996A45C12E49D99AB7853333D65C13"><enum>(I)</enum><text>of teachers not
teaching in the academic subjects or grade levels that the teachers were
trained to teach; or</text>
</subclause><subclause id="H5C8D434E8CE047ADBA75A0A0C9B13EDD"><enum>(II)</enum><text>of teachers with
emergency, provisional, or temporary certification or licensing; and</text>
</subclause></clause><clause id="HF98FFD6D2A7741E3A23B7BE4DC6FB3D9"><enum>(iii)</enum><text>that is located
in an urban area.</text>
</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HAA5BC24F8DC345A6989F1B963B93C5A5"><enum>(h)</enum><header>National
clearinghouse for urban teaching</header>
<paragraph commented="no" id="HD01BE7222CC64082B998124D31860C23"><enum>(1)</enum><header>In
general</header><text>The Secretary shall contract with a not-for-profit
organization to establish a clearinghouse to identify and disseminate
strategies to improve teacher effectiveness in high-need urban local
educational agencies.</text>
</paragraph><paragraph commented="no" id="HF72AC9D2DDBB4D1DBE3C67653220EE20"><enum>(2)</enum><header>Activities</header><text>The
not-for-profit organization shall—</text>
<subparagraph commented="no" id="H4FEBB1D155B94493BD037FD97DC102E0"><enum>(A)</enum><text>examine and
synthesize scientific evidence pertaining to teaching in an urban
setting;</text>
</subparagraph><subparagraph commented="no" id="HC59F9DAD0D54435AB32CAA8A19D15DB1"><enum>(B)</enum><text>identify promising
practices in the effective teaching and learning of students in high-need urban
local educational agencies;</text>
</subparagraph><subparagraph commented="no" id="H5D102E8A497D4D61B6EABA4113CB8CED"><enum>(C)</enum><text>identify promising
training and professional development techniques designed to prepare, assist,
and retain teachers placed in high-need urban schools; and</text>
</subparagraph><subparagraph commented="no" id="HF0E32375A1D04825ACA19128852AAB04"><enum>(D)</enum><text>ascertain areas in
which existing data about promising practices is insufficient.</text>
</subparagraph></paragraph><paragraph commented="no" id="H0CD12227757E408DB549FC7C2BD1924E"><enum>(3)</enum><header>Dissemination</header><text>The
not-for-profit organization shall work in collaboration with the Secretary to
publicly disseminate and share its findings though such avenues as a website,
national and regional publications, and national and regional summits.</text>
</paragraph><paragraph commented="no" id="H79013E1835604EE9B2D76946966E7DF9"><enum>(4)</enum><header>Reporting</header><text>The
not-for-profit organization shall produce an annual report for the Secretary to
help inform the grant making process for subsection
(g).</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph><paragraph commented="no" id="H69FB928C209A440D8114075A15DCD240"><enum>(5)</enum><header>Mathematics and
science partnerships</header><text>Section 2201(b)(1)(B)(i) of such Act (20
U.S.C. 6661(b)(1)(B)(i)) is amended to read as follows:</text>

the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7201 et seq.) is
amended by adding at the end the following:</text>

alignment programs</header>
<subsection commented="no" id="HDBE3E729B5FB4CB392626CD706901AB1"><enum>(a)</enum><header>Purpose</header><text>It
is the purpose of this section—</text>
<paragraph commented="no" id="H6FDD287AF7294CBC8B1C9C893287CB57"><enum>(1)</enum><text>to promote more
accountability with respect to preparation for higher education, the 21st
century workforce, and the Armed Forces, by aligning—</text>
<subparagraph commented="no" id="H369E1D53CBD149CA9CE2EEC9FFB2F013"><enum>(A)</enum><text>student knowledge,
student skills, State academic content standards and assessments, and
curricula, in elementary and secondary education, especially with respect to
mathematics, science, reading, and, where applicable, engineering and
technology; with</text>
</subparagraph><subparagraph commented="no" id="H3A040A9EA3D846E6861C638BED12F7B9"><enum>(B)</enum><text>the demands of
higher education, the 21st century workforce, and the Armed Forces;</text>
</subparagraph></paragraph><paragraph commented="no" id="HBCCDF246E74749AE9FA019E9316A11D8"><enum>(2)</enum><text>to support the
establishment or improvement of statewide P-16 education data systems
that—</text>
<subparagraph commented="no" id="HB7B95292D8294316BEFD1A0E05394CDA"><enum>(A)</enum><text>assist States in
improving the rigor and quality of State academic content standards and
assessments;</text>
</subparagraph><subparagraph commented="no" id="HBE2CC5C82F65417BB793436EE14BFF5D"><enum>(B)</enum><text>ensure students
are prepared to succeed in—</text>
<clause commented="no" id="H1FD6D3E9652E43C59302E4DDB039B182"><enum>(i)</enum><text>academic
credit-bearing coursework in higher education without the need for
remediation;</text>
</clause><clause commented="no" id="HD17CC7DFE11348C0BD49D7FFD0B4BCD0"><enum>(ii)</enum><text>the 21st century
workforce; or</text>
</clause><clause commented="no" id="HA9BBC28C20FE47568F9856C4B4905F45"><enum>(iii)</enum><text>the Armed
Forces; and</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H50C6F8FBFBF74AC6AE81CB64E136095A"><enum>(3)</enum><text>enable States to
have valid and reliable information to inform education policy and
practice.</text>
</paragraph></subsection><subsection commented="no" id="HF2952640A3CE4E969B089BAF58BDEEC0"><enum>(b)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph commented="no" id="H2CC3D8468E764F99AD8CB529BC95BDC4"><enum>(1)</enum><header>P-16
education</header><text>The term <quote>P-16 education</quote> means the
educational system from preschool through the conferring of a baccalaureate
degree.</text>
</paragraph><paragraph commented="no" id="H255490D4ECFE4876961E000FA633442F"><enum>(2)</enum><header>Statewide
partnership</header><text>The term <quote>statewide partnership</quote> means a
partnership that—</text>
<subparagraph commented="no" id="HB7F83CCD850243F79EB3A0DF430F2B5D"><enum>(A)</enum><text>shall
include—</text>
<clause commented="no" id="HA1B67C340F184C2CAAD7631ED07DFCB3"><enum>(i)</enum><text>the Governor of
the State or the designee of the Governor;</text>
</clause><clause commented="no" id="HFB1802EFBD0E447FB081FED6BEA2DFB2"><enum>(ii)</enum><text>the heads of the
State systems for public higher education, or, if such a position does not
exist, not less than 1 representative of a public degree-granting institution
of higher education;</text>
</clause><clause commented="no" id="H6697EA48017249D58E96C8DD6A142ADF"><enum>(iii)</enum><text>a representative
of the agencies in the State that administer Federal or State-funded early
childhood education programs;</text>
</clause><clause commented="no" id="HED6808B9FB994773B0B78EE1D8B73D8D"><enum>(iv)</enum><text>not less than 1
representative of a public community college;</text>
</clause><clause commented="no" id="H0F97A8A447844DC3B934E6A9FDE84311"><enum>(v)</enum><text>not less than 1
representative of a technical school;</text>
</clause><clause commented="no" id="HDAFEF371882A46938691E2499B027BA0"><enum>(vi)</enum><text>not less than 1
representative of a public secondary school;</text>
</clause><clause commented="no" id="HFAB5BD8AE9E04BC980BF802436EAEAFC"><enum>(vii)</enum><text>the chief State
school officer;</text>
</clause><clause commented="no" id="HD72480493AC341178E88A7D48CE7EFB6"><enum>(viii)</enum><text>the chief
executive officer of the State higher education coordinating board;</text>
</clause><clause commented="no" id="H5C6FEA9662E8424FB0F7D2445F1B8C14"><enum>(ix)</enum><text>not less than 1
public elementary school teacher employed in the State;</text>
</clause><clause commented="no" id="HC81D264D6C8245DCA8374D07F5FD23C1"><enum>(x)</enum><text>not less than 1
early childhood educator in the State;</text>
</clause><clause commented="no" id="H0FC3227CF906425EA7EF7B51E4055B09"><enum>(xi)</enum><text>not less than 1
public secondary school teacher employed in the State;</text>
</clause><clause commented="no" id="H9F0D7C14650449159FB155543D5796E5"><enum>(xii)</enum><text>not less than 1
representative of the business community in the State; and</text>
</clause><clause commented="no" id="H5F049617B6BE49359B1990AAEF5B9650"><enum>(xiii)</enum><text>not less than 1
member of the Armed Forces; and</text>
</clause></subparagraph><subparagraph commented="no" id="HDFCFC80AF0F443F3B879B67678781872"><enum>(B)</enum><text>may include other
individuals or representatives of other organizations, such as a school
administrator, a faculty member at an institution of higher education, a member
of a civic or community organization, a representative from a private
institution of higher education, a dean or similar representative of a school
of education at an institution of higher education or a similar teacher
certification or licensure program, or the State official responsible for
economic development.</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="H2FFD63096B96456CA4A87A2510075272"><enum>(c)</enum><header>Grants
authorized</header><text>The Secretary is authorized to award grants, on a
competitive basis, to States to enable each such State to work with a statewide
partnership—</text>
<paragraph commented="no" id="H75A56B1F96C94915A7D9099D81697FF3"><enum>(1)</enum><text>to promote better
alignment of content knowledge requirements for secondary school graduation
with the knowledge and skills needed to succeed in postsecondary education, the
21st century workforce, or the Armed Forces; or</text>
</paragraph><paragraph commented="no" id="H7CD604F596C74899A9F73AD366078216"><enum>(2)</enum><text>to establish or
improve a statewide P-16 education data system.</text>
</paragraph></subsection><subsection commented="no" id="H3BABAF3056FE479BA7A784607586971F"><enum>(d)</enum><header>Period of
grants; non-Renewability</header>
<paragraph commented="no" id="H4344CDEB491A4EF6B711BE923C787F17"><enum>(1)</enum><header>Grant
period</header><text>The Secretary shall award a grant under this section for a
period of not more than 3 years.</text>
</paragraph><paragraph commented="no" id="H3A57B366EBDA45CA82BDC769D02E7770"><enum>(2)</enum><header>Non-renewability</header><text>The
Secretary shall not award a State more than 1 grant under this section.</text>
</paragraph></subsection><subsection commented="no" id="H67AE094D6EDB48F5A52B89445E964949"><enum>(e)</enum><header>Authorized
activities</header>
<paragraph commented="no" id="H61DB24F2808B4AA2A890A566ADB9C402"><enum>(1)</enum><header>Grants for p-16
alignment</header><text>Each State receiving a grant under subsection
(c)(1)—</text>
<subparagraph commented="no" id="HC5C6C7F72A194A5A9F5A14469DED5A34"><enum>(A)</enum><text>shall use the
grant funds for—</text>
<clause commented="no" id="H636246B920E544B3AA9482CE652D87CB"><enum>(i)</enum><text>identifying and
describing the content knowledge and skills students who enter institutions of
higher education, the workforce, and the Armed Forces need to have in order to
succeed without any remediation based on detailed requirements obtained from
institutions of higher education, employers, and the Armed Forces;</text>
</clause><clause commented="no" id="HAD542438F2DF4F2994E41FA992DD5557"><enum>(ii)</enum><text>identifying and
making changes that need to be made to a State’s secondary school graduation
requirements, academic content standards, academic achievement standards, and
assessments preceding graduation from secondary school in order to align the
requirements, standards, and assessments with the knowledge and skills
necessary for success in academic credit-bearing coursework in postsecondary
education, in the 21st century workforce, and in the Armed Forces without the
need for remediation;</text>
</clause><clause commented="no" id="HBF0027E85377472F91408A3F6BA3E751"><enum>(iii)</enum><text>convening
stakeholders within the State and creating a forum for identifying and
deliberating on education issues that—</text>
<subclause commented="no" id="HF79B40829BC24DC1BD62913DBD1E31FA"><enum>(I)</enum><text>involve preschool
through grade 12 education, postsecondary education, the 21st century
workforce, and the Armed Forces; and</text>
</subclause><subclause commented="no" id="HB5CF7FD5ED9341D78D301BD0DF299677"><enum>(II)</enum><text>transcend any
single system of education’s ability to address; and</text>
</subclause></clause><clause commented="no" id="H498DF2CA5ED745F5B7AA66AADF429888"><enum>(iv)</enum><text>implementing
activities designed to ensure the enrollment of all elementary school and
secondary school students in rigorous coursework, which may include—</text>
<subclause commented="no" id="HDA90B3842D2844208739756728CD25C4"><enum>(I)</enum><text>specifying the
courses and performance levels necessary for acceptance into institutions of
higher education; and</text>
</subclause><subclause commented="no" id="HE77FC51ADF5746EA9AC56DE080C33C9D"><enum>(II)</enum><text>developing or
providing guidance to local educational agencies within the State on the
adoption of curricula and assessments aligned with State academic content
standards, which assessments may be used as measures of student academic
achievement in secondary school as well as for entrance or placement at
institutions of higher education, including through collaboration with
institutions of higher education in, or State educational agencies serving,
other States; and</text>
</subclause></clause></subparagraph><subparagraph commented="no" id="HE85D20AF745D42B396F63A24002F5970"><enum>(B)</enum><text>may use the grant
funds for—</text>
<clause commented="no" id="H7F6A22CBD79947269D4E5A963B3FBD94"><enum>(i)</enum><text>developing and
making available specific opportunities for extensive professional development
for teachers, paraprofessionals, principals, and school administrators,
including collection and dissemination of effective teaching practices to
improve instruction and instructional support mechanisms;</text>
</clause><clause commented="no" id="H389ABEB7CD2441AEA874C9F60703E479"><enum>(ii)</enum><text>identifying
changes in State academic content standards, academic achievement standards,
and assessments for students in grades preceding secondary school in order to
ensure such standards and assessments are appropriately aligned and adequately
reflect the content needed to prepare students to enter secondary
school;</text>
</clause><clause commented="no" id="H50AB4677A27B42EFBE69EE966B2374BC"><enum>(iii)</enum><text>developing a
plan to provide remediation and additional learning opportunities for students
who are performing below grade level to ensure that all students will have the
opportunity to meet secondary school graduation requirements;</text>
</clause><clause commented="no" id="HBB980B2996854E5EB67C366465D06D49"><enum>(iv)</enum><text>identifying and
addressing teacher certification needs; or</text>
</clause><clause commented="no" id="H864BBFC1176248F6A5302CCE9EA99F56"><enum>(v)</enum><text>incorporating 21st
century learning skills into the State plan, which skills shall include
critical thinking, problem solving, communication, collaboration, global
awareness, and business and financial literacy.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H3FA17E83BC454B92AFF9C1F7FB0C30AE"><enum>(2)</enum><header>Grants for
statewide p-16 education data systems</header>
<subparagraph commented="no" id="H79EE01D0D7D24DB79DFC29322536B13E"><enum>(A)</enum><header>Establishment of
system</header><text>Each State that receives a grant under subsection (c)(2)
shall establish a statewide P-16 education longitudinal data system
that—</text>
<clause commented="no" id="H64F2477DEE8A4FE391E3948C410FA96D"><enum>(i)</enum><text>provides each
student, upon enrollment in a public elementary school or secondary school in
the State, with a unique identifier, such as a bar code, that—</text>
<subclause commented="no" id="H87622F3A17074F45AAF1383A57700955"><enum>(I)</enum><text>does not permit a
student to be individually identified by users of the system; and</text>
</subclause><subclause commented="no" id="H8E41B286C6F34097A63E71C279F46CFD"><enum>(II)</enum><text>is retained
throughout the student’s enrollment in P-16 education in the State; and</text>
</subclause></clause><clause commented="no" id="H64AB95DAEF334C0FA90162D3F9DF9B16"><enum>(ii)</enum><text>meets the
requirements of subparagraphs (B) through (E).</text>
</clause></subparagraph><subparagraph commented="no" id="H1FCD6D3995A646BCBD4B4C8DD870131F"><enum>(B)</enum><header>Improvement of
existing system</header><text>Each State that receives a grant under subsection
(c)(2) may employ, coordinate, or revise an existing statewide data system to
establish a statewide longitudinal P-16 education data system that meets the
requirements of such subparagraph, if the statewide longitudinal P-16 education
data system produces valid and reliable data.</text>
</subparagraph><subparagraph commented="no" id="HA65B40544725475788140883E9E9CC1F"><enum>(C)</enum><header>Privacy and
access to data</header>
<clause commented="no" id="H694E793F8B9F44098CB785B9CA7A7F9B"><enum>(i)</enum><header>In
general</header><text display-inline="yes-display-inline">Each State that
receives a grant under subsection (c)(2) shall implement measures to—</text>
<subclause commented="no" id="HD067F71F869043259D615D9C073A574D"><enum>(I)</enum><text>ensure that the
statewide P-16 education data system meets the requirements of section 444 of
the General Education Provisions Act (20 U.S.C. 1232g) (commonly known as the
Family Educational Rights and Privacy Act of 1974);</text>
</subclause><subclause commented="no" id="HA35DD243FDCC4E819FE650D708358688"><enum>(II)</enum><text>limit the use of
information in the statewide P-16 education data system by institutions of
higher education and State or local educational agencies or institutions to the
activities set forth in paragraph (1) or State law regarding education,
consistent with the purposes of this subtitle;</text>
</subclause><subclause commented="no" id="H48E979C075BC431886D390C97D9D39C9"><enum>(III)</enum><text>prohibit the
disclosure of personally identifiable information except as permitted under
section 444 of the General Education Provisions Act and any additional
limitations set forth in State law;</text>
</subclause><subclause commented="no" id="HCB2959660F204AB8A1F7C9C4AC1EB705"><enum>(IV)</enum><text>keep an accurate
accounting of the date, nature, and purpose of each disclosure of personally
identifiable information in the statewide P-16 education data system, a
description of the information disclosed, and the name and address of the
person, agency, institution, or entity to whom the disclosure is made, which
accounting shall be made available on request to parents of any student whose
information has been disclosed;</text>
</subclause><subclause commented="no" id="HBE0D4580B34444EF9ED0D03B8B37F6B6"><enum>(V)</enum><text>notwithstanding
section 444 of the General Education Provisions Act, require any
non-governmental party obtaining personally identifiable information to sign a
data use agreement prior to disclosure that—</text>
<item commented="no" id="H463C81368E97477A89369891697981D1"><enum>(aa)</enum><text>prohibits the
party from further disclosing the information;</text>
</item><item commented="no" id="HEADF94F4E00F41A69491E4369B02A4A0"><enum>(bb)</enum><text>prohibits the
party from using the information for any purpose other than the purpose
specified in the agreement; and</text>
</item><item commented="no" id="H07AB4032AF9549D48BE2FE9AF374DA50"><enum>(cc)</enum><text>requires the
party to destroy the information when the purpose for which the disclosure was
made is accomplished;</text>
</item></subclause><subclause commented="no" id="H925D7F02CA374AC995FDB828E95C3715"><enum>(VI)</enum><text>maintain adequate
security measures to ensure the confidentiality and integrity of the statewide
P-16 education data system, such as protecting a student record from
identification by a unique identifier;</text>
</subclause><subclause commented="no" id="H9A577B2EE2924AF9AE98F7896019AE3F"><enum>(VII)</enum><text>where rights are
provided to parents under this clause, provide those rights to the student
instead of the parent if the student has reached the age of 18 or is enrolled
in a postsecondary educational institution; and</text>
</subclause><subclause commented="no" id="HE61A15C711FC46958C1215A8CB506F89"><enum>(VIII)</enum><text>ensure adequate
enforcement of the requirements of this clause.</text>
</subclause></clause><clause commented="no" id="HE2E17D6425774B2C89FC50CD79117FFB"><enum>(ii)</enum><header>Use of unique
identifiers</header>
<subclause commented="no" id="H939DE87819394EF9960DC074E2397A06"><enum>(I)</enum><header>Governmental use
of unique identifiers</header><text>It shall be unlawful for any Federal,
State, or local governmental agency to use the unique identifiers employed in
the statewide P-16 education data systems for any purpose other than as
authorized by Federal or State law regarding education, or to deny any
individual any right, benefit, or privilege provided by law because of such
individual’s refusal to disclose the individual’s unique identifier.</text>
</subclause><subclause commented="no" id="H3E151C6A2F5A4785BCD8C70E7C3D9FD4"><enum>(II)</enum><header>Regulations</header><text>Not
later than 180 days after the date of enactment of this section, the Secretary
shall promulgate regulations governing the use by governmental and
non-governmental entities of the unique identifiers employed in statewide P-16
education data systems, including, where necessary, regulations requiring
States desiring grants for statewide P-16 education data systems under this
section to implement specified measures, with the goal of safeguarding
individual privacy to the maximum extent practicable consistent with the uses
of the information authorized in this Act or other Federal or State law
regarding education.</text>
</subclause></clause></subparagraph><subparagraph commented="no" id="H3A2CE40E4B414C6FA6EF04DA6BF5340D"><enum>(D)</enum><header>Required
elements of a statewide p-16 education data system</header><text>The State
shall ensure that the statewide P-16 education data system includes the
following elements:</text>
<clause commented="no" id="H2C1A4D7C24C14EA6B8C320D9CB48EDC3"><enum>(i)</enum><header>Preschool
through grade 12 education and postsecondary education</header><text>With
respect to preschool through grade 12 education and postsecondary
education—</text>
<subclause commented="no" id="HA3568B0DCB1D480BAB9CF4A9735EDA9F"><enum>(I)</enum><text>a unique statewide
student identifier that does not permit a student to be individually identified
by users of the system;</text>
</subclause><subclause commented="no" id="HE725ABEA18D045FF8F8DD9E7490E9E10"><enum>(II)</enum><text>student-level
enrollment, demographic, and program participation information;</text>
</subclause><subclause commented="no" id="H745141E9722E408C9AB63339CB027CA3"><enum>(III)</enum><text>student-level
information about the points at which students exit, transfer in, transfer out,
drop out, or complete P-16 education programs;</text>
</subclause><subclause commented="no" id="HA7534A44178D43739EBCA9431729C8DD"><enum>(IV)</enum><text>the capacity to
communicate with higher education data systems; and</text>
</subclause><subclause commented="no" id="H684D064A9A9F4AED9EE01D5127F82776"><enum>(V)</enum><text>a State data audit
system assessing data quality, validity, and reliability.</text>
</subclause></clause><clause commented="no" id="H10BE881A7E1B4DD29755977A3DA10291"><enum>(ii)</enum><header>Preschool
through grade 12 education</header><text>With respect to preschool through
grade 12 education—</text>
<subclause commented="no" id="H5B265177F1E44545A8EC26FB1422756B"><enum>(I)</enum><text>yearly test
records of individual students with respect to assessments under section
1111(b);</text>
</subclause><subclause commented="no" id="HBFE57A994E6A48E991AB2A625B7C1420"><enum>(II)</enum><text>information on
students not tested by grade and subject;</text>
</subclause><subclause commented="no" id="HF0F2CFBE4D2C4FBBB984C910B544B2F9"><enum>(III)</enum><text>a teacher
identifier system with the ability to match teachers to students;</text>
</subclause><subclause commented="no" id="H222256B9DE1743149A89136641856C5A"><enum>(IV)</enum><text>student-level
transcript information, including information on courses completed and grades
earned; and</text>
</subclause><subclause commented="no" id="H049DB0E0214F4209B331FDC4F2024B20"><enum>(V)</enum><text>student-level
college readiness test scores.</text>
</subclause></clause><clause commented="no" id="HB04A6C864E1B4850A4C0F0699B6304CB"><enum>(iii)</enum><header>Postsecondary
education</header><text>With respect to postsecondary education, data that
provide—</text>
<subclause commented="no" id="HF9ADB3A719554A1F8A3BC0E96315B17F"><enum>(I)</enum><text>information
regarding the extent to which students transition successfully from secondary
school to postsecondary education, including whether students enroll in
remedial coursework; and</text>
</subclause><subclause commented="no" id="HA52706B677AA46DC9E566C7E029DE97E"><enum>(II)</enum><text>other information
determined necessary to address alignment and adequate preparation for success
in postsecondary education.</text>
</subclause></clause></subparagraph><subparagraph commented="no" id="H60AAEACDBF9440E8A734E39B00CDAFB8"><enum>(E)</enum><header>Functions of the
statewide p-16 education data system</header><text>In implementing the
statewide P-16 education data system, the State shall—</text>
<clause commented="no" id="HE3B511072FE24881AAACEB09586BCD67"><enum>(i)</enum><text>identify factors
that correlate to students’ ability to successfully engage in and complete
postsecondary-level general education coursework without the need for prior
developmental coursework;</text>
</clause><clause commented="no" id="HEC8836370C8D43B38AD40C27F926B4C1"><enum>(ii)</enum><text>identify factors
to increase the percentage of low-income and minority students who are
academically prepared to enter and successfully complete postsecondary-level
general education coursework; and</text>
</clause><clause commented="no" id="H26228E3A1F4F49599570DF26CF9B0C3B"><enum>(iii)</enum><text>use the data in
the system to otherwise inform education policy and practice in order to better
align State academic content standards, and curricula, with the demands of
postsecondary education, the 21st century workforce, and the Armed
Forces.</text>
</clause></subparagraph></paragraph></subsection><subsection commented="no" id="H809F9B552B3F4B9F8397511D81B00D47"><enum>(f)</enum><header>Application</header>
<paragraph commented="no" id="HC64933CA14364F9A898849E4478F2152"><enum>(1)</enum><header>In
general</header><text>Each State desiring a grant under this section shall
submit an application to the Secretary at such time, in such manner, and
containing such information as the Secretary may reasonably require.</text>
</paragraph><paragraph commented="no" id="H720E6457EA8F483D87300553628C739F"><enum>(2)</enum><header>Application
contents</header><text>Each application submitted under this section shall
specify whether the State application is for the conduct of P-16 education
alignment activities, or the establishment or improvement of a statewide P-16
education data system. The application shall include, at a minimum, the
following:</text>
<subparagraph commented="no" id="HAE46210D20314A3CB50F5D76C20FCD40"><enum>(A)</enum><text>A description of
the activities and programs to be carried out with the grant funds and a
comprehensive plan for carrying out the activities.</text>
</subparagraph><subparagraph commented="no" id="HCBA9A6E0D19049F1AF9F28DD28965AF9"><enum>(B)</enum><text>A description of
how the concerns and interests of the larger education community, including
parents, students, teachers, teacher educators, principals, and preschool
administrators will be represented in carrying out the authorized activities
described in subsection (e).</text>
</subparagraph><subparagraph commented="no" id="H847FA539A2044FF4B667009A5DCED0DA"><enum>(C)</enum><text>In the case of a
State applying for funding for P-16 education alignment, a description of how
the State will provide assistance to local educational agencies in implementing
rigorous State academic content standards, substantive curricula, remediation,
and acceleration opportunities for students, as well as other changes
determined necessary by the State.</text>
</subparagraph><subparagraph commented="no" id="H101EFEA49F454E6ABEF9E2EF6E24B4CC"><enum>(D)</enum><text>In the case of a
State applying for funding to establish or improve a statewide P-16 education
data system—</text>
<clause commented="no" id="HE6F3170BDD984E5CB8D471461E6CEB87"><enum>(i)</enum><text>a description of
the privacy protection and enforcement measures that the State has implemented
or will implement pursuant to subsection (e)(2)(C), and assurances that these
measures will be in place prior to the establishment or improvement of the
statewide P-16 education data system; and</text>
</clause><clause commented="no" id="H1AA0BFEE20994E42ADE58592B1D6E038"><enum>(ii)</enum><text>an assurance that
the State will continue to fund the statewide P-16 education data system after
the end of the grant period.</text>
</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HC82B60BCDA2A48258D2A222D4BB26E8C"><enum>(g)</enum><header>Supplement not
supplant</header><text>Grant funds provided under this section shall be used to
supplement, not supplant, other Federal, State, and local funds available to
carry out the authorized activities described in subsection (e).</text>
</subsection><subsection commented="no" id="H2AA13A31BA384FEDA58A911B286F1CF2"><enum>(h)</enum><header>Reservation of
funds for local alignment programs</header><text>Each State receiving a grant
under this section shall reserve not less than 25 percent of its funds to award
subgrants to eligible partnerships under section 5622.</text>
</subsection><subsection commented="no" id="HCA16F6BD14E64752AB2E2AC40BA37D33"><enum>(i)</enum><header>Matching
requirement</header><text>Each State that receives a grant under this section
shall provide, from non-Federal sources, an amount equal to 100 percent of the
amount of the grant, in cash or in kind, to carry out the activities supported
by the grant.</text>
</subsection><subsection commented="no" id="H64925B5531A84075A0295DF4168C175B"><enum>(j)</enum><header>Rule of
construction</header>
<paragraph commented="no" id="HE504BA3862984703B2D4099B1DCBA26C"><enum>(1)</enum><header>No raw data
requirement</header><text>Nothing in this section shall be construed to require
States to provide raw data to the Secretary.</text>
</paragraph><paragraph commented="no" id="H98D5D8EBF72A41A7A23B02405278F98C"><enum>(2)</enum><header>Private or home
schools</header><text>Nothing in this section shall be construed to affect any
private school that does not receive funds or services under this Act or any
home school, whether or not the home school is treated as a home school or a
private school under State law, including imposing new requirements for
students educated through a home school seeking admission to institutions of
higher education.</text>
</paragraph></subsection></section><section commented="no" id="HFE7E43C5E8A9462D8766C20131DEF327"><enum>5622.</enum><header>Local
alignment programs</header>
<subsection commented="no" id="HD26AFF7FEC3C40BA9A17A41AE39FA11F"><enum>(a)</enum><header>Purpose</header><text>It
is the purpose of this section—</text>
<paragraph commented="no" id="HB70F20C5752846FE90CF40EE5F108A38"><enum>(1)</enum><text>to provide a
framework for public discourse amongst key stakeholders in the local
community;</text>
</paragraph><paragraph commented="no" id="H67D2BF184E7D45E08268ACC20496DB72"><enum>(2)</enum><text>to collectively
assess and establish educational goals and expectations for the local
community;</text>
</paragraph><paragraph commented="no" id="H09BE37B501E5461285915E7F5559AC02"><enum>(3)</enum><text>to coordinate
educational strategies amongst key stakeholders in the local community;
and</text>
</paragraph><paragraph commented="no" id="HB12D30F88C474AA9A738B6F3F5AC8635"><enum>(4)</enum><text>to create a
seamless P-16 education continuum that improves the K-12 academic performance
of students, high school graduation rates, workforce and postsecondary
readiness, and college enrollment and persistence (including adequate financial
assistance) in the local community.</text>
</paragraph></subsection><subsection commented="no" id="H6E52632E63E74E118370EE48E9CD709E"><enum>(b)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph commented="no" id="HEC2C2DA89C124E82BB30FD2ABE0905C4"><enum>(1)</enum><header>P-16
education</header><text>The term <quote>P-16 education</quote> means the
educational system from preschool through the conferring of a baccalaureate
degree.</text>
</paragraph><paragraph commented="no" id="HFB3D4EBE68EB4BFC95049E2933A659FB"><enum>(2)</enum><header>Local
partnership</header><text>The term <quote>local partnership</quote> means a
partnership in a city or region that—</text>
<subparagraph commented="no" id="HF54DB544D827485C8C81E49292A62FB8"><enum>(A)</enum><text>shall
include—</text>
<clause commented="no" id="HBABC551F2F3B4ACCBAC501CB52B5A262"><enum>(i)</enum><text>a mayor or a
designee of a mayor;</text>
</clause><clause commented="no" id="HA49D9278C9764C709987BD51404AC35B"><enum>(ii)</enum><text>a superintendent
of a local educational agency;</text>
</clause><clause commented="no" id="HF8ACEAA0B3DC4341A3D8891A5485D3AD"><enum>(iii)</enum><text>not less than 1
representative of a school board;</text>
</clause><clause commented="no" id="H429BE63C328E4B2CB5A1C1965C676319"><enum>(iv)</enum><text>not less than 1
president of a two-year institution of higher education;</text>
</clause><clause commented="no" id="H1EA5E8952F7943A599B1474EA4CD4105"><enum>(v)</enum><text>not less than 1
president of a four-year institution of higher education;</text>
</clause><clause commented="no" id="HF8F133B0AC834DD0B309E9E70AFD2A11"><enum>(vi)</enum><text>not less than 1
representative of a technical school;</text>
</clause><clause commented="no" id="H02CA98646FA444C682DD04A61FBBB61F"><enum>(vii)</enum><text>not less than 1
representative of an early childhood education program;</text>
</clause><clause commented="no" id="HEC689B85EF7C46AFB5F685B95D09C882"><enum>(viii)</enum><text>not less than 1
public elementary school teacher;</text>
</clause><clause commented="no" id="H3C262E9B52F4485885D09890CBB696CB"><enum>(ix)</enum><text>not less than 1
public secondary education school teacher;</text>
</clause><clause commented="no" id="H776D3120075B49BEABF63F3C7924B5AC"><enum>(x)</enum><text>not less than 1
representative from a foundation;</text>
</clause><clause commented="no" id="H0785AF98DFD2417B9DB74C6889AC3EF2"><enum>(xi)</enum><text>not less than 1
representative of the business community; and</text>
</clause><clause commented="no" id="HEECA5441D8614B5B8CB42F39F235E9A1"><enum>(xii)</enum><text>not less than 1
member of the Armed Forces; and</text>
</clause></subparagraph><subparagraph commented="no" id="HCA24D254454E4ACC92E8E02167A28F82"><enum>(B)</enum><text>may include other
individuals or representatives identified by the local partnership as critical
to carrying out the mission and activities of such partnership.</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="HAD1B93E6CC134AE697FDAB85F2B6DCCC"><enum>(c)</enum><header>Subgrants to
local partnerships</header><text display-inline="yes-display-inline">A State
that receives a grant under section 5621, shall use the funds reserved under
section 5621(h) to make subgrants, on a competitive basis, to eligible local
partnerships to enable such partnerships to carry out the activities described
in subsection (e).</text>
</subsection><subsection commented="no" id="HD6AE9839314F404F9ECF80F7DB0992D2"><enum>(d)</enum><header>Applications</header><text>To
be eligible to receive a subgrant under this section, an eligible local
partnership shall submit an application to the State at such time, in such
manner, and containing such information as the State may require.</text>
</subsection><subsection commented="no" id="HA9D43B26F28948FAA9833201AE71F7F8"><enum>(e)</enum><header>Uses of
funds</header><text display-inline="yes-display-inline">An eligible local
partnership that receives a subgrant under this section shall use the subgrant
funds for—</text>
<paragraph commented="no" id="H8830314C37484220994A32D227D137A8"><enum>(1)</enum><text>conducting a
community-wide assessment of local community needs as it pertains to P-16
education;</text>
</paragraph><paragraph commented="no" id="H8E41649B2E9246819DF0007CB8FB702D"><enum>(2)</enum><text>setting
developmental and identifiable P-16 educational milestones for students based
on such assessment;</text>
</paragraph><paragraph commented="no" id="HB59C91022A5F48DFBCF93012B3BAF036"><enum>(3)</enum><text>collecting,
analyzing, and reporting on data that measures such milestones;</text>
</paragraph><paragraph commented="no" id="H22BC02CC3AC04C02A6B22A21FA2D04E2"><enum>(4)</enum><text>identifying
strategies, programs, and projects to improve student outcomes across the local
P-16 education system; and</text>
</paragraph><paragraph commented="no" id="H9B1F7831528442A3ABA313716A2908FF"><enum>(5)</enum><text>organizing efforts
of various stakeholders who provide support services to improving student
outcomes across the local P-16 education system.</text>
</paragraph></subsection><subsection commented="no" id="H52B3CEA6C9FB423284BF4E86051323B9"><enum>(f)</enum><header>Matching
requirement</header><text>Each local partnership that receives a grant under
this section shall provide, from non-Federal sources, an amount equal to 100
percent of the amount of the grant, in cash or in kind, to carry out the
activities supported by the grant.</text>
</subsection><subsection commented="no" id="H71238E76F0D94BBD880A93850AFACDC1"><enum>(g)</enum><header>Special
rule</header><text>Each local partnership that receives a grant must comply
with aligning their standards and data systems to those coordinated by the
State under section
5621.</text>
</subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H8D42580DC6AF49078C4246EF09C68373"><enum>(c)</enum><header>Clerical
amendment</header><text>The table of contents in section 2 of the Elementary
and Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.) is amended by

<subsection id="H564F0C1C0906464DA0EC7E1E4B13F450"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">It is the purpose of this part to provide
incentives to urban universities to enable such universities to expand research
knowledge and develop and implement initiatives in partnership with
community-based organizations and other public or nonprofit private entities to
strengthen the economies of units of general local government for urban areas,
foster innovation and opportunity, and solve urban challenges.</text>
</subsection><subsection id="H25FB7D5249984157B53AB1CDB368B05E"><enum>(b)</enum><header>Program
authorized</header><text>From the amounts appropriated under section 755, the
Secretary shall award grants to urban universities to enable such universities
to carry out the activities described in section 753 in accordance with this
part.</text>
</subsection></section><section id="H6472F50EFC6940BE96001EA818D2777E"><enum>752.</enum><header>Application for
urban university grants</header>
<subsection id="H02BC56FBF2A646759D75EF9ABFED8215"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">An urban university seeking assistance
under this part shall submit to the Secretary an application at such time, in
such manner, and containing such information as the Secretary may reasonably
require.</text>
</subsection><subsection id="HA1D98A75E96C44EF89B345B98D5CC7DF"><enum>(b)</enum><header>Priority in
selection of applications</header><text>The Secretary shall give priority to
urban universities—</text>
<paragraph id="H303BB435AA354A66BCF2E34CA102BEB1"><enum>(1)</enum><text>that propose to
carry out the activities described in section 753 with the support of other
Federal programs, or State or local programs; or</text>
</paragraph><paragraph id="H56781701F2CD4F48BD1065E56D8EBCED"><enum>(2)</enum><text>with a
demonstrated record of working with local partners (as such term is defined by
the Secretary) in the urban area in which such universities are located to
carry out the activities described in section 753.</text>
</paragraph></subsection></section><section id="H7EC34C9FDBE44669A5D1022492EF81FB"><enum>753.</enum><header>Required
activities</header><text display-inline="no-display-inline">An urban university
shall use funds awarded under this part to further develop and apply research
findings to the development, implementation, and ongoing evaluation of—</text>
<paragraph id="HDCFBA9FB693740F2B9743B89F8C96D16"><enum>(1)</enum><text display-inline="yes-display-inline">systemic initiatives carried out by the
university in partnership with elementary and secondary schools and other
educational organizations designed to—</text>
<subparagraph id="HF2800F54A51A49DFA90B8F4C9CE007AE"><enum>(A)</enum><text>improve elementary
and secondary school teacher quality and retention; or</text>
</subparagraph><subparagraph id="HFEADE0D44D6642FB85056C5F2FBE446B"><enum>(B)</enum><text>develop strategies
to improve postsecondary and workplace readiness of elementary and secondary
school students, particularly in fields related to science, technology,
engineering, and mathematics;</text>
</subparagraph></paragraph><paragraph id="H82CD9487B7AC4CA79803FC8874BAB608"><enum>(2)</enum><text display-inline="yes-display-inline">efforts carried out by the university in
partnership with community-based organizations and other public, nonprofit, or
private entities to improve the economic health of the unit of general local
government for the urban area in which the university is located, including
through efforts involving the development of mixed use and retail or commercial
properties, affordable housing, or community facilities; or</text>
</paragraph><paragraph id="HA317F71AF05B44ACA46009663FBA7E59"><enum>(3)</enum><text>public health
outreach, education, and intervention activities designed to reduce health
disparities in the unit of general local government carried out by the
university in partnership with community-based organizations and other public
or nonprofit private entities.</text>
</paragraph></section><section id="H0F16AF0E02C34E399A19814A27291F71"><enum>754.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
<paragraph id="H669FCFA77502406FA55442BF09787EB5"><enum>(1)</enum><header>Unit of general
local government</header><text display-inline="yes-display-inline">The term
<term>unit of general local government</term> means any city, county, town,
township, parish, village, or other general purpose political subdivision of a
State.</text>
</paragraph><paragraph id="H26126EFD9DB74E389F97E76B48D6E8A6"><enum>(2)</enum><header>Urban
area</header><text display-inline="yes-display-inline">The term <quote>urban
area</quote> means a metropolitan statistical area having a population of not
less than 450,000.</text>
</paragraph><paragraph id="H3E22004716FD47D59986525268B8772E"><enum>(3)</enum><header>Urban
university</header><text display-inline="yes-display-inline">The term
<quote>urban university</quote> means an institution of higher education
that—</text>
<subparagraph id="HB26C26E1526540679CCC9421315EB2C0"><enum>(A)</enum><text>has the meaning
given the term <quote>institution of higher education</quote> in section
101;</text>
</subparagraph><subparagraph id="H446884D36CA641E0AB36086DAE8F1831"><enum>(B)</enum><text>is located in an
urban area;</text>
</subparagraph><subparagraph id="HBCAEDEE05BDF4128ABFC77B19C6924F6"><enum>(C)</enum><text>has the capacity
to conduct research applicable to the activities carried out under section 753,
as demonstrated by enrolling, either individually or jointly with another
institution of higher education, at least 10 doctoral students per academic
year in academic disciplines relevant to the activities described in section
753; and</text>
</subparagraph><subparagraph id="H4BEC22FAFD944934A0EC497D46BF0EDC"><enum>(D)</enum><text>draws a
substantial portion of its students from the urban area in which such
institution is
located.</text>
</subparagraph></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
</section></part><enum>III</enum><header>Diversifying the
Health Care Workplace</header>
<section id="H21D6139164A64A73A1F528A7086F24A5"><enum>301.</enum><header>Amendment to
Public Health Service Act</header><text display-inline="no-display-inline">The
Public Health Service Act (42 U.S.C. 201 et seq.) is amended by adding at the
end the following:</text>

<section id="H126FD9B1C0E040ED92EC03F3B536E07B"><enum>3301.</enum><header>Report on
workforce diversity</header>
<subsection id="H09A2A0C32E0D415D8EB8C16734C1D2EC"><enum>(a)</enum><header>In
general</header><text>Not later than July 1, 2011, and biannually thereafter,
the Secretary, acting through the head of each entity within the Department of
Health and Human Services, shall prepare and submit to the Committee on Health,
Education, Labor, and Pensions of the Senate and the Committee on Energy and
Commerce of the House of Representatives a report on health workforce
diversity.</text>
</subsection><subsection id="H310D1E39F412498FAB54A6E75456460F"><enum>(b)</enum><header>Requirement</header><text>The
report under subsection (a) shall contain the following information:</text>
<paragraph id="H4D92D256F23D433E95A7314E9EE9AE25"><enum>(1)</enum><text>A description of
any grant support that is provided by each such entity for workforce diversity
initiatives with the following information—</text>
<subparagraph id="HBCA3F2124CD6475CBA9F02AC3F6D213F"><enum>(A)</enum><text>the number of
grants made;</text>
</subparagraph><subparagraph id="H68BD4AFEC1194DD2809CC97E3CDC7B5E"><enum>(B)</enum><text>the purpose of the
grants;</text>
</subparagraph><subparagraph id="H91B183ED732141009077C576BCF8CC31"><enum>(C)</enum><text>the populations
served through the grants, including specification of urban and rural
populations;</text>
</subparagraph><subparagraph id="H20FEE2132E694F238DAE8E9A69C45173"><enum>(D)</enum><text>the organizations
and institutions receiving the grants, including specification of the number of
Hispanic health professions schools and minority-serving institutions;
and</text>
</subparagraph><subparagraph id="HEE9363AE3514485DB405DC7F2598F29F"><enum>(E)</enum><text>the tracking
efforts that were used to follow the progress of participants.</text>
</subparagraph></paragraph><paragraph id="H21AE7F0652B84C1BA77E6A63F5C87F6C"><enum>(2)</enum><text>A description of
the entity’s plan to achieve workforce diversity goals that includes, to the
extent relevant to such entity—</text>
<subparagraph id="H14402946683442B58EBFE07DDE809B1A"><enum>(A)</enum><text>the number of
underrepresented minority health professionals that will be needed in various
disciplines over the next 10 years to achieve population parity, including
specification to geographic areas and urban and rural areas;</text>
</subparagraph><subparagraph id="HA6506E7889DF434AA9818F1FA182234E"><enum>(B)</enum><text>the level of
funding needed to fully expand and adequately support health professions
pipeline programs;</text>
</subparagraph><subparagraph id="H41D3FD55CF0744968716ECBEF9C57BA7"><enum>(C)</enum><text>the impact such
programs have had on the admissions practices and policies of health
professions schools;</text>
</subparagraph><subparagraph id="H966038F3513D48319B0206023DACEB57"><enum>(D)</enum><text>the management
strategy necessary to effectively administer and institutionalize health
profession pipeline programs, including those targeted at urban and rural
areas;</text>
</subparagraph><subparagraph id="HCC1F6FEE6D9A4D4F94217D45AAA4FF3B"><enum>(E)</enum><text>the impact that
the Government Performance and Results Act (GPRA) has had on evaluating the
performance of grantees and whether the GPRA is the best assessment tool for
programs under titles VII and VIII; and</text>
</subparagraph><subparagraph id="HD16E92EB601F48A78284A63001FC2547"><enum>(F)</enum><text>an examination of
the role and support for minority-serving institutions and Hispanic health
professions schools in training minority health professionals and in increasing
their representation at all levels in the Department of Health and Human
Services.</text>
</subparagraph></paragraph><paragraph id="H4759476C8F5248D08ACB00EBC42E2BB0"><enum>(3)</enum><text>A description of
measurable objectives of the entity relating to workforce diversity
initiatives.</text>
</paragraph></subsection><subsection id="H3E4EC07F321A43E4818CAE383963BBE3"><enum>(c)</enum><header>Public
availability</header><text>The report under subsection (a) shall be made
available for public review and comment.</text>
</subsection></section><section id="H091762018570420698D607B04AC0C08D"><enum>3302.</enum><header>Technical
clearinghouse for health workforce diversity</header>
<subsection id="H70E7A775D8834076B6AA003B5790D4A2"><enum>(a)</enum><header>In
general</header><text>The Secretary, acting through the Office of Minority
Health, and in collaboration with the Bureau of Health Professions within the
Health Resources and Services Administration, shall establish a technical
clearinghouse on health workforce diversity within the Office of Minority
Health and coordinate current and future clearinghouses.</text>
</subsection><subsection id="H86B22B145FD8439EB8FAF034D8198BC3"><enum>(b)</enum><header>Information and
services</header><text>The clearinghouse established under subsection (a) shall
offer the following information and services:</text>
<paragraph id="H0EAE0032014141AAAA2454336CC896DD"><enum>(1)</enum><text>Information on the
importance of health workforce diversity.</text>
</paragraph><paragraph id="H6900E227B89B4224BCA73BCC1429B918"><enum>(2)</enum><text>Statistical
information relating to underrepresented minority representation in health and
allied health professions and occupations, including specification to urban and
rural areas.</text>
</paragraph><paragraph id="HB4AD7CC6446D403AAFE4EEB95787A252"><enum>(3)</enum><text>Model health
workforce diversity practices and programs.</text>
</paragraph><paragraph id="HBF7CA48703854226B8502F049891D38A"><enum>(4)</enum><text>Admissions
policies that promote health workforce diversity and are in compliance with
Federal and State laws.</text>
</paragraph><paragraph id="H240D8C7A007D4E7C89BA9D1713CEE14E"><enum>(5)</enum><text>Lists of
scholarship, loan repayment, and loan cancellation grants as well as fellowship
information for underserved populations for health professions schools.</text>
</paragraph><paragraph id="HD1A721A0484C4D1EB87994467D7E872F"><enum>(6)</enum><text>Foundation and
other large organizational initiatives relating to health workforce
diversity.</text>
</paragraph></subsection><subsection id="HE3C21F02BA7F40B7AD4E49B23021E984"><enum>(c)</enum><header>Consultation</header><text>In
carrying out this section, the Secretary shall consult with non-Federal
entities, which shall include minority health professional associations to help
ensure thoroughness and accuracy of information.</text>
</subsection></section><section id="H34D3373D52AA4BBA8902C197335CA626"><enum>3303.</enum><header>Evaluation of
workforce diversity initiatives</header>
<subsection id="H8FA8DD5D2D654C819079037C278ED1C0"><enum>(a)</enum><header>In
general</header><text>The Secretary, acting through the Bureau of Health
Professions within the Health Resources and Services Administration, shall
award grants to eligible entities for the conduct of an evaluation of current
health workforce diversity initiatives funded by the Department of Health and
Human Services.</text>
</subsection><subsection id="H9CF788FC8C9C41ED8A90C331C5737D4B"><enum>(b)</enum><header>Eligibility</header><text>To
be eligible to receive a grant under subsection (a), an entity shall—</text>
<paragraph id="HB28D67DFC72D42268EB6F8502387B315"><enum>(1)</enum><text>be a city, county,
Indian tribe, State, territory, community-based nonprofit organization, health
center, university, college, or other entity determined appropriate by the
Secretary;</text>
</paragraph><paragraph id="H3103A89D5F8E4776BF831226D9C888F0"><enum>(2)</enum><text>with respect to an
entity that is not an academic medical center, university, or private research
institution, carry out activities under the grant in partnership with an
academic medical center, university, or private research institution;
and</text>
</paragraph><paragraph id="H7DC87248C1A841F39AEBC912BF2993A7"><enum>(3)</enum><text>submit to the
Secretary an application at such time, in such manner, and containing such
information as the Secretary may require.</text>
</paragraph></subsection><subsection id="H753983FB4FD64F5DAF8E19BB6A97FFAC"><enum>(c)</enum><header>Use of
funds</header><text>Amounts awarded under a grant under subsection (a) shall be
used to support the following evaluation activities:</text>
<paragraph id="H18C8348F5EF44FF1A368B2C8A3E560F4"><enum>(1)</enum><text>Determinations of
measures of health workforce diversity success, including placement in urban
and rural settings.</text>
</paragraph><paragraph id="HDEA8118C1E0146DE9134FD0C34821297"><enum>(2)</enum><text>Assessments of the
effects of health workforce diversity on quality, including—</text>
<subparagraph id="HE419FD688C914CECB25FFFB280BDB644"><enum>(A)</enum><text>language
access;</text>
</subparagraph><subparagraph id="HDCD5E7BB7E834B8FAF87C4A7B60EDD8B"><enum>(B)</enum><text>cultural
competence;</text>
</subparagraph><subparagraph id="HF9BC95764C2F4A11A99030AF57282826"><enum>(C)</enum><text>patient
satisfaction;</text>
</subparagraph><subparagraph id="HBC76C8ED6D05410491FA4763FEDD2E51"><enum>(D)</enum><text>timeliness of
care;</text>
</subparagraph><subparagraph id="H4DA19F79CE8A4BA4B0635295E934CAC8"><enum>(E)</enum><text>safety of
care;</text>
</subparagraph><subparagraph id="HAA490D33CBFC40BDB858E0E4EDF681CD"><enum>(F)</enum><text>effectiveness of
care;</text>
</subparagraph><subparagraph id="HFB6C0C1DB663415686C6DE4EB558628C"><enum>(G)</enum><text>efficiency of
care;</text>
</subparagraph><subparagraph id="H26CC79CD8E874007BA5D95150631A824"><enum>(H)</enum><text>patient
outcomes;</text>
</subparagraph><subparagraph id="HC008928525994B80B4BCEE26A5A5CC96"><enum>(I)</enum><text>community
engagement;</text>
</subparagraph><subparagraph id="H53368614A4FA47F1A8A6C9254D39DA3E"><enum>(J)</enum><text>resource
allocation;</text>
</subparagraph><subparagraph id="H57185E38AE1E44C3A5F401BECBDFF995"><enum>(K)</enum><text>organizational
structure; and</text>
</subparagraph><subparagraph id="H90541DDCFFD145569235878D5E48F4C5"><enum>(L)</enum><text>other topics
determined appropriate by the Secretary.</text>
</subparagraph></paragraph><paragraph id="HDBCB4903D57C4952B411D29D3421154F"><enum>(3)</enum><text>The short- and
long-term tracking of participants in health workforce diversity pipeline
programs funded by the Department of Health and Human Services, including those
targeted at urban and rural areas.</text>
</paragraph><paragraph id="H8843A1AF676346329EAF19BA5B72CE2E"><enum>(4)</enum><text>Assessments of
partnerships formed through activities to increase health workforce
diversity.</text>
</paragraph><paragraph id="H16EF5620A7E445F1B15D72A42906F105"><enum>(5)</enum><text>Assessments of
barriers to health workforce diversity.</text>
</paragraph><paragraph id="HB1C595C5AF3748C4801242FBE7392A8D"><enum>(6)</enum><text>Assessments of
policy changes at the Federal, State, and local levels.</text>
</paragraph><paragraph id="H207EBEEBD42B4C2AA701D13CB4F53141"><enum>(7)</enum><text>Assessments of
coordination within and between Federal agencies and other institutions.</text>
</paragraph><paragraph id="HE240F9F3D0E44BC382C98C033AEDD419"><enum>(8)</enum><text>Other activities
determined appropriate by the Secretary.</text>
</paragraph></subsection><subsection id="H44C232BB4C0645E48C966950F9E305AB"><enum>(d)</enum><header>Report</header><text>Not
later than 1 year after the date of enactment of this title, the Bureau of
Health Professions within the Health Resources and Services Administration
shall prepare and make available for public comment a report that summarizes
the findings made by entities under grants under this
section.</text>
