		(H.R. 5566) entitled <quote>An Act to amend title 18, United States Code, to
		prohibit interstate commerce in animal crush videos, and for other
		purposes.</quote>, do pass with the following</text>
		</section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after
	 the enacting clause and insert the
	 following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic">
				<section id="idE142B2B4190C4A8ABF5BAA7F36527BAF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
		<quote><short-title>Animal Crush Video Prohibition Act of
		2010</short-title></quote>.</text>
				</section><section id="id000F9E37D38F4232B5D7E17F0561744A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
					<paragraph id="idCACC1B9D09DF461C824D42D9CD039508"><enum>(1)</enum><text>The
		United States has a long history of prohibiting the interstate sale, marketing,
		advertising, exchange, and distribution of obscene material and speech that is
		integral to criminal conduct.</text>
					</paragraph><paragraph id="idF4C1BA987A2440379DA409FB2A91BB13"><enum>(2)</enum><text>The
		Federal Government and the States have a compelling interest in preventing
		intentional acts of extreme animal cruelty.</text>
					</paragraph><paragraph id="idB909621438A24AAD812D3ACC94524853"><enum>(3)</enum><text>Each
		of the several States and the District of Columbia criminalize intentional acts
		of extreme animal cruelty, such as the intentional crushing, burning, drowning,
		suffocating, or impaling of animals for no socially redeeming purpose.</text>
					</paragraph><paragraph id="id7F66B5B516764BA5B1721F0AE1009ADC"><enum>(4)</enum><text>There are certain
		extreme acts of animal cruelty that appeal to a specific sexual fetish. These
		acts of extreme animal cruelty are videotaped, and the resulting video tapes
		are commonly referred to as <quote>animal crush videos</quote>.</text>
					</paragraph><paragraph id="id0E3D6A6D7BEF498E9A324DEED5BE5731"><enum>(5)</enum><text>The
		Supreme Court of the United States has long held that obscenity is an exception
		to speech protected under the First Amendment to the Constitution of the United
		States.</text>
					</paragraph><paragraph id="idBF06BB4C35ED426280E868FEE5FFDCB3"><enum>(6)</enum><text>In
		the judgment of Congress, many animal crush videos are obscene in the sense
		that the depictions, taken as a whole—</text>
						<subparagraph id="idE4CFCED9808C4DFB891254306B13B128"><enum>(A)</enum><text>appeal to the
		prurient interest in sex;</text>
						</subparagraph><subparagraph id="id2A384A302C734C83B36CCFE476B1061B"><enum>(B)</enum><text>are patently
		offensive; and</text>
						</subparagraph><subparagraph id="id591F7D26207D4C4C87AA677659FE2913"><enum>(C)</enum><text>lack serious
		literary, artistic, political, or scientific value.</text>
						</subparagraph></paragraph><paragraph id="idF71F0631A3FD4947947A44C5AF70909F"><enum>(7)</enum><text>Serious criminal
		acts of extreme animal cruelty are integral to the creation, sale,
		distribution, advertising, marketing, and exchange of animal crush
		videos.</text>
					</paragraph><paragraph id="idD38A6B5D56E24B51B01687DAEAD0675C"><enum>(8)</enum><text>The
		creation, sale, distribution, advertising, marketing, and exchange of animal
		crush videos is intrinsically related and integral to creating an incentive
		for, directly causing, and perpetuating demand for the serious acts of extreme
		animal cruelty the videos depict. The primary reason for those criminal acts is
		the creation, sale, distribution, advertising, marketing, and exchange of the
		animal crush video image.</text>
					</paragraph><paragraph id="id74FE308738B34A9A8535C5631961214A"><enum>(9)</enum><text>The
		serious acts of extreme animal cruelty necessary to make animal crush videos
		are committed in a clandestine manner that—</text>
						<subparagraph id="idF09F3AA264DD474BBEBA71C651EF9AEF"><enum>(A)</enum><text>allows the
		perpetrators of such crimes to remain anonymous;</text>
						</subparagraph><subparagraph id="id252E0670A3F947F2A59764B14420818C"><enum>(B)</enum><text>makes it
		extraordinarily difficult to establish the jurisdiction within which the
		underlying criminal acts of extreme animal cruelty occurred; and</text>
						</subparagraph><subparagraph id="idDA1820DCF30040AA9A21C8E88E5D75A3"><enum>(C)</enum><text>often precludes
		proof that the criminal acts occurred within the statute of limitations.</text>
						</subparagraph></paragraph><paragraph id="id459841EB396F4C0EB16AC5FF305022EC"><enum>(10)</enum><text>Each of the
		difficulties described in paragraph (9) seriously frustrates and impedes the
		ability of State authorities to enforce the criminal statutes prohibiting such
		behavior.</text>
					</paragraph></section><section id="idFA53BBDB21CF4001A6468697FEA0F32E"><enum>3.</enum><header>Animal crush
		videos</header>
					<subsection id="idB94F413ECBA340439FBBFF9E7E8E216E"><enum>(a)</enum><header>In
		general</header><text>Section 48 of title 18, United States Code, is amended to
		read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idFC5ACB1196ED43A78D2DC0EFED5B0BCD" style="USC">
							<section id="id4D82920D277E4F06A687468851525FF1"><enum>48.</enum><header>Animal crush
		  videos</header>
								<subsection id="id38C113DF9B544465A8A9387BAD53F2B2"><enum>(a)</enum><header>Definition</header><text>In
		  this section the term <quote>animal crush video</quote> means any photograph,
		  motion-picture film, video or digital recording, or electronic image
		  that—</text>
									<paragraph id="idF2D9B5F146BE4E598FCF175F427B9731"><enum>(1)</enum><text>depicts actual
		  conduct in which 1 or more living non-human mammals, birds, reptiles, or
		  amphibians is intentionally crushed, burned, drowned, suffocated, impaled, or
		  otherwise subjected to serious bodily injury (as defined in section 1365 and
		  including conduct that, if committed against a person and in the special
		  maritime and territorial jurisdiction of the United States, would violate
		  section 2241 or 2242); and</text>
									</paragraph><paragraph id="id4301B2E25DD54E73B8C91C27AD91F1CB"><enum>(2)</enum><text>is
		  obscene.</text>
									</paragraph></subsection><subsection id="id78FF617730214A2384E5EC2468BDBA38"><enum>(b)</enum><header>Prohibitions</header>
									<paragraph id="id6418D0979F314A60842C974598AC7285"><enum>(1)</enum><header>Creation of
		  animal crush videos</header><text>It shall be unlawful for any person to
		  knowingly create an animal crush video, or to attempt or conspire to do so,
		  if—</text>
										<subparagraph id="idE9BDC1335F144A56827CCCD33C067DD7"><enum>(A)</enum><text>the person
		  intends or has reason to know that the animal crush video will be distributed
		  in, or using a means or facility of, interstate or foreign commerce; or</text>
										</subparagraph><subparagraph id="id0B715D4282FC41BE94F8E55991665CDF"><enum>(B)</enum><text>the animal crush
		  video is distributed in, or using a means or facility of, interstate or foreign
		  commerce.</text>
										</subparagraph></paragraph><paragraph id="id43E5EFAEC2F143BBA47770721B42F432"><enum>(2)</enum><header>Distribution of
		  animal crush videos</header><text>It shall be unlawful for any person to
		  knowingly sell, market, advertise, exchange, or distribute an animal crush
		  video in, or using a means or facility of, interstate or foreign commerce, or
		  to attempt or conspire to do so.</text>
									</paragraph></subsection><subsection id="id190D245DED95457CB1A164F1EC499752"><enum>(c)</enum><header>Extraterritorial
		  application</header><text>Subsection (b) shall apply to the knowing sale,
		  marketing, advertising, exchange, distribution, or creation of an animal crush
		  video outside of the United States, or any attempt or conspiracy to do so,
		  if—</text>
									<paragraph id="id80C1F38C89B84775B6497E5E11AED8A3"><enum>(1)</enum><text>the person
		  engaging in such conduct intends or has reason to know that the animal crush
		  video will be transported into the United States or its territories or
		  possessions; or</text>
									</paragraph><paragraph id="idEFC75DA7221E4D418148DB3C427DF68A"><enum>(2)</enum><text>the animal crush
		  video is transported into the United States or its territories or
		  possessions.”</text>
									</paragraph></subsection><subsection id="idEAC2CD568D0147F9A4105C38A9726F49"><enum>(d)</enum><header>Penalty</header><text>Any
		  person who violates subsection (b) shall be fined under this title, imprisoned
		  for not more than 7 years, or both.</text>
								</subsection><subsection id="idE92E873BC38F4F78BBE2F7FB6F87DF04"><enum>(e)</enum><header>Exceptions</header>
									<paragraph id="id86576EECBE444FBB9E0729588E1B6D52"><enum>(1)</enum><header>In
		  general</header><text>This section shall not apply with regard to any visual
		  depiction of—</text>
										<subparagraph id="idCEA775921B254FB0AE431AA91AF55657"><enum>(A)</enum><text>customary and
		  normal veterinary or agricultural husbandry practices;</text>
										</subparagraph><subparagraph id="id239418E5427742C1BD67448B2A56C1FE"><enum>(B)</enum><text>the slaughter of
		  animals for food; or</text>
										</subparagraph><subparagraph id="idBA436CB33C4845DB8920817F7D5EB94F"><enum>(C)</enum><text>hunting,
		  trapping, or fishing.</text>
										</subparagraph></paragraph><paragraph id="id5CAEB66A220F4C5AB2EC784693AE700E"><enum>(2)</enum><header>Good-faith
		  distribution</header><text>This section shall not apply to the good-faith
		  distribution of an animal crush video to—</text>
										<subparagraph id="idB82F538E0E024304B6EFCFA4E531F12D"><enum>(A)</enum><text>a law enforcement
		  agency; or</text>
										</subparagraph><subparagraph id="idFDC7082952694B5F9F27CFA6841BEA92"><enum>(B)</enum><text>a third party for
		  the sole purpose of analysis to determine if referral to a law enforcement
		  agency is appropriate.</text>
										</subparagraph></paragraph></subsection><subsection id="idA8FAA4D65FE343C19E575ECC5DD2B28B"><enum>(f)</enum><header>No
		  preemption</header><text>Nothing in this section shall be construed to preempt
		  the law of any State or local subdivision thereof to protect
		  animals.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="id3460E606253C4856A72A3636C555E5E0"><enum>(b)</enum><header>Clerical
		amendment</header><text>The item relating to section 48 in the table of
		sections for chapter 3 of title 18, United States Code, is amended to read as
		follows:</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="id872659162F7F48498EA27AA7AD056CB5"><enum>(c)</enum><header>Severability</header><text>If
		any provision of section 48 of title 18, United States Code (as amended by this
		section), or the application of the provision to any person or circumstance, is
		held to be unconstitutional, the provision and the application of the provision
		to other persons or circumstances shall not be affected thereby.</text>
