		(H.R. 553) entitled <quote>An Act to require the Secretary of Homeland Security
		to develop a strategy to prevent the over-classification of homeland security
		and other information and to promote the sharing of unclassified homeland
		security and other information, and for other purposes.</quote>, do pass with
		the following</text>
		</section><amendment><amendment-instruction blank-lines-after="0"><text>In lieu of the
	 matter proposed to be inserted, insert the
	 following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic">
				<section id="ID20612bdc9d5f4828b0d64eebbae218ec" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
		<quote><short-title>Reducing Over-Classification
		Act</short-title></quote>.</text>
				</section><section id="IDf53b525110f1420bab9a6976a839454d"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
					<paragraph id="ID4896b6ae3025440cab98a0cba57c3912"><enum>(1)</enum><text>The
		National Commission on Terrorist Attacks Upon the United States (commonly known
		as the <quote>9/11 Commission</quote>) concluded that security requirements
		nurture over-classification and excessive compartmentation of information among
		agencies.</text>
					</paragraph><paragraph id="ID9f6ec910eaf94469b517cf87fce05cb3"><enum>(2)</enum><text>The
		9/11 Commission and others have observed that the over-classification of
		information interferes with accurate, actionable, and timely information
		sharing, increases the cost of information security, and needlessly limits
		stakeholder and public access to information.</text>
					</paragraph><paragraph id="ID9bfb1128a61148d4b69956a62038d967"><enum>(3)</enum><text>Over-classification
		of information causes considerable confusion regarding what information may be
		shared with whom, and negatively affects the dissemination of information
		within the Federal Government and with State, local, and tribal entities, and
		with the private sector.</text>
					</paragraph><paragraph id="IDabd8e78148ea48e4959ac71b32a74bd5"><enum>(4)</enum><text>Over-classification
		of information is antithetical to the creation and operation of the information
		sharing environment established under section 1016 of the Intelligence Reform
		and Terrorism Prevention Act of 2004 (6 U.S.C. 485).</text>
					</paragraph><paragraph id="ID17e2c2cbf1154308998c257681a80403"><enum>(5)</enum><text>Federal
		departments or agencies authorized to make original classification decisions or
		that perform derivative classification of information are responsible for
		developing, implementing, and administering policies, procedures, and programs
		that promote compliance with applicable laws, executive orders, and other
		authorities pertaining to the proper use of classification markings and the
		policies of the National Archives and Records Administration.</text>
					</paragraph></section><section id="ID3dbd86c248f146e5aaf3f80e53aee68a"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
					<paragraph id="id5C4FC12083404290A70359E60BE41600"><enum>(1)</enum><header>Derivative
		classification and original classification</header><text>The terms
		<term>derivative classification</term> and <term>original classification</term>
		have the meanings given those terms in Executive Order No. 13526.</text>
					</paragraph><paragraph id="idC3EB329BE4114EA6A8CD22A85942F2B0"><enum>(2)</enum><header>Executive
		agency</header><text>The term <quote>Executive agency</quote> has the meaning
		given that term in section 105 of title 5, United States Code.</text>
					</paragraph><paragraph id="id8F90A61FA1A742E982EC56CC908E6F6E"><enum>(3)</enum><header>Executive Order
		No. 13526</header><text>The term <quote>Executive Order No. 13526</quote> means
		Executive Order No. 13526 (75 Fed. Reg. 707; relating to classified national
		security information) or any subsequent corresponding executive order.</text>
					</paragraph></section><section id="id64C1AAAE19F54D20B6E359C67F48F172"><enum>4.</enum><header>Classified
		Information Advisory Officer</header>
					<subsection id="IDe42eda47652849028aca2e015d2db540"><enum>(a)</enum><header>In
		general</header><text>Subtitle A of title II of the Homeland Security Act of
		2002 (6 U.S.C. 121 et seq.) is amended by adding at the end the
		following:</text>
						<quoted-block display-inline="no-display-inline" id="id3EAD81AB78E64E46B14903AC22FE22BB" style="OLC">
							<section id="ID342cc8d425254449abe7c4434c31db81"><enum>210F.</enum><header>Classified
		  Information Advisory Officer</header>
								<subsection id="ID007f3f3bd28045a288d1b56dd8cd6a63"><enum>(a)</enum><header>Requirement To
		  establish</header><text>The Secretary shall identify and designate within the
		  Department a Classified Information Advisory Officer, as described in this
		  section.</text>
								</subsection><subsection id="ID20a4cf591f654977bf64622331aff412"><enum>(b)</enum><header>Responsibilities</header><text>The
		  responsibilities of the Classified Information Advisory Officer shall be as
		  follows:</text>
									<paragraph id="ID925b590c5fe0405bac5e669b9ebf3fe9"><enum>(1)</enum><text>To
		  develop and disseminate educational materials and to develop and administer
		  training programs to assist State, local, and tribal governments (including
		  State, local, and tribal law enforcement agencies) and private sector
		  entities—</text>
										<subparagraph id="ID7cddb24100aa4dcfbcb225db0cc7e0ea"><enum>(A)</enum><text>in developing
		  plans and policies to respond to requests related to classified information
		  without communicating such information to individuals who lack appropriate
		  security clearances;</text>
										</subparagraph><subparagraph id="ID53ba4f60111c4e2aa1a8b68c8359fc56"><enum>(B)</enum><text>regarding the
		  appropriate procedures for challenging classification designations of
		  information received by personnel of such entities; and</text>
										</subparagraph><subparagraph id="IDc38d423043d4425ea30e94b308f6652d"><enum>(C)</enum><text>on the means by
		  which such personnel may apply for security clearances.</text>
										</subparagraph></paragraph><paragraph id="IDa802ea7dada74f8ebd294cfa6e3491d8"><enum>(2)</enum><text>To
		  inform the Under Secretary for Intelligence and Analysis on policies and
		  procedures that could facilitate the sharing of classified information with
		  such personnel, as appropriate.</text>
									</paragraph></subsection><subsection id="id2F0F19AF66F74EF995D273BF62C47E3A"><enum>(c)</enum><header>Initial
		  designation</header><text>Not later than 90 days after the date of the
		  enactment of the <short-title>Reducing Over-Classification Act,</short-title>
		  the Secretary shall—</text>
									<paragraph id="id38B2181A210846F3AF8CEF7076B1A725"><enum>(1)</enum><text>designate the
		  initial Classified Information Advisory Officer; and</text>
									</paragraph><paragraph id="id9C09B0F7D9CA467D928C5A379058129C"><enum>(2)</enum><text>submit to the
		  Committee on Homeland Security and Governmental Affairs of the Senate and the
		  Committee on Homeland Security of the House of Representatives a written
		  notification of the
		  designation.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID34f3d10fc7f649ac81ac97cb49803116"><enum>(b)</enum><header>Clerical
		amendment</header><text>The table of contents in section 1(b) of the Homeland
		Security Act of 2002 (6 U.S.C. 101 et seq.) is amended by inserting after the
		item relating to section 210E the following:</text>

					</subsection></section><section id="ID74d2ed0bf5944a69b5f1266fc0d12e98"><enum>5.</enum><header>Intelligence
		information sharing</header>
					<subsection id="IDaab610ba9e6d4ccd82ec7c45b219f986"><enum>(a)</enum><header>Development of
		guidance for intelligence products</header><text>Paragraph (1) of section
		102A(g) of the National Security Act of 1947 (50 U.S.C. 403–1(g)) is
		amended—</text>
						<paragraph id="ID2bb5bd2211ab4c1b811e0df1c09e5ae9"><enum>(1)</enum><text>in
		subparagraph (E), by striking <quote>and</quote> at the end;</text>
						</paragraph><paragraph id="ID4c20aff4b1ce42c4bb36ac39f37c5f98"><enum>(2)</enum><text>in
		subparagraph (F), by striking the period at the end and inserting a semicolon
		and <quote>and</quote>; and</text>
						</paragraph><paragraph id="ID1ad91f8083a749b3a7fb203251a3f7be"><enum>(3)</enum><text>by
		adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idEA52AD73B38240B5AAEEAFAACD2763A5" style="OLC">
								<subparagraph id="ID39f7bd1615974c0db71e57f05b20c747"><enum>(G)</enum><text>in accordance
		  with Executive Order No. 13526 (75 Fed. Reg. 707; relating to classified
		  national security information) (or any subsequent corresponding executive
		  order), and part 2001 of title 32, Code of Federal Regulations (or any
		  subsequent corresponding regulation), establish—</text>
									<clause id="ID543bde78dc864ccb84e9ebfb304ceb64"><enum>(i)</enum><text>guidance to
		  standardize, in appropriate cases, the formats for classified and unclassified
		  intelligence products created by elements of the intelligence community for
		  purposes of promoting the sharing of intelligence products; and</text>
									</clause><clause id="ID5224ab68f8fc4a3e87457a104bea4459"><enum>(ii)</enum><text>policies and
		  procedures requiring the increased use, in appropriate cases, and including
		  portion markings, of the classification of portions of information within one
		  intelligence
		  product.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="ID5d9d72efe85341d7aa087db5ea0a5a02"><enum>(b)</enum><header>Creation of
		unclassified intelligence products as appropriate for State, local, tribal, and
		private sector stakeholders</header>
						<paragraph id="ID1ea805e2382547fead42f0b7101207f5"><enum>(1)</enum><header>Responsibilities
		of Secretary relating to intelligence and analysis and infrastructure
		protection</header><text>Paragraph (3) of section 201(d) of the Homeland
		Security Act of 2002 (6 U.S.C. 121(d)) is amended to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="id5EF670F58AAD4FA888620716470CB5D8" style="OLC">
								<paragraph id="ID544a19d39201450b88d956b542d27441"><enum>(3)</enum><text>To
		  integrate relevant information, analysis, and vulnerability assessments
		  (regardless of whether such information, analysis or assessments are provided
		  by or produced by the Department) in order to—</text>
									<subparagraph id="ID5bd287ae4d3e4277b4ddfceac27a0d8f"><enum>(A)</enum><text>identify
		  priorities for protective and support measures regarding terrorist and other
		  threats to homeland security by the Department, other agencies of the Federal
		  Government, State, and local government agencies and authorities, the private
		  sector, and other entities; and</text>
									</subparagraph><subparagraph id="ID9a5d3f90bb8c4e08a1e70865ad550c12"><enum>(B)</enum><text>prepare finished
		  intelligence and information products in both classified and unclassified
		  formats, as appropriate, whenever reasonably expected to be of benefit to a
		  State, local, or tribal government (including a State, local, or tribal law
		  enforcement agency) or a private sector
		  entity.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="IDa7e545e45ec442429c01f515b78758db"><enum>(2)</enum><header>ITACG
		Detail</header><text>Section 210D(d) of the Homeland Security Act of 2002 (6
		U.S.C. 124k(d)) is amended—</text>
							<subparagraph id="ID75da3ce870ef43f4a0453717fa3253a1"><enum>(A)</enum><text>in paragraph
		(5)—</text>
								<clause id="id71DD2C06669D45A4921B7FD133C6FE34"><enum>(i)</enum><text>in
		subparagraph (D), by striking <quote>and</quote> at the end;</text>
								</clause><clause id="IDa184fda481fa4766ab48b9ac357c9287"><enum>(ii)</enum><text>by
		redesignating subparagraph (E) as subparagraph (F); and</text>
								</clause><clause id="ID9413ebee235e4a16b39ef30064e21440"><enum>(iii)</enum><text>by
		inserting after subparagraph (D) the following:</text>
									<quoted-block display-inline="no-display-inline" id="id4C1C379A9099473CB3158066AE968366" style="OLC">
										<subparagraph id="ID63ad53bb8ebf49a9b9294ccace22fe0b"><enum>(E)</enum><text>make
		  recommendations, as appropriate, to the Secretary or the Secretary’s designee,
		  for the further dissemination of intelligence products that could likely inform
		  or improve the security of a State, local, or tribal government, (including a
		  State, local, or tribal law enforcement agency) or a private sector entity;
		  and</text>
										</subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
								</clause></subparagraph><subparagraph id="ID78bbf1a769d94b1da54b96dbd86693a3"><enum>(B)</enum><text>in paragraph
		(6)(C), by striking <quote>and</quote> at the end;</text>
							</subparagraph><subparagraph id="id4A250E30CBAC403C9AA377B8D2A2153D"><enum>(C)</enum><text>in paragraph (7),
		by striking the period at the end and inserting a semicolon and
		<quote>and</quote>; and</text>
							</subparagraph><subparagraph id="idC5415F1A980142B1B007CE322D0C582D"><enum>(D)</enum><text>by adding at the
		end the following:</text>
								<quoted-block display-inline="no-display-inline" id="id9664BB03E67D42EC9DD80DBCF0B36D7D" style="OLC">
									<paragraph id="IDdd6790ce11c54ac0b84d97e6759beafa"><enum>(8)</enum><text>compile an annual
		  assessment of the ITACG Detail’s performance, including summaries of customer
		  feedback, in preparing, disseminating, and requesting the dissemination of
		  intelligence products intended for State, local and tribal government
		  (including State, local, and tribal law enforcement agencies) and private
		  sector entities; and</text>
									</paragraph><paragraph id="IDa04a3c6265bf4812bd4f47dc74834d7f"><enum>(9)</enum><text>provide the
		  assessment developed pursuant to paragraph (8) to the program manager for use
		  in the annual reports required by subsection
		  (c)(2).</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="IDefd9b3e3adec4edcb3e601708fc726f8"><enum>(c)</enum><header>Interagency
		threat assessment and coordination group annual report
		modification</header><text>Subsection (c) of section 210D of the Homeland
		Security Act of 2002 (6 U.S.C. 124k) is amended—</text>
						<paragraph id="ID3fe58f59f04c43329485ff2a04d495b1"><enum>(1)</enum><text>in
		the matter preceding paragraph (1), by striking <quote>, in consultation with
		the Information Sharing Council,</quote>;</text>
						</paragraph><paragraph id="ID1e97e3056dcd43d3a25469501c3640b3"><enum>(2)</enum><text>in
		paragraph (1), by striking <quote>and</quote> at the end;</text>
						</paragraph><paragraph id="IDc735d4e2364144cbb9286f91d2db0bd6"><enum>(3)</enum><text>in
		paragraph (2), by striking the period at the end and inserting a semicolon and
		<quote>and</quote>; and</text>
						</paragraph><paragraph id="IDd9626c855bdd44ff8af91b970fc51bcf"><enum>(4)</enum><text>by
		adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id96DB631FD93F434CA1E10C4E8610112C" style="OLC">
								<paragraph id="ID51db2875e30d400380fadad69d9e11d5"><enum>(3)</enum><text>in
		  each report required by paragraph (2) submitted after the date of the enactment
		  of the Reducing Over-Classification Act, include an assessment of whether the
		  detailees under subsection (d)(5) have appropriate access to all relevant
		  information, as required by subsection
		  (g)(2)(C).</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="ID516cdbd99808477397894165a9bf2565"><enum>6.</enum><header>Promotion of
		accurate classification of information</header>
					<subsection id="ID0979a5409b304982936f7743c1d7ea44"><enum>(a)</enum><header>Incentives for
		accurate classifications</header><text>In making cash awards under chapter 45
		of title 5, United States Code, the President or the head of an Executive
		agency with an officer or employee who is authorized to make original
		classification decisions or derivative classification decisions may consider
		such officer’s or employee’s consistent and proper classification of
		information.</text>
					</subsection><subsection id="ID002822a384854e68970b7f19264e1f00"><enum>(b)</enum><header>Inspector
		general evaluations</header>
						<paragraph id="IDeddea7b78c564be394244837c9c63d3b"><enum>(1)</enum><header>Requirement for
		evaluations</header><text>Not later than September 30, 2016, the inspector
		general of each department or agency of the United States with an officer or
		employee who is authorized to make original classifications, in consultation
		with the Information Security Oversight Office, shall carry out no less than
		two evaluations of that department or agency or a component of the department
		or agency—</text>
							<subparagraph id="ID94f0ef58db1c40ed91b07412542887f7"><enum>(A)</enum><text>to assess whether
		applicable classification policies, procedures, rules, and regulations have
		been adopted, followed, and effectively administered within such department,
		agency, or component; and</text>
							</subparagraph><subparagraph id="ID1dc2d2222b804a5389072cef12c6a320"><enum>(B)</enum><text>to identify
		policies, procedures, rules, regulations, or management practices that may be
		contributing to persistent misclassification of material within such
		department, agency or component.</text>
							</subparagraph></paragraph><paragraph id="ID43673dde2e0140419a9df9b35d2c480a"><enum>(2)</enum><header>Deadlines for
		evaluations</header>
							<subparagraph id="ID735a5916658c44e2b6168b7006b3b8ae"><enum>(A)</enum><header>Initial
		evaluations</header><text>Each first evaluation required by paragraph (1) shall
		be completed no later than September 30, 2013.</text>
							</subparagraph><subparagraph id="ID5f8d5ec5e18b469d9e9e5b8cbfee0a09"><enum>(B)</enum><header>Second
		evaluations</header><text>Each second evaluation required by paragraph (1)
		shall review progress made pursuant to the results of the first evaluation and
		shall be completed no later than September 30, 2016.</text>
							</subparagraph></paragraph><paragraph id="ID315f26f2ad93479caabfd94edf679335"><enum>(3)</enum><header>Reports</header>
							<subparagraph id="IDf40c0b34b7b24255a12989da6d4c5090"><enum>(A)</enum><header>Requirement</header><text>Each
		inspector general who is required to carry out an evaluation under paragraph
		(1) shall submit to the appropriate entities a report on each such
		evaluation.</text>
							</subparagraph><subparagraph id="IDa882372bfbe04a1bab1621a6d4a571d6"><enum>(B)</enum><header>Content</header><text>Each
		report submitted under subparagraph (A) shall include a description of—</text>
								<clause id="ID7e0aa1f35fd84107af373915f44f65ae"><enum>(i)</enum><text>the
		policies, procedures, rules, regulations, or management practices, if any,
		identified by the inspector general under paragraph (1)(B); and</text>
								</clause><clause id="IDd864cee824cd416e81d2a5444194232f"><enum>(ii)</enum><text>the
		recommendations, if any, of the inspector general to address any such
		identified policies, procedures, rules, regulations, or management
		practices.</text>
								</clause></subparagraph><subparagraph id="ID51d9966ee9034cb093bc53c1f509418f"><enum>(C)</enum><header>Coordination</header><text>The
		inspectors general who are required to carry out evaluations under paragraph
		(1) shall coordinate with each other and with the Information Security
		Oversight Office to ensure that evaluations follow a consistent methodology, as
		appropriate, that allows for cross-agency comparisons.</text>
							</subparagraph></paragraph><paragraph id="ID5e25afb9cad9495d9471cce6424daee8"><enum>(4)</enum><header>Appropriate
		entities defined</header><text>In this subsection, the term <term>appropriate
		entities</term> means—</text>
							<subparagraph id="IDfa5d2fda5ba74c39ab4d29548f55c923"><enum>(A)</enum><text>the Committee on
		Homeland Security and Governmental Affairs and the Select Committee on
		Intelligence of the Senate;</text>
							</subparagraph><subparagraph id="ID00f357e32f3f4541bbfed89b19b2793b"><enum>(B)</enum><text>the Committee on
		Homeland Security, the Committee on Oversight and Government Reform, and the
		Permanent Select Committee on Intelligence of the House of
		Representatives;</text>
							</subparagraph><subparagraph id="ID122ba9e8e49a4e73be21253718c82f3b"><enum>(C)</enum><text>any other
		committee of Congress with jurisdiction over a department or agency referred to
		in paragraph (1);</text>
							</subparagraph><subparagraph id="IDa5abbb04a1b94f948d5f1d3c2acce607"><enum>(D)</enum><text>the head of a
		department or agency referred to in paragraph (1); and</text>
							</subparagraph><subparagraph id="ID769ad3d3894e49c1b2c4c46dfaf1ed60"><enum>(E)</enum><text>the Director of
		the Information Security Oversight Office.</text>
							</subparagraph></paragraph></subsection></section><section id="IDb7417808b3744b66ad9c642273f74a81"><enum>7.</enum><header>Classification
		training program</header>
					<subsection id="IDd36c8a6339f5453ab85c0d7e3346e6e4"><enum>(a)</enum><header>In
		general</header><text>The head of each Executive agency, in accordance with
		Executive Order 13526, shall require annual training for each employee who has
		original classification authority. For employees who perform derivative
		classification, or are responsible for analysis, dissemination, preparation,
		production, receipt, publication, or otherwise communication of classified
		information, training shall be provided at least every two years. Such training
		shall—</text>
						<paragraph id="IDcdaff543dc2d4dda97237c76fe504128"><enum>(1)</enum><text>educate the
		employee, as appropriate, regarding—</text>
							<subparagraph id="IDdf7c6db4040e4e4a9c4543e2e382c4fc"><enum>(A)</enum><text>the guidance
		established under subparagraph (G) of section 102A(g)(1) of the National
		Security Act of 1947 (50 U.S.C. 403–1(g)(1)), as added by section 5(a)(3),
		regarding the formatting of finished intelligence products;</text>
							</subparagraph><subparagraph id="ID88eb29a867c5414788953f2ec7ef1b3e"><enum>(B)</enum><text>the proper use of
		classification markings, including portion markings that indicate the
		classification of portions of information; and</text>
							</subparagraph><subparagraph id="ID3290a3bc21fa4c529209d73fb13e5e9b"><enum>(C)</enum><text>any incentives
		and penalties related to the proper classification of intelligence information;
		and</text>
							</subparagraph></paragraph><paragraph id="ID7cbd0fea601341d19bb6996ed332c993"><enum>(2)</enum><text>ensure such
		training is a prerequisite, once completed successfully, as evidenced by an
		appropriate certificate or other record, for—</text>
							<subparagraph id="ID67d6d8efc37045cda69f07b85a26bdd4"><enum>(A)</enum><text>obtaining
		original classification authority or derivatively classifying information;
		and</text>
							</subparagraph><subparagraph id="ID0399b49d33eb4bcfa5b01797f63ada17"><enum>(B)</enum><text>maintaining such
		authority.</text>
							</subparagraph></paragraph></subsection><subsection id="ID71902209e37844a284295b4a2507466a"><enum>(b)</enum><header>Relationship to
		other programs</header><text>The head of each Executive agency shall ensure
		that the training required by subsection (a) is conducted efficiently and in
